MEMORANDUM SALING PENGERTIAN ANT ARA KEMENTERIAN LUAR NEGERI REPUBLIK INDONESIA DAN KEMENTERIAN LUAR NEGERI UKRAINA MENGENAI KERJA SAMA PELATIHAN DIPLOMATIK
Kementerian Luar Negeri Republik Indonesia dan Kementerian Luar Negeri Ukraina, selanjutnya disebut "Para Pihak";
BERKEINGINAN untuk membangun dan mengembangkan kerja sama di bidang
pelatihan diplomatik; MEMPERTIMBANGKAN kepentingan bersama mereka untuk menciptakan
kondisi-kondisi guna memelihara hubungan secara regular dan mendorong kerja sama
pelatihan
diplomatik
berdasarkan
asas
timbal balik
dan
saling
menguntungkan; MERUJUK pada Persetujuan antara Pemerintah Republik Indonesia dan
Pemerintah Ukraina mengenai Kerja Sama Ekonomi dan Teknik yang ditandatangani di Jakarta pada Februari 1996; SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di
masing-masing negara Pihak;
TELAH MENCAPAI kesepahaman sebagai berikut:
Pasal 1 TUJUAN
Tujuan dari Memorandum Saling Pengertian ini adalah untuk: 1.
Menciptakan dan
memelihara
hubungan diplomatik dan
mendorong
kerjasama pelatihan diplomatik di antara Para Pihak; 2.
Menyediakan kerangka kerja sama dan mendorong peningkatan kapasitas di bidang pendidikan dan pelatihan diplomatik di antara kedua negara. Kerja sama dimaksud tidak akan didasarkan pada pertimbangan komersial;
Pasal2 BENTUK KERJA SAMA
Bentuk kerja sama di bawah Memorandum Saling Pengertian ini dapat meliputi: 1.
Pertukaran bahan pengajaran, pengetahuan dan pengalaman, metode dalam penyelenggaraan pelatihan diplomatik, program pelatihan, seminar;
2.
Pertukaran literatur dan publikasi terkait yang diterbitkan oleh Para Pihak atau lembaga lainnya yang ada di negara masing-masing di bidang kebijakan
luar negeri, hubungan
internasional, hukum
ekonomi internasional, ilmu politik atau
internasional,
bidang lain yang
menjadi
kepentingan bersama; 3.
Pertukaran pengetahuan dan pengalaman mengenai pengaturan kerja di bidang perpustakaan;
4.
Konsultasi bersama mengenai pelatihan bahasa asing;
5.
Pengaturan pertemuan mengenai isu-isu yang menjadi kepentingan bersama serta pertukaran fakultas dari kedua Pihak;
6.
Pertukaran
para
ahli, tenaga
pengajar dan
siswa
untuk
berbagi
pengetahuan dan pengalaman dalam pelatihan diplomatik, konferensi, simposium, dan diskusi panel; 7.
Bentuk kerja sama lainnya yang dapat diputuskan bersama oleh Para Pihak.
Pasal3 LEMBAGA PELAKSANA
Lembaga Pelaksana yang bertanggung jawab atas pelaksanaan Memorandum Saling Pengertian ini adalah sebagai berikut:
1.
Kementerian Luar Negeri Republik Indonesia menunjuk Pusat Pendidikan dan Pelatihan Kementerian Luar Negeri Republik Indonesia.
2.
Kementerian Luar Negeri Ukraina menunjuk Akademi Diplomatik Ukraina di bawah Kementerian Luar Negeri Ukraina;
Pasal4
PELAKSANAAN 1.
Untuk pelaksanaan Memorandum Saling Pengertian ini, sebuah pengaturan khusus akan disusun oleh Lembaga Pelaksana meliputi syarat dan ketentuan, prosedur, rencana, program yang direkomendasikan, dan ketentuan kerja sama lain yang disetujui berdasarkan Memorandum Saling Pengertian ini;
2.
