DEFINITIES

The terms in these rules shall have the meanings respectively assigned to them as stated in the GNG LIST OF TERMS AND DEFINITIONS.

These regulations bear the following name: RULES FOR COMPLAINTS AND DISCIPLINARY ACTION.

OBJECTIVES

DOELSTELLING

The objectives of these rules and regulations are: To promote and maintain the quality of Action and behaviour of the certificate holders, in the broadest sense, as well as describe a procedure which deals with the settlement of complaints against certificate holders submitted by certificate holders, non-certificate holders or licensed bodies.

Dit reglement heeft tot doel: Het bevorderen en handhaven van de kwaliteit van het handelen en het optreden van de certificaathouders, zulks in de ruimste zin van het woord, alsmede het beschrijven van een procedure ter afhandeling van klachten tegen certificaathouders ingediend door certificaathouders, niet certificaathouders of bevoegde organen.

PROCEDURE

PROCEDURE

IN GENERAL

ALGEMEEN

The procedure consists of three stages, namely: 1. handling the complaint by the complaints mediator (stage 1) 2. handling the complaint by the complaints committee (stage 2) 3. handling the appeal lodged by the Quality Standards Committee (stage 3)

De procedure kent een drie behandelingsfasen, te weten: 1. de behandeling van de klacht door de klachtbemiddelaar (1e fase) 2. de behandeling van het klacht door de klachtcommissie (2e fase) 3. de behandeling van het ingestelde beroep door de Quality Standards Committee (3e fase)

These regulations are applicable to all (associate) certificate holders. Complainants can be: 1. natural persons 2. legal persons 3. (non) certificate holders 4. the economic sector and professional organizations when their status is shown from the valid statutes of the company concerned 5. GNG itself

Dit reglement is van toepassing op alle (associate) certificaathouders. Als klager kunnen optreden: 1. natuurlijke personen 2. rechtspersonen 3. (niet) certificaathouders 4. branche en beroepsorganisaties indien hun status blijkt uit de geldige statuten van de betreffende organisatie 5. GNG zelf




FILING A COMPLAINT

INDIENEN VAN EEN KLACHT

5.4

The complaint needs to be lodged clearly and well-motivated, in writing by registered post.

De klacht dient schriftelijk per aangetekend schrijven, duidelijk en met redenen omkleed te worden ingediend.

5.5

The complaint cannot be lodged anonymously.

De klacht kan niet anoniem worden ingediend.

The complainant must state the following details: name and initials, address, zipcode and place of residence, telephone number, fax number and email address, if appropriate: the name of the company or the organization as well as its registration number with the chamber of commerce. the personal and address data of the entire management, the representative(s) of the authorized agent(s) as well as an authorization in the name of said representative(s) or authorized representative(s). the personal and company data of the certificate holder to whom the complaint is directed. a description of the complaint which includes an account of the rule(s) of conduct at issue.

De klager vermeldt tenminste de navolgende gegevens: naam en voorletters, adres, postcode en woonplaats, telefoonnummer, indien beschikbaar een faxnummer, indien beschikbaar een emailadres, indien van toepassing: de naam van het bedrijf of de organisatie alsmede het inschrijfnummer in het register bij de kamer van koophandel. de persoons- en adresgegevens van het voltallige bestuur, de vertegenwoordiger(s) of gemachtigde(n) alsmede een volmacht ten name van genoemde vertegenwoordiger(s) of gemachtigde(n). de persoons- en bedrijfsgegevens van de certificaathouder waar de klacht betrekking op heeft. een omschrijving van de klacht waaronder mede verstaan de vermelding van de in het geding zijnde gedragsregel(s).

GNG records the date of receipt of the complaint and acknowledges its receipt to the complainant in writing.

GNG legt de dag van de ontvangst van de klacht vast en bevestigt de ontvangst van de klacht schriftelijk aan klager.

APPOINTMENT AND DUTIES OF THE COMPLAINTS MEDIATOR (STAGE 1) GNG appoints a complaints mediator within two calendar months of receipt of the complaint fee and forwards a copy of the file to the complaints mediator. GNG promptly acknowledges the appointment of the complaints mediator in writing to both complainant and respondent.

5.10

The complaints mediator, having due regard to the principle of hearing both sides of the argument, has the duty to investigate whether the complaint can be settled to the satisfaction of all parties involved. The procedure of the complaints mediator is without let. The complaints mediator will document in writing his chosen procedure and the results obtained. The complaints mediator reports to GNG in writing, intermediate upon request, but in any case directly after the completion of his/her duties.

