PERJANJIAN ANTARA REPUBLIK INDONESIA DAN REPUBLIK KOREA TENTANG BANTUAN HUKUM TIMBAL BALIK DALAM MASALAH PIDANA
Republik Indonesia dan Republik Korea ( dalam hal m1 disebut sebagai
"Para Pihak"); BERHASRAT untuk meningkatkan kerjasama yang efektif kedua negara dalam pencegahan penyidikan, penuntutan dan penanggulangan kejahatan melalui bantuan hukum timbal balik dalam masalah pidana; TELAH MENYETUJUI hal-hal sebagai berikut :
Pasal J RUANG LINGKUP PENERAPAN PERJANJIAN
I.
Para Pihak, berdasarkan ketentuan Perjanjian ini, saling memberikan bantuan dalam maslah pidana.
2.
Yang dimaksud oleh Perjanjian ini, masalah pidana adalah penyidikan, penuntutan atau proses acara yang berkaitan dengan setiap kejahatan yang dapat dihukum pada saat permintaan bantuan diajukan, berdasarkan juridiksi pihak yang berwenang di Pihak Peminta.

Masalah pidana meliputi juga masalah mengenai kejahatan terhadap hukum yang berkaitan dengan pajak, kepabeanan, pengawasan pertukaran mata uang atau masalah penghasilan lainnya, tetapi tidak meliputi masalah yang tidak ada hubungannya dengan proses acara terse but.
4. Bantuan harus meliputi : (a) pengambilan alat/barang bukti atau pemyataan dari orang; (b) pemberian infonnasi, dokumen, catatan dan barang bukti; (c) lokasi atau identifikasi orang atau barang; (d) penyampaian dokumen; (e) pelaksanaan pennintaan tmtuk penyidikan dan penyitaan; (t) membuat pengaturan tmtuk orang yang memberikan kesaksian atau membantu dalam penyidikan, penuntutan atau proses acara pidana di Pihak Peminta; (g) penelusuran, penahanan sementara, perampasan dan penyitaan yang dihasilkan dari kegiatan kejahatan dan yang dihasilkan dari membantu dilakukannya kejahatan; (h) bantuan lain yang diperlukan dengan Pihak Peminta dan tidak bertentangan dengan Perjanjian ini maupun hukum di Pihak Diminta.
5. Bantuan yang diberikan berdasarkan Perjanjian ini tidak meliputi : (a) ekstradisi, atau dengan maksud untuk penangkapan atau penahanan setiap orang; (b) pelaksanaan di Pihak Diminta mengenai putusan pidana yang dijatuhkan di Pihak Peminta kecuali dalam batas yang diperbolehkan oleh hukum Pihak Diminta dan Perjanjian ini; ( c) pemindahan orang dalam penjara untuk menjalani pidana; ( d) pemindahan proses acara dalam masalah pidana.
Pasal 2 BANTUAN LAIN Perjanjian ini tidak menghapus kewajiban-kewajiban yang ada antara Para Pihak, baik itu berdasarkan persetujuan lain, pengaturan atau cara lain, serta tidak menghalangi Para Pihak untuk saling memberikan bantuan baik itu berdasarkan perjanjian, pengaturan atau cara lain.
Pasal3 KANTOR PUSAT
I . Para Pihak setiap saat harus memiliki orang atau pejabat yang ditunjuk oleh Kantor Pusat untuk menjamin dan menerima permintaan untuk maksud Perjanjian ini. 2. Orang atau pejabat berikut ditunjuk untuk menjadi Kantor Pusat pada saat dimulainya Perjanjian ini : Untuk Republik Indonesia, Kantor Pusat adalah Menteri (a) Kehakiman dan HAM atau pejabat yang ditunjuk oleh Menteri tersebut. (b) Untuk Republik Korea, Kantor Pusat adalah Menteri Kehakiman atau pejabat yang ditunjuk oleh Menteri tersebut. 3 . Para pihak harus saling memberitahukan adanya perubahan terhadap Kantor Pusat. 4 . Kantor Pusat harus berhubungan satu dengan yang lain secara langsung, namun jika mereka memilih, dapat berhubungan melalui saluran diplomatik.
Pasal 4 ISi PERM INTAAN 1. Permintaan bantuan harus memuat: (a) uraian maksud permintaan dan sifat bantuan yang diminta; (b) identifikasi dari orang, badan atau instansi yang mengajukan permintaan; ( c) meliputi uraian mengenai sifat masalah pidana termasuk, uraian ringkas fakta yang relevan, hukum, dan ancaman pidana yang dikenakan; (d) meliputi pernyataan yang menunjukan status terakhir dari penyidikan atau proses acara; ( e) meliputi pernyataan yang menerangkan mengenai batas waktu yang diinginkan untuk melaksanakan permintaan. 2. Permintaan bantuan, sejauh itu relevan dan dimungkinkan, harus memuat juga :

