PERJANJIAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN ASIA PACIFIC TELECOMMUNITY MENGENAI HAK-HAK ISTIMEWA DAN KEKEBALAN

MERUJUK pada keperluan untuk membentuk sebuah perianJlan bilateral scbagai mana dimaksud dalam Pasal 12 Ay at 3 dari Konstitusi Asia Pacific Tclccommunity; MENGAKUI Keputusan Presiden Republik Indo nesia No mor 12 Tahun 1985 tcntang Ratifikasi Konstitusi Asia-Pacific Telecommunity; SESUAI dengan hukum clan peraturan yang berlaku di Republik Indonesia;

PASAL 1 DEI'INISI Yang dimaksu
2. Asia Pacific Telecommunity (APT) adalah organisasi telekomunikasi regional Asia P asi fic yang dibentuk sesuai dengan Pasal 32 dari Konven si Tclekomunikasi Intcrnasion al 1973; 3. H ukum clan peraturan Indonesia termasuk scmua hukum dan p eraturan legislatif, keputusan atau perintah yang dikeluarkan oleh atau di bawah wewenang Pemerintah atau lcmbaga Pemerintah yang berwenang;
4. Otoritas Pcmerintah adalah lembaga nasional atau lembaga lain di Indonesia yang berwcnang clan yang sesuai dengan hukum clan peraturan di Indonesia; 5. Pejabat adalah pejabat dari Sekretariat APT sebagaimana ditentukan dalam Pasal 10 Konstitusi APT; 6. Ahli adalah orang dengan keahlian khusus yang dipekerjakan oleh APT; 7. Direktur Eksekutif clan Wakil Direktur Eksekutif adalah Direktur Eksekutif clan Wakil Direktur Eksekutif dari APT yang dipilih olch Komite Manajemen APT sebagaimana diatur dalam Pasal 9 Konstitusi APT.
PASAL 2 HAK-HAK ISTIMEWA DAN KEKEBALAN 1. Pemerintah membcrikan hak-hak istimewa terhadap aset clan properti milik APT yang berada di Indonesia;
2. Direktur Eksekutif, Wakil Direktur Eksekutif, pejabat dan ahli APT selama perjalanan resminya ke Indonesia juga diberi hak-hak istimewa sesuai dengan hukum clan peraturan Indonesia; 3. Direktur Eksekutif, Wakil Direktur Eksekutif, pejabat clan ahli A PT menikmati kekebalan dari proses hukum dalam kaitannya dengan pernyataan yang diucapkan atau ditulis da1am melaksanakan tugas resminya; 4. Hak-hak istimewa clan kekebalan ini diberikan untuk keperluan memfasilitasi kerja APT di Indonesia dan tidak untuk keuntungan pribadi. Pasal-pasal dalam perjanjian ini tidak akan membebaskan siapapun dari pertanggungjawaban atas kcrusakan yang timbul karena tindakan kriminal, kelalaian atau kecurangan.
PASAL3 PEMBEBASAN PAJAK
1. Aset clan properti milik APT yang berada di Indonesia dibebaskan dari pajakpajak sesuai dengan hukum clan peraturan yang secara cfcktif bcrlaku dari waktu ke waktu; 2. Barang-barang yang cliimpor dcngan pembebasan pajak sebagaimana diatur dalam Pasal 3 ayat (1) di atas tidak dapat diperjualbelikan clan dialihkan kepada siapapun di Indonesia kecuali dengan syarat-syarat yang disctujui oleh Pemerintah. 2
PASAL4 PEMBATASAN AKTIFITAS APT harus memastikan bahwa pejabat, ahli, clan orang lain yang dipekerjakan oleh APT, selama keberadaannya di Indonesia, tidak akan terlibat dalam masalahmasalah politik dan kegiatan-kegiatan lain di luar cakupan tugasnya.
PA.SAL 5 PENYALAHGUNAAN H AK-HAK ISTIMEWA DAN KEKEBALAN 1. APT harus bekerjasama dengan Otoritas Pemerintah terkait untuk mencegah terjadinya penyalahgunaan hak-hak istimewa clan kekebalan yang diberikan dalam Perjanjian ini;
2. Apabila Pemerintah mempertimbangkan bahwa penyalahgunaan terhadap hakhak istimewa clan kekebalan yang diberikan berdasarkan Perjanjian ini telah terjadi, maka APT harus berkonsultasi clengan Otoritas Pemerintah.
PASAL 6 PERUBAHAN Perjanjian ini dapat diubah atau diperbaiki, atas permintaan tertulis clari salah satu Pihak, clengan kesepakatan bersama.
PASAL 7 PENYELESAIAN PERSENGKETAAN Setiap sengketa diantara para Pihak mengenai interpretasi clan/ atau implementasi dari Perjanjian ini akan diselesaikan secara clamai melalui konsultasi atau negosiasi.
PASAL 8 PEMBERLAKUAN 1. Perjanjian ini mulai berlaku pacla tanggal penandatanganan;

2. Perjanjian ini berlaku untuk masa waktu 3 (tiga) tahun, dan diperpanjang secara otomatis untuk setiap periode 2 (dua) tahunan;

3. Perjanjian ini dapat diakhiri oleh masing-masing Pihak dengan menyampaikan pernyataan tertulis setidak-tidaknya 6 (enam) bulan sebelumnya.