5.11

The complaints mediator will be able to perform his duties within three calendar months after the appointment. This period can be extended by three calendar months twice.

5.12

If the complaints mediator succeeds in resolving the complaint, the settlement will be recorded in writing and confirmed to GNG and the parties involved. No notice of objection can be lodged against a settlement.

BENOEMING EN WERKZAAMHEDEN KLACHTBEMIDDELAAR (1E FASE) GNG benoemt binnen twee kalendermaanden na ontvangst van het klachtgeld een klachtbemiddelaar en zendt de klachtbemiddelaar een kopie dossier toe. GNG bevestigt de benoeming van de klachtbemiddelaar prompt schriftelijk aan klager en beklaagde. De klachtbemiddelaar heeft met achtneming van de beginselen van hoor en wederhoor tot taak te onderzoeken of de klacht minnelijk kan worden opgelost tot tevredenheid van alle betrokken partijen. De werkwijze van de klachtbemiddelaar is vrij. De klachtbemiddelaar legt zijn gekozen werkwijze en de behaalde resultaten schriftelijk vast. De klachtbemiddelaar rapporteert schriftelijk aan GNG, indien gewenst tussentijds doch in ieder geval aansluitend aan de afronding van zijn / haar werkzaamheden. De klachtbemiddelaar heeft gedurende drie kalendermaanden na benoeming de gelegenheid zijn werkzaamheden te verrichten. De termijn kan twee keer met drie kalendermaanden worden verlengd. Indien de klachtbemiddelaar slaagt in zijn werkzaamheden wordt de oplossing schriftelijk vastgelegd in een vaststellingsovereenkomst en bevestigd aan GNG en de partijen. Ten aanzien van een vaststellingsovereenkomst kan geen bezwaar worden aangetekend. Indien de klachtbemiddelaar niet slaagt in zijn werkzaamheden wordt de opdracht teruggegeven aan GNG. De klachtbemiddelaar meldt de teruggave van de opdracht schriftelijk aan GNG en aan partijen. BENOEMING EN WERKZAAMHEDEN KLACHTCOMMISSIE (2E FASE) GNG benoemt binnen twee kalendermaanden na de niet-geslaagd melding van de klachtbemiddelaar een klachtcommissie. De klachtcommissie bestaat uit tenminste twee leden. GNG ziet er op toe dat de klachtcommissie evenwichtig, onpartijdig en deskundig van samenstelling is.

If the complaints mediator does not succeed in resolving the complaint, the assignment will be handed back to GNG. The complaints mediator will confirm the termination of the assignment in writing to GNG and the parties. APPOINTMENT AND DUTIES OF THE COMPLAINTS COMMITTEE (STAGE 2) GNG appoint a complaints committee within two calendar months of the mediator’s notification of non-success. The complaints committee will comprise at least two members. GNG will make sure the complaints committee is composed in a wellbalanced, impartial and professional way.




5.16

The complaints committee appoints a chairman and a secretary from among its members.

The chairman of the complaints committee will preferably be a lawyer.

5.18

The complaints mediator cannot serve in the complaints committee unless otherwise agreed upon by the complainant(s) and respondent(s).

5.19

The complaints committee hears the complaint having due regard to the principle of hearing both sides of the argument. Both the complainant and the respondent are given the opportunity to explain their respective positions as well as take note of the each other’s ositions. Both parties will be invited to attend a hearing by the complaints committee on a date set by this committee in order to provide the committee with further information and give an oral explanation to the committee.

5.20

The complaints committee will take a decision by a simple majority of votes. The complaint can only be dealt with by the entire complaints committee. The complaints committee can decide, contrary to what is stipulated in 5.19 of these rules and regulations, that when there are grounds for doing so it can suffice to give a written explanation by the parties and to renounce a hearing.

5.21

The complaints committee will render a written decision within three months after its appointment. This three months period can be extended twice. An extension will be reported in writing to GNG and both parties.

5.22

The complaints committee will send its ruling to GNG and both parties.

5.23

An appeal can be brought against the ruling of the complaints committee by the Quality Standards Committee. An appeal needs to be instigated within six calendar weeks after the date of the committee’s ruling. An appeal can only be instigated in writing and by registered post.

