PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN KABINET MENTERI UKRAINA MENGENAI KERJA SAMA EKSPLORASI DAN PEMANFAATAN ANTARIKSA UNTUK MAKSUD DAMAI
Pemerintan Republik Indonesia dan Kabinet Menteri Ukrai!la (selanjutnya disebut sebagai Para Pihak),
Berkeinginan memperkuat hubungan persahabatan dan kerja sama yang selama ini telah ada antara kedua Negara;
Menimbang
kepentingan
bersama
dalam
memajukan
pemanfaatan
antariksa untuk maksud-maksud damai;
Berupaya rnelestarikan antariksa secara eksklusif untuk maksud-maksud damai yang terbuka untuk ketja sama internasional secara luas;
Menimbang syarat-syarat dalam Traktat mengenai Prinsip-prinsip yang Mengatur Kegiatan Negara-negara dalam Eksplorasi dan Penggunaan Antariks·1 termasuk Bulan dan Benda-benda Langit Lainnya, tanggal 27 Januari 1967, serta Traktat-traktat dan Perjanjian-perjanjian Multilateral lainnya mengenai eksplorasi dan penggunaan antariksa di mana kedua Negara menjadi anggota;
Berkeinginan untuk membuat bentuk-bentuk kerja sama yang efektif di bidang kegiatan keantariksaan yang akan meningkatkan pembangunan sosial, ekonomi, dan budaya untuk kemanfaatan masyarakat negaranya;
Bertujunn mendorong kerja sama perdagangan dan industri antara sektorsektor swasta dari kedua Negara di bidang antariksa;
Sesuai dengan masing-masing perundangan-undangan nasional di kedua Negara.
Telah menyetujui hal-hal sebagai berikut:
PASAL1 Tujuan
Tujuan dari Persetujuan ini adalah untuk meningkatkan kerja sama dalar . kerangka kerja Persetujuan, sesuai dengan perundang-undangan masing-masing Negara dan hukum internasional yang berlaku.
PASAL 2 Hukum yang Berlaku
Kerja sama berdasarkan Persetujuan ini wajib dilakukan sesuai dengan perundang-undangan Negara-negara Para

prinsip-prinsip dan norma-norma hukum internasional yang diakui secara umum tanpa mengurangi pemenuhan Para Pihak terhadap kewajiban dan hak-hak mereka dalam perjanjian-perjanjian internasional di mana mereka berperan serta.
PASAL 3 Otoritas Berwenang

Dalam hal salah satu Pihak menunjuk Otoritas Berwenang lainnya, Pihak tersebut wajib dengan segera memberitahukan secara tertulis melalui saluran diplomatik mengenai penunjukan dimaksud.

Sesuai dengan
masing-masing
perundang-undangan
nasional
Negara mereka, Para Pihak atau Badan-badan Berwenang selanjutnya dapat menunjuk kementerian-kementerian/badan-badan atau organisasi-organisasi baik publik maupun swasta, untuk melaksanakan kegiatan-kegiatan khusus dalam kerangka
kerja
Persetujuan
ini
(selanjutnya disebut sebagai
Organisasi
Pelaksana).
3.
Untuk maksud-maksud Persetujuan ini, istilah "Para Peserta
Kegiatan Bersama" adalah Otoritas-otoritas Berwenang, Organisasi Pelaksana dan badan-badan hukum lainnya, baik publik maupun swasta, yang terlibat dalam kegiatan-kegiatan bersama dalam kerangka kerja Persetujuan ini.
4.
Para Peserta Kegiatan
Bersama wajib
mematuhi
peraturan-
peraturan internal yang dibuat oleh Para Pihak dalam pelaksanaan Persetujuan ini.
PASAL 4 Bidang Kerja Sama
1.
Kerja sama dalam kerangka kerja Persetujuan ini dapat dilakukan
dalam bidang-bidang berikut: a)
ilmu
antariksa
dasar,
meteorologi
antariksa,
geofisik:l
antariksa, astronomi dan astrofisika, material dan konstruksi antariksa, bioteknologi, ionosfer, dan plasma antariksa; b)
penelitian dan peralatan pendukung antariksa;
c)
sistem-sistem transportasi antariksa;
d)
pengembangan dan fabrikasi satelit untuk tujuan sains dan komersial;
e)
pengembangan sistem-sistem penginderaan jauh;
f)
telekomunikasi antariksa;
g)
kegiatan penelitian dan pengembangan bersama, konstruksi, produksi,
peluncuran,
pengoperasian
dan
pemanfaatan
wahana peluncuran, satelit dan sistem antariksa lain;

h)
infrastruktur ruas bumi sistem antariksa, termasuk pusatpusat peluncuran;
i)
perancangan, pengujian, fabrikasi, dan penyediaan berbagai komponen wahana luncur, satelit dan infrastruktur ruas bumi.
2.
Bidang-bidang kerja sama tambahan wajib ditentukan dengan
kesepakatan bersama antara Para Pihak.
PASAL 5
Bentuk-bentuk Kerja Sama
1.
Kerja sama dalam kerangka kerja Persetujuan ini dapat dilakukan
dalam bentuk-bentuk sebagai berikut: a)
perencanaan
dan
pelaksanaan
proyek-proyek
antariksa
bersama; b)
program-program
pelatihan
personil
dan
bantuan
bagi
keikutsertaan staf di bidang sains, rekayasa dan teknis pada proyek-proyek bersama; c)
pertukaran ilmuwan dan teknisi;
d)
pertukaran peralatan, dokumentasi, data, hasil percobaan dan informasi sains dan teknologi;
e)
pengembangan dan pelaksanaan bersama program-program industri dan perdagangan;
f)
pengembangan dan pemanfaatan bersama peluncur-peluncur dan sistem-sistem antariksa lainnya;
g)
pengorganisasian simposium dan acara sains bersama lainnya.
2.
Setiap bentuk kerja sama tambahan lainnya wajib ditentukr. !
dengan kesepakatan bersama antara Para Pihak.

