DEPARTEMEN KELAUTAN DAN PERIKANAN REPUBLIK INDONESIA DAN MARINE AQUARIUM COUNCIL MENGEN AI PROGRAM KERJASAMA UNTUK MEMPRPMQSIKAN SISTEM SERTIFIKASI INTERNASIONAL DARI PIHAK KETIGA DALAM PENGAMBILAN DAN EKSPOR BIOTA UNTUK AKUARIUM LAUT DI INDONESIA
Direktorat Jenderal Pesisir dan Pulau-Pulau Kecil, Departemen Kelautan dan Perikanan, Republik Indonesia (selanjutnya disebut "Ditjen P3K") dan Marine Aquarium Council, berpusat di Hawaii, Amerika Serikat (selanjutnya disebut "MAC"), dimana keduanya selanjutnya disebut " Para Pihak "; Mengingat adanya keinginan bersama yang saling menguntungkan dalam menjamin 1J?,asa depan keberlanjutan industri akuarium," sumberdaya laut, ~kan hias dan karang hias laut serta pengelolaan perikanan; · Berkeinginan untuk mendukung dan mempromosikan sistem labelisasi dan sertifikasi untuk hasil-hasil laut secara efektif; Berdasarkan hukum dan peraturan yang berlaku di Indonesia dan juga prosedurprosedur dan kebijakan Pemerintah Republik Indonesia mengenai kerjasama teknis internasional; Bersepakat sebagai berikut :
Pasal I UMUM Ditjen P3K akan merumuskan kebijakan dan pedoman untuk pengelolaan dan konservasi sumberdaya pesisir dan pulau-pulau kecil di Indonesia. Ditjen P3K akan berkoordinasi dengan institusi yang sah di ,Indonesia dalam hubungannya dengan sistem labelisasi dan sertifikas i hasil-hasil laut dalam kerangka progran1 kerjasama seperti untuk industri akuarium, sumberdaya laut dan pengelolaan perikanan.
MAC yang berkedudukan di Nu' uanu Avenue No. 923, Honolulu, Hawaii 96817Amerika Serikat adalah sebuah organisasi nir-laba internasional multi stakeholder yang memiliki misi untuk mendukung konservasi sumberdaya laut melalui mempromosikan sistem setiifikasi serta pemberian label pada perdagangan biota untuk akuarium laut. MAC bekerjasama secara erat dengan para pemangku kepentingan (multi stakeholder) dalam mernbangun sistem sertifikasi internasional dari pihak ketiga yang independen untuk menjamin bahwa hasil-hasil dan para pelaku industri telah memenuhi standar praktek kerja terbaik (Best Practices). Sistem sertifikasi yang dipromosikan oleh MAC merupakan suatu sistem yang digunakan secara sukarela terhadap daerah pengambilan ikan hias, karang, live rock, para nelayan pengambil dan eksportir yang dapat memberikan pilihan terbaik kepada para importir dan konsumen untuk mendapatkan produk biota akuarium laut yartg disertifikasi secara independen Sertifikasi yartg dipromosikan oleh MAC harus sesuai dengan kebijakan pemerintah dibidang perikanan hias laut, sejauh mungkin menghindari keterlibatannya dalam fungsi-fungsi pemerintahan yang bersifat hakiki, pengaturan dan penegakan hukum.

Pasal II TUJUAN Tujuan urnum kerjasama arttara para pihak dalam Nota Kesepahaman ini (selanjutnya disebut " MOU") adalah untuk bekerjasama dalam mengembangkart dan melaksartakart sertifikasi internasional dari pihak ketiga dalam pengambilart dart ekspor biota akuarium laut bersama-sama seluruh pemangku kepentingan di Indonesia.
Pasal III PROGRAM KERJA DAN RENCANA OPERASI Para Pihak akan bekerjasama dalam rencarta program-program sebagai berikut : I. Menyediakan tenaga ahli dan bantuan dibidang sains, ekonomi dart pembangunan sosial berkelanjutan dimasa depart bagi industri akuarium laut, yang termasuk aspek-aspek konservasi dan pengelolaan sumberdaya laut. 2. Membantu Ditjen P3K dalam mengembangkart kapasitas melalui pelatihanpelatihan yang berhubungan dengan pembangunan industri akuarium laut yang berkelartj utart. 3. Mengembangkan dart memberikart pelatihan keterampi lart kepada para nelayan pengambil tentang cara-cara/metode pengambilan dan pemeliharaan yang bertartggung jawab dan ramah Iingkungan.
4. Beke1jasama dengan pernerintah daerah dan para pemangku kepentingan didalam masyarakat dimana para nelayan pengambil akuarium laut berada.

