The terms in these rules shall have the meanings respectively assigned to them as stated in the GNG LIST OF TERMS AND DEFINITIONS.

OBJECTIVES

DOELSTELLING

The objectives of these rules and regulations are: IN GENERAL - to achieve a permanent process of education, schooling and training.

4.1.2

FOR THE PROFESSIONAL GROUP - to promote the quality of the professional group. - to promote the image of the professional group. - to promote the confidence in the professional group. - objectify expectations, standards (requirements), testing and maintenance.

4.1.3

FOR THE CERTIFICATE HOLDER - give support to personal intensification and broadening of the scope of the certificate holder(s). - maintain and keep up-to-date the personal expertise, the knowledge and the skills of the certificate holder(s).

Dit reglement heeft tot doel: ALGEMEEN - het tot stand brengen van een permanent proces van opleiding, scholing en training. VOOR DE BEROEPSGROEP - het bevorderen van de kwaliteit van de beroepsgroep. - het bevorderen van het imago van de beroepsgroep. - het bevorderen van het vertrouwen in de beroepsgroep. - het objectiveren van verwachtingen, normen ( eisen ), toetsing en handhaving. VOOR DE CERTIFICAATHOUDER - het leveren van een bijdrage aan de persoonlijke verdieping en verbreding van de scope van de certificaathouder(s). - het onderhouden en actueel houden van de persoonlijke kennis, kunde en vaardigheden van de certificaathouders(s).

RELEVANCE

TOEPASSELIJKHEID

These regulations apply to all (associate & full) certificate holders. Suspension does not release the certificate holder from the obligations which result from these regulations. When the certificate holder falls short of the obligations which result from these regulations this is reason for suspension and/or dispossession of certification and/or the nonassignment of (re)certification.

Het reglement geldt voor alle (associate & full) certificaathouders. Schorsing ontslaat de certificaathouder niet van de verplichtingen welke voortkomen uit dit reglement. Het niet voldoen door de certificaathouder aan de verplichtingen welke voortkomen uit dit reglement is grond voor schorsing en/of ontneming van de certificering en/of het niet toewijzen van de (her)certificatie.

CATEGORY ONE: EDUCATION

CATEGORIE ÉÉN: SCHOLING

To participate in acknowledged education or training and rounding off this education by means of an exam or test, all within the scope of the certificate holder.

Het deelnemen aan erkende opleiding of training alsmede het afronden van de scholing met behulp van een examen of toets en dit alles binnen de scope van de certificaathouder. CATEGORIE TWEE: VERDIEPING

CATEGORY TWO: IN-DEPTH ACTIVITIES & TRAINING

To attend or take part in exhibitions, conferences, congresses, intervision groups, seminars, specific meetings, workshops as well as acknowledged education and training which are not rounded off with an exam or a test, all within the scope of the certificate holder.

Het bijwonen van of het deelnemen aan beurzen, conferenties, congressen, intervisiegroepen, seminars, themabijeenkomsten, workshops alsmede erkende opleiding en training waaraan geen examen of toets is gekoppeld en dergelijke en dit alles binnen de scope van de certificaathouder.

CATEGORY THREE: PROFESSIONAL ACTIVITIES

To act as supervisor, teacher, speaker, researcher, tutor, patron or trainer within the scope of the certificate holder, this also includes offering opportunities for training, study, experience and research.

Het publiceren in populaire of wetenschappelijke uitgaven, vakbladen of vakperiodieken van artikelen, onderzoeken, rapporten en verslagen en dit alles binnen de scope van de certificaathouder.

To publish articles, research papers, reports and accounts in popular or scientific magazines, specialist journals or specialist periodicals, all within the scope of the certificate holder.

To execute activities or duties for the purpose of the branch or the occupational group within the scope of the certificate holder, such as: executing public duties and responsibilities, executing administrative duties and responsibilities, executing other duties and responsibilities within organizations, public administration, clubs and foundations.

Het binnen de scope van de certificaathouder verrichten van activiteiten of werkzaamheden ten dienste van de branche of de beroepsgroep, zoals onder meer: het uitoefenen van publieke functies en taken, het uitoefenen van bestuurlijke functies en taken, het uitoefenen van overige functies en taken binnen organisaties, openbaar bestuur, verenigingen en stichtingen.

CPDP RATING OF SCORES

CPDP PUNTENWAARDERING

The CPDP will be considered as an educational model. The CPDP is a dynamic process of education which will develop over time and with deepening insight. The CPDP will be marked on the basis of a scoring system.

Het CPDP wordt aangemerkt als een ontwikkelmodel.