PASAL 6
Pengaturan Pelaksanaan dan Perjanjian Program Bersama

membuat
perjanjian-
perjanjian/pengaturan-pengaturan pelaksanaan terpisah.
2.
Otoritas-otoritas
Berwenang
dapat,
sesuai
dengan
prosedur-
prosedur yang dibentuk oleh masing-masing perundang-undangan nasional Negara Para Pihak, menyepakati program-program bersama tertentu, yang akan menentukan prinsip-prinsip, aturan-aturan dan prosedur-prosedur terkait dengan pengorganisasian, pelaksanaan dan, apabila perlu, dukungan pendanaan untuk program-program tersebut.

PASAL 7
Kelompok Kerja
Untuk maksud-maksud pencapaian tujuan-tujuan dari Persetujuan

Otoritas-otoritas Berwenang dapat, apabila dipertimbangkan perlu dan dengan kesepakatan bersama, membuat kelompok-kelompok kerja teknik bersama.
PASAL 8
Prinsip-prinsip Pendanaan
1.
Pendanaan program-program bersama yang dilakukan sesuai
dengan Persetujuan ini di bawah kebijakan pemerintahan di bidang antariksa wajib disediakan oleh
Para Pihak sesuai dengan peruntukan anggaran
tergantung pada ketersediaan dana dalam anggaran riegara dari Negara Para Pihak. 5
2.
Pendanaan program-program bersama yang melebihi peruntukan
anggaran dan/atau program-program pemerintah wajib menjadi tanggung jawab Otoritas-otoritas Berwenang dan/atau organisasi-organisasi yang berpartisipasi yang terlibat dalam kegiatan-kegiatan tersebut, wajib diatur dalam perjanjianperjanjian terpisah.
3.
Kedua Pihak, kecuali dipersyaratkan sebaliknya oleh
perundan~;-
undangan nasional Negara Para Pihak, tidak akan bertanggung jawab untuk kewajiban-kewajiban pendanaan yang timbul dari perjanjian-perjanjian terpisah antara Otoritas-otoritas Berwenang atau organisasi-organisasi yang berpartisipasi dalam kerangka kerja Persetujuan ini.
PASAL 9 Kekayaan lntelektual
Kecuali disepakati sebaliknya oleh Otoritas-otoritas Berwenang dalam pengaturan-pengaturan pelaksanaan yang terkait dengan program-program bersama, perlakuan terhadap obyek-obyek kekayaan intelektual yang tercipta atau dihasilkan dalam pelaksanaan kegiatan-kegiatan bersama yang dilakukan berdasark.an Persetujuan ini wajib sesuai dengan Lampiran pada Persetujuan ini, yang wajib merupakan suatu bagian yang tidak terpisahkan dari Persetujuan ini.
PASAL10 Pertukaran lnformasi
1.
Dengan mematuhi ketentuan-ketentuan mengenai kerahasiaan
sebagaimana tercantum· dalam Lampiran, Otoritas-otoritas Berwenang wajib menyediakan akses timbal balik dalam jangka waktu yang layak, terhadap hasil penelitian ilmiah dan pekerjaan yang dilakukan secara bersama dalam kerangka kerja Persetujuan ini. Untuk maksud tersebut, mereka wajib mendorona pertukaran informasi ilmiah dan teknis dan data yang terkait, yang tidak dapat dialihkan kepada pihak ketiga tanpa kesepakatan bersama terlebih dahulu.

2.
Otoritas-otoritas
Berwenang,
sesuai
dengan
hukum
nasional
mereka mengenai akses informasi terbatas, wajib memfasilitasi pertukaran informasi timbal balik mengenai arahan-arahan dasar dari program-program antariksa mereka masing-masing.
PASAL11 ProsedurKepabeanan
Berdasarkan
perundang-undangan
nasional
masing-masing
Negara
mereka, masing-masing Pihak wajib melakukan kegiatan secara timbal balik untuk memfasilitasi importasi peralatan untuk program-program bersama yang akan dilaksanakan berdasarkan Persetujuan ini.
PASAL12 Pertukaran Personil
Masing-masing Pihak wajib, sesuai dengan perundang-undangan nasional Negara
mereka
masing-masing
berkenaan
dengan
pertukaran
personil,
mengambil langkah-langkah yang diperlukan untuk memfasilitasi pemeriksaan pada izin masuk, tinggal, dan keluar bagi warga negara Pihak lainnya yang memasuki, tinggal, dan keluar dalam wilayah suatu Negara dalam rangka melakukan program-program bersama yang dibentuk berdasarkan Persetujuan ini.
PASAL13 Pertanggungjawaban
1.
Para Pihak wajib membuat pengaturan-pengaturan pelaksanaan
terpisah mengenai pertanggungjawaban untuk masing-masing kerugian dan kerusakan yang disebabkan olehnya dan/atau Otoritas-otoritas Berwenang mereka. Pengaturan-pengaturan pelaksanaan tersebut wajib berlaku untuk setiaf..i program bersama.