5. Mernbangun jaringan informasi dan pendampingan serta pertukaran informasj untuk membantu penyusunan kebijakan dan pengembangan program. 6. Melakukan komunikasi dan penyadaran masyarakat dalam pembahan1an industri perdagangan akuarium laut. 7. Memberikan laporan kemajuan kepada Ditjen P3K secara periodik dalam pelaksanaan pelatihan berdasarkan standar-standar MAC dan praktek kerja terbaik (Best Practiczs), termasuk didalamnya peningkatan kapasitas, pengkaj ian sumberdaya dan monitoring.
Pasal IV
KONTRIBUSI DITJEN P3K Dalam pelaksanaan MOU ini, Ditjen P3K akan : I. Secara aktif terlibat dalam perencanaan, pengawasan, pelaksqnaan dan evaluasi kegiatan-kegiatan yang dilaksanakan berdasarkan MOU ini. 2. Menyediakan fasilitas dan dukungan logistik untuk pelaksanaan proyek-proyek yang disetujui berdasarkan MOU ini bilamana tersedia. 3. Menyediakan personii yang berkualifikasi untuk ikut dalam pelatihan dan proyekproyek yang diperlukan selama pelaksanaan program berdasarkan MOU ini. 4. Membantu pengurusan visa serta dokumen terkait lainnya bagi staf dan konsultan asing MAC yang bekerja berdasarkan MOU ini.
Pasal V KONTRIBUSI MAC Dalam pelaksanaan Nota Kesepahaman ini, MAC akan : I. Berkonsultasi dengan Ditjen P3K dalam perencanaan dan persiapan proyek atau kegiatan-kegiatan sebagaimana dimaksud dalam MOU ini untuk menjamin koordinasi dan kesesuaian program yang ditetapkan oleh Oitjen P3K berkaitan dengan isu-isu akuarium laut. 2. Membuka kantor resmi, mengangkat dan menempatkan seorang koordinator di Indonesia yang dilengkapi dengan sarana dan prasarana untuk menjamin kelancaran hubungan para pihak dan memberikan arahan kegiatan, pengembangan dan pelaksanaan proyek yang tepat.
3. Membantu dalam mengidentifikasi dan menjamin ketersediaan dukungan teknis dan pendanaan untuk pelaksanaan kegiatan-kegiatan sebagaimana dimaksud dalam MOU ini.

4. Membantu kegiatan-kegiatan administrasi, monitoring dan evaluasi kegiatan sebagaimana dimaksud dalam MOU ini. 5. Menyediakan peralatan penelitian dan fasilitas pengelolaan serta dukungan logistik untuk pelaksanaan kerjasama sebagaimana dimaksud dalam MOU ini. 6. Menyusun pedoman-pedoman untuk pengambilan dan ekspor biota akuarium laut dalam bahasa lnggris dan Indonesia.
Pasal VI
STATUSPERALATAN Peralatan dan kendaraan yang dibeli oleh MAC untuk program kerjasama ini akan menjadi milik Ditjen P3K setelah berakhirnya program.
Pasal VII
HAK KEKA YAAN INTELEKTUAL I. Setiap hak kekayaan intelektual yang dibawa oleh salah satu pihak didalam pelaksanaan kegiatan sebagaimana dimaksud dalam MOU, akan tetap menjadi milik pihak tersebut. Meskipun demikian, pihak tersebut harus menjamin bahwa hak kekayaan intelektual tersebut tidak diperoleh secara melanggar hukum dari pihak ketiga yang secara legal telah memiliki hak tersebut. Selanjutnya hak tersebut harus dapat dipertanggungjawabkan terhadap adanya klaim yang diajukan oleh pihak ketiga berkenaan dengan kepemilikan dan aspek hukum penggunaan hak kekayaan intelektual yang dibawa oleh pihak tersebut untuk pelaksanaan kegiatan-kegiatan berdasarkan MOU ini.

