Voorzitter Kapt. Alain Pels opent de vergadering die uitzonderlijk doorgaat in Restaurant “Captain’s Lounge”, Beatrijslaan 27, te 2050 Antwerpen. Verkiezing van een deel van het bestuur De stembiljetten worden uitgedeeld waarop 11 namen vermeld staan voor 11 open mandaten. De volgende uittredende bestuursleden hebben zich herkiesbaar gesteld: Tom Aga*, Thierry Coornaert*, Jef Cuyt, Ignace De Cauwer*, Claude Maerten, Jef s’Jegers*, Davy Vanderplasschen. Marc Esmé De Cocker stelde zijn mandaat ter beschikking. Er werden vier nieuwe kandidaturen ingediend: Rodrigue Bijlsma*, Elvira Deleu*, Thomas Goethals, Tim Heiremans. (* = varende leden) Kapitein Jean-Paul Lechat en Marc Sohie worden aangesteld als stemopnemers. Er worden 32 stemmen uitgebracht: 24 aanwezige leden, 2 volmachten, 6 leden stemden per brief. Alle kandidaten worden gekozen, in volgorde van verkregen stemmen: J.Cuyt (26), T.Aga* (24), E.Deleu* (24), I. De Cauwer* (23), D.Vanderplasschen (23), C.Maerten (22), J.’s Jegers* (22), T.Goethals (21), T.Heiremans (21), T.Coornaert* (19), R.Bijlsma* (11). Applaus. Goedkeuring Jaarverslag 2012 De tekst van het Jaarverslag 2012, voorgedragen op de Jaarlijkse Algemene Vergadering van 5 maart 2013, en gepubliceerd in de Nautilus van april 2013, wordt door de Algemene Vergadering goedgekeurd. Jaarverslag 2013 Voorzitter Kapt. Alain Pels draagt vervolgens afwisselend in het Nederlands en in het Frans het jaarverslag over 2013 voor dat op applaus wordt onthaald. Financieel verslag 2013 Het financieel verslag over het boekjaar 2013, opgesteld door Schatbewaarder Davy Vanderplasschen wordt voorgedragen en toegelicht door de Schatbewaarder. Het bedrijfsresultaat (algemeen beheer) 2013 afgesloten met een negatief saldo van € 1.376,62. Hierbij dient echter € 8.304,10 aan uitgaven worden toegevoegd voor eenmalige kosten De schatbewaarder wordt door de voorzitter en door de secretaris-generaal bedankt voor de nauwkeurigheid waarmee dit verslag werd opgesteld. Verslag rekeningtoezichters De hh. Kapt. Jean Lechat en Kapt. Marc Proost zijn opgetreden als rekeningtoezichters en hebben daarbij vastgesteld dat alle cijfers uit de boekhouding overeenkwamen met de werkelijkheid en een juiste weergave waren van de kastoestand. Zij stellen bijgevolg aan de Algemene Vergadering voor om voor het jaar 2013 décharge te verlenen aan het Bestuur. Voor het jaar 2014 worden Kapt. J.Lechat en Kapt. M.Proost opnieuw als rekeningtoezichters aangesteld. Leden met 50 jaar lidmaatschap Dit jaar zijn er geen leden met 50 jaar lidmaatschap. Erelid Met algemene stemmen wordt voor het jaar 2014 voorgedragen als erelid: de heer Peter Verstuyft, directeur van de Koninklijke Belgische Redersvereniging, omwille van zijn grote verdiensten ten gunste van de bemanningen van Belgische koopvaardijschepen, en de goede verstandhouding met het KBZ Jaarlijks diner Op het daaropvolgend jaarlijks diner dat doorgaat in Restaurant “Captain’s Lounge” dankt Voorzitter Pels in zijn gelegenheidstoespraak de sponsors dank zij wiens steun dit exclusief diner mogelijk was. In zijn gelegenheidstoespraak dankt het nieuwe erelid P. Verstuyft het KBZ voor de eer hem toebedeeld. Vervolgens schetst hij zijn loopbaan in de maritieme sector, beginnend bij de Boelwerf tot zijn huidige functie bij de Belgische Redersvereniging. Tijdens het diner ontvangen Voorzitter Alain Pels en Secretaris-Generaal Jef Cuyt uit handen van de voorzitter van de Franse kapiteinsvereniging ACOMM, Capitaine Yannick Lauri, de onderscheiding van “Chevalier d” l’Ordre du Mérite Maritime”. Le président Capt. Alain Pels ouvre la réunion qui a lieu exceptionnellement au Restaurant « Captain’s Lounge », Beatrijslaan 27, à 2050 Anvers. Election d’une partie du Conseil d’Administration Les bulletins sont distribués sur lesquels 11 noms sont marqués pour 11 mandats vacants. Les membres du conseil démissionnants suivants se sont portés rééligibles: Tom Aga*, Thierry Coornaert*, Jef Cuyt, Ignace De Cauwer*, Claude Maerten, Jef s’Jegers*, Davy Vanderplasschen. Marc Esmé De Cocker met son mandat à disposition. Quatre nouveaux membres se sont portés candidats : Rodrigue Bijlsma*, Elvira Deleu*, Thomas Goethals, Tim Heiremans. (* = membres navigants) Le Capitaine Jean-Paul Lechat et Marc Sohie sont nommés compteurs de voix. 32 Voix valables sont enregistrées: 24 sur place, 2 par procuration, et 6 par lettre. Tous les candidats sont élus, dans l’ordre des voix obtenues: J.Cuyt (26), T.Aga* (24), E.Deleu* (24), I. Approbation de Rapport Annuel 2012 Le texte du Rapport Annuel 2012, présenté à la Réunion Générale Annuelle du 5 mars 2013 et publié dans le Nautilus d’avril 2013 est approuvé par la Réunion Générale. Rapport annuel 2013 Ensuite, le Président Capt. Alain Pels présente alternativement en français et en néerlandais le rapport annuel 2013 qui est accepté avec des applaudissements Rapport financier 2013 Le rapport financier sur l’année 2013 rédigé par le Trésorier Davy Vanderplasschen, est présenté et commenté par le Trésorier. Le résultat général de 2013 montre un solde négatif de € 1.376,62, auquel doit être ajouté un coût de € 8.304,10 comme dépenses uniques. Le trésorier est remercié par le président et le secrétaire général pour la précision avec laquelle le rapport a été rédigé. Rapport des contrôleurs des comptes Capt. Jean Lechat et Capt. Marc Proost ont exercé la fonction de contrôleurs des comptes et ont constaté que tous les chiffres de la comptabilité correspondaient avec la réalité et donnaient une image exacte de la situation financière. Par conséquent ils proposent à l’ Assemblée Générale d’accorder décharge au Conseil d’Administration pour l’année 2013. Les Capt. J-P.Lechat et M. Proost sont nommés à nouveau contrôleurs des comptes pour l’an 2014. Membres avec 50 ans d’affiliation Cette année-ci il n’y a pas de membres avec 50 ans d’affiliation. Membre d’honneur A l’unanimité la Réunion Générale approuve la nomination de Mr. Peter Verstuyft, directeur de l’Union Royale des Armateurs Belges, comme membre d’honneur du CRMB, en vue de son grand mérite en faveur des équipages de la Marine Marchande Belge, et ses bonnes relations avec le CRMB. Dîner annuel Au dîner annuel qui eut lieu à l’issue de la Réunion Générale au Restaurant « Captain’s Lounge » le Président Pels remercie les sponsors pour leur appui qui rendit possible ce dîner exclusif. Dans son discours d’acceptation, le nouveau membre d’honneur P.Verstuyft remercie le CRMB pour cette honneur particulière lui accordée. Ensuite il fait un aperçu de sa carrière dans le secteur maritime, depuis le Chantier Boel jusqu’à sa fonction actuelle comme directeur général de URAB. Lors du dîner, le Président Alain Pels et le Secrétaire Général Jef Cuyt reçurent des mains du Capitaine Français Yannick Lauri, Président de l’ACOMM, la nomination au grade de « Chevalier de l’Ordre du Mérite Maritime ». Geachte leden, chers membres, 2013 is het jaar dat het collectief geheugen zal ingaan als de viering van 150 jaar Scheldevrij, maar ook als het jaar van het vergaan van onze laatste echte “Congoboot”; de “Charlesville”. Ook viel onze secretaris-generaal op 2 oktober l.l. de eer te de beurt om de 107 promotie “nautische wetenschappen” naar hem vernoemd te worden als „Promotie Kapitein Jozef “Jef” Cuyt‟. 1. MEMBRES Un court appercu de l’évolution du chiffre : fin 2009 : 318 membres fin 2010 : 324 membres fin 2011 : 336 membres fin 2012 : 323 membres fin 2013 : 320 membres Cette année : nous avons 25 nouveaux membres contre 4 décès, 12 démissions et 12 membres n’ayant pas renouvelé leur affiliation sans aucune notification. Le Conseil d’Administration ne proposa à l’Assemblée Générale en date du 5 mars 2013, aucune candidature pour membre d’honneur. Cette année je ne peux vous présenter aucun membre avec 50 ans d’affiliation. 3. INTERN BELEID Volgende onderwerpen werden op de maandelijkse vergaderingen regelmatig besproken : -