2.
Para Pihak sepakat untuk saling melepaskan tanggung jawab
antara Para Pihak, Otoritas-otoritas Berwenang dan organisasi-organisasi yang berpartisipasi untuk meningkatkan keikutsertaan mereka dalam program-program bersama mengenai eksplorasi dan penggunaan antariksa;
Para Pihak sepakat untuk saling melepaskan tanggung jawab, di mana masing-masing Pihak melepaskan semua tuntutan terhadap Otoritas-otoritas Berwenang mereka sendiri dan/atau organisasi-organisasi yang berpartisipasi, termasuk kontraktor-kontraktor dan sub-sub kontraktornya.
Prinsip-prinsip mengenai saling melepaskan tanggung jawab tersebut wajib
hanya
menyebabkan
berlaku
apabila
kerusakan
yang
orang,
badan
atau
kekayaan
terjadi
dalam
program-program
dimaksud bersama
berdasarkan Persetujuan ini, dan orang, badan atau kekayaan tersebut rusak karena penggunaannya dalam program-program bersama.
3.
Dalam hal tuntutan-tuntutan yang timbul berdasarkan Konvensi
tentang Tanggung Jawab lnternasional Terhadap Kerugian yang Disebabkan Oleh Benda-benda Antariksa, 29 Maret 1972, Para Pihak wajib dengan segera berkonsultasi mengenai pemberlakuan pasal-pasal yang relevan dengan Konvensi terse but.
PASAL14 Penyelesaian Sengketa
Setiap sengketa mengenai penafsiran dan pelaksanaan dari Persetujuan ini wajib diselesaikan dengan cara negosiasi langsung antara Para Pihak atau dengan cara-cara lainnya yang disepakati oleh Para Pihak dan diakui oleh Hukum lnternasional.

PASAL15 Perubahan
Persetujuan ini dapat diubah dengan pengaturan bersama antara Para Pihak dalam bentuk protokol-protokol yang wajib merupakan
bagian yang tidak
terpisahkan daripadanya.
PASAL16 Ketentuan Akhir
1.
Persetujuan ini wajib mula! berlaku pada tanggal pemberitahuan
terakhir mengenai pemenuhan oleh Para Pihak mengenai prosedur hukum internal mereka, yang diperlukan untuk pemberlakuannya, dan wajib berlaku sementara apabila tidak bertentangan dengan perundang-undangan Negara Para Pihak sejak tanggal penandatanganan, kecuali salah satu pihak
menyataka ~ l
keinginannya untuk terikat dengan Persetujuan ini.
2.
Persetujuan ini akan tetap berlaku untuk jangka waktu 10 (sepuluh)
tahun dan wajib secara otomatis diperpanjang untuk jangka waktu 10 (sepuluh) tahun berikutnya. Persetujuan ini dapat diakhiri oleh salaf-t satu Pihak melalui Nata Diplomatik. Pengakhiran tersebut wajib mulai berlaku 6 (enam) bulan berikutnya setelah tanggal pemberitahuan.
3.
Dalam hal pengakhiran Persetujuan ini, ketentuan-ketentuannya
wajib terus berlaku terhadap seluruh program dan proyek yang belum selesai kecuali Para Pihak menyepakati sebaliknya. Pengakhiran Persetujuan ini wajib tidak berlaku sebagai dasar untuk revisi atau pengakhiran kewajiban keuangan atau yang bersifat kontraktual yang masih berlaku, dan wajib tidak mempengaruhi hak dan kewajiban dari badan-badan hukum dan orang-perseorangan yang telah timbul sebelum pengakhiran Persetujuan ini.

