MEMORANDUM SALING PENGERTIAN ANTARA BADAN STANDARDISASI NASIONAL REPUBLIK INDONESIA (BSN) DAN ORGANISASI DEWAN KERJASAMA STANDARDISASI NEGARA-NEGARA ARAB Dl KAWASAN TELUK (GSO) Dl BIDANG STANDARDISASI Badan Standardisasi Nasional Republik Indonesia (BSN) dan Organisasi Dewan Kerjasama Standardisasi Negara-Negara Arab di Kawasan Teluk (GSO) untuk selanjutnya masing-masing disebut sebagai "Pihak" dan bersama-sama disebut sebagai "Para Pihak". BERTEKAD untuk memperkuat hubungan persahabatan dan kerjasama antara kedua negara dan rakyatnya; MEMPERTIMBANGKAN mempromosikan
dan
kepentingan memperkuat
bersama
kerjasama
kedua teknis
negara dalam

kesetaraan dan manfaat bersama; MENGAKUI

meningkatkan
pertumbuhan ekonomi melalui fasilitasi perdagangan kedua negara; BERDASARKAN hukum dan peraturan perundang-undangan yang berlaku di masing-masing negara; TELAH MENYETUJUI HAL-HAL BERIKUT:

PASAL1 DEFINISI Dalam Memorandum Saling Pengertian ini (MSP): 1.
lstilah BSN berarti dan menunjuk ke Badan Standardisasi Nasional Republik Indonesia;
2.
lstilah GSO berarti dan menunjuk ke Organisasi Dewan Kerjasama Standardisasi Negara-Negara Arab di Kawasan Teluk;
3.
lstilah MSP mengacu pada Memorandum Saling Pengertian ini. PASAL 2 TUJUAN DAN RUANG LINGKUP
Para Pihak akan bekerja sama dalam hal-hal berikut: 1.
Untuk mendukung dalam meningkatkan kerjasama ekonomi antara kedua organisasi melalui fasilitasi perdagangan dengan menghilangkan hambatan teknis perdagangan (TBT) di bidang standardisasi.
2.
Untuk menyediakan kerangka kerja dan mekanisme kerjasama teknis di bidang standardisasi, penilaian kesesuaian, informasi teknis, pelatihan, dan bidang lain yang akan disepakati bersama oleh Para Pihak. PASAL 3 AKTIVITAS KERJASAMA
Para Pihak akan melakukan kerjasama dalam hal berikut: 1.
Pertukaran informasi tentang kepentingan bersama, yang harus mencakup, tetapi tidak akan terbatas pada, a.
Produk dan jasa yang diperdagangkan antara dua pihak, yang meliputi daftar produk, standar, regulasi teknis, prosedur penilaian kesesuaian, dan informasi lainnya untuk memfasilitasi perdagangan produk ini.
b. 2.
Katalog standar nasional dan publikasi penilaian kesesuaian.
Pertukaran tenaga ahli dalam kegiatan pengembangan standar, penilaian kesesuaian, dan metro!ogi.
3.
Pelatihan personil secara timbal balik dalam bidang pengembangan standar, p_enilaian kesesuaian dan metrologi.

