Executive Summary 1.1

Project Description The RRDP project is aided project of ADB loans (No.2817-INO) and financing IDB (No.0161-IND). The proposed Project 1 will improve strategic national road corridors in northern Kalimantan and southern Java to support economic growth in these two less developed and poorer areas of Indonesia. The National Road network in southern Java is incomplete, with some road sections of the southern Trans Java Highway not yet constructed resulting in gaps in the network. Similarly, road network improvements are needed to support economic development in the less developed and remote districts in northern Kalimantan and road connections in Kalimantan to the border. The project includes a component for the rehabilitation of 476 km of national roads consisting of new construction, resurfacing and widening and bridge 3390 meters in two (2) Provinces in Java and two (2) Provinces in Kalimantan.

Current Implementation Situation 1.2.1

Procurement All sub-projects started with pre-qualification in 20 December 2011 through ICB procurement process. West Kalimantan One (1) of the three (3) packages in West Kalimantan, CW-05 (SosokTayan; Tanjung – Batas Kota Sanggau), Bid Documents were submitted to ADB on 25 April 2014; ADB commented

on the draft Bidding

Documents (retendering) on 23 June 2014 and agreed that DGH may apply the full e-procurement system for this package as a pilot test. Bid opening (Re-tender) for package 30RCP01 (CW-05) (Sosok – Tayan) was held on 9 September 2014 and Bid Evaluation Report (BER) sent to ADB. However, ADB instructed DGH by letter to open an additional bid which was submitted by Spanish Contractor not previously accepted. POKJA sent revised BER to ADB on 22 October 2014 including the additional bid opening result held on 16 October 2014. ADB issued “No Objection Letter” on 9 December 2014 and Minister approved BER on 11 December 2014. East Kalimantan Revised Bid Evaluation Report IV for package 34-RCP01(CW-08) was sent to ADB on 11 September 2014 and was concurred by ADB on 25 September 2014. Contract was signed 3 November 2014; ADB concurred with the contract on 19 November 2014. Commencement of Work NTP was issued on 12 December 2014.

Central Java Bid opening for 3 Packages; 24-RCP-01(CW-01) (Tambakmulyo – Wawar), 24-RCP-02(CW-02) (Giriwoyo - Duwet (Section 1)) and 24RCP-03(CW-03) (Wawar - Congot), was held on 15 July 2014 at Semarang, Central Java. The Procurement Team completed the Bid Evaluation Report and this was sent to IDB on 23 September 2014; IDB issued “No Objection Letter” for all three (3) Packages on 1 December 2014. DSC-2, who will cover the Central Java province, has not been mobilized yet. At the meeting held on 29 October 2014 among the related parties, IDB instructed to DGH to expedite the process of selection. POKJA submitted a detailed analysis of Consultants Technical proposals and the IDB issued a “No Objection Letter” on 4 December 2014. The Consultant Financial proposals were consequently opened on 12 December 2014. 1.2.2

As can be seen from the above table the appointment of all Consultancy Services have been late for a number of reasons including delay of procurement process Consultant Services DSC-2 and delay in the procurement process for civil works in Central Java. Also there has been delay for Technical Assistant Consultant services CSP-4 to CSP-10 1.3

Current Status of Loan At the end of this fourth quarter 2014, (December 2014) some US $ 21,686.86 representing 8.85% of the available loan, has been disbursed. Disbursement is therefore considerably behind schedule as 21.74% (10 months) of the loan availability period has already elapsed with the main reasons for the delay being:

a) The long period elapsing waiting for the NOL for tender documents packages in Central Java. b) The delay of disbursement of Advance Payment for package 34-RCP03 (Sp.3 Apas – Simanggaris, section 1) and 34-RCP04 Sp.3 Apas – simanggaris – section 2; ; Simanggaris – bts. Negara). c) Late appointment of Technical Assistance (TA) Consultants for CSP 4 to CSP10 yet contracted. Details of the overall loan situation are presented a series in forms A through E found immediately after the main text in this report. These forms are an English translation of the quarterly report prepared by PMU for Bappenas. 1.4

During this fourth quarter, ADB Midterm Review mission visited to the project commencing on 23 September 2014. As can be seen from the table below the mission started their visit to the East Java project at end September 2014. One (1) site visit to RRDP projects in West Kalimantan was made in middle of October and one (1) site visit made mid November 2014 for Packages in North Kalimantan, with meetings for every province prior to site visits. At the beginning of October 2014, the ADB Midterm mission made a site visit to East Java and West Kalimantan only, a Coordination meeting with Ministry of Finance, DGLT, DGNTP, Bappenas and PMU being held in Bappenas meeting room on 23 October 2014. 2.6

Project Steering Committee Meeting No Steering Committee meetings have been held to date.