The CPDP activity can belong to one or more CPDP categories.

De CPDP activiteit kan aan één of meer CPDP categorieën worden toegeschreven.

The CPDP scoring system only recognizes full marks (CPD points). Every CPD point equals 1 shift. One shift is made up of one hour on the clock. The committee for training & education awards the number of clockhours to each CPDP activity, education or training. For this purpose the committee for training & education can base themselves either on the actual number of hours on the clock (shifts), a fixed number of hours on the clock (shifts) or a combination of both. Every shift counts for 1 CPD points. The committee for training & education recommends the GNG management with regard to the assessment of the CPDP evaluation of points. The committee for training & education can set further conditions or impose limits to the CPDP evaluation of points.

Het CPDP puntensysteem kent uitsluitend hele cijfers (CPD punten).

Het CPDP als dynamisch proces ontwikkelt zich in tijd en inzicht. Het CPDP wordt gewaardeerd op basis van een puntensysteem.

Iedere CPD punt staat voor 1 klokuur CPDP. De scholingscommissie kent aan iedere CPDP activiteit, scholing of training het aantal klokuren toe. Hiertoe kan de scholingscommissie zich baseren op het feitelijk aantal klokuren, een gefixeerd aantal klokuren of een combinatie van beiden. Ieder klokuur levert 1 CPD punt op. De scholingscommissies zijn belast met de advisering het GNG management met betrekking tot het vaststelling van de CPDP puntenwaardering (CPD punten). De scholingscommissies kunnen aan CPDP puntenwaarderingen nadere voorwaarden of beperkingen stellen. CPDP puntenwaarderingen worden toegekend voor een bepaalde duur en kunnen altijd worden ingetrokken, gewijzigd of geschorst (onderbroken).

CPDP ACKNOWLEDGEMENTS AND CPDP GRANTS

CPDP ERKENNINGEN EN CPDP TOEKENNINGEN

GNG is in charge of the acknowledgement of trainers, courses and exercises. The training committee recommends the GNG management with regard to the mentioned acknowledgements. An objection against a CPDP recommendation of the committee for training & education can be lodged with the GNG management. Further conditions can be laid down against CPDP acknowledgements and costs may be charged.

GNG is belast met de erkenning van opleiders, opleidingen en trainingen. De scholingscommissie is belast met het adviseren van het GNG management met betrekking tot de genoemde erkenningen. Tegen een CPDP advies van de scholingscommissie kan bezwaar worden aangetekend bij de GNG directie. Aan CPDP erkenningen kunnen nadere voorwaarden worden gesteld en kosten verbonden zijn. CPDP erkenningen worden toegekend voor bepaalde tijd en kunnen altijd worden ingetrokken, gewijzigd en geschorst (onderbroken).

CPDP REGISTRATIE

9.1

GNG is obliged to start a CPDP registration infrastructure.

9.2

The certificate holder is obliged to register its CPDP per CPDP period. For this purpose the certificate holder keeps records of the CPDP in the personal CPDP registration system and the certificate holder is obliged to retain the underlying CPDP evidence for the duration of the entire current certification period increased by two contiguous calendar years as well as show the accompanying CPDP evidence at first request to GNG or to an audit organization appointed by GNG.

GNG is gehouden een CPDP registratie infrastructuur in te stellen. De certificaathouder is gehouden het eigen CPDP per CPDP periode te registreren. Hiertoe muteert de certificaathouder de CPD punten in het persoonlijke CPDP registratie systeem en is de certificaathouder gehouden het onderliggende CPDP bewijs voor de duur van de gehele lopende CPDP periode vermeerderd met twee aansluitende kalenderjaren te bewaren alsmede het bijbehorende CPDP bewijs op eerste verzoek te tonen aan GNG of wel een door GNG aangewezen controlerende organisatie.

The following items will be acknowledged as PE evidence: - original certificate, diploma, certificate or proof of attendance - admission ticket - statements - copies of articles and documents - all other evidence that is acceptable to GNG The CPDP registration per certificate holder is not open to the public and can only be accessed by the certificate holder himself and by GNG and by GNG appointed or authorized auditors.

Als CPDP bewijsmateriaal wordt erkend: - origineel certificaat, diploma, getuigschrift of bewijs van deelname - toegangsbewijs - verklaringen - kopie artikelen en documenten - alles dat redelijkerwijs bewijs levert zulks ter genoegdoening van GNG De CPDP registratie per certificaathouder is niet openbaar en uitsluitend toegankelijk voor de certificaathouder zelf alsmede voor GNG en door GNG aangestelde of erkende auditors.




