PERS ETUJU AN AN T ARA PE MERINTAH REPUBLIK INDONESIA DAN PEMERIN TAH REPUBLIK KAZAKHSTAN MENGENAI PEM BEBASAN VISA BAGI PEM EGANG PASPOR DI PLO MATIK DAN DINAS
Pemerintah Republik Indonesia dan Pemerintah Repu blik Kazakhstan selanjutnya disebut "Para Pihak"; Menimbang untuk memperkuat hubungan bersahabat antara Rep ublik Indonesia dan Re publik Kazakhstan; Berhasrat berdasarkan asas ti mbal balik untuk menyederhanakan saling kunjung warga negara Republik Indonesi a dan Republik Kazakhstan, antara pemegang paspor diplomati k dan din as kedua negara ; Sesuai dengan peraturan perundang-undangan yang berlaku di negara Para Pihak; Telah menyetuj ui hal-hal sebagai be rikut:
PASAL1 PEMBEBASAN VISA Warga negara Para Pihak , pemegang paspor diplomatik dan dinas dapat memasuki , meninggalkan dan transit melalui wilayah negara Pih ak lainnya tanpa visa untuk suatu jangka waktu yan g tidak melebihi 30 (tiga puluh) hari sejak tanggal masuk dan tidak dapat diperpanj ang.
PASAL2 MASA BERLAKU PASPOR YANG SAH Masa berlaku paspor diplomatik dan dinas yang sah dari warga negara Para Pihak wajib sekurang-kurangnya 6 (enam) bulan sebelum memasuki wilayah negara Pihak lainnya.
PASAL3 PE MBATASAN VISA Warga negara Para Pihak, pemegang paspor diplomatik dan dinas, wajib masuk dan keluar dari wilayah negara Pihak lainnya melalui titik manapun yang terbuka untuk lalu lintas internasional tan pa pembatasan apapun, kecuali yang ditentukan bagi syarat-syarat keama na n, migrasi, bea cukai dan kesehatan, yang menurut hukum negara Para Pihak dapat diterapkan kepada pemegang paspor diplomatik dan dinas.
PASAL4 VISA BAGI ANGGOTA MISI DI PLOMATIK DAN POS KO NSULER W arga negara Para Pihak, yang merupakan pemegang paspor diplomatik dan dinas yang sah, yang ditunjuk sebagai anggota misi diplomatik dan pas konsuler, terakreditasi untuk negara Pihak lain, termasuk anggota keluarga mereka tidak dibebaskan dari prosedur mem pe roleh visa dan wajib dipersyaratkan untuk memperoleh visa masuk yang tepat dari misi diplomatik atau pas konsuler Pihak lainnya sebelum memasuki wilayah negara Pihak tersebut.
PASAL 5 HAK PIHAK BE RWE NAN G Masing-masing Pihak berhak untuk menolak memberikan izin masuk atau mengakhiri masa tinggal warga negara Pihak lainnya, pemegang paspor diplomatik dan dinas, yan g berada di wilayahnya apabila dianggap bahwa orang tersebut tidak dikehendaki.
PASAL 6 CONTOH PASPOR Para Pihak wajib saling bertukar melalui saluran diplomati k, contoh pasporpaspor diplomatik dan dinas yang masih berlaku sebelum Persetujuan ini berlaku. Dalam hal terjadi perubahan terhadap paspor diplomatik dan dinas, Para Pihak wajib saling memberitahukan satu sama lainnya melalui saluran diplomatik secara

tertulis, dengan melampirkan paspor ba ru tersebut , sebelum paspor baru tersebut berlaku.
PASAL7 PENANGGUH AN
1. Masing-masing Pihak dapat menangguhkan sementara Persetujuan ini, baik secara keseluruhan maupun sebagia n, dengan alasan-alasan keamanan nasional, ketertiban umum atau kesehatan publik . 2. Pengenalan, sebagaimana peng akhi ran penangguhan Persetujuan menu rut ayat 1 Pasal in i, wajib dikomunikasi ka n sebelumnya kepada Pihak lainnya melalui saluran diplomatik.
PASAL 8 PE NYE LESAIAN SE NGKETA
Setiap perbedaan atau persel isih an yang timbul dari penafsiran atau pelaksanaan ketentuan Perjanjian ini akan diselesaikan secara damai melalui konsultasi atau perundingan antara Pa ra Pihak.
PASAL 9 PERUBAHAN DAN SISIPAN
Persetujuan ini dapat diubah ata u disisipi berdasarkan kesepakatan bersama Para Pihak. Perubahan tersebut wajib menjadi bagian yang tidak terpisahkan dari Persetujuan ini dan mulai berlaku sesuai dengan ketentuan ayat 1 dari Pasal 10 Persetujuan ini .
PASAL10 MULA! BERLAKU, JANG KA WAKTU DAN PENGAKHIRAN
1. Persetujuan ini wajib mulai berla ku setelah 30 (tiga puluh) hari sejak tanggal penerimaan terakhir dimana Para Pihak saling memberitahukan , melalui saluran diplomatik, bal1wa persyaratan untuk mulai berlakunya Persetujuan ini sebagaimana tercantum dalam masing-masing peraturan perundang-undangan nasionalnya telah dipenu hi. 2. Persetujuan ini berlaku untuk waktu yang tidak ditentukan dan wajib tetap berlaku untuk 2 (dua) bulan sejak tanggal penerimaan pemberitahuan tertulis melalui saluran diplomatik dari salah satu Pihak mengenai keinginannya untuk mengakhiri Persetujuan ini.
Sebagai bukti, yang bertanda tang an di bawah ini yang diberi kuasa penuh oleh Pemerintahnya masing-masing , telah menandatangani Persetujuan ini.