identitas, kewarganegaraan, dan lokasi dari orang atau orang yang menjadi subyek, atau orang yang mungkin memiliki infonnasi berkaitan dengan masalah pidana; dalam hal bantuan berdasarkan Pasal l 0 : (i) uraian masalah mengenai orang yang akan diperiksa, apabila dimungkinkan, termasuk pertanyaan yang diajukan oleh Pihak Peminta terhadap orang tersebut; (ii) uraian dari dokumen, catatan atau barang bukti yang dihasilkan dan, sejauh itu relevan, uraian mengenai orang yang tepat untuk diminta memberikan keterangan tersebut; dalam hal pennintaan bantuan berdasarkan Pasal 11 atau Pasal 12, hams disebutkan infonnasi mengenai tunjangan dan biaya yang diberikan untuk perjalanan orang ke Pihak Peminta; dalam hal pennintaan bantuan berdasarkan Pasal 15 atau Pasal 16, uraian mengenai barang-barang yang dicari, dan sejauh itu relevan, mengenai lokasi barang-barang itu berada; dalam hal permintaan bantuan berdasarkan Pasal 16 : (i) pemyataan yang menjadi dasar keyakinan Pihak Peminta bahwa basil kejahatan berada dalam yurisdiksi Pihak Diminta; dan (ii) putusan pengadilan, jika ada, yang dapat dilaksanakan dan pemyataan mengenai status putusan tersebut; dalam hal pennintaan bantuan untuk pengembalian basil kejahatan atau yang telah diketemukan, diperlukan pernyataan pengaturan khusus berdasarkan Pasal 16 ayat 4; pemyataan mengenai tata cara atau adanya syarat tertentu di Pihak Peminta, atau yang dapat mempengaruhi terhadap pennintaan, meliputi rincian yang hams diberikan mengenai masalah atau setiap bentuk infonnasi, barang bukti, dokumen atau barang yang diminta untuk diserahkan; pernyataan, jika ada, oleh Pihak Peminta mengenai kerahasiaan dari pennintaan dan alasan-alasannya; dalam hal pejabat dari Pihak Peminta bennaksud melakukan perjalanan ke Pihak Diminta berkaitan dengan permintaan, infonnasi mengenai maksud kunjungan pejabat tersebut, jangka waktu dan pengaturan perjatanannya; dan setiap informasi penunjang lainnya, barang bukti atau dokumen yang diperlukan, atau dapat membantu, Pihak Diminta memenuhi pennintaan tersebut.
3. Pennintaan, setiap dokumen penunjang dan komunikasi yang dibuat sesuai dengan Perjanjian ini, hams dibuat dalam bahasa Pihak Peminta dan disertai dengan terjemahannya kedalam bahasa Pihak Diminta atau kedalam bahasa Inggris. 4. Jika Pihak Diminta menganggap bahwa infonnasi yang terdapat dalam pennintaan tidak cukup untuk memenuhi permintaan bantuan sesuai dengan Perjanjian ini, Pihak Diminta dapat meminta infonnasi tambahan. 5. Permintaan hams dibuat, secara tertulis kecuali Pihak Peminta dapat menerima pennintaan dalam bentuk lain dalam keadaan yang mendesak. Dalam keadaan seperti ini, pennintaan tertulis harus ditetapkan dalam waktu tiga puluh hari (30) hari kecuali Pihak Diminta menyetujui jangka waktu lain.
Pasal S PENOLAKAN BANTUAN l . Bantuan harus ditolak jika : (a) pennintaan berkaitan dengan kejahatan yang menurut Pihak Diminta adalah kejahatan yang bersifat politik atau kejahatan berdasarkan hukum militer; (b) pennintaan berkaitan dengan penuntutan terhadap seseorang atas kejahatan yang pelakunya telah selesai menjalani pidana yang dijatuhkan, atau diberi grasi atau dibebaskan di Pihak Diminta; terdapat alasan kuat untuk menduga bahwa pennintaan bantuan itu (c) dengan maksud untuk menuntut atau memidana seseorang karena alasan suku, jenis kelamin, agama, kewarganegaraan atau pandangan politik atau bahwa pennintaan bantuan itu akan men1gikan orang yang bersangkutan karena alasan tersebut; pennintaan, jika diberikan, akan merugikan kedaulatan Pihak (d) Diminta, keamanan, atau kepentingan utama lainnya, meliputi juga pertimbangan terhadap keselamatan setiap orang dan menyebabkan beban berat terhadap kekayaan Pihak Diminta; pennintaan itu berkaitan dengan penuntutan dan pemindanaan (e) terhadap seseorang untuk perbuatan yang tidak dinyatakan sebagai suatu kejahatan, jika perbuatan itu dilakukan didalam yurisdiksi Pihak Diminta.
2. Bantu an dapat ditolak jika pennintaan itu berkaitan dengan penuntutan terhadap seseorang atas suatu kejahatan yang tidak dapat lagi dituntut karena alasan kadaluarsa jika kejahatan itu dilakukan didalam jurisdiksi Pihak Diminta. 3. Bantuan dapat ditunda oleh Pihak Diminta jika pennintaan akan mempengaruhi penyidikan atau penuntutan yang sedang dilaksanakan di Pihak Diminta. 4. SebeIurn menolak atau menunda pemberian bantuan sesuai dengan Pasal ini, Pihak Diminta melalui Kantor Pusat harus : (a) memberitahukan dengan segera Pihak Peminta dengan alasan penolakan atau penundaan tersebut; dan (b) mengkonsultasikan dengan Pihak Peminta untuk menentukan apakah bantuan dapat diberikan berdasarkan syarat-syarat dan kondisi yang dianggap perlu oleh Pihak Peminta.
5. Jika Pihak Peminta menerima bantuan dengan syarat dan kondisi yang ditentukan ayat 4 b, maka pennintaan bantuan dilaksanakan sesuai dengan syarat dan kondisi tersebut.
Pasal 6 PELAKSANAAN PERM INTAAN I . Pennintaan bantuan harus dilaksanakan dengan segera oleh pihak berwenang di Pihak Diminta sesuai dengan ketentuan hukum Pihak tersebut, dan sejauh diperbolehkan hukum di Pihak Diminta, dengan cara yang dikehendaki oleh Pihak Peminta. 2. Pihak Diminta dapat menunda penyerahan barang yang diminta jika barang itu sedang diperlukan untuk proses acara berkaitan dengan masalah-masalah pidana atau perdata di Pihak Peminta. Dalam hal ini, Pihak Diminta han1s, atas pennintaan, memberikan salinan resmi dokumen. 3. Pihak Diminta harus segera memberitahukan Pihak Peminta mengenai keadaan, jika Pihak Diminta dapat mengetahui, adanya hal-hal yang menyebabkan tertundanya pelaksanaan pennintaan.
Pasal 7 PENGEMBALIAN RARANG BUKTI KEPADA PIHAK DIMINTA
)ejauh dikehendaki oleh Pihak Dirninta, Pihak Peminta harus rnengemba1ikan barang bukti yang diberikan berdasarkan Perjanjian ini ~pabila barang bukti itu sudah tidak diperlukan lagi untuk masa1ah pidana ~ang berkaitan dengan pennintaan.
Pasal 8 KERAHASIAAN DAN PEMBATASAN PENGGUNAAN I . Pihak Diminta harus, jika diminta, mengupayakan sebaik-baiknya kerahasiaan permintaan bantuan, isi permintaan dan dokumen-dokumen penunjangnya dan setiap tindakan sesuai dengan permintaan itu. Jika permintaan tidak dapat dilaksanakan tanpa melanggar kerahasiaan, Pihak Diminta juga harus memberitahukan Pihak Peminta sebelum melaksanakan permintaan itu, dan Pihak Peminta harus memberitahukan Pihak Diminta apakah permintaan tetap diajukan meskipun melanggar kerahasiaan. 2. Pihak Peminta harus, jika diminta, mengupayakan sebaik-baiknya kerahasiaan informasi dan barang bukti yang diberikan oleh Pihak Diminta kecuali jika informasi dan barang bukti itu diperlukan untuk masalah pidana yang berkaitan dan selain dari yang diperbolehkan oleh Pihak Diminta. 3. Pihak Peminta harus, jika diminta, mengupayakan sebaik-baiknya untuk menjamin bahwa informasi atau barang bukti adalah dilindungi dari kehilangan cara-cara yang tidak berwenang, perubahan, pengungkapan atau penyalahgunaan Iainnya. 4. Pihak Perninta tidak akan menggunakan informasi dan barang bukti yang diperolehnya, untuk maksud selain daripada yang dinyatakan didalam permintaannya tanpa persetujuan terlebih dahulu dari Pihak Diminta.
