PERSETUJUAN ANT ARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH KERAJAAN THAILAND MENGENAI PEMBEBASAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN DINAS
Pemerintah Republik Indonesia dan Pemerintah Kerajaan Thailand, selanjutnya disebut "Para Pihak", MENIMBANG hubungan bersahabat antara Para Pihak; BERHASRAT
untuk
lebih
memperkuat
hubungan .bersahabat
mereka,
berdasarkan asas timbal balik, dengan memfasilitasi masuknya pemegang paspor diplomatik dan dinas Republik Indonesia dan Kerajaan Thailand ke masing-masing negara; SESUAI dengan peraturan perundang-undangan yang berlaku di masing-masing negara; TELAH MENYETUJUI hal-hal sebagai berikut: PASAL1 PEMBEBASAN VISA 1.
Warga negara Republik Indonesia yang memegang paspor diplomatik atau paspor dinas yang sah, tidak wajib untuk memperoleh visa untuk masuk, transit dan tinggal di wilayah Kerajaan Thailand untuk suatu jangka waktu yang tidak melebihi 30 (tiga puluh) hari terhitung sejak tanggal masuk.
2.
Warga negara Kerajaan Thailand yang memegang paspor diplomatik atau paspor dinas yang sah, tidak wajib untuk memperoleh visa untuk masuk, transit dan tinggal di wilayah Republik Indonesia untuk suatu jangka waktu yang tidak melebihi 30 (tiga puluh) hari terhitung sejak tanggal masuk.
PASAL2 MASA BERLAKU PASPOR Jangka waktu paspor diplomatik dan dinas dari warga negara setiap Pihak wajib sekurang-kurangnya 6 (enam) bulan sebelum memasuki wilayah Pihak yang lain.
PASAL3 VISA BAGI ANGGOTA MISI DIPLOMATIK ATAU POS KONSULER Warga negara dari salah satu Pihak yang merupakan pemegang paspor diplomatik atau dinas yang sah dan ditugaskan sebagai anggota misi diplomatik atau pos konsuler di wilayah merupakan
Pihak lain, termasuk anggota keluarga mereka yang
pemegang
paspor
diplomatik
atau
dinas
yang
sah,
wajib
dipersyaratkan untuk memperoleh visa masuk yang sesuai dari Kedutaan Besar Pihak lainnya sebelum memasuki wilayah Pihak tersebut.
PASAL4 KETENTUAN MASUK DAN KELUAR Pemegang paspor diplomatik dan dinas yang sah dari salah satu Pihak sebagaimana dimaksud dalam Persetujuan ini, dapat memasuki dan meninggalkan wilayah negara Pihak lainnya, di setiap titik yang diizinkan oleh pihak imigrasi yang berwenang sebagai tempat-tempat pemeriksaan lalu lintas internasional, kecuali di tempat-tempat yang telah ditentukan oleh perundang-undangan dan peraturan yang mengatur keamanan, migrasi, bea cukai, kesehatan dan persyaratan hukum lainnya yang mengatur masuknya, perjalanan dan tinggalnya orang asing.
PASALS PERUBAHAN HUKUM NASIONAL
Para Pihak wajib segera memberitahukan satu sama lainnya secara tertulis, melalui saluran diplomatik mengenai perubahan pada perundang-undangan dan peraturan masing-masing yang mengatur masuk, tinggal dan keluarnya orang asing.
PASAL6 HAK PIHAK BERWENANG
1.
Persetujuan ini wajib tidak membebaskan warga negara salah satu Pihak dari kewajiban untuk menghormati peraturan perundang-undangan Pihak lainnya ketika memasuki wilayahnya, termasuk tetapi tidak terbatas pada peraturan perundang-undangan berkenaan dengan masuk, tinggal dan keluarnya orang asing.
2.
Para
Pihak
berhak
untuk
menolak
memberikan
izin
masuk
atau
memperpendek masa tinggal setiap orang, yang diberikan pembebasan visa berdasarkan Persetujuan ini, apabila dianggap bahwa orang tersebut tidak dikehendaki
atau
dicurigai
dapat
membahayakan
ketentraman
umum,
ketertiban umum, kesehatan publik atau keamanan nasional.
