Sector is leverancier van grondstoffen en energie De grondstoffenschaarste brengt een groeiende vraag naar alternatieven met zich mee. Alternatieven die onze sector levert! Veel afvalbedrijven zijn al jaren actief in het omzetten van afval in grondstoffen en materialen. Zij vervangen onze natuurlijke hulpbronnen door secundaire grondstoffen. Met de productie van energie uit afval leveren ze bovendien een bijdrage aan het terugdringen van het broeikaseffect en het behalen van doelen voor duurzame energieproductie. Onze sector maakt onderdeel uit van de productieketen en de bedrijven werken steeds nauwer samen met producenten voor een duurzamer materialengebruik en het voorkomen van afval. Met de kennis en kunde die onze leden in huis hebben en de Nederlandse infrastructuur - denk aan onze havens - kan ons land grondstoffencentrum van Europa worden. Samen met de overheid denken we na over de realisatie hiervan. Wij vinden het belangrijk dat afvalbeheer wordt gezien als een normale industriële activiteit, ook als het gaat om het verwerken van buitenlands afval. We werken immers op een internationale markt. Het streven naar een materialenbeleid vinden wij niet meer dan vanzelfsprekend. Leidend blijft de prioriteitstelling binnen het afvalbeheer. Alle inzet is gericht op een hoogwaardiger beheer, mits het milieu hierbij is gebaat en het resultaat in verhouding staat tot de (maatschappelijke) kosten. Overigens blijft
het voor altijd een samenspel van alle verwerkingsmethoden, de ketens zullen namelijk nooit helemaal gesloten kunnen worden. Het verder sluiten van materiaalkringlopen wordt steeds belangrijker. Door een toename van het hergebruik zal de hoeveelheid te verbranden en storten afval verder afnemen. Bovendien verwachten wij dat er ondanks het voorzichtige herstel van de economie structureel een teveel aan verwerkingscapaciteit blijft bestaan. Bedrijven moeten hier adequaat op inspelen en zo nodig hun capaciteit aanpassen. Sturing vanuit Europees perspectief speelt hierbij een belangrijke rol. Wij kunnen ons goed vinden in het bestaande instrumentarium en dringen aan op een voortvarende invoering. Daarbij denken we vooral aan het duurzaam inkopen door de overheid en het scheiden aan de bron van bouw- en sloopafval. Bij duurzaam inkopen willen wij meer aandacht voor materiaalhergebruik. Secundaire grondstoffen en duurzame energie moeten voorrang krijgen. Met het aantreden van de milieustaatssecretaris Joop Atsma en de nieuwe regering hebben we er alle vertrouwen in de goede samenwerking met de overheid voort te zetten. We hopen samen met het rijk verder te bouwen aan de totstandkoming van een samenleving waarin op een duurzame wijze wordt omgegaan met materialen en klimaat. Waste sector is a supplier of raw materials and energy The scarcity of raw materials is fuelling a growing demand for alternatives – alternatives that our sector supplies! For several years already, many waste companies have been turning wastes into secondary raw materials for use as substitutes for natural resources. Moreover, by producing energy from waste, they contribute to mitigating the greenhouse effect and meeting sustainable energy targets. Our sector is part of the production chain. The Dutch waste companies are working ever more closely with manufacturers to make materials use more sustainable and prevent waste arising in the first place. With the knowledge and expertise of our members and the national infrastructure already in place – such as our ports – the Netherlands can become the raw materials centre for Europe. We are working with the government to developing ideas on how to realise this. It is important to us that waste management is seen as a normal industrial activity, and that includes the processing of foreign waste. We do, after all, work in an international market. For us, moving towards a materials policy is the obvious next step. This process should be guided by the need for a clear set of priorities for managing wastes. All our efforts are focused on high-quality waste management, as long as this benefits the environment and the results justify the social and financial costs. At the same time, we will always need a combination of treatment methods, because product loops can never be completely closed.
Progress with closing materials loops is becoming increasingly important. As more and more waste is reused and recycled, less waste will be incinerated and landfilled. However, despite the gradual economic recovery, we still expect to have an overcapacity in the Dutch waste processing market. Waste companies must anticipate and respond adequately to this trend, and where necessary adapt their capacities. In this respect, it is important that we take a European perspective when steering the management of waste streams. We are comfortable with the existing policy instruments and are pressing for their vigorous implementation, particularly the sustainable procurement rules for the public sector and the source separation of construction and demolition waste. On sustainable procurement, we want to see a greater emphasis on materials recycling. Secondary raw materials and sustainable energy should be given priority. Following the formation of the new Government and the appointment of the state secretary for the environment, Joop Atsma, we have every confidence in continuing our valuable cooperation with the government authorities. q Belastingtarief voor niet-herbruikbaar en niet-brandbaar afval moet € 0,- zijn Het in het tweede Landelijk afvalbeheerplan (LAP-2) geformuleerde sturingsinstrumentarium is naar de mening van de Vereniging Afvalbedrijven toereikend. Zij dringt wel aan op een voortvarende implementatie ervan, met name als het gaat om het intensiveren van duurzaam inkopen door de overheid en de lang geleden toegezegde regeling voor scheiden aan de bron van bouw- en sloopafval. De Vereniging Afvalbedrijven vraagt bij duurzaam inkopen meer aandacht voor materiaalhergebruik en het verlenen van voorrang voor de toepassing van secundaire grondstoffen en het gebruik van duurzame energie. Dit moet plaatsvinden binnen de reguliere marktverhoudingen en de Vereniging Afvalbedrijven is van mening dat bij de prijsbepaling van primaire grondstoffen de milieukosten moeten worden meegenomen. Verder is gericht beleid voor specifieke stromen uit huishoudelijk afval zoals verpakkingen en gft-afval om het materiaalhergebruik te stimuleren van belang, evenals het bevorderen van het scheiden van grof huishoudelijk afval via de milieustraten en (Europese) minimumstandaarden voor de verwerking van de diverse afvalstromen. Afvalsturing moet altijd worden bezien vanuit een Europees perspectief.
Het nieuwe kabinet dat in oktober 2010 aantreedt, heroverweegt momenteel de belastingen. In 2010 vraagt de Vereniging Afvalbedrijven om toepassing van de monostroomregeling voor het storten van rookgasreinigsresiduen. Afvalstoffen die niet-herbruikbaar en niet-brandbaar zijn kan de overheid aanwijzen BERT KROM (AFVALZORG HOLDING)

Na uitvoerige overwegingen heeft staatssecretaris Weekers het verzoek afgewezen en
aangegeven dit bij de bredere belastingherziening te betrekken.
Kwaliteit rioleringsbeheer Er is een onderzoek gestart naar de vervuilingsgraad van riolen, dat met medewerking van de Vereniging Afvalbedrijven en financieel gedragen door RIONED en de Vereniging Afvalbedrijven plaatsvindt. Aan de hand hiervan zullen gemeenten en rioleringsbedrijven beter in staat zijn om de mate van vervuiling in de riolen tot uiting te laten komen in de tarieven van de dienstverleners. In het eerste kwartaal van 2011 wordt de laatste hand aan het onderzoek gelegd. Andere ontwikkelingen zijn de nationale discussie over het toepassen van de Nederlandse NEN-normen in relatie tot de Europese EN-normen, het herzien van de Beoordelingsrichtlijn en het toewerken naar een andere wijze van aanbesteden in de markt. Deze ontwikkelingen hangen nauw samen en moeten een bijdrage leveren aan een transparantere vorm van aanbesteden en een verhoging van het kwaliteitsniveau in de sector. Hiervoor zijn de diverse strategische discussies bij de stakeholders van de
leden ook van belang. Gemeenten en waterschappen worden geconfronteerd met forse bezuinigen. Deze ontwikkeling kan ook zijn beslag hebben op riolerings- en stedelijk waterbeheer. De Vereniging Afvalbedrijven houdt de ontwikkelingen in de gaten.
Toekomst storten In 2010 onderzoekt het ministerie van Infrastructuur en Milieu (IenM) de toekomst van de stortsector. Hieruit blijkt dat de stortsector als geheel structureel verlies leidt en dat dit de komende jaren waarschijnlijk niet verbetert. Het stortaanbod is de afgelopen decennia sterk teruggelopen en de storttarieven zijn gezakt tot onder het kostendekkende niveau. Zeker tot 2018 is de ingerichte capaciteit voldoende voor de achtervangfunctie. Toch adviseren de LEO VAN DER VALK (VANDERVALK+DEGROOT)

de prijs zich herstelt doordat het aantal stortplaatsen afneemt. Het kan ook zijn dat de ene prijsvechter de andere opvolgt. Hoewel Nederland met de vergunde capaciteit ook na 2018 nog vooruit kan, kan de investeringsbereidheid te klein zijn om nieuwe capaciteit in te richten. De onderzoekers hebben de indruk dat de provincies zich onvoldoende bewust zijn van de financiële risico’s die zij lopen. De meeste stortplaatsen zijn in eigendom van overheden. Voor de eindafwerking en nazorg is nog geld nodig. Het benodigde bedrag per te storten ton afval is hoger als niet alle stortcapaciteit benut wordt. De sector meent dat de overheid (mede)verantwoordelijk is voor de stortcapaciteit. Om de situatie te verbeteren heeft de Vereniging Afvalbedrijven ten eerste geopperd de afvalstoffenbelasting voor het storten van niet-herbruikbaar en niet-brandbaar afval te verlagen naar € 0,- om afval dat alleen kan worden gestort op stortplaatsen in Nederland te verwerken. Verder zijn met duurzaam stortbeheer de kosten voor de eindafwerking en de nazorg te beperken zonder het milieu te schaden. De overheid bekijkt in het eerste kwartaal van 2011 of maatregelen nodig zijn om de toekomst van de stortsector te verbeteren.