Pasal 9 PENYAMPAIAN DOKUMEN I . Pihak Diminta harus, sejauh diperbolehkan oleh ketentuan hukumnya, melaksanakan pennintaan untuk penyampaian dokumen yang berkaitan dengan masalah pidana. 2. Pennintaan penyampaian untuk pemeriksaan yang memuat panggilan kehadiran seseorang sebagai saksi di Pihak Peminta harus diajukan kepada Pihak Diminta sekurang-kurangnya empat puluh lima (45) hari sebelum jadwal kehadirannya. Dalam keadaan mendesak, Pihak Diminta dapat mengesampingkan syarat ini. 3. Pihak Diminta harns menyampaikan kepada Pihak Peminta bukti penyampaian dokumen. Jika penyampaian dokumen tidak dapat dilakukan, Pihak Peminta akan diberitahu juga mengenai hal itu disertai dengan alasannya. 4. Seseorang yang tidak dapat memenuhi setiap proses yang barns dilakukannya, maka terrhadap orang tersebut tidak akan dikenakan hukuman atau tindakan lain sesuai dengan hukum Pihak Peminta atau Pihak Diminta.
Pasal 10 PENGAMBILAN BARANG BUKTI 1. Pihak Diminta barns, sejauh diperbolehkan ketentuan bukumnya dan atas pennintaan, untuk mengambil kesaksian, atau selain dari pemyataan yang diperoleb dari orang itu, atau meminta barang bukti yang ada padanya untuk disampaikan kepada Pihak Peminta. 2. Pihak Diminta, sejauh diperbolehkan oleh ketentuan hukumnya, barns mengijinkan kebadiran orang tersebut sebagaimana disebutkan didalam permintaan selama permintaan dilaksanakan dan mengijinkan orang tersebut untuk diperiksa dengan orang yang diminta kesaksiannya atau barang bukti yang ada padanya. Dalam bal pemeriksaan secara langsung tidak diperbolehkan, diperbolehkan untuk orang tersebut secara terbuka menyampaikan pertanyaan secara tertulis.
3. Seseorang yang daripadanya diperoleh barang bukti yang berada di Pihak Diminta sesuai dengan pennintaan berdasarkan perjanjian ini, dapat menolak memberikan barang bukti sejauh hukum apakah Pihak Diminta atau Pihak Peminta membolehkannya. 4. Jika seseorang di Pihak Diminta menyatakan bahwa terdapat hak atau kewajiban untuk menolak memberikan kesaksian menurut hukum Pihak Peminta, maka Kantor Pusat dari Pihak Peminta harus aatas pennintaan memberikan surat keterangan kepada Kantor Pusat Pihak Diminta mengenai adanya hak itu. Dalam hal tidak ada bukti sebaliknya, surat keterangan itu merupakan bukti yang cukup masalah tersebut. 5. Untuk maksud Pasal ini, pengambilan barang bukti meliputi pengadaan
atau barang lainnya dokumen yang dihasilkan atau barang-barang lainnya. Pasal 11 PEMINDAHAN ORANG TAHANAN/NARAPIDANA UNTUK MEMBERIKAN KESAKSIAN.
I . Seseorang tahanan/narapidana di Pihak Diminta, atas permintaan dari Pihak Peminta, dapat dipindahkan sementara ke Pihak Peminta untuk memberikan kesaksian dalam proses acara di Pihak Peminta. 2. Pihak Diminta harus memindahkan tahanan/narapidana ke Pihak Peminta hanyajika: (a). orang itu bersedia untuk dipindahkan; dan (b). Pihak Peminta setuju sesuai dengan syarat yang ditentukan oleh Pihak Diminta berkenaan dengan penahanan atau keamanan dari orang yang akan dipindahkan. 3. Apabila Pihak Diminta menyatakan kepada Pihak Peminta bahwa orang yang dipidahkan sudah tidak perlu Jagi berada dalam tahanan/penjara, orang itu harus dilepaskan. 4. Seseorang yang dipindahkan sesuai dengan permintaan berdasarkan Pasal ini harus dikembalikan ke Pihak Diminta sesuai dengan ketentuan yang disetujui oleh Pihak Diminta yang dilaksanakan sesegera mungkin setelah orang itu mernberikan kesaksian atau dalam waktu yang lebih awal setelah kehadiran orang itu tidak diperlukan lagi.
5. Seseorang yang dipindahkan han1s diakui masa hukuman yang dijalaninya di Pihak Diminta untuk waktu selama orang itu menjalani penahanan di Pihak Peminta.
Pasal 12 MENGHADIRKAN ORANG LAIN UNTUK MEMBERIKAN KESAKSIAN ATAU UNTUK MEMBANTU PENYIDIKAN I . Pihak Peminta dapat meminta bantuan Pihak Diminta untuk mengatur pemindahan seseorang (bukan orang sebagaimana dimaksud didalam Pasal 11 perjanjian) dengan persetujuan orang itu kepada Pihak Peminta untuk memberikan kesaksian atau bantuan yang berkaitan dalam masalah pidana di Pihak Peminta; 2. Jika Pihak Diminta dapat menerima bahwa pengaturan yang memuaskan akan dilakukan oleh Pihak Peminta untuk menjamin keamanan orang itu, Pihak Diminta meminta persetujuan dari orang tersebut untuk memberikan kesaksian atau bantuan di Pihak Peminta. Orang tersebut hams diberitahukan mengenai setiap biaya atau tunjangan yang wajib dibayarkan. Pihak Diminta hams segera memberitahukan Pihak Peminta mengenai kesediaan orang tersebut dan, jika orang itu menyetujui, mengambil semua langkah-langkah yang diperlukan untuk memudahkan permintaan tersebut. Pasal 13 TINDAKAN JAMINAN KESELAMATAN I . Dengan memperhatikan ayat 2 Pasal ini, apabila seseorang berada di Pihak Peminta berdasarkan permintaan yang diajukan menurut Pasal 11 atau Pasal 12 Perjanjian ini, selama waktu orang tersebut diperlukan, tetap tinggal di Pihak Peminta untuk maksud permintaan: (a)
orang tersebut tidak akan ditahan, dituntut atau dihukum di Pihak Peminta untuk pelanggaran apapun, atau tidak menjadi pihak dalam proses secara perdata apapun, menjadi tergugat yang tidak dapat dikenakan padanya jika ia tidak berada di Pihak Peminta, berkenaan dengan perbuatan atau omisi apapun yang dilakukannya sebelum orang itu meninggalkan Pihak Diminta; dan
(b)
orang itu tidak boleh, tanpa persetujuannya, diminta untuk memberikan kesaksian da1am suatu proses secara pidana atau membantu suatu penyidikan pidana selain daripada masalah pidana yang berkaitan dengan permintaan.
2. Ayat I Pasal ini tidak berlaku lagi jika orang itu, setelah bebas untuk pergi, tidak meninggalkan Pihak Peminta dalam jangka waktu (15 hari) lima belas hari setelah orang itu secara resrni diberitahu bahwa kehadirannya tidak diperlukan lagi atau, setelah meninggalkan negara itu, temyata kembali lagi. 3. Seseorang yang tidak memberikan persetujuan untuk kesaksian yang dimaksud dalam Pasal 11 dan Pasal 12 tidak akan, karena alasan itu diancam dengan suatu dikenakan upaya paksa apapun oleh Pengadilan Pihak Pihak Diminta.