LAMPI RAN Kekayaan lntelektual
Untuk maksud-maksud Persetujuan ini, istilah "kekayaan intelektual" akan memiliki arti sebagaimana tercantum dalam Pasal 2 Konvensi Pembentukat1 Organisasi Kekayaan lntelektual Dunia, yang ditandatangani di Stockholm tanggal 14 Juli 1967. Untuk maksud-maksud Lampiran ini, istilah "Organisasi-organisasi Kerja Sama" wajib berarti Otoritas-otoritas Berwenang dan Organisasi Pelaksana lainnya.
Para Pihak melaksanakan kewajibannya sesuai dengan perundanQundangan nasional mereka masing-masing untuk memastikan perlindungan yang efektif terhadap kekayaan intelektual yang diperoleh dalam kerangka kerja proyek-proyek kerja sama yang dilakukan berdasarkan Persetujuan ini.
Organisasi-organisasi Kerja Sama wajib memberitahukan satu sama lain dengan tepat waktu mengenai obyek-obyek hak kekayaan intelektual yang diperoleh dalam kerangka kerja Persetujuan ini, dan wajib mengambil tindakan untuk mendapatkan hak-hak atas obyek-obyek kekayaan intelektual dimaksuu sesegera mungkin.
I. Lingkup
A.
Lampiran ini berlaku untuk seluruh bentuk kegiatan kerja sama yang
dilakukan dalam kerangka kerja Persetujuan ini, kecuali disepakati sebaliknya secara tertulis oleh Para Pihak.
B.
Lampiran
ini
wajib
mengatur
peruntukan,
kepemilikan,
dan
penggunaan hak-hak kekayaan intelektual bagi obyek-obyek yang dikembangkan dalam pelaksanaan kerja sama.
C.
Lampiran ini tidak akan mengubah hubungan antara Organisasi-
organisasi Kerja Sama. Lebih lanjut, Lampiran ini tidak akan mengurangi kewajiban-kewajiban internasional dari Para Pihak. D.
Seluruh hak kekayaan intelektual yang diperoleh sebelumnya atau
merupakan hasil dari penelitian mandiri wajib tidak dapat diubah berdasarkan syarat-syarat dari Lampiran ini.
II. Prinsip-Prinsip
Dengan mempertimbangkan peruntukan, kepemilikan , dan penggunaan hak-hak kekayaan intelektual, Para Pihak dan Organisasi Pelaksana harus menerapkan prinsip-prinsip dasar berikut:
A.
prinsip perlindungan yang memadai terhadap hasil-hasil kegiatan
intelektual yang diperoleh dan/atau digunakan dalam kerangka kerja Persetujuan ini; B.
prinsip pertimbangan atas kontribusi yang diberikan oleh Para Pihak
dan organisasi pelaksana dalam peruntukan hak-hak atas dan kepentingarikepentingan mereka dalam kekayaan intelektual yang diciptakan bersama; C.
prinsip penggunaan yang efisien atas kekayaan intelektual;
D.
prinsip perlakuan non-diskriminasi bagi para peserta dalam kegiatan
bersama;
E.
prinsip perlindungan terhadap inforn'lasi bisnis terbatas;
F.
prinsip pengalihan dan penggunaan obyek-obyek ha!< kekayaan
intelektual hanya setelah mereka diberikan perlindungan hukum di wilayah Negara di mana barang tersebut akan digunakan; G. tindakan
prinsip pelaksanaan wajib oleh Para Pihak terhadap tindakanyang
ditujukan
untuk
mencegah ,

prinsip saling melepaskan oleh salah satu Pihak terhadap setiap
tuntutan yang diajukan oleh Pihak ketiga terhadap pelanggaran yang dilakukan mengenai kepemilikan dan legitimasi penggunaan oleh Pihak lain atau pesertapesertanya dalam kegiatan bersama terhadap hak-hak kekayaan intelektual dalam kerangka kerja Persetujuan ini.
Ill. Distribusi Hak
A.
Kecuali disepakati sebaliknya oleh Para Pihak dan Badan-badan
Pelaksana mereka dalam Pengaturan-pengaturan Pelaksanaan dan Persetujuanpersetujuan Program Bersama, hak-hak kekayaan intelektual akan dialokasikan dengan mempertimbangkan kontribusi ekonomi, ilmiah dan teknologi dari tiap Pihak dalam
menciptakan
kekayaan
intelektual tersebut sesuai
dengr n
perundang-undangan Nasional Negara masing-masing.
B.
Publikasi-publikasi
dilindungi
sebagai
obyek-obyek
hak-hak
kekayaan intelektual. Obyek-obyek tersebut digunakan berdasarkan perjanjian- · perjanjian mengenai kepemilikan hak-hak kekayaan intelektual yang terkait dengan terjemahan, reproduksi dan distribusi publik artikel jurnal ilmiah dan teknis, laporan-laporan dan buku-buku yang dihasilkan secara langsung dari kerja sama yang dilakukan berdasarkan Persetujuan ini. Semua salinan distribu~: secara publik wajib memuat nama pengarang, kecuali pengarang meminta untuk tidak disebutkan namanya dalam kaitannya dengan pekerjaan tersebut. C.
Hak-hak untuk segala bentuk kekayaan intelektual, selain dari hak-
hak sebagaimana dijelaskan dalam bagian Ill. B. di atas, akan didistribusikan sebagai berikut:
1.
Setiap hak-hak kekayaan intelektual yang mungkin dihasilkan dari
kegiatan-kegiatan individu berdasarkan syarat-syarat dari Persetujuan ini wajib diberikan hak serta masing-masing royalti wajib dibayarkan, baik oleh
lembaga-lembaga
penyelesaian
mereka
atau
perjanjian-perjanjian
oleh
mereka
mengenai
sendiri,
kepemilikan
dari
hak-hak
kekayaan intelektual yang terkait penggunaan obyek-obyek hak-hak kekayaan intelektual, sesuai dengan hukum dan peraturan masing-masing Negara Pihak.
2.
Hak-hak untuk obyek-obyek kekayaan intelektual yang tercipta
dalam pelaksanaan kerja sama yang dapat diperoleh di negara-negara ketiga dan keuntungan yang diterima dari penggunaan obyek-obyek ini akan ditentukan dalam pengaturan-pengaturan pelaksanaan spefisik atau perjanjian-perjanjian kerja sama yang diselesaikan sesuai dengan Pasal 6 Persetujuan ini.
3.
Apabila suatu penelitian atau kegiatan tidak ditetapkan sebagai
"penelitian
bersama"
atau
"kegiatan
pengaturan Pelaksanaan atau
bersama"
dalam
Pengaturan-
Program-program Kerja Sarna yang
relevan yang diselesaikan sesuai dengan Pasal 6 Persetujuan ini, hak-hak kekayaan intelektual yang timbul dari penelitian atau kegiatan dimaksud akan didasarkan

