MEMORANDUM SALING PENGERTIAN ANT ARA KEMENTERIAN PEMUDA DAN OLAHRAGA REPUBLIK INDONESIA DAN KEMENTERIAN OLAHRAGA DAN PEMUDA REPUBLIK ISLAM IRAN TENT ANG KERJASAMA BIDANG PEMUDA DAN OLAHRAGA
Kementerian Pemuda dan Olahraga Republik Indonesia Dan Kemente:rian Olahraga dan Pemuda Republik Islam Iran, selanjutnya disebut sebagai "Para Pihak"; MEMPERTIMBANGKAN minat untuk mempererat hubungan persahabatan dan meningkatkan sal ing pengertian di antara kedua negara; BERKEINGINAN untuk mendorong dan meningkatkan hubungan kerjasama bilateral di bidang pemuda dan olahraga; MERUJUK kepada Persetujuan Kebudayaan antara Republik Indonesia dan ·1ran, ditandatangan i di Tehran pada tanggal 24 April 1971 (41h , Ordibehsht, 1350); TELAH menyepakati sebagai berikut:
PASAL1 TUJUAN KERJASAMA Memorandum Saling Pengertian ini bertujuan untuk meningkatkan pengembangan Sumber Daya Manusia di bidang pemuda dan olahraga antara Para Pihak atas
dasar timbal balik, saling pengertian dan saling menguntungkan sesuai dengan peraturan perundangan-undangan yang berlaku di masing-masing negara.
PASAL2 BIDANG-BIDANG KERJA SAMA
Para pihak sepakat untuk bekerja sama di bidang sebagai berikut: (1) Bidang Pemuda a. Pertukaran kunjungan oleh para pejabat pemerintah yang menangani pembuatan kebijakan pemuda. b. Mengkoordinir masalah-masalah sehubungan dengan kegiatan-kegiatan organisasi kepemudaan lnternasional. c. Bekerja sama mengembangkan gerakan-gerakan pemuda seperti pusatpusat pemuda, kamp-kamp pemuda, kreativitas dan inovasi pemuda, kewirausahaan pemuda, aktivitas-aktivitas kamp kerja relawan serta pertukaran delegasi pemuda kedua negara. d. Memfasilitasi pertukaran informasi, pelatihan, pengalaman ilmiah dan budaya. e. Pertukaran delegasi untuk berpartisipasi dalam kamp-kamp, festivalfestiva l, event-event dan kunjungan-kunjungan persahabatan di bidang kepemudaan . f. Mendorong partisipasi para ahli, dokter, spesialis dan organisasiorganisasi kepemudaan kedua negara dalam seminar-seminar ilmiah dan konferensi-konferensi.
(2) Bidang Olahraga a. Pertukaran
kunjungan oleh pejabat pemerintah yang
menangani
pembuatan kebijakan olahraga. b. Menciptakan kerja sama dan komunikasi antara organisasi-organisasi olahraga kedua negara untuk menyelenggarakan kegaitan-kegiatan seminar, aktifitas penelitian, pertukaran informasi dan pengalaman di bidang olahraga.
c. Memfasilitasi kerja sama antar lembaga/organisasi mengenai pertukaran para atlit, pelatih, wasit, pakar olahraga dan tenaga olahraga lainnya. d. Kerja sama dan pertukaran pengalaman tekhnik berkenaan dengan pembangunan infrastruktur dan fasilitas olahraga. e. Mempromosikan dan mengembangkan olahraga tradisional kedua negara.
(3) Kegiatan-kegiatan kerjasama lainnya yang disepakati oleh para pihak.
PASAL3 PELAKSANAAN
Dalam rangka merealisasikan pelaksanaan Memorandum Saling Pengertian ini dengan berhasil, maka Para Pihak dapat membentuk kelompok kerja untuk menyiapkan suatu pengaturan khusus atau rencana kerja yang akan akan disepakati secara bersama. Pengaturan atau rencana kerja tersebut perlu merinci antara lain, program-program dan kegiatan-kegiatan, pengaturan keuangan, hak kekayaan intelektual sebagaimana dianggap perlu dan rincian lainnya yang berkaitan dengan usaha-usaha khusus dari semua peserta yang terkait.
PASAL4 KONDISI KEUANGAN
Masing-masing pihak akan menanggung biaya untuk membiayai kegiatannya untuk melaksanakan Memorandum Saling Pengertian ini dengan sumber-sumber yang telah dialokasikan dan dalam anggarannya, dengan memperhitungkan ketersediaan
dana,
taksiran
anggaran-anggaran
dan
ketentuan-ketentuan
perundangan nasional. Hal-hal lainnya yang terkait juga dapat diatur melalui kesepakatan bersama .

