PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK AZERBAIJAN MENGENAI PEMBEBASAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN PASPOR DINAS
Pemerintah Republik Indonesia dan Pemerintah Republ ik Azerbaijan, selanjulnya sebaga1 individu disebut "Pihak" dan bersama-sama sebaga1 "Para Pihak"; MENGAKUI hubungan bersahabat yang terjalin antara kedua negara; BERHASRJ.l..T untuk mempermudah prosedur yang berhubungan denyan kunjungan wcirga negaranya ke Republik Indonesia dan Republik Azerbaijan; SESlJAi dengan hukum dan peraturan perundang-undangan yang beilaku di negara mereka mnsing-masing; TELAH MENYETUJUI sebagai berikut:
PASAL1 PEMBEBASAN VISA VVarga negara Republik Indonesia, pemegang paspor d1plomatik dan paspor dinas yang masih berlaku, dan warga negara Republik Azerbaijan, pemegang paspor diplomatik dan paspor dinas yang masih berlaku , tidak dipersyaratkan rnemperoleh visa untuk masuk, transit dan tinggal di dalam wilayah Pihak lain unti..:k jangka wa~tu tidak melebihi 30 (tiga puluh) hari sejak tnnggal masuk.
PASAL 2 VISA BAGI ANG GOTA MISI DIPLOMATIK AT AU KONSULER
Warga negara dari masing-masing Pihak yang memegang paspor yang berlaku sebagaimana ditetapkan pada Pasal 1 Persetujuan ini dan ditugaskan sebagai anggota misi diplomatik atau konsuler di dalam wilayah Pihak lain , termasuk anggota keluarga mereka (istilah anggota keluarga merujuk kepada suami atau isteri dan anak-anak yang belum menikah berusia dibawah 25 tahun dan belum bekerja dan bergantung pada orang tua), disyaratkan untuk memperoleh visa masuk yang sah dari Kedutaan Besar Pihak lainnya sebelum memasuki wilayah Pihak tersebut.
PASAL 3 MASA BERLAKU PASPOR
Masa berlaku paspor warga negara dari masing-masing Pihak sekurangkurangnya 6 (enam) bulan sebelum memasuki wilayah Pihak lain .
PASAL 4 TEMPAT-TEMPAT PEMERIKSAAN

Warga negwa dari Pam Pihak pernegang paspor diplomatik d8n dinas harus memasuki wilayah negara Pihak lain melalui tempat-tempat pemeriksaan yang dibuka u11tuk lalulinta$ penumpang internasional.
PASAL 5 PEMBATASAN VISA
Pemegang paspor yang berlaku dari setiap Pihak merujuk kepada Persetujuan ini diperbolehkan rnemasuki dan meninggalkan wilayah Pihak lainnya dari tempat manapun yang diizinkan untuk maksud tersebut oleh pihak imigrasi yang berwenang , tanpa pembatasan apapun kecuali di tempat-tempat yang telah ditentukan bagi syarat-syarat keamanan , migrasi, bea cuKai dan kesehatan dan lainnya yang secara hukum diterapkan kepada pemegang paspor diplomatik dan dinas.
PASAL 6 HAK PIHAK BERWENANG
Kedua belah Pihak memiliki hak untuk menolak memberikan izin rnasuk atau mempersingkat jangka waktu tinggal orang yang memiliki hak atas pembebasan visa dan fasilitas berdasarkan Persetujuan ini jika yang bersangl

PASAL 7 CONTOH PASPOR
Kedua Pihak akan saling melakukan pertukaran, melalui saluran diplomatik, contoh paspor yang digunakan oleh masing-masing Pihak sebelum Persetujuan ini berlaku atau sebelum paspor tersebut diterbitkan .
PASAL 8 PENUNDAAN
1. Masing-masing Pihak dapat, sewaktu-waktu, menunda sementara Persetujuan ini secara keseluruhan atau sebagian, dengan alasan keamanan nasional, ketertiban masyarakat atau kesehatan umum. 2. Berlakunya maupun beraktiirnya aturan sebagaimana disebutkan dalam ayat 1 Pasal ini harus diberitahukan kepada Pihak lainnya terlebih dahulu melalui saluran diplornatik.
PASAL 9 PENYELESAIAN SENGKETA
Setiap perselisihan antara Pihak-pihak dalam penafsiran a tau pelaksan::lan ketentuan Persetujuan ini akan diselesaikan secara damai melalui konsultasi atau perundingan antara Para Pihak.
PASAL10 AMANOEIVIEN
Persetujuc:tn ini daf)cJt diubah atau direvisi apabila dipandang perlu berdasarkan kesepakatan bersama secara tertul is oleh kedua Pihak. Perubahan-perubahan atau revisi mulai berlaku sesuai Pasal 11 Persetujuan ini dan menjadi bagian yang tak terpisahkan dari Persetujuan ini.
PASAL11 PEMBERLAKUAN, MASA BERLAKU DAN PENGAKHIRAN
1. Persetujuan ini mulai berlaku sejak tanggal diterimanya oleh Para Pihak pemberitahuan terakhir rnelalui saluran diplomatik yang menegaskan bahwa telah dipenuhinya semua persyaratan untuk mulai berlakunya Perset~juan ini. ·
2: Persetujuan ini akan berlaku untuk jangka waktu lima tahun dan akan secara otomatis diperbarui untuk jangka lima tahun berikutnya kecuali salah satu Pihak sekurang-kurangnya enam bulan sebelumnya