4.
Partisipasi
dalam
konferensi,
simposium,
workshop,
pameran,
dan
pertemuan terkait lainnya yang diselenggarakan oleh salah satu pihak. 5.
Melakukan kegiatan yang berkaitan dengan pengaturan saling pengakuan atas penilaian kesesuaian.
6.
Beroperasi dalam kerangka kerja dan pedoman WTO serta dalam kontak yang melekat dalam kerangka kerja organisasi standardisasi internasional termasuk ISO, IEC, dan CODEX untuk mempromosikan konsolidasi posisi mereka dan meningkatkan peran kedua Pihak dalam kegiatan internasional di bidang standardisasi.
7.
Penelitian pada kegiatan Standardisasi. PASAL 4 PENDANAAN
Bentuk nyata untuk mencapai kegiatan di bidang kerjasama ini, seperti yang dinyatakan oleh MSP ini serta syarat-syarat untuk pembiayaan akan ditentukan oleh Para Pihak atas dasar bahwa Pihak yang meminta wajib menanggung biaya. PASAL 5 PENGATURAN TEKNIS 1.
Dalam rangka mengimplementasikan MSP ini, kelompok kerja dapat sesuai diatur dari perwakilan kedua belah pihak untuk merumuskan programprogram pelaksanaan di bidang yang disepakati bersama. Programprogram ini harus dilaksanakan setelah persetujuan dari otoritas yang relevan dari kedua belah pihak.
2.
Dalam rangka memfasilitasi kerjasama di bawah MSP ini, pengaturan teknis dapat dibentuk mencakup prosedur rinci di bidang yang disepakati bersama dan hal-hal lain yang sesuai termasuk, jika dipandang perlu, pengaturan keuangan program. PASAL 6 ISU-ISU. YANG TIDAK TERCAKUP DALAM MSP
Dalam hal pengaturan-pengaturan, program-program, atau proyek-proyek yang dilaksanakan atas dasar MSP ini akan menghasilkan hal-hal yang tidak - 3-
tercakup dalam MSP, termasuk hak kekayaan intelektual, Para Pihak sepakat untuk mendiskusikan hal tersebut dalam pengaturan-pengaturan terpisah sesuai dengan peraturan perundang-udangan masing-masing. PASAL 7 KERAHASIAAN 1.
Masing-masing Pihak wajib menjaga dokumen, informasi, dan data lain yang diterima dari atau diberikan ke pihak lain selama periode pelaksanaan MSP atau perjanjian lain yang dibuat berdasarkan MSP ini.
2.
Para Pihak sepakat bahwa ketentuan dalam pasal ini terus mengikat kedua belah pihak setelah berakhirnya MSP.
3.
Ketentuan dalam pasal ini tidak akan mengabaikan hukum dan peraturan yang berlaku di Para Pihak. PASAL 8 PEMBATASAN KEGIATAN PERSONIL
Setiap orang yang terlibat dalam kegiatan yang terkait dengan MSP ini wajib menghormati kemerdekaan politik, kedaulatan, dan integritas wilayah negara tuan rumah, dan akan menghindari kegiatan yang tidak sesuai dengan tujuan dan maksud dari MSP ini. PASAL 9 PENYELESAIAN SENGKETA Setiap perbedaan atau perselisihan yang mungkin timbul dari penafsiran atau penerapan ketentuan MSP ini akan diselesaikan secara damai melalui konsultasi atau negosiasi antara Para Pihak. PASAL10 AMANDEMEN MSP ini dapat diubah dan ditambah setiap saat secara tertulis dengan persetujuan bersama dari kedua belah pihak. PASAL11 I
PEMBERLAKUAN, MASA BERLAKU, DAN PENGAKHIRAN 1.
MSP ini mulai berlaku pada saat tanggal penandatanganan. -4-
2. MSP ini akan berlaku selama 2 (dua) tahun dan akan diperpanjang untuk 2 (dua) tahun berikutnya, kecuali salah satu Pihak mengakhiri MSP dengan memberikan pemberitahuan secara tertulis melalui jalur diplomatik kepada Pihak lainnya sekurang-kurangnya
3 (tiga) bulan sebelum tanggal
pengakhiran dimaksud. 3. Pengakhiran MSP ini tidak akan mempengaruhi keabsahan dan jangka waktu dari segata kegiatan-kegiatan yang berlangsung atas dasar MSP ini sampai selesainya seluruh kegiatan-kegiatan tersebut kecuali Para Pihak menentukan lain. SEBAGAI BUKTI, yang bertandatangan di bawah yang telatl diberikan wewenang oleh pemerintah masing-masing, telah menandatangani MSP ini. DIBUAT, dalam rangkap dua di Riyadh, Arab Saudi, pada tanggal dua Desember tahun dua ribu empat betas, dalam tiga salinan asli, dalam Bahasa Indonesia, Bahasa lnggris, dan Bahasa Arab, semua naskah tersebut berkekuatan hukum yang sama. Dalam hal terjadi perbedaan terhadap penafsiran MSP ini, naskah Bahasa lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL STANDARDIZATION AGENCY OF THE REPUBLIC OF INDONESIA (BSN) AND THE STANDARDIZATION ORGANIZATION FOR THE COOPERATION COUNCIL FOR THE ARAB STATES OF THE GULF (GSO) ON STANDARDIZATION The National Standardization Agency of the Republic of Indonesia (BSN) and The Standardization Organization for the Cooperation Council for the Arab States of the Gulf (GSO) hereinafter individually referred to as 'the Party" referred to as "the Parties". DETERMINED to strengthen the existing friendly relation and cooperation between the two parties and their people; CONSIDERING their common interest to promote and foster technical cooperation in spirit of equality and mutual benefit; RECOGNIZING the need for technical cooperation which will enhance the economic development through trade facilitation of both Parties; PURSUANT to the prevailing laws and regulations in their respective parties; HAVE AGREED AS FOLLOWS:

