REPUBLIK INDONESIA
PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK TAJIKISTAN MENGENAI PEMBEBASAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN PASPOR DINAS
Pemerintah Republik Indonesia dan Pemerintah Republik Tajikistan, selanjutnya disebut "Para Pihak",
MENIMBANG hubungan persahabatan yang terjalin antara kedua negara;
BERHASRAT untuk lebih memperkuat hubungan persahabatan yang terjalin, secara timbal balik, dengan memfasilitasi masuknya warga negara Indonesia dan Tajikistan ke wilayah masing-masing ;
SESUAI dengan peraturan perundang-undangan yang berlaku di masingmasing negara;
TELAH MENYETUJUI hal-hal sebagai berikut :
.. PASAL1 PEMBEBASAN VISA :' '1
Warga negara Republik Indonesia dan warga negara Republik Tajikistan . pemegang paspor diplomatik dan dinas yang sah, tidak dipersyaratkan untuk memperoleh visa untuk masuk, sin9gah dan tinggal di wilayah Pihak lainnya untuk jangka waktu yang tidak rr.elebihi 30 (tiga puluh) han sejak tanggal masuk.
PASAL 2 MASA BERLAKU PASPOR YANG SAH
Masa berlaku paspor warga negara dari salah satu pihak wajib sekurangkurangnya 6 (enam) bulan sebelum memasuki wilayah Pihak lainnya.
PASAL 3 PEMBATASAN VISA
Pemegang paspor yang sah dari salah satu Pihak sebagaimana dimaksud dalam Persetujuan ini dapat masuk dan keluar dari wilayah Pihak lainnya yang ijinkan oleh pihak imigrasi yang berwenang, tanpa pembatasan kecuali yang diatur dalam keamanan , migrasi, bea cukai dan kesehatan dan lain-lain yang secara hukum dapat diberlakukan bagi pemegang
paspor diplomatik dan paspor dinas.
PASAL 4 VISA BAGI AN GGOTA MISI DIPLOMATIK DAN KANTOR KONSULER
Warga negara dari salah satu Pihak, pemegang paspor yang sah 11
sebagaimana dimaksud dalam Pasal 1 Persetujuan ini dan ditugaskan sebagai anggota misi diplomatik atau
pos konsuler
di wilayah Pihak
lainnya, termasuk anggota kelunrga mereka, wajib dipersyaratkan untuk memperoleh visa masuk yang sah dari kedutaan Pihak lainnya sebelum kedatangan mereka.
PASAL 5 HAK PIHAK YANG BE RWE NANG
Salah satu Pihak berhak untuk menolak izin masuk, memperpendek masa
tinggal orang
yang
mendapdtkan
pembebasan
visa
dan
fasilitas
sebagaimana yang dimaksud Persetujuan ini apabila dianggap orang ~
tersebut tidak dikehendaki '
PASA LG PENAN GGUHAN
'
1. Salah satu Pihak dapat menangguhkan sementara Persetujuan ini baik seluruhnya maupun sebagian , dengan alasan ketertiban umum, perlindungan
terhadap
keamanan
nasional
atau
perlindungan '
terhadap kesehatan masyarakat.
2. Pemberlakuan maupun pengakhiran tindakan-tindakan sebagaimana disebutkan dalam ayat 1 dan Pasal 1ni wajib diinformasikan ke pihak lain melalui saluran diplomatik.
3. Penangguhan Persetujuan ini, baik seluruhnya maupun sebagian, wajib tidak mempengaruhi warga negara dari salah satu pihak, pemegang paspor diplomatik dan paspor dinas yang sah , yang telah diizinkan
masuk dan sudah berada di wilayah
berdasarkan pada pasal
1 dan
Pihak lainnya
3 Persetujuan ini pada saat
penangguhan.
PASAL 7 CONTOH PASPOR
1.
Para Pihak wajib saling bertukar, melalui saluran diplomatik, contoh-
l
contoh paspor yang digunakan oleh para pihak 30 (tiga puluh) hari sebelum pemberlakuan Persetujuar ini dan juga contoh paspor baru sebelum diberlaKuKan.

2. Apabila salah seorang warga negara dari salah satu Pihak kehilangan paspor diplomatik atau paspor dinas, atau apabila paspor tersebut rusak
di
wi layah
negara
pihak
lainya, orang
tersebut
waj ib ~
memberitahukan kepada pihak berwenang di negara penerima melalui misi diplomatik atau pas konsuler negara asal orang tersebut. Misi diplomatik atau pos konsuler terseb:.it, sesuai dengan peraturan dan perundang-undangan yang ber1aku di negaranya, wajib menerbitkan dokumen perjalanan bagi warga negara tersebut untuk kembali ke negara asalnya.
PASAL 8 PENYELESAIAN SENGKETA
Setiap
sengketa
yang
timbul
dari
penafsiran
atau
pelaksanaan
:
Persetujuan ini wajib diselesaikan secara damai melalui konsultasi dari negosiasi para Pihak.