4. Seseorang yang memberikan persetujuannya untuk memberikan kesaksian yang dimaksud dalam Pasal 11 atau Pasal 12 Perjanjian ini tidak akan dilakukan penuntutan berdasarkan kesaksiannya, kecuali untuk sumpah palsu atau penghinaan terhadap peradilan.
Pasal 14 PENYEDIAAN INFORMASI I . Pihak Diminta han1s memberikan salinan dari dokumen dan catatan yang terbuka untuk umum yang merupakan bagian dari daftar umum atau daftar lain, atau dapat dibeli atau diperiksa oleh umum. 2. Pihak Diminta dapat memberikan salinan dokumen atau catatan dengan cara yang sama dan dengan syarat-syarat yang sama apabila kalau dokumen atau catatan tersebut dapat diberikan kepada penegak hukum atau pejabat peradilan.
Pasal 15 PENCARIAN DAN PE NY ITAAN
1. Pihak Diminta, sepanjang hukumnya mengizinkan, harus melaksanakan permintaan yang berkaitan dengan masalah pidana di Pihak Peminta untuk mencari, menyita dan menyerahkan barang sitaan kepada Pihak Peminta. 2. Pihak Diminta harus memberikan informasi sebagaimana diminta oleh Pihak Peminta, mengenai basil dari pencarian, tempat dan keadaan pada saat penyitaan, dan penyimpanan selanjutnya barang sitaan tersebut. 3. Pihak Peminta harus memperhatikan setiap syarat yang ditetapkan oleh Pihak Diminta dalam kaitannya dengan barang sitaan yang diserahkan kepada Pihak Peminta.
Pasal 16 HASIL KEJAHATAN
1. Pihak Diminta, atas permintaan, barns berusaha untuk memastikan apakah hasil kejahatan berada di dalam yurisdiksinya dan harus memberitahukan kepada Pihak Peminta mengenai hasil penyidikannya. 2. Dalam hal, menuntt ayat I, basil kejahatan yang dicurugai itu diketemukan, Pibak Diminta harus mengambil tindakan yang diperbolehkan oleh hukumnya untuk menahan dan menyita hasil kejahatan tersebut. 3. Dalam melaksanakan Pasal ini, hak dari pihak ketiga yang beritikad baik harus dihormati menurut hukum Pihak Diminta. 4. Pihak Diminta harus menahan suatu basil kejahatan yang disita, kecuali untuk kasus tertentu yang disetujui, berlaku lain. 5. Untuk maksud Perjanjian ini " basil kejahatan" berarti setiap barang yang
dicurigai, atau dinyatakan oleh pengadilan, sebagai barang yang berasal dari atau diperoleh, langsung atau tidak langsung sebagai hasil dari dilakukannya suatu kejahatan atau harga lawan dari barang dan keuntungan lain yang berasal dari dilakukannya suatu kejahatan, dan
tennasuk barang yang digunakan untul< melakukan atau memudahkan dilakukannya kejahatan. Pasal 17 PENGUATAN DAN PENGESAHAN
1. Dengan memperhatikan ayat 2, pennintaan bantuan, dokumen penunjangnya dan dokumen atau barang yang diberikan sebagai jawaban atas permintaan, tidak harus diperlukan suatu bentuk penguatan atau pengesahan. 2. Apabila dalam kasus tertentu Pihak Diminta atau Pihak Peminta meminta bahwa dokumen atau barang disahkan, dokumen atau barang harus disahkan dengan cara sebagaimana diatur didalam ayat 3. 3. Dokumen atau barang adalah sah untuk maksud Perjanjian ini jika : (a) ditandatangani atau dikuatkan oleh hakim atau pejabat lain di atau dari Pihak yang mengirimkan dokumen~ dan (b) dibubuhi dengan cap resmi dari Pihak pengirim dokumen atau dari Menteri, Departemen atau dari pejabat pemerintah, dari Pihak itu.
Pasal 18 PENGATURAN TAMBAHAN
Kantor Pusat masing-masing Pihak dapat membuat pengaturan tambahan yang sesuai dengan tujuan Perjanjian ini dan hukum kedua Pihak.
Pasal 19 PERWAKILAN DAN BIA YA
1. Kecuali jika diatur Jain dalam Perjanjian ini, Pihak Diminta harus menyiapkan hal-hal yang diperlukan agar Pihak Peminta diwakili secara hukum dalam setiap proses acara pidana yang timbul karena adanya permintaan bantuan dan dengan demikian Pihak Diminta akan mewakili kepentingan Pihak Peminta.
2. Pihak Diminta harus menanggung biaya untuk memenuhi pennintaan bantuan kecuali biaya yang harus ditanggung oleh Pihak Peminta yaitu : (a) biaya yang berhubungan dengan pengangkutan orang ke atau dari wilayah Pihak Diminta clan biaya akomodasi orang itu dan setiap upah, tunjangan atau biaya lain yang wajib dibayar kepada orang itu selama berada di Pihak Peminta berdasarkan pennintaan menurut Pasal 9, Pasal 11 atau Pasal 12 Perjanjian ini; (b) biaya yang berhubungan dengan pengangkutan petugas tahanan/penjara atau petugas pengawal; upah dan biaya dari ahli dan biaya yang berhubungan dengan (c) terjemahan dokumen. 3.
Jika timbul biaya sebagai akibat dari pelaksanaan pennintaan yang memerlukan biaya yang bersifat khusus, Para Pihak harus memberitahukan untuk memutuskan keadaan-keadaan syarat untuk pennintaan bantuan dapat diberikan.
Pasal 20 KONSULTASI DAN PENYELESAIAN PERSELISIHAN Para Pihak harus mengadakan konsultasi dengan segera, atas permintaan pihak lainnya, mengenai suatu hal yang berhubungan dengan penafsiran, penerapan atau pelaksanaan Perjanjian ini, baik secara umum maupun dalam kaitannya dengan kasus tertentu.
Pasal 21 AMANDEMEN Perjanjian ini dapat diamandemen setiap saat dengan persetujuan ke dua Pihak clan akan mulai berlaku setelah persyaratan nasional masingmasing telah dipenuhi.
Pasal 22 MULAI BERLAKU DAN BERAKHIR 1. Perjanjian ini mulai berlaku pada tanggal terakhir pemberitahuan oleh Para Pihak bahwa persyaratan nasional masing-masing untuk berlakunya Perjanjian ini telah dipenuhi.
2. Perjanjian ini akan berlaku untuk Perjanjian yang dilakukan baik sebelum dan setelah tanggal mulai berlakunya Perjanjian ini. 3. Salah satu Pihak dapat mengakhiri Perjanjian ini setiap saat melalui pemberitahuan tertulis. Pengakhiran akan mulai berlaku enam (6) bulan setelah tanggal pemberitahuan. 4. Pengakhiran Perjanjian ini tidak akan mempengaruhi penyelesaian dari setiap kegiatan yang sedang berjalan yang disetujui Para Pihak berdasarkan Perjanjian ini.
SEBAGAI BUKTI, yang bertandatangan dibawah ini, yang diberi kuasa oleh Pemerintah masing-masing telah menandatangani Perjanjian ini. DIBUAT dalam rangkap dua di .;).lke.wt... pada tanggal.~Q.. ('..7.~ . pada tahun dua ribu dua, dalam bahasa Indonesia, bahasa Korea, dan bahasa Inggris, semua naskah mempunyai kekuatan yang sama. TREATY BET\VEEN THE REPUBLIC OF INDONESIA AND THE REPUBLIC OF KOREA ON MUTUAL LEGAL ASSISTANCE IN CRIMINAL MATTERS The Republic of Indonesia and the Rq"1blic of Korea (hereinafter referred to
as "the Parties"); DESIRING to improve the effectiveness of both countries in the prevention, investigation, proseeution and suppression of crime through cooperation and mutual assistance in criminal matters; HA VE AGREED as follows: Article 1 SCOPE OF APPLICATION
l.
The Parties shall, in accordance with the provisions of this Treaty, grant each other assistance in criminal matters.
2.
For the purposes of this Treaty~ criminal matters mean investigations, prosecutions or proceedingH'elating to any offence the punishment of which at the time of the request for assistance, falls within the jurisdl~ion of the competent authorities of the Requesting Party.
3.
Criminal matters also include matte connected with offences against a law related to taxation, customs duties, foreign exchange control or other revenue matters, but not in connection with nonaeriminal proceedings relating thereto.