4. ACTIVITES – CAUSERIES 4.1 Je suis fier de pouvoir vous anoncer que l’année écoulée nous avons encore une fois - cela devient une tradition organisé une soirée informations pour les « étudiants maritimes » au sens large, début mars dans les locaux de Stella Maris à Anvers. Non seulement étaient représentés les départements “pont” et ”machine” de l’ESNA, mais il y avait aussi des membres d’autres institutions présents pour discuter métier avec les représentants des armements. 4.2 Nous continuons à soutenir le bon fonctionnement des Alumnis de l’ESNA 4.3 Nous étions présents lors de la journée “portes ouvertes” à l’ESNA, avec nos nouvelles bannières 4.4 Suite à la décision du conseil de l’an dernier, nous n’avons organisé que deux conférences annuelles :. - le 25 juin 2013 à 17hr30 à l’ESNA , conjointement avec: la LMB, l’ARMB, URAB, et le BVZ, avec comme sujet “Pirates – Private Armed Guards – what next?” par : mlle Elle De Soomer, mr. Peter Van den Wouwer & mr. Stephen Askins - le 24 octobre 2013 à 20hr00 à l’ESNA , conjointement avec le Koninklijk Gallois Genootschap, ayant comme sujet: “Uitdagingen van de Prestige” par notre secrétaire –général, le capt.a.l.c. Jef Cuyt. 5. EXTERN BELEID - IFSMA : de 39° J.A.V. werd gehouden op 16 en 17 april 2013 te Melbourne (Australia) Onze secretaris-generaal kapt. Jef Cuyt kreeg van het bestuur het mandaat om er het College te vertegenwoordigen. Uitgebreid verslag kon u nalezen in de Nautilus van juni. - CESMA : de 18° J.A.V. werd gehouden op 10 en 11 mei 2013 te Nantes (France) Secretaris-generaal kapt. Jef Cuyt kreeg ook hier het mandaat van het bestuur om er het College te vertegenwoordigen. Uitgebreid verslag kon u nalezen in Nautilus van juli. - HZSA : ook dit jaar waren er weer meer inschrijvingen dan vorig jaar. Het leerlingenaantal voor het schooljaar 2012/2013 de steeg met 12 % t.o.v. het vorige jaar. En we kregen er een 3 doctor in de nautische wetenschappen bij ! Mevrouw Helen Verstraete verdedigde haar doctoraatsthesis “Invloed van de staalkwaliteit op de corrosie in ballasttanks” op 29 maart 2013 met succes. Het KBZ tracht, traditiegetrouw, ook aanwezig te zijn op talrijke binnenlandse maritieme huldigingen. Zo werd ook dit jaar deelgenomen aan : - de naamgevingceremonie van de nieuwe promoties dek en machine aan de HZS - de plechtige opening van het werkjaar van de Koninklijke Belgische Marine Academie - de herdenkingsplechtigheid van de ramp met het o/s “Comte de Smet de Nayer” - de kransneerlegging tijdens de “Dag der Zeelieden” Verder was het College vertegenwoordigd op volgende vergaderingen : - JAV Belgische Zeevaartbond – Ligue Maritime Belge - JAV Koninklijk Gallois Genootschap - JAV Koninklijke Belgische Marine Academie - JAV Vrienden van het Nationaal scheepvaartmuseum 6. COMMUNICATION Hors notre mensuel “NAUTILUS” qui se porte toujours très bien, même financièrement, nous avons remodelé notre site et avons mis en activité une page Facebook, qui connait un succès parmi nos membres les plus jeunes ! It can accommodate nearly 6,300 passengers and 2,394 crew members ― the equivalent of a small town towering over the clear blue waters of the Caribbean Sea. It measures 1,188 feet long. Its sister ship, the Oasis of the Seas, is two inches shorter. Experts point out that larger ships have larger challenges. For instance, they have fewer options in an emergency, said Michael Bruno, dean of the engineering school at the Stevens Institute of Technology in Hoboken, N.J., and former chairman of the National Research Council’s Marine Board. “Given the size of today’s ships, any problem immediately becomes a very big problem,” he said. “I sometimes worry about the options that are available.” A recent report by the Coast Guard on the Splendor fire revealed glaring problems with the crew’s firefighting abilities as well as failures in fire safety equipment. The investigation did not address the size of the ship, which carried 3,299 passengers. But it showed that big vessels can quickly become crippled by small fires that disable complex systems. No passengers were hurt, but the damage to the engine room was severe, disabling the ship’s power and forcing it to be towed to port in San Diego. The investigation found a wide range of problems with the engine’s maintenance history as well as missing fire safety records. No fire drills had been conducted in the engine room for six months. Emergency sprinklers were turned off by mistake and then doused the wrong parts of the engine room. Believing the fire had been contained, the captain vented the engine room to clear out the smoke. He reignited the fire instead. These incidents have brought new attention to the behavior of cruise operators. Rear Adm. Joseph Servidio, the Coast Guard’s assistant commandant for prevention policy, said at a Senate hearing in July that the three fires, including the one aboard the Splendor, “highlight serious questions about the design, maintenance and operation of fire safety equipment on board these vessels, as well as their companies’ safety management cultures.” In July, the Coast Guard said cruise ships would need to conduct periodic engine-room fire drills. The risks of building bigger ships became apparent over a decade ago, as cruise companies pushed the limits of naval architecture. The head of the International Maritime Organization, the United Nations agency in charge of marine regulations, warned in 2000 of the growing hazards of building larger ships and called for a comprehensive review of safety rules, known as Safety of Life at Sea, or Solas. William O’Neil, the group’s secretary general at the time, said the industry could not “rely on luck holding indefinitely.” One result was a set of new global regulations in 2010 called the Safe Return to Port rules. Those require new ships to have sufficient redundant systems, including power and steerage, to allow them to return to port even in the worst emergency. Only about 10 ships built since then comply with this new rule. “The idea is that a ship is its own best lifeboat,” said John Hicks, the vice president for global passenger ships at Lloyds Register, the largest ship classification society. “The idea is to do everything to keep the crew and passengers on a vessel.”