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF AZERBAIJAN ON VISA EXEMPTION FOR DIPLOMATIC AND SERVICE PASSPORTS
The Government of the Republic of Indonesia and the Government of the Republic of Azerbaijan, hereinafter refe rred to individually as a "Party" and collectively as the "Parties"; RECOGNIZING the existing friendly ties between the two countries; DESIRING to simplify the procedures relating to visits of nationals of their countric:s to the Republic of Indonesia and the Republic of Azerhaijan: PURSUANT to th8 prev3iling law s and regulations of the respective countries: HAVE AGREED as follows:
ARTICLE 1 VISA EXEMPTION Nationals of the Republic uf Indonesia, holders of valid diplomatic and service passports. and nationals of the Republic of Azerbaijan , holdF;rs of valid dirlomatic and se1vice passports, shall not be required to obtain visa to enter, transit and stay in the territo1y of the other Party for a period which does not exceed 30 (thirty) days from the date of entry
ARTICLE 2 VI SA FOR MEMBERS OF DIPLOMATIC OR CONSULAR MISSION Nationals of the st<.3te of a Party who are ho!der of valid passport reforred to Article 1 of this Agreement and assigned as members of diplomatic or consular mission 111 1he territory of the other Party, including thei r family members (th8 term family members refer to the husband I wife, and unmarried child1·en under the age of 25 years and who are unemployed and
dependant parents), shall be required to obtain appropriate entry visa from the Embassy of the other Party prior to the entry.
ARTICLE 3 Du'RATION OF PASSPORT VALIDITY The duration of passport validity of nationals of either Party shall be at least 6 (six) months before entering the territory of the other Party.
ARTICLE 4 CHECK-POINTS OF ENTRY The nationals of the country of Party holding diplomatic and service passport shall enter the territory of the country of the other Party through check-points open for international passenger traffic.
ARTICLE 5 VISA RESTRICTION The llolders of the valid passports of either Party referred to this Agreement rn3y enter into and depart from the territory of other Party by any point authorized for that purpose by the competent immigration authorities. without any restriction except for those stipulated in the security, migratory, custom and sanitary provisions and others v1hich may be legally applicable to holders of diplomatic and service passport.
ARTICLE 6 THE RIGHT OF AUTHORITIES Either Party reserves the right to refuse admission of entry or shorten the duration of stay of any person entitled to visa exemption and facilities under this Agreement if it considers that person undesirable.
ARTICLE 7 SPECIMEN OF PASSPORT The Parties shall exchange with each other, through diplomatic channels, specimens of their passports being used by each Party before this Agreement comes into forces as well as specimens of any new passports before i.he passports' issued.
ARTICLE 8 SUSPENSION 1. Each Pa'rty may, at any time, temporarily suspend this Agreement either in whole or in part, with the reasuns of national security, public order or public health.
2. The introduction as we ll as termination of the measures stated in paragraph 1 of this Article shall be duly informed to other Party through diplomatic channels in advance.
ARTICLE 9 SETTLEMENT OF DISPUTES Any disputes between the Parties on the interpretation or implementation of th!s Agreement shall be settled amicably through consultations or negotiations between the Parties.
ARTICLE 10 AMENDMENT This Ag reement may be amEmded or revised at any time by mutual consent in writing by the t\tl/o Parties. Such amendment or revis ion shall enter into force in accordance with Article 11 of this Agreement and form as integrai part of this Agresr,1ent.
ARTICLE 11 ENTRY INTO FORCE, DURATION AND TERMINATION 1. This Agreement shall enter into force on the date of receiving by tile Parties ·of the last wri1ten notifisation through diplomatic channels confirming the completion of their respective internal procedures required for the entry into force of this Agreement.
2. ·This Agreement is concluded for a period of five years and shall mmc:in in force automatically thereafter for the next five years unless either of the Partier. at least six months in advance notifies through diplomatic channels the other Party in written of its intention to terminate this Agreement.
IN WITNESS WHEREOF, the undersigned , being duly authorized thereto by their respective Governments, have signed this Agreement.
DONE at Baku on this twelfth day of May in the year two thousand and eight,
in duplicate in the Indonesian, Azerbaijani and English languages , all texts being equally authentic. In case of any differences of interpretation, the English text shall prevail.