Over statuten en huishoudelijk reglement wordt in 2010 overeenstemming bereikt. De verwachting is dat de Stichting in het tweede kwartaal van 2011 de Arbocatalogus Afvalbranche in beheer neemt. Belangrijk aandachtspunt is het uitrollen van de Arbocatalogus Afvalbranche in de sector. Om hun achterban te informeren en zicht te krijgen op wat de bedrijven nodig hebben om de catalogus daadwerkelijk ter hand te nemen, organiseren de samenwerkende partijen in juni 2010 een bijeenkomst. Tijdens de bijeenkomst, die een grote belangstelling kent, wordt een goede basis gelegd voor het opstellen van een implementatie/communica-
Heroverweging belastingen In de zomer van 2010 peilen de ministeries van Milieu en Financiën het voorstel om te komen tot één tarief voor de afvalstoffenbelasting. De Vereniging Afvalbedrijven beoordeelt voorstellen voor aanpassing van de belastingtarieven op de effectiviteit van de afvalsturing. Van het huidige reguliere tarief gaat volgens de Vereniging Afvalbedrijven een sturende werking uit. Zij vindt daarom dat het reguliere tarief voor herbruikbaar en brandbaar afval moet blijven bestaan. Het tarief voor niet-herbruikbaar en niet-brandbaar afval zou € 0,- moeten zijn, omdat voor dit afval storten de enige goede verwerkingsmethode is. Verlaging van het lage tarief naar € 0,- zal ook een positief effect hebben op de sanering van oude stortplaatsen. Voor afvalverbranding houdt de Vereniging Afvalbedrijven vast aan het nihiltarief. Uniformering van het tarief wordt uiteindelijk niet doorgevoerd in het Belastingplan 2011.
Veiligheid: naleving afspraken verhogen Arbocatalogus Afvalbranche sluit goed aan op de praktijk q Aandacht voor implementatie Arbocatalogus Afvalbranche in sector q Werken aan verbeteren naleving arboregels q Arbeidsomstandigheden en veiligheid zijn belangrijke aandachtspunten binnen de sector. Om een verdere verbetering van de veiligheid te bereiken, werkt de Vereniging Afvalbedrijven samen met de hele branche aan het opstellen van een Arbocatalogus Afvalbranche en de uitvoering van een plan voor een verbeterde naleving van arboregels. Belangrijke gedachte daarbij is dat de voorlopers de achterblijvers begeleiden bij dit proces.
Arbocatalogus Afvalbranche Werknemersorganisaties (ABVAKABO/ FNV, CNV Publiek, Het Zwarte Corps
en LPMA), werkgeversorganisaties (WENb) en de branche (BRBS Recycling, BVOR, NVRD en Vereniging Afvalbedrijven) werken in 2010 gestaag verder aan de realisatie van de Arbocatalogus Afvalbranche. De verwerking van het commentaar van de Arbeidsinspectie (AI) en de achterban kost meer tijd dan verwacht. Een herziene versie van de catalogus wordt in het najaar ter toetsing aan de AI voorgelegd. Onderdelen die eind 2009 zijn goedgekeurd, worden hierbij buiten beschouwing gelaten. Eind 2010 wordt duidelijk dat de AI een tamelijk deel van de catalogus op
korte termijn kan goedkeuren. Een ander deel moet nog worden verbeterd. Een deel hiervan kan betrekkelijk snel worden aangepast, zodat de AI het nog kan meenemen in haar goedkeuringsbrief. Andere delen vergen meer aanpassing. De samenwerkende partijen willen herhaaldelijk toetsen voorkomen. Zij spreken af dat nieuwe onderdelen in het vervolg per risico aan de AI worden voorgelegd. De inhoud van de catalogus is gebaseerd op praktijkervaringen wat heeft geleid tot een behoorlijk complete en goed op de praktijk aansluitende arbocatalogus. Deze ‘bottom up-

de AI heeft hierop betrekking. Tegelijkertijd bestaat behoefte aan optimalisatie van de digitale document. Hierbij gaat het vooral om een betere structuur en zoekfunctie. Ook
Vereniging Afvalbedrijven drijven ‘niet ontvankelijk’ wat betekent dat de afgegeven beschikking binnen de Wet bodembescherming geldig is en Tilburg aan de slag kan. Over de inhoud van de beschikking doet de RvS echter geen uitspraak, waardoor de centrale vragen voor de sector onbeantwoord blijven. Het is nog steeds onduidelijk of het materiaal dat bij de sanering wordt opgegraven afval, grond of bodem is en of het op de bodem brengen hiervan is te beschouwen als storten. De Vereniging Afvalbedrijven blijft bij haar standpunt dat het om afval gaat en binnen de afvalbeheerstructuur verwerkt moet worden, waarvan bij Tilburg geen sprake is. Verder gaat het volgens de Vereniging Afvalbedrijven om een inrichting waarvoor een vergunning nodig is. Dit is in een eerder, voorlopig oordeel van de RvS bevestigd. De Vereniging Afvalbedrijven wil voorkomen dat afval op of in de bodem wordt gebracht zonder inachtneming van de vereiste milieubeschermende voorzieningen. Het omzeilen van de regels en het op een ‘creatieve’ manier verwerken van het ontgraven materiaal is vaak goedkoper dan het afval naar een stortplaats brengen. Aandachtspunt daarbij is dat dit bij oude stortplaatsen en stortplaatsen in exploitatie op vergelijkbare wijze beoordeeld moet worden. Om een antwoord op de juridische vragen over de interpretatie van milieuwetgeving bij het afgraven en herstorten van afval uit oude stortplaatsen te krijgen, klopt de Vereniging Afvalbedrijven nu aan bij het ministerie van IenM. De Vereniging Afvalbedrijven vindt eenduidige interpretatie van regels van groot belang.
tieplan dat in de eerste helft van 2011 wordt uitgewerkt. De sector is van mening dat de arbocatalogus niet alleen van toepassing moet zijn op werknemers die onder de CAO Afval & Milieu vallen, maar op alle betrokken partijen uit de branche.
Plan van aanpak naleving Om de naleving van de arboregels te verbeteren stelt de Vereniging Afvalbedrijven in 2009 een Plan van Aanpak op. Een verbeterde naleving moet leiden tot verbeterde arbeidsomstandigheden en veiligheid in de afvalsector. Doel van het plan is dat in 2012 het aantal ongevallen is gehalveerd in vergelijking met 2008 en dat elk bedrijf beschikt over een gecertificeerd arbozorgsysteem. Verder is het streven dat alle bedrijven gaan werken met de Arbocatalogus Afvalbranche. Om realisatie van het plan een grotere kans te geven stelt het Platform KAM (kwaliteit, arbo en milieu) van de Vereniging Afvalbedrijven voor om gezamenlijk subsidie aan te vragen. Het