Bud Darr, the senior vice president for technical and regulatory affairs at the Cruise Lines International Association, the industry’s trade group, said today’s ships operated under layers of oversight. The Coast Guard inspects each ship that calls at United States ports at least once a year and enforces national and international norms. Private auditors, hired by cruise operators, perform frequent safety reviews, including comprehensive annual checks that last seven to 10 days, he said, and flag countries like the Bahamas or Panama, where most cruise ships are registered, provide their own oversight. “We are subject to very close scrutiny,” Mr. Darr said. “The standards are universal.” But incidents like the Costa Concordia grounding have raised questions about whether evacuation regulations are still applicable in the age of megaships. Under the Solas regulations, for instance, passengers grouped at their muster stations must be able to evacuate on lifeboats within 30 minutes of an evacuation alarm. 124

The investigation into the Costa Concordia revealed that the crew and its captain failed to sound the general evacuation alarm for more than an hour after rocks had breached the hull. As a result, some lifeboats could not be lowered once the ship started to list. After the accident, cruise operators said they would change muster drill procedures. Instead of holding a drill for passengers within 24 hours of departure, cruise ships said they would do so before ships leave a port. While ships are becoming bigger, the burden on crew members is growing. The Queen Elizabeth 2, which was launched in 1969, had one crew member for about 1.8 passengers. On the Triumph, the ratio was one crew member for every 2.8 passengers. The issue is also complicated by language and communication problems, and a high crew turnover rate that can reach 35 percent a year. The International Transport Workers’ Federation, which represents seafarers and crew members, has expressed concerns about the evacuation time and suggested the need to limit the number of people aboard ships, depending on where they operate and what search-and-rescue facilities are available. “Experience has cast doubt on the adequacy of existing lifesaving appliances,” the group said in a report. “The current equipment, especially lifeboats and life rafts, has proved to be inadequate when confronted with high sea states.” Safety rules also state that lifeboats should not carry more than 150 people. But the two largest ships, the Allure of the Seas and the Oasis of the Seas, have much bigger lifeboats, for 370 people, because of a provision of the 2010 rules that allows for exemptions if the cruise line can demonstrate an equivalent level of safety. Those bigger lifeboats have only enough room for passengers. To evacuate the more than 2,300 crew members, the ships are equipped with inflatable rafts that would have to be entered through 59-foot evacuation chutes. “The simple problem is they are building them too big and putting too many people aboard,” said Capt. William H. Although use of a combination ladder is very beneficial in reducing the height of climb to a maximum of 9m, it does unfortunately add another potential obstacle where the embarking pilot must transfer from the pilot ladder to the accommodation ladder (or vice versa when disembarking). This is particularly hazardous if the pilot ladder and/or the accommodation ladder are hanging freely (not connected to the ship's side). The problem may be further aggravated if the vessel has a list, is operating in strong winds or has not been able to provide an adequate lee course. … Where a combination arrangement is used, SOLAS V Regulation 23 states quite clearly: ‘The accommodation ladder shall be sited leading aft. When in use, means shall be provided to secure the lower platform of the accommodation ladder to the ship’s side, so as to ensure that the lower end of the accommodation ladder and the lower platform are held firmly against the ship’s side.' Furthermore, the regulation goes on to specify, ‘...when a combination arrangement is used for pilot access, means shall be provided to secure the pilot ladder and manropes to the ship's side at a point of nominally 1.5m above the bottom platform of the accommodation ladder.’ The relevant dates of application for the items covered by the SOLAS V regulation are clearly stated within the regulation. They do not make reference to vessels being built before or after 1 July 2012, but they do make reference to 'Equipment and arrangements for pilot transfer installation dates’. If it is logically accepted - and referred to by industry guidelines and in current legislation - that when referring to a combination ladder arrangement, this should include the accommodation ladder and the pilot ladder with its associated equipment. If any part of the arrangement is renewed or replaced, then the whole system becomes a new arrangement and it should under the regulations ‘in so far as is reasonable and practicable’ be required to comply with the rules for post-July 2012 installation. This includes requiring the accommodation ladder and the pilot ladder to be secured to the ship’s side. Many shipping companies and a number of flag states are continuing to mistakenly read the renewed Regulation 23 and interpret that it is only applicable for vessels built after July 2012. One common reason given for the wish to disregard the spirit of the regulation is the perceived difficulty for the ship's staff to secure the lower platform of the accommodation ladder to the ship's side. Unfortunately there have been occasions where ship's crew have been fatally injured during the operation of rigging pilot ladders. Lt must be stressed that each rigging of a pilot ladder arrangement must involve the completion of a risk assessment lo ensure that it is safe, for both the pilot and the ship's crew. There are available a number of inexpensive pieces of commercially produced equipment which have been developed to enable both the accommodation ladder and pilot ladder (and its manropes) to be safely secured to the ship’s side. These specially-designed securing arrangements have integral magnetic or hydraulic systems to attach to the ship's side. These then provide an independent lashing point for making fast the accommodation ladder, the pilot ladder and manropes. Portable securing devices give a great advantage over the previous arrangements, where one option was the use of inset securing points which had to be built into the ship's hull. Their ease of use means they are particularly useful for large tanker or bulk vessels, since ladder securing arrangements can be easily rigged at various heights to allow for the different conditions of draft and trim encountered for loaded, partially loaded or ballast conditions. Because the units are not fixed, the vessel's hull remains free of hull protrusions which could foul locks, berths or associated fenders. It must be appreciated that pilots have to take responsibility for their own and their colleagues’ safety. lf pilots are presented with a poorly constructed or poorly maintained ladder or of the arrangement is not correctly rigged, they are duty bound to report this deficiency to the proper authorities and, importantly, are not required to use the presented illegal access installation. For a pilot who is given a ladder with a climb of more than 9m, this should be considered a reportable incident. If subsequently, the vessel cannot demonstrate its ability to rig a compliant pilot transfer arrangement, it will be considered to be in breach of the SOLAS Convention and may be subject to detention until the defect is rectified. In addition, delay to the ship will be incurred whilst immediate arrangements are made by the ship’s staff to enable compliant arrangements to be made. It is only when all parties involved in the embarkation and disembarkation of pilots are fully committed to complying with pilot transfer regulations that the potential risks can be identified and reduced to the minimum possible. Further, and as instructed by the Committee (MSC 75/24, paragraph 18.41), the Secretariat has, since July 2002, started classifying separately any reported incidents of piracy and armed robbery at sea (international or territorial waters) vis-à-vis acts of armed robbery allegedly committed in port areas, as well as attempted acts of armed robbery. …

