) Pemerinteh Republik Indonesie dan Pemerintah Republik Deookrasi P.akjat Korea berkeinginan w1tuk memperkembang dan memperluas hubungan dagang antera Indonesia dan Republik Demokrasi Rakjat Korea, ates dasar

dan
keuntungan timbal-balik, tele.h menjetudjui sebagai berikut :
PASAL I Kedua Pemerintah akan mengambil tindakan2 jang diperlukan untuk memperkembang perdagangan antara kedua. negara dan memberikan masing2 izin impor/ekspor seperlunja, chususnja mengenai barang2 a.tau bahan2 sebagai diutarakan dalam daf'tar "A" dan "B" jang dilampirkan pada persetudjuan ini. Ketentuan2 dalam Persetudjuan ini tidak mengandung larangan untuk melakukan perdagangan barang2 dan bahan2 jang tidak
terte~a
pada daftar tersebut.
PASAL II Kedua Pemerintah akan berusaha untuk memperluas volume perdagangan seluruhnja antara mereka, dengan djalan menjediakan satu sama lain, barang2 dan djasa.2 jang dihasilkan oleh masing2 negara de.n memberi keuntungan timbal-balik. PAS.AL
III
Kedua Belah Fiha.k menjetudjui bahwa pertukaran barang2 atau bahan2 tunduk pad.a dan dilaksanakan dalam rangka paraturan
impor-~kspor
umum jang
berlaku di-masing2 negare selama berlakunja Persetudjuan ini.
PASAL IV Kedua Belah Fi.hak menjetudjui untuk memberikan pad.a masing2 Fihak perlakuan jang tidak kurang menguntungkan dalam hubUilBan perdagangan antara kedua negara, seperti a.pa jang diberikan kepada lain negara, chususnja mengenai peraturan2 dan formalitas2 pa.bean, bea-tjukai, padjak2 dan berbagai matjam pungutan, peraturan2 jang mengatur impor dan ekspor barang2 atau bahan2, maupun tatatjara pemerintah izin impor dan ekspor.
PASAL V Penjerahan barang2 antara Republik Indonesia dan Republik Demokrasi Rakjat Korea akan dilaksanakan atas dasar kontrak2 jang diselenggarakan antara

- 2 perusahaan2 dan firma.2 berkedudukan di Republik Indonesia jang mempunjai pengesahan untuk mele.kukan perda.gangan luar negeri disatu fibak, den dilain fihak perusahaan2 dan firma.2 berkedooukan di ReJ.llblik :Demokrasi Rakjat Korea jang men'punjai pengesaha.n pula seperti tersebut diatas. Perusahaan dan firma2 tersebut diatas mempunjai kedudukan sebagai baian hukum jang berdiri sendiri, sesuai dengan masing-me.sing hukum jang berlaku dinegara dimana mereka mempunjai kedudukan itu. Mereka bertanggung djawab penuh atas transaksi2 commercil jang diselenggarakannja. PASAL
VI
Kedua Belah Fihak menjetudjui bahwa harga2 bahan2 jang akan diserahlmn menurut persetudjuan ini, sedapat mungkin ditentukan atas dasar harga2 pa.saran dunia untuk bahan2 jang sama. jang diperoleh pada waktu kontrak2 tersebut diselenggarakan. Djika tidak tersea.ia harga.2 pa.saran dunia untuk barang2 atau bahan2 tertentu, akan disetudjui harga2 jang bersaingan. PAS.AL VII
Untuk manperkemba.ng perdagangan internasional1 Kedua Belah Fihak akan mengambil tinclakan-tindakan untuk manpermudah perdagangan atas dasar multilateral.
PASAL VIII Pengapalan barang2 dan bahan2 dari Republik Indc:nesia ke Republik Demokrasi Rakjat Korea atau dari Republik Demokrasi Rakjat Korea ke Republik Indonesia sejogjanja dilakukan oleh armada komersil nasional dari Kedua Belah Fihak menurut Persetudjuan ini. PASAL

Kapal2 dtiga11g. dari nega.ra2 Fihak kesatu jang masuk, membongkar den berlabuh di pelabuhan negara lain, akan mendapa t per lakuan j ang tidak kura.ng menguntungkan dari.pada apa jang diberikan menurut undang-w1dang dan peraturan2 masing2 negara kepada kapal2 dagang jang berlaja.r dengan bendera negara ketiga. Semua pembajaran antara kedua negara akan dilakukan dalam Pound Sterling . jang konpertibel dan bebas. Dalam ha.12 tertentu, dan djika oleh Kedua ]Selah Fihak disetudjui, maka pembajaran d.apat pula. dilakukan de.lam ma.ta uang lain.