perjanjian-perjanjian yang akan dirundingkan antara
Para Pihak atau Organisasi-organisasi Kerja Sama mereka.
4.
Dalam hal bahwa suatu proyek penelitian bersama berdasarkan
Persetujuan ini akan mengarah pada penciptaan atau pemberian suatu jenis kekayaan intelektual yang tidak dilindungi dari hukum yang berlaku dari salah satu Pihak, Para Pihak wajib dengan segera mengadakan diskusi dengan maksud untuk menghasilkan suatu jalan keluar yang dapat diterima bersama.

IV. Piranti Lunak A.
Hak-hak
kekayaan
intelektual
untuk
piranti
lunak
yang
dikembangkan secara bersama dan/atau didanai secara bersama dalam kerangka kerja dari kegiatan-kegiatan
kerja sama wajib didistribusikan antara
Organisasi-organisasi Kerja Sama, dengan memperhatikan kontribusi mereka masing-masing untuk pengembangan dan pendanaannya. B.
Peruntukan remunerasi yang dihasilkan dari penggunaan komersial
piranti lunak yang dikembangkan secara bersama dan/atau didanai secara bersama dapat juga ditentukan melalui perjanjian-perjanjian atau kontrak- kontrak terpisah.
V. lnformasi Terbatas
A.
lstilah "informasi terbatas" wajib merujuk pada setiap data teknis
atau informasi keuangan, tidak tergantung pada bentuk dan medianya, yang dialihkan untuk maksud-maksud pelaksanaan kegiatan-kegiatan dalam kerangka kerja Persetujuan ini dan sesuai dengan ketentuan-ketentuan sebagai berikut:
1.
kepemilikan atas informasi ini dapat memastikan keuntungan,
terutama yang
bersifat ekonomis, ilmiah
dan teknis, yang
dapat
menggambarkan keuntungan dalam persaingan dengan orang yang
tida~
memilikinya; 2.

Para Pihak dan Organisasi-organisasi Kerja Sama diwajibkan unh I<
mengambil seluruh langkah-langkah yang dibutuhkan yang terkait dengan para pegawainya, pelaksana dari pekerjaan dan sub-sub kontraktor untuk pemenuhan kewajiban-kewajiban
mengenai perlindungan kerahasiaan sebagaimana telah
ditentukan di atas.
VI. Pihak Ketiga
Distribusi hak-hak kekayaan intelektual sebagai hasil dari penelitii h bersama
pada
pihak-pihak
ketiga
wajib
didasarkan
pada
kesepakatan
pendahuluan tertulis antara Para Pihak atau Organisasi-organisasi Kerja Samanya masing-masing.
VII. Penyelesaian Sengketa
Sengketa-sengketa berkenaan dengan kekayaan intelektual yang timbul berdasarkan Persetujuan ini wajib diselesaikan melalui diskusi damai antara Organisasi-organisasi Kerja Sama atau, apabila dianggap perlu antara Para Pihak. Apabila sengketa tersebut tidak dapat diselesaikan dalam jangka waktu 6 (enam) bulan setelah permintaan diskusi dimaksud dan ketiadaan kesepakatan 6
bersama berkenaan dengan metode-metode lain dari penyelesaian sengketa dimaksud, sengketa tersebut atas permintaan salah satu Pihak wajib dimintakan keputusan final dari Majelis Arbitrator, salah satu arbitrator akan ditunjuk oleh Pihak tersebut yang akan mengusulkan prosedur arbitrase, salah satu arbitrator akan ditunjuk oleh Pihak lainnya dan arbitrator ketiga yang wajib menjadi Ketua, akan dipilih bersama oleh kedua arbitrator sebelumnya; apabila salah satu Pihak gagal menunjuk seorang arbitrator dalam jangka waktu 60 (enam puluh) hari sejak penunjukan oleh Pihak lain, atau apabila para arbitrator tersebut gagai menyepakati arbitrator ketiga dalam jangka waktu 60 (enam puluh) hari sejak penunjukannya, Presiden Mahkamah lnternasional dapat membuat penunjukan yang diperlukan atas permintaan Pihak lainnya. Keputusan Majelis Arbitrator bersifat final dan mengikat. Masing-masing Pihak menanggung pengeluaran arbitrator dan pengacaranya selama proses di pengadilan. Pengeluaranpengeluaran beracara oleh Ketua arbitrator dan pengeluaran-pengeluaran lainnya ditanggung oleh kedua Pihak secara seimbang.
VIII. Pengakhiran atau Habisnya Masa Berlaku dari Persetujuan lni
Pengakhiran atau habisnya masa berlaku dari Persetujuan ini tidal< akan mempengaruhi hak dan kewajiban yang sebelumnya diper.oleh dalam kerangka kerja Lampiran ini.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE CABINET OF MINISTERS OF UKRAINE ON COOPERATION IN THE EXPLORATION AND PEACEFUL USES OF OUTER SPACE
The Government of the Republic of Indonesia and the Cabinet of Ministers of Ukraine (hereinafter referred to as the Parties), Desiring to strengthen the traditional relations of friendship and cooperation between the two countries; Taking into consideration the mutual interest in enhancing the peaceful uses of outer space; Seeking to preserve outer space exclusively for peaceful purposes open to wide international cooperation; Considering the terms of the Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies, of January 27th 1967, and of other Multilateral Treaties and Agreements on the exploration and use of outer space to which both States are parties; Desiring to establish effective forms of bilateral cooperation in the field of space activities that would promote social, economic and cultural development for the benefit of the peoples of their countries; Aiming to encourage commercial and industrial cooperation between the private sectors of both countries in the field of outer space; Pursuant to the respective national legislations of both Countries. Have agreed as follows:
ARTICLE 1
Objective
The objective of this Agreement is to promote cooperation within the framework of the Agreement. in accordance with the legislation in force in each State and applicable international law.
ARTICLE 2
Applicable Law
Cooperation pursuant to this Agreement shall be carried out in accordance with the legislation of the States of the Parties, subject to observance of generally recognized principles and norms of international law without prejudice to the fulfillment by the Parties of their obligations and the exercise of their rights under other international agreements in which they participate.
ARTICLE 3
Competent Authorities
1.
The Competent Authorities responsible for the development and
coordination of cooperation in implementation of this Agreement shall be:
for the Indonesian Party
the National Institute of Aeronautics and Space (LAPAN).
for the Ukrainian Party
the National Space Agency of Ukraine (NSAU),
In case of appointment by either Party of any other Competent Authorities, such a Party shall without delay notify the other Party in writing via diplomatic channels of such an appointment.
2. Parties
In accordance with respective national legislations of their States, the or