5. The number of acts of piracy and armed robbery against ships, which were reported to the Organization to have occurred or to have been attempted in 2013, was 298, a decrease of 43 (12.6%) over the figure for 2012. 6. From the information referred to above, it emerges that the areas most affected in 2013 were the South China Sea, West Africa and the Western Indian Ocean (Arabian Sea, East Africa, the Persian Gulf and the wider Indian Ocean), followed by South America and the Caribbean and the Mediterranean Sea. Following the trend in 2012, the number of incidents caused by Somalia-based pirates has further fallen to 20, significantly lower than the 78 incidents reported in 2007 when Somalia-based piracy started to develop. No merchant ship was reported hijacked in the Somalia-based High Risk Area in 2013. However, Somali pirates still hold approximately 64 personnel captive ashore – most of them from ships which had been released. 130

7. A significantly high number of attacks again occurred in the South China Sea where 142 reports were made to the Organization compared with the 90 incidents reported for 2012. Incidents that have occurred in the waters of the Philippines and Indonesia are categorized as South China Sea incidents and not as Indian Ocean incidents in order to distinguish them from pirate-activities westerly of the Indian Sub-continent. In 116 of the 142 reported incidents the pirates/armed robbers have either deployed actual force against the crew or have threatened them with violence. 8. The number of reported acts of piracy and armed robbery in the Gulf of Guinea (West Africa) decreased to 54, compared with 64 incidents reported in 2012 and 61 incidents reported for 2011. However, 9 ships have been reported hijacked (and subsequently released) to the Organization. 9. The number of reported acts of piracy and armed robbery in South America and the Caribbean has fallen to 17 incidents, compared with 21 reported for 2012. Eight incidents were reported for the Mediterranean Sea with most of them taking place at the ports near the entrance to the Suez Canal. One incident occurred in the North Atlantic Ocean. 10. More than 60% of the attacks worldwide were reported to have occurred or to have been attempted in port areas, largely due to increased armed robbery activity in the waters off the Philippines and Indonesia. In many of the reports received, the crews were violently attacked by groups of one to four people carrying knives or guns. 11. From the same information, it emerges that, during the period under review at least one crew member was killed, as compared to 2012, which saw five casualties which all occurred in the West Africa region. About 137 crew members were reportedly taken hostage/kidnapped, as compared to 313 in 2012 while 11 crew were assaulted. Worldwide, 11 ships were reportedly hijacked, as compared to 26 in 2012. 12. The total number of incidents of piracy and armed robbery against ships, reported to have occurred or to have been attempted from 1984 to the end of December 2013, has risen to 6,752. ….. "Piracy" is defined in the 1982 United Nations Convention on the Law of the Sea (UNCLOS) (article 101) as follows: "Piracy consists of any of the following acts: (a) any illegal acts of violence or detention, or any act of depredation, committed for private ends by the crew or the passengers of a private ship or a private aircraft, and directed: (i) on the high seas, against another ship or aircraft, or against persons or property on board such ship or aircraft; (ii) against a ship, aircraft, persons or property in a place outside the jurisdiction of any State; (b) any act of voluntary participation in the operation of a ship or of an aircraft with knowledge of facts making it a pirate ship or aircraft; (c) any act inciting or of intentionally facilitating an act described in subparagraph (a) or (b)." WO1 IN DE DE WO1 -- DUMPSITE DUMPSITE IN BELGISCHE TERRITORIALE ZEE _________
De WO1-dumpsite in de ondiepe kustwateren vóór Heist bevat zeer waarschijnlijk veel meer gifgas dan tot nu toe werd aangenomen. Dat blijkt uit een nieuwe analyse van historische bronnen. Na de Eerste en Tweede Wereldoorlog werd telkens een hoop ongebruikte munitie in zee gekieperd. Ook voor de Belgische en Nederlandse kust. Ter hoogte van Knokke en in de Oosterschelde liggen twee van de grootste munitiestorten van de Noordzee. Het is er verboden te vissen of het anker uit te werpen, want er liggen grote hoeveelheden granaten, deels geladen met gifgas, op en in de bodem. Het scheelde niet veel of de Paardenmarkt was voorgoed in de vergetelheid geraakt. De stortplaats, vernoemd naar de zandbank waarop ze ligt, werd „herontdekt‟ in 1971, tijdens baggerwerken bij Zeebrugge. Duikers zagen toen tientallen obussen en granaten op de zeebodem liggen, vlak voor de kust van Knokke-Heist. Hadden de baggeraars pas enkele jaren later hun werken uitgevoerd, dan hadden ze wellicht niets gevonden. Door de forse uitbreiding van de haven van Zeebrugge een jaar later, in 1972, werd de zeestroming immers omgelegd en kwam een dikke sliblaag op de Paardenmarkt en op het munitiestort te liggen. De werkelijke omvang van de stortplaats kwam pas in de jaren 1980 aan het licht, dankzij magnetometrisch onderzoek – dat metalen verstopt onder de bodem kan opsporen. Op de zeekaart van de Belgische territoriale wateren verscheen prompt een ingekleurde vijfhoek met een oppervlakte van drie vierkante kilometer, waar een permanent visverbod geldt. De onbereikbaarheid van de met zand en slib bedekte munitie enerzijds, en de grote risico‟s verbonden aan het graven in deze zandbank anderzijds, maakten schattingen over de omvang en de samenstelling van de munitie die op de Paardenmarkt ligt te roesten moeilijk. De tot op vandaag gehanteerde cijfers zijn dan ook op drijfzand gebouwd. De raming van een totaalhoeveelheid van 35.000 ton munitie berust integraal op één getuigenis, uit de tweede hand en „herverteld‟ na ruim een halve eeuw. Daarin stelt voormalig directeur van de baggerfirma Decloedt dat gedurende zes maand a rato van 300 ton per dag werd gestort. De veronderstelling dat van deze munitie, een derde gifgas betreft, volgde dan weer indirect uit de verhouding in munitiegebruik op het eind van de oorlog door de Duitse artillerie en dus niet uit registraties bij de stortoperatie ter plaatse. Nieuw speurwerk door dr. Luc Vandeweyer (Rijksarchief) en dr. Tine Missiaen (Universiteit Gent), brengt een heel andere waarheid aan het licht. Uit nooit eerder doorplozen dossiers van het Bestuur van het Zeewezen, van de Recuperatiedienst van het Belgisch Leger en van het kabinet van toenmalig Belgisch minister van oorlog Masson blijkt dat het bij het storten op de Paardenmarkt van achtergebleven munitie uitsluitend ging om gifgasgranaten. De gedumpte munitie op de Paardenmarkt bestaat dus hoogstwaarschijnlijk vrijwel volledig, in plaats van voor een derde deel, uit gifgasgranaten. Tekenend hiervoor is dat het betreffende subdossier uit het archief van het Bestuur van het Zeewezen als titel meekreeg: “Immersion d‟obuz à gaz asphyxiant”. Chemische munitie leverde immers het grootste gevaar op en kon niet, zoals bij conventionele munitie gebruikelijk was, in een kuil aan land gecontroleerd tot ontploffing worden gebracht; de kans dat dampen door de wind oncontroleerbaar zouden worden weggeblazen was immers te groot. Zes maanden lang voer een baggerfirma dagelijks uit om munitie van het IJzerfront in zee te dumpen Daarom scheidde de „Service de la Récupération‟ van het Belgische leger na WOI de achtergebleven munitie systematisch in chemische en „gewone‟ granaten, zo blijkt. De chemische munitie werd opzij gelegd om naar zee te worden afgevoerd. De conventionele munitie werd in de directe buurt aan land gecontroleerd tot ontploffing gebracht. De dienst Hydrografie van het Bestuur der Zeewezen had de Paardenmarkt aangewezen als ideale stortplaats, vermits het een „banc absorbant‟ betrof waarin de granaten zouden wegzinken en spoedig onder het slib zouden verdwijnen. Als gevolg hiervan vertrokken de dumpingschepen vanuit de haven van Zeebrugge. Over de precieze aantallen obussen begraven op de Paardenmarkt blijft de briefwisseling vaag. Zeker is dat een belangrijk deel van de achtergebleven chemische munitie, honderdduizenden gifgasgranaten voor het overgrote deel van Duitse origine, hier terecht is gekomen.