If the attended CPDP has not yet been acknowledged by GNG and/or the committee for training & education has not yet recommend a CPDP rating, the certificate holder is obliged to submit a request to do so with GNG and/or the committee for training & education. A request can be: - denied - accepted

Indien de gevolgde CPDP nog niet is erkend door GNG en/of indien de scholingscommissie nog geen CPDP advies heeft uitgebracht is de certificaathouder verplicht een verzoek hiertoe in te dienen bij GNG en/of de scholingscommissie. Een verzoek kan worden: - afgewezen - toegewezen

CPDP PERIOD AND CPDP REQUIREMENTS

CPDP PERIODE EN CPDP VEREISTEN

10.1

The CPDP period equals a calendar year.

De CPDP periode is gelijk aan het kalenderjaar.

10.2

The CPDP period starts on 1 January.

10.3

If the certificate holder is certified after 1 January no CPDP obligations apply in this 1st year of registration.

10.4

The CPDP period always ends on 31 December.

10.5

The certificate holder is obliged to obtain a total of twelve (12) CPD points per CPDP period.

De CPDP periode begint op 1 januari van een kalenderjaar. Indien de certificaathouder niet op 1 januari wordt gecertificeerd geldt een CPDP vrijstelling voor het resterende deel van dit 1e registratiedeeljaar. De CPDP periode eindigt altijd op 31 december. De certificaathouder is gehouden per CPDP periode een totaal aantal van twaalf (12) CPD punten te behalen. Het per CPDP periode te behalen aantal punten dient uit tenminste twee categorieën te zijn samengesteld. Per CPDP periode dienen minimaal 6 PE punten te worden behaald in de categorie één (scholing) en/of twee (verdieping). De CPDP periode kent geen maximum aantal te behalen punten. Indien de certificaathouder aan het einde van de CPDP periode een overschot aan CPD punten heeft wordt het overschot verrekend met de CPDP verplichting voor de voorliggende CPDP periode (carry back) en/of opvolgende CPDP periode (carry forward) zulks met tot maximum van twee CPDP periodes, zowel achteruit als vooruit. Het minimaal aantal CPD punten over vijf aaneengesloten CPDP periodes is derhalve 60 CPD punten.

The amount of CPD points to be obtained per CPDP period have to be composed of at least two categories. Per CPDP period at least 6 CPD points need to be obtained in category one (training) and/or two (in-depth activities). There is no maximum number of obtainable points per CPDP period. If the certificate holder has a surplus of CPD points at the end of the CPDP period, this surplus will be settled with the CPDP obligation for the previous CPDP period (carry back) and/or next CPDP period (carry forward), however to the maximum of two previous and/or next CPDP period. Therefore the average amount of CPD points per unbroken 5 CPDP periods is 60 CPD points.

If the certificate holder has not met the obligations as laid down in these regulations at the end of the CPDP period, the certificate holder will get the opportunity to yet fulfil the obligations during one calendar year. The obligations of the certificate holder in the following new continuous CPDP period remain undiminished. If necessary the (re)certification will be awarded provisionally. The aforementioned year starts on the first day after the CPDP period finishes. If the certificate holder has not met the requirements according to these regulations at the end of aforementioned year, the certification will be taken away from the certificate holder.

10.11

Appeal against the dispossession of the certification on the grounds of these regulations can be lodged with the quality standards committee in the certificate holder’s scope.

Indien de certificaathouder aan het einde van de CPDP periode niet heeft voldaan aan de verplichtingen zoals bepaald in dit reglement krijgt de certificaathouder gedurende één kalenderjaar te gelegenheid alsnog aan de verplichtingen te voldoen onverminderd de verplichtingen van de certificaathouder volgend uit de dan ingegane aangesloten nieuwe CPDP periode. In voorkomend geval wordt de (her)certificatie voorwaardelijk toegekend. Het bedoelde kalenderjaar gaat in op de eerste dag na het aflopen van de CPDP periode. Indien de certificaathouder bij het eindigen van het bedoelde kalenderjaar niet heeft voldaan aan de verplichtingen volgens dit reglement wordt de certificatie aan de certificaathouder ontnomen. Tegen de ontneming van de certificatie op grond van dit reglement staat beroep open bij de waarborgcommissie van de scope van de certificaathouder.

EXEMPTIONS AND CONCURRENCE

VRIJSTELLINGEN EN SAMENLOOP

A complete or partial exemption of the obligations can be granted to the certificate holder according to these regulations. To this effect, the certificate holder needs to submit a written request to GNG. A thorough motivation and justification have to be included in this request. A request can be: - denied - accepted - partially accepted - conditionally accepted Concurrence can be seen as the compliance of the certificate holder to the none GNG CPD programs for other professions or activities than for which the certificate holder has been certified by GNG.

