PERSETUJUAN DAGANG ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK INDIA
Pemerintah Republik Indonesia dan Pemerintah Republik India, berhasyrat untuk mengembangkan hubungan dagang dan ekonomi antara kedua negara atas dasar prinsip persamaan dan saling menguntungkan, telah menyetujui sebagai berikut : PASAL
I
Pemerintah Republik Indonesia dan Pemerintah Republik India, dalam batas perundang-undangan dan peraturan-peraturan yang berlaku di masing-masing negara, akan mengambil segala tindakan yang wajar untuk melancarkan, memperkuat, memperbesar dan menganeka-ragamkan perdagangan antara kedua negara. PASAL 1.
II
Kedua Pemerintah sepakat untuk saling memberikan
perlakuan yang tidak kurang kepada pihak lainnya dari pada yang diberikan kepada negara lain dalam hal-hal yang berhubungan dengan perdagangan, terutama mengenai peraturanperaturan dan formalitas-formalitas bea cukai, pajak-pajak dan pungutan jenis apapun, serta peraturan yang mengatur imper dan ekspor barang-barang. 2.
Ketentuan-ketentuan pada ayat (1) pasal ini, tidak
akan menghalangi Pemerintah Indonesia untuk mempertimbangkan pengaturan-pengaturan istimewa dalam perdagangan diantara negara-negara ASEAN. 3.
Ketentuan-ketentuan pada ayat (1) pasal ini, selanjut-
nya tidak akan menghalangi kedua Pemerintah untuk mempertahankan atau tetap mempertimbangkan : (i) hak-hak istimewa yang sudah atau akan diberikan oleh masing-masing Pihak yang Berjanji untuk melancarkan perdagangan perbatasan;

(ii) pemberian pengaturan istimewa, keuntungan-keuntungan, hak-hak istimewa atau kekebalan-kekebalan oleh kedua belah Pihak yang Berjanji kepada negara ketiga yang telah ada

pada tanggal Persetujuan ini atau yang menggantinya. (iii) keuntungan-keuntungan

pengaturan istimewa yang
diberikan oleh kedua Pemerintah dalam setiap rencana per-

luasan kerjasama perdagangan dan ekonomi secara global, regional atau sub-regional antara negara-negara yang sedang berkembang dimana masing-masing Pihak sudah atau akan menjadi salah satu peserta. PASAL
III
Tanpa mengurangi ketentuan-ketentuan Pasal II, masingmasing Pemerintah akan memberikan kepada kapal-kapal dagang pihak lainnya pada waktu memasuki pelabuhan, berlabuh dan membongkar muatan kepelabuhan-pelabuhannya, perlakuan yang sama menguntungkannya dengan yang diberikan kepada kapal-kapal dagang berbendera negara ketiga sesuai undang-undang, ketentuan-ketentuan dan peraturan-peraturan yang bersangkutan. Pasal ini tidak berlaku untuk perdagangan pantai atau antar pulau dari salah satu Pihak. PASAL
IV
Semua pembayaran dalam rangka Persetujuan ini akan dilakukan dalam mata uang yang bebas dipertukarkan yang dapat diterima oleh kedua negara, sesuai dengan undang-undang dan peraturan-peraturan yang berlaku dari waktu ke waktu dikedua negara .

V
Kedua Pemerintah setuju untuk memberikan fasilitasfasilitas untuk penyelenggaraan Pameran-pameran dan Pertun-

jukan-pertunjukan dagang dan kunjungan-kunjungan pengusahapengusaha dan delegasi-delegasi dagang, sesuai dengan undang-undang dan peraturan-peraturan mereka masing-masing.