PASAL XI

Bank Inaonesia dan The Foreign Trade Bank of the Democratic People's
Republic of Korea bersama-sama akan menentukan semua technical details jang diperlukan, supaja Persetudjuan ini dapat dilaksanakan setjara effektip.
PASAL XII Untuk mempermudah pelaksanaan Persetudjuan ini, Kedua Belah Fihak setudju untuk mengadakan konsoltasi satu sama lain mengenai persoalan2 jang timbul dari atau jang berhubungan dengan perd.agangan antara kedua negara. Untuk maksud ini akan dibentuk Panitya Bersama jang atas permintaan salah satu Fihak akan
menga~an
sidang di Dje.karta atau di Pyongyang pada
waktu jang disetudjui kedua belah fihak dan ti.dak melampaui 45 hari sesudah permintaan tersebut diadjukan.
PASAL XTII Persetudjuan ini berlaku untuk djangka waktu satu tahun.
Djika salah satu Fihak tidak memberitahukan setjara tertulis niatnja untuk mengachiri Persetudjuan ini, tiga bulan sebelum berachirnja, maka Persetudjuan ini dengan sendirinja dianggap sebagai diperpandjang setiap kalinja untuk djangka waktu satu tahun.
J Ketentuan2 jang diutarakan dalam Persetudjuan ini untuk sementara mulai berlaku pada hari ditanda-tanganinja. Ketentuan2 itu akan berlaku sesungguhnja setelah diadakan pertukaran Nota antara kedua Pemerintah dan akan tetap berlaku untuk djangka waktu satu tahun sedjak tanggal pertukara.n Nota. AGREEMENT between

THE GOVERNMmT OF THE REPUBLIC OF INDONE:>IA AND THE GOVERNMENT OF THE DEMOCRATIC PEOPLE ' S REFUBLIC OF KOREA.
The Government of the Republic of Indonesia and the Government of the
Democratic People's Republic of Korea, desirous of promoting and expanding trade relations between the Republic of Indonesia and the Democratic People's Republic of Korea based on the principle of equality and mutual benefit, have agreed as follows : Article I . The two Governments will take all appropriate measures to promote trade between the two countries and to grant each other the respective import/export licences, in particular with regard to the goods or commodities mentioned in lists "A" and "B" attached to this Agreement. Nothing in this Agreement shall be deemed to preclude trade in goods or commodities not mentioned in the said lists. Article
II.
The two Governments shall endeavour to expand the total volume of trade_ between them by supplying to each other goods and services produced by each country that are mutually advantageous to them. Article
III.
The Contracting Parties agree tblt the exchange of goods or commodities shall be subject to and effected within the scope of the general import-export regulations in force in each country during the validity of this Agreement. }.rticle
IV.
The Contracting Parties agree to grant each other no less favourable treatment in trade relations between the two countries than that applying to any other country, in particular as regards : customs rules and formalities, customs duties, taxes and charges of any kind, regulations governing the import and export of goods or commodities, as well as with regard to the procedure governing import and export licences. Article V. Deliveries of goods between the Republic of Indonesia and the Democratic People's Republic of Korea will be carried out on the basis of

contracts to be concluded between the enterprises and firms domiciled in the ! Republic of -----J-'

Indonesia, authorized to participate in foreign trade on the one ham, and

tho enterpriHs and firms domiciled in the Democratic People's Republic of
Korea, authorized thereto on the other.
The above mentioll8d enterprises and :firms, in accordance with the respective laws o:f the States in which they are domiciled, have the status o:f
independent juridical persons. They are :f'ully responsible :for their commercial transactions. Article VI.
Both Parties agree that the prices for the conmodities to be delivered according to this Agreement shall be :fixed when ever possible .on the basi.s o:f world-market prices :for similar commodities, prevailing at the time the said contracts are concluded. In case of non-existance of world-market prices for certain goods er commodities, competitive prices shall be agreed upon. Article
VII.
In order to promote international trade both Contracting Parties will taka all appropriate measures to :facilitate trade on a multilateral basis.
Article VIII. The shipping of goods or oommodities fran the Republic of Indonesia to
the Democratic People's igpublio o:f Korea or from the Democratic People's Republic of Korea to the Republic of Indonesia will be done preferably by the commercial fleets o:f both Parties to the Agreement.
Article IX. Merchant vessels of one country while entering, putting ott and ]3:1.ng at the ports o:f the other country, will enjoy treatment no less favourable than that accorded by their respective laws, rules and regulations to tbs vessels under the :flag of any third country. Article X.

All payments between the two countries shall be effected in tree transferable Pound Sterling. In particular cases, and i t agreecl upon by both Contracting Parties, ~nts 88\Y alao be effected in another currency. All contracts, invoicea, clratt etc. ab.all therefore be expressed. either in Pound Sterling or in aqy other currency as the case may be.

- 3 Peopl.e's Republic o:f' Korea shall by mutual agreement establish all technical details necessary for the effective f\mctioning of the present Agreement.
Article XII. In order to :facilitate the implementation ot this Agreement, both Con-
tracting Parties agree to consult each other in respect ot &%\Y matter arising :t'rom or in connection with the trade between the two countries. For thia purpose they will :t'orm a Joint Committee which will meet at the request of either Contracting Party at a convenient date after mutual. consent and not later than
45 days after the request to that ef'fect bas been made,
either in Djakarta or in Pyongyang. Article XIII. This Agreement shall be valid :f'or a period of one year. In case neither of the Contracting Parties shall have ,given notice three
months before the expirations of said period of its intention to terminate this Agreement, it will by tacit understanding be prolonged each time tor another period of one year. The provisions set forth in thi.s Agreement shall cme into force provisionally on the day of the signing of thi3 Agreement. Tru,will definitely come into force after an exchange of notes to th.at e:ffect between the two Governments and shall remain in force for a period o:f' c:meyear.