Loan Closing Date During the ADB Midterm Review Mission, informal discussions were again held relating to the completion date for the packages in Kalimantan and three (3)

Packages in Central Java. It was agreed that most Packages were unlikely to be completed before their scheduled Project Hand Over (PHO) dates. 3

Project Management and Implementation There were no major changes in project management during the quarter 3.1

Procurement Plan Appendix No. 2 presents a copy of the general Procurement Plan for all, Civil Works, Goods and Consulting Services, of the project as updated to the end of the fourth quarter 2014.

3.2

Procurement Status (A) Works Procurement is being conducted under the Bank’s Procurement Procedures as described in the Loan Agreement. International Competitive Bidding (ICB) will apply for packages with the estimated total cost of more than US$10 Million to comply with the Bank’s threshold. According to Government of Indonesia (GOI) regulation, prequalification shall be apply to all packages with construction estimated cost to be more than IDR 100 Billion. All subprojects have been started with prequalification since 20 December 2011 for ICB multiple contracts. This was an advanced procurement action agreed between the DGH and the Asian Development Bank (ADB) prior to the establishment of a CTC. The deadline for submission of Qualification Document by Applicants was 27 April 2012. Procurement is now complete for seven (7) packages: two (2) packages in West Kalimantan, one (1) package in East Java and four (4) packages in East Kalimantan. One package CW-05, 30-RCP01, Sosok – Tayan; Tanjung – Batas Kota Sanggau, NOL for Bid Evaluation Report was approved by ADB on 9 December 2014 and by the Ministry of PU on 11 December 2014. Three Packages in Central Java Province, CW-01, 24-RCP01, Tambakmulyo Wawar ; CW-02, 24-RCP02 Giriwoyo – Duwet and CW-03,24-RCP03, Wawar – Congot , NOL for Bid Evaluation Report was approved by IDB (Islamic Development Bank)

on 1 December 2014 and by the Ministry PU on 8

December 2014. (B) Goods There was no Goods procurement processed during the fourth quarter 2014.

Services

The status of Core Team Consultant (CTC), Design and Supervision Teams (DSC-1 and DSC-3), are shown in Section 3.5 of this report. : 3.3

Implementation Status – Civil Works Contracts have been signed for Seven (7) Packages; one (1) for East Java Province (CW-4), two (2) for West Kalimantan (CW-6 and 7) and four (4) for East Kalimantan and construction has commenced. One Package 28-RCP-01A, Jolosutro – Sendangbiru progress

is behind

schedule at 28.456%. First SCM (Show Cause Meeting) was held by PPK at project level between PPK, Consultant and Contractor on 7th October 2014. Contractor had to follow the test case agreed, however failed to fulfill the target set. A Second SCM also was held in Balai Besar V Surabaya on 3rd November 2014, attended by Chief of Implementation Section of Balai Besar V Surabaya, Satker Pembangunan Jalan Wilayah 1, PPK, Consultant DSC-3, Field Team Consultant and Contractor. At this 2nd stage the Contractor also failed to improve his performance. It appears that it is difficult for the Contractor to continue the project due to a cash flow problem. One (1) Package 30-RCP03, Sp.Tanjung – Galling; Aruk- Bts Serawak is behind schedule at 6.42%, DSC team is aware of this situation and are monitoring. One Package is ahead of schedule at 7.24% , Tebas – Singkawang (section 1 & 2) ; Bypass Sambas; Galing – Tj.Harapan. Package 34-RCP02 (CW-09) (Sp.3 Tanjung Palas- Sekatak Biji ) (Section 2). The Contractor commenced work on 4 September 2014 and Physical progress is slightly ahead schedule at 0.63%. The Contractor should be encouraged because less progress this month. Package 34-RCP03 (CW-10), Sp. Tiga Apas –Simanggaris (Section 1), the Commencement of work was issued on 10 July 2014. The Contractor progress is now was ahead schedule at 1.29%. ADB concurred with the Contract for 34-RCP04 (CW-11) (Sp. Tiga Apas Simanggaris (Section 2) and (Simanggaris – Bts Negara (Serudong)) on 14 May 2014. Commencement of Work was issued on 1 October 2014; to date physical progress is slightly behind schedule at -0.21%. The summary of Implementation Status and Cost Monitoring of RRDP project is shown in Appendix No. 3.

