MEMORANDUM KEHENDAK ANTARA KEPOLISIAN NEGARA REPUBLIK INDONESIA DAN DEPARTEMEN LUAR NEGERI AMERIKA SERIKAT TENTANG PENGEMBANGAN KAPASITAS ANTI TERORISME
Kepolisian Negara Republik Indonesia dan Departemen Luar Negeri (Department of State I DOS) Amerrika Serikat, selanjutnya akan disebut sebagai "Para Pihak", Berkeinginan untuk lebih meningrkatkan dan memperkuat hubungan persahabatan yang ada antara kedua negara, yang dibuat dalam semangat Kemitraan Komprehensif Republik Indonesia - Amerika Serikat; Memperhatikan pentingnya kerja sama antara lembaga penegak hukum dan perlunya mencegah dan memberantas terorisme secara efektif; Mengakui prinsip-prinsip kedaulatan, kemerdekaan , keutuhan wilayah, noninterferensi, kesetaraan dan keuntungan bersama; Sesuai dengan undang-undang dan peraturan ya ng berlaku, serta prosedur dan kebijakan di negara masing-masing; Menyatakan niat mereka sebagai berikut: 1.
Memorandum Kehendak (Memorandum) ini bertujuan untuk memberikan kerangka kerja sama untuk meningkatkan kemampuan Para Pihak untuk mencegah dan memberantas terorisme melalui pengembangan kapasitas kepolisian berdasarkan manfaat bersama dan persetujuan antara Lembaga Pendidikan Polri dan Program Bantuan Anti Teror (Department of State's Antiterrorism Assistance Program I DSS-ATA) Departemen Luar Negeri Amerika Serikat.

Dalam batas yurisdiksi dan hukum serta kebijakan masing-masing Pihak; kedua Pihak berniat untuk meningkatkan kerja sama dalam pengembangan kapasitas, yang dapat meliputi hal-hal berikut ini: a. Berbagi dan bertukar informasi dan praktik terbaik; b.
Pelatihan, kursus, pertukaran keterampilan dan personil sumber daya manusia;

2 Penyediaan peralatan pelatihan dan operasional; Penilaian kemampuan berkala yang dilakukan oleh Para Pihak untuk mengembangkan program pelatihan dan mengkaji pelaksanaan berdasarkan temuan dari penilaian. Modalitas dari penilaian diharapkan akan ditentukan bersama oleh Para Pihak.
Ked ua Pihak berniat untuk melaksanakan Memorandum ini melalui program peningkatan kapasitas yang diharapkan akan ditentukan oleh kedua Pihak sesuai dengan dana dan personil yang tersedia. DOS melalui Kedutaan Besar AS bermaksud untuk membuat penawaran pelatihan formal ke Polri. Setiap penawaran akan menggambarkan kursus pelatihan yang diusulkan; mengidentifikasi lokasi pelatihan dan persyaratan teknis dan fisik untuk para peserta; dan, jika memungkinkan, mengidentifikasi peralatan untuk sumbangan dan persyaratan sumbangan peralatan tersebut. a.
Polri bermaksud untuk bekerja sama dengan Kedutaan Besar AS, Kantor Keamanan Regional (Regional Security Office I RSO) untuk mencalonkan dan meninjau semua kandidat untuk memastikan yang dipilih yang paling berkualitas dan bahwa semua persyaratan terpenuhi.

Untuk mendukung program , Polri bermaksud untuk menempatkan peserta pelatihan pada posisi, dimana mungkin, di bidang mereka dilatih untuk jangka waktu yang sesuai setelah selesainya pelatihan agar peserta dapat mengimplementasikan dan menerapkan keterampilan dan pengetahuan yang didapat dari pelatihan.
c.
Untuk lebih mendukung pelembagaan kemampuan yang diperoleh dari program ini, Polri berniat untuk mengidentifikasi para peserta dalam pelatihan ATA untuk menjadi instruktur di masa mendatang di akademi pelatihan atau di unit mereka masing-masing. Polri berniat menggunakan setiap peralatan yang diberikan oleh program ATA hanya untuk tujuan yang telah ditetapkan. Pemantauan berkala terhadap penggunaan peralatan dapat dilakukan jika dianggap perlu dan sesuai dengan Akta Hibah yang sebelumnya ditandatangani oleh Pihak. Untuk DOS: RSO Kedutaan Besar Amerika Serikat Tiap Pihak berniat menunjuk seorang perwakilan resmi untuk bertindak sebagai liaison/penghubung untuk memastikan pelaksanaan tepat waktu program ini.

Pertemuan konsultatif berkala akan diselenggarakan antara Para Pihak untuk membahas perencanaan dan meninjau pelaksanaan program dan proyek dari Memorandum ini.

Ketentuan lainnya: a. Keikutsertaan dalam pelatihan dibatasi hanya untuk personil penegakan hukum sipil. Keikutsertaan personil militer yang ditugaskan ke lembaga penegakan hukum sipil akan dipertimbangkan berdasarkan kasus per kasus. Personil dari organisasi yang utamanya terlibat dalam pengumpulan intelijen tidak berhak untuk dapat mengikuti program ini. b. Para Pihak memahami bahwa para peserta pelatihan yang bepergian ke AS untuk mengikuti pelatihan diwajibkan melakukan tes kesehatan sebelumnya oleh dokter yang ditunjuk Kedutaan Besar AS. ATA berniat menanggung biaya pemeriksaan medis tersebut. c.
Pajak, tarif cukai dan bea masuk dapat saja dibebaskan, tunduk pada hukum dan peraturan yang berlaku. Polri dan DOS berniat untuk berkoordinasi untuk mengunus proses pembebasan tersebut.
d.
Polri dan DOS berniat untuk mengkaji semua calon peserta pelatihan untuk memastikan bahwa semua calon tidak pernah melakukan tindak pidana.