PASALS KEADAAN DAR URAT
Jika
salah
satu
pihak
tidak
dapat melaksanakan
komitmennya
menurut
Memorandum Saling Pengertian ini dikarenakan keadaan-keadaan darurat, maka pihak tersebut akan memberitahukan kondisi tersebut secara tertulis kepada pihak yang lain. Situasi tersebut tidak dapat dianggap sebagai pelanggaran ketentuan Memorandum Saling Pengertian ini.
PASAL6 KERAHASIAAN
(1) Masing-masing
pihak
akan
berupaya
memperhatikan
kerahasiaan
dan
pcrahasiaan dokumen, informasi dan data lain yang diterima atau diberikan oleh pihak yang lain untuk pelaksanaein Memorandum Saling Pengertian ini atau pengaturan khususnya.
(2) Para
Pihak
sepakat
untuk
mematuhi
ketentuan
pasal
ini
meskipun
Memorandum Saling Pengertian ini telah diakhiri atau ditangguhkan.
PASAL 7 PENYELESAIAN PERSELISIHAN
Setiap
perselisihan
atau
perbedaan
yang
timbu!
akibat
penafsiran
atau
pelaksanaan Memorandum Saling Pengertian ini akan diselesaikan secara damai dengan konsultasi dan/atau negosiasi melalui saluran diplomatik antara Para Pihak.
PASAL 8
AMANDEMEN
Memorandum Saling Pengertian ini dapat ditinjau kembali atau diamandemen kapan saja berdasarkan kesepakatan bersama secara tertulis oleh Para Pihak. Amandemen tersebut akan mulai berlaku pada tanggal yang di tetapkan oleh Para Pihak dan akan menjadi bagian yang tidak dapat dipisahkan dari Memorandum Saling Pengertian ini.
PASAL 9
MULAI BERLAKU, JANGKA WAKTU , PENANGGUHAN DAN PENGAKHIRAN
(1) Memorandum Saling Pengertian ini akan mulai berlaku pada tanggal penandatanganannya.
(2) Memorandum Saling Pengertian ini akan terus berlaku untuk jangka waktu 5 (lima) tahun dan dapat diperpanjang untuk jangka waktu 5 (lima) tahun setelah itu, berdasarkan persetujuan tertulis sebelumnya oleh Para Pihak.
(3) Salah
satu
pihak
dapat mengakhiri
atau
menangguhkan
berlakunya
Memorandum Saling Pengertian ini dengan memberikan surat pemberitahuan resmi kepada pihak yang lain mengenai keinginannya untuk mengakhiri Memorandum Saling Pengertian ini sekurang kurangnya 6 (enam) bulan sebelum tanggal pengakhiran yang diinginkan.
(4) Pengakhiran Memorandum Saling Pengertian ini tidak akan mempengaruhi keabsahan dan jangka waktu dari suatu pengaturan hingga berakhirnya pengaturan, program dan/atau kegiatan tersebut, kecuali
Para
Pihak
menyepakati hal-hal lain.
SEBAGAI BUKTI, yang bertanda tangan di bawah ini telah menandatangani
Memorandum Saling Pengertian ini.
Termasuk bagian Pembukaan dan sembilan pasal, dengan dibuat rangkap dua, Memorandum Saling Pengertian ini ditandatangani pada tanngal 12 bulan September tahun dua ribu lima belas (21 /9/94) di Tehran dalam Bahasa Indonesia, Persia, dan lnggris, Seluruh naskah memiliki keabsahan yang sama. Dalam hal terjadi perbedaan penafsiran atas Memorandum Saling Pengertian ini, naskah Bahasa lnggris yang akan berlaku.