Variation Orders The first variations was made for package CW-04. For this variations no additional cost (balance budget) only there is a change in the quantity of items common excavation, rock excavation, common embankment , excavation of existing asphalt Pavement, CTB was raised and mortared stone work in V ditch C3 reinforced concrete, clearing and grubbing, aggregate base class S, aggregate base class A decreased during this period. The submission of final Evaluation Report (Technical and Financial) and draft contract for Design and supervision Consultant (DSC-2) was submitted to the IDB by DGH on 24 December 2014. e) Other Consultants for Technical Assistant Road Sector Development Program. CSP-4: Road Safety Engineering Support (DGH) EOI was submitted by the Consultants on 20 September 2014 and the Evaluation Report for the Short List of Consultant was sent to ADB on 28 October 2014. “No Objection Letter” for the short list of the consultant and draft of Request for Proposal (RFP) was issued by ADB on 9 December 2014. CSP-5: Capacity Development Program (DGH) Coordination meeting was held among the related sections of DGH and CTC presided by Secretary General of BINA MARGA on the scope of works on 31 October 2014, but the program has only just started to move and the TOR is still under discussion. CSP-6: Road Safety Awareness Campaign & Training (DGLT) A Meeting was held between DGLT and CTC on Terms of Reference (TOR) for which ADB already gave the comment to revise on the first submission. DGLT is preparing the revised TOR for the approval of ADB.

CSP-7: Overloading and Speed Enforcement (DGNTP) ADB selected another institution to support INTPC to draft the short list of consultants due to conflict of interest. Short list of the consultants was completed including Request for Proposal (RFP) and Terms of Reference (TOR), sent to ADB 26 September 2014. This was concurred by the Bank on 19 November 2014. Invitation of RFP was conducted by POKJA of DGNTP on 4 December 2014. Bid submission is expected to be on 19 January 2015. CSP-8: Indonesia Transport Sector Development Strategy and Policy Study (Bappenas) A Short list of consultants including Request for Proposal (RFP) and TOR was sent to ADB on 10 July 2014 and this was concurred on 24 September 2014. CSP-9: Integrated Vehicle Overloading Control Strategy A Meeting was held between DGLT and CTC on Terms of Reference (TOR) for which ADB already gave the comment to revise on the first submission. DGLT is preparing the revised TOR for the approval of ADB. CSP-10: Human Trafficking Prevention and HIV/AIDS Campaign Programs EOI was submitted by the Consultants on 20 September 2014. Evaluation Report for Short List of Consultant was sent to ADB on 28 October 2014. “No Objection Letter” for short list of the Consultant and draft of Request for Proposal (RFP) was issued by the ADB on 9th December 2014. 3.6

Implementation of the Anti-Corruption Plan 3.6.1

Community Representative Observer (CRO) Bid openings for three (3) packages in West Kalimantan and four (4) packages in East Kalimantan (3) three Packages in Central Java were attended by the selected CROs who are required to prepare reports with the results of their observations. A CRO did not attend in the bid opening ceremony for one (1) Package in East Java. See Appendix 7 for a tabular summary of CRO activities.

3.6.2

Third Party Monitoring (TPM) The Terms of Reference and budget for the TPM are contained in CTC draft Amendment No.1, now in preparation. All operational costs will come from the Technical Assistance component of the Loan for RRDP through the Core Team Consultant (CTC). It was decided that the best method of recruitment for TPM was through the universities closest to each individual package and PMU mailed 18


invitations asking them to express their interest in forming independent monitoring teams of Third Party Monitors. This concept is based on the fact that Universities/Technical Faculties have engineers available for recruitment and Universities could use this opportunity to be involved in public service.

It is hoped that this concept will be more effective and

more efficient in getting legitimate, competent, independent Third Party Monitoring (TPM). The duties of a TPM include a) Report to the PPK for his package and obtain copies of all drawings and contract documentation. b) Report to the PPK for his package and obtain copies of all drawings and contract documentation. c) Make at least three (3) separate visits to site, with each visit lasting up to four (4) days long, to ascertain that the works are being carried out in compliance with the drawings and documentation. d) Following each visit prepare a report and submit to the PMU. 3.6.3

HIV-AIDS and Anti Human Trafficking Program The Program for HIV/AID and Anti Human Trafficking has not yet started, still in the process of procurement.

3.7.2

Monitoring of Health and Safety Each contractor must take reasonable precautions to maintain the health and safety of his employees including collaboration with local health authorities. The object of this program is to minimize any accident and health problems during construction work execution; is part of CTC monitoring activities. Health and Safety Monitoring for each package can be found in Appendix 15. From the details in this Appendix it can be seen that the minimum attainment is “mildly satisfactory” with “good” being attained only for a few number of factors. Each package is made aware of the results and is encouraged to improve as necessary.

