PROGRAM KERJASAMA KEBUDAYAAN AN TARA DEPARTEMEN KEBUDAYAAN DAN PARIWISATA REPUBLIK INDONESIA DAN LEMBAGA KEBUDAYAAN DAN SINEMATOGRAFI (FEDERASI RUSIA) TAHUN 2008-2010
Departemen Kebudayaan dan Pariwisata Republik Indonesia dan Lembaga Kebudayaan dan Sinematografi (Federasi Rusia) , selanjutnya disebut " Para Pihak " ; untuk meningkatkan perluasan hubungan Berhasra t kebudayaan dan persahabatan antara kedua negara dan masyarakat;
Merujuk Indonesia Kerjasama Lumpur pada
pada Persetujuan antara Pemerintah Republik dan Pemerintah Federasi Rusia tentang Kebudayaan yang ditandatangani di Kuala tanggal 14 November 1998 ;
Sesuai dengan hukum dan peraturan perundangundangan yang berlaku di negara masing-masing, Telah mencapai saling pengertian mengenai perumusan Program Kerjasama Kebudayaan untuk tahun 2008-2010 sebagai berikut : Pasal 1
Para pihak akan mengadakan Hari Kebudayaan Rusia di Indonesia dan Hari Kebudayaan Indonesia di Federasi Rusia . Para Pihak akan saling mengirim dan menerima pemusik dan penari kenamaan , film untuk festival film, pameran foto dan delegasi .
Pasal 2
Para Pihak sepakat bahwa penga tu ran ( wa kt u, tempa t dan jumlah anggota delegasi) dan masalah pembiayaan untuk penyelenggaraan Hari Kebudayaan Rusia di Indonesia dan Har i Kebudayaan Indonesia di Rusia serta program - programnya akan diatur dalam dokumen terpisah.
Pasal 3
Para Pihak akan mendorong pertukaran kunjungan berbagai kelompok mus i kal , tea ter , balet , kesenian daerah dan seni , seniman individual dan insan film .
Pasal 4
Para Pihak akan mendorong pengembangan kerjasama da l am bidang seni klasik , pameran , lokakarya kebudayaan, pekan raya p r oduk kerajinan tangan, dan mendorong pertukaran delegasi seniman dan pengrajin terampil , kr i ti kus sen i, spes ial is sen i budaya tradit i onal , dan bidang - bidang lain yang terkait dengan studi kebudayaan .
Pasal 5
Para Pihak akan memberikan bantuan kepada perpustakaan - perpustakaan, museum - museum , arsip - arsip , insti tusi pendidikan dan i l mu pengetahuan yang utama serta lembaga yang ter l ibat dalam upaya perlindungan dan pemugaran serta konservasi warisan sejarah dan budaya di kedua negara .
Pasal 6
Para Pihak akan melakukan pertukaran delegasi spesialis dalam bidang musik , teater , seni klasik dan tradisional , perlindungan dan pemugaran benda warisan budaya , perpustakaan dan pengelolaan museum, serta peneliti - peneliti untuk pertukaran pengalaman antara lembaga kebudayaan masing-masing dan berpartisipasi da l am konferensi-konferensi, simposium-simposium dan pertemuan-pertemuan yang diadakan di kedua negara .
Pasal 7
Para Pihak akan memfasilitasi pengembangan kerjasama antara perhimpunan seniman dan asosiasi kebudayaan di kedua negara .
Pasal 8
Pihak Rusia telah siap mengirimkan guru-guru untuk musik , balet , seni lukis dan profesi lainnya untuk bekerja di lembaga - lembaga kebudayaan Indonesia dalam kontrak jangka panjang jika dikehendaki oleh Pihak Indonesia . Pengaturan kontrak yang akan ditandatangani akan dirundingkan secara terpisah antara organisasi terkait dari Para Pihak .
Pasal 9
Program ini tidak menutup kemungkinan adanya bentukbentuk kerj asama lain yang dilaksanakan oleh Para Pihak berdasarkan kesepakatan bersama .
Pasal 10
Kecuali jika disepakati lain , pengaturan keuangan untuk pelaksanaan Program ini akan dilaksanakan melalui pembuatan pengaturan - pengaturan khusus atau protokol terpisah antara Para Pihak .
Pasal 11
Pengaturan rinci yang berhubungan dengan pelaksanaan kegiatan-kegiatan tertentu berdasarkan Program ini akan dinegosiasikan oleh Para Pihak berdasarkan kasus per kasus .
Pasa1 12
Para Pihak akan mengajukan kepada Kementerian Luar Negeri di negaranya untuk menerbitkan visa yang sesuai bagi peserta kegiatan budaya dan anggota-anggota delegasi kebudayaan .
Pasal 13
Program ini tidak dianggap sebagai perjanjian internasional dan tidak menimbulkan kewajiban sebagaimana diatur dalam hukum internasional .
Pasal 14
Masing-masing Pihak akan memberikan perlindungan atas kekayaan intelektual sesuai dengan perjanJlan internasional dimana Federas i Rusia dan Republik Indonesia berpartis ipasi, dan sesuai dengan hukum nasional yang berlaku di masing-masing negara . Pasal 15
Perubahan dan perselisihan apapun di antara Para Pihak a kan diselesaikan berdasarkan ketentuan Persetuj uan an tara Pemerintah Rusia dan Federasi Pemerintah Republik Indonesia mengenai Kerjasama Kebudayaan , yang ditandatangani di Kua la Lumpur pada tanggal 14 November 1998 .
Program ini dibuat dalam rangkap dua di Jakarta , pada tanggal 6 (enam) bulan September tahun dua ribu tujuh , da l am bahasa Indonesia , Rusia dan Inggris. Dalam ha l terjadi perbedaan penafsiran te rha dap Program Kerjasama ini maka naskah dalam bahasa Inggris yang digunakan .

