ABSTRAK: PEMODELAN TATA KELOLA PERLINDUNGAN TOKO TRADISIONAL BERBASIS OPERA FRAMEWORK HAK ASASI MANUSIA DI KOTA MALANG
Perkembangan jaringan toko modern di kota Malang semakin tidak terkendali dengan dampak negatif berupa pelemahan kapasitas dan akses hak-hak ekonomi toko tradisional yang merupakan bagian dari usaha mikro, kecil dan menengah (UMKM toko tradisional). UMKM toko tradisional menempati posisi yang sangat penting dalam kehidupan masyarakat karena selain aset ekonomi negara juga merupakan aset budaya dalam sistem sosial kemasyarakatan. Pelemahan UMKM toko tradisional secara otomatis juga akan berdampak kepada pelemahan ekonomi dan budaya masyarakat. Pemerintah baik pusat maupun daerah tidak melindungi secara efektif hak dan kepentingan UMKM toko tradisional ketika harus menghadapi penetrasi bisnis jaringan toko modern baik yang nasional maupun internasional. Hukum dan kebijakan yang sudah dikeluarkan tidak dapat berjalan dengan efektif untuk menciptakan persaingan pasar yang sehat dan berkeadilan. Penelitian ini telah mengungkapkan bahwa berdasarkan penggunaan metode kerangka kerja OPERA Hak Asasi Manusia, Pemerintah Kota Malang belum secara maksimal mendayagunakan kewenangan hukum yang dimilikinya, merevitalisasi kebijakan dan struktur kelembagaannya, serta mendistribusikan sumber daya yang dimilikinya untuk secara efektif melindungi dan memberdayakan toko tradisional sebagai salah satu bentuk kewajiban kewajiban negara terhadap warganya di bidang hak asasi manusia. ABSTRACT:
MODELLING PROTECTION FOR TRADITIONAL SMALL RETAILER BASED ON HUMAN RIGHTS OPERA FRAMEWORK IN THE MUNICIPALITY OF MALANG
The fast growing of modern retailer network in the municipality of Malang has not been well controlled by local authority and as result has undermined capacity of traditional small retailer to enjoy their economic rights. Small traditional retailer hold very important position in the community cause of its economic and cultural function in the social system; therefore, weakening small traditional retailer to some extent has negative impacts towards economic and culutural sector. Government has not provide sufficient protection for economic interest of traditional small retailer when their market has been penetrated by modern retailer company which supported by strong capital and business network nationallya and internationally. Law and policy are now very powerless and ineffective to promote fair and just market especially. This research has confirmed that local government of Municipality of Malang has no capability in impementing enforceable law and policy to manage protection for traditional small retailer in an unfair and unjust market although the government has been supported by sufficient financial resources and institutional instruments. RINGKASAN: PEMODELAN TATA KELOLA PERLINDUNGAN TOKO TRADISIONAL BERBASIS OPERA FRAMEWORK HAK ASASI MANUSIA DI KOTA MALANG Permasalahan utama dalam penelitian ini adalah tentang tata kelola perlindungan terhadap toko tradisional di era liberalisasi dan masifnya ekspansi jaringan toko modern hingga ke tingkat daerah sehingga mempengaruhi preferensi konsumen untuk beralih dari kebiasaan berbelanja di toko tradisional yang bersifat usaha perseorangan dan rumah tangga ke gerai-gerai toko modern yang dekat, lengkap dan lebih tertata pola pelayanan dan fasilitas tambahannya seperti parkir gratis dan ruangan berpendingin. Dengan metode penelitian sociolegal, fenomena persaingan ekonomi tingkat lokal yang tidak seimbang baik secara modal maupun jaringan tersebut ditinjau dari segi kewajiban negara di bidang hak asasi manusia yaitu untuk melindungi, menghormati, dan memenuhi hak-hak ekonomi pengusaha UMKM toko tradisional. Alat analisis yang digunakan dalam mengurai permasalahan tersebut adalah metode kerangka kerja OPERA hak asasi manusia yang secara singkat meliputi empat tahapan utama yaitu Outcome (aspek penikmatan hak oleh pelaku usaha toko tradisional), Policy Effort (aspek pemenuhan kelengkapan pengaturan dan implementasinya oleh pemerintah lokal), Resource (aspek penggunaan sumberdaya baik yang potensi maupun aktual di tingkat lokal oleh pemerintah), dan Assesment (agregasi penilaian tahapan sebelumnya sehingga menjadi rekomendasi solusi). Toko tradisional merupakan industri perdagangan tingkat mikro yang secara hukum mendapatkan privilege perlindungan berdasarkan Undang-Undang Nomor 20 Tahun 2008 tentang UMKM, Peraturan Presiden Nomor 112 Nomor 2007 tentang Penataan dan Pembinaan Pasar Tradisional, Pusat Perbelanjaan dan Toko Modern, serta Peraturan Daerah Kota Malang Nomor 8 Tahun 2010 tentang Penyelenggaraan Usaha Perindustrian dan Perdagangan. Pemberdayaan dan perlindungan UMKM toko tradisional yang secara normatif menjadi tanggung jawab pemerintah dan pemeirntah daerah mencakup aspek pendanaan, sarana dan prasarana, informasi usaha, kemitraan, perizinan usaha, kesempatan berusaha, promosi dagang, dan dukungan kelembagaan. Sumberdaya yang dimiliki oleh Pemerintah Kota Malang belum teroptimalisasi untuk mengelola perlindungan toko tradisional dengan indikasi berupa pembiaran praktek ekspansi toko moderen yang melanggar norma hukum dan telah menggerus potensi pasar yang dimiliki oleh toko tradisional. Struktur hukum, kebijakan maupun kelembagaan di tingkat lokal Kota Malang juga belum menjadi cerminan dari tata kelola perlindungan toko tradisional karena masih bersifat umum, bias dan secara penegakan hukum juga tidak dilengkapi dengan instrumen dapat berfungsi secara efektif dan proaktif. Tata kelola perlindungan toko tradisional yang efektif dimulai dari proses penilaian terhadap ketidakefektifan tata kelola perlindungan toko tradisional yang saat ini ada dengan menggunakan metode kerangka kerja OPERA HAM sehingga dihasilkan penilaian-penilaian yang komprehensif. Hasil penilaian