Memorandum ini dapat direvisi kapan saja berdasarkan persetujuan tertulis kedua Pihak. Revisi tersebut akan berlaku pada tanggal yang ditentukan oleh Para Pihak.
7.
Memorandum ini dimaksudkan untuk berlaku efektif pada tanggal penandatanganannya dan akan tetap berlaku selama periode dua (2) tahun. Salah satu Pihak dapat menghentikannya setiap saat, namun akan berupaya untuk memberikan pemberitahuan tertulis kepada Pihak lainnya tiga (3) bulan sebelumnya.
8.
Para Pihak berniat untuk menyelesaikan perbedaan terkait penafsiran atau pelaksanaan Memorandum ini secara damai melalui konsultasi dan negosiasi.
Ditandatangani rangkap dua di Jakarta pada tanggal sembilan Oktober tahun dua ribu lima belas dalam bahasa Indonesia dan bahasa lnggris.

MEMORANDUM OF INTENT BETWEEN THE INDONESIAN NATIONAL POLICE AND THE DEPARTMENT OF STATE OF THE UNITED STATES OF AMERICA ON ANTITERRORISM CAPACITY BUILDING
The Indonesian National Police and the Department of State (DOS) of the United States of America, hereinafter referred to as "The Participants", Desiring to further enhance and strengthen the existing friendly relations between the two countries, made in the spirit of the Republic of Indonesia - the United States of America Comprehensive Partnership; Noting the central importance of the cooperation between law enforcement agencies and the need for effectively preventing and combating terrorism; Recognizing the principles of sovereignty, independence, territorial integrity, non-interference, equality and mutual benefits. Pursuant to the prevailing laws and regulations , as well as the procedures and policy in their respective countries; Declare their intent as follows: 1.
This Memorandum of Intent (Mol) aims to provide a framework of cooperation to enhance the abilities of the Participants to prevent and combat terrorism through development of Police capacity based on mutual benefits and consent via cooperation between the Indonesian National Police's Police Education Institution and the United States Department of State's Antiterrorism Assistance Program (ATA).

Within the limits of its jurisdiction and the Participants' respective laws and policies, both Participants intend to enhance cooperation in capacity building, which may include the following : a. Sharing and exchange of information and best practices; b. Training, courses, exchange of expertise and human resources personnel;

2 Providing training and operational equipment;
d. Periodic capabilities assessment conducted by the Participants to develop a training program and review the implementation based on the findings of the assessment. The modalities of the assessment are expected to be mutually determined by the Participants. 3.
Both Participants intend to implement this Mol through capacity building programs which are expected to be determined by both Participants in accordance with available funds and personnel. DOS through the U.S. Embassy intends to make formal training offers to the INP. Each offer is to describe the proposed training course; identify the training location and the technical and physical requirements for participants; and , when applicable, identify any equipment for donation and the conditions under which the equipment would be donated. a.
The INP intends to work closely with the U.S. Embassy, Regional Security Office (RSO) to nominate and review all candidates to ensure the most qualified are selected and that all requirements are met.
b.
To support the program , the INP intends to assign training participants to positions, where possible, in the area for which they are trained for an appropriate period following the completion of training in order that the Participants may implement and apply the skills and knowledge gained from the training.
c.
To further support the institutionalization of the capabilities to be gained in the program, the INP intends to identify participants in the ATA training to serve as future instructors at their training academies or at their respective units.
d.
The INP intends to use any equipment provided under the ATA program only for the purpose for which it was intended. Periodic monitoring of the use of the equipment may be conducted if deemed necessary and in accordance with the Letter of Grant previously signed by the Participants.

Each Participant intends to designate an official representative to serve as a liaison to ensure timely implementation of the program.

Periodic consultative meetings should be organized between the Participants to discuss planning and to review the implementation of the programs and projects of this Mol .
5.
Other Provisions: a.
Participation in training courses is to be limited to civilian law enforcement personnel. Participation of military personnel seconded to civilian law enforcement agencies is to be considered on a caseby-case basis. Personnel of organizations involved primarily in the collection of intelligence are not eligible to participate in the program.
b.
The Participants understand that participants traveling to the U.S. for training are required to have prior medical screening by physicians designated by the U.S. Embassy. The ATA intends to cover the costs of these medical screenings.
c.
Taxes, customs tariffs and import duties may be exempted subject to the prevailing laws and regulations. The INP and DOS intend to coordinate to administer the exemption process.
d.
The INP and DOS intend to review all candidates for training to ensure that all candidates have never committed any criminal offences.
6.
This Mol may be revised at any time by mutual written consent of both Participants. Such revision is intended to be effective on a date as may be determined by the Participants.
7.
This Mol is intended to be effective on the date of its signature and to remain effective for a period of two (2) years. Either Participant may discontinue it at any time, but should endeavor to provide three (3) months prior written notification to the other Participant.
8.
The Participants intend to settle any differences concerning the interpretation or the implementation of this Mol amicably through consultations and negotiations.