Assistance shall include: (a) taking evidence or statements from persons; (b) providing information, documents, records and articles of evidence; (c) locating or identifying persons or items; (d) serving documents; (e) executing requests for search and seizure;

making anangements for persons to give evidence or assist in criminal investigations, prosecutions, or proceedings in the Requesting Party. tracing, restraining, forfeiting and confiscating the proceeds and instrnmentalities of criminal activities; and other assistance deemed necessary by the Requesting Party and consistent with this Treaty as well as the law of the Requested Party.
Assistance granted under this Treaty does not include: tl1e extradition, or the arrest or detention for that purpose, of (a) any person; (b) the execution in the Requested Party of criminal judgements imposed in the Requesting Party except to the extent permitted by the law of the Requested Party and this Treaty; (c) the transfer of persons in custody to serve sentences; (d) the transfer of proceedings in criminal matters.
Article 2 OTHER ASSISTANCE This Treaty shall not affect any existing obligations between the Parties, whether pursuant to other treaties, atTangements, or otherwise, nor prevent the Parties from providing assistance to each other pursuant to other treaties, arrangements, or otherwise.
Article 3 CENTRAL AUTHORITY 1.
The Pat1ies at all times shall each have a person who, or an authority which, is designated as the Central Authority to transmit and receive requests for the purposes of this Treaty.
2.
The following persons or authorities are hereby designated to be the Central Authorities at the commencement of this Treaty: (a) For the Republic of Indonesia, the Central Authority is the Minister of Justice and Human Rights or an official designated by that Minister. (b) For the Republic of Korea, the Central Authority is the Minister of Justice or an official designated by that Minister. 2
3.
Each Party shall notify the other of any change of its Central Authority.
4.
The Central Authorities shall nonnally communicate directly with one another, but may, if they choose, communicate through the diplomatic channel. Article 4 CONTENTS OF Mt.:QtJ.t.:S'l'S
l.
Requests for assistance shall: (a) specify the purpose of the request and the nature of the assistance sought; (b) identify the person, agency or authority that initiated the request; (c) include a description of the nature of the criminal matter, including a summary of the relevant facts and laws and applicable penalties; (d) include a statement indicating the current status of the investigation or proceeding; (e) include a statement specifying any time frame within which compliance with the request is desired.
2.
Requests for assistance, where relevant and so far as possible, shall also include: (a) the identity, nationality and location of the person or persons who are the subject of, or who may have information relevant to, the criminal matter; (b) \ivhcre the request is for assistance under Article I 0 : (i) a description of the matters about which persons are to be examined including, where appropriate, any questions that the Requesting Party '"'ishes to be put to those j.JCl ~UJI S;