PASAL
VI
Untuk melancarkan pelaksanaan Persetujuan ini, kedua Pemerintah setuju untuk saling berkonsultasi mengenai setiap persoalan yang berhubungan dengan perdagangan antara kedua

negara. Untuk maksud ini, suatu pertemuan konsultasi yang dihadiri oleh wakil-wakil kedua Pemerintah dapat diadakan atas permintaan salah satu Pihak pada waktu yang cocok yang

disetujui oleh kedua belah Pihak. PASAL
VII
Persetujuan ini akan berlaku sementara pada hari penandatanganan.
Persetujuan ini akan berlaku tetap pada
tanggal kedua belah Pihak saling mempertukarkan surat-surat pemberitahuan bahwa persyaratan

mereka masing-
masing untuk berlakunya Persetujuan ini telah dipenuhi dan akan tetap berlaku terus untuk jangka waktu satu tahun sejak pertukaran surat-surat pemberitahuan: kecuali jika salah satu Pihak telah memberitahukan secara tertulis kepada Pihak lain tentang keinginannya untuk mengakhiri Persetujuan ini tiga bulan sebelum berakhirnya jangka waktu satu tahun tersebut, maka Persetujuan ini dianggap secara otomatis diperpanjang untuk satu tahun dan seterusnya untuk jangka waktu masingmasing satu tahun sesuai dengan prosedur yang sama mengenai pengakhiran berlakunya Persetujuan ini. SEBAGAI BUKTI, yang bertandatangan dibawah ini yang dikuasakan oleh Pemerintah mereka masing-masing telah menandatangani Persetujuan ini. DIBPAT dalam rangkap dua di Jakarta pada tanggal 3 Juni

tahun 1978, dalam bahasa Indonesia, bahasa Hindi dan bahasa Inggeris.

TRADE AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF INDIA
I The Government of the Republic of Indonesia and the
I
Government of the Republic of India, being desirous of promoting trade and economic relations between the two countries on the basis of principle of equality and mutual benefit, have agreed as follows ARTICLE
I
I
The Government of the Republic of Indonesia and the Government of the Republic of India shall within the framework of their respective laws and regulations in force take all appropriate measures to facilitate, strengthen, maximise and diversify trade between the two countries. ARTICLE (1)
II
Both Governments agree to accord to each other in
matters of trade no less favourable treatment than that accorded to any other country, particularly as regards customs rules and formalities, customs duties and charges of any kind and regulations governing the importation and exportation of goods/commodities. (2)
The provisions of paragraph (1) of this Article shall
not preclude the considering by the Indonesian Government of preferential arrangements in trade among ASEAN countries. (3)
The provisions of paragraph (1) of this Article shall
further not preclude the maintenance or further consideration by either Government of : (i)
privileges which are or may be granted by either of the Contracting Parties to facilitate frontier trade;
(ii)
preferences, advantages, privileges or immunities accorded by either Contracting Party to any third
- 2 country existing on the date of this Agreement or in replacement thereof (iii) advantages or preferences accorded by either Government under any scheme for expansion of trade and economic cooperation among developing countries on a global, regional or sub-regional basis to which i t is or i t may become a party. ARTICLE
III
Without prejudice to the provisions of Article II, each Government shall grant merchant vessels of the other party while entering, putting off and lying at its ports, most-favoured-nation treatment accorded by the respective laws, rules and regulations, to the merchant vessels under the flag of any third country. This Article does not apply to coastal or interinsular trade of either Party. ARTICLE
IV
All payments under this Agreement shall be made in freely convertible currency acceptable to both countries in accordance with the laws and regulations in force from time to time in the two countries. ARTICLE
V
Both Governments agree to accord, subject to their respective laws and reg ulations, facilities for the holding of Trade Fairs and Exhibitions and visits of businessmen and trade delegations. ARTICLE
VI
In order to facilitate the imp lementation of this Agreement, both Governments agree to consult each other in respect of any question in connection with the trade between the two countries.

For this purpose a consultative meeting attended by representatives of both Governments may be held, upon the request of one of the Contracting Parties at a convenient time agreed upon by the Parties. ARTICLE'
VII
This Agreement shall enter into force provisionally on the day of the signing of this Agreement.
It will
definitively enter into force on the date that the Parties exchange notifications with each other that their constitutional requirements for the entering into force of the Agreement have been fulfilled and shall remain in force for a period of one year following the exchange of notifications; unless one of the Parties has notified the other in writing of its intention to terminate this Agreement three months prior to the expiration of the aforesaid period of one year, it shall be considered as automatically extended for another year and thereafter, subject to the same procedure with respect of its termination, for further successive periods of one year each. IN WITNESS WHEREOF the undersigned, being duly authorised by their respective Governments, have signed this Agreement. DONE in duplicate at Jakarta on of June 3, 1978, in the Indonesian, Hindi and English languages.
In case of