REPUBLIK INDONESIA
MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF YOUTH AND SPORTS OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF SPORTS AND YOUTH OF THE ISLAMIC REPUBLIC OF IRAN ON YOUTH AND SPORTS COOPERATION
The Ministry of Youth and Sports of the Republic of Indonesia and the Ministry of Sports and Youth of the Islamic Republic of Iran, hereinafter referred to as "the Parties"; CONSIDERING the interest in strengthening the ties of friendship and increasing
mutual understanding between the two countries; DESIRING to promote and enhance bilateral cooperative relations in the fields of
youth and sports; REFERRING to the Cultural Agreement between Indonesia and Iran signed in
Tehran on 241h April 1971 (41h , Ordibehsht, 1350); HAVE agreed as follows:
ARTICLE 1 AIMS OF COOPERATION
This Memorandum of Understanding aims to promote human resources development in the field of youth and sports between the Parties on the basis of
reciprocity, mutual understanding and benefit, in accordance with the prevailing laws and regulations of their respective countries.
ARTICLE 2 FIELDS OF COOPERATION
The Parties agreed to cooperate in the following areas:
(1) Youth Matters: a. exchange of visits by the government officials in charge of youth policy making. b. coordinate on matters with regard to activities of youth international organizations. c. cooperate to develop the youth movements such as the, youth centers, youth camps, youth creativity and innovation, youth entrepreneurship, volunteer work camp activities as well as exchanges of youth delegations of both countries. d. facilitate the exchange of information, training , scientific experience and culture. e. exchange of delegations to participate in camps, festivals, events and friendly visits in the field of youth . f.
encourage participation of experts, physicians. specialists and youth organizations of the two countries in scientific seminars and conferences.
(2) Sports Matters: a. exchange of visits by the government officials in charge of sports policy making. b. establish cooperation and communication between sports organizations of
the
two
countries
in
organizing
seminar
activities, exchange of information and experiences.

c. facilitate cooperation among institutions/organizations with regards to exchange sports athletes, coaches, referees , sports experts, and other personnel in sports.
d. cooperate and exchange of technical experiences regarding the development of sport infrastructure and facilities. e. promote and develop the traditional sports of the two countries.
(3) Other cooperative activities agreed upon by the Parties.
ARTICLE 3 IMPLEMENTATION
In order to carry out the successful imp!ementation of this Memorandum of Understanding, the Parties may establish a working group to prepare a specific arrangement or action plan which will be mutually agreed upon. Such arrangement or action plan shall specify, inter alia, program and activities, financial arrangement, intellectual property rights as deemed necessary, and other details relating to specific undertakings of all participants involved.
ARTICLE 4 FINANCIAL CONDITION
Each Party shall bear its cost to finance its activities to implement this Memorandum of Understanding with the resources allocated in its budgets, taking into account the availability, budgetary appraisal and the provisions of its national legislation. Any other related matters may also be arranged upon mutual consent.

ARTICLE 5 EMERGENCY CONDITIONS
If either Party incapable to perform its commitments under this Memorandum of Understanding due to, emergency conditions , the Party will advice such condition in writing the other Party. Such a situation may not be considered as violation of the provision of this Memorandum of Understanding.
ARTICLE 6 CONFIDENTIALITY
(1) Each Party will undertake to observe the confidentiality and secrecy of documents, information and other data received or supplied by the other Party for the implementation of this Memorandum of Understanding or its specific arrangements.
(2) The Parties agree to respect the provision of this Article notwithstanding the termination or suspension of this Memorandum of Understanding.
ARTICLE 7 SETTLEMENT OF DISPUTES
Any dispute or difference arising out of the interpretation or implementation of this Memorandum of Understanding will be settled amicably through consultations and/or negotiations through diplomatic channels between the Parties.
ARTICLE 8 AMENDMENTS
This Memorandum of Understanding may be reviewed or amended at any time by mutually written consent of the Parties. Such amendments will enter into force on such a date as determined by the Parties and will form an integral part of this Memorandum of Understanding.
ARTICLE 9 ENTRY INTO FORCE, DURATION, SUSPENSION AND TERMINATION
(1) This Memorandum of Understanding will enter into effect on the date of its signing.
(2) This Memorandum of Understanding will remain in force for a period of 5 (five) years and may be extended for a period of 5 (five) years thereafter, subject to prior written agreement by the Parties.
(3) Either Party may terminate or suspend the effectiveness of this Memorandum of Understanding, by giving official letter of notification to the other Party of its intention to terminate this Memorandum of Understanding at least 6 (six) months prior to the intended date of termination.
(4) The termination of the present Memorandum of Understanding will nut affect the validity and duration of any arrangement until the completion of such arrangement, program and/or activity, unless the Parties agreed otherwise.
IN WITNESS WHEREOF, the undersigned, have signed this Memorandum of Understand:ng.

Including an introduction and nine articles and done in duplicate, this Memorandum of Understanding has been signed on 121h September, 2015 (21/6/1394) in Tehran, in Indonesian, Persian. and English languages, all text being equally authentic. In case of any divergence of interpretation in this Memorandum of Understanding, the English text shall prevail.
