Strategisch gebruik van auteursrecht Prof. dr. Martin Senftleben Vrije Universiteit Amsterdam Bird & Bird, Den Haag
Inleiding
Digitale omgeving
dream of the free flow of information
Problemen in de academische wereld • crisis of communication via scientific journals – increasing price of journals – in addition: more and more online resources – shrinking library budgets
• libraries offering only a small fraction of the knowledge available
Oplossing: open access • broader access to resources • free availability of resources • easier exchange of thoughts and ideas • broad acceptance in the scientific community – money or fame? – monetary incentive not necessarily required
– earning a reputation much more important
Open Access: voorwaarde 1 ‘…a free, irrevocable, worldwide, right of access to, and
a license to copy, use, distribute, transmit and display the work publicly and to make and distribute derivative
works, in any digital medium for any responsible purpose, subject to proper attribution of authorship […], as well as the right to make small numbers of printed copies for their personal use.’ Berlin Declaration, October 20-22, 2003
Open Access: voorwaarde 2 ‘A complete version of the work and all supplemental
materials […], in an appropriate standard electronic format is deposited (and thus published) in at least one online repository […] that is supported and maintained by an academic institution, scholarly society, government agency, or other well-established
organization that seeks to enable open access, unrestricted distribution, inter-operability, and longterm archiving.’ Berlin Declaration, October 20-22, 2003
Actuele ontwikkelingen • substantial investment in open access platforms – example NL: 5.000.000 € in 2010 – 2.500.000 € for financing publications in peerreviewed scientific open access journals – similar initiatives in other EC countries
• open access ≠ free of cost

Golden road

verveelvoudiging • branches, gebruiksomgevingen, distributiekanalen • territoir, taalgebied • tijd • werkonderdelen • aantallen exemplaren of openbaarmakingen
Voorbeeld green road • exclusieve rechten slechts voor een
beperkte periode • het liefst ruimte voor parallele open access publicatie vanaf het begin • embargo periode zo kort mogelijk ‘…rights shall be granted exclusively for a period of one year, subsequently the publisher shall keep the non-exclusive rights for an unlimited
period of time.’