Gifgas De BMM is, als onderdeel van het Belgisch Ministerie van de Noordzee, samen met het Ministerie voor Volksgezondheid en Leefmilieu verantwoordelijk voor de opvolging van het munitiestort op de Paardenmarkt. De slib- laag die sinds de uitbreiding van de haven van Zeebrugge in 1972 op de Paardenmarkt ligt, functioneert als een veiligheidsdichting bovenop de stortplaats. „De sliblaag is gemiddeld twee meter dik, maar die dikte varieert sterk van plaats tot plaats. Aan de kustzijde is ze op sommige plaatsen dikker dan vier meter. Maar vooral aan de noordwestelijke kant van de Paardenmarkt, waar nog erosie optreedt door het havenverkeer, is de sliblaag dun‟, zegt Francken. Volgens Tine Missiaen, geoloog aan de Universiteit Gent, creëert de sliblaag een zuurstofarm milieu als gevolg van de productie van methaangas door rottend organisch materiaal. „Daardoor roesten de metalen omhulsels van de munitie erg traag. De granaten die duikers in 1971 opdiepten, waren volgens de toenmalige rapporten in opmerkelijk goede staat‟, aldus Missiaen, die tien jaar geleden een reeks akoestische bodemmetingen uitvoerde bij de Paardenmarkt. „Het is zeer aannemelijk dat de munitie ook op dit moment nog niet al te zwaar is aangetast‟, merkt Frederic Francken op. Wat als …? Dat de gifgasgranaten onder de metersdikke sliblaag zullen doorroesten en hun toxische inhoud vrijgeven, is erg onwaarschijnlijk. Maar een gestrand schip zou wel voor problemen kunnen zorgen. Als dat tegen de granaten botst, kunnen die plotseling openbarsten. In de Oosterschelde ligt TNT en witte fosfor Om die reden geldt er al jaren een vis- en ankerverbod boven de Paardenmarkt. Toch wordt er soms nog stiekem gevist. „Tijdens ons onderzoek, tien jaar geleden, konden we duidelijk sporen ontwaren van vis- en sleepnetten op de bodem‟, zegt Tine Missiaen. Als een visser een gifgasgranaat naar boven haalt, dan lopen in de eerste plaats hijzelf en zijn bemanning gevaar. Mosterdgas kan bij contact ernstige brandwonden veroorzaken, om maar te zwijgen van het ontploffingsgevaar. Een aanvaring door een groot schip zou pas echt problematisch zijn. De Paardenmarkt ligt vlak bij een van de drukste havens van West-Europa, en op een boogscheut van de voornaamste scheepsroutes, pijpleidingen en gasterminals. „Op het eerste gezicht lijkt het risico dat grote schepen vastlopen op de Paardenmarkt, erg klein‟, zegt Missiaen. „We verwachten dat schepen met een grote diepgang, zoals tankers en containerschepen, stranden vóór ze de munitiestortplaats kunnen bereiken.‟ Toch zijn er de afgelopen decennia bij zwaar stormweer al schepen gestrand op de Belgische kust. Het meest recente ongeluk vond plaats in november 2001, toen een Duits containerschip vastliep op het strand van Blankenberge. De gevolgen van een botsing van een scheepsboeg met kisten volgestouwd met munitie, waarbij grote hoeveelheden toxische stoffen in één keer kunnen vrijkomen, zouden desastreus zijn voor het zeeleven en voor het kustgebied – inclusief het nabijgelegen natuurgebied het Zwin. Tsunami Wat gebeurt er eigenlijk als een gifgasgranaat openbarst – hetzij omdat hij is doorgeroest, hetzij omdat hij door een schip werd geramd? „Mosterdgas ziet er niet uit als een gas‟, legt Missiaen uit. „In een granaat lijkt het op een stroperige vloeistof. Het wordt pas gasvormig na de explosie. Dat verkleint de kans op een snelle verspreiding in het zeewater, want het goedje zou direct naar de zeebodem zakken. Bovendien heerst er in de Noordzee een sterke zeestroming, waardoor de kans op verdunning groot is.‟ De munitie mag dan bijna een eeuw oud zijn; het explosiegevaar is niet geweken. Missiaen: „Aangezien het grotendeels om munitie uit voorraden gaat, kunnen we aannemen dat het ontstekingsmechanisme niet op scherp staat. Toch is het niet uitgesloten dat relatief intacte granaten, gevuld met nog steeds actieve explosieven, na aanvaring met een schip zullen ontploffen.‟ Dat oude munitie nog steeds gevaarlijk is, bleek in 2008, toen de Franse ontmijningsdienst op zee een mijn wilde laten exploderen. De Fransen wisten niet dat er zich vlak onder de zeemijn een vergeten munitiestort bevond – van het genre van de Paardenmarkt. De gecontroleerde ontploffing van de zeemijn werd onverwachts gevolgd door een tweede explosie, die veel krachtiger was dan de knal van de zeemijn en die zelfs een lokale mini-tsunami aan de Noord-Franse kust veroorzaakte. Opruimen Het huidige beleid voorziet in de regelmatige controle van het munitiestort op de Paardenmarkt. „Daarmee voldoet België aan de internationale afspraken inzake (oude) munitiestortplaatsen: niets aanraken, maar blijven controleren‟, zegt Francken. Opruimen hoeft niet. België heeft weliswaar het internationale Chemisch Wapenverdrag ondertekend, dat sinds 1997 van kracht is. Maar dat verplicht alleen maar tot het saneren van stortplaatsen van chemische wapens tot en met de Tweede Wereldoorlog. Welke bestemming de munitiestortplaats op de Paardenmarkt op lange termijn zal krijgen, staat nog niet vast. Een van de mogelijkheden is de zandbank ophogen zodat een kunstmatig eiland ontstaat. „Dat eiland zou een broedplaats kunnen worden voor zeevogels als sternen, een bedreigde soort aan onze kust, meeuwen en plevieren, en tegelijk een rustplaats voor zeehonden‟, zegt Francken. Toch zal zo‟n transformatie tot een eiland – tot een offshore versie van het Zwin, zeg maar – het probleem van de gestorte munitie niet verhelpen. Missiaen: „We mogen niet uit het oog verliezen dat een dergelijke ophoging het probleem van lekkende munitie niet zal oplossen. Bijkomende controle zal daarom nog steeds nodig zijn.‟ Waarom ruimen we de boel niet gewoon op?