2. Setiap hak kekayaan intelektual, data dan informasi hasi l dari kegiatan penelitian yang dilakukan sebagaimana dimaksud dalam MOU ini akan menjadi milik kedua belah pihak. Kedua belah pihak akan diij inkan menggunakannya untuk tujuan non komersial yang tidak perlu membayar royalti. Bila hak kekayaan intelektual, data dan informasi yang dihasilkan dari kegiatan berdasarkan MOU ini digunakan untuk tujuan komersial oleh salah satu pibak, maka pihak lainnya berhak terhadap basil yang diperoleh dari eksploitasi terhadap properti tersebut berdasarkan pada prinsip pembagian yang adil. Dalam kasus seperti itu, obyek kegiatan penelitian yang dilaksanakan berdasarkan MOU ini akan merupakan bagian kontribusi dari pihak dimana obyek kegiatan penelitian tersebut berasal. 3. Jika salah satu pihak berkeinginan untuk memberikan informasi dalam bentuk tertulis yang dianggap memiliki sifat rahasia dari kegiatan berdasarkan MOU ini kepada pihak ketiga, maka pihak yang ingin memberikan informasi harus mendapat

ijin tertulis terlebih dahulu dari pihak lainnya sebelum pemberian informasi tersebut terlaksana. 4. Apabila salah satu pihak membutuhkan ke1jasama dengan pihak lain di luar Indonesia untuk mengembangkan setiap produk komersial berdasarkan kekayaan intelektual dibawah MOU ini, maka pihak tersebut akan memberikan pilihan pertama untuk bekerjasama pada pihak yang bersepakat dalam MOU ini, kecuali pihak tersebut tidak bersedia bekerjasama dalam kerangka saling menguntungkan. 5. Apabila memungkinkan, setiap royalti yang diperoleh oleh para pihak dari hasil eksploitasi kekayaan intelektual atau melalui kegiatan-kegiatan komersial yang terkait, dapat dibayarkan untuk tujuan konservasi di Indonesia melalui permohonan. 6. Penghentian MOU ini tidak akan mempengaruhi hak dan kewajiban dalam pasal ini selama sepuluh tahun pertama sejak penghentian.
Pasal VIII BAT ASAN KEGIAT AN MAC DAN PERSONILNY A I. MAC menjamin bahwa personilnya yang bekerja dalam program kerjasama berdasarkan MOU ini tidak akan terlibat dalam kegiatan politik atau melakukan kegiatan usaha di Indonesia di luar program yang telah disepakati tanpa persetujuan dari Pemerintah Indonesia melalui Sekretariat Kabinet.

2. Untuk mendukung kegiatan-kegiatan dari program berdasarkan MOU ini, MAC akan mengumpulkan dana dari sumber-sumber pembiayaan hanya dari luar Indonesia.
Pasal IX TANGGUNG JAWAB PUBLIK I. Dalam ha! terjadinya kerusakan material atau kecelakaan yang diakibatkan oleh kesengajaan atau kelalaian selama pelaksanaan proyek berdasarkan MOU ini, maka pihak Ditjen P3K atau MAC tidak akan saling mengajukan tuntutan atau kompensasi. 2. Ketentuan ini tidak membebaskan setiap personil MAC dari tanggung jawab atas tindakan kriminal, kelalaian atau penipuan.

Pasal X PENYELESAIAN PERSELISIHAN Setiap perselisihan atau perbedaan yang timbul dalam ha! penafsiran atau pelaksanaan dari MOU ini, harus diselesaikan secara damai melalui konsultasi atau negosiasi diantara para pihak.