De voorzitter van de klachtcommissie is bijvoorkeur een jurist. De klachtbemiddelaar kan geen zitting nemen in de klachtcommissie tenzij met instemming van klager(s) en beklaagde(n) anders wordt besloten. De klachtcommissie behandelt de klacht op basis van de beginselen van hoor en wederhoor. De klachtcommissie stelt zowel klager als beklaagde in de gelegenheid hun standpunt toe te lichten alsmede van de wederzijdse standpunten kennis te nemen. Alle partijen worden uitgenodigd voor een hoorzitting door de klachtcommissie op een door de klachtcommissie vastgestelde behandelingsdatum teneinde nadere inlichtingen aan de commissie te verstrekken alsmede het geven van een mondelinge toelichting. De klachtcommissie beslist op basis van het principe van de gewone meerderheid. De klacht kan alleen door een voltallige klachtcommissie worden behandeld. De klachtcommissie kan, in afwijking van het gestelde onder 5.19 van dit reglement, besluiten dat in voorkomende gevallen wordt volstaan met het geven van schriftelijke toelichtingen door partijen en af te zien van een hoorzitting. De klachtcommissie doet binnen drie kalendermaanden na de benoeming schriftelijk uitspraak. De termijn kan twee keer met drie kalendermaanden worden verlengd. Een verlenging wordt schriftelijk gemeld aan GNG en aan partijen. De klachtcommissie zendt haar uitspraak aan GNG en aan partijen. Tegen de uitspraak van de klachtcommissie kan bezwaar worden ingesteld bij de Quality Standards Committee. Een bezwaar dient binnen zes kalenderweken na de dagtekening van de uitspraak van de klachtcommissie te worden ingesteld. Een bezwaar kan uitsluitend schriftelijk per aangetekend schrijven worden ingesteld.

APPOINTMENT AND DUTIES OF THE QUALITY STANDARDS COMMITTEE (STAGE 3) The Quality Standards Committee of the certificate scheme of the scope of the certificate holders is authorized. The Quality Standards Committee will not be appointed separately. The Quality Standards Committee will hear the objection within the normal meeting schedule. No further terms are needed.

5.27

The Quality Standards Committee will hear the objection having due regard to the principle of hearing both sides of the argument. Both the complainant and the respondent are given the opportunity to explain their respective positions as well as take note of the each other’s positions by the complaints committee. Both parties will be invited to attend a hearing by the Quality Standards Committee on a date set by this committee in order to provide the committee with further information and give an oral explanation.

5.28

The Quality Standards Committee will take a decision by a simple majority of votes. The complaints committee can decide, contrary to what is stipulated in 5.27 of these regulations, that when there are grounds for doing so it can suffice to give a written explanation by the parties and to renounce a hearing.

5.29

During the handling of the objection, the execution of the ruling of the complaints committee will be sustained unaffected by the right of GNG to take and enforce interim sanctions which can be equal to the main and/or additional sanctions as formulated by the complaints committee. The Quality Standards Committee will deliver a decision in writing and will inform its ruling to both parties as well as to GNG. The ruling of the Quality Standards Committee cannot be opposed.

BENOEMING EN WERKZAAMHEDEN QUALITY STANDARDS COMMITTEE (3E FASE) De Quality Standards Committee van het certificatieschema van de scope van de certificaathouder is bevoegd. De Quality Standards Committee wordt niet apart benoemd. De Quality Standards Committee behandelt het bezwaar binnen het reguliere vergaderschema. Hiervoor gelden geen nadere termijnen. De Quality Standards Committee behandelt de bezwaar op basis van de beginselen van hoor en wederhoor. De klachtcommissie stelt zowel klager als beklaagde in de gelegenheid hun standpunt toe te lichten alsmede van de wederzijdse standpunten kennis te nemen. Alle partijen worden uitgenodigd voor een hoorzitting door de Quality Standards Committee op een door de Quality Standards Committee vastgestelde behandelingsdatum teneinde nadere inlichtingen aan de Quality Standards Committee te verstrekken alsmede het geven van een mondelinge toelichting. De Quality Standards Committee beslist op basis van het principe van de gewone meerderheid. De klachtcommissie kan, in afwijking van het gestelde onder 5.27 van dit reglement, besluiten dat in voorkomende gevallen wordt volstaan met het geven van schriftelijke toelichtingen door partijen en af te zien van een hoorzitting. Gedurende de behandeling van het bezwaar wordt de ten uitvoer legging van de uitspraak van de klachtcommissie aangehouden onverlet het recht van GNG tot het nemen en opleggen van tussentijdse sancties welke gelijk mogen zijn aan de door de klachtcommissie geformuleerde hoofd- en /of bijkomende sancties. De Quality Standards Committee doet schriftelijk uitspraak en deelt haar uitspraak mee aan de partijen en GNG. Tegen de uitspraak van de Quality Standards Committee kan geen bezwaar worden ingesteld.