tersebut kemudian diklasifikasikan berdasarkan aspek kontribusinya apakah bersifat positif yang artinya konstruktif ataukah bersifat negatif yang berarti bersifat destruktif, inefektif, berpotensi terhadap penyalahgunaan atau tidak relevan. Terhadap hasil penilaian yang berklasifikasi positif kemudian dilakukan penguatan-penguatan seperti pelipatgandaan pengaruh dan dampaknya, pengarusutamaan pada tindakan administratif pemerintah, serta menjaga konsistensi dan keberlanjutannya. Sedangkan terhadap hasil penilaian yang berklasifikasi negatif akan dilakukan proses evaluasi melalui mekanisme perubahan peraturan perundang-undangan, pembuatan peraturan perundang-undangan, pembuatan dan/atau perubahan kebijakan, serta penyelerasan dan penyesuaian kelembagaan termasuk alternatif perluasan kewenangan maupun pembuatan struktur baru dalam sistem pemerintahan daerah. Pada saat melakukan proses evaluasi hasil penilaian negatif dan penguatan hasil penilaian positif maka secara simultan dilakukan proses kolaborasi sehingga hasil kedua klasifikasi penilaian tersebut akan saling menunjang satu dengan yang lainnya untuk menghasilkan formula baru tata kelola perlindungan toko tradisional di daerah yang lebih efektif dan berkeadilan.
Pemerintah Kota Malang perlu menerbitkan lebih detail lagi instrumen hukum baik berupa kebijakan administratif maupun peraturan daerah untuk menindaklanjuti ketentuan-ketentuan yang sudah ada terkait tata kelola perlindungan toko tradisional. Peraturan perundang-undangan yang sudah ada saat ini juga mempunyai potensi untuk diberdayakan sebagai mekanisme tata kelola perlindungan akan tetapi sangat membutuhkan kemauan politik (political will) yang sangat kuat dari pemerintah daerah untuk menegakkannya sekaligus menggunakan kewenangan-kewenangan diskresinya. Pada sisi lain, metode kerangka kerja OPERA hak asasi manusia mempunyai kapasitas untuk diberdayakan sebagai alat evaluasi maupun peningkatan efektifitas tata kelola pemerintahan sehingga sangat tepat jika diadopsi menjadi salah satu alat bantu dalam penyusunan program-program pembangunan di daerah umumnya dan di pemerintahan Kota Malang khususnya. Dengan mengadopsi metode tersebut maka pemenuhan kewajiban negara khususnya pemerintah daerah dalam perlindungan, penghormatan dan pemenuhan hak asasi manusia bagi warganya dapat terwujud dan akan meningkatkan kredibilitas pemerintah daerah baik hadapan warganya maupun di mata dunia internasional.
SUMMARY: MODELLING PROTECTION FOR TRADITIONAL SMALL RETAILER BASED ON HUMAN RIGHTS OPERA FRAMEWORK IN THE MUNICIPALITY OF MALANG
The main problem of this research is about protection on the traditional retailer in the era of liberalization and massive expansion of modern chain stores up to the local level which affecting consumer preference to move away from the habit of shopping at traditional stores to the modern chain store. By applying sociolegal methods, this research has analyzed such phenomenon of economic competition at the local level which is not fair and balance both in capital and business network aspects in terms of State obligations in the field of human rights that is to protect, to respect and to fulfill economic rights towards traditional micro retailer. Analysis tools used in understanding the problem is the human rights OPERA framework which briefly covers the four main steps which are Outcome (aspect enjoyment of the right by the actor of micro traditional retailer), Policy Effort (law and regulation compliance by local governments), Resource (maximizing the use of both potential and actual resources at local level by the government), and Assessment (aggregating all assessment from previous steps before making a recommendation for final solution). Traditional micro retaliler is micro-level trading industry that legally obtain privilege protection under Law No. 20 Year 2008 on MSME, Presidential Decree No. 112 of 2007 on Management and Development of Traditional Markets, Shopping Centers and Modern Stores and Malang Regional Regulation No. 8 Year 2010 on Implementation of Business Industry and Trade. Empowerment and protection of micro traditional retailer normatively is part of local government’s responsibility in the area of capital, infrastructure, information, business, partnership, business licensing, business opportunities, trade promotion, and institutional support. Resources owned by the Government of Malang yet optimized to manage the protection of micro traditional retailer which reflected by massive and uncontrolled expansion of modern chain stores that violate the law and has eroded the market of micro traditional retailer. Law and regulation, policies and institutions at the local level of Malang is not also a manifestation of good governance for the protection of micro traditional retailer, bias and law enforcement does not also work effectively and proactively. Effective protection of micro traditional retailer starting from the assessment to the ineffectiveness of protections that currently exist by using human rights OPERA framework to produce comprehensive assessments. Assessment results are then classified based on whether they are contribute positively which means constructive or negative nature which means destructive, ineffective, potentially against misuse or irrelevant. The results of assessments classified as positive then are magnified their effect and impact by mainstreaming in government administrative action, as well as maintaining consistency and sustainability. While the results of the assessment which classified as negative then be used in the evaluation process through the mechanism of changes in laws and regulations, creation of legislation, policy changes, as well as institutional adjustments included establishment of alternative structures in the government system.