Competent
Agencies
may
designate,
accordingly,
other
ministries/agencies or organizations, both public and private, to carry out

specialized types of activities within the framework of this Agreement (hereinafter referred to as Designated Organizations).
3.
For the purposes of this Agreement, the term "Joint Activity
Participants" shall mean Competent Authorities, Designated Organizations and other legal entities, both public and private, involved in joint activities within the framework of this Agreement. 4.
Joint Activity Participants shall observe the internal regulations
established by the Parties in implementation of this Agreement.
ARTICLE 4
Areas of Cooperation
1.
Cooperation within the framework of the present Agreement may be
carried out in the following areas: a)
basic space science, space meteorology, space geophysics, astronomy
and
astrophysics,
space
materials
and
constructions, biotechnology, ionosphere and space plasma; b)
research and support space equipment;
c)
space transportation systems;
d)
satellite development and manufacturing for scientific and commercial purposes;
e)
development of remote sensing systems;
f)
space telecommunications;
g)
joint research
and development activities, construction,
production, launching, operation and utilization of launch vehicles, satellites and other space systems; h)
space system ground infrastructure, including launch centers;
i)
design, testing,
manufacturing, and
supply
of various
components for launch vehicles, satellites and ground infrastructure.

2.
Additional areas of cooperation shall be determined by mutual
agreement between the Parties. ARTICLE 5
Forms of Cooperation 1.
Cooperation within the framework of the present Agreement may be
carried out in the following forms: a)
planning and implementation of joint space projects;
b)
personnel
train ing
programs
and
assistance
to
the
participation of scientific and engineering and technical staff in joint projects; c)
exchange of scientists and technicians;
d)
exchange of equipment, documentation, data, results of experiments and scientific and technological information;
e)
joint development and implementation of industrial and commercial programs;
f)
joint development and utilization of launchers and other space systems;
g) 2.
organization of symposia and other joint scientific events.
Any other additional form of cooperation shall be determined by
mutual agreement between the Parties. ARTI CLE 6
Implementing Arrangements and Joint Program Agreements 1. present
For implementation of specific programs or projects under the Agreement,
the
Parties
may
conclude
separate
implementing
agreements/arrangements. 2.
The Competent Authorities may, subject to procedures established
by respective national legislation of the Parties' States, agree on specific joint

programs, which will determine the principles, rules and procedures related to the organization, implementation and, if necessary, financial support to such programs. 3.
Upon mutual agreement, the Implementing Agencies may enlist the
participation of governmental and private institutions, firms and natural persons from third countries in the joint programs carried out within the framework of the present Agreement.
ARTICLE 7
Working Groups For the purposes of achieving the objectives of the present Agreement, the Competent Authorities may, if considered necessary and by mutual agreement, establish joint technical working groups.
ARTICLE 8
Principles of Financing 1.
Financing of joint programs carried out pursuant to this Agreement
within the governmental space policy shall be provided by the Parties according to the budget allocations subject to availability of funds in the state budgets of the Parties' States.
2.
Financing of the joint programs beyond budget allocations and/or
government programs shall be within the scope of responsibility of the Competent Authorities and/or participating organizations engaged in such activities, which shall be stipulated in separate agreements.

