Kementerian Luar Negeri Republik Indonesia menyampaikan salam hormatnya kepada Kedutaan Besar Belgia di Jakarta dan dengan merujuk pada nota diplomatik Kedutaan no. 248 tertanggal 29 April 201 O menyampaikan bahwa Kementerian Luar Negeri menyambut baik keputusan unilateral negara-negara Benelux pada tanggal 1 November 2006 untuk memberikan pembebasan visa bagi pemegang paspor diplomatik dan dinas Indonesia selama 90 (sembilan puluh) hari. Selain itu, Kementerian Luar Negeri juga menyambut baik keputusan negara-negara Benelux untuk menerima usulan Indonesia untuk memberikan pembebasan visa bagi pemegang paspor diplomatik dan dinas dari negara-negara Benelux selama 30 (tiga puluh) hari. Kementenan Luar Negeri lebih fanjut menyampaikan usulan untuk memformalisasikan kesepakatan tersebut melalui Exchange of Notes. Terlampir disampaikan draft Nota-nota tersebut sebagai bahan pertimbangan pihak Benelux. Kementerian Luar Negeri Republik Indonesia menggunakan kesempatan rn1 untuk menyampaikan sekali lagi penghargaan yang setinggi-tingginya kepada Kedutaan Besar Belgia di Jakarta. The Ministry of Foreign Affairs of the Republic of Indonesia presents its compliments to the Embassy of Belgium in Jakarta and, referring to the latter's Note no. 248 dated 29 April 2010, has the honour to inform the latter that the Ministry welcomes the decision taken by Benelux countries to maintain the unilateral decision of November 151 2006 regarding the abolishment of visa requirements for bearers of Indonesian diplomatic and service passports for a duration of 90 (ninety) days and the decision to accept the Indonesian proposal for the abolishment of visa requirements for bearers of Benelux diplomatic and service passports for a duration of 30 (thirty) days. The Ministry would further like to propose that the agreement be formalized in the form of Exchange of Notes. Attached is the draft of the Notes for Benelux consideration. The Ministry of Foreign Affairs of the Republic of Indonesia avails itself of this opportunity to renew to the Embassy of Belgium in Jakarta the assurances of its highest consideration.

Excellency, I have the honor to refer to the recent discussions and correspondences held between the representatives of the Government of the Republic of Indonesia and the Government of Belgium in its capacity as the President of the Belgium, the Netherlands and Luxembourg (Benelux) and as such on behalf of the three Benelux countries concerning visa exemption for holders of diplomatic and service passports, and to propose. on behalf of the Government of the Republic of Indonesia, the following arrangements:
A. For the Government of the Republic of Indonesia: I. The Government or the Republic of Indonesia wi II exempt visa requirements for nationals of the Benelux countries who are holders of valid diplomatic or serv ice passports to enter, transit or stay in the territory of the Republic of Indonesia for a period which docs not exceed 30 (thirty) days, counted from the dale of entry. 2. Nationals of the Benelux countries who arc holders or valid diplomatic or service passports may enter into and depart from the territory of the Republic of Indonesia by any point authorized for that purpose by the competent immigration authorities. without any restriction except for those stipulated in the security, migratory, custom and sanitary provisions, and other provisions which may be legally applicable to holders of such valid passports. 3. Nationals of the Benelux countries who arc holders or valid diplomatic or service passports and assigned as members of diplomatic or consular mission in the territory of the Republic of Indonesia, including their family members who share the same household and who are holders of valid diplomatic or service passports, will be required to obtain appropriate visas from the Republic of Indonesia through diplomatic mission or consular office of the Republic of Indonesia in Benelux countries.

4. The duration of diplomatic or service passport validity of nationals of the Benelux countries wi ll be at least 6 (six) months on the date of entry into the territory of the Republic of Indonesia.