The Directorate General of Coasts arid Small Islands, Ministry of Marine Affairs and Fisheries of the Republic Indonesia (hereinafh~r refen:ed to ·as " DGCSI") and the Marine Aquarium' Council, based in Hawaii, the Uruted States of America (hereinafter referred to as. " MAC" ), in which both of them hereinafter being .referred to as " the Parties";

Bearing in mind the mutual interest· in ~nsuring a su~tainabie future fo r the aquarium industry, marine resources and marine ornamentals and fisheries management; '
Desiring to 'support and promote the certification and labeling' systems for marine products effectively; '
Pursuant to the prevailing laws and . regulations in· Indonesia, as well as procedures and policies of the Government of the Republic of ·Indonesia concerning international technical cooperation;
HAVE AGREED AS FOLLOWS :
ARTICLE I
GENERAL ' The DGCSI· shali formulate p.olicy and guidelines for the management and conservation of coastal and small island resources in Indonesia.. The DGCSI shall coord~I).at~ .with the authorized agencies in Indonesia relating to the certification and labeling system for marine products in the framework ~

collaborative programs such as for the aquarium industry, marine resources and marine ornamentals and fisheries management. MAC having place on 923 Nu'uanu Avenue, Honolulu, Hawaii 968 I7 - USA is a non-profit international multi-stakeholder organization whose mission is to achieve conservation of marine resources through certification and labeling for the marine ornamentals trade. MAC is working closely with concerned stakeholders to establish an independent third party international certification system to ensure that products and industry operators comply with ::>tandards of best prac!ict. MAC certification i~ a voluntary mechanism that is ava)~at,le to aquarium fish, c~nal and iivc rock collection areas, collectors, and exporter:; \.Vii.:· V·1.n:!c; like to take the importers and consumer's strong preference for independently certi~ied marine ornamemals, MAC certification shall not infringe on the govemmei1t'~ Mandate to develop Indonesian marine ornamentals fishery, much less preclude concerned government institutions from performing their intrinsic, regulatory and t>nforceni.ent functions;
ARTICLE II
OBJECTIVE The general objective of the cooperation between thf.. Parties under this Memorandum of Understanding (hereinafter referred to as the "MOU") is to collaborate on the development and implementation of an independent international third party certification for collection and export of marine ornamentals with ail stakeholders in Indo;1esia.
ARTICLE Ill

PROGRAM DIRECTION AND PLAN OF OPERATION ~l 'he

1. Pro viding expert service and tech.nicai assistance on scienrific, economic, and social
development of a sustainable future for the marine aquarium industry, which includes aspects of conservation and marine natural resource management. 2. Assisting DGCSI in building the capacity of DGCSI through training related to the development of a sustainable marine aquarium industry. 3. Developing and delivering of skills training to collectors on responsible and environmentally sound harvesti ng methods and husbandry.
4. Working with local governments and other stakeholders marine ornamentals collectors are based.