Nationaal beleid beoordeelt de Vereniging Afvalbedrijven altijd op de effecten die het heeft op de totstandkoming van een gelijkwaardig speelveld op Europees niveau. Toch onderkent de Vereniging Afvalbedrijven nationale omstandigheden waarin het nodig kan zijn om op Nederlandse schaal strengere eisen te stellen. Daar moet dan een weloverwogen motivering aan ten grondslag liggen die is gebaseerd op een maatschappelijke kosten- en batenanalyse. De Vereniging Afvalbedrijven verwacht dat de overheid oog heeft voor de internationale concurrentieverhoudingen en deze meeweegt in haar besluitvorming. Ook specifieke, lokale omstandigheden kunnen - mits adequaat onderbouwd - op bedrijfsniveau aanvullende eisen rechtvaardigen.
Aanpassing afvalbeleid Het eind 2009 in werking getreden Landelijk afvalbeheerplan 2 (LAP-2) krijgt begin 2010 een eerste wijziging. Het gaat om vervroegde invoering van een formule uit de Europese Kaderrichtlijn Afvalstoffen (KRA) waarmee de energie-efficiënte van afvalenergiecentrales (AEC’s) wordt bepaald. Met de formule wordt vastgesteld of een AEC een installatie voor nuttige toepassing of verwijdering van afval is. Installaties voor nuttige toepassing maken vrij verkeer van brandbaar restafval in Europa mogelijk. De Vereniging Afvalbedrijven heeft zich sterk gemaakt voor deze wijziging van het nationale beleid. De meerderheid van de Nederlandse centrales krijgt in 2010 de status van nuttige toepassing, kortweg R1-status. Daarvoor spreekt de Vereniging Afvalbedrijven met de overheid af dat de capaciteit van de afvalenergiecentrales tot 2020 niet verder wordt uitgebreid. De verwachting is dat op basis van Europese bepalingen nagenoeg alle Nederlandse AEC’s in 2011 de R1-status zullen hebben. Dit neemt niet weg dat de AEC’s blijven werken aan het verder verbeteren van de energie-efficiency. Door de wijziging is het nodig de doelstelling voor nuttige toepassing aan te passen. Nuttige toepassing staat immers niet op gelijke hoogte als materiaalhergebruik. De minimumstandaarden uit het LAP-2 bepalen
ministerie van Sociale Zaken en Werkgelegenheid heeft subsidie beschikbaar voor stimulering van de arbeidsveiligheidscultuur in ondernemingen in het midden- en kleinbedrijf. Door gezamenlijk subsidie aan te vragen, komt het benodigde budget beschikbaar. Het streven is dat tenminste twintig bedrijven subsidie aanvragen. Door kennis en ervaring te delen verwacht de Vereniging Afvalbedrijven effectiever te kunnen zijn in de uitvoering van het Plan van Aanpak ‘Goede regelnaleving binnen de afvalbranche’. Per deelnemend bedrijf worden veiligheidscultuur en -gedrag in kaart gebracht. Dit geeft goed zicht op de mogelijkheden tot verbetering. Mede op basis van de eigen ambitie wordt een plan opgesteld om te komen tot de gewenste situatie. Tegelijkertijd wordt gezamenlijk een aantal hulpmiddelen ontwikkeld. Deze worden ingezet voor het in positieve zin beïnvloeden van de veiligheidscultuur en het veiligheidsgedrag bij leden van Vereniging Afvalbedrijven.
de verwerking van de verschillende afvalstromen. De doelstelling voor 60 procent nuttige toepassing van huishoudelijk afval moet worden gewijzigd in een vergelijkbare doelstelling voor materiaalhergebruik om de beleidsdoelstellingen te realiseren. De implementatie van de KRA in de Wet milieubeheer (Wm) die op 12 december 2010 gerealiseerd moet zijn, loopt mede als gevolg van de verkiezingen en de nieuw gevormde regering en Tweede Kamer vertraging op. De gewijzigde Wm treedt op 5 maart 2011 in werking. Tot tevredenheid van de Vereniging Afvalbedrijven leidt de wijziging niet tot het afschaffen van de gemeentelijke verplichting om gft-afval gescheiden in te zamelen. Ook wordt afgezien van het opnemen van een wettelijke zorgplicht voor de verwerking van huishoudelijk afval. Volgens de Vereniging Afvalbedrijven is die ook niet nodig. Positief is verder dat bron- en nascheiding van kunststofverpakkingsafval naast elkaar kunnen bestaan mits de kwaliteit hieronder niet lijdt.
Handhaving Systeemtoezicht levert een positieve bijdrage aan het wederzijds vertrouwen tussen overheid en bedrijfsleven. De VROM-Inspectie en provincies integreren deze wijze van toezicht geleidelijk in hun werk. Bij systeemtoezicht worden bedrijven vooral gehandhaafd op de wijze waarop het bedrijf de naleving van wet en vergunning waarborgt en minder op de naleving van concrete voorschriften. Wanneer een bedrijf naleving van regels goed borgt, nemen de toezichtlasten af. In de praktijk is het voor beide partijen wennen aan de nieuwe rol. Een knelpunt is de onvoorspelbare rol van het Openbaar Ministerie (OM). Het OM is onafhankelijk en hoeft zich formeel niets aan te trekken van afspraken tussen bevoegd gezag en bedrijf. De Inspectie voert hierover overleg met het OM dat mee wil denken over verdere afstemming. Dit overleg blijkt constructief. De Vereniging Afvalbedrijven blijft betrokken bij de ontwikkelingen en in overleg met de VROM-Inspectie. Provincies en gemeenten moeten op termijn hun milieutaken onderbrengen bij de op te richten Regionale Uitvoeringsdiensten (RUD’s). Daarbij gaat het zowel om vergunningverlening als om handhaving. De oprichting van de RUD’s is echter niet wettelijk vastgelegd. Dit vrijblijvende karakter leidt tot een tijdrovend en intensief proces. Het streven om een landelijke dekkende structuur te hebben op 1 januari 2012 wordt waarschijnlijk niet gehaald. De Vereniging Afvalbedrijven betreurt dit omdat zij groot voorstander is van het bundelen van kennis en ervaring van vergunningverlening en handhaving. De afvalsector en ook de provincies maken zich zorgen over de voortgang van de overdracht van de taken naar de RUD’s en de deskundigheid van de toekomstige toezichthouders.
Besluit melden De Vereniging Afvalbedrijven is nauw betrokken bij de totstandkoming van het nieuwe Besluit melden van bedrijfsafvalstoffen en gevaarlijke afvalstoffen dat op 1 januari 2011 in werking treedt. Om alle betrokkenen in de keten voldoende gelegenheid te geven om de wijzigingen over te nemen en nieuwe formuleren in gebruik te nemen, wordt op verzoek van afvalbrancheorganisaties, waaronder de Vereniging Afvalbedrijven, een ruime overgangstermijn tot 1 mei 2011 opgenomen in het Besluit.
Daartegenover staat dat de overheid enkele suggesties van de provincies overneemt, waaronder een verdere beperking van de ‘inzamelaarsregeling’, die niet in het belang van de sector zijn. Over het algemeen is de Vereniging Afvalbedrijven echter tevreden over het eindresultaat.
Besluit verbranden Het ministerie van Infrastructuur en Milieu (IenM) overweegt om bij de implementatie van de Europese richtlijn voor industriële emissies in het Besluit verbanden afvalstoffen op een aantal punten strengere eisen op te nemen. Aanleiding voor dit voorstel is het in de afgelopen jaren succesvol aanvechten van vergunningen door milieuorganisaties wat veelal heeft geresulteerd in aangescherpte eisen. Ook is een aantal bedrijven uit eigen beweging scherpere eisen overeengekomen met het bevoegd gezag. De Vereniging Afvalbedrijven voert met IenM overleg over de voorstellen en toetst elk voorstel op de bijdrage aan de bescherming van het milieu en aan het gelijkwaardige speelveld. Het overleg komt eind 2010 stil te liggen als blijkt dat IenM overweegt om het Bva op te hangen aan het Activiteitenbesluit. Daardoor worden de eisen uit het Bva ‘algemene regels’ en daarmee rechtstreeks werkend. De sector beraadt zich over de consequenties van dit voornemen en mogelijke tegenstrijdigheid met andere Europese regelgeving. WILLEM GEERLING (ATTERO)
“Sinds 2010 hebben de meeste Nederlandse afvalenergiecentrales de status van nuttige toepassing, R1-status. Daar hebben we ons sterk voor gemaakt omdat het recht doet aan het hoge niveau van energie-efficiency van de Nederlandse installaties en bijdraagt aan een gelijkwaardig Europees speelveld.”
Elektriciteitswet Vanwege een dreigend tekort aan transportcapaciteit op het elektriciteitsnet, bestaat de kans dat energie die op duurzame wijze is opgewekt niet op het net kan worden opgenomen. Eind 2010 neemt de Eerste Kamer een wetsvoorstel aan dat voorrang voor duurzame elektriciteit regelt. Via een algemene maatregel van bestuur (AMvB) worden nadere regels voor congestiemanagement vastgelegd, waaronder de mate van voorrang. De Vereniging Afvalbedrijven vraagt onder meer aandacht voor de regelbaarheid van een installatie en de positie van afvalverwerkingsinstallaties hierin. Indien congestie optreedt voordat de wet in werking treedt, is het huidige regime van kracht. Hieronder valt het in 2010 vastgestelde systeem voor een betere benutting van de transportcapaciteit. Hierin is een uitzondering opgenomen voor niet-regelbare energiebronnen zoals afvalenergiecentrales. Naar verwachting wordt de AMvB aan het einde van het eerste kwartaal 2011 aan beide Kamers voorgelegd.
Warmtewet In 2010 werkt de overheid aan de uitwerking in lagere regelgeving van de in 2009 aangenomen Warmtewet. Op basis van onderzoek naar het effect van het voorgestelde tariefstelsel ter bescherming van de consument op de rentabiliteit van bestaande warmtenetten, is geconcludeerd dat de

huidige Warmtewet niet voldoet aan de doelstellingen en eisen die daaraan gesteld moeten worden om de warmtenetten in stand te kunnen houden. Er zijn wetswijzigingen in voorbereiding met als doel de Warmtewet werkbaar en uitvoerbaar te houden en het tariefstelsel te vereenvoudigen. De Vereniging Afvalbedrijven steunt een vereenvoudiging. Deze wetsvoorstellen worden naar verwachting aan het einde van het eerste kwartaal van 2011 naar de Tweede Kamer gestuurd. PETER LOUWMAN (INDAVER/DELTA MILIEU)
“Met onderzoek kunnen we aantonen dat duurzaam stortbeheer de milieurisico’s van storten verder kan terugdringen. Als de overheid aangeeft bereid te zijn het beleid op basis van de resultaten aan te passen, zal de stortsector zeker in het onderzoek investeren.”
Modernisering stortregels De overheid bereidt een modernisering van de stortregels voor op basis van de huidige technieken. Ook verduurzaming van het stortbeheer wordt bij de modernisering betrokken. De sector wil met grootschalig onderzoek aantonen dat duurzaam stortbeheer de milieurisico’s van storten verder kan terugdringen. Het doel van duurzaam stortbeheer is de emissies zodanig terug te brengen dat stortplaatsen binnen één generatie geen risico meer vormen voor mens en milieu. Een intentieverklaring voor uitvoering van het onderzoek, ondertekend door alle Nederlandse stortplaatsexploitanten, is op 10 februari 2011 overhandigd aan het Interprovinciaal Overleg (IPO) en het ministerie van IenM. De Stichting Duurzaam Storten, de Vereniging Afvalbedrijven en alle stortbedrijven vragen de provincies hun steun aan het initiatief te geven door een actieve bijdrage te leveren aan uitvoering van het onderzoek. De milieugedeputeerden ontvangen het initiatief positief. Zij zijn bereid het initiatief met de branche en het ministerie uit te werken. Zekerheid over de consequenties die verbonden worden aan de resultaten van het onderzoek is voor de sector van cruciaal belang. Als de overheden vooraf duidelijk maken dat geslaagd onderzoek leidt tot beleidsaanpassingen, investeren de stortplaatsexploitanten in het onderzoek. Wanneer het met duurzaam stortbeheer lukt om de emissies voldoende terug te dringen, moet dat leiden tot aanpassing van de eisen aan eindafwerking, vervanging van de afdichting en de duur en invulling van de nazorg. Om vooraf helder te hebben tot welk niveau de emissies beperkt moeten worden, is het nodig om emissiegrenswaarden in de regelgeving te introduceren. De sector is met de provincies en het ministerie van IenM in overleg om dit te realiseren bij de modernisering van de Stortbesluit bodembescherming.
Bssa Het ministerie van IenM bereidt aanpassingen van het Besluit stortplaatsen en stortverboden afvalstoffen (Bssa) voor. Van een algehele herziening is afgezien. De wijziging spitst zich toe op afvalstoffen waarvoor een stortverbod gaat gelden en een herziening van de wijze waarop ontheffingen worden verstrekt. De Vereniging Afvalbedrijven vraagt aandacht voor de voorstellen over afwijken van stortverboden. Zij is van mening dat dit op landelijk niveau moet worden bepaald en niet door het bevoegd gezag. In het eerste kwartaal van 2011 wordt het commentaar uit het veld op een eerste concept voor de wijziging verwerkt. Het aangepaste concept kan nog niet opnieuw aan het veld worden voorgelegd, omdat mogelijk een wetswijziging nodig is voor de nieuwe ontheffingssystematiek. IenM onderzoekt dit nog.

Europees beleid: duurzaam materialengebruik en energie-efficiëntie Grondstoffenschaarste zet Europa op spoor van duurzamer materialengebruik q

Dit past niet alleen bij het toewerken naar een recyclingmaatschappij, een duurzamer gebruik van grondstoffen draagt ook bij aan het verminderen van de kwetsbaarheid van de economie en zorgt voor groei van de werkgelegenheid. Overheid en parlement zien een rol voor de afvalsector als belangrijke leverancier van grondstoffen en energie. De Europese overheid werkt aan een gids voor een resource efficient Europe. Dit betekent zo weinig mogelijk grondstoffen gebruiken en de milieu-impact van het gebruik zo gering mogelijk laten zijn. Een intensievere samenwerking tussen industrie en afvalsector en slimmer produceren en consumeren zijn hierbij belangrijke factoren. Het onderwerp resource efficiency is ook het thema van het FEAD-jaarcongres waarvan de Vereniging Afvalbedrijven in 2010 gastheer is. Om het voor belanghebbenden eenvoudiger te maken de discussies over het Europese afvalbeleid in Europa te volgen en ter ondersteuning van haar belangenbehartiging in de Europese arena, lanceert de Vereniging Afvalbedrijven in 2010 website www.wastematters.eu. De website wordt door landen verspreid over de hele wereld bezocht en met belangstellig bekeken.
veel te verbeteren. Zo zijn er lidstaten die nog sterk afhankelijk zijn van het storten van afval. Naar de mening van de Vereniging Afvalbedrijven moet de Europese overheid nadrukkelijk sturen om het storten van herbruikbaar afval terug te dringen. De Vereniging Afvalbedrijven ondersteunt het voorstel van Europarlementariërs om Europese minimumstandaarden in te voeren en zo het storten van herbruikbaar en brandbaar afval te voorkomen. Ook is er steun voor het aanpassen van de Richtlijn ecodesign waarmee ontwerpers een grotere rol krijgen bij het ontwerpen van duurzamere producten. Verder wil de Vereniging Afvalbedrijven dat de Europese Unie meer werk maakt van implementatie van bestaande regels in alle lidstaten. MICHAËL VAN HULST (SHANKS NEDERLAND)