TESTING

TOETSING

The Action of the respondent will exclusively be tested against the applicable code of conduct and the requirements. SUSPENSION OF THE HEARING AND CONVERGENCE The complaints mediator and/or the complaints committee and/or the Quality Standards Committee has/have the right to suspend the arbitration in order to await the outcome or verdict of another authority and to take this into consideration with their arbitration. The complaints mediator and/or the complaints committee and/or the Quality Standards Committee has/have the right to suspend arbitration if according to them an undesired convergence of procedures arises which will have or can have an adverse influence on the arbitration of the complaint and/or the progress of other procedures or can cause damage to parties. A request for suspension can be lodged by both the complainant as well as the respondent. A decision to suspend arbitration will be announced in writing to both complainant and respondent. It is not possible to appeal against a decision to suspension. When a certificate holder is also certified by another certifying organization, GNG, the complaints mediator and/or the complaints committee and/or the Quality Standards Committee can decide to deal with the complaint at the same time or to hand it over to the other certifying organization.

Het handelen van de beklaagde wordt uitsluitend getoetst op basis van de vigerende gedragsregels en requirements. SCHORSING VAN DE BEHANDELING EN SAMENLOOP De klachtbemiddelaar en/of de klachtcommissie en/of de Quality Standards Committee heeft ( hebben ) het recht de behandeling op te schorten teneinde een besluit of vonnis van een andere autoriteit af te wachten en mee te wegen bij de behandeling. De klachtbemiddelaar en/of de klachtcommissie en/of de Quality Standards Committee heeft ( hebben ) het recht de behandeling op te schorten indien een naar hun opvatting ongewenste samenloop van procedures ontstaat welke de behandeling van de klacht en/of het verloop van andere procedures nadelig beïnvloedt of kan beïnvloeden dan wel partijen zouden kunnen schaden. Een verzoek tot opschorting kan worden ingediend door zowel klager als beklaagde. Een besluit tot opschorting van de behandeling wordt schriftelijk ter kennis gebracht van klager en beklaagde. Tegen een besluit tot opschorting is geen beroep mogelijk. Indien een certificaathouder ook door een andere certificerende instantie is gecertificeerd kan GNG, de klachtbemiddelaar en/of de klachtcommissie en/of de Quality Standards Committee besluiten de klacht parallel te behandelen of over te dragen aan de andere certificerende instantie.




COSTS

5.35

The complainant has to pay a deposit, the complaints fee, in advance. The amount of the complaints fee can be found on the annual price list published by GNG.

5.36

The complaints fee has to be paid to GNG by the complainant before the complaint will be heard. A complaint will only become a formally lodged complaint when the complaints fee due has been received by GNG. When the complaint fee has not been paid yet, GNG is not obliged to hear the complaint.

5.37

The costs of the complaints mediator, the complaints committee, the Quality Standards Committee and/or other experts will be charged to both parties. The amount of the fees and the costs of the complaints mediator, complaints committee and the Quality Standards Committee can be found on an annual price list, published by GNG.

5.38

Should it be necessary to use external expertise or experts in order to hear the complaint, both parties need to give their prior consent and the costs resulting from this will be charged to both parties at cost price.

5.39

The costs of hearing the complaint need to be paid by the party/parties who will be declared at fault unless otherwise decided during the handling of the complaint. The complaints fee paid in advance by the complainant will be refunded.