5. Setting up information/outreach networks, and exchanging information in aid of policy formulation and program development. 6. Undertaking communication and public awareness-raising for aquarium trade industry reform. 7. Providing DGCSI with periodical progress reports on the implementation of the training of MAC Standards and Best Practices, which includes capacity building, resource assesment and monitoring.
ARTICLE IV
CONTRIBUTION OF DGCSI For implementation of this MOU, the DGCSI shall: 1. Actively be involved in the planning, supervision, implementation and evaluation of the activities implemented under this MOU. 2. Provide facilities and logistical support for the approved projects implemented under this MOU whenever available. 3. Provide qualified personnel to participate in training and projects as needed for the implementation of the program under this MOU. 4. Assist in and arranging visas and other work related documents, of MAC expatriate staff and consultants who are affiliated with activities undertaken under this MOU.
ARTICLE V
CONTRIBUTION OF MAC For implementation of this MOU, MAC shall:
J. Consult with DGCSI in the planning and preparation of projects, or act1v1t1es contemplated under the MOU to ensure coordination and compatibility of programs set by the DGCSI regarding marine aquarium issues. 2. Establish a legal office, appoint and maintain in Indonesia a Country Coordinator with the necessary resources to ensure adequate liaison between the parties and to provide for appropriate project direction, development and implementation. 3. Assisting in identifying and securing sufficient funding and technical support for the activities being considered for implementation under this MOU.
4. Assist in administration, monitoring and evaluation of activities under this MOU. 5. Provide equipment research supplies and management faci li ties and logistical support for the implementation of cooperation under this MOU. 6. Produce guidelines for collection and export of marine ornamentals in English and Indonesian languages.
ARTICLE VI
STATUS OF EQUIPMENT Equipment and vehicles purchased by MAC for the collaborative program shall become the property of the DGCSI after the termination of the program.
ARTICLE VII
INTELECTUAL PROPERTY RIGHTS I. Any intellectual property right brought by one of the Parties for the implementation of the activities under this MOU shall remain the property of that Party. However, that party shall have indemnity so that the intellectual property right has not resulted from the infringement of any third party's legitimate rights. Further, that right shall be liable for any claim made by any third party on the ownership and legally of the use of intellectual property rights which are brought in by the aforementioned Party for the implementation of the activities under this MOU.

2. Any intellectual property right, data and information resulting from research activities conducted under this MOU shall be jointly owned by both parties, and both parties shall be allowed to use such property for non-commercial purposes free of royalty. Should the intellectual property right, data and information resulted from the activities under this MOU be used for commercial purposes by one Party, the other Party shall be entitled to the royalties obtained from the exploitation of such property on the basis of the principle of equitable contribution. In such a case, the object of the research activities conducted under this MOU shall constitute a part of a contribution of the Party from which the object derives. 3. If either party wishes to disclose information identified in writing as confidential resulting from activities under this MOU to any third party, the disclosing Party must obtain prior consent from the other Party before any disclosure can be made. 4. Whenever either Party requires the cooperation of another party outside fndonesia to develop any commercial product based on intellectual property covered by this MOU, this Party will give first preference to the cooperation to the other Party under this MOU, which will be waived if the other Party is unable to participate in a mutually beneficial manner.
5. Whenever possible, any royalties obtained by either Party from the exploitation of intellectual property or by related commercial activities may be paid by applying the royalties due to conservation in Indonesia. 6. Termination of this MOU shall not affect rights or obligations under this article during the first ten years after termination.
ARTICLE VIII
LIMITATION OF ACTIVITIES OF MAC AND ITS PERSONNEL I. MAC assures that its personnel in the cooperative program under this MOU shall not engage in political affairs or any ventures or activities in Indonesia outside the program without the prior approval of the Government of the Republic of Indonesia through the Cabinet Secretariat. 2. To support its program of activities under this MOU, MAC shall raise funds from financial resources outside Indonesia only.
ARTICLE IX
CIVIL LIABILITY I. In the event of any material damage or injury owing to an accident for any reason other than those resulted from willful misconduct or negligence during the implementation of the project under this MOU, no compensation will be claimed against either by DGCSI or MAC. 2. The provision shall not relieve any MAC personnel from liability for any criminal, gross negligence or fraudulent act.

ARTICLE X
SETTLEMENT OF DISPUTES Any disputes or differences arising out of the interpretation or implementation of this MOU shall be settled amicably through consultation or negotiation between the paities.
ARTICLE XI
AMENDMENTS This Memorandum of Understanding may be amended or modified at any time, as agreed by both parties in writing by mutual consent of the Pa11ies.
ARTICLE XII
ENTRY INTO FORCE DURATION AND TERMINATION I. This Memorandum of Understanding shall enter into fo rce on the date of its signature and shall be valid for 5 (five) years and shall be automatically extended or renewed for an additional 5 (five) years thereafter unless by either Party intends to terminate it by giving written notification to the other Party at least 6 (six) months before the expiration or terminated or replaced with a revised MOU. 2. The termination of this MOU shall not affect the ongoing programs until the completion of such programs under this MOU.