Thematische strategieën De Europese overheid werkt aan een herziening van de thematische strategieën voor duurzaam gebruik van natuurlijke hulpbronnen en voor afvalpreventie en afvalrecycling. De strategieën uit 2005 zijn hiervoor in 2010 geëvalueerd. Hieruit blijkt dat het recyclingpercentage met name in het noordwesten van Europa is toegenomen en de hoeveelheid gestort afval is afgenomen. Er valt echter nog
Ook de meetmethoden behoeven harmonisatie. In de Kaderrichtlijn Afvalstoffen worden recyclingdoelstellingen genoemd voor huishoudelijk en vergelijkbaar afval en voor bouwen sloopafval. Lidstaten kunnen dit nu op vier manieren berekenen. Dit bemoeilijkt de vergelijking van prestaties van de lidstaten. De Europese Commissie geeft echter aan op korte termijn geen actie te ondernemen op
dit punt. De Vereniging Afvalbedrijven betreurt het dat de gewenste harmonisatie uitblijft en een betrouwbare vergelijking van de milieuprestaties tussen lidstaten lastig blijft.
‘Einde afval’ en REACH Het toekennen van het ‘einde afval’predicaat voor afvalstromen als deze opnieuw als grondstof zijn in te zetten, is een stimulans voor de ontwikkeling van een recyclingmaatschappij. Eind 2010 komt deze status in beeld voor metaal- en aluminiumschroot. De sector schat in dat, gezien de gestelde criteria, van het metaalschroot slechts een klein deel, ongeveer tien procent, in aanmerking komt voor de ‘einde afval’-status. Voor koper, glas en papier gaat de procedure van start om tot ‘einde afval’-criteria te komen. Verder worden studies gestart naar de mogelijkheden om criteria voor compost, aggregaten van bouw- en sloopafval en energiepellets (RDF) te formuleren. Bij ‘einde afval’-stromen gaat het om materialen van hoge kwaliteit die zonder risico’s voor het milieu op de markt kunnen worden gebracht. Omdat de afvalmarkt een Europese markt is, vindt de Vereniging Afvalbedrijven dat de ‘einde afval’-status op Europees niveau moet worden vastgesteld en dat strikt gehandhaafd moet worden op een goede toepassing van de ‘einde afval’-criteria in de lidstaten. Op dit moment is nog sprake van een nationale invulling van ‘einde afval’. In elk geval moeten kwaliteitscriteria maatgevend zijn bij het verkrijgen van de status. Ook de emissieregimes voor stromen die worden ingezet voor energetische toepassingen moeten worden geharmoniseerd en toepasbaar blijven voor ‘einde afval’-stromen. Als stoffen eenmaal de ‘einde afval’status hebben bereikt, kunnen ze onder de werking van REACH komen. Dit kan
de nodige administratieve lasten met zich meebrengen wat met de ‘einde afval’-status juist zou moeten afnemen. Om buiten de werking van REACH te blijven, moeten recyclebedrijven de overeenkomst met primaire grondstoffen aantonen. Dit kan met eigen analyses worden gedaan. Recyclebedrijven worden echter geconfronteerd met de vraag een bijdrage te leveren aan de kosten die door registranten van stoffen zijn gemaakt om te voldoen aan de REACH-wetgeving. De afvalsector houdt dit scherp in de gaten en is van mening dat recyclebedrijven deze kosten niet voor hun rekening hoeven te nemen. Afvalstoffen waarvoor de ‘einde afval’-status nog niet geldt, hebben formeel niet met REACH te maken. Toch verlangt de markt in sommige situaties van een bedrijf om te voldoen aan REACH omdat de producenten een voorkeur hebben voor primaire grondstoffen. Dit is in strijd met een gelijkwaardige marktwerking en werkt de totstandkoming van een recyclingmaatschappij tegen.

Bioafval Ondanks de nadrukkelijke wens van het Europese Parlement en de sector, blijft de Europese Commissie bij haar standpunt dat aanvullende wetgeving voor de verwerking van bioafval niet nodig is. De Commissie voert als argument aan dat de Europese stortrichtlijn adequaat is ingevoerd en dat daarom geen aanvullende maatregelen nodig zijn. De stortrichtlijn is na tien jaar tijd echter door vele landen nog
steeds niet goed geïmplementeerd. In veel lidstaten belandt een groot deel van het bioafval nog op stortplaatsen. Het Nederlandse voorbeeld laat zien dat een gescheiden inzamelplicht voor dit afval leidt tot nuttige producten, waaronder compost en biogas. De Commissie laat zich echter niet overtuigen, maar overweegt wel om in de Kaderrichtlijn Afvalstoffen een recyclingdoelstelling van 36,5 procent voor bioafval op te nemen. Dit zou zijn beslag kunnen krijgen in 2014, na definiëring van ‘einde afval’-criteria voor compost. Ook overweegt de Commissie de Richtlijn voor zuiveringsslib te herzien en hierin normen voor specifieke compostklassen op te nemen. Deze normen moeten een prikkel zijn om te komen tot een hogere kwaliteit compost uit zuiveringsslib. De normstelling voor de compostklassen zoals voorgesteld door de Europese Commissie is te halen door compostering van ongescheiden huishoudelijk afval. De Vereniging Afvalbedrijven is tegen laagwaardige Europese compoststandaards, omdat die tot marktbederf en imagoschade voor en achterstelling van kwaliteitscompost uit gft-afval kunnen leiden.
Handleiding R1 De Europese Commissie stelt een handleiding op met een berekening voor de energie-efficiëntie van de verbranding van stedelijk restafval. Op basis van die berekening kan het onderscheid worden gemaakt tussen nuttige toepassing (R1) en verwijdering (D10). Het is geen bindend document, maar de Nederlandse overheid volgt de handleiding voor de berekening. In 2010 staat de reikwijdte van de handleiding ter discussie. De vraag wordt opgeworpen of het verbranden van gevaarlijk afval in afvalenergiecentrales (AEC’s) ook onder de R1-status moet vallen. De Vereniging Afvalbedrijven is van mening dat als het technisch en milieuverantwoord mogelijk is om bepaalde gevaarlijke afvalstoffen in een AEC te verbranden dit mee moet tellen bij de bepaling van de R1-status. Steeds vaker werken afvalbedrijven en producenten samen aan ecodesign en productvernieuwing. Dit leidt tot het voorkomen van het ontstaan van afval en het hoogwaardig hergebruik van afval. De Vereniging Afvalbedrijven beziet het toekomstig beheer van afvalstoffen vooral vanuit het perspectief van de schaarste aan primaire grondstoffen. Dit brengt een toenemende vraag naar alternatieven met zich mee, een belangrijke reden tot het geven van een hoge prioriteit aan het sluiten van materiaalkringlopen. Het accent van werken komt niet alleen voor de bedrijven meer en meer aan de voorkant van de keten te liggen - bij preventie en het geschikt maken van afval voor hergebruik - , ook het werkterrein van de Vereniging Afvalbedrijven verbreedt zich in die richting. De Vereniging Afvalbedrijven neemt graag de uitnodiging van de regering aan om bij het beheer en de verwerking van afval tot een nauwere samenwerking te komen tussen overheid, bedrijfsleven en kennisinstellingen.

Dit betekent ook dat in sommige gevallen afgeweken moet worden van de hiërarchie. Hieraan moet een levenscyclusanalyse (LCA) ten grondslag liggen, waarin ook de financiële en maatschappelijke
aspecten worden meegewogen. Een LCA kan leiden tot het bepleiten van een hogere of lagere trede in de afvalhiërarchie. Vanwege milieuhygiënische, maatschappelijke en financiële redenen ontstaat er overigens nooit een situatie waarbij product- en materiaalkringlopen volledig gesloten kunnen worden. De optimale afvalbeheerstructuur bestaat in de visie van de Vereniging Afvalbedrijven uit een samenspel van de activiteiten uit de afvalhiërarchie. Alle onderdelen zijn hierin cruciaal en kunnen alleen in samenhang met elkaar succesvol zijn. Door een toename van het hergebruik van afval neemt de hoeveelheid te verbranden en storten afval verder af. De bedrijven moeten hier adequaat op inspelen en zo nodig hun capaciteit aanpassen. Ook in een recyclingmaatschappij zijn de activiteiten lager in de afvalhiërarchie in voldoende mate nodig om het totaal aan maatschappelijke activiteiten adequaat te kunnen ondersteunen.
Grondstoffencentrum Naar verwachting komt staatssecretaris Atsma van Milieu in juni 2011 met een plan voor het transformeren van Nederland tot grondstoffencen-
trum van Europa. Dit idee spreekt de Vereniging Afvalbedrijven aan. Het is in het belang van het zekerstellen van de beschikbaarheid van grondstoffen en van het verminderen van de milieudruk in de levenscyclus van grondstoffen door hiermee duurzamer om te gaan.