5. Nationals of the Benelux countries who arc holders of valid diplomatic or service passports wi ll respect the laws and regu lations of the Republic of Indonesia concerning the entry, stay and exit of foreigners. The Government of the Republic of Indonesia reserves the right to refuse adm ission to or shorten the stay of persons considered undesirable or likely to endanger the public peace. public order, public health or national security.
B. For the Benelux countries: I. The Benelux countries will exempt visa requirements for nationals of the Republic of Indonesia who arc holders of valid diplomatic or service passports to enter, transit or stay in the territory of the Benelux Economic Union for a period which does not exceed 90 (ninety) days, counted from the date of entry into either the territory of the Benelux Economic Union. 2. Nationals of the Republic of Indonesia who arc holders of valid diplomatic or service passports may enter into and depart from the territory of the Benelux by any point authori.1.cd for that purpose by the competent immigration authorities, without any restriction except for those stipulated in the security, migratory, custom and sanitary provisions, and other provisions which may be legally applicable to holders of such valid passports. 3. Eropa Barat telah menerima nota diplomatik dari Kedutaan Besar Belgia di Jakarta No. 09/510 tertanggal 20 Mei 2009 yang intinya menyampaikan keinginan agar pembebasan visa bagi pemegang paspor diplomatik dan paspor dinas dari negara-negara Benelux dapat diberlakukan secara resiprokal selama 90 hari.

Nota Diplomatik tersebut merupakan tanggapan atas Surat Menlu tanggal 22 Januari 2009 yang ditujukan kepada Sekjen Benelux mengenai usulan Indonesia untuk memberikan pembebasan visa bagi pemegang paspor diplomatik dan paspor dinas dari negara-negara Benelux selama tidak lebih dari 30 hari.

Mengingat hal tersebut terkait dengan kewenangan dan lingkup tugas Saudara, mohon permintaan Kedubes Belgia dimaksud dapat ditanggapi dalam waktu yang tidak terlalu lama.

Holders of such passports are visa exempted for stays not exceeding 90 days

Merujuk perihal tersebut pada pokok nota dengan hormat d1sampaikan hal-hal sebagai berikut: 1.
Berdasarkan nota diplomatik dan Kedutaan Besar Belg1a d1 Jakarta no 248 tanggal 29 April 2010, pihak Benelux telah menerima tawaran Pemenntah Indonesia yang memberikan bebas visa selama 30 (tlga pufuh) han bag1 pemegang paspor dinas dan paspor dipfomatik Benelux untuk berkun1ung ke Indonesia, sebaga1 res1prositas kepada pihak Benelux yang sejak 1 November 2006 telah secara unilateral memberikan bebas visa selama 90 (sembilan puluh) hari bagi pemegang paspor dinas dan paspor diplomatik Indonesia yang berkunjung ke Benelux

Selanjutnya, dari pembahasan inter kementenan d1 pihak Indonesia, bentuk formalisasi pengaturan bebas visa tersebut hingga kini belum dapat disepakati. Dua altematif beserta argumentasi yang diusulkan adalah sebaga1 benkut a. Bentuk agreement dinilai akan lebih kuat dari sisi hukum dan relatif tidak akan terkendala dalam proses ratifikasi. b. Bentuk exchange of notes diusulkan dengan pertimbangan bahwa kesepakatan dalam bentuk yang lebih mengikat (MoU/Agreement) dikhawatirkan akan membuka peluang parlemen negara-negara Benelux untuk dapat membahas kembali kebijakan pemberian fasilitas bebas visa yang telah mereka benkan secara unilateral, terutama karena res1pros1tas yang diberikan oleh p1hak Indonesia ttdak seimbang.

