Pemerintah Republik Iraq dan Pemerintah Republik Indonesia, Berhubung dengan adanja hasrat untuk mengadakan suatu persetudjuan untuk memperkuat hubungan batin jang I
telah berabad-abad ada antara kedua ne gara dan untuk memperkokoh usaha-usaha jang akan mendekatkan hubungan-

hubungan kebudajaan, intelektuil, dan ilmiah antara kedua negara: Demikian djuga untuk mewudjudkan suatu perdjandjian dua-pihak dalam lapangan pendidikan dan kebudajaan seperti

jang telah diandjurkan dalam Pengumuman Bersama dari Konperensi Asia-Afrika di Bandung pada tanggal 24 April 1955,

telah menjetudjui hal-hal berikut:
Ajat 1 11
Pihak Penandatangan Agung akan memadjukan pertukaran gurubesar-gurubesar dari Universitas, Perguruan Tinggi, Lembaga Islam, Lembaga-Lembaga tingg i lainnja, dan misi-misi keBudajaan.
Kedua belah Pihak akan menjediakan
tempat kediaman jang diperlukan. Ajat 2 Pihak Penandatangan Agung menjatakan keinginan mereka untuk memadjukan pertukaran mahasiswa-mahasiswa (t.OllO lb. i1 X

dan mempermudah penerimaan mereka di Lembaga-Lembaga tersebut.
Masing -masing dari Kedua belah Pihak akan
berusaha memberikan beasiswa kepada mahasiswa-mahasiswa dan gurubesar-gurubesar.
Ajat 3 Pihak Penandatangan Agung akan berusaha memperkenalkan negara masing-masing dan memperkokoh hubungan mereka dengan segala alat-alat jang ada, seperti:
buku-buku batjaan,
pameran-pameran kesenian dan ilmu pengetahuan, pertundjukanpertundjukan film, konser-konser, pertundjukan-pertundjukan dan kundjungan dari kaum tjerdik-pandai, mahasiswa-mahasiswa, pandu-pandu dan rombongan-rombongan olahraga, serta mendorong kerdjasama antara perkumpulan-perkumpulan pengetahuan, perkumpulan-perkumpulan teknik, dan perkumpulan-perkumpulan kesusasteraan, jang setjara resmi telah diakui oleh Pihak masing-masing .
Ajat 4 Pihak Penandatangan Agung akan memadjukan pertukaran dari hasil penjelidikan-penjelidikan ilmu pengetahuan dan pengetahuan umurn, jang ditudjukan baik untuk menaikkan tingka t ekonomi, sosial dan kesedjahteraan djasmani, maupun untuk menghidupkan kembali peninggalan kebudajaan nasional dan kebudajaan Islam.
Ajat 5 Pihak Penandatangan Agung akan mengusahakan untuk

mempermudah penukaran dari bahan-bahan pendidikan dan kebudajaan, termasuk buku-buku, madjallah-madjallah berkala, penerbitan-penerbitan lainnja, dan turunan dari barangbarang purbakala serta tindasannja.
Djuga akan diberikan
dorongan untuk menterdjemahkan bahan-bahan pendidikan jang terpilih dan penerbitan-penerbitan kebudajaan.
Ajat 6 Kedua Belah Pihak akan menerima-baik pembentukan dari jajasan-jajasan kebudajaan dan pengetahuan didalam wilajah masing-masing, selama tidak bertentangan dengan peraturan-peraturan setempat.
Jang dimaksud dengan istilah
"jajasan kebudajaan" adalah pusat-pusat pendidikan, perpustakaan-perpustakaan buku dan film.
Ajat 7 Untuk memperkuat hubungan antara kedua bangsa, dan menambah pengertian antara kedua rakjat, Pihak Penandatangan Agung akan menjediakan dalam atjara penjiaran nasionalnja masing-masing suatu rentjana chusus dengan tudjuan untuk memperkenalkan rakjatnja masing-masing dengan perkembanganperkembangan dalam lapangan kebudajaan, kesenian, dan teknik.
Ajat 8 Pemerintah dari Penandatangan Agung akan mengesahkan Persetudjuan ini menurut undang-undangnja masing-masing. Persetudjuan ini akan mulai berlaku mulai hari