a description of any documents, records or articles of evidence to be produced and, where relevant, a description of the appropriate person to be asked to produce them;

where the request is for assistance under Articles 11 or 12, information about the allowances and expenses to which a person traveling to the Requesting Party would be entitled; where the request is for assistance under Articles 15 or 16, a description of the material sought and, where relevant, its likely location; where the request is for assistance under Article 16 : (i) a statement outlining the basis of Requesting Party' s belief that proceeds of crime may be located in the jurisdiction of the Requested Party; and (ii) the court order, if any, sought to be enforced and a statement about the status of that order; where the request is for assistance that may lead to or result in the discovery or recovery of proceeds of crime, a statement as to whether a special arrangement under Article 16 paragraph 4 is sought; a statement outlining any particular requirement or procedure that the Requesting Party may have, or wish to be followed in giving effect to the request, including details of the manner or form in which any information, evidence, document or item is to be supplied; a statement setting out the wishes, if any, of the Requesting Party concerning confidentiality of the request, and the reasor:is for those wishes; where att- official of the Requesting Patty intends traveling to the Requested Party in connection with the request, information about the purpose of that person' s visit, the proposed time frame and travel arrangement; and any other supporting information, evidence or documents that is necessary to enable, or may assist, the Requested Party to give effect to the request.
3.
A request, any supporting documentation and any communications made pursuant to this Treaty, shall be in the language of the Requesting Party and be accompanied by a translation into the language of the Requested Party or in the English language.
4.
If the Requested Party considers that the information contained in a request is not sufficient to enable the request to be dealt with m accordance with this Treaty, it may request additional infonnation. 4
5.
A request shall be made in writing except that the Requested Party may accept a request in another form in urgent situations. In any such situation, the request shall be confirmed in writing within thirty (30) days unless the Requested Party agrees otherwise.
Article 5 REFUSAL OF ASSISTANCE I.
Assistance shall be refused if: (a) the request relates to an offence that is regarded by the Requested Party as an offence of a political character or an offence only under military law; (b) the request relates to the prosecution of a person for an offence in respect of which the person has been finally acquitted or pardoned or has served the sentence imposed in the Requested Party; (c) there are substantial grounds for believing that the request for assistance has been made for the purpose of persecuting or punishing a person on account of that person's race, sex, religion, nationality or political opinions, or that the request for assistance w ill result in that person being prejudiced for any of those reasons; the request, if granted, would seriously impair the Requested ( d) Party's sovereignty, security or essential interests, considerations of which may include the safety of any persons and the burden on the resources of the Requested Party; or ( e) the request relates to the prosecution or punishment of a person fo r conduct that would not, if it had taken place within the jurisdiction of the Requested Party, have constituted an offence.
2.
Assistance may be refused if the request relates to the prosecution of a person for an offence for which the person could no longer be prosecuted by reason of lapse of time if the offence had been com mitted within the jurisdiction of the Requested Party.
3.
Assistance may be postponed by the Requested Party if the request relates to an ongoing investigation or prosecution in the Requested Party.

