NOTA KESEPAHAMAN ANTARA KEMENTERIAN LUAR NEGERI REPUBLIK INDONESIA DAN KEMENTERIAN LUAR NEGERI REPUBLIK PANAMA MENGENAI KONSUL TASI BILATERAL
Kementerian Luar Negeri Republik Indonesia dan Kementerian Luar Negeri Republik Panama, selanjutnya disebut sebagai "Para Pihak"; BERKEINGINAN untuk meningkatkan saling pengertian dan kerjasama antara kedua negara untuk mengembangkan dan memperkuat hubungan kedua negara yang berdasarkan keterbukaan, saling menghormati, keuntungan bersama, dan prinsip-prinsip kesetaraan kedautatan; MENYADARI kebutuhan untuk menciptakan suatu mekanisme konsultasi bilateral antara Para Pihak mengenai hal-hal dari kepentingan bersama; BERKEYAKINAN bahwa konsultasi berkala dan pertukaran pikiran dan informasi mengenai hubungan bilateral dan masalah internasional dari kepentingan bersama akan saling menguntungkan; SESUAI dengan peraturan perundang-undangan yang berlaku di kedua negara;
Telah menyetujui sebagai berikut: Pasal I Tujuan
Tujuan dari Nota Kesepahaman ini adalah untuK memfasilitasi penyelenggaraan konsultasi berkala antara Para Pihak guna meninjau dan mengkaji seluruh aspek hubungan bilateral serta untuk saling bertukar pandangan mengenai isu-isu internasional yang menjadi kepentingan bersama.

Pasalll Mekanisme Konsultasi
1. Konsultasi akan diselenggarakan secara berkala, bergantian di Indonesia atau di Panama sesuai dengan kesepakatan bersama. Pelaksanaan konsultasi dan perincian mengenai tanggal, tempat, agenda, serta tingkat perwakilan pada konsultasi tersebut akan disetujui melalui saluran diplomatik. 2. Para Pihak akan menjamin kerahasiaan hasil dari konsultasi, termasuk setiap dokumen dan/atau informasi yang dipertukarkan antara Para Pihak yang tidak dapat dipindahkan atau diberikan kepada pihak ketiga tanpa persetujuan tertulis dari Pihak lainnya. 3. Kedua Pihak dapat mengundang pihak berwenang lainnya dan/atau peserta yang berasal dari masing-masing negara untuk menghadiri pertemuan yang didasarkan atas Nota Kesepahaman ini, sesuai dengan kesepakatan bersama oleh Para Pihak. 4. Para Pihak dapat membentuk kelompok kerja atau pertemuan para ahli untuk membahas kepentingan bersama di bidang-bidang tertentu. Pasal Ill Ruang Lingkup Kerjasama
1. Para Pihak akan melaksanakan Konsultasi untuk membahas halhal yang menjadi kepentingan bersama, terutama isu-isu politik, ekonomi, kebudayaan, konsuler, sosial, dan pendidikan. 2. Para Pihak juga dapat bertukar pandangan mengenai isu-isu internasional dan regional serta perkembangan atas masalah bersama dan, jika diperlukan, membahas kerjasama bilateral dalam hal-hal regional dan internasional. 3. Para Pihak mendorong kerjasama dan hubungan langsung antara kedua institusi diplomatik kedua negara. Pasal IV Penyelesaian Perbedaan
Setiap perbedaan yang mungkin timbul dari interpretasi atau implementasi dari Nota Kesepahaman ini akan diselesaikan secara damai melalui konsultasi diantara Para Pihak.
PasalV Perubahan Nota Kesepahaman ini dapat diubah secara tertulis setiap saat melalui kesepakatan bersama oleh Para Pihak. Perubahan tersebut akan mulai berlaku pada tanggal yang disetujui oleh Para Pihak dan akan menjadi bagian yang tidak terpisahkan dari Nota Kesepahaman ini.
Pasal VI Ketentuan-Ketentuan Penutup 1. Nota Kesepahaman penandatanganannya.