PROGRAM OF CULTURAL COOPERATION BETWEEN THE MINISTRY OF CULTURE AND TOURISM OF THE REPUBLIC OF INDONESIA AND
THE FEDERAL AGENCY FOR CULTURE AND CINEMATOGRAPHY (RUSSIAN FEDERATION) FOR THE YEARS 2008 - 2010
The Ministry of Culture and Tourism of the Republic of Indonesia and the Federal Agency for Culture and Cinematography of the Russian Federation , hereinafter referred to as " the Parties ", to strengthen and develop cultural ties friendship between the two countries and peoples ;
Desiring
and
Referring to the Agreement between the Government of the
Republic of Indonesia and the Government of the Russian Federation on Cultural Cooperation , done at Kuala Lumpur on 14 November 1998 ; to the prevailing laws respective countries ;
Pursuant

this Program of Cultural Cooperation for the years 2008 2010, as follows : Article 1
The Parties shall hold the Days of Russian Culture in Indonesia and the Days of Indonesian Culture in the Russian Federation . Both Parties will send and receive leading musical and dance performers , fil ms for a film festival , photo exhibition and a delegation vice versa .
Article 2
The Parties accept that organizational (time , venue, number of delegates) and financial conditions of hold i ng the Days of Russian Culture in Indonesia and the Days of Indonesian Culture in Russia as well as their programs will be subject to separate protocols .
Article 3
The Parties will encourage exchange of visits of various musical, theater, ballet, folk, artistic and theater troupes , individual performers and specialists in cinematography . Article 4
The Parties will promote the development of cooperation in the field of the fine arts, exhibitions, cultural workshops, fairs of handicrafts products, foster the exchange of delegations of artists and skilled handicraftsmen, art critics, specialist in traditional folk art, folklore and other fields related to the study of culture .
Article 5
The Parties will render assistance to the leading libraries, museums, archives, educational and scientific institutions and establishments involved in protection and restoration as well as conservation of historical and cultural heritages of both countries .
Article 6
The Parties will exchange delegations of specialists in the field of music theatre, fine and folk arts, protection and restoration of objects of cultural heritage, library and museum management as well as of researchers for exchange of experience between respective cultural establishments and participation in conferences , symposia and meetings held in both countries .
Article 7
The Parties will facilitate the cooperation between artists unions associations of both countries .

Article 8
The Russian Party is ready to send teachers of music, ballet, painting art and other professions to work in cultural establishments of Indonesia under long - term contracts if required by the Indonesian Side . The condition of the contract to be signed will be the subject to separate negotiations between the Parties' relevant organizations .
Article 9
The present Program does not exclude any other forms of cultural cooperation that may be taken based on mutual consent of the Parties.
Article 10
Unless agreed otherwise , financial terms of the implementation of this Program may be implemented through the development of specific arrangements or separate protocol between the Parties .
Article 11
The detailed arrangements related to the implementation of the specific activities under this Program will be negotiated by the Parties on case by case basis . Article 12
The Parties shall apply to the ministries of foreign affairs of its countries for appropriate visas for the participants of cultural events as well as for members of cultural delegations.
Article 13
The Program is not considered as the international treaty and does not create obligations adjustable by international law .
Article 14
Each party shall provide the protection of the intellectual property in accordance with the international treaties in which the Russian Federation and the Republic of Indonesia take part as well as in accordance with domestic law in force in their respective countries . Article 15
Any amendment and dispute between the Parties shall be settled on the basis of the provisions of Agreement between the Government of the Russian Federation and the Government of the Republic of Indonesia on Cultural Cooperation , done at Kuala Lumpur on 14 November 1998.
This Program is done in duplicate at Jakarta , on this 6th of September 2007, in Indonesian, Russian and English languages. In case of any divergence of interpretation , the English text shall be used .