PASAL7 PENUNDAAN
Masing-masing Pihak dapat menunda sementara Persetujuan ini, baik secara keseluruhan
maupun
sebagian,
dengan alasan-alasan
keamanan
nasional,
ketertiban umum atau kesehatan publik. Pihak lain wajib segera diberitahukan mengenai pengenalan, dan pengakhiran kebijakan-kebijakan dalam Pasal ini tidak lebih dari 15 (lima belas) hari melalui saluran diplomatik.
PASAL8 CONTOH DAN PENERBITAN PASPOR ATAU DOKUMEN PERJALANAN
1.
Para Pihak wajib saling bertukar, melalui saluran diplomatik, dalam jangka waktu 30 (tiga puluh) hari setelah penandatangan Persetujuan ini, contohcontoh paspor diplomatik dan paspor dinasnya yang sah.
2.
Dalam hal pengenalan paspor diplomatik atau paspor dinas baru, serta modifikasi terhadap yang telah ada, Para Pihak wajib saling memberitahukan secara tertulis, melalui saluran diplomatik, mengenai setiap perubahan 30 (tiga puluh) hari sebelum pengenalan resminya.
3.
Dalam hal warga negara dari salah satu Pihak kehilangan atau rusak paspor diplomatik atau paspor dinasnya di wilayah Pihak lainnya, mereka wajib segera memberitahukan kepada misi diplomatik atau pos konsuler di negara yang bersangkutan. Misi diplomatik atau pas konsuler yang bersangkutan wajib menerbitkan kepada orang dimaksud, sesuai dengan perundang-undangan nasionalnya, suatu dokumen untuk kembali ke negara asalnya.
PASAL9 PENYELESAIAN SENGKETA
Setiap perbedaan atau perselisihan yang timbul dari penafsiran atau pelaksanaan ketentuan Persetujuan ini akan diselesaikan secara damai melalui konsultasi atau perundingan antara Para Pihak.
PASAL10 PERUBAHAN
Persetujuan ini dapat diubah atau direvisi, apabila dipandang perlu, berdasarkan kesepakatan tertulis Para Pihak.
Perubahan atau revisi tersebut akan mulai
berlaku sesuai ketentuan Pasal 11 ayat 1 Persetujuan ini, dan menjadi bagian yang tak terpisahkan dari Persetujuan ini.
PASAL11 PEMBERLAKUAN, JANGKA WAKTU DAN PENGAKHIRAN
1. Persetujuan ini wajib mulai berlaku 30 (tiga puluh) hari sejak tanggal penerimaan pemberitahuan terakhir melalui saluran diplomatik bahwa semua persyaratan
untuk
mulai
berlakunya
Persetujuan
ini,
sebagaimana
dipersyaratkan oleh masing-masing perundang-undangan nasionalnya, telah dipenuhi. 2. Persetujuan ini wajib berlaku untuk waktu yang tidak ditentukan, kecuali salah satu Pihak memutuskan untuk mengakhiri Persetujuan ini dengan memberikan pemberitahuan secara tertulis kepada Pihak lain, melalui saluran diplomatik, 30 (tiga puluh) hari sebelum pengakhiran tersebut.
SEBAGAI BUKTI, yang bertanda tangan di bawah ini diberi kuasa penuh oleh
Pemerintahnya masing-masing, telah menandatangani Persetujuan ini.
DIBUAT di Bangkok pada 1 Juni 2012, dalam dua rangkap, dalam Bahasa
Indonesia, Bahasa Thai dan Bahasa lnggris, semua naskah memiliki keabsahan yang sama. Dalam hal terdapat perbedaan penafsiran, naskah Bahasa lnggris wajib berlaku.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE KINGDOM OF THAILAND ON VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC AND OFFICIAL/SERVICE PASSPORTS
The Government of the Republic of Indonesia and the Government of the Kingdom of Thailand, hereinafter referred to as "the Parties", CONSIDERING the friendly relations between the Parties; DESIRING to further strengthen their friendly relations, on a reciprocal basis, by facilitating the entry of holders of diplomatic and official/service passports of the Republic of Indonesia and the Kingdom of Thailand into their respective countries; PURSUANT to the prevailing laws and regulations of the respective countries; HAVE AGREED as follows: ARTICLE 1 VISA EXEMPTION 1.
Nationals of the Republic of Indonesia who are holders of valid diplomatic or service passports, shall not be required to obtain a visa to enter, transit and stay in the territory of the Kingdom of Thailand for a period which does not exceed 30 (thirty) days from the date of their entry.