3.
Both Parties, unless otherwise required by respective national
legislations of the Parties' States, shall not be responsible for financial obligations arising out of separate agreements between the Competent Authorities or participating organizations within the framework of this Agreement.
ARTICLE 9
Intellectual Property Unless otherwise agreed by the Competent Authorities in the implementing arrangements relating to the joint programs, the treatment of intellectual property objects created or furnished in the course of joint activities carried out under this Agreement shall be in accordance with the Annex to the present Agreement, which shall be an integral part of this Agreement.
ARTICLE 10
Exchange of Information 1.
Observing the conditions of confidentiality envisaged in the Annex,
the Competent Authorities shall provide access, on a mutual basis and within a reasonable time, to the results of scientific research and work jointly carried out within the framework of this Agreement. To that end, they shall encourage the exchange of corresponding scientific and technical information and data, which cannot be transferred to third parties without prior mutual consent. 2.
The
Competent Authorities, according
to
their national
law
concerning the information of limited access, shall facilitate the mutual exchange of information concerning the basic directions of their respective national space programs.

ARTICLE 11
Customs Procedures Subject to its respective national legislation of their States, each Party shall reciprocally carry out activities to facilitate equipment importation for the joint programs to be undertaken under this Agreement.
ARTICLE 12
Exchange of Personnel Each Party shall, in accordance with its respective national legislation of their States regarding the exchange of personnel, take necessary measures to facilitate the clearance of entry, stay and exit for the other Party's nationals who enter, stay and exit within territory of a State in order to carry out activities under the joint programs established under this Agreement. ARTICLE 13
Liability
1.
The Parties shall conclude a separate implementing arrangement of
liability for the respective losses and damages imposed by them and/or their Competent Authorities. Such implementing arrangement shall apply to every joint program; 2.
The Parties agree to establish a cross-waiver of liability between the
Parties, Competent Authorities and participating organizations in order to promote their participation in the joint programs on the exploration and use of outer space; The Parties agree with the cross-waiver of liability according to which each Party waives all claims against their own Competent Authorities and/or participating organizations, including its contractors and subcontractors.

Principles of the cross-waiver of liability shall apply only if the person, entity or property causing the damage is involved in the joint programs under this Agreement and the person, entity or property damaged is damaged by virtue of its involvement in the joint programs.
3. In the event of claims arising out of the Convention on International Liability for Damage Caused by Space Objects, of March 291h 1972, the Parties shall consult promptly on the application of the relevant articles of the mentioned Convention.
ARTICLE 14 Settlement of Disputes
Any disputes concerning interpretation and implementation of the present Agreement shall be settled by means of direct negotiations between the Parties or by any other means agreed upon by the Parties and recognized by International Law.
ARTICLE 15 Amendments
This Agreement may be amended by mutual arrangement between the Parties in the form of protocols which shall become an integral part thereof.
ARTICLE 16 Final Provisions
1.
The present Agreement shall enter into force on the date of the last
notification on the fulfillment by the Parties of their legal internal procedures necessary for its entry into force, and shall be temporarily in force where it does not contradict the legislation of the Parties' States from the date of its signature, unless either party express its intention to be bound by the Agreement.

2.
The present Agreement will remain in force for a period of ten (10)
years and shall be automatically extended for subsequent ten (10) year periods. This Agreement may be terminated by either Party through a diplomatic Note. The denunciation shall take effect six (6) months following the date of the notification.
3.
In the event of the termination of the present Agreement, its
provisions shall continue to apply to all unfinished programs and projects unless the Parties agree otherwise. The termination of the present Agreement shall not serve as the basis for the revision or termination of obligations of financial or contractual nature still in force, and shall not affect the rights and obligations of legal entities and natural persons which have arisen before the termination of the present Agreement.

For the purposes of the present Agreement, the term "intellectual property" will have the meaning found in Article 2 of the Convention establishing the World Intellectual Property Organization, signed in Stockholm on 14 July 1967. For the Organizations"

The Parties take the obligation in accordance with their respective national legislations to ensure an effective protection of intellectual property obtained within the framework of cooperative projects carried out under this Agreement. The Cooperating Organizations shall inform one another in a timely manner of any intellectual property right objects obtained in the framework of this Agreement, and shall take actions to receive rights for such intellectual property objects as soon as possible. I. Scope A
The present Annex applies to all forms of cooperative activity
performed within the framework of this Agreement, except as otherwise agreed in the written form by the Parties. B.
The present Annex shall regulate the allocation, ownership and
exercise of intellectual property rights for objects developed in the course of cooperation. C.
The present Annex does not alter the relations between Cooperating
Organizations. Furthermore, it will not prejudice the international obligations of the Parties. D.
All intellectual property rights acquired earlier or being the result of
independent research shall not be altered by the terms of the present Annex.
II. Principles
With regard to allocation. ownership and exercise of intellectual property rights, the Parties and Designated Organizations shall apply the following basic principles: A.
the principle of adequate protection of the results of intellectual
activities obtained and/or used within the framework of the Agreement;
B.
the principle of due consideration of corresponding contributions by
the Parties and designated organizations in the allocation of their rights to and interests in jointly created intellectual property;
C.
the principle of efficient use of intellectual property;
0.
the principle of non-discriminatory treatment of participants in the joint
activity; E.
the principle of protection of business confidential information;
F.
the principle of transfer and use of intellectual property right objects
only after they are provided with legal protection in the territory of the State where they shall be used;
G.
the principle of mandatory implementation by the Parties of measures
aimed at preventing, identifying, investigating, restraining and suppressing infringements of the intellectual property rights; H.
the principle of restraining from infringing the legitimate rights of third
parties to intellectual property obtained and/or used within the framework of the Agreement; I.
the principle of waiving by either Party on a mutual basis
consideration of any claim presented by a third party with respect to alleged

