NOTA KESEPAHAMAN ANTARA BADAN NARKOTIKA NASIONAL REPUBLIK INDONESIA DAN DIREKTORAT JENDERAL PERILAKU KECANDUAN DAN KETERGANTUNGAN REPUBLIK PORTUGAL
TENTANG KERJA SAMA DALAM PENGURANGAN PERMINTAAN NARKOBA
Badan Narkotika Nasional Republik Indonesia dan Direktorat Jenderal Perilaku Kecanduan dan Ketergantungan Republik Portugal, selanjutnya secara individual disebut sebagai "Pihak" dan secara kolektif disebut sebagai "Para Pihak";
MENYADARI bahwa masalah narkoba terus menimbulkan ancaman serius bagi kesehatan , keselamatan dan kesejahteraan umat manusia dan memerlukan upaya terpadu para pihak di tingkat internasional; MENEGASKAN
kebutuhan
untuk
mempromosikan
pendekatan
yang
komprehensif dan seimbang dalam pengurangan permintaan , berdasarkan bukti ilmiah;
MENGUNGKAPKAN keinginan mereka untuk mengembangkan
kerang~a
kerja
sama yang saling menguntungkan untuk menangani semua aspek pengurangan permintaan ; MEMPERTIMBANGKAN kebutuhan untuk memperkuat dan melengkapi upayaupaya yang tertuang dalam Konvensi Tunggal Narkotika, diadopsi di New York tanggal 30 Maret 1961 ; Protokol yang mengubah Konvensi Tunggal Narkotika, diadopsi di Jenewa tanggal 26 Maret 1972, Konvensi tentang Psikotropika yang

diadopsidi Wina tanggal 21 Februari 1971 , dan Konvensi PBB Melawan Perdagangan Gelap Narkotika dan Bahan-bahan Psikotropika , diadopsi di Wina tanggal 20 Desember 1988;
BERPEDOMAN
pada
prinsip-prinsip
dan
tujuan
perjanjian
internasional
multilateral yang ada tentang pengawasan narkoba; MENGAKUI pentingnya prinsip kedaulatan , kesetaraan dan hak integritas teritoritorial;
BERDASARKAN pada hukum dan peraturan yang berlaku di masing-masing negara;
Telah menyepakati sebagai berikut; PASAL1 TUJUAN
Tujuan Nota Kesepahaman ini adalah untuk meningkatkan kerja sama antara para Pihak dalam pengurangan permintaan narkoba, dengan cara yang komprehensif,
meliputi
langkah-langkah
untuk
menangani
narkoba
di
bidang
pencegahan , terapi, pengurangan dampak buruk dan reintegrasi sosial. PASAL 2 RUANG LINGKUP KERJA SAMA Kerja sama antara para Pihak meliputi:
1)
Saling tukar informasi, pengalaman dan praktek terbaik terkait penggunaan narkoba;
2)
Pertukaran informasi tentang strategi , rencana , program dan praktek, tindakan legislatif dan administratif yang bertujuan mengurangi penggunaan narkoba;
3)
Berbagi pengalaman tentang pengumpulan , analisis dan penyebaran data tentang narkoba; 2

4)
Pertukaran publikasi dan penelitian mengenai masalah narkoba;
5)
.Memfasilitasi partisipasi bersama para ahli dari Badan Narkotika Nasional dan Direktorat Jenderal Pengawasan dan Ketergantungan Narkoba dalam seminar I pertemuan , yang diselenggarakan oleh masing-masing pihak mengenai hal-hal di bawah kompetensi lembaga, dengan tujuan untuk meningkatkan keterampilan dan untuk berbagi pengetahuan dan keahlian;

Bidang kerja sama lain yang telah disepakati oleh para Pihak; PASAL 3 OTORITAS NASIONAL YANG BERKOMPETEN
1.
Atas nama Badan Narkotika Nasional Republik Indonesia: Deputi Rehabilitasi.
2.
Atas nama Direktorat Jenderal Perilaku Kecanduan dan Ketergantungan: Direktur Jenderal.
3.
Kedua lembaga akan menunjuk anggota staf mereka untuk kontak langsung. PASAL 4 KERAHASIAAN
1. lnformasi dan dokumen yang diperoleh sesuai dengan Nota Kesepahaman ini akan dijaga kerahasiaannya dan digunakan sesuai dengan tujuan, ditentukan oleh pihak yang memberikan. 2. lnformasi dan dokumen tidak akan diberikan kepada pihak ketiga tanpa persetujuan tertulis terlebih dahulu dari pihak yang memberikan. PASAL 5 PERTEMUAN
1. Untuk meninjau situasi yang terkait dengan narkoba gelap dan kemajuan yang telah dicapai dalam pelaksanaan Nota Kesepahaman ini, para Pihak sepakat untuk menjadi tuan rumah pertemuan secara berkala , baik melalui video conference atau di wilayah para Pihak secara bergantian. Dalam pertemuan-pertemuan ini, upaya-upaya bersama yang sedang berlangsung akan ditinjau ulang dan ruang lingkup kerja sama baru akan diidentifikasi dan dikembangkan.