Para Pihak akan menyelenggarakan konsultasi secara berkala apabila dipandang perlu untuk mengevaluasi pelaksanaan Memorandum Saling Pengertian ini dan merekomendasikan proyek kegiatan kerja sama lainnya berdasarkan Memorandum Saling Pengertian ini;
Pasal5
PENGATURANKEUANGAN 1.
Pengaturan keuangan untuk pelaksanaan Memorandum Saling Pengertian ini akan ditentukan oleh Para Pihak atas dasar kasus per kasus dan akan bergantung pada ketersediaan dana dan personil.
2.
Kecuali diputuskan lain secara bersama. masing-masing Pihak akan bertanggung jawab untuk menyediakan pembiayaannya sendiri dalam pelaksanaan Memorandum Saling Pengertian ini;
3.
Para Pihak dapat membuat pengaturan lain mengenai masalah keuangan dengan Pihak ketiga atas dasar persetujuan bersama secara tertulis.
Pasal6
PENYELESAIAN PERSELISIHAN Setiap perselisihan yang timbul dari penafsiran dan pelaksanaan Memorandum Saling Pengertian ini akan diselesaikan secara damai melalui konsultasi dan perundingan oleh Para Pihak.
Pasal 7 PEMBATASAN KEGIAT AN PERSON IL
Masing-masing Pihak wajib memastikan bahwa semua personil yang terlibat dalam kegiatan di bawah Memorandum Saling Pengertian ini tidak akan berpartisipasi dalam kegiatan politik dan/atau kegiatan komersial di negara penerima di luar kegiatan atau program kerja sama di bawah Memorandum Saling Pengertian ini.
Pasal8 AMAN DEM EN
Memorandum Saling Pengertian ini dapat ditinjau atau diubah setiap waktu atas kesepakatan bersama secara tertulis dari Para Pihak. Peninjauan kembali atau perubahan-perubahan dimaksud akan mulai berlaku pada tanggal sebagaimana ditentukan oleh Para Pihak dan akan menjadi bagian yang tidak terpisahkan dari Memorandum Saling Pengertian ini.
Pasal9 MULAI BERLAKU, MASA BERLAKU DAN PENGAKHIRAN
1.
Memorandum Saling Pengertian ini akan mulai berlaku pada tanggal penandatanganan
dan
akan tetap berlaku selama
3 (tiga) tahun.
Memorandum ini akan diperpanjang secara otomatis untuk 1 (satu) tahun berikutnya, kecuali salah satu Pihak memberitahu Pihak lain, secara tertulis, mengenai keinginannya untuk mengakhiri Memorandum Saling Pengertian ini selambat-lambatnya tiga bulan sebelum tanggal pengakhiran yang diinginkan. 2.
Pengakhiran Memorandum Saling Pengertian ini tidak akan memengaruhi keabsahan dan masa berlaku setiap program atau kegiatan yang sedang berjalan yang dibuat berdasarkan Memorandum Saling Pengertian ini hingga penyelesaian program atau kegiatan tersebut kecuali Para Pihak memutuskan lain.

MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF FOREIGN AFFAIRS OF UKRAINE ON DIPLOMATIC TRAINING COOPERATION
The Ministry of Foreign Affairs of the Republic of Indonesia and the Ministry of Foreign Affairs of Ukraine, hereinafter referred to as "the Parties";
DESIRING to establish and develop cooperation in the field of diplomatic
training;
CONSIDERING their common interest to create conditions for maintaining
regular contacts and promoting diplomatic training cooperation on the basis of reciprocity and mutual benefit; REFERRING to the Agreement between the Government of the Republic of
Indonesia and the Government of Ukraine on Economic and Technical Cooperation signed in Jakarta in February 1996;
PURSUANT to the prevailing laws and regulations of the States of the Parties;
HAVE REACHED the following understanding :
Article 1
OBJECTIVES
The objectives of the Memorandum of Understanding are to:
1. Create and
maintain regular contacts and promoting diplomatic training
cooperation between the Parties; 2. Provide a framework of cooperation and promote capacity building in the field of diplomatic education and training between the two countries. Such cooperation shall not be guided by any commercial consideration. Article 2
FORMS OF COOPERATION
Forms of cooperation under this Memorandum of Understanding may include: 1. Exchange of teaching materials, knowledge and experience, methods in the organization of diplomatic courses, training programs, seminars; 2. Exchange of relevant literature and publications published by the Parties or other institutions in their respective countries in the field of foreign policy, international relations, international law, international economic affairs, political sciences or other subjects of common interest; 3. Exchange of knowledge and experience concerning the organization of work in libraries; 4. Joint consultations on foreign language courses; 5. Organization of meetings on issues of mutual interest as well as the exchange of faculty of the two Parties; 6. Exchange of experts, lecturers and students to share their knowledge and experience in diplomatic trainings, conferences, symposiums and panel discussion; 7. Any other forms of cooperation that may be jointly decided upon by the Parties.