Persetujuan
ini
dapat diubah
sewaktu-waktu
" melalui
kesepakatan
bersama secara tertulis oleh Para Pihak. Perubahan dimaksud wajib diberlakukan sesuai tanggal yang ditentukan oleh para pihak yang merupakan bagian yang tidak terpisahkan dari Persetujuan ini.
PASAL10 MULAI BERLAKU , JANGKA WAKTU DAN PENGAKHIRAN 1. Persetujuan ini wajib mulai berlaku 30 (tiga puluh) hari sejak tanggal
penerimaan, melalui saluran diplomatik, pemberitahuan terakhir secara tertulis oleh para Pihak mengenai telah dipenuhinya syaratsyarat pemberlakuan

ini sesuai dengan ketentuan

Persetujuan in;, berlaku untuk waktu yang tidak ditentukan , kecuali salah satu Pihal.; memutuskan untuk mengakhiri Persetujuan ini dengan membE:rikan pemberitahuan secara tertu1is kepada pihak la1nya, melalui saluran diplornatik, sekurang-kurangnya 3 (tiga) bulan dari tanggal penerimaan dari salah satu pihak.

DIBUAT di Jakarta pada tanggal satu bulan Agustus tahun dua ribu enam
belas, dalam rangkap dua, masing-masing dalam Bahasa Indonesia, Bahasa Tajik, dan Bahasa lnggris, semua naskah memiliki kekuatan hukum yang sama. Dalam hal terjadi perbedaan penafsiran mengenai ketentuan-ketentuan dari Persetujuan ini, naskah Bahasa lnggris wajib berlaku.

REPUBLIK INDONESIA
AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF TAJIKISTAN ON VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC AND SERVICE PASSPORTS
The Government of the Republic of Indonesia and the Government of the Repub lic of Tajikistan hereinafter referred to individually as the "Parties";
CONSIDERING the existing friendly relations between the two
countries ;
DESIRING to further strengthen such relations, on a reciprocal
basis, by facilitating the entry of nationals of Indonesia and Tajikistan into their respective countries ;
PURSUANT to the p reva iling laws and regulations of the respective
countries ;
HAVE AGREED as follows:
ARTICLE 1 VISA EXEM PTION
Nationals of tne Republ ic of Indonesia and nationals of the Republic of Tajikistan , holders of valid diplomatic and service passports , shall :iot be required to obtain a visa to enter, transit and stay in the territory of the other Party for a period which does not exceed 30 (thirty) days from the date of entry. ARTICLE 2 DURATION OF PASSPORT VALIDITY
The duration of passport validity of nationals of either Party shall be at least 6 (six) months before entering the territory of the other Party . - I'
ARTICLE 3 VISA RESTRICTION

The holders of the valid passports of either Party referred to this Agreement may enter into and depart from the territory of the other Party
by the
competent
imm ig ration
authorities, without
any
restriction except for those stipulated in the security, migratory, custom and sanitary provisions and others which may be legally applicable to holders of diplomatic and service passports . ARTICLE 4 VISA FOR MEMBER OF DIPLOMATIC AND CONSULAR MISSIONS
Nationals of either Party who are holders of valid passports referred to Article 1 of this Agreement and assigned as members of diplomatic or consular mission in the territory of the other Party, including
their family
members , shall
be
required
to
obtain
appropriate entry visa from th e Embassy of the other Party prior to their entry.
ARTI CLE 5
THE RIGHT OF .l\0THORITIES
Either Party reserves the r:ght to refuse admission of entry or shorten the duration of stay of any person entitled to visa exemption and facilities under this Agreement if it considers that person undesirable .

SUSPEN SI ON
1
Each Party may temporarily suspend this Agreement either in whole or in part, with the reasons of national security, public order or public health.
2
The introduction as well as termination of the measures stated in paragraph 1 of this Article shall be duly informed to other Party through diplomatic channels .
3. The suspension of this Agreement, in whole or in part, shall not affect nationals of a Party holding valid diplomatic and service passport who have been granted entry into and are already presenr in the territory of the: Other Party under Articles I and 3
of this Agreement at the point of suspension .
ARTICLE 7 SPECIMEN OF PASSPORT
1. The Parties shall exchange to each other, through diplomatic channels, specimens of tbeir passports being

Party 30 \thirty) days beforP. the entry into force of this Agreement as well as specimens of any new passports before the introduction .
2. If a national of either Party loses his/her diplomatic or service passport, or if it is damaged in the territory of the State of the other
Party,
he/she
shall
promptly
inform
the
competent
authorities of the receiving State via the diplomatic m1ss1on or consular post of their country of origin_ The diplomatic mission or consular post concerned , in accordance with the laws and regulations of its country , shall issue such a national with a travel document to return to his/her country of origin .
AR TICLE 8 SETTLEMENT OF DISPUTES
Any
disputes
between
the
Parties
on
the
interpretation
or
implementation of this Agreement shall be settled amicably through consultations or negotiations between the Parties.
ARTICLE 9 AMENDMENT
This Agreement may be amended or revised at any time by mutual consent in writing by the two Parties. Such amendment or revision shall enter into force on such a date as may be determined by the Parties and form as integral part of this Agreement.
ARTICLE 10 ENTRY INTO FORCE , DURATION AND TERMINATION
1. This Agreement shall enter into force 30 (thirty ) days from the date of the receipt of the last written notification in which the Parties inform each other, through diplomatic channels , that all requirements for the entry into force of this Agreement, as stipulated under their respective national legislation , have been fulfilled.

2. This Agreement , shall remain in tcrce fer 3n indefinite period of time , unless either Party decides to terminate this Agreemer.t by giving written notice to the other Party, through dipl0rr1at1c channels , at least 3 (three) months from the date of receipt by