“Toekomstig beheer van afvalstoffen bekijken we vooral vanuit het perspectief van de grondstoffenschaarste. De schaarste leidt tot een toenemende vraag naar alternatieven, een belangrijke reden tot het geven van een hoge prioriteit aan het sluiten van materiaalkringlopen.” Met het ministerie van Infrastructuur en Milieu (IenM) en het ministerie van Economie, Landbouw en Innovatie wisselt de Vereniging Afvalbedrijven gedachten uit over de mogelijkheden van het concept. Met het oog op diverse economische ontwikkelingen vindt de Vereniging Afvalbedrijven het van belang dat afvalbeheer wordt gezien als een normale industriële activiteit. Deze is binnen Nederland gewenst en noodzakelijk, ook wanneer het om de verwerking van buitenlands afval gaat. Het creëren van een ‘kenniscentrum duurzame grondstoffen’ kan in de visie van de Vereniging Afvalbedrijven
een belangrijke impuls geven aan het sluiten van meer materiaalketens en de vestiging van recyclingactiviteiten in Nederland. Nederlandse afvalbedrijven stellen grondstoffen zeker die opnieuw in de economie ingezet worden. De afhankelijkheid van het buitenland neemt daarmee af en in Nederland worden de reststromen uit recycling milieuhygiënisch verantwoord en met hoge efficiëntie benut. De Vereniging Afvalbedrijven wijst erop dat recycling door marktmechanismen wordt gestuurd. Het creëren van een aantrekkelijk vestigingsklimaat vergroot de kans op nieuwe recyclingactiviteiten in Nederland, maar het biedt geen garantie.
Plastic afval Sinds 2010 bestaat er een inzamelplicht voor kunststof verpakkingsafval. Al jaren bestaat er veel discussie over de voor- en nadelen van het gescheiden inzamelen en verwerken van dit materiaal. Om deze discussie te faciliteren voert de Vereniging Afvalbedrijven een LCA uit naar de milieueffecten van de verwerkingsmogelijkheden voor dit afval. De milieudruk van de verschillende inzamel- en verwerkingsmethoden wordt onder de loep genomen. Hierbij wordt ook gekeken naar het effect van mogelijke combinaties, van bijvoorbeeld bron- en nascheiding en een statiegeldregeling, en naar de verwerkingsmethoden recyclen en verbranden met energieopwekking. De Vereniging Afvalbedrijven stelt het huidige beleid niet ter
Vereniging Afvalbedrijven specifieke bepalingen opgenomen in de vergunning. De Commissie geeft aan dat gevaarlijk afval meetelt in de formule voor de R1-status, maar ze verbindt hieraan geen juridische consequenties. Dit wordt overgelaten aan de lidstaten. De Vereniging Afvalbedrijven is hier geen voorstander van omdat het kan leiden tot verschillen in interpretatie. De verwachting is dat de Commissie de handleiding in de zomer van 2011 publiceert.
Emissierichtlijn Eind 2010 wordt de ontwikkeling van de Industriële Emissierichtlijn (Industrial Emissions Directive, IED) afgerond. De Vereniging Afvalbedrijven verzet zich met succes tegen onder andere het voorstel dat het bevoegde gezag de mogelijkheid geeft om zonder opgaaf van redenen strengere emissie-eisen dan de best beschikbare technieken te stellen in de vergunning. Nederland brengt dit voorstel in met als doel om onder nationale regie strenger eisen te kunnen stellen dan de Europese referentie, dit met het oog op het behalen van andere door Europa gestelde doelen. De definitieve IED geeft lidstaten de bevoegdheid regels op te stellen op basis waarvan het lokale bevoegde gezag alleen gemotiveerd strengere eisen mag stellen dan de best beschikbare technieken. Hiermee kan voorkomen worden dat één regio veel strengere eisen stelt dan een andere regio, waardoor het gelijkwaardig speelveld ondermijnd wordt. Op 6 januari 2011 treedt de IED in werking. Lidstaten hebben drie jaar de tijd om de IED de implementeren. Een belangrijk gevolg van de inwerkingtreding van de IED is dat gerelateerde documenten die best beschikbare technieken beschrijven aangepast moeten worden. De verwachting is dat eind 2011 een start wordt gemaakt met de herziening van de BREF Afvalbehandeling. De Vereniging Afvalbedrijven bereidt zich hierop voor en richt zich daarbij ook op de installaties die nu, door de herziening van de IED, deel uitmaken van het bereik van de BREF Afvalbehandeling: composteer- en vergistinginstallaties, en installaties voor de verwerking van slakken en assen, van metaalschroot en gevaarlijk afval.
discussie maar wil met de LCA een bijdrage leveren aan de beleidsevaluatie die plaatsvindt na afloop van de Raamovereenkomst bij het Besluit Verpakkingen in 2012. De Vereniging Afvalbedrijven vindt het belangrijk dat de studie breed gedragen wordt. Daarvoor benadert zij vele belanghebbende partijen. Het ministerie van IenM, AgentschapNL, NVRD en Recycling Netwerk willen betrokken zijn bij het onderzoek. Vertegenwoordigers van deze partijen zitten in de begeleidingscommissie die zich bezighoudt met de aannames, uitgangspunten en methoden van de studie. Een wetenschappelijke review naar de uitkomsten de LCA maakt onderdeel uit van de studie. De verwachting is dat de LCA direct na de zomer van 2011 wordt afgerond.
Certificering verpakkingsafval De Vereniging Afvalbedrijven vindt het van groot belang de inzamel- en hergebruikprestaties van afval te monitoren en werkt graag daaraan mee. Zij spreekt in 2010 met Nedvang af dat voor leden met ISO certificering 9001/14001 in afwijking van de door Nedvang gehanteerde Certificeringrichtlijn kunststofverpakkingsafval (CRV) een apart protocol gaat gelden. Leden van de Vereniging Afvalbedrijven nemen het initiatief voor het opstellen van dit protocol. Afgesproken wordt dat de monitoring over 2010 als pilot geldt. De leden leveren voor 1 juni 2011 de monitoringgegevens aan bij Nedvang en op basis hiervan wordt het monitoringprotocol geëvalueerd en zo nodig bijgesteld.

een subsidie voor duurzame warmteprojecten, garantstellingen, goedkope leningen en een inspanningsverplichting voor het nuttige gebruik van restwarmte. Een andere mogelijkheid ziet de Vereniging Afvalbedrijven in het komen tot een verplicht aandeel duurzame energie in de leveringsmix van energie.
SDE+ Afvalbedrijven zijn producenten van secundaire grondstoffen en energie. Op die manier leveren zij een bijdrage aan de reductie van de CO2-uitstoot en de realisatie van de klimaatdoelstellingen. Door de schaarste aan primaire grondstoffen wordt het benutten van energie uit afval en het terugwinnen van stoffen uit afval en deze opnieuw toepassen in de productieketens alleen maar aantrekkelijker. Ook met efficiënt transport neemt de sector zijn verantwoordelijkheid voor een duurzame samenleving. Het is voor de Vereniging Afvalbedrijven van belang dat de maatschappij doordrongen is van deze belangrijke rol van de afvalbedrijven.
Meetprotocol Binnen de Vereniging Afvalbedrijven bestaat groot draagvlak voor een eenduidige standaard voor het op een neutrale manier in beeld brengen van de effecten van de afvalsector op het klimaat. Het EpE-protocol,

en opmerkingen van de Vereniging Afvalbedrijven worden het protocol en bijbehorend rekentool in 2010 herzien. Het protocol kent nu de mogelijkheid om afzonderlijk te rapporteren over het vastleggen van koolstof (carbon sequestration). De Vereniging Afvalbedrijven omarmt het protocol en erkent het als rapportagetool. Om eenduidige rapportage in Nederland verder te bevorderen wordt jaarlijks een lijst van binnen de branche afgestemde en nationaal geaccepteerde kentallen opgesteld.
Gft-afval Het vergisten van gft-afval neemt verder toe. In 2010 verklaart de Nederlandse composteersector de komende jaren grootschalig te investeren in de vergisting van gft-afval. De sector heeft het doel om in 2015 ruim 1 miljoen ton gft-afval om te zetten in 150 miljoen kilowattuur groene stroom of 18 miljoen m3 groen gas. Door energieopwekking en composttoepassing voorkomt de sector in 2015 de uitstoot van 200.000 ton CO2. De bij de Vereniging Afvalbedrijven aangesloten bedrijven ondertekenen in juni een Duurzaamheidsverklaring om de uitdaging kracht bij te zetten. Met het vergisten van gft-afval wordt biogas opgewekt dat kan worden gebruikt voor de productie van elektriciteit of als groen gas voor transport en verwarming. Het residu van de vergisting (digestaat) wordt alsnog omgezet in compost. De kwaliteit ervan is vergelijkbaar en soms beter dan die van conventionele gft-compost. Om uitbreiding van gft-vergisting te kunnen realiseren is een robuuste subsidieregeling voor duurzame energie (SDE) noodzakelijk. De beperkte middelen en de onvoorspelbare uitkomst van de SDE-regeling
resulteren in 2010 in afwijzingen van subsidieaanvragen. Om het belang van het gescheiden inzamelen en verwerken van organisch afval en de waarde van compost onder de aandacht te brengen, organiseren de Vereniging Afvalbedrijven en BVOR elk jaar de Landelijke Compostdag. De dag is inmiddels uitgegroeid tot een succesvol evenement waaraan vele bedrijven en gemeenten deelnemen en dat vele burgers trekt. Met het uitdelen van gratis compost bedankt de sector de burger voor het gescheiden aanbieden van gft- en groenafval.
Energieproducenten Afvalenergiecentrales en biomassaenergiecentrales zijn belangrijke producenten van energie. De energie wordt in de vorm van elektriciteit en warmte teruggeleverd aan de maatschappij. Ook stortgas wordt ingezet voor de productie van energie. De afvalsector kan in zijn totaliteit 1,2 miljoen huishoudens voorzien in hun elektriciteitsbehoefte. De vrijkomende warmte wordt steeds vaker en beter ingezet in de industrie en stadsverwarming. De afvalsector is verantwoordelijk voor ruim 15 procent van de duurzame energieproductie. De Nederlandse thermische verwerkingscapaciteit onderscheidt zich door een hoge mate van energieterugwinning. De Vereniging Afvalbedrijven vindt een verdere verbetering van belang. Vooral de toepassing van de bij afvalenergiecentrales vrijkomende warmte kan sterk worden verbeterd door de aanleg of optimalisatie van de infrastructuur. De Vereniging Afvalbedrijven verwacht daarvoor een stimulans vanuit de overheid. Naast het wegnemen van belemmeringen in wet- en regelgeving denkt de Vereniging Afvalbedrijven daarbij aan

De Vereniging Afvalbedrijven houdt de uitwerking van de regeling nauwlettend in de gaten en kijkt daarbij met name naar de wijze waarop de stimulering van warmtetoepassing vormgegeven wordt.

