MEMORANDUM SALING PENGERTIAN ANTARA PROVINSI DAERAH ISTIMEW A YOGY AKART A, REPUBLIK INDONESIA DAN PROVINSI CHIANG MAl, KERAJAAN THAILAND MEN GENAl KERJASAMA PERSAHABA TAN
Provinsi Daerah Istimewa Yogyakaria, Republik Indonesia dan Provinsi Chiang Mai, Kerajaan Thailand, selanjutnya disebut "Para Pihak". BERPEDOMAN pada keinginan bersama untuk memperkokoh rasa saling pengertian dan niat baik antara kedua Provinsi, dan MEMPERTIMBANGKAN hubungan yang telah lama terjalin antara Provinsi Daerah Istimewa Yogyakarta, Republik Indonesia dan Provinsi Chiang Mai, Keraj aan Thailand; Telah mencapai kesepahaman hal -hal sebagai berikut: 1. Para Pihak akan, dalam kewenangannya dan sesuai peraturan serta perundangundangan yang berlaku di masing-masing negara, saling bekerjasama untuk meningkatkan kemakmuran dan pcmhcmgunan bcrdasarkan pada kesetaraan dan saling menguntungkan.

Para pihak akan saling bekerjasama dalam berbagai bidang sepanjang dimungkinkan menurut peraturan dan perunctang-unctangan dari Pnra Pihak scrta discsuaikan dcngan kcbijakan pcmcrintah dan kcwajiban internasional. 3. Para pihak akan mendorong instansi terkait untuk saling memelihara komunikasi langsung dalam rangka kc1jasama bcrdasarkan Memorandum Saling Pengertian ini. 4. Para pihak juga akan mendorong para pejabatnya untuk saling mengunjungi dan mendorong hubungan antar masyarakat. 5. Para pihak apabila diperlukan akan saling berkonsultasi mengenai cara yang ditempuh dalam pelaksanaan program kerjasama berdasarkan Memorandum Saling Pengertian U11.
6. Sctiap perbedaan yang timbul de-dam penafsiran atau pelaksanaan Memorandum Saling Penge1iian ini akan clisclcsnikan sccar;1 bcrsalwbnt mclalui konsultasi atau pcrundingan antara Para J>ilwk.

7. Memorandum Saling Pengertian ini berlaku sejak tanggal penandatanganan untuk jangka waktu 5 (lima) tahun dan dapat diperpanjang untuk jangka waktu 5 (lima) tahun berikutnya secara berkesinambungan, kecuali bila diakhiri secara tertulis oleh salah satu Pihak dengan memberikan pemberitahuan 6 (enam) bulan sebelumnya. Dibuat dalam rangkap tiga, di Chiang Mai, Thailand, pada tanggal empat bulan September tahun dua ribu tujuh, dalam bahasa Indonesia, Thailand, dan Inggris, semua naskah mempunyai kekuatan hukum yang sama. Dalam hal terjadi perbedaan pei1afsiran Memorandum Saling Pengertian ini, maka naskah bahasa Inggris yang digunakan.

MEMORANDUM OF UNDERSTANDING BETWEEN THE PROVINCE OF YOGYAKARTA SPECIAL REGION, THE REPUBLIC OF INDONESIA AND THE PROVINCE OF CHIANG MAl, THE KINGDOM OF THAILAND CONCERNING FRIENDLY TIES COOPERATION
The Province of Yogyakarta Special Region, the Republic of Indonesia and the Province of Chiang Mai, the Kingdom of Thailand, hereinafter referred to as "the Parties".
GUIDED by a mutual aspiration towards the strengthening of understanding and goodwill between their respective provinces, and TAKING IN TO consideration the already long existing relations between the Province of Yogyakarta Special Region, the Republic of Indonesia and the Province of Chiang Mai, the Kingdom ofThailand; HAVE reached the lo l! O\,ving undcrstnnding :
1. The Parties shall, within their authorities and to the extent permitted by the laws and regulations in force in their respective countries, cooperate with each other to promote mutual prosperity and clcvclopment on the basis of equality and mutual benefits. 2.
The Parties shall cooperate with each other in various fields as long as permitted under laws and regulations of the Parties and as may be compatible with their respective goverment's policies and international obligations.
3.
The Parties shall encourage their relevant agencies to maintain direct contacts with each other for the cooperation under this Memorandum of Understanding.
4.
The Parties shall also encourage exchange of visits between their officials and people to people contact.
5.
The Pariies shall, \vhen necessary, consult each other regarding the modalities for the implementation of program cooperation under the Memorandum of Understanding.
G.
Any differences arising out of the interpretation of implementation of this Memorandum of Understanding shall be settled amicably through consultation or negotiation between the Pa1iies.
7.
This Memorandum of Understanding shall be valid on the date of its signature for a period of 5 (five) years and may be extended for another period of 5 (five) years consecutively unless it is denounced in writing by either Party giving 6 (six) months notice in advance.
Done in duplicate at Chiang Mai, Thailand, on this 4th day of September in the year two thousand and seven in the Indonesian, Thai and English languages, all texts are being equally authentic. In case of divergent interpretations, the English text shall prevail.