2.
Nationals of the Kingdom of Thailand who are holders of valid diplomatic or official passports, shall not be required to obtain a visa to enter, transit and stay in the territory of the Republic of Indonesia for a period which does not exceed 30 (thirty) days from the date of their entry.
ARTICLE 2 DURATION OF PASSPORTS VALIDITY The duration of diplomatic and official/service passport validity of nationals of either Party shall be at least 6 (six) months on the date of entry into the territory of the other Party.
ARTICLE 3 VISA FOR MEMBERS OF DIPLOMATIC OR CONSULAR MISSION Nationals of either Party who are holders of valid diplomatic or official/service passports and assigned as members of diplomatic or consular mission in the territory of the other Party, including their family members who are holders of valid diplomatic or official/service passports, shall be required to obtain appropriate entry visa from the Embassy of the other Party prior to their entry.
ARTICLE 4 ENTRY AND EXIT CONDITIONS Holders of valid diplomatic and official/service passports of either Party referred to in this Agreement, may enter into and depart from the territory of the other Party, at any point authorized by the competent immigration authorities as international passenger traffic checkpoints, except for those stipulated in the laws and regulations concerning security, migratory, customs, sanitary entry and other legal provisions governing the entry, travel and stay of foreigners.

ARTICLE 5 AMENDMENT OF NATIONAL LAW
The Parties shall immediately inform each other in writing, through diplomatic channels about any changes in their respective laws and regulations concerning the entry, stay and exit of foreigners.
ARTICLE 6 RIGHTS OF AUTHORITIES
1.
This Agreement shall not exempt nationals of either Party from the obligation to respect the laws and regulations of the other Party when entering into its territory, including but not limited to the laws and regulations concerning the entry, stay and exit of foreigners.
2.
The Parties reserve the rights to refuse admission of entry or shorten the stay of persons, entitled to visa exemption under this Agreement, who are considered undesirable or likely to endanger public peace, public order, public health or national security.
ARTICLE 7 SUSPENSION
Either Party may temporarily suspend this Agreement, either in whole or in part, with the reasons of national security, public order or public health. The other Party shall be duly informed of the introduction, as well as the termination of the measures stated in this paragraph no later than 15 (fifteen) days through diplomatic channels in advance.
ARTICLE 8 SPECIMEN AND ISSUANCE OF PASSPORTS OR TRAVEL DOCUMENTS 1.
The Parties shall exchange, through diplomatic channels, within 30 (thirty) days after the signing of this Agreement, the specimens of their valid diplomatic and official/service passports.
2.
In case of introduction of new diplomatic or official/service passports, as well as, modifications of the existing ones, the Parties shall inform each other in writing, through diplomatic channels, about any changes 30 (thirty) days prior to their official introduction.
3.
In case of nationals of either Party lose or damage their diplomatic or official/service passports in the territory of the country of the other Party, they shall immediately inform their diplomatic mission or consular office in that country. The diplomatic mission or consular office shall issue to the aforementioned persons, in conformity with the legislation of their country, a document for returning to the country of their nationality.
ARTICLE 9 DISPUTE SETTLEMENT Any differences or disputes arising out of the interpretation or implementation of the provisions of this Agreement shall be settled amicably by consultation or negotiation between the Parties.
ARTICLE 10 AMENDMENTS This Agreement may be amended or revised, if it is deemed necessary, by mutual written consent of the Parties. Such amendment or revision shall enter into force according to the provision of paragraph 1 of Article 11 of this Agreement, and form as an integral part of this Agreement.
ARTICLE 11 ENTRY INTO FORCE, DURATION AND TERMINATION 1.
This Agreement shall enter into force 30 (thirty) days from the date of the receipt of the last written notification through diplomatic channels that all requirements for the entry into force of this Agreement, as stipulated by their respective national legislation, have been fulfilled.
2.
This Agreement shall remain in force for an indefinite period of time, unless either Party decides to terminate this Agreement by giving written notice to the other Party, through diplomatic channels, 30 (thirty) days prior to that effect.

IN WITNESS WHEREOF, the undersigned being duly authorized by their respective Governments, have signed this Agreement.
DONE at Bangkok on this 1st June 2012, in duplicate, in the Indonesian, Thai and English languages, all text being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