AGREEMENT BETWEEN TH E GOVERNMENT OF THE REPU BLIC OF INDONESIA AND THE ASIA PACIFIC TELECOMMUNITY CONCERNING PRIVILEGES AND IMMUNITIES
The Government of the Republic of Indonesia and the Asia Pacific Telecommunity, hereinafter referred to as the Parties; CONSIDERING their common interest for a close cooperation in the development of telecommunication services and information infrastructure; CONSIDERING FURTHER the Constitution of the Asia Pacific Telecornmunity; REFERING to the need for the establishment of a bilateral agreement as stipulated in the Article 12 Paragraph 3 of the Constitution of the Asia Pacific Telecommunity; RECOGNIZING the Decree of the President of the Republic of Indonesia number 12 I 1985 on the Ratification of the Constitution of the Asia-Pacific Telecommunity; PURSUANT to the prevailing laws and regulations of the Republic of Indonesia;
Have agreed as follows:
ARTICLE 1 DEFINITIONS For the purpose of this Agreement: 1. The Government means the Government of the Republic of Indonesia;
2. Asia Pacific Telecommunity (AP1) means the Asia Pacific regional telecommunication organization established in conformity with Article 32 of the International Telecommwlication Convention of 1973; 3. Laws and regulations of Indonesia includes all legislative acts and regulations, decrees or orders, issued by or under the authority of the Government or appropriate Government authorities;
4. Government authorities means such national or other authorities in Indonesia as may be appropriate in the context and in accordance with prevailing laws and regulations in Indonesia; 5. Official(s) means the official(s) of the Secretariat of the APT as defined in Article 10 of the Constitution of the APT; 6. Expert(s) means person(s) with certain expertise employed by the APT; 7. Executive Director and Deputy Executive Director are the Executive Director and Deputy Executive Director of the APT who are elected by the Management Committee of the APT, as stipulated in the Article 9 of the Constitution of the APT.
ARTICLE 2 PRNILEGES AND IMMUNITIES 1. The Government grants privileges to the assets and properties of the AJYT located in Indonesia; 2. The Executive Director and Deputy Executive Director, official(s) and expert(s) of the APT during his or her official trip to Indonesia will also be granted privileges in accordance with the Indonesian laws and regulation; 3. The Executive Director and Deputy Executive Director, official(s) and expert(s) of the APT shall enjoy the immunity from legal process in respect of words spoken or written performed by them in the exercise of their official duty; 4. These privileges and immunities are granted in the interest of facilitating the works of the APT in Indonesia, and not for personal benefit. Any provision in this agreement will not relieve any person from liability for any damage arising from any criminal act, gross negligence or fraudulent act.
ARTICLE 3 TAX EXEMPTION 1. The assets and properties of the APT located in Indonesia shall be exempted from taxes in accordance with Indonesian laws and regulations effectively in force from time to time; 2. Articles imported under the exemptions stipulated in Article 3 (1) above shall not be sold and transferred to any person in Indonesia except under such conditions agreed by the Government. 2
ARTICLE4 LIMITATION OF ACTIVITIES The APT shall ensure that its official(s), cxpert(s) and such other person(s) employed by the APT, during their stay in Indonesia, will not engage in political affairs and any other ventures or activities outside their scope of duty.
ARTICLE 5 ABUSE OF PRIVILEGES AND IMMUNITIES 1. The APT shall cooperate with the appropriate Government authori ties in order to prevent any abuse of the privileges and immunities provided for in this Agreement; 2. Should the Government consider that an abuse of privileges and immunities accorded under this Agreement has occurred, the APT shall consult the Government authorities.
ARTICLE 6 AMENDMENT This present Agreement may be amended or revised, at the written request of either Party, by mutual consent.
ARTICLE 7 SETLEMENT OF DISPUTE Any disputes between the Parties concerning the interpretation and/ or implementation of this Agreement shall be settled ainicably through consultations or negotiations.
ARTICLE 8 ENTRY INTO PORCE 1. T his Agreement shall come into force on the date of its signing;

2. This Agreement will be valid for the duration of 3 (three) years, and will be extended automatically for succ~ss1ve 2 (two) year period;
3. This Agreement may be terminated by either Party by written notice at least 6 (six) months in advance.
IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Authorities, have signed this Agreement.