2. Apabila diperlukan, pertemuan-pertemuan khusus dapat dilaksanakan PASAL 6 PENGATURAN BIAYA
Setiap Pihak harus menanggung biaya dan pengeluaran sendiri, kecuali disepakati oleh para Pihak berdasarkan kasus per kasus. PASAL 7 PENYELESAIAN PERSELISIHAN
Setiap
perbedaan
yang
timbul
dari
penafsiran
Kesepahaman ini akan diselesaikan secara damai
atau
pelaksanaan
Nota
oleh kedua Pihak melalui
konsultasi dan/atau jalur diplomatik. PASAL 8 AMENDEMEN
Nota Kesepahaman ini dapat diperbaiki atau diamendemen sewaktu-waktu berdasarkan kesepakatan bersama secara tertulis oleh para Pihak. Perbaikan atau amendemen dimaksud mulai berlaku sejak tanggal yang ditentukan oleh para Pihak.
PASAL 9 PEMBERLAKUAN, MASA BERLAKU DAN PENGAKHIRAN
1. Nota Kesepahaman ini mulai berlaku pada tanggal penandatanganan. 2. Nota Kesepahaman ini ---akan berlaku selama 3 (tiga) tahun dan akan diperpanjang secara otomatis untuk masa berlaku yang sama. Para Pihak dapat menghentikan kesepakatan tersebut dengan pemberitahuan tertulis 6 (enam) bulan sebelum tanggal habis masa berlaku Nota Kesepahaman ini.

0 National Narcotics Board da Republica da Indonesia e o Servi~o de lnterven~ao nos Comportamentos Aditivos e Dependencias, da Republica de Portugal, adiante designados individualmente como ((a Parte", ou coletivamente referidos como uas Partes"; Tendo presente que o problema da droga continua a ser uma seria amea~a

Expressando a vontade em desenvolver uma mol dura de coopera~ao mutua para abordar todos os aspetos da area da

Tendo em conta a necessidade de fortalecer e complementar as medidas contidas na Conven~ao Unica sobre Estupefacientes, adotada a 30 de Mar~o de 1961, o Protocolo de
Emendas
a Conven~ao Unica sobre
Estupefacientes, adotado em Genebra, -a 26 de Mar~o de
1972, a Conven~ao sobre as Substancias Psicotr6picas, adotada em Viena em 21 de Fevereiro de 1971 e a Conven~ao das Na~oes U nidas contra o Trafico llkito de Estupefacientes e Substancias Psicotr6picas, adotada em Viena, a 20 de Dezembro de 1988; Guiados pelos prindpios e objetivos dos ja existentes acordos multilaterais de coopera~ao em materia de controlo de drogas;
Reconhecendo as prindpios da soberania, igualdade e integridade territorial; Cumprindo com as leis e regulamentos existentes nos seus respetivos pafses; Acordam no que se segue:
ARTIGO 1 OBJETIVO

ARTIGO 2 AREAS DE COOPERA(:AO
A coopera~ao entre as Partes inclui :
1. Troca de informa~ao, experiencias e melhores praticas relacionadas com o consume de drogas; 2. Troca de informa~ao sabre estrategias, pianos, programas e praticas, legisla~ao e atos administrativos que visem reduzir o consume de drogas; 3. Troca de experiencias na recolha, analise e dissemina~ao de dados sabre drogas; 4. Troca de publica~oes e estudos sabre o problema das drogas; 5. Facilitar a participa~ao mutua de peritos no National Narcotics Board e do Servi~o de lnterven~ao nos Comportamentos Aditivos e Dependencias em seminaries e/ou reunioes, organizadas par qualquer uma das Partes, no ambito das suas competencias, com o objetivo de melhorar as suas qualifica~oes, partilhar conhecimento e competencias tecnicas; 6. Outras formas de coopera~ao acordadas pelas Partes.

ARTIG04 CONFIDENCIALIDADE
A informa~ao e documentos obtidos de acordo com este Memoranda de Entendimento serao sujeitos a um regime de confidencialidade e apenas serao usados pelas Partes, em conformidade com os fins estabelecidos, pela Parte detentora dos mesmos. 2. Toda a informa~ao e documentos nao poderao ser transmitidos a uma terceira Parte sem a previa autoriza~ao escrita da Parte detentora dos mesmos.