Rapat interkem terakhir yang diadakan ofeh Drrektorat Hukum Kementerian Luar Negeri pada tanggaf 21 Februari 2011 menyimpufkan bahwa mengingat tingkat kepentingan Indonesia yang besar, maka apabifa bentuk exchange of notes tetap akan digunakan, maka kiranya diperfukan pertimbangan Pres1den Rf terhadap usulan bentuk tersebut. Sekrranya tidak ada keberatan dan Menten Luar Negen dan Presiden perihal digunakannya exchange of notes dalam pembentukan kesepakatan bersama ini, maka penyusunan draft kesepakatan bersama tersebut dapat dilakukan pada kesempatan pertama

Sebagai informasi, Undang-Undang no 9 tahun 1992 tentang Ke1m1grasian pasal 7 ayat 1 butir (a) berbunyi: Pasal 7 (1)
Dikecualikan dari kewajiban memiliki Visa sebagaimana dimaksud dalam Pasal 6 ayat (1) adalah: a. orang asmg warga negara da11 nogara yang berdasarkan Keputusan Presiden tidak diwaj1bkan memil1k1 Visa

Pasal tersebut dan pasal-pasal yang berkaitan tidak menyebutkan keharusan untuk membuat kesepakatan bebas visa dalam bentuk MoU atau Agreement. 5.
Sehubungan dengan itu, apabila tidak ada pertimbangan lain yang memberatkan, menurut hemat kami formalisasi dapat dilakukan melalui exchange of notes dan kemudian secara internal ditetapkan dengan Keputusan Presiden untuk dapat direalisasikan oleh Direktorat Jenderal lmigrasi segera.

Terlampir disampaikan konsep surat Menteri Luar Negeri kepada Presiden RI guna mendapatkan persetujuan dan tandatangan.

Reference 1s made to the dec1s1on taken by the BENELUX countries which, since November 1st 2006, abolished visa requirements for bearers of diplomatic and service passports of the Republic of Indonesia and this for a duration of three months. Further reference is made to the last Benelux visa sub-committee, which has been held on January 22"" 2010, in view of finalizing the position of the Benelux regarding this matter. On March 1sin 2010 it has been decided to maintain and confirm the unilateral decision of November 1st 2006. Furthermore it has been decideQ to accept the Indonesian proposal for the abolishment of visa requirements for bearers of diplomatic and service passports of the three Benelux countries for the durabon of one month. Merujuk barafks Direktur Eropa Barat nomor RR-00611 /DEPLU/ll/09 tanggal 1O Februari 2009 dengan hormat disampaikan hal-hal sebagai berikut :
1. Sesuai arahan pusat, pada tanggal 12 Februarl 2009 kami telah menyerahkan salinan surat Menlu RI yang ditujukan untuk SEKJEN BENELUX Union kepada Menlu Luksemburg. Salinan surat tersebut diterima langsung oleh Mr. nm Kesseler, Wakil KPN Kemlu Luksemburg. 2. Terkait dengan hal tersebut, terdapat beberapa hal yang kiranya dapat
dipert1mbangkan yaitu :

Secara prinsip KBRI Brussel sangat menyambut baik keputusan Pemerintah Indonesia untuk membebaskan visa untuk masuk ke Indonesia bagi pemegang paspor dinas dan diplomatik negara BENELUX.
b}
Keputusan Dewan Uni Eropa no. 2006/684/EC yang membebaskan pemegang paspor diplomatik dan dinas Indonesia dari ketentuan memiliki visa untuk memasuki negara BENELUX merupakan keputusan internal Dewan Uni Eropa atas usul dan inisiatif negara BENELUX. Tidak terdapat perjanjian antara Dewan Uni Eropa atau Benelux Union dengan Pemri atas hal ini.

