PERDJANDJIAN DAGANG antara
REPUBLIK INDONE}SIA DAN REPUBLIK IRAQ
Pemerintah Republik Indonesia dan Pemerintah Republik Iraq, terdorong oleh keinginan untuk memperkembangkan hubungan perdagangan antara Indonesia dan Iraq serta berdasarkan atas persamaan dan keuntungan bersama telah mentjapai persetudjuan sebagai berikut: Pasal 1. Kedua Pemerintah menjetudjui untuk mengambil tindakantindakan seperlunja untuk memadjukan perdagangan langsung antara kedua negara, terutama perdagangan dalam barang-barang dan bahan-bahan jang disebut dalam daftar A dan daftar B jang terlampir pada perdjandjian ini. Barang-barang dan bahan-bahan jang tidak disebut dalam daftar tersebut dapat.pula diperdagangkan antara kedua negara. Pasal 2 . Kedua Pemerintah menjetudjui bahwa pertukaran barang-barang dan bahan-bahan
akan diselenggarakan
dalam
rangka peraturan-peraturan umum mengenai impor/ekspor jang berlaku dalam tiap-tiap negara selama berlakunja perdjandj ian ini. Fasal 3. Perlakuan jang diberikan oleh satu pihak kepada pihak jang lain tidak akan kurang daripada perlakuan jang diberikan oleh kedua pihak kepada pihak-pihak ketiga .

Perlakuan jang d i maksud diatas adalah perlakuan dalam hubungan dagang, terutama mengenai peraturan- peraturan pabean , bea dan tjukai, padjak- padjak , dan pemungutanpemungutan lain serta peraturan- peraturan impor dan ekspor dari barang-barang dan bahan-bahan.

Pasal 4. Kapal-kapal perniagaan kepunjaan sal ah satu pihak dalam perdjandjian ini,
beserta muatan- muatannja ,
akan diperbolehkan masulc dengan bebas kedalam pelabuhanpelabuhan jang terbuka bagi perdagangan luar negeri, penggunaan pelabuhan beserta fasilitet- fasil i tetnja , beaja pemuatan dan pembongkaran, padjak- padjak dan lainlain fasilitet , perlakuan jang tidak kurang daripada perlakuan terhadap kapal- kapal dari negara as ing lainnja . Konsesi-konsesi jang di peruntukkan bagi pel ajaran jang meme lihara perdagangan pantai tidak termasuk dalam pasal i ni. Fasal 5. Kedua belah pihak menjetudjui bahwa barangbarang dan bahan- bahan jang diekspor dari negara satu kenegara jang lain tidak akan diekspor lagi ( re-export) kenegara ketiga , ketjuali dj ika iz i n telah diperoleh terlebih dahulu dari negara asal barang- barang atau bahan- bahan tersebut.

Pasal 6.
Untuk mempermudah pelaksanaan dari Perdjandjian ini, maka kedua Pemerintah menjetudjui untuk atas permintaan salah satu p ihak merundingkan bersama hal-hal jang timbul dalam rangka Perdjandjian ini, atau hal- hal jang timbul dalam hubungan perdagangan antara kedua negara. Untuk maksud ini kedua negara akan membentuk suatu Panitya bersama jang akan berkumpul atas permintaan salah satu Pemerintah jang bersangkutan.

7.
Segala pembajaran- pembajaran jang harus dilakukan oleh seseorang atau oleh badan-badan hukum jang berkedudukan di Indonesia atau Iraq akan dibeajai melalui non-re sident account dinar Iraqi atau alat-alat pembajaran lain jang transferable atas persetudjuan dari kedua belah pihak.
Untuk maksud tersebut segala kontrak-
kontrak dan invoices jang bersangkutan dengan perdagangan antara Indonesia dan Iraq akan diselesaikan menurut peraturan tersebut diatas.

