REPUBLIK INDONESIA
MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL COUNTER-TERRORISM AGENCY OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF PUBLIC SECURITY OF THE PEOPLE'S REPUBLIC OF CHINA ON STRENGTHENING COUNTER-TERRORISM COOPERATION
The National Counter Terrorism Agency of the Republic of Indonesia and the Ministry of Public Security of the People's Republic of China (hereinafter referred to as "the Parties"); Desiring to consolidate and develop the Comprehensive Strategic Partnership between the Republic of Indonesia and the People's Republic of China; Aiming to strengthen cooperation in combating terrorism on the basis of mutual respect for sovereignty, equality and mutual benefits; Pursuant to the prevailing laws and regulations in their respective countries as well as international conventions to which both governments are parties; Have reached the following understanding:
I.
Objective
This Memorandum of Understanding will provide a framework for cooperation between the Parties in preventing, countering and combating international terrorism in all of its forms.
II.
Areas of Cooperation
The Parties, within the limit of its competence and prevailing laws, will cooperate to implement this Memorandum of Understanding, in the following activities: 1.
Exchange of information pertaining to: a.
1nternat1onal and regional counter terrorism s1tuat1on, as well as on legislation, national policies and strategies that related to counter terrorism ;
b.
organizations and persons conducting terrorist activities against Indonesia or China and other activities related to terrorism ; information concerning the provision of fund, material, personnel, technology and training to the above mentioned organizations or persons;
c
money laundering and terrorist financing by terrorist persons/groups in the territory of Indonesia and China;
d.
information related to cyber terrorism;
e.
any other information on the safety of its citizens and institutions related to counter terrorism.
2.
Exchange of views, experience, lesson learned and best practices in countering terrorism
3.
Promoting cooperation between the two countries ' law enforcement agencies and other institutions related to the effort to counter and combat terrorism.
4.
Strengthening capacity building and capabilities through networking and programs of training and education, seminars, and conferences.
5.
Exchange of visits of high officials, analysts and field operators.
6.
Other areas related to counter terrorism that may be agreed by the Parties.
Ill.
1.
Joint Working Group
In order to coordinate, oversee, evaluate implemented activities, identify and prepare subsequent programs and activities conducted within the framework of this Memorandum of Understanding, the Parties hereby establish a Joint Working Group at Director General level.
2.
The Joint Working Group consists of Parties' representatives with the composition to be determined by both Parties. It will be co-chaired by chief representative at Director General level from either Party.
3.
The Joint Working Group will hold its regular meeting at least once a year alternately in Indonesia and China on a date mutually agreed upon. It
may hold a spQcial meeting as mutually agreed upon by both Parties. IV.
Designated Authority
1.
The designated authority responsible for the implementation of this MOU will be the Deputy for International Cooperation Office of the National Counter Terrorism Agency of the Republic of Indonesia and the Counter Terrorism Department of the Ministry of Public Security of the People's Republic of China .
2.
To ensure timely and effective communication, the Parties may communicate through the following details: a. V.
Funding
1.
The implementation of this Memorandum of Understanding will be subject to the availability of funding and officials of each Party.
2.
Unless otherwise agreed in writing, each Party will bear the cost and expenses for its participation in activities under this Memorandum of Understanding.
VI.
Confidentiality
1.
The information and documents provided to either Party must be treated as confidential and will only be used within the framework of this Memorandum of Understanding.
2.
Any information, document or technical means received in accordance with this Memorandum of Understanding shall not be transferred to a third party or used for purposes other than prescribed without the prior written consent from the providing Party.
3.
The provisions of this Article shall continue to be binding between the Parties not withstanding the termination of this MoU.
VII.
1.
Refusal of Requests
Request of assistance may be refused completely or partially, if the requested Party considers the execution of the request would be prejudicial to its state sovereignty, national security or public interests.
2.
The requesting Party will be notified promptly of the reason for the complete or partial refusal to execute its request, in any case, within 30 days after the requested Party receives such request of assistance.
VJll.
Settlement of Disputes
Any dispute arising out of the interpretation or implementation of this Memorandum of Understanding will be settled amicably through consultations or negotiations between the two Parties through diplomatic channels.
IX.
Amendment
This Memorandum of Understanding may be amended or revised , as deemed necessary, by mutual written consent of the two Parties. Such amendment or revision will come into effect on the date determined by the Parties and will be part of this Memorandum of Understanding.
X.
Duration and Termination
1.
The Memorandum of Understanding will come into force on the date of its signing and will remain in effect for three (3) years and will be automatically extended for a further period of three years.
2.
Either Party may at any time terminate this Memorandum of Understanding by giving three (3) months advance written notice to the other Party.
3.
The termination of this Memorandum of Understanding will not affect the implementation of ongoing cooperative activities that had been approved by the Parties prior to the date of termination, unless otherwise agreed by the Parties.
IN WITNESS WHEREOF, the undersigned being duly authorized thereto by their respective Governments, have signed this Memorandum of Understanding.
DONE in duplicatg in Bgijing on this 21st day of August in the year 2014 in Indonesian, Chinese and in English language, all texts being equally authentic. In case of any divergence of interpretation, the En91ish text will prevail.