The market: steering from a European perspective Vigorous implementation of steering instruments needed q Sustainable procurement should focus on materials recycling and prioritising secondary raw q materials and sustainable energy
Tariff for non-recyclable and non-combustible waste must be €0 q The Dutch Waste Management Association considers the steering instruments in the Second National Waste Management Plan (NWMP-2) to be satisfactory. However, the Association insists on vigorous implementation of these instruments, particularly the tightening up of government sustainable procurement rules and the long promised regulation on the source separation of construction and demolition waste. On sustainable procurement, the Dutch Waste Management Association wants more attention to be given to materials recycling and to prioritising the use of secondary raw materials and sustainable energy. This must be effected under normal market conditions and the Dutch Waste Management Association argues that environmental costs should be reflected in the price of primary raw materials. Moreover, specific policies are needed for certain household waste streams, such as packaging and vegetable, garden and fruit (VGF) waste, to stimulate materials recycling, as well as measures to promote the sorting of bulky household waste at municipal waste recycling centres and (European) minimum standards for the processing of the various waste streams. The regulation of waste streams should always be steered from a European perspective.
Reconsideration of waste tariffs In the summer of 2010 the environment and finance ministries consulted on the proposed introduction of a single waste disposal tariff. The Dutch Waste Management Association assesses proposals to adjust waste tariffs on their effectiveness in regulating waste streams. The Association argued that the existing standard tariff has a regulatory effect and therefore recommended that the standard tariff for recyclable/reusable and combustible wastes should be retained. The tariff for non-recyclable and non-combustible wastes should be set at €0, because landfill is the only responsible treatment option for this waste. Lowering the low rate tariff to €0 would also have a positive effect on
the remediation of closed landfill sites. The Association holds firm on its position that the zero rate should apply to waste incineration. In the end, the 2011 Tax Plan did not contain provisions for more uniform waste disposal tariffs. The new Government, which took office in October 2010, is now reviewing tax policy. In 2010 the Dutch Waste Management Association made representations on applying the monostream regulation to landfilling flue gas treatment residues. Under the regulation, the government can designate non-recyclable and noncombustible wastes as monostreams, which are subject to the low-rate waste disposal tariff. After lengthy consideration, the state secretary rejected this request and said it would be taken into consideration in the wider tax review.
Quality of sewer maintenance A study has begun into fouling and blockages in sewers, with the assistance of the Dutch Waste Management Association and financed by RIONED and the Dutch Waste Management Association. The results will give local

by one price cutter after the other. Although the Netherlands has sufficient permitted capacity to last beyond 2018, investment interest may be too low to allow new capacity to be developed. The researchers have the impression that the provincial authorities are not sufficiently aware of the financial risks they are running as most landfill sites are owned by government authorities. There is still enough money available to cover the costs of restoration and aftercare, but the price per tonne of landfilled waste needed to cover these costs will be higher if full use is not made of all the available landfill capacity. The sector contends that the government bears a responsibility for the nation’s landfill capacity. To improve the situation, the Dutch Waste Management Association suggested lowering the waste disposal charges for landfilling non-recyclable and non-combustible waste to €0 to ensure that waste that can only be landfilled is disposed of in the Netherlands. The legal proceedings instituted by the Dutch Waste Management Association against the redevelopment plans for the former Kempenbaan landfill site in Tilburg ended in 2010 with a disappointing outcome for the sector. The Council of State declared the Dutch Waste Management Association’s case to be inadmissible, which means that the decision issued under the Soil Protection Act is valid and that Tilburg Municipal Council can proceed with its redevelopment plans. However, the Council of State made no judgement on the content of the decision, which leaves the main question for the sector unanswered. It is still not clear whether the material to be excavated during the clean-up should be classified as waste or as soil, and whether using it as fill material should be considered to be a landfill operation. In 2010 the Ministry of Infrastructure and the Environment conducted a study on the future of the landfill sector. The outcome revealed that the landfill sector as a whole was suffering sustained losses and that the situation will probably not improve in the coming years. In recent decades the waste volumes going to landfill have declined rapidly and landfill charges have fallen below the break-even point. The available capacity is sufficient to provide the required reserve waste disposal capacity at least until 2018. Nevertheless, the researchers recommended preparing a back-up plan in case the economic recovery falters, there is a major change in policy or the losses become larger than the profits obtained from other waste processing activities carried out by the landfill operators. Working conditions and safety are key concerns within the waste sector. To further improve safety, the Dutch Waste Management Association is working with the whole industry on the preparation of a health and safety catalogue for the waste sector and implementing a plan for better compliance with the occupational health and safety regulations. A key notion is that the early adopter companies provide assistance to those lagging behind.

A revised version of the catalogue was submitted to the Labour Inspectorate in the autumn, excluding the sections of the catalogue that had already been approved in 2009. At the end of 2010 it became clear that the Labour Inspectorate would soon be able to approve the majority of the catalogue; the remainder will have to be improved. Part of this can be amended quite quickly so that the Labour Inspectorate can include it in its official letter of approval; other parts will require more substantive changes. As the compilers of the catalogue want
to avoid repeated reviews, they agreed that subsequent new sections on individual safety issues will be submitted individually to the Labour Inspectorate. The content of the catalogue is based on practical experiences, which has resulted in a fairly complete and practice-oriented health and safety catalogue. This ‘bottom-up’ approach has proved valuable, but a consequence is that much time had to be invested in ensuring the necessary consistency and uniformity. Some of the comments by the Labour Inspectorate related to this aspect. At the same time, there is a need to optimise the digital document to improve its structure and the search function, and to make clear which sections have been approved, which sections have been agreed and which are under development.
A Foundation with its own recognisable house style has been established to maintain the Health and Safety Catalogue for the Waste Sector, which is an online document under continual development. Agreement was reached on the constitution and standing rules in 2010. It is expected that the Foundation will take over responsibility for the management of the health and safety catalogue in the second quarter of 2011. An important consideration is rolling out the catalogue throughout the waste sector. The compilers of the

catalogue organised a meeting in June 2010 to keep all involved informed and to identify exactly what the companies need in order to put the catalogue into practice. During the meeting, which drew considerable interest, a sound basis was laid for preparing an implementation/communication plan, which will be drawn up during the first half of 2011. The sector believes that the health and safety catalogue must apply not only to employees covered by the Waste & Environment collective labour agreement, but to everyone working in the waste sector.
Compliance action plan In 2009 the Dutch Waste Management Association drew up an action plan on improving compliance with the health and safety regulations. Better compliance should lead to improved working conditions and safety in the waste sector. The aim of the plan is to reduce the accident numbers in 2008 by half in 2010 and for every company to have a certified occupational health and safety management system. An additional aim is for all companies to work with the Health and Safety Catalogue for the Waste Sector.

This was confirmed in an earlier, preliminary opinion of the Council of State. The Dutch Waste Management Association wants to prevent waste being deposited in or on the soil without the necessary environmental protection measures being taken. Circumventing the rules and taking a ‘creative’ approach to treating the excavated material is often cheaper than delivering the waste to a landfill site. All such activities should be treated in the same way, whether they involve former landfill sites or operational landfill sites. The Dutch Waste Management Association has appealed to the Ministry of Infrastructure and the Environment for an answer to the legal questions about the interpretation of the environmental legislation when excavating and landfilling waste from closed landfill sites. The Dutch Waste Management Association stresses the importance of unambiguous and consistent interpretation of legislation and regulations.

The Dutch Waste Management Association always judges national policy on its effects on the development of a European level playing field. Nevertheless, the Dutch Association recognises that national circumstances may sometimes make it necessary to set more stringent national requirements, but these must always be justified by sound arguments based on a social cost-benefit analysis. The Dutch Waste Management Association expects the government to take account of international competitive positions in its decision making. Specific local circumstances – if adequately substantiated – may also justify additional demands on individual companies.

Amendment to waste policy
To improve the chances of the achieving the plan’s objectives, the Association’s Platform for Quality, Health and Safety, and Environment proposed making a joint grant application to the Ministry of Social Affairs and Employment, which has made subsidies available to promote a culture of safe working in small and medium-sized enterprises. A successful joint application would leverage the required funds. The aim is for at least twenty companies to apply. The Dutch Waste Management Association expects that sharing expertise and experiences will lead to more effective implementation of the action plan ‘Good legislative compliance in the waste sector’. The safety culture and behaviour in each company is being monitored and recorded to provide a clear picture of the possibilities for improvement. Plans are being prepared on creating the desired situation, based on each company’s own ambitions. At the same time a number of common tools are being developed and used to positively influence the safety culture and behaviour among the Association’s members.

