Please describe briefly the legal context of implementation of the RES Directive 2009/28/EC in your country: max 150 words The common European framework (2009/28/EC Directive) for the promotion of energy from renewable sources has been implemented according to the laws of the EU and Hungary in the form of national laws, government decrees and decrees of the relevant ministries. For the detailed list of legislation see Annex I. 3. Please describe briefly the general status of implementation of the RES Directive 2009/28/EC in your country: max 150 words The implementation of the directive started in 2010 and it proceeds towards the goals set for 2020. The Ministry of National Development is the responsible body for the coordination of the implementation but other ministries (Ministry of Rural Development, Ministry of Interior, and Ministry of National Economy) and relevant institutions (e.g. Hungarian Energy Office, Energy Centre, etc.) were also involved in the procedure. 4. Please describe briefly at least 2 key activities for implementation of the RES Directive 2009/28/EC conducted and/or planned in your country. Sustainable criteria system for production of biofuels and bioliquids in Hungary
Articles 17-19 and 21 of the RED Directive have been implemented in the following legislations: Law on biofuels (2010. CXVII. Law) Decree on requirements and certification of sustainable biofuel production (343/2010. (XII.28.) government decree) Decree on avoidance of GHG-emission (36/2010. (XII.31.) MND decree) Decree on the territoies of sustainable production of raw materials for the purpose of biofuel production (42/2010. (XII.20.) MRD decree) Decree on quality requirements of motor propellants (30/2011. (VI.28.) MND decree) Decree on implementation of the law on electricity (273/2007. (X.19.) government decree) Scope of the above mentioned legislation covers all the relevant definitions, interpretative provisions, the explanation of and obligations towards a sustainable system of biofuel production in Hungary. The target groups are set in the legislation and they cover all the participants/market players of the biofuels’ value chain. Chain of custody and the mass balance system are also named in the legislation documents. The purpose of the legislation, that is to set up a sustainable criteria system for biofuel production in Hungary, has been achieved. This means that Hungary has set up a national scheme on time, but later on those voluntary schemes that had been approved by the European Commission, have also become eligible ones according to the national legislation.

One of the main financial support scheme for renewable energy technologies in Hungary is EEOP (Environment and Energy Operational Programme) 20114.2.0/A: Local heat and cooling supply from renewable sources (automatic evaluation). The support scheme is funded by the European Regional Development Fund (85%) and by the Hungarian State (15%). In the frame of this scheme, decentralized small scale RES technologies are preferred. Only projects under support demand of 50 million Forints are subsidised. The main beneficiaries of the financial support scheme are: enterprises, public administration and institutions, NGOs and other companies. Eligible costs are available between 30-85% depending on type of organization. The maximum share of support is 50% for SMEs and 85% for public institutions. There is no variation of support level by type of technology or by size. In the frame of this support scheme, the following renewable energy technologies are supported: solar thermal energy systems, photovoltaic energy systems, solid biomass boilers, heat pump systems (excluding air-air heat pumps). Every technology has to fulfil specific technical requirements. Projects are evaluated and selected by simplified methodology. Projects do not fall under detailed technical evaluation carried out by energy experts. Projects that fulfil the formal and technical criteria are automatically supported. In this way application is significantly simpler and evaluation is quicker that suits for renewable energy investors. The total amount of support contracted is 6.4 billion HUF (cca. 22.1 Million EUR at exchange rate of 290 HUF/EUR). The total investment that mobilized thanks to the support is 9.7 billion HUF (cca. 33.5 Million EUR at exchange rate of 290 HUF/EUR). Planned increase of renewable heat utilization thanks to the investments is 50 544 GJ/year. Planned increase of renewable based electricity production is 6 928 MWh/year. Planned decrease of greenhouse gas emission resulted by the scheme is 9 410 t/year. The supporting scheme is regulated by the Decree No 9/2010 (I. 21.) NFGM laying down the detailed rules governing the use of funds allocated to the priorities of the Environment and Energy Operational Programme and on certain titles of support. The managing authority of the program is the National Development Agency. The implementation body is Energy Centre Non-Profit Limited Company.
