MEMORANDUM SALING PENGERTIAN MENGENAI KERJASAMA PERDAGANGAN ANTARA REPUBLIK INDONESIA DAl'-1
JAMAHIRIYA RAKYAT ARAB LIBYA SOSIALIS RAYA Republik Indonesia dan Jamahariya Rakyat Arab Libya Sosialis Raya selanjutnya clisebut sebagai "Para Pihak";
Mengakui manfaat pengembangan perdagangan bilateral yang saling menguntungkan antara Republik lndonesi~ clan Jamahariya Rakyat Arab Sosialis Raya dengan mempromosikan perdagangan, dan menjamin kualitas produk ekspor clan impor; Berkeinginan untuk lebih memperernt hubungan yang telah ter_jalin antara rnasyarakat Indonesia dengan masyarakat Jamahiriya Rakyat Arab Libya Sosialis Raya; Mewujudkan keuntungan clan manfaat yang ditimbulkan dari kerjasama untuk kedua belah pihak; Mengharapkan promosi, pengembangan clan mernperku~tt tingkat kerja$ama perdagangan atas dasar persarnaan bak, tirnbal-balik clan saling kemauan bersama; 11emperhatikan Persetuju:1n Dasar antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakya[ Sosialis Arab Libya mengenai Kerjasama Ekonomi, llmu Pengetahucu1, clan Teknik, ditandatangani 26 September 1995; Mengacu pada pernturan perundang-unlfangan yang berlaku dimasing-rnci.sing Pihak; Telah mer.yepakati hal-hal sebagai berikut;
Pasal l Ketentuan Dasar "Para Pihak" wajib melakukan langkah-lcrngkah yang diperh.1 kan unn.ik mempromosikan, memfasilitasi clan mernperkuat perdaganga11 barang dan jasa antara kedua negara sesuai dengan peraturan perundang-undangan yang berlaku climasir.gmasing negara.
Pasal 2 Fasilitas Perdagangan 1. Pertukaran barang dan jasa antara kedua negara akan dilaksanakan sesuai dengan peraturan perundang-undangan yang berlaku di masing-masing negara; 2. Kontrak perdagangan mencakup; kontrak antar perusahaan, lembaga clan perorangan di kedua negara;
3. Para Pihak sedapat mungkin memberikan fasilitas yang akan mengembangkan clan mempromosikan perdagangan dalam kerangka Memorandum Saling Pengertiar. ini. Pasal 3 Standarisasi Pertukaran barang clan jasa antara Para Pihak harus sesuai dengan spesifikasi, standar, penilaian kesesuaian clan metrologi yang diterapkan oleh para Pihak dan sesuai dengan prinsip dan norma internasional yang cliakui para Pihak.
Pasal 4 Perlindungan Hak Kekayaan lntelektual Perlindungan Hak Kekayaan lntelektual wajib dilaksanakan sesuai dengan peraturan perunclang·undangan para Pihak dcln sesuai dengan persetujuan internasional, dimana pan Pihak rnenjadi anggota.
Pasal 5 Bea Masuk clan Pungutan Bea masuk clan µajak di kedua pihak lintuk procluk ekspor da.n lain-lain dise:;uaikan dengan ketentuan peraturan perundang-undangan yang berlaku d i masing-masing Pihak.
Pasal 6 Hambatan Perdagangan Non Tarif Dalam rangka mengemoangkan clan meningkatkan hubungan perdagangan di kedua negara, Para Pihak sepakat untuk mengurangi atau menghapus hambatan perdagangan non tariff secara timbal balik.
Pasal 7 Persetujuan Pembayaran Pembayaran yang ditimbulkan dari transaksi komersial diantara para pilrnk wajib dibayarkan dengan marn. uang yang s~suai dan metode pembayr,yaran binnya sesuai ~gan peratc1ran perundang·t;ndangan yeng berlaku di masing·masing Pihak.

Pasal 8 Partisipasi clalam Eksibisi, Pameran clan Seminar Kedua pihak akan mendorong perusahaan komersial clan lembaga-lembaga untuk ikut berperan aktif berpartisipasi dalam Pameran lnternasional/eksibisi khusus, pameran clan seminar yang diselenggarakan di wilayah masing-masing Pihak clan wajib, sepanjang memungkinkan, memberikan kemudahan-kemudahan yang diperlukan sesuai dengan peraturan perundang-undangan Para Pihak.
Pasal 9 Pembentukan Kantor Dagang Dalam rangka menfasilitasi clan pengembangan pertukaran komoditi/barang, jasa clan informasi dagang diantara kedua ncgara, Para Pihak sepakat untuk mcndirikan kantor dagang di masing-masing wilayah Para Pihak sesuai pcraturan perundang-undangan yang berlaku Pam Pihak.
Pasal 10 Saling Kunjung clan Delegasi Perdagangan Parn Pihak wajib mendorong saling kunjung clan pertukaran delegasi clagang clan juga mendirikan hmtak langsung diantara institt;si clan perusahaan yang melakukan kegiatan usaha di kedua negara dan membcrikan fasilitas yang diperlukan.
Pasal 11 Kerjasama antara Kamar Dagang clan lnclustri Para Pihak wajib mendorong Kamar Dagang dan Industri kedua negara untuk melakukan kerjasama yang efektif clan membentuk Kamar Dagang clan Industri Bersama, pertukaran delegasi dagang, clan menyelcnggarakan seminar-seminar khusus, dengan tujuan untuk memperkenalkan masing-masing produk clan pemasaran serta menyediakan fasilitas yang diperlukan untuk me.ncapai tujuan tersebut.
Pasal 12 Komite Perdagangan Bersama Dalam rangka memfasilitasi implementasi yang efektif clari Memorandum Saling Pengertian ini, para Pihak wajib membcntuk sebuah Kom!te Perdagangan Bersama yang cerdiri dari perwakilan Pemcrintah clan Swasta, Komite 'Najib bertemu, apabila diperlubln, diwilayah masing-masing negara deng,rn maksud unruk:

Mencermati implementasi Memorandum Saling Pcngcrtian ini dan mencari solu:;i terhadap permasalahan yang timbul;
2.
Mencari jalan keluar untuk lebih memperluas kcrjasama pcrdagangan bilateral;
3.
M ernajukan potensi dagang yang terdapat cti kedua negarCl..

Pasal 13 Kerjasa1na Perdagangan yang akan Datang Para Pihak wajib mengembangkan Memorandum Saling Pengertian ini menjadi instrumen hukum yang lebih komprehensive untuk mendorong kerjasama dagang diantara kedua negara dimasa mendatang.
DIBUAT dalam rangkap dua di Tripoli, pada tanggal empat bulan April tahun dua ribu sembilan dalam bahasa Indonesia, bahasa Arab clan bahasa lnggris, semua naskah mempunyai keaslian yang sama. Dalam hal terjadi perbedaan penafsiran, naskah bahasa lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING ON TRADE COOPERATION BETWEEN THE REPUBLIC OF INDONESIA AND THE GREAT SOCIALIST PEOPLE'S LIBYAN ARAB JAMAHIRIYA
The Republic of Indonesia and the Great Socia list People's Libyan Arnb Jamahiriyt1 hereafter efe!"red to as "the Parties"; Rec0gnizing the interest of developing mutuai benefits on trade between the Republic of ndonesia and the Great Socialist People's Libyan Arab Jamahiriya, with a view to promote rade, a&;uring the quality of imported and exported goods; Desiring to strengthen the close and friendiy relation already existing between the people of the rwo countries; Realizing the benefits and advantages that will be generated for the P:uties from such oopcration; Wishing to promort:!, develop and strengthen the level of trade cooperation on the basis of ~quality, reciprocity and mutual intereH; !faking into account the Ba3ic Agreement for Economic, Scientific and Technical Cooperation pcrween the Government of the Republic of Indonesia and the Socialist Peoplc:'s Libyan Arab amahiriya signed on 26 September 1995; : > ursuant to the· prevailing laws and regulations of the Parties, H.ave agr~ed as follows:
Article 1

Ar ticle 3 Standardization The exchange of goods and services between the Parties shall be in accordance with the specification, standard, conformity assessmen t and metrology applied in the Parties and in accordance with the in ternational principle and norm mutually recognized by the Parties.
Article 4 P rotection of Intellectual Property Rights The protection of Intellectual Property Rights shall be enforced in conformity with the laws, rules and regulations of the Parties and with other international agreements which both parties are member to.
Article 5 Customs Du ties and Charges Customs duties and taxes levied by either Party on the export products of the other Party shall be in accordance with the laws and regulations of each Party.
Article 6 Non - Tariff Measures In order to develop mutual commercial relations between the two countries, the Parties have agreed to reduce 01 eliminate the non-tariff barrier reciprocally.
Article 7 P ayment Arrangement The payments arising from commercial transaction between the Pa rties shall be settled with convertible currencies and any other methods of payments in accordance with the laws and regulations of each Party.
Article 8 Participation in Exhibitions, Fairs an d Seminars Each Party shall encourage its commercial companies and institutions to participate in internation
Article 9 Establish ment of Trade Office In order to facilit?te and develop the exchange of commodities/goods, services and trade information between the two countries, the Partie~ agreed to establish Trade Office in each territory of the Party according to the prevailing laws and regulations of the Partie:>.
Article 10 Exchange of Visits and Trade Delegations The Parties shall encourage the exchange of visits and trade delegations, and also establish direct contact between the institutions and companies operating in the two countries as well as to provide the necessary facilities in this regard.
Article 11 Cooperation Between Chambers of Commerce The Parties shall encourage their chambers of commerce to maintain close and effective cooperation and to establish joint chambers of commerce, exchange of commercial delegations, and convene of specialized 3eminars and conferences in order to familiarize each other's products and their marketing and provide the required facilities to achieve their goals.
Article 12 Joint Trade Committee In order to facilitate the effective implementation of this Memorandum of Understanding, the Parties shall establish a Joint Trade Committee consisting of the representatives of officia ls and businessmen of the Parties, the committee shall meet annually alternately, if it is deemed necessary, in the territory of each country with the aim tv: 1. Examine the implementation of this Memorandum of Understanding and find solutions of problems which might artse thereof; 2. Study the ways and means for further expansion of bilateral trade cooperation; Promote commercial and trade potentials existing in the two countries.
Article 13 Future Trade Cooperation Parties shall develop this Memorandum of Understanding to be a more comprehensive egal instrument for enhancing future trade cooperation between the two countries. one in duplicate at Tripoli 011 the Fourth day of April two thousand and nine, in Indonesian, abic and English languages, al! texts being equally authentic. In case of any d ivergence of nterpretation, the English text shall prevail.