Before refusing or postponing assistance pursuant to this Article, the Requested Party, through its Central Authority, shall : (a) promptly inform the Requesting Party of the reason for considering refusal or postponement; and (b) consult with the Requesting Party to determine whether assistance may be given subject to such terms and conditions as the Requested Party deems necessary.
5.
If the Requesting Party accepts assistance subject to the terms and conditions referred to in paragraph 4 (b), it shall comply with those terms and conditions. Article 6 EXECUTION OF REQUESTS
l.
Requests for assistance shall be carried out promptly by the competent authorities of the Requested Party in accordance with the laws of that Party and, to the extent those laws permit, in the manner requested by the Requesting Party.
2.
The Requested Party may postpone the delivery of material requested if such material is required for proceedings in respect of criminal or civil matters in that Party. If this is the case, the Requested Party shall, upon request, provide certified copies of documents.
3.
The Requested Party shall promptly infonn the Requesting Party of circumstances, when they become known to the Requested Party, which are likely to cause a significant delay in carrying out the request.
Article 7 RETURN OF MATERIAL TO REQUESTED PARTY
Where required by the Requested Party, the Requesting Party shall return material provided under this Treaty when it is no longer needed for the criminal matter to which the request relates.

Article 8 CONFIDENTIALITY AND LIMITATION OF USE 1.
The Requested Party shall, if so requested, use its best efforts to keep confidential a request for assistance, the contents of the request and its supporting documentation, and any action taken pursuant to the request. If the request cannot be executed without breaching confidentiality, the Requested Party shall so infonn the Requesting Party before executing the request, and the Requesting Party shall advise whether it nevertheless wishes the request to be executed.
2.
The Requesting Party shall, if so requested, use its best efforts to keep confidential the information and evidence provided by the Requested Party, except to the extent that the evidence and infonnation is needed for the criminal matters to which the request relates and where otherwise authorized by the Requested Party.
3.
The Requesting Party shall, if so requested, use its best efforts to ensure that the infonnation or evidence is protected against loss and unauthorized access, use, modification, disclosure or other misuse.
4.
The Requesting Party shall not use the information or evidence obtained, nor anything derived from either, for purposes other than those stated in a request without the prior consent of the Requested Party.
Article 9 SERVICE OF DOCUMENTS 1.
The Requested Party shall, to the exteht its laws permit, carry out requests for the service of documents in respect of a criminal matter.
2.
A request for service of a summons requiring the appearance of a person as a witness in the Requesting Party shall be made to the Requested Party not less than forty five (45) days before the scheduled appearance. In urgent cases, the Requested Party may waive this requirement.

3.
The Requested Party shall forward to the Requesting Party proof of service of the documents. If service cannot be effected, the Requesting Party shall be so infonned and advised of the reasons.
4.
A person who fails to comply with any process served on him or her shall not thereby be liable to any penalty or coercive measure pursuant to the law of the Requesting Party or the Requested Party.
Article 10 TAKING OF EVIDENCE

1.
The Requested Party shall, to the extent its laws pennit and upon request, take testimony, or otherwise obtain statements of persons or require them to produce items of evidence for transmission to the Requesting Party.
2.
The Requested Party, to the extent permitted by its law, shall pennit the presence of such persons as specified in the request during the execution of request, and may allow such persons to question the person whose testimony or evidence is being taken. In the event that such direct questioning is not permitted, such persons shall be allowed to submit written questions.
3.
A person from whom evidence is to be taken in the Requested Party pursuant to a request under this Article may decline to give evidence where the law of the Requested Party or that of the Requesting Party so provides.
4.
If any person in the Requested Party claims that there is a right or obligation to decline to give evidence under the law of the Requesting Party, the Central Authority of the Requesting Party shall, upon request, provides a certificate to the Central Authority of the Requested Party as to the existence of that right. In the absence of evidence to the contrary, the certificate shall be sufficient evidence of the matters stated in it.

For the purposes of this Article, the taking of evidence includes the production of documents or other articles.

Article 11 TRANSFER OF PERSONS IN CUSTODY TO GIVE EVIDENCE 1.
A person in custody in the Requested Party may, at the request of the
Requesting Party, be temporarily transferred to that Party to give evidence in criminal proceedings in that Party. 2.
The Requested Party shall transfer a person m custody to the Requesting Party only if: (a) the person freely consents to the transfer~ and (b) the Requesting Party agrees to comply with any conditions specified by the Requested Party relating to the custody or security of the person to be transferred.
3.
Where the Requested Party advises the Requesting Party that the transferred person is no longer required to be held in custody, that person shall be released.
4.
A person who is transferred pursuant to a request under this Article
shall be returned to the Requested Party in accordance with arrangements agreed by the Requested Party as soon as practicable after the evidence has been given or at such earlier time as the person's presence is no longer required. 5.
A person transferred shall receive credit for service of the sentence
imposed in the Requested Party for the time served in the custody of the Requesting Party.
Article 12 AVAILABILITY OF OTHER PERSONS TO GIVE EVIDENCE OR ASSIST INVESTIGATIONS l.
The Requesting Party may request the assistance of the Requested Party in arranging for the transfer of a person (not being a person to whom Article l l of this Treaty applies) with his or her consent to the Requesting Party to give or provide evidence or assistance in respect of a criminal matter in the Requesting Party.