KOSTEN Klager is bij het indienen van de klacht een voorschot bedrag, het zogenaamde klachtgeld, verschuldigd. De hoogte van het klachtgeld blijkt uit een jaarlijkse door GNG af te geven tarievenlijst. Het klachtgeld dient door klager voor de behandeling van de klacht aan GNG te worden voldaan. Een klacht is eerst een formele ingediende klacht indien het verschuldigde klachtgeld door GNG is ontvangen. Zolang het klachtgeld niet is voldaan is GNG niet gehouden de klacht in behandeling te nemen. De kosten van de klachtbemiddelaar, de klachtcommissie, de Quality Standards Committee en/of overige door GNG ingeschakelde deskundigen worden aan partijen in rekening gebracht De hoogte van de honoraria en de kosten van de klachtbemiddelaar, klachtcommissie en de Quality Standards Committee blijken uit een jaarlijks door GNG af te geven tarievenlijst. tarievenlijst. Voor zover en indien voor de behandeling van de klacht gebruik dient te worden gemaakt van externe expertise of deskundigen dienen partijen vooraf toestemming te verlenen en worden de hieruit voortkomende kosten tegen kostprijs door belast aan partijen. In exceptional cases, to be determined by GNG, costs can be divided by both parties or be mitigated. If the complainant withdraws his complaint all costs will be charged to the complainant. GNG is authorized to ask for a deposit or guarantee from the complainant, the respondent or from both parties before hearing the complaint, to cover the costs which will be made.

In bijzondere situaties, zulks ter beoordeling van GNG, kunnen de kosten worden verdeeld over partijen, of worden gematigd. Indien klager de klacht intrekt zijn alle kosten voor rekening van klager. GNG is gerechtigd aan klager, aan beklaagde of aan beiden alvorens de klacht in behandeling te nemen een borg of garantstelling te vragen met betrekking tot de te maken kosten. Indien een klacht wordt ingediend door of namens een certificaathouder en mitsdien een klacht is tussen certificaathouders onderling worden de kosten ponds-ponds-gewijs verrekend tenzij anders tussen partijen overeengekomen en volgt automatisch schorsing van de betreffende certificaathouder(s) bij een geheel en/of gedeeltelijke niet-nakoming.

If a complaint will be lodged by or on behalf of a certificate holder and consequently becomes a complaint between certificate holders, the costs will be divided on a pro rata basis unless otherwise decided between both parties. The certificate holder in question will be automatically suspended in case of complete and/or partial non-performance.

SPECIAL STIPULATIONS

BIJZONDERE BEPALINGEN

The complaints mediator, the entircomplaints committee, the entire Quality Standards Committee as well as the individual members of the complaints committee and/or the Quality Standards Committee can be challenged by both parties. For this end, a request for challenge should be lodged by GNG. GNG takes a decision within three calendar months after the request for challenge has been lodged. During the handling of the request for challenge, other time limits with regards to treatment, as referred to in these rules and regulations will be suspended and resumed directly after this decision has been taken. No grounds for challenge are: being a GNG certificate holder being a member of or associated with a branch or professional organization when the status is shown from the valid statutes of the organization concerned.

De klachtbemiddelaar, de klachtcommissie als geheel, de Quality Standards Committee als geheel alsmede de individuele leden van de klachtcommissie en/of de Quality Standards Committee kunnen door partijen worden gewraakt. Hiertoe wordt het wrakingsverzoek ingediend bij GNG. GNG beslist binnen drie kalendermaanden na indiening over het wrakingsverzoek. Gedurende de behandeling van het wrakingsverzoek worden andere behandelingstermijnen zoals bedoeld in dit reglement geschorst en aansluitend aan bedoeld besluit hervat. Geen grond tot wraking is: het zijn van GNG certificaathouder het lid zijn van of aangesloten zijn bij een branche of beroepsorganisatie indien de status blijkt uit de geldige statuten van de betreffende organisatie.

The complaints mediator, the complaints committee and the Quality Standards Committee have an obligation of secrecy with regard to all information, facts and circumstances which they are familiar with from their duties based on these rules and regulations. At the request of both parties it is possible to deviate from the stipulated periods in the rules and regulations. To do this a request should be lodged by GNG. GNG decides about meant request and will inform both parties by return post of the taken decision. The complainant can withdraw the complaint at all times, unaffected by the provisions of article 5.39 of these rules and regulations.

De klachtbemiddelaar, de klachtcommissie en de Quality Standards Committee hebben geheimhoudingsplicht ten aanzien van alle kennis, feiten en omstandigheden welke hen vanuit hun werkzaamheden op grond van dit reglement bekend zijn. Op verzoek van partijen kan van de gestelde termijnen in dit reglement klachten tuchtrecht worden afgeweken. Hiertoe wordt een verzoek ingediend bij GNG. GNG beslist over bedoeld verzoek en stelt partijen per ommegaande schriftelijk in kennis van het genomen besluit. Klager kan de klacht ten alle tijden intrekken, onverlet het bepaalde in artikel 5.39 van dit reglement. Ieder natuurlijke persoon, waar onder nadrukkelijk mede begrepen certificaathouders, kunnen door GNG worden aangesteld als klachtbemiddelaar of als lid van de klachtcommissie.