Article 3
EXECUTING AGENCIES
The Executing Agencies that are responsible for the implementation of this
Memorandum of Understanding are as follows: 1. The Ministry of Foreign Affairs of the Republic of Indonesia designates the Centre for Education and Training of the Ministry of Foreign Affairs of the Republic of Indonesia; 2. The Ministry of Foreign Affairs of Ukraine designates the Diplomatic Academy of Ukraine under the Ministry of Foreign Affairs of Ukraine. Article 4
IMPLEMENTATIONS
1. For the implementation of this Memorandum of Understanding, a specific arrangement shall be concluded by the Executing Agencies which include terms and conditions, procedures, plans, recommended programs, and other agreed
provisions
of the
cooperation
under this
Memorandum
of
Understanding. 2. The Parties shall hold periodical consultations as deemed
necessary to
review the implementation of this Memorandum of Understanding and recommend other projects of activities of the cooperation under this Memorandum of Understanding. Artic le 5
FINANCIAL ARRANGEMENT
1. The financial arrangement for the implementation of this Memorandum of Understanding shall be determined by the Parties on case-by-case basis and shall be subject to the availability of fund and personnel. 2. Unless otherwise jointly decided, each Party shall be responsible to provide its own cost incurred in the implementation of this Memorandum of Understanding. 3. The Parties may conclude other arrangements concerning the financia l matters with the Third Parties by mutually written consent.
Article 6 SETTLEMENT OF DISPUTE
Any disputes arising out of the interpretation and implementation of this Memorandum of Understanding shall be settled amicably through consultations and negotiations by the Parties. Artic le 7 LIMITATION OF PERSONNEL
Each party shall ensure that all personals engaged in the activities under this Memorandum of Understanding will not participate in any political affairs and/or any commercial ventures in the host country outside the activities or programs on cooperation under this Memorandum of Understanding. Article 8 AMENDMENT
This Memorandum of Understanding may be reviewed or amended at any time by mutually written consent of the Parties. Such revisions or amendments shall enter into force on a date as determined by the Parties and shall form an integral part of this Memorandum of Understanding. Article 9 ENTRY INTO FORCE, DURATION AND TERMINATION
1. This Memorandum of Understanding shall enter into force on the date of signature and shall remain in effect for a period of 3 (three) years. It shall be automatically extended for 1 (one) year consecutively, unless either Party notifies the other, in writing, of its intention to terminate this Memorandum of Understanding at least three months prior to the intended date of termination. 2. The termination of this Memorandum of Understanding shall not affect the validity and duration of any ongoing programs or activities made under this Memorandum of Understanding until the completion of such programs or activities unless the Parties agree otherwise.
IN WITNESS WHEREOF , the undersigned have signed this Memorandum of
Understanding. Done in Jakarta on the fifth of August in the year of two thousand sixteen in two
originals, each in Indonesian , Ukrainian, and English languages, all the texts being equally authentic. In case of any divergences of interpretation of the provisions of the present Memorandum of Understanding, the English text shall prevail.