infringements of ownership of and legitimacy of the use by the other Party or its participants in the joint activity of intellectual property rights within the framework of Agreement.
Ill. Distribution of Rights A.
Unless otherwise agreed by the Parties and their Implementing
Agencies in Implementing Arrangements and Joint Program Agreements, the intellectual property rights will be allocated with due regard to the economic, scientific and technological contributions of each Party into the creation of this intellectual property in accordance with respective national legislations of the States. B.
Publications are protected as intellectual property rights objects. Such
objects are used subject to agreements for intellectual property rights ownership related , namely, to translation, reproduction and public distribution of scientific and technical journal articles, reports and books directly arising from cooperation carried out under this Agreement. All such publicly distributed copies should contain the author's name unless he/she requires not mentioning it in relation to the work. C.
Rights to all forms of intellectual property, other than those rights
described in section Ill. B. above, will be distributed as follows: 1.
Any intellectual property rights that may result from the activities of
individuals under the terms of this Agreement shall be entitled, as well as the respective royalties shall be earned, either by their institutions or themselves, from concluding agreements on intellectual property rights ownership related to use of intellectual property rights objects, according to the laws and regulations of each Party's State. 2.
Rights for intellectual property objects created in the course of
cooperation that can be obtained in the third states and profits received from use of these objects will be defined in specific implementing arrangements or

cooperative agreements concluded in accordance to the Article 6 of the Agreement.
3.
If a research or activity is not designated as "joint research" or "joint
activity" in the relevant Implementing Arrangements or Cooperative Programs concluded pursuant to Article 6 of this Agreement, rights to intellectual property arising from such research or activity will be the subject of agreements to be negotiated between the Parties or their cooperative organizations.
4.
In the event that a joint research project under this Agreement will
lead to creation or grant of intellectual property of a type not protected by the applicable laws of one of the Parties, the Parties shall immediately hold discussions with a view to arriving at a mutually acceptable solution. IV. Software
A.
The intellectual property rights to software jointly developed and/or
jointly financed within the framework of cooperative activities shall be distributed between the Cooperating Organizations, taking into account their respective contribution to its elaboration and financing. B.
The allocation of remuneration generated by the commercial use of
the software jointly developed and/or jointly financed can also be determined by separate agreements or contracts.
V. Confidential Information
A.
The term "confidential information" shall refer to any technical data or
financial information, independent of the form and media, transferred for the purposes of carrying out activities within the framework of the present Agreement and meeting the following conditions: 1.
possession of this information may ensure gains, in particular of an
economic, scientific or technical nature, which may represent an advantage in competition with persons not possessing it;

2.
this information is not generally known or publicly available from other
sources;
3.
this information was not earlier passed on by its possessor to a third
person without the previous obligation to maintain its confidentiality; 4.
this information is not already at the receiver's disposal without the
previous obligation to maintain its confidentiality; B.
Confidential information shall be designated as such in an appropriate
manner. The responsibility for such a designation shall rest upon the Party or Cooperating Organization which demands such confidentiality. Each Party or Cooperating Organization shall protect such information in correspondence with applicable laws and regulations of its State. C.
Confidential information may be passed on by the Part.ies or
Cooperating Organizations to their own employees, whenever it is not otherwise envisaged in separate agreements or contracts. Information given in this way may be used only within the limits of the sphere of application of Implementing Arrangements and Cooperative Programs, which shall envisage the conditions and time limits of application of such provisions on confidentiality. D.
The Parties and Cooperating Organizations are obliged to take all
necessary measures in relation to their employees, basic performers of work and subcontractors for the observance of the obligations on safeguarding confidentiality determined above. VI. Third Parties The distribution of intellectual property rights as a result of joint research to third parties shall be the subject of a preliminary written agreement between the Parties or their respective Cooperating Organizations.

VII. Settlement of Disputes Disputes concerning intellectual property arising under this Agreement should be resolved through amicable discussions between the Cooperating Organizations or, if deemed necessary the Parties. If such a dispute cannot be resolved within a period of six months following the request for such discussions and in the absence of mutual agreement concerning other methods of dispute settling, it shall be referred at the request of either Party for final decision to a tribunal of arbitrators, one to be named by the Party which initiated the arbitration procedures, one to be named by the other Party and the third, who shall be the Chairman, to be chosen jointly by the first two; if either Party fails to appoint an arbitrator within 60 days of appointment by the other Party, or if these arbitrators should fail to agree on the third arbitrator within 60 days of their appointment, the President of the International Court of Justice may make any necessary appointments at the request of either Party. The decisions of the tribunal of arbitrators are final and binding. Each Party covers the expense of its arbitrator and its lawyer during the process in court. The expenses of the Chairman of the arbitration court and other expenses are covered by both Parties equally.
VIII. The termination or expiration of the present Agreement The termination or expiration of the present Agreement will not affect rights or obligations previously acquired within the framework of this Annex.