VERGOEDINGEN

The complaints mediator, the complaints committee and the Quality Standards Committee are entitled to a remuneration of their honorarium and expenses. If appropriate GNG will enter into agreements with the complaints mediator, the complaints committee and the Quality Standards Committee. The honorarium and the costs incurred will be passed on the basis of the provisions laid down in these rules and regulations.

INADMISSIBLE

NIET ONTVANKELIJKHEID

In voorkomend geval maakt GNG vooraf afspraken met de klachtbemiddelaar, de klachtcommissie en de Quality Standards Committee. Het honorarium en de kosten worden doorbelast op basis van het bepaalde in dit reglement.

Indien de klacht geen betrekking heeft op een certificaathouder of wel geen betrekking heeft op het persoonlijk handelen en optreden van de certificaathouder verklaart GNG de klacht niet ontvankelijk. De klachtcommissie en de Quality Standards Committee kunnen de klacht op gronden van het gestelde onder 6.1 van dit reglement eveneens niet ontvankelijk verklaren. Een klacht tegen een branche of beroepsorganisatie is niet ontvankelijk. De onderhavige regeling voorziet niet in institutioneel klachten tuchtrecht. Bij niet ontvankelijkheid kan GNG aanbevelingen doen aan beklaagde en/of klager, ondermeer met betrekking tot doorverwijzing naar een bevoegde instantie of rechter.

If the complaint does not concern a certificate holder or does not relate to the personal conduct and behaviour of the certificate holder, GNG will declare the complaint inadmissible. The complaint committee and the Quality Standards Committee can declare the complaint inadmissible based on the declared under 6.1 of these rules and regulations. A complaint against a branch or professional organization is inadmissible. The present scheme does not provide for corporate rules for complaints and disciplinary Action. When there is no case GNG can make recommendations to the respondent and/or complainant. This can include referring to an authorized agency.

RULING

UITSPRAAK

The complaints committee will render a decision. The rules and regulations distinguish four types of decision, namely: 1. The complaint is inadmissible. 2. The complaint is unfounded. 3. The complaint is manifestly unfounded 4. The complaint is well-founded.

The complaints committee is not obliged to reveal the internal voting proportions.

The complaints committee is obliged to motivate its ruling in writing. If the complainant does not cooperate in carrying out these regulations or otherwise hinders the complaints committee from carrying out its duties, the committee is entitled to break off the hearing as well as declare the complaint manifestly unfounded. If the accused does not cooperate in carrying out these regulations or otherwise hinders the complaints committee from carrying out its duties, the committee is entitled to rule midterm, declare the complaint well-founded and determine measures. If the complaints committee declares the complaint well-founded the committee is obliged to determine a sanction.

De klachtcommissie is verplicht haar uitspraak schriftelijk te motiveren. Indien klager niet meewerkt aan de uitvoering van deze regeling of anderszins de klachtcommissie in haar werkzaamheden belemmert, is de klachtcommissie bevoegd de behandeling af te breken alsmede de klacht kennelijk ongegrond te verklaren. Indien beklaagde niet meewerkt aan de uitvoering van deze regeling of anderszins de klachtcommissie in haar werkzaamheden belemmert, is de klachtcommissie bevoegd de klacht tussentijds uitspraak te doen, gegrond te verklaren en een maatregel vast te stellen. Indien de klachtcommissie de klacht gegrond verklaart is de commissie gehouden een sanctie vast te stellen.

If the complaints committee declares the complaint well-founded the committee will proceed to determine a sanction.

Het reglement onderscheidt zes hoofd sancties, te weten: 1. geen maatregel wegens bijzondere omstandigheden 2. waarschuwing 3. schriftelijke berisping 4. schriftelijke berisping met melding aan de branche en/of beroepsorganisatie waar de certificaathouder bij is aangesloten 5. schorsing voor bepaalde duur van de certificering; een schorsing voor bepaalde duur kan per schorsing ten hoogste één kalenderjaar beslaan 6. ontneming van de certificering

The rules and regulations distinguish six main sanctions, namely: 1. no measure because of special circumstances 2. caution 3. written reprimand 4. written reprimand with a notification to the branch and/or professional organization with which the certificate holder is affiliated. 5. suspension of the certification for a fixed term with a maximum of one calendar year per suspension. 6. confiscation of the certification If the complaints committee declares the complaint well-founded, the committee can proceed to determine not only the main measure but also an additional sanction or additional sanctions. An additional sanction can have the purpose to guide the conduct and behaviour of a certificate holder or serve a higher purpose of the professional organization.