Aan de certificaathouder kan een gehele of gedeeltelijke vrijstelling voor de verplichtingen volgens dit reglement worden toegekend. Hiertoe dient de certificaathouder een schriftelijk verzoek in bij GNG. Het verzoek dient te worden voorzien van een nauwgezette motivering en verantwoording. Een verzoek kan worden: - afgewezen - toegewezen - gedeeltelijk worden toegewezen - voorwaardelijk worden toegewezen Als samenloop wordt aangemerkt het door de certificaathouder moeten voldoen aan de andere CPDP verplichtingen voor andere beroepen of activiteiten dan waarvoor de certificaathouder is gecertificeerd door GNG. Op verzoek van de certificaathouder kan GNG besluiten onderdelen van niet GNG CPD programma’s volgens dit reglement te laten kwalificeren voor de CPDP verplichtingen van de certificaathouder. Een verzoek tot vrijstelling of een verzoek van samenloop wordt onder meer getoetst aan de doelstelling zoals vastgesteld in artikel vier van dit reglement.

At the request of the certificate holder GNG can decide to accept parts of none GNG CPD programs instead of the GNG CPDP in order to meet the obligations of the certificate holder.

ARCHIVE AND INFORMATION

ARCHIEF EN INFORMATIE

GNG is in charge of registering all documents (the archive) which are linked to these regulations and its execution. This also includes all CPD files. The archive mentioned in article 12.1 is not accessible for third parties and non-certificate holders.

GNG is belast met de archivering van alle documenten (het archief) die verband houden met deze regeling en de uitvoering daarvan waaronder mede begrepen alle CPD dossiers. Het onder 12.1 bedoelde archief is niet toegankelijk voor derden en nietcertificaathouders.

LIABILITY

AANSPRAKELIJKHEID

GNG does not accept any liability whatsoever for actions and/or behaviour resulting from this document. GNG emphatically denies liability of any kind.

GNG aanvaardt geen aansprakelijkheid, in welke vorm dan ook, voor het handelen en/of optreden verband houdende met onderhavig reglement. GNG wijst iedere aansprakelijkheid nadrukkelijk van de hand.

AUTHORITY

BEVOEGDHEID

GNG is authorized to set and alter these rules.

GNG is bevoegd tot het vaststellen en wijzigen van dit reglement.

CONFIDENTIALITY

GEHEIMHOUDING

GNG, its management, its committees as well as individual committee members are obliged to keep their knowledge of certificate holders and/or third parties, information regarding companies, agencies, and any organizations and/or persons about which they have information as a result of their role within GNG strictly confidential.

GNG, de directie, de commissies alsmede de individuele commissieleden zijn gehouden aan de geheimhoudingsplicht jegens de certificaathouders en/of derden met betrekking tot de kennis en/of de informatie omtrent bedrijven, certificaathouders, instanties, organisaties en/of personen welke kennis en/of informatie tot hen is gekomen op grond van hun functie binnen GNG.

Any breach of confidentiality is grounds for the removal of the person from his/her position and if they are certificate holders grounds for examination of compatibility with the code of conduct and the standing rules regulating complaints and disciplinary action.

Het schenden van de geheimhoudingsplicht is grond voor ontzetting uit de functie en ingeval van het zijn van certificaathouder grond voor toetsing aan de gedragsregels op basis van het reglement klacht- en tuchtrecht.

DISPUTES

GESCHILLEN

Should a dispute occur because this code does not or does not adequately cover a situation, GNG is authorized without prejudice to the provisions of the articles of association to leave no stone unturned to alter the statutes of GNG.

Voor zover en indien dit reglement iets niet of onvolledig regelt en/of leidt tot een geschil is GNG bevoegd, onverlet het bepaalde in de statuten van GNG

If the GNG does not settle the dispute, the dispute will be subject to mediation. If mediation is not successful, the dispute will be brought before a Dutch court.

Indien GNG geen besluit neemt ten aanzien van het geschil, wordt het geschil onderworpen aan mediation. Indien de mediation niet slaagt wordt het geschil aan de bevoegde Nederlandse rechter voorgelegd.

MULTILINGUAL

MEERTALIGHEID

In cases where more than one language is in use, English will be the language of choice.

Bij meertaligheid prefereert de Engelse taal boven elke andere taal.

LAW

WET

This code shall be governed by Dutch law only.

Uitsluitend de Nederlandse wetgeving is van toepassing.