The Second National Waste Management Plan (NWMP-2), which came into force at the end of 2009, was amended at the beginning of 2010. The amendment introduced a formula from the EU Waste Framework Directive (WFD) for determining the energy efficiency of waste-to-energy (WtE) plants. The formula is used to determine whether a WtE plant should be classified as a waste recovery operation or a waste disposal operation. Recovery facilities make the free movement of combustible residual waste in Europe possible. The Dutch Waste Management Association had argued vigorously for this amendment to national policy. The majority of Dutch waste-to-energy plants were given recovery status (R1 status) in 2010. In return, the Dutch Waste Management Association made an agreement with the government that the total capacity of the waste-toenergy plants would not be increased until after 2020. It is expected that under European regulations almost all Dutch WtE plants will have obtained R1 status by the end of 2011. This does not alter the fact that the WtE plants continue to work on further improving their energy efficiency. The policy amendment makes it necessary to revise the recovery target, because recovery does not have the same status as materials recycling. The minimum standards in the NWMP2 determine how the various waste streams are treated. To achieve the policy targets, the target of 60 per cent recovery of household waste must be changed into a comparable target for materials recycling. The transposition of the WFD into the Dutch Waste Management Act, which had to be completed by 12 December 2010, was delayed because of the general election and the formation of the new Government. The revised Waste Management Act came into force on 5 March 2011. The Dutch Waste Management Association is pleased that the changes do not abolish the duty on
the local authorities to separately collect household vegetable, garden and fruit (VGF) waste. The government also decided not to introduce a legal duty of care for the treatment of household waste, which the Association also considers to be unnecessary. Another positive outcome is that both sourceseparation and post-separation of plastic packaging waste can continue in parallel, as long as the quality of the processing of this waste is not compromised.
Enforcement Systems monitoring is making a positive contribution to the mutual trust between government and industry. The Housing, Spatial Planning and Environment Inspectorate and the provincial authorities are gradually integrating this method of inspection into their regulatory work. In the systems monitoring approach, inspection and enforcement is based primarily on how companies guarantee compliance with the legislation and permits, with less emphasis on compliance with specific licence conditions. If a company operates an effective compliance system, the inspection burden decreases. Both parties need time to get used to how the new system works in practice. A difficulty is the unpredictable role of the Public Prosecution Service (PPS), which is independent and has no formal obligation to recognise agreements between competent authorities and companies. The Inspectorate is holding discussions on this matter with the PPS, which is willing to consider further interagency coordination. These discussions are continuing in a constructive atmosphere. The Dutch Waste Management Association remains involved in further developments in discussion with the Inspectorate. The provincial and local authorities will eventually have to transfer their environmental tasks to regional implementing agencies, which are in the process of being set up. The provincial and local authorities will be transferring both their licensing and enforcement duties to these agencies. However, the establishment of the regional implementing agencies is not a statutory requirement and the non-binding nature of this exercise means that the process is timeconsuming and intensive. The goal of having a nationwide implementation structure in place by 1 January 2012 will therefore probably not be met. The Dutch Waste Management Association regrets this because it is strongly in favour of consolidating the available expertise and experience on licensing and enforcement. The waste sector and the provincial authorities are concerned about the progress being made with the transfer of these tasks to the regional implementing agencies and the expertise of the future inspectors.
Industrial and Hazardous Wastes (Notification) Decree The Dutch Waste Management Association was closely involved in the preparation of the new Industrial and Hazardous Wastes (Notification) Decree, which came into force on 1 January 2011. At the request of the waste industry associations, including the Dutch Waste Management Association, a generous transitional period to 1 May 2011 was included in the decree to give all stakeholders in the materials chains sufficient opportunity to take the changes on board and switch over to using the new
notification forms. On the other hand, the government took over several suggestions by the provincial authorities, including a further restriction on the ‘waste collection regulation’, which are not in the interests of the sector. Nevertheless, the Dutch Waste Management Association is generally satisfied with the final content of the decree.
Waste Incineration Decree In transposing the EU Industrial Emissions Directive into national law the Ministry of Infrastructure and the Environment is considering adopting stricter requirements for some emissions in the Waste Incineration Decree. The proposal was prompted by the successful legal challenges made by environmental organisations to a number of permits issued to incineration facilities in recent years. In many cases these resulted in the imposition of more stringent conditions. Several companies also voluntarily agreed tighter standards with the competent authorities. The Dutch Waste Management Association held discussions with the Ministry of Infrastructure and the Environment on the proposals, assessing each proposal on its environmental protection merits and its effects on the level playing field. The discussions faltered at the end of 2010 when it became clear that the ministry was considering tying the Waste Incineration Decree to the Activities Decree, which would make the provisions in the Waste Incineration Decree ‘general rules’ and therefore directly applicable. The sector is considering the consequences of this proposal and possible conflicts with other European legislation.
Electricity Act Because of the impending shortage of transmission capacity on the national grid there is a risk that energy generated from sustainable sources will be denied access to the grid. At the end of 2010 the Dutch Senate passed a bill giving priority of access to sustainable electricity. Specific congestion management rules, including the degree of priority, will be laid down in an administrative order. The Dutch Waste Management Association is calling for more consideration to be given to the controllability of energy-generating facilities and the position of waste processing plants. Any congestion occurring before the act comes into force will be subject to measures under the current regime. These include the system for making better use of the transmission capacity that was adopted in 2010, which gives a special status to energy sources whose output cannot be regulated on demand, such as waste-to-energy plants. It is expected that the administrative order will go before both houses of parliament at the end of the first quarter of 2011.
Heat Act In 2010 the government drew up subordinate legislation to implement the provisions of the Heat Act adopted in 2009. From research into the effect on the profitability of the existing heat supply networks of the proposed tariff structure introduced to protect consumers, it was concluded that the current Heat Act does not meet the objectives and the necessary conditions for maintaining the heat supply networks. Amendments to the Heat Act are being prepared with the aim of keeping the act workable and enforceable and simplifying the tariff structure. The Dutch Waste Management Association supports a simplification
of the act. These legislative proposals are expected to be put before the House of Representatives at the end of the first quarter of 2011.
Modernisation of the landfill regulations The government is preparing to modernise the landfill regulations in accordance with current techniques, including measures to make landfilling more sustainable. By carrying out a large-scale research programme the sector wants to demonstrate that sustainable landfilling can further reduce the environmental risks of landfilling wastes. The goal of sustainable landfill management is to reduce emissions to an extent that within a single generation landfills will present no risk to people or the environment. A declaration of intent to carry out the research, signed by all the Dutch landfill operators, was presented to the Association of Provincial Authorities (IPO) and the Ministry of Infrastructure and the Environment on 10 February 2010. “Through research we can demonstrate that sustainable landfill management can further reduce the environmental risks of landfilling. If the government is prepared to adapt its policy in line with the results, the landfill sector will certainly invest in this research.” Dutch Waste Management Association and all landfill operators have asked the provincial authorities to support the initiative by making an active contribution to the implementation of the research. The environment portfolio holders of the provincial executives reacted positively and are prepared to work up the proposal with the industry and the ministry. Of crucial importance to the sector is having certainty about the consequences attached to the outcome of the research. If the government authorities clearly state that a positive outcome will lead to a revision of policy, the landfill operators will invest in the research. If sustainable landfill management proves successful in reducing emissions, this should lead to a revision of the requirements for restoration, replacing sealing layers, and the nature and duration of aftercare. To be clear in advance about the degree to which emissions will have to be reduced, it is necessary to introduce emission limit values into the regulations. The sector is holding discussions with the provincial authorities and the ministry to include this in the modernisation of the Soil Protection (Landfill) Decree.
Waste (Landfill Sites and Prohibitions) Decree The Ministry of Infrastructure and the Environment is preparing amendments to the Waste (Landfill Sites and Prohibitions) Decree, having decided not to embark on a general revision of the act. The amendments focus on the wastes to be subject to a landfill ban and a revision of the way discretionary permits are issued. The Dutch Waste Management Association drew attention to the proposals on exemptions from landfill bans, arguing that these should be determined at the national level and not by the competent authorities. Observations on the first draft from stakeholders in the field will be processed during the first half of 2011. The amended draft cannot yet be put to stakeholders, because the new exemption arrangements may require changes to the legislation. The Ministry of Infrastructure and the Environment is looking into this.

European policy: sustainable materials use and energy efficiency Raw materials scarcity puts Europe on a course towards more sustainable use of materials q Policy steer to reduce the landfilling of recyclable wastes in Europe q Minimum use of resources at the lowest possible environmental impact q The growing raw materials scarcity is putting Europe on a course towards more sustainable use of materials. This is not only compatible with the transition towards a recycling society, but will also help to reduce the vulnerability of the economy and create jobs. The Dutch Government and parliament see a role for the waste sector as an important supplier of raw materials and energy. The European Commission is preparing a roadmap for a resource efficient Europe, which entails using as few resources as possible and minimising the environmental impact of resource use. Key elements in the strategy will be more intensive cooperation between industry and the waste sector and smart production and consumption. Resource efficiency was also the theme of the FEAD Annual Conference 2010, which was hosted by the Dutch Waste Management Association. To make it easier for stakeholders to follow the debate on European waste policies and to support the promotion of its members’ interests in the European arena, the Dutch Waste Management Association launched the website www.wastematters.eu in 2010. The website is accessed from countries across the world and its contents followed with interest.
Thematic strategies The European Commission is working on revisions of the thematic strategies on Sustainable Use of Natural Resources and on Prevention and Recycling of Waste. The strategies, published in 2005, were reviewed in
2010. The outcomes of these reviews show that the recycling percentages have increased, particularly in north-west Europe, and the amount of waste going to landfill has declined. However, much can still be improved. For example, some member states still depend heavily on landfill. In the opinion of the Dutch Waste Management Association, the EU will have to steer with a firm hand to reduce the landfilling of recyclable and reusable wastes. The Association supports the proposal by MEPs to introduce a European minimum standard to prevent the landfilling of reusable, recyclable

and combustible waste. There is also support for revising the Ecodesign Directive to give designers a greater input to the design of more sustainable products. In addition, the Dutch Waste Management Association wants the European Union to do more to implement existing regulations in all the member states.
The measuring methods should also be harmonised. The Waste Framework Directive contains recycling targets for household and similar commercial waste and for construction and demolition waste. Currently, member states can calculate this in one of four ways, which makes it difficult to compare how well the different member states are performing. However, the European Commission has said that it will not take any action on this matter in the short term. The Dutch Waste Management Association regrets that the calledfor harmonisation is not forthcoming and that it will remain difficult to obtain reliable comparisons of the environmental performances achieved by the member states.
End of Waste and REACH The development of a recycling society is stimulated by classifying waste streams that can be recycled as reusable raw materials as ‘end of waste’. At the end of 2010 it became clear that a decision on reclassifying ferrous and aluminium scrap was imminent. The sector estimates that under the proposed criteria only a small fraction of scrap metals, about ten per cent, will qualify for end-of-waste status. The procedure for drawing up end-of-waste criteria for copper, glass and paper was started and studies were launched to identify possibilities for formulating criteria for compost, aggregates from construction and demolition waste, and energy pellets (RDF). End-of-waste streams are materials of high quality that can be put on the market without any risk to the environment.

The scarcity of primary raw materials makes the recovery of energy and materials from waste and reusing them in production chains even more attractive. By transporting waste and materials efficiently the sector takes further responsibility for the transition to a sustainable society. It is important to the Dutch Waste Management Association that society is fully aware of the significant contribution being made by waste companies.
Measurement protocol Within the Dutch Waste Management Association there is widespread support for an unequivocal standard for drawing up an impartial assessment of the effects of the waste sector’s activities on the climate. The EpE protocol for calculating CO2 balances has been further developed for use in the sector. Following recommendations and comments by the Dutch Waste Management Association, the protocol and calculation tool were revised in 2010. The protocol can now be used to report separately on carbon sequestration. The Dutch Waste Management Association welcomes the protocol and
recognises it as a reporting tool. To further promote uniform and unambiguous reporting in the Netherlands, each year a list is drawn up of indicators agreed within the sector and accepted nationally.
VGF waste An increasing proportion of vegetable, garden and fruit (VGF) waste is treated by anaerobic digestion. In 2010 the Dutch compost sector announced it will be making major investments in the anaerobic digestion of VGF waste

The sector has set itself a target for 2015 of converting more than 1 million tonnes of VGF waste into 150 million kWh of green electricity or 18 million m3 of green
gas. In 2015 the sector will be able to avoid 200,000 tonnes of CO2 emissions through energy recovery and the use of compost. In June the composting companies in the Dutch Waste Management Association signed a Sustainability Declaration to reaffirm their commitment to this challenge. The anaerobic digestion of VGF waste produces biogas, which can be used to generate electricity or as a green gas for transport and heating. The digestate (the solid material remaining after the anaerobic digestion) is then composted. The quality of this compost is comparable with, and sometimes even better than, conventional VGF compost. Achieving this expansion of anaerobic digestion capacity will depend on a robust subsidy scheme for sustainable energy. The limited resources and unpredictability of the existing incentive scheme for sustainable energy production resulted in rejection of the subsidy applications in 2010. Each year the Dutch Waste Management Association and the Association of Dutch Greenwaste Composting Plants (BVOR) organise a National Compost Day to publicly promote the importance of the separate collection and treatment of organic waste and the value of the compost produced.
Because the waste market is a European market, the Dutch Waste Management Association believes that end-of-waste status should be established at the European level and that the administration of the criteria in the member states should be strictly enforced. At the moment, end-of-waste criteria can be decided at the national level. At the very least, quality criteria should be the yardstick for obtaining the status. The emission regimes for materials streams used for energetic applications should also be harmonised and remain applicable to end-of-waste streams. Once materials have achieved endof-waste status they may fall within the scope of REACH. This can lead to additional administrative burdens, whereas the end-of-waste status should actually lead a reduction in

To keep these materials outside the scope of REACH, recycling companies have to demonstrate their sameness with primary raw materials. They can do this by carrying out analyses themselves. However, recycling companies are also being asked to contribute towards the costs incurred by parties who have registered substances to comply with
The day has now become a successful annual event involving many companies and local authorities and attracting many members of the public. Handing out free compost is the sector’s way of thanking the public for their efforts in separating their VGF and green waste.