2. Nota Kesepahaman ini akan tetap berlaku untuk jangka waktu 5 (lima) tahun dan dapat diperpanjang melalui kesepakatan tertulis untuk jangka waktu 5 (lima) tahun berikutnya. 3. Salah satu Pihak dapat mengakhiri Nota Kesepahaman ini setiap saat melalui pemberitahuan tertulis kepada Pihak lainnya. Nota Kesepahaman akan berakhir dalam waktu 6 (enam) bulan setelah pemberitahuan tertulis diterima. SEBAGAI BUKTI , yang bertandatangan di bawah ini, dengan diberi kuasa oleh pemerintah masing-masing, telah menandatangani Nota Kesepahaman ini. Dibuat dalam rangkap dua di Panama City pada tanggal lima bulan Juni pada tahun dua ribu lima betas dalam bahasa Indonesia, Spanyol, dan lnggris, semua naskah memiliki kekuatan hukum yang sama. Apabila terjadi perbedaan penafsiran, maka naskah dalam bahasa lnggris yang berlaku.

MEMORANDUM DE ENTENDIMIENTO ENT RE EL MINISTERIO DE RELACIONES EXTERIORES DE LA REPUBLICA DE INDONESIA y EL MINISTERIO DE RELACIONES EXTERIORES DE LA REPUBLICA DE PANAMA SOBRE CONSULTAS BILATERALES El Ministerio de Relaciones Exteriores de la Republica de Indonesia y el Ministerio de Relaciones Exteriores de la Republica de Panama, en adelante denominados "las Partes",
Deseosos de promover el entendimiento mutuo y la cooperaci6n entre ambos paises y pueblos para desarrollar y fortalecer las relaciones entre ambas naciones, basadas en la transparencia, el respeto mutuo, beneficio comun y los principios de la igualdad soberana; Reconociendo la necesidad de crear un mecanismo de consulta bilateral entre las Partes sabre asuntos de interes comun; Convencidos de que la consulta peri6dica y el intercambio de ideas e informaci6n sobre las relaciones bilaterales y asuntos internacionales de interes comun serian de beneficio mutuo; De conformidad con las leyes y reglamentos vigentes de los dos paises, Han acordado lo siguiente: Articulo I Prop6sito El prop6sito de este Memorandum de Entendimiento es facilitar la celebraci6n de consultas peri6dicas entre las Partes para revisar y examinar
todos los aspectos de sus relaciones bilaterales e intercambiar puntos de vista sobre temas internacionales de interes mutuo. Articulo II Mecanismo de Consulta
1.
La consulta se llevara a cabo con regularidad , alternativamente
en Indonesia o en Panama segun acuerdo mutuo entre las Partes. Las modalidades para la consulta y los detalles sobre la fecha, lugar, orden del dia, y el nivel de los representantes de la consulta seran acordadas por la via diplomatica. 2.
Las Partes garantizaran la confidencialidad de los resultados de
la consulta, incluyendo los documentos y/o informaci6n intercambiada entre las Partes, los cuales no seran transferidos o cedidos a terceros sin el consentimiento previo por escrito de la otra Parte. 3.
Ambas Partes podran invitar a otras autoridades y/o participantes
de sus respectivos paises para asistir a las reuniones celebradas sobre la base de este Memorandum de Entendimiento, con sujeci6n al consentimiento mutuo de las Partes. 4.
Las Partes podran establecer grupos de trabajo o reuniones de
expertos para discutir areas especificas de interes mutuo. Articulo Ill Ambito de Consultas
1.
Las Partes realizaran consultas para discutir asuntos de interes
comun, en particular los temas politicos, econ6micos, culturales, consulares, sociales y educativos. 2. Las Partes podran intercambiar puntos de vista sobre temas y acontecimientos regionales e internacionales de interes comun, y cuando sea necesario, discutir la cooperaci6n bilateral en asunto''s regionales e internacionales.