Por forma a acompanhar a situa~ao em materia de drogas e os progresses efetuados na implementa~ao deste Memoranda de Entendimento, as Partes concordam em realizar reunioes peri6dicas, seja por vfdeo-conferencia ou alternadamente no territ6rio de cada uma das Partes. Nestas reunioes, serao revistos os esfor~os em curso e identificadas novas possfveis areas de coopera~ao. Em caso de necessidade serao realizadas reunioes extraordinarias.
ARTIGO 6 ClAUSULA FINANCEIRA
Cada Parte suportara as suas despesas financeiras, exceto em casas espedficos e acordados entre as Partes, caso a caso.
ARTIG07 RESOLUtAO DE DIFERENDOS
Qualquer diferendo que surja na
interpreta~ao
ou
implementa~ao
deste Memoranda de
Entendimento sera resolvido de forma amigavel por am bas as Partes, atraves de consultas e/ou dos respetivos canais diplomaticos.

MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL NARCOTICS BOARD OF THE REPUBLIC OF INDONESIA AND THE GENERAL DIRECTORATE ON ADDICTIVE BEHAVIOURS AND DEPENDENCIES OF THE PORTUGUESE REPUBLIC ON COOPERATION ON DRUG DEMAND REDUCTION
The National Narcotics Board of the Republic of Indonesia and the General Directorate on Addictive Behaviours and Dependencies of the Portuguese Republic hereinafter referred to individually as "the Party" and collectively referred to as "the Parties"; REALIZING that the drug problem continues to pose a serious threat to health, safety and well-being of humanity and need integrating efforts of the Parties at international level; REAFFIRMING the need to promote a comprehensive and balanced approach on demand reduction, based on scientific evidence; EXPRESSING their wish to develop a framework of mutual cooperation to address all aspects of demand reduction; TAKING INTO ACCOUNT the need to strengthen and complement the measures provided in the Single Convention on Narcotic Drugs, adopted in New York, on March 30th, 1961; the Protocol Amending the Single Convention on Narcotic Drugs, adopted in Geneva, on March 26th, 1972; the Convention on Psychotropic Substances, adopted in Vienna, on February 21st, 1971, and the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, adopted in Vienna on December 20th, 1988;
BEING guided by the principles and aims of existing multilateral international agreements on drug control; RECOGNIZING the principle of sovereignty, equality and territorial integrity; PURSUANT to the prevailing laws and regulations of their respective countries;

HAVE AGREED as follows:
ARTICLE 1 PURPOSE The purpose of this Memorandum of Understanding is to promote cooperation between the Parties on drug demand reduction, in a comprehensive way, including measures to address drug use in the field of prevention, treatment, harm reduction and social reintegration.
ARTICLE 2 AREAS OF COOPERATION The cooperation between the Parties will include: 1)
Exchange of information, experience and best practices related to drug use;
2)
Exchange of information on strategies, plans, programs and practices, legislative and administrative measures aiming at reducing drug use;
3)
Sharing experience on the collection, analysis and dissemination of data on drugs;
4)
Exchange of publications and studies concerning the drug problem;
5)
Facilitating the mutual participation of experts from the National Narcotics Board and the General Directorate on Addictive Behaviours and Dependencies in seminars/meetings, organised by each Party on matters under their competence, with the aim to improve their skills, and to share knowledge and expertise;
6)
Any other areas of cooperation as agreed by the Parties.
ARTICLE 3 COMPETENT NATIONAL AUTHORITIES 1. On behalf of the National Narcotics Board of the Republic of Indonesia: the Deputy for Rehabilitation. 2. On behalf of the General Directorate on Addictive Behaviours and Dependencies: the General Director. 3. Both entities will designate a member of their staff for the maintenance of direct contacts.

ARTICLE 4 CONFIDENTIALITY 1. The information and documents obtained in accordance with this Memorandum of Understanding shall be kept confidential and be used in compliance with the purposes, determined by the providing party. 2. The information and documents shall not be transmitted to a third party without prior written authorization from the providing party.
ARTICLE 5 MEETINGS 1.
In order to review the situation dealing with illicit drugs and progress made in the implementation of this Memorandum of Understanding, the Parties agree to host meetings periodically, either through video conference or alternately in the territories of either Party. In these meetings, ongoing joint efforts shall be reviewed and new areas for cooperation may be identified and developed.
2.
In case of necessity, extraordinary meetings may be convened.
ARTICLE 6 FINANCIAL ARRANGEMENT Each Party shall bear its own cost and expenditure, unless otherwise agreed by the Parties on a case by case basis. ARTICLE 7 SETTLEMENT OF DIFFERENCES Any difference arising from the interpretation or implementation of this Memorandum of Understanding, shall be settled amicably by both Parties through consultations and/or diplomatic channel.
ARTICLE 8 AMENDMENT This Memorandum of Understanding may be revised or amended at any time by mutual written consent of both Parties. Such revision or amendment shall enter into force on the date mutually determined by both Parties.