Energy producers Waste-to-energy plants and biomass power stations are important producers of energy, which is returned to society in the form of electricity and heat. Landfill gas is also used to produce energy. The waste sector as a whole can produce enough electricity to meet the needs of 1.2 million households. The recovered heat is increasingly being used to better effect in district heating schemes and as process heat for industry. The waste sector is responsible for more than 15 per cent of all the sustainable energy produced in the Netherlands. Dutch thermal processing capacity is distinguished by a high rate of energy recovery. The Dutch Waste Management Association stresses the value of
the REACH legislation. The waste sector is keeping a close eye on this and contends that recycling companies should not have to pay these costs. Wastes that have not yet been classified as end of waste are excluded from REACH. Nevertheless, in some situations the market demands companies to comply with REACH because the manufacturers have a preference for primary raw materials. This is at odds with the free and equal operation of the market and hampers progress towards the recycling society.
Biowaste Against the clear wishes of the European Parliament and the waste sector, the European Commission is sticking to its position that additional legislation on treating biowaste is unnecessary. The Commission’s argument is that the EU Landfill Directive has been adequately brought into effect and therefore no new measures are necessary. However, ten years after the introduction of the Landfill Directive, many countries have still not properly implemented it and many member states still landfill a large proportion of their biowaste. The situation in the Netherlands shows that mandatory separate collection of this waste leads to its recovery in useful products, including compost and biogas. The Commission remains unconvinced, but it is considering including a biowaste recycling target of 36.5% in the Waste Framework Directive. This could come into effect in 2014, following the specification of end-of-waste criteria for compost. The Commission is also considering revising the Sewage Sludge Directive to include standards for specific classes of compost. These standards should be an incentive to produce higher quality compost from sewage sludge. However, the standards for
further improvement. In particular, the use of residual heat from waste-toenergy plants can be much improved by building more infrastructure or optimising existing networks. The Association expects the government to provide the necessary incentives. In addition to the removal of legislative obstacles, the Association would like to see subsidies for sustainable heat projects, guarantees, low-cost loans and a best efforts obligation to recover and use residual heat. Another possibility is to designate a mandatory share of sustainable energy in the energy supply mix.
Subsidy for sustainable energy The details of the new subsidy scheme for sustainable energy, SDE+, began to take shape at the end of 2010. The scheme includes a fund for waste-toenergy plants, despite the fact that it has been agreed that no new WtE plants will be built until after 2020. The Dutch Waste Management Association therefore made the case for keeping WtE plants outside the SDE+ with regard to electricity production, an argument which applies to any new initiatives for the thermal processing of waste that can also be incinerated in a WtE plant. This will create scope for other initiatives, such as anaerobic digestion or recovering and reusing residual heat from existing facilities and from VGF composting. The SDE+ will be finalised in the first half of 2011 and is expected to be opened for applications in tranches sometime in the summer. The Dutch Waste Management Association will be closely following the rollout of the scheme, paying particular attention to how the stimulation of residual heat recovery and use works out in practice.
Dutch Waste Management Association the compost classes proposed by the European Commission can be met by composting unseparated household waste. The Dutch Waste Management Association is opposed to low European compost standards because these can disrupt the market for compost and damage the image of high-quality compost from vegetable, garden and fruit (VGF) waste, thus putting it at a disadvantage.
R1 Guidance The European Commission is preparing a guidance document on calculating the energy efficiency of the incineration of municipal residual waste. The calculation can be used to distinguish between recovery (R1) and disposal (D10) operations. The guidance document is not legally binding, but the Dutch government will use it when making these calculations. In 2010 the scope of the document came under discussion. The question was whether the incineration of hazardous waste in waste-to-energy (WtE) plants should also be classified as recovery R1. The Dutch Waste Management Association believes that if it is technically possible to incinerate certain hazardous waste in a WtE plant in an environmentally responsible way, this should count towards the determination of R1 status. Many permits contain specific conditions on this point. The Commission stated that hazardous waste should be included in the formula for R1 status, but attaches no legal consequences to this statement, leaving the final decision to the member states. The Dutch Waste Management Association does not support this position because it can lead to differences in interpretation. The Commission will probably publish the guidance document in the summer of 2011.

Emissions Directive The preparation of the Industrial Emissions Directive (IED) was completed at the end of 2010. The Dutch Waste Management Association successfully resisted several proposed provisions, including the proposal to give competent authorities powers to set stricter emission standards than the best available techniques when issuing permits, without giving any reasons for doing so. The Netherlands made this proposal so that it would be able to pursue a national policy of setting more stringent standards than the European reference standards, with the aim of achieving other EU targets. The final IED gives member states the authority to adopt regulations that give local competent authorities powers to demand more stringent conditions than the best available techniques only when these are supported by sound arguments. This can prevent situations in which one region sets much stricter standards than another, thus undermining the level playing field. The IED came into force on 6 January 2011. Member states have three years to implement the IED. An important consequence of the coming into force of the IED is that the documents describing the best available techniques will have to be revised. The process of revising the BAT Reference Document (BREF) on waste treatment is expected to begin at the end of 2011. The Dutch Waste Management Association is carrying out preparatory work for this and is looking at facilities that under the revised IED now fall within the scope of the BREF on waste treatment: composting and anaerobic digestion facilities, and plants for processing slags and ashes, scrap metal and hazardous waste.

Waste companies and manufacturers are collaborating more frequently on ecodesign and product renewal, which leads to waste prevention and high-grade waste recycling. The Dutch Waste Management Association believes the scarcity of primary raw materials will be the main driver of future waste management. This scarcity is generating a growing demand for alternatives, which is an important reason for giving a high priority to closing materials loops. Not only is the focus of companies’ activities shifting towards the front end of supply chains – on prevention and making wastes suitable for reuse – but the field of activity of the Dutch Waste Management Association is also expanding in this direction. The Association has willingly taken up the government’s invitation to develop closer working relations between government, industry and scientific institutions on the management and processing of waste.
Higher up the ladder The main theme of the Dutch Waste Management Association’s work is making progress with closing materials loops and moving higher up the waste hierarchy. The aim is optimal recovery of raw materials and energy, reducing the environmental burden and limiting the costs to society. This means that in some cases it will be necessary to deviate
from the waste hierarchy. Such decisions must be based on a life-cycle assessment (LCA), which should include consideration of the financial and social aspects. An LCA may provide an argument to move a step up or down the waste hierarchy. For environmental, financial and social reasons, we will never reach FREEK VAN EIJK (SITA NEDERLAND)

In the vision of the Dutch Waste Management Association, the optimal waste management infrastructure consists of a combination of activities in the waste hierarchy. All the elements in this hierarchy are essential and they can only be successful when used together as complementary parts of an integrated system. As more waste is reused and recycled, the amount of waste to be incinerated and landfilled will continue to decline. Waste companies must anticipate and respond adequately
to this trend, and if necessary adapt their capacities. Even in a recycling society, the activities lower down the hierarchy will have to be maintained at a sufficient level to adequately support the full range of social activities.
Raw materials centre In June 2011 the state secretary for the environment, Joop Atsma, is expected to present a plan for transforming the Netherlands into a European raw materials centre, an idea that appeals to the Dutch Waste Management Association. More sustainable materials management serves the interests of securing supplies of raw materials and reducing the environmental burdens of materials throughout their life cycles. The Dutch Waste Management Association is exchanging ideas about the potential of this concept with the Ministry of Infrastructure and the Environment and the Ministry of Economic Affairs, Agriculture and Innovation. In the light of various economic trends, the Association emphasises the importance of treating waste management as a normal economic activity. This is both desirable and necessary, not only for the management of Dutch waste but also for the processing of foreign waste in the Netherlands. In the vision of the Dutch Waste Management Association, the creation of an ’expertise centre for raw materials’ would provide an important stimulus for closing more materials loops and attracting the establishment of more recycling activities in the Netherlands. Dutch waste companies are a reliable source of raw materials that can be reused in the
economy. They reduce dependence on foreign supplies and recover residual waste streams from recycling activities in highly efficient processes with minimal environmental impact. The Dutch Waste Management Association points out that recycling is steered by market forces. Creating an attractive business climate will increases the chances of new recycling activities becoming established in the Netherlands, but cannot guarantee this.
Plastic waste The separate collection of plastic packaging waste has been mandatory in the Netherlands since 2010. For years there has been much discussion about the benefits and disadvantages of the separate collection and processing of these materials. To facilitate this debate, the Dutch Waste Management Association is carrying out a life-cycle assessment (LCA) to determine the environmental effects of the processing options for this waste. The study is critically examining the environmental burdens of the different collection and processing methods, including the effects of possible combinations of methods, such as source- and post-separation and a deposit system, and of recycling the waste and incinerating it with energy recovery. The Dutch Waste Management Association does not question current policy, but wants the LCA to make a contribution to the policy evaluation to be held when the framework agreement under the Packaging Decree expires in 2012. Recognising the importance of broad support for the LCA study, the Association approached a wide range of stakeholders and invited them to participate in the project. The Ministry of Infrastructure and the Environment, NL Agency, the Association for Refuse and Cleansing Management, and
Recycling Netwerk all wanted to be involved in the study. Representatives from these bodies sit on the steering committee, which was responsible for determining the assumptions, principles and methods used in the study. The study will also include a scientific

review of the outcomes of the LCA. The LCA is expected to be completed at the end of summer 2011.
Certification of packaging waste The Dutch Waste Management Association attaches great importance to monitoring the performance of waste collection and recycling activities and is pleased to assist with such efforts. In 2010 the Association agreed with Nedvang that members with ISO 9001/14001 certification will be subject to a different monitoring protocol than Nedvang’s own certification guidelines for plastic packaging waste (CRV). Members of the Dutch Waste Management Association drew up this protocol themselves. It was agreed that the monitoring that took place in 2010 will be used as a pilot project. The members will provide Nedvang with these monitoring data before 1 June 2011. The data will be used to evaluate the monitoring protocol, which will then be amended if necessary.