Indien de klachtcommissie de klacht gegrond verklaart kan de klachtcommissie naast het vaststellen van een hoofdmaatregel overgaan tot het vaststellen van een bijkomende sanctie of bijkomende sancties. Een bijkomende sanctie kan tot doel hebben het handelen en optreden van een certificaathouder te sturen of een hoger belang van de beroepsgroep te dienen. Het reglement onderscheidt drie bijkomende sancties, te weten: 1. het stellen van nadere voorwaarden aan het continueren van de lopende certificering. 2. het stellen van nadere voorwaarden aan (her) certificatie. 3. het openbaar maken van de uitspraak.

ARCHIVE AND INFORMATION

ARCHIEF EN INFORMATIE GNG is belast met de archivering van alle documenten (het archief) die verband houden met deze regeling en de uitvoering daarvan waaronder mede begrepen alle klachtendossiers. Het onder 9.1 bedoelde archief is niet toegankelijk voor derden en nietcertificaathouders. GNG doet jaarlijks in haar jaarverslag een opgave van het aantal ingediende klachten, de gedane uitspraken en de opgelegde sancties. De rapportage is geanonimiseerd onverlet het openbaar maken als bedoeld in artikel 8.4.

GNG is in charge of registering all documents (the archive) which are linked to these regulations and its execution. This also includes all files of complaints. The archive mentioned in article 9.1 is not accessible for third parties and non-certificate holders. GNG will make a statement in its annual report of the number of complaints lodged , the decisions made and the sanctions that were imposed. The report is anonymous except for making it public as meant in article 8.4.

GNG does not accept any liability whatsoever for actions and/or behaviour resulting from this document. GNG emphatically denies liability of any kind.

GNG aanvaardt geen aansprakelijkheid, in welke vorm dan ook, voor het handelen en/of optreden verband houdende met onderhavig reglement. GNG wijst iedere aansprakelijkheid nadrukkelijk van de hand.

AUTHORITY

BEVOEGDHEID

GNG is authorized to set and alter this code.

GNG is bevoegd tot het vaststellen en wijzigen van dit reglement.

CONFIDENTIALITY

GEHEIMHOUDING

GNG, its management, its committees as well as individual committee members are obliged to keep their knowledge of certificate holders and/or third parties, information regarding companies, agencies, and any organizations and/or persons about which they have information as a result of their role within GNG strictly confidential.

GNG, de directie, de commissies alsmede de individuele commissieleden zijn gehouden aan de geheimhoudingsplicht jegens de ADR practitioners en/of derden met betrekking tot de kennis en/of de informatie omtrent bedrijven, ADR practitioners, instanties, organisaties en/of personen welke kennis en/of informatie tot hen is gekomen op grond van hun functie binnen GNG.

Any breach of confidentiality is grounds for the removal of the person from his/her position and if they are certificate holders grounds for examination of compatibility with the code of conduct and the standing rules regulating complaints and disciplinary action.

Het schenden van de geheimhoudingsplicht is grond voor ontzetting uit de functie en ingeval van het zijn van ADR practitioner grond voor toetsing aan de gedragsregels op basis van het reglement klachten tuchtrecht.

DISPUTES

GESCHILLEN

Should a dispute occur because this code does not or does not adequately cover a situation, GNG is authorized without prejudice to the provisions of the articles of association to leave no stone unturned to alter the statutes of GNG.

Voor zover en indien dit reglement iets niet of onvolledig regelt en/of leidt tot een geschil is GNG bevoegd, onverlet het bepaalde in de statuten van GNG

If the GNG does not settle the dispute, the dispute will be subject to mediation. If mediation is not successful, the dispute will be brought before a Dutch court.

Indien GNG geen besluit neemt ten aanzien van het geschil, wordt het geschil onderworpen aan mediation. Indien de mediation niet slaagt wordt het geschil aan de bevoegde Nederlandse rechter voorgelegd.

MULTILINGUAL

MEERTALIGHEID

In cases where more than one language is in use, English will be the language of choice.

Bij meertaligheid prefereert de Engelse taal boven elke andere taal.

LAW

This code shall be governed by Dutch law only.