Las Partes fomentaran la cooperaci6n y el contacto directo entre
los miembros de sus servicios diplornaticos. Artitculo IV Soluci6n de Diferencias
Las diferencias que pudieran surgir de la interpretaci6n o implementaci6n del presente Memorandum de Entendimiento se resolveran amistosamente mediante consultas entre las Partes. Articulo V Enmienda
El presente Memorandum de Entendimiento podra ser modificado por escrito en cualquier momento, por consentimiento mutuo de las Partes. Esta modificaci6n entrara en vigor en una fecha mutuamente acordada por las Partes, y formara parte integrante del presente Memorandum de Entendimiento. Articulo VI Disposiciones Finales
1. Este Memorandum de Entendimiento entrara en vigor en la fecha de su firma. 2. Este Memorandum de Entendimiento tendra una vigencia de cinco (5) anos y podra ser prorrogado por acuerdo mutuo por escrito por periodos sucesivos de cinco (5) anos. 3. Cualquiera de las Partes podra dar por terminado el presente Memorandum de Entendimiento en cualquier momento mediante notificaci6n escrita a la otra Parte. Este Memorandum de Entendimiento dejara de estar en vigor seis (6) meses despues de la fecha en que se recibi6 la notificaci6n. EN FE DE LO CUAL, los abajo firmantes , debidamente autorizados al efecto, han firmado el presente Memorandum de Entendimiento.
Hecho por duplicado en la ciudad de Panama, este dia cinco (5) de junio del atio dos mil quince (2015), en los idiomas indonesio, espatiol e ingles, siendo todos los textos igualmente autenticos. En caso de cualquier divergencia en la interpretaci6n, el texto en ingles prevalecera.

MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF PANAMA ON BILATERAL CONSULTATION
The Ministry of Foreign Affairs of the Republic of Indonesia and the Ministry of Foreign Affairs of the Republic of Panama, hereinafter referred to as the "Parties"; DESIRING to promote mutual understanding and cooperation between both countries and peoples to develop and strengthen the relations between both nations based on openness, mutual respect, common benefit, and the principles of sovereign equality; RECOGNIZING the need to create a mechanism for bilateral consultation between the Parties on matters of common interests; CONVINCED that periodical consultation and exchange of ideas and information on bilateral relations and international matters of common interest would be of mutual benefit; PURSUANT to the prevailing laws and regulations of the two countries; Have agreed as follows : Article I Purpose The purpose of this Memorandum of Understanding is to facilitate the holding of regular consultations between the Parties to review and examine all aspects of their bilateral relations and to exchange views on international issues of mutual interest.
Article II Mechanism of Consultation
1. The consultation will be held regularly, alternately in Indonesia or in Panama as mutually agreed by the Parties. The modalities for the consultation and details concerning the date, venue, agenda, and level of representatives of the consultation will be agreed upon through diplomatic channel. 2. The Parties will guarantee the confidentiality of the outcome of the consultation, including any documents and/or information exchanged between the Parties, which will not be transferred or passed to a third party without the prior written consent of the other Parties. 3. Both Parties may invite other authorities and/or participants from their respective countries to attend meetings held based on this Memorandum of Understanding, subject to the mutual consent of the Parties. 4. The Parties may establish working groups or expert meetings in order to discuss specific areas of mutual interest. Article Ill Scope of Consultation
1. The Parties will carry out Consultation to discuss matters of common interest, in particular political, economic, cultural, consular, social, and educational issues. 2. The Parties may also exchange views on international and regional issues and developments of common concern, and whenever necessary, discuss bilateral cooperation in regional or international matters. 3. The Parties will encourage cooperation and direct contacts between members of their diplomatic services. Article IV Settlement of Differences
Any differences that may arise from the interpretation or implementation of this Memorandum of Understanding will be settled amicably through consultations between the Parties.
A rticle V Amendment This Memorandum of Understanding may be amended in writing at any time by mutual consent of the Parties. Such amendment will enter into force on a date mutually agreed by the Parties and will form an integral part of this Memorandum of Understanding. A rticle VI Final Provisions 1. This Memorandum of Understanding will enter into force on the date of its signing. 2. This Memorandum of Understanding will remain in force a period of five (5) years and may be extended by mutual written agreement for subsequent periods of five (5) years. 3. Either Party may terminate this Memorandum of Understanding at any time by giving written notice to the other Party. This Memorandum of Understanding will cease to be in force six (6) months after the date on which the notice was received. IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed this Memorandum of Understanding. Done in duplicate at Panama City, on this fifth day of June, in the year two thousand and fifteen, in Indonesian, Spanish, and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text will prevail.