page four penukaran dari piagam pengesahan, jang akan dilaksanakan di
Djakarta. Sesuatu perobahan dari persetudjuan ini akan
berlaku djika ditanaatangani oleh Pemerintah.
Dan pihak
jang satu mempunjai hak untuk rnengachiri Persetudjuan ini, asalkan pihak jang lain diberitahu setjara tertulis enam bulan sebelum hari Persetudjuan berachir. Bahwasanja setelah menjaksikan hal-hal tersebut diatas, maka para Berkuasa Penuh masing-masing menandatangani Persetudjuan ini, jang ditulis dalam bahasa Arab, bahasa Indonesia, dan bahasa Inggeris. Ketiga naskah dari Persetudjuan ini adalah sah. Akan tetapi pada waktu terdapat sesuatu perbedaan pengertian, maka naskah bahasa Inggeris-lah jang akan berlaku. Dibuat di Baghdad pada tanggal 5 April 1960.

CULTURAL AGREEMENT BET"JEEN THE GOVERNMENT OF THE REPUBLIC OF LWDONESIA AND
THE GOVERNMENT OF THE REPUBLIC OF IRl\.Q
The Government of the Republic of Indonesia and the Government of the Republic of Iraq. Being desirous of concluding an agreement in order to strengthen the spiritual ties existing between

them for several centuries and to consolidate their efforts to establish closer cultural, intellectual and scientific relations between their nations; Also in order to realize a bilateral agreement in the field of Education and Culture as was recommended in the joint communique issued by the Afro-Asian Conference at Bandung, 24th., April 1955, have agreed on the following: Article
1.
The High Contracting Parties shall promote the exchange of professors of Universities, colleges, Islamic and other high institutions and of cultural delegations.
The two contracting parties shall under-
take to provide facilities for necessary accommodation. Article
2.
The High Contracting Parties declare their desire to promote the exchange of university students and facilitate their admittance.
The two contracting .
parties shall respectively endeavour to grant scholar-

ships to students and scholars from the other party.

The High Contracting Parties shall endeavour to familiarize their countries to each other and to strengthen their relations by all possible means such as lectures, art and scientific exhibitions, fj.lms, concerts, plays and visits of scientific, students,

spor·ts delegations and encourage co-operation betiaeen scientific, technical and literary societies which are offtcially recognized in each other ' s country. Article
4.
The High Contracting Parties shall promote the exchange of scientific researches and general studies designed to raise the economic, social and physical welf'are as well as those to revive national cultural herj.tage and Islamic civilization. Article
5.
The High Contracting Parties shall endeavour to facilitate the exchange of educational and cultural publications including books, .,periodicals, bulletins and of duplicated antiquities and their casts. Encouragement shall also be

to translate selected

Parties shall welcome the
establishment of cultural and scientific institutions in each other's territory subject to local laws· and regulations.

shall ratify this Agreement in accordance with their respective constitutional procedures . The Agreement shall come into force as from the day of exchanging the instruments of ratification in Djakarta. Any amendJnent on this agreement shall come into force as from the date of its signature by the t·.vo contracting governments and each party has the right to terminate the Agreement provided that the other party shall be given a written notice six months 9rior to the day that pa'"'ty '.'!ants the Agreement to expire . In witness thereof the respective Plenipotenti aries have signed the present Agreement 'Nhich is \vri tten in Indonesian , Arabic and English languages .

PROTOCOL OF EXCHANGE OF INSTRU?11Y:NTS OF RATIFICATION
The undersigned, Dr. Subandrio, Minister for Foreign Affairs and Foreign Economic Relations of the Republic of Indonesia and Dr. Faisal J. El-Samir, Minister Plenipotientiary and Charge d'Affaires a.i. of the Embassy of the Republic of Iraq, have met for the purpose of exchanging the instruments of ratification by their respective Governments of the Cultural Agreement between the Republic of Indonesia and the Republic of Iraq, signed at Baghdad on the 5th April,
1960. The respective instruments of ratification of the Agreement aforesaid having been examined and found to be in due form, the exchange thereof took place this day. In witness whereof, they have signed the present Protocol. Done in duplicate of Djakarta,