3.8

Resettlement & Rehabilitation Activities 3.8.1

Preparation of LARP In accordance with the requirement set forth in the safeguard document from

ADB

implementation of the for each package on RRDP program. Monitoring conducted by the CTC has been prepared in five (5) documents of LARP while one (1) LARP will be prepared for two (2) physical work packages that are 34-RCP-03 and 34-RCP04. 3.8.2

LARP Implementation Based on the results of monitoring, data collection and coordination with local government and projects, the progress of the implementation of the LARP can be grouped as follows: 1. East Java For Package 28-RCP 01A (CW-04): Determination and acquisition of land replacement located in Bondowoso District. The candidate of replacement land has been surveyed on September 2013 and status of the land replacement for forestry permits in form of that is the recommendation from Bondowoso Regent issued on February 2014. Socialization of project affected people has been carried out several times, in May, July and September 2014. In general, people understand the land acquisition plan. This will be supported by preparing documents related to the land acquisition process. The Local Government of Malang District has allocated budget for livelihood restoration assistance to affected households. The programs are geared to restore, the socio-economic conditions of affected households, including vulnerable households. However, up to now the income restoration program not yet implemented due to the program still not discussed with related agencies. The BPM (Badan Pemberdayaan Masyarakat/ Community Empowerment Office) has already prepared an Action Plan for related project, otherwise budgets still wait TAPD allocation (List of Malang District Project). Assistance programs in order to improve the welfare of society, especially those located around the project will be met through a program of related work units of the Government of Malang. 2. Central Java Package24-RCP-01 (CW-01): Tambak Mulyo-Wawar. Package 24RCP-02: Giriwiryo - Duwet (CW-02) and Package 24-RCP 03: Wawar(CW-03)-Congot. Compensation payment for Packages 24 21

Kebumen District supporting project on community empowerment for the Affected People of road project is still developed among Bappeda and BPM. 3. West Kalimantan Package 30-RCP 01(CW-05): Sosok-Tayan; Tanjung-Sanggau City Border. and Acquisition Sosok - Tayan is 100 % complete and currently preparing recapitulation. Package 30-RCP 02 (CW-06): Tebas-Singkawang (Section-1 and Section-2), Bypass Sambas, Galing-Tanjung Harapan. Pakage 30-RCP 03 (CW-07): Simpang Tanjung-Galing (Section-1 dan Section-2), Aruk (Batas Serawak) - Simpang Tanjung. a. Singkawang City Based on data obtained by CTC, residents were identified who will be affected by the project that is in the Bambang Ismoyo Street on Tebas-Singkawang (Section-1) link which is part of the Package 30-RCP 02 (CW-06). Singkawang government has set aside for the purpose of land acquisition, but up to now still to be identified PAPs (Project Affected Persons). Planned in October 2014 at the location of the land acquisition process will be completed. However, on a field trip with the ADB mission, in Nov 2014 these activities had still not been completed. Currently the process is still in the stage of consultation with PAPs. b. Sambas District CTC team has had discussions with the Public Works Agency of Sambas district, and agreed to be clarification and validation of differences in the number and name of the PAPs. Corrective action based on the LARP document there are programs that have yet to be implemented, namely: - Allowances of lost revenue; - Assistance to vulnerable groups;

Currently budget is not available to implement the program, the regional government will propose assistance from the Provincial Government. Directorate General of Highways, through the Balai Besar of the Region VII Kalimantan, has sent a letter to LG Regent Sambas and Singkawang concerning Implementation of Land Acquisition and Resettlement for RRDP in Sambas and Singkawang District of West Kalimantan Province. Recovery back to the communities affected by land acquisition, until now there has been no program of Sambas district government and Singkawang. However, the local government has planned an empowerment program for people whose land is affected by land acquisition. 4. North Kalimantan Package 34-RCP 01 (CW-08): Tanjung Selor- SP. 3 Tanjung Palas and Sp. 3 Tanjung Palas Sekatak Buji (Section-1); Package 34-RCP 02 (CW-09): Sp. 3 Tanjung Palas Sekatak Buji (Section-2); Package 34-RCP 03 (CW-10): SP.3 Apas - Simaranggis (Section- 1); Packages 34-RCP 04 (CW-11): SP.3 Apas - Simaranggis (Section2) and Simanggaris-Bts Negara (Serudong). a) Bulungan District Activities that have been carried out on 34-RCP Package 01 (CW-08) and Package 34-RCP 02 (CW-09) is a form of socialization and data collection of the residents who have the building and crops affected by the project in August 2014. Contractors have not been measuring the community lands that have been identified land affected by land acquisition, because still rainy season and measurement could not be done. b) Nunukan District Until now for Package 34-RCP 03 (CW-10) and Package 34RCP 04 (CW-11) activities related to land acquisition for road construction have not been carried out. In connection with the realignment in Package CW-10 and CW11 a new survey and measurement should be conducted and data collected for LARP. Preparation for LARP can be done with financing (proposed) included in Addendum 01 CTC-RRDP.