Perdjandjian ini akan berlaku mulai dari tanggal pertukaran alat-alat ratifikasi dan akan berlaku selama satu tahun, setelah mana perdjandjian tersebut dengan sendirinja dapat diperbaharui dari tahun ketahun, ketjuali djika s alah satu pihak memberitahukan setjara tertulis kepada pihak lain tentang k ehendaknja untuk

mengachiri Perdjandjian tersebut, tiga bulan sebeltUD. sa'at berachirnja Perdjandjian itu untuk tiap-tiap tahun jang bersangkutan. Dibuat di Baghdad pada tanggal 4 April tahun 1960. dalam rangkap dua aseli dalam naskah bahasa Indonesia, Arab dan Inggris, naskah mana semuanja adalah sah.

T RADE
A GR E E ME N T between
THE REPUBLIC OF INDONESIA AND THE REPUBLIC OF IRAQ.
The Government of the Republic of Indonesia and the Government of the Republic of Iraq, being desirous of expanding trade relations between Indonesia and Iraq based on the principle of equality and mutual benefit, have agreed as follows: Article
l,
The two Governments agree to take appropriate measures to promote direct trade between the two countries7 in particular to the goods or commodities mentioned in the schedules

to this agreement, Nothing in this agreement shall be deemed to preclude trade in goods or commodities not mentioned in the said schedules. Article
2,
The two Governments agree that the exchange of goods and commodities shall be subject to, and effected within, the scope of the general Import/Export regulations in force in each country during the validity of this agreement. Article
3.
The two Governments agree to grant each other no less '
favourable treatment in trade relations between the two countries than applied to any other country, in particular as regards: customs rules and formalities, customs duties, taxes and charges of any kind, regulations of imnort and export of goods and commodities, as well as with regard to the procedure governing import and export licences. Article
4,
The merchant ships belonging to either of the two Contracting Parties, toeether with their cargoes , shall enjoy, in respect of all matters relating to navigation, free entry into the ports open to foreign trade, use of ports and harbour facilities, loading and unloading dues, taxes and other facilities, a treatment in no way less favourable

Than the treatment accorded to the ships of any other foreign cotmtry , except that any concessions made to ships engaged in the coasting trade of either Party shall not be available under this Article to the other Party.
Article
5.
Both parties agree that commodities exported from one country to the other shall not be re-exported to a third country unless a prior approval from the originating country is obtained. Article
6.
In order to facilitate the implementation of this Agreement, the two Governments agree to consult together, upon the reauest of either, to discuss any matters arising from this agreement or in connection with the trade between the two countries . For this purpose they will form a joint Committee which will meet at the request of either Government . Article
7.
All current payments between physical and juridical persons having their domiciles in Indonesia and in Iraq shall be financed through a non-r esident Iraqi Dinar account or any other transferable currency a greed upon by both parties . For this purpose all contracts and i nvoices relating to the trade between Indonesia and Iraq shall be expressed in same . Article
8.
This Agreement shall come into force as from the date on which the instruments of ratifica tion are exchanged .
It shall remain in
force for one year and shall automatically be renewable from year to year unless notice of termination in writine has been gi ven by either Party three months before the expiry of the Agree ment in any year . Done at Baghdad on the 4th Day of April 1960 in two original copies in Indonesian, Arabic and English

Excellency, With reference to the Trade Agreement signed to-day between our two countries, an agreement was reached between us to the effect that the provisions of Article Three thereof shall not apply to: (1)
Privileges which are or may be gr anted by either of the two contracting Parties in order to facilitate frontier trade.
(2)
Special privileges and advantages which are or may be granted by the Iraqi Republic to any Arab State. I shall be very obliged if Your Excellency would be so kind
as to confirm that the above letter correctly sets out the agreement reached between us and is considered as an integral part of this Agreement. Please accept, Excellency, the

The respective instruments of ratification ot the Agreement aforesaid having been examined and round to be in due form, the exchange thereof took place this day.