AGREEMENT BETWE EN THE GOVERNMENT OF THE REPUBLIC OF IN DONES IA AN D TH E GOVERNM ENT OF THE REPUBLIC OF KAZAKHS TAN ON VI SA EXEMPTION FOR HOLDERS OF DIPLOMATIC AND SERVICE PASSPORTS
Th e Governm ent of the Repub lic of Indonesia and the Government of the Republic of Kaza khstan hereinafter referred to as "the Parties"; Con sid ering to stre ngthen the friend ly relations between the Republic of Indonesia and the Republic of Kazak hstan; Des iri ng on a re ciprocal basis to simplify mutual travel of nationals of the Republic of Indonesia and the Republi c of Kazakhstan, the holders of va lid diplomatic and service passports between the two States; Pursuant to the prevai ling laws and regul ations of the States of the Pa rties; Have agreed as follows:
ARTICLE 1 VISA EXEMPTION Nationals of the States of the Pa rties, holders of valid diplomatic and service passport may enter, leave and transit through the territory of the State of the other Party without visas fo r a period not exceedin g 30 (thirty) days from the date of entry and cannot be extended.
ARTI CLE 2 DURATION OF THE VALIDITY OF THE PASSPORTS The duration of the va lidity of the diplomatic and service pa ssports of nation als of the States of each of the Parties shall be at least 6 (six) months before ente ri ng into the territory of the State of the other Party.
ARTI CLE 3 VISA RESTRI CTIONS Nationals of the States of the Pa rties, holders of va lid diplomatic and service passport, sh all enter and depart from the territory of the State of the other Party thro ugh any check-points opened for international traffic without limitations, except fo r those stipulated in the security, migratory , customs and sanitary provisions , according to national legislation of the States of the Parties may apply to holders of valid dip lomatic and service passports.
ARTI CLE 4 VISA FOR MEMBERS OF DIPLOMATIC MISSION S OR CONS ULAR POSTS Nationals of the States of th e Parties, holders of valid diplomatic and service passports, appointed as members of diplomatic missions or consu la r posts , accredited on the te rritory of th e State of the other Party, including their family members are not exempted from the visa procedure and shall be requ ired to obtain appropriate entry visas from the dip lomati c missions or con su lar post of the State of th e c ~ her Party prior to entry.
ARTI CLE 5 RIG HTS OF AUTHORITIES Each Party reserves the rig hts to refuse the admission of entry or term inate the stay of nationa ls of the State of the oth er Party , holders of va lid diplomatic and service pa sspo rts, on the territory of its State if it co nsid ers that these person s are fo und to be undesirable.
ARTICL E 6 SPECIM ENS OF PASSPORTS The Parties shall exchange th ro ugh diplomatic channels, specimens of valid diplomatic and servi ce passports before this Agreement enters into force. In case of any ch anges to diplomatic and se rvice pa ssports , th e Parties shall 11

inform each other thro ugh diplomatic channels by written notice, enclosing the new passports before the passports enter into force .
ARTICLE 7 SU SPENS ION 1. Each Party may temporarily suspend this Agreement, either in whole or in part, with the re asons of national security, public order or public health . 2. The introd uction, as well as the termination of suspension of this Agreement referred to parag raph 1 of this Article, shall be duly informed to the oth er Party throug h diplomatic chann els in advance.
ARTICLE 8 SETTLEMENT OF DISPUTES Any differences or disputes arising out of th e inte rp retation or implementation of this Agreement shall be settled amica bly throu gh consultation s or negotiations between the Parties .
ARTICLE 9 AMENDM EN TS AN D SUPPLE MENTS This Agreement may be amen ded and supplemented by mutual consent of the Parties. Su ch amendments shall fo rm an integral part of this Agreement and enter into force according to the provision of paragraph 1 of Article 10 of this Agreement.
ARTICLE 10 ENTRY INTO FORCE, DU RATION AND TERMINATION 1. Th is Agreement shall enter into force after 30 (th irty) days fro m the date of receipt of th e last written notification by which the Parties notify each oth er, through diplomatic ch annels, that their internal requirements for the entry into force of th is Ag ree ment have been fu lfi lled. 2. The present Agreement is con cl uded for an indefinite period and shall remain valid for 2 (two) months after the date of receiving written notification through diplomatic chann els from one of the Parties of its intention to terminate it. In witness whereof, the undersigned being duly authori zed thereto by their respective Govern ments, have signed th e present Agreement.