ARTICLE 1 DEFINITION In this Memorandum of Understanding (MoU): 1.
The term BSN shall mean and refer to The National Standardization Agency of the Republic of Indonesia;
2.
The term GSO shall mean and refer to The Standardization Organization for the Cooperation Council for the Arab States of the Gulf;
3.
The term MoU shall refer to this Memorandum of Understanding. ARTICLE 2 OBJECTIVES AND SCOPE
The Parties shall cooperate in the following matters: 1.
To support in enhancing the economic cooperation between the two organizations through trade facilitation by eliminating the technical barriers to trade (TBT) in the area of standardization.
2.
To provide a framework and mechanism for technical cooperation in standardization, conformity assessment, technical information, training, and other field as may be mutually agreed upon by the Parties. ARTICLE 3 COLLABORATIVE ACTIVITIES
The Parties shall collaborate in the following: 1.
Exchange of information on mutual interest, which shall include, but will not be limited to, a.
Products and services being traded between two parties, which shall include lists of products, standards, technical regulations, conformity assessment procedures, and any other information to facilitate the trade of these products.
b.
Catalogue
of
national
standards
and
conformity
assessment
publication. 2.
Exchange of experts in the activities of standard development, conformity assessment, and metrology.

3.
Training of personnel on mutual basis in the fields of standard development, conformity assessment and metrology.
4.
Participation in conferences, symposium, workshops, exhibitions and other relevant meetings organized by either party.
5.
Carrying out activities related to mutual recognition arrangement on conformity assessment.
6.
Operate within the framework and guidelines of WTO as well as in close contact
within
the
framework
of
the
international
standardization
organizations including ISO, IEC, and CODEX to promote consolidation of their positions and increase the role of both Parties in international activities in the field of standardization. 7.
Research on Standardization activities. ARTICLE 4 FUNDING
Actual form for accomplishing activities in the area of this cooperation, as stated by this MoU as well as conditions for their financing will be determined by the Parties on the basis that the requesting Party is obliged to bear the costs. ARTICLE 5 TECHNICAL ARRANGEMENT 1.
In order to implement this MoU, a working group may accordingly be set up of the representatives of both parties to formulate implementation programs in the fields mutually agreed. These programs shall be implemented after the approval of relevant authorities of both parties.
2.
In order to facilitate cooperation envisaged by this MoU, technical arrangement may be concluded covering detailed procedures in the fields mutually agreed and other appropriate matters including, if it is deemed necessary, the financial arrangement of programs. ARTICLE 6 ISSUES NOT COVERED BY THE MOU
In case specific arrangement, programs, or projects, implemented under this MoU may result in issues that are not covered by the present MoU, including -3-
intellectual property, the Parties agree to discuss such issues in separate arrangement in accordance with their respective legislations. ARTICLE 7 CONFIDENTIALITY 1. Each Party shall undertake to observe the confidentiality and secrecy of documents, information , and other data received from or supplied to the other Party during the period of the implementation of this MoU or any other agreements made pursuant to the MoU . 2. The Parties agree that the provision of this Article shall continue to be binding between the Parties notwithstanding the termination of this MoU . 3. The .provision of this Article shall not prejudice the prevailing laws and regulations of the Parties. ARTICLE 8 LIMITATION OF PERSONNEL ACTIVITIES Any persons engaged in activities related to this MoU shall respect political independence, sovereignty, and territorial of the host country, and shall avoid any activities inconsistent with the purposes and objectives of this MoU . ARTICLE 9 SETTLEMENT OF DISPUTES Any difference or dispute that may arise out from the interpretation or application of the provisions of this MoU shall be settled amicably through consultation or negotiation between the Parties. ARTICLE 10 AMENDMENT This MoU may be amended and supplemented at any time in writing by mutual consent of the Parties. ARTICLE 11 ENTRY INTO FORCE, DURATION, AND TERMINATION 1. This MoU shall come into force and be implemented by the Parties on the date of its signing . -4-
2. This MoU shall be in force for a period of 2 (two) years and shall be extended for subsequent period of 2 (two) year, unless either Party terminate it by giving a written notification through diplomatic channel to the other Party at least 3 (three) months prior to the intended date of such termination. 3. The termination of this MoU shall not affect the validity and duration of any on-going activities made under this MoU until the completion of such activities unless the Parties decide otherwise. IN WITNESS WHEREOF, the undersigned being duly authorized thereto by their respective governments, have signed this MoU. DONE, in duplicate in Riyadh, Saudi Arabia, on this second day of December two thousand and fourteen , in three original copies, in Bahasa Indonesia, English, and Arabic, all texts being equally authentic. In case of divergence of the interpretation of this MoU, the English text shall prevail.