„Alle munitie bergen lijkt technisch misschien wel haalbaar, maar een schoonmaakoperatie is erg duur én riskant – zowel voor het personeel als voor het milieu‟, zegt Missiaen. „Het risico dat ongecontroleerde hoeveelheden schadelijke stoffen in het milieu terechtkomen tijdens de bergingsoperatie, is zeer groot.‟ Daarbij vergt zo‟n grote operatie ook een aangepast transport en opslagmogelijkheid. „Eén van de grootste bekommernissen blijft de ontmanteling van de geborgen granaten. De vernietiging van zoveel munitie vergt een zeer uitgebreide capaciteit. De ontmantelingsfabriek in Poelkapelle kan tien à vijftien granaten per dag aan. Op dit moment liggen nog ruim twintigduizend granaten te wachten op ontmanteling en dagelijks worden er nog granaten gevonden op akkers in de Westhoek.‟ Terwijl de Belgische Paardenmarkt wordt afgeschermd door een sliblaag, ligt de munitie in de Oosterschelde „bloot‟: het risico op verontreiniging van het zeemilieu is er dan ook veel groter. De uiteindelijke milieu-impact van de vrijgekomen toxische stoffen hangt af van de snelheid waarmee de metalen omhulsels doorroesten en uiteenvallen. De verwachting is dat dit niet snel zal gebeuren, en veel belangrijker, zeker niet op hetzelfde moment. Als de vrijgave van toxische stoffen plaatsvindt over een periode langer dan dertig jaar, zo staat in een rapport van Rijkswaterstaat uit 2001, zullen de risico‟s op overschrijding van de milieunormen eerder klein zijn. bron: Senne Starckx – Eos medewerker

2. Pour l’environnement Les avaries ont entraîné une fuite de fioul provoquant une pollution sur la plage de Kerminihy et dans la ria d'Étel. Deux nappes de fioul d'une surface totale approximative de 2,6 km² représentant une quantité de carburant comprise entre 5 et 8 m3 ont été repérées le 17 décembre 2011 dans le L'importance des avaries ne permettant pas de remorquer le navire vers un port, en vue de sa déconstruction, le TK.BREMEN a été découpé sur place. Le chantier de démolition s’est achevé début février 2012. Il est complété par une remise en état des espaces dunaires. ANALYSE Les conditions météorologiques - Les prévisions : Le 15 décembre 2011 à 05h15 UTC, Météo-France Brest émet un avis de grand frais à fort coup de vent et tempête pour la nuit du 15 au 16. Il est prévu, du 15 décembre à 20h00 UTC au 16 décembre 12h00 UTC, un vent de SW 8 à 9, fraîchissant par le Nord de la zone, passagèrement 10, virant NW 7 à 8 en fin de nuit au nord de Belle-Île. Par ailleurs, de très fortes rafales et une mer devenant très forte à grosse sont prévues pour la nuit, avec grande houle de sud-ouest de 7 à 8 mètres. - Le temps observé du 15 au 16 décembre A Belle-Île: vent d’ouest 27 noeuds, rafales à 41 noeuds, mer forte et visibilité de 1 à 2 milles. A bord du TK.BREMEN : - à 11h20 UTC, le navire venant de mouiller, vent de sud-ouest 4, creux de 1 mètre et longue houle ; - à 18h30 UTC, le vent forcit rapidement à 8 et vire à l'ouest ; - vers 01h00 UTC, au moment de l’échouement, le vent souffle en forte tempête (165 km/h)3. Les conditions météorologiques très difficiles sont retenues comme étant le premier facteur déterminant de l'évènement. La marée et les courants Le TK.BREMEN a commencé à chasser sur son ancre à 19h30, à la pleine mer, et s’est déplacé dans le nord-est de sa position de mouillage initiale. Le courant dans le secteur est de l'ordre 0,2 à 0,5 noeuds, portant au SW. Celui conserve cette orientation 2 heures après la pleine mer en diminuant. Par conséquent, le courant n’a pas joué de rôle particulier dans l’évènement. Le mouillage d’attente sous Groix Le mouillage généralement utilisé en attente de rentrée à Lorient se situe dans l’est nord-est de Port Tudy, pour 2 milles environ. La zone située entre la Pointe de la Croix et la Basse Mélite, à une distance d’un mille de la côte, constitue le meilleur endroit pour mouiller, car mieux abrité des trains de houle contournant l’île de Groix par le nord et le sud. Dans la partie nord, on trouve de la vase ou du sable fin vaseux ; au sud, le fond est constitué de sables et de graviers. La dynamique sédimentaire est importante dans cette zone. La qualité du mouillage, réputé de bonne tenue, ne peut donc être retenue comme facteur contributif.

Les apparaux de mouillage Le TK.BREMEN, est équipé de deux ancres à bascule (Hall) de 2500 kg. Ce type d'ancre convient pour tout type de fond. Elle tient bien sur les fonds durs. Sa principale caractéristique est son poids qui lui permet de s’enfoncer. Les chaînes comportent 9 maillons de diamètre 44 mm à tribord et 8 maillons à bâbord. Il a toutefois été constaté sur l’épave que le diamètre des mailles de la ligne bâbord était de 31 à 36 mm, alors que les rapports d’inspection périodique font état d’un diamètre moyen de l’ordre de 40mm. A bâbord, les mailles n'épousent pas correctement l'empreinte du barbotin. Le stoppeur, de type à linguet, est désolidarisé de son support et la ligne de mouillage est saisie par une élingue tournée sur une bitte. Les patins de serrage du frein sont fortement usés. Malgré les anomalies constatées après l’accident, la nature et l’état des apparaux de mouillage ne constituent pas un facteur contributif. Le chargement du TK BREMEN Le TK.BREMEN, ayant achevé son déchargement, poursuit son voyage sur ballast. Le commandant a déclaré que l’ensemble des ballasts eau de mer étaient pleins. Si cette configuration permet un effet normal de la propulsion, lorsque les conditions météo sont maniables, il n’en va pas de même dans des conditions très dégradées, à l’instar de celles rencontrées le 15 décembre au soir. En effet, le tangage très prononcé du navire a empêché l’appareil propulsif de délivrer sa puissance maximale, l’hélice se trouvant fréquemment émergée. Si ceci n’a pas eu de conséquence en début d’évènement, lorsque le navire était encore sur son ancre, il n’en a plus été de même lorsque le TK.BREMEN a relevé son mouillage et tenté de remonter au vent pour gagner à nouveau un abri sous Groix. 138

Par ailleurs, lorsque le navire est sur ballast, il présente une très importante prise au vent, ce qui limite sa capacité à remonter au vent. Ces conditions de chargement, en l’espèce normales pour un navire «à vide», constituent toutefois un facteur sousjacent. Facteurs humains La décision d’appareiller de Lorient : Ainsi qu’il a déjà été précisé supra, dans la chronologie, l’information n’a pas suffisamment circulé et le commandant, qui souhaitait pourtant différer le départ, n’a eu confirmation de la possibilité de rester à quai qu’une fois pilote, remorqueurs et lamaneurs commandés pour l’appareillage. … L’article L 5241-5 du Code des Transports précise par ailleurs : «Au cas où le navire ne pourrait prendre la mer sans risque pour la sécurité ou la santé de l'équipage ou des personnes embarquées, le milieu marin et ses intérêts connexes ou les autres navires, son départ peut être interdit ou ajourné, après visite». Ainsi, lorsque les officiers de port ont connaissance de telles défaillances, ils immobilisent le navire jusqu’à intervention et contrôle par le Centre de Sécurité des navires compétent. Enfin, en cas de conditions météorologiques très mauvaises, l’autorité portuaire peut interdire l’entrée et la sortie du port, dans la mesure où un mouvement présente un risque pour la sécurité des