Oleh karena itu mempertimbangkan azas resiprositas kami tidak melihat perlunya Pemri memiliki perjanjian terpisah dengan negara BENELUX atas hal tersebut pada butir (a). Dalam pandangan kami. keputusan Pemri untuk membebaskan visa bagi pemegang paspor diplomatik dan dinas BENELUX cukup dibuat secara internal, sesuai ketentuan keimigrasian Indonesia yang berlaku. Setelah menjadi sebuah keputusan yang memiliki kekuatan hukum maka keputusan ini baru diberitahukan kepada negara BENELUX.
d)
Sebagai ilustrasi, berdasarkan keputusan no. 2006/684/EC tersebut, pemegang paspor diplomatik dan dinas Indonesia dapat tinggal di wilayah BENELUX selama maksimal 90 hari dalam waktu 1 {satu) tahun. Hal ini merupakan ketentuan umum dari Schengen acquis untuk sebuah kunjungan
singkat. Sementara itu dalam surat Menlu RI kepada Sekjen Benelux Union, Pemri mengusulkan agar pemegang paspor diplomatik dan dinas Indonesia dapat tinggal di wilayah BENELUX tidak lebih dari 30 hari dalam 6 blulan. Apabila hat ini disetujui oleh negara BENELUX maka otomatis masa tinggal yang akan diperoleh pemegang paspor diplomatik dan dinas Indonesia menjadi lebih pendek dari yang sudah berlaku selama ini. Merujuk penhal pada pokok nota, bersama int disampa1kan bahwa Kedutaan Besar Belgia di Jakarta melalui Nola Diplomatik No. C4 1 Nr. 1863 tanggal 1 7 Desember 2008 menyampaikan hal-hal sebagai berikut: 1.
Negara-negara Benelux yang terdin dan Belanda. Belg1a dan Luksemburg tela'l memberikan pembebasan visa bag1 pemegang paspor diplomat1k dan dinas dan Indonesia yang akan berkunjung ke negara-negara tersebut sejak 1 November
2006. 2.
Oalam penyelenggaraan Senior Officials Meetmg (SOM) RI - Belanda d1 Bah, 9 Oktober 2008 yang lalu, delegasi Belanda telah menyampaikan keinginan untuk memperoleh pembebasan visa bag1 pemegang paspor d1plomatik dan dinas dari negara-negara Belgia, Belanda dan Luksemburg yang akan berkunjung ke Indonesia berdasarkan asas resiprositas

Terkait hal tersebut, atas nama negara anggota Benelux, Kedutaan Besar Belgia di Jakarta menyampa1kan permintaan agar Pemenntah Indonesia dapal menerapkan asas resiprositas terkait pembebasan visa bagi pemegang paspor diplomatik dan dinas dari negara tersebut yang akan berkun1ung Indonesia

Hubungan bilateral antara Indonesia dengan negara anggota Benelux saat 1ni menunjukkan peningkatan s1gnifikan yang tercerm1n dalam berbagai ke11asama di bidang politik, ekonom1, sos1al dan budaya. Hal ini berdampak pada peningkatan kegiatan saling kun1ung antar pe1abat dan Indonesia d an dari

VERBAL N OTE 011 beltalf of t!te BENELUX co1111trie~ (Belgium, llte Netlterln11ds and L11xe111b11rg) The Embassy of the Kingdom of Belgium in Jakarta presents its compliments to the Department of Foreign Affairs of the Republic of indonesia, Directorate General of Protocol and Consular Affairs, and has the honour, in its capacity of Benelux President and as such on behalf of the three BENELUX countries (Belgium, the Netherlands and Lu\emburg}, to request the following from the Esteemed Department. Reference is made to the decision taken by the BENELUX countries which, since November l 5 t 2006, abolished visa requirements for bearers of d1plomat1c and service passports of the Republic of Indonesia, and this, without concluding a Visa Abolition Agreement (which 1s usually lmked to a readmission agreement). Reference is further made to the Indonesian-Dutch bilateral pol1llcal consultations regarding this issue, as well as to the recent meeting of l hc Dulch Ambassador with the Indonesian Minister of Justice on this matter. The Embassy of Belgium in Jakarta, on behalf of the BENELUX countries, would greatly appreciate that the BENELUX countries be granted rec1proc1ty in this rnatter by receiving a similar exemption of visa requirements for bearers of diplomatic and service passports from Belgium, the Netherlands and Luxemburg. The Embassy of Belgium in Jakarta would be grateful to be informed in timely fashion of the decision by the Directorate General of Protocol and Consular Affai rs rega rding this significant issue for the BENELUX countries. The Embassy of Belgium in Jakarta avails itself of this opportunity to renew to the Department of Foreign Affairs of the Republic of Indonesia the assurances of its highest cons1derat1on.
