Misdaad en straf in Japan Uit Encyclopedie
Inleiding Veel criminologen zien een onvermijdelijke link tussen misdaad en modernisering. Ondanks de status van Japan als een moderne, geïndustrialiseerde natie blijven de misdaadcijfers er echter overwegend stabiel (vb. moordcijfers (http://en.wikipedia.org/wiki/File:Homicide-world.png) ). Volgens Ruth Benedict [1] zijn deze lage misdaadcijfers het resultaat van wat zij beschrijft als de Japanse "schaamte- of schuldcultuur". Dit is het idee dat de traditionele nadruk die wordt gelegd op het feit dat het individu deel uitmaakt van een groep, mensen ervan weerhoudt om misdaden te plegen, om de groep niet ten schande te maken. Sinds beruchte incidenten zoals de saringas-aanval door Aum Shinrikyo of Nevada-tan is men zich in Japan meer in misdaad gaan interesseren. Ook de angstcultuur - gepromoot door de postmoderne, kapitalistische media heeft de interesse voor misdaad opgewekt. [2] In de bibliotheek stuitte ik al op een aantal bachelorpapers over dit onderwerp (= misdaad algemeen), waardoor ik het nodig vind om mijn uiteindelijke onderzoeksvraag wat verder af te bakenen. Voorlopig ga ik grasduinen in wat er te vinden is aan bronnen om zo te beslissen op welk aspect ik me precies wil focussen. Wat ik met deze oefening wil bereiken is dus een keuze maken tussen de verschillende aspecten van het brede gegeven "misdaad en straf in Japan" aan de hand van de kwantiteit/kwaliteit van de gevonden bronnen, met als doel het onderwerp van mijn bachelorpaper definitief te beslissen. Mogelijke aspecten die me interesseren: het gevangenissysteem, strafrecht, het politieorgaan en de doodstraf. De doodstraf in Japan Een enquête door de overheid in 2010 heeft aangetoond dat 85.6% van de Japanse bevolking voor de doodstraf is, terwijl 5.7% van mening is dat de doodstraf moet afgeschaft worden. Welke argumenten beïnvloeden de mening van deze meerderheid? Hoe meer ik lees over de doodstraf in Japan, hoe meer ik de indruk krijg dat het onderwerp met de grootste discretie wordt behandeld, en er weinig duidelijke informatie te vinden is over de executies. Opmerkelijk is wel dat de media in augustus 2010, op aandringen van voormalig minister van Justitie Keiko Chiba [3], een rondleiding kreeg in de executiekamers. Japanse gevangenissen Hoe is de situatie in Japanse gevangenissen? Wat zijn de rechten van gevangenen? Dit zijn maar enkele vragen waar ik graag het antwoord op zou vinden. Een vergelijking met het Belgische gevangenissysteem lijkt me ook interessant. Keisatsu (警察 警察) 警察 Hebben de lage misdaadcijfers iets te maken met de manier waarop de Japanse politie georganiseerd wordt? Naast centrale politiebureaus, zijn er de kōban (交番): kleinere politiebureautjes in elke buurt. Zorgen deze kōban voor meer misdaadpreventie? Verder valt het woord "corruptie" wel eens wanneer men spreekt over de Japanse politie. Wat zijn de feiten en hoe wordt dit probleem aangepakt? Japans strafrecht In welke opzichten verschilt het Japanse strafrecht van andere rechtsstelsels? Waarom is het veroordelingspercentage zo hoog (99%)? systeem) ingevoerd, wat betekent dat burgers kunnen participeren aan de rechtspraak (o.a. moordzaken). Ik zou eventueel willen onderzoeken in welke mate de invoering van Saiban-in het Japanse gerechtelijke systeem heeft beïnvloed. Wanneer ik enkel "criminaliteit" als trefwoord ingaf werd ik overspoeld door irrelevante bronnen. Door te specificeren met "Japan" als bijkomende zoekterm verkreeg ik meestal wel het gewenste resultaat. Het merendeel van de gevonden bronnen zijn Engels; door in het Nederlands te zoeken kwam ik eerder terecht bij informatie over georganiseerde misdaad in Japan.