ouvrages. C’était d’ailleurs le cas le 15 décembre 2011, pour le GPM de Nantes - Saint-Nazaire, mais non pour Lorient où les conditions, au moment de l’appareillage, permettaient la sortie du TK.BREMEN. Il semblerait donc que la décision finale d’appareiller, une fois le capitaine informé, avant la manoeuvre, de la possibilité de rester à quai, et ce malgré les réserves émises par le pilote, ait tenu au fait qu’il fallait régler un dédit pour le déplacement inutile, en cas de maintien à quai, du remorqueur et du service de lamanage. Pour un navire de haute mer, la décision, prise après l’appareillage, d’attendre une accalmie sur un mouillage relativement abrité, procède de la prudence, face à des conditions particulièrement sévères attendues pour la traversée prévue. La décision de quitter Lorient et de prendre un mouillage d’attente ne peut être retenue comme facteur contributif au sens du Code de l’OMI sur les enquêtes après accident, même s’il est évident que le fait de différer l’appareillage aurait évité l’accident. … La tenue au mouillage Au moment où le navire a commencé à chasser, vers 19h30, le commandant vire la chaîne en utilisant le guindeau et la machine en avant lente, à partir de 20h00. Conservant 2 maillons à l’eau, il décide de laisser son navire dériver, machine stoppée, afin de parer l’autre navire au mouillage. Il file ensuite la chaîne et l’ancre croche à nouveau. Face à une telle situation, la pratique habituelle consiste à utiliser immédiatement la machine, en réglant l’allure de manière à tenir le mouillage et à mouiller la seconde ancre. En l’espèce, le navire serait resté à sa position initiale, là où l’abri de l’île était le meilleur. Cependant, lorsque le navire chasse une nouvelle fois, vers 21h00, la machine, bien que parée à manoeuvrer, n’est pas non plus utilisée pour aider à la tenue du mouillage. Une telle pratique est pourtant «classique» et il n’est pas rare de voir, y compris sur rade de Lorient, des navires y recourir par mauvais temps. A tout le moins, le commandant aurait pu mouiller la seconde ancre «en plomb de sonde» et le navire se serait trouvé tenir sur les deux lignes de mouillage. La machine n’a été lancée en avant lente qu’à 22h30, pour faire éviter le navire dans le but de relever l’ancre, puis en avant toute à 23h00, au moment du début du relevage de l’ancre. Dans ces conditions, l’insuffisance d’utilisation de la machine et le fait de ne pas mouiller immédiatement la deuxième ancre constituent le second facteur déterminant. La tentative de virer sur bâbord A 23h30, le commandant, constatant qu’il n’arrive pas à remonter tribord amures, décide de venir en grand sur bâbord. Il s’aperçoit qu’il n’arrive pas non plus à remonter bâbord amures, et que de plus, vent arrière, il se dirige rapidement vers les dangers de la Pointe de Gâvres. Il revient alors en grand à droite pour se retrouver à suivre une route fond au 120°. Cette manoeuvre l’a rapproché de la côte d’environ un mille et sa route fond, telle qu’indiquée par SPATIONAV, le mène maintenant sur les dangers situés au sud de la ria d’Etel. De ce fait, il lui restait moins d’eau à courir sur la route fond tenue avant d’arriver à la côte. Ceci a contribué à aggraver la situation.

SYNTHESE A 11h00 le 15 décembre 2011, le TK.BREMEN quitte le port de Lorient. Les prévisions météorologiques sont très mauvaises pour la soirée et il mouille sous Groix pour attendre une accalmie. En fin d’après-midi, le vent fraîchit et le TK.BREMEN chasse sur une distance de deux milles, mais n’utilise pas suffisamment sa machine pour tenir le mouillage et ne mouille pas sa deuxième ancre. Sorti de l’abri relatif procuré par l’Ile de Groix, le commandant décide de relever l'ancre et de se repositionner. Le navire ne parvient cependant pas à remonter au vent pour gagner un mouillage abrité. La cinématique du navire est observée par le sémaphore et le CROSS. Jusqu’à minuit (où il précise manquer de puissance pour lofer), le commandant ne fait part d’aucune inquiétude. Du fait de son faible tirant d’eau et d’un important fardage, le navire ne peut suivre un cap supérieur au sud sud-est, ce qui correspond, vu la dérive due au vent et à la mer, à une route fond au sud-est qui l’amène sur les dangers de la pointe d’Erdeven. Le navire demande l’assistance d’un remorqueur portuaire. Le SCORFF, en astreinte pour un pétrolier à quai, ne peut intervenir. Malgré le mouillage des deux ancres au niveau de la ria d’Etel, le navire chasse et vient s’échouer sur la plage de Kerminihy, provoquant une pollution par hydrocarbures. Irrécupérable, le navire sera démantelé sur place.
RECOMMENDATIONS Le BEAmer recommande : 1. à l’Administration chargée de la réglementation portuaire : d’introduire dans la réglementation nationale une partie des dispositions de la directive CE 2002/59, article 18, paragraphes 1, alinéa a) et 2. Ainsi, en cas de conditions météorologiques exceptionnellement défavorables, seraient obligatoires et formalisées : - la notification au capitaine, par l’autorité portuaire, de la situation météorologique et des conditions locales, - l’information du port par le capitaine sur les raisons d’un départ en dépit des conditions prévues. 2. aux autorités territoriales et maritimes : d’encadrer la zone de mouillage d’attente de Lorient : délimitation, statut, surveillance et intervention... Vanaf 1823 werden de eerste pogingen ondernomen om een lijndienst met stoomschepen in te stellen tussen de havens van Antwerpen en Londen. Na verloop van enkele jaren resulteerden die pogingen in een echte regelmatige dienst. Die dienst werd echter uitsluitend door Britse stoomschepen verzekerd. Op 7 november 1835 werd door een aantal vooraanstaande maritiem geïnteresseerde Belgen in Antwerpen de Société Anversoise des Bateaux à Vapeur opgericht met als doel onder Belgische vlag stoomschepen uit te baten tussen Antwerpen en Londen. Het eerste schip van de nieuwe rederij was het ss “Princess Victoria”, gebouwd in Schotland in 1835 en in dienst getreden op 25 april 1836. Het jaar nadien kwam het ss “Antwerpen” in de vaart, gevolgd in 1838 door het ss “Bruges”. De twee laatstgenoemde schepen kwamen resp. van een Antwerpse en van een Brugse werf. De drie stomers waren alle nog in hout gebouwd. De concurrentie met de Britse stomers van de General Steam Navigation Co. die dezelfde lijn verzorgden was uitermate scherp, zozeer dat de Belgische rederij in het begin der jaren 1840 overwoog ermee op te houden. De dagen en uren van afvaart en de prijzen die aan de passagiers werden aangerekend zorgden voor eindeloze verwikkelingen en ruzies. Gelukkig werden in 1844 tussen beide rederijen ingevolge enkele “gentlemen’s agreements” de problemen opgelost en de Belgische stomers konden verder zonder noemenswaardige moeilijkheden met alle mogelijke dynamiek de dienst naar Londen blijven verzorgen. In 1851 kwam nog een nieuwe stomer in de vaart, gebouwd in Londen en “Baron Osy” gedoopt, naar één van de oprichters van de rederij. Deze ijzeren ”Baron Osy” voldeed waarschijnlijk niet erg, want reeds in 1855 werd het schip vervangen door een nieuwe “Baron Osy” (II) die afkomstig was van de Londense werf J.Scott Russell & Co. De “Baron Osy” (II) was, net als alle andere schepen van de Société Anversoise des Bateaux à Vapeur, een raderstoomschip. Volgens