2.
The Requested Party shall, if satisfied that satisfactory arrangements for that person's safety will be made by the Requesting Patty, invite the person to consent to give or provide evidence or assistance in the Requesting Party. The person shall be informed of any expenses or allowances payable. The Requested Party shall promptly inform the Requesting Party of the person' s response and, if the person consents, take all steps necessary to facilitate the request.
Article 13 SAFE CONDUCT l.
Subject to paragraph 2 of this Article, where a person is in the Requesting Party pursuant to a request made under Articles 11 or 12 of this Treaty, during the period that the person is required to remain in the Requesting Party for the purposes of the request: a. the person shall not be detained, prosecuted or punished in the Requesting Party for any offence, nor be subject to any civil proceedings, being civil proceedings to which the person could not be subjected if the person were not in the Requesting Party, in respect of any act or omission which preceded the person' s departure from the Requested Party; and b. the person shall not, without the person' s consent, be required to give evidence in any criminal proceeding or to assist any criminal investigation other than the criminal matter to which the request relates.
2.
Paragraph l of this Article ceases to apply if that person, being free to leave, has not left the Requesting Party within a period of fifteen (15) days after that person has been officially notified that his or her presence is no longer required or, having left, has returned.
3.
A person who does not consent to give evidence pursuant to Articles 11 or 12 of this Treaty shall not by reason thereof be liable to any penalty or coercive measure by the courts of the Requesting Party or the Requested Party.
4.
A person who consents to give evidence pursuant to Articles 11 or 12 of this Treaty shall not be subject to prosecution based on his or her testimony, except for perjury or contempt of court. 10
Article 14 PROVISION OF INFORMATION I.
The Requested Party shall provide copies of documents and records that are open to public access as part of a public register or otherwise, or that are available for purchase or inspection by the public.
2.
The Requested Party may provide copies of any documents or records in the same manner and under the same conditions as they may be provided to its own law enforcement and judicial authorities.
Article 15 SEARCH AND SEIZURE I.
The Requested Party shall, to the extent its laws permit, carry out requests made in respect of a criminal matter in the Requesting Party for the search, seizure and delivery of material to that Party.
2.
The Requested Party shall provide such information as may be required by the Requesting Party concerning the result of any search, the place and circumstances of seizure, and the subsequent custody of the material seized.
3.
The Requesting Party shall observe any conditions imposed by the Requested Party in relation to any seized material which is delivered to the Requesting Party.
Article 16 PROCEEDS OF CRIME 1.
The Requested Party shall, upon request, endeavour to ascertain whether any proceeds of a crime are located within its jurisdiction and shall notify the Requesting Party of the results of its inquiries.
2.
Where, pursuant to paragraph 1, suspected proceeds of crime are found, the Requested Party shall take such measures as are permitted by its law to restrain or confiscate such proceeds.
3.
In the application of this Article, the ri ghts of bona fide third parties shal I be respected under the law of the Requested Party.
4.
The Requested Party shall retain any proceeds of crime that are confiscated unless otherwise agreed in a particular case.
5.
For the purposes of this Treaty, " proceeds of crime" mean any property suspected, or found by a court to be property directly or indirectly derived or realized as a result of the commission of an offence or to represent the value of property and other benefits deri ved from the commission of an offence, and includes property that is used to commit or to facilitate the commission of an offence.
Article 17 CERTIFICATION AND AUTHENTICATION l.
Subject to paragraph 2, a request for assistance, the documents in support thereof, and documents or materials furnished in response to a request, shall not require any form of certification or authentication.
2.
Where, in a particular case, the Requested or Requesting Party requests that documents or materials be authenticated, the documents or materials shall be duly authenticated in the manner provided in paragraph 3.
3.
Documents or materials are authenticated for the purposes of this Treaty if: (a) they purport to be signed or certified by a judge or other officiai in or of the Party sending the documents; and (b) they purport to be sealed with an officia l seal of the Party sending the document or of a Minister, a Department or official of the Government, of that Party.
Article 18 SUBSIDIARY ARRANGEMENTS The Central Authority of each Party may enter into subsidiary aITangements consistent with the purposes of this Treaty and with the laws of both Parties.

Article 19 REPRESENTATiON AND EXPENSES 1.
Unless otherwise provided in this Treaty, the Requested Party shall make all necessary arrangements for the representation of the Requesting Party in any criminal proceedings arising out of a request for assistance and shall otherwise represent the interests of the Requesting Party.
2.
The Requested Party shall meet the cost of fulfilling the request for assistance except that the Requesting Party shall bear : (a) the expenses associated with conveying any person to or from the territory of the Requested Party, and the accommodation expenses of the person and any fees, allowances or other expenses payable to that person while in the Requesting Party pursuant to a request under Articles 9, 11, or 12 of this Treaty; (b) the expenses associated with conveying custodial or escorting officers; (c) fees and expenses of experts and those associated with the translation of documents.
3.
If it becomes apparent that the execution of the request requires expenses of an extraordinary nature, the Parties shall consult to determine the tenns and conditions under which the requested assistance can be provided. Article 20 CONSULTATION AND SETTLEMENT O F DISPUTES
The Parties shall consult promptly, at the request of either, concerning any issue relating to the interpretation, application or implementation of this Treaty, either generally or in relation to a particular case.
Article 21 AMENDMENT This Treaty may be amended at any time by mutual consent of both Parties and shall enter into force after their respective national requirements have been fulfilled.

Article 22 ENTRY INTO FORCE AND TERrvlINA TION 1.
This Treaty shall enter into force on the date of the last notification by which the Parties notify each other that their respective national requirements for the entry into force of this Treaty have been fulfilled.
2.
This Treaty shall apply to offences committed before as well as after the date it enters into force.
3.
Either Party may terminate this Treaty by notice in writing at any time. Termination shall take effect six (6) months after the date on whicli the notice is given.
4.
The !ermination of this Treaty shall not prejudice the completion of any ohgoing activities agreed upon by the Parties under this Treaty.