Bronnen Als bibliografisch referentiesysteem heb ik "Chicago A" gekozen, omdat ik dit het meest overzichtelijke vond, en omdat ik dit referentiesysteem had ingesteld in Zotero. Bronnen per categorie zijn alfabetisch gesorteerd volgens auteur. Belangrijke en/of naar mijn mening zeer relevante bronnen hebben een paars kleurtje.
Bibliotheek Ik heb niet alleen in de Oost-Aziatische Bibliotheek gezocht, maar ook in de Centrale Bibliotheek en de bib Rechtsgeleerdheid. Verder heb ik de website van de Ugent bib en die van de VUB geprobeerd.

Amazon Omdat de naam "Elmer Johnson" een paar keer terugkomt bij het zoeken, heb ik de man eens gegoogled. Worldcat Met deze database heb ik niets relevants meer gevonden. Ik vond het ook vrij moeilijk om hier iets te vinden: ik had de indruk dat de resultaten die ik kreeg weinig of niets te maken hadden met de trefwoorden die ik had ingevoerd.

Het merendeel van de bronnen die ik via GeNii vond had ik al gevonden met de andere Japanse databanken, zoals CiNii en Webcat Plus, waar GeNii naar doorverwijst.
Besluit Ik heb zeker genoeg bronnen kunnen vinden in verband met alle onderwerpen die me interessant leken voor onderzoek in de vorm van een bachelorpaper. Mijn voorkeur voor een eventueel bachelorpaperonderwerp ging al van in het begin naar "de doodstraf in Japan". Hier is immers naar mijn weten nog niet zoveel onderzoek naar gedaan. Omdat ik had gezien dat de individuele oefening van een medestudent die ook rond dit onderwerp gezocht had niets opleverde, ben ik aangenaam verrast door het aantal bronnen dat ik heb gevonden. Het liefst zou ik verder onderzoek doen over de doodstraf, misschien in combinatie met de situatie in Japanse gevangenissen (o.a. de dodencellen), waarover ik ook aardig wat bronnen heb kunnen sprokkelen. Deze oefening heeft me dus in de eerste plaats geholpen om een beslissing te nemen over de inhoud van mijn bachelorpaper. De uiteindelijke onderzoeksvraag zal ik uiteraard nog meer moeten afbakenen. Op het einde van deze zoektocht merk ik dat ik er heel wat vaardigheden bij heb. Voor mijn eindwerk (6de middelbaar) was ik al eens een kijkje gaan nemen in verschillende bibliotheken van de K.U. Leuven, maar toen heb ik weinig boeken gevonden, omdat ik niet goed wist waar en hoe te zoeken. Nu loop ik niet meer doelloos rond tussen de rekken, maar raadpleeg ik eerst de online catalogus om te kijken of er boeken zijn die ik kan gebruiken. Voordien was het nooit in me opgekomen om japanologische tijdschriften te raadplegen (Shame on me.). Dankzij de rondleiding in de bib weet ik nu van hun bestaan af. Ik ben enigszins vertrouwd geraakt met veel databanken waar ik voor de lessen encyclopedie nog nooit van gehoord had. Ik heb ontdekt welke me het beste liggen, en hoe ik het best kan zoeken in elke database afzonderlijk (Advanced Search, welke trefwoorden, etc.). De Japanse databanken, die me eerst onoverkomelijk leken, zijn tegen mijn verwachtingen in erg gebruiksvriendelijk (met hulp van Rikaichan) en natuurlijk een meerwaarde voor ieder japanologisch onderzoek. Bij zoeken op het internet met zoekmachines als Google of Yahoo heb ik geleerd om kritisch te zijn bij het kiezen van mogelijke bronnen, aan de hand van de betrouwbaarheidscriteria die ik voor mezelf heb bepaald. Ik heb kennisgemaakt met tools, zoals Zotero, die ik niet meer zou willen missen.