Bureau Veritas waren de afmetingen: lengte 63,7m, breedte 8,6m en diepgang 4,15m. De registertonnenmaat bedroeg 679 ton bruto en 449 ton netto. De gloednieuwe “Baron Osy” (II) was op 14 oktober 1855 in Antwerpen gearriveerd, komende van de Londense werf, om in Antwerpen opgetuigd te worden en tevens voor de inrichting van de accomodatie die nodig was voor de passagiers. De Antwerpenaars vonden dat “le magnifique steamer neuf Baron Osy....est d’une bonne coupe, d’une marche supérieure; il est plus grand qu’aucun des steamers qui aient jamais fait le trajet entre le Belgique et l’Angleterre. ». In opdracht van het Ministerie van Buitenlandse Zaken onderzochten ingenieurs J.Zuber en J.A.Gras grondig het nieuw raderstoomschip en bevonden dat het schip “...se trouve en parfait état de navigabilité et propre à la navigation transatlantique”. De experten van Bureau Veritas zagen het wel anders en keurden het schip alleen voor de “Grote Kustvaart”. Door het K.B.van 1 december werd het stoomschip genationaliseerd tot Belgisch vaartuig en trad op 5 december 1855 in dienst. Negen dagen later verliet de eerste “Baron Osy”, die verkocht was, definitief Antwerpen. Net als de andere schepen van de rederij vervoerde de “Baron Osy” (II) vracht en passagiers. Het aantal passagiers kon enorm verschillen. Het allergrootste aantal werd bereikt op 25 juni 1862, toen 208 passagiers inscheepten die in Londen de Wereldtentoonstelling gingen bezoeken. De “Baron Osy” (II) vertrok elke woensdag uit Antwerpen en keerde ’s zondags terug uit Londen. De prijs per overtocht bedroeg voor de passagiers uit eerste klas £1 en 7 shilling en voor de tweede klas £1. Een overtocht duurde, bij normaal weer, ongeveer 15 uren. Ter hoogte van Gravesend kwam de Britse douane aan boord en begon reeds de bagage van de passagiers te controleren, zodat ze in Londen bij de ontscheping geen tijd moesten verliezen! Een hele reeks kapiteins heeft het bevel gevoerd over de “Baron Osy” (II): Peirce (die aan boord overleed op 29 oktober 1859), Demazière, Ferguson, Muys, Van Diependael, Verbist, De Smet, Van Gulick en Meulenaer. De gekendste onder hen was zeker Julien Verbist, die later directeur werd van het Antwerps Internationaal Zeemanshuis en die goed bevriend was met de schrijver Lode Baekelmans. De “Baron Osy” (II) die gedurig de drukke wateren van het Kanaal bevoer, heeft natuurlijk af en toe bij slecht weer of mist problemen gekend. Op 20 maart 1865 moest de stomer gedurende 20 bange uren een zware storm trotseren: “Les marins disent n’avoir jamais vu une telle tourmente.....les lames avaient balayé sans interruption le pont pendant 7 heures…… les tables et les sièges flottaient......par suite de la forte gelée le pont était un miroir de verglas… ». 142

Op 30 december 1866 werd de “Baron Osy” (II) aangevaren door een Britse brik. Er waren 5 gekwetsten. Op 3 maart 1872 werd de stomer in dichte mist (“...blaesde de fluyt alle twee à vyf minuten...”) nog eens aangevaren door een zeilschip dat “...de verschansing gedeeltelijk beschadigde, een stuk van zijn kluyverboom aen ons dek liet, alsook vier man van zijn equipage dewelke bij ons oversprongen...”. Gelukkig waren er geen slachtoffers. Het spectaculairst ongeluk heeft zich echter voorgedaan op 3 september 1863, toen de “Baron Osy” (II) op weg was naar zijn vaste aanlegplaats vlakbij de Tower Bridge in Londen. Het schip voer bij laagwater op een onbekend onder water liggend obstakel, waardoor een lek ontstond en het schip vol water liep. Het ongeluk gebeurde ter hoogte van Cuckold’s Point, gelegen op het einde van Limehouse Reach, bij de scherpe bocht van de Thames.

Benevens de bemanning en enkele Britse douanebeambten waren er ongeveer 80 à 90 passagiers aan boord. De kapitein was Richard Muys, 48 jaar oud en afkomstig uit Hamme.
Enkele Belgische kranten brachten het nieuws van het ongeluk via de vertaling van het bericht in de Shipping Gazette: “....Men vaerde als naer gewoonte toen een hevige schok gevoeld werd en de machienen stil stonden. De eerste mecan icien, die toen in de machienekamer was, voelde een schok onder hem als of het schip ging openscheuren; op het zelfde oogenblik drong het water in met zooveel geweld, dat hy en de stoker zich in alleryl moesten redden, want op weinig tyd stond de machienekamer vol en het vaertuyg zonk. De ty was van de ebbe en kalm... “. Kapitein Muys praaide een voorbijvarende Woolwich steamer die de passagiers overnam. Er heerste geen paniek en de redding geschiedde in de beste orde. Elke passagier werd met zijn bagage ongedeerd aan wal gezet. Spoedig kwam daarna een ploeg arbeiders aan boord om onmiddellijk zoveel mogelijk van de lading te bergen. Het was immers zeker dat de “Baron Osy” (II) bij hoogwater geheel onder water zou gaan staan. De lading uit het voorste ruim kon geborgen worden in lichters. Het ijzeren paneel achter de machinekamer was ong edeerd gebleven, waardoor het achterste ruim voorlopig droog bleef en ook daar een groot gedeelte van de lading kon gered worden “behalve eenige boucauts tabak”. Bij het opkomend tij gebeurde het onvermijdelijke: “...by de vloed was het voorgedeelte onder water; het achtergedeelte was inwendig overstroomd.... De plaets waer de Baron Osy gezonken is, is een slykbed, waer reeds verscheidene schepen vergaen zyn en ongetwyfeld is de steamer op een oud anker of wrak van een schip vergaen.” Het “slykbed” waarvan sprake was een zandbank die nog niet lang bekend was. Het was mogelijk, dacht men, dat de Belgische stomer op de rand van de zandbank had gestoten, terwijl de romp open scheurde door wrakstukken van een Noors vaartuig dat eerder op de zandbank was vergaan. Bij hoogwater waren nog enkel de schoorsteen en de masten te zien. Op 7 september werden kettingen aangebracht onder de romp van het schip om te trachten het te bergen.Inmiddels huurde de rederij het Engels stoomschip “Lady Inglington” om de “Baron Osy” (II) te vervangen zolang die uit de vaart was. Op 12 september kwam dan het bericht dat de stomer gelicht was en naar de oever van de Thames gesleept werd om later op een werf hersteld te worden. Er was, aldus het bericht, “een ontzagelyke kracht aengewend om het schip uit den weg te brengen”. Op 31 januari 1864 vertrok de stomer uit Londen richting Antwerpen. Onder toezicht van een expert van Lloyd’s was in Londen alles aan boord vernieuwd of geheel hersteld. De romp, de machines, de ketels, het interieur, het dek, de tuigage, alles verkeerde terug in perfecte staat en voor de Antwerpenaars was het een blij weerzien: “Le Baron Osy a eu une traversée excéssivement rapide et en arrivant il a salué la ville de plusieurs coups de canon, auxquels ont répondu les batteries de la Digue ». Op 3 februari kon de regelmatige dienst Antwerpen – Londen hervat worden. Jaren later, augustus 1875, werd de “Baron Osy” (II) herdoopt in “Max Van den Bergh” want de Antwerpse rederij had een derde “Baron Osy” laten bouwen in Newcastle en deze kwam in dienst in diezelfde maand augustus. Tenslotte vertrok de “Max Van den Bergh”, ex “Baron Osy” (II), met Florimond Van Gulick als kapitein, op 1 april 1876 naar Londen om ginds verkocht te worden. De nieuwste “Baron Osy” (III) bleef verder de succesvolle en erg geapprecieerde dienst Antwerpen – Londen verzekeren. Luc Van Coolput, lid Koninklijke Belgische Marine Academie
