Jailed tug skipper released on bail SHETLAND coastguard tug skipper Peter Leask, who was jailed in April for being drunk in charge of his vessel, ramming rocks and polluting Scalloway harbour last September, was released on bail Tuesday pending an appeal. The Court of Appeal in Edinburgh released 42 year old Leask on bail after he had spent 48 days of his eight month sentence behind bars. He was the first person in Scotland to be jailed under new laws aimed at tackling drinking at sea. On 19 April he pleaded guilty to three charges including being more than three times the legal limit for alcohol in his breath, taking his vessel off the rocks without assessing the damage and causing pollution. Leask had been at the helm of the Maritime and Coastguard Agency's anti-pollution tug Anglian Sovereign on 3 September last year when he missed a marker buoy and struck the Cheynies rocks at full speed. After his crew were airlifted to safety he reversed the powerful vessel off rocks, and then limped into Scalloway harbour spilling 84 tonnes of marine diesel into an area of sea full of fish farms. The father of four, who lives at Leaside, Mossbank, is not expected to work as a skipper again, even though his master's ticket has not been taken off him. He has been sacked by his employers Klyne Tugs, of Lowestoft. The accident left a repair and clean up bill of more than £3 million, though the environmental damage was limited. DAILY COLLECTION OF MARITIME PRESS CLIPPINGS 2006 – 113 At Lerwick Sheriff Court Leask asked to be given a community service order, but Sheriff Graeme Napier sent him to prison. His advocate Claire Mitchell successfully argued he should be released from jail while he appeals against his sentence. No date for his appeal hearing has yet been heard. The 2,258 tonne Anglian Sovereign was chartered to patrol the northern isles by the MCA in 2000 as one of the recommendations of the Lord Donaldson inquiry following the 1993 Braer oil spill, off Shetland.
UN praises cruise ship for rescuing migrants The United Nations refugee agency today praised the rescue of 22 migrants, including at least one asylum seeker, whose vessel had sunk in the Aegean Sea, by the crew of a Dutch-registered cruise ship of the Holland America Line. “This incident highlights the urgent need for states to cooperate in order to prevent the tragedies that are occurring almost daily, in the Mediterranean and elsewhere, when people use desperate means to seek a better life or refuge,” UN High Commissioner for Refugees (UNHCR) António Guterres said. The MS Noordam was on its way from the Greek city of Piraeus to the Turkish port of Kusadasi on Tuesday, when the crew spotted several people in the water off the Greek island of Samos. The ship rescued 22 people from various countries, including Somalia and Iraq but sadly one child drowned before the group could be rescued. The group were taken to Kusadasi on Wednesday. “We want to commend the shipmaster and crew of the MS Noordam for their humanitarian act and for upholding international law and custom. We are also grateful to the government of Turkey for receiving these people in need,” Mr. Guterres said. UNHCR is working closely with the UN International Maritime Organisation (IMO) and other relevant UN agencies to safeguard the integrity of the international search and rescue regime so as to offer support and guidance to ships’ masters who come to the aid of refugees and asylum seekers in difficulty at sea. Shipmasters have an obligation under international law to rescue any persons in distress at sea. Persons rescued at sea should be disembarked at the next port of call, where they should be admitted, at least on a temporary basis. "At a time when captains are constantly asked to boost efficiency and cut costs, it remains vital that they continue to take the time and trouble to rescue people in peril - whether they are refugees or any other people in distress,” UNHCR said.
P&O virus passed on by sick passenger
New South Wales Health says it is likely a sick passenger was the source of a stomach virus outbreak on a P&O cruise. PSi-Daily Shipping News

DAILY COLLECTION OF MARITIME PRESS CLIPPINGS 2006 – 113 The Pacific Sun is due home in Sydney this morning after 60 people fell ill with the norovirus, which causes diarrhoea and vomiting. The 10-day tour along the Queensland coast was delayed in Brisbane as crews disinfected the ship. Dr Mark Ferson from NSW Health says the outbreak does not appear to have been caused by food poisoning. "It can be transmitted through food but in this case it's just people spreading it," he said."We know that it just spreads because the virus is present in the vomit and in the faeces. "It just spreads by close contact between people and there's just huge amounts of virus present in those body substances. "The illness can sometimes last only a short time, like only a few hours or one or two days."
Cruise Ship Freed From Sandbar According to reports, the cruise ship Norwegian Crown, with 1,104 passengers aboard, ran aground just off Bermuda on June 7, and after remaining stuck on a sandbar through the day, was pulled off by tugs during the evening high tide. The cruise ship's passengers and crew were at no time in any danger, according to Norwegian Cruise Lines, which said the ship tendered passengers ashore to Hamilton for local excursions. The 34,000-ton ship ran aground at about at the top of Dundonald Channel as it sailed from St. George's, Bermuda, to Hamilton in heavy rain. Three tugboats tried to set the Norwegian Crown free, and eventually postponed efforts due to high tide. After it was pulled free, the ship headed for Dockyard, skipping Hamilton as a port of call.
Unions warn Tallink on Silja Tallink, one of the bidders for Silja Line, the Baltic ferry subsidiary of Sea Containers, has been warned by seamen’s unions in Finland and Sweden not to try cutting manning costs. The Estonian company, badly bruised in last week’s boycott of its ferries in Finland, is singled out in the stark message from the Finnish Seamen’s Union and its Swedish counterpart, Seko. The unions, with around 2,000 members working for Silja, think the Estonian company is favourite to win the auction for Silja, put up for sale by troubled Sea Containers last November and with a decision due by the end of this month. The FSU and Seko say pay and conditions on the cruiseships and ro-ro ferries operating between Finland and Sweden must be kept at Finnish or Swedish levels, whatever the flag or nationality of shipboard personnel. Tomas Abrahamsson of Seko says no decision on boycotting the ships under any cost-cutting new owner has been taken, but admits: “In the end that’s our weapon”. After its dispute with the FSU last week Tallink eventually agreed to increase pay for its Estonian crews on three recently-acquired superfast ferries to Finnish levels by 2008 and was forced to drop a call in the Estonian port of Paldiski to offset the higher costs on the surviving Germany-Finland route. Tallink is competing for Silja with several other bidders, including rival Viking Line, a management buyout led by CEO Antti Pankakoski and Norwegian investment firm Norferries which announced a bid of EUR 520m ($658m) last month. Sea Containers has been restructuring Silja ahead of the sale and said it would sell or charter out the Swedish-flag Silja Opera as “unions have been slow to allow manning conditions which would enable the vessel to continue to operate in the Baltic”. With the sale or chartering-out of another ship, Silja is being reduced to a core fleet of eight ships on three routes, while 150 shoreside jobs are being cut in Finland, Sweden and Germany at a cost of up to $10m to produce annual savings of $18m. Societe Generale was appointed by Sea Containers to hold a “controlled auction” of Silja. PSi-Daily Shipping News

Supreme Court Allows Toxic Ship Blue Lady to Enter India The Supreme Court on Monday permitted Norwegian ship Blue Lady, containing 1,240 metric tonnes of toxic asbestos, to enter Indian territorial waters with the directions that the ship be anchored at Alang port in Gujarat for inspection by the Indian authorities. The vacation bench comprising Justice Arijit Pasayat and Justice C K Thakker allowed the application filed by the Centre seeking permission for the entry of the ship into India. Additional Solicitor General Gopal Subramanium, appearing for the Centre, assured the court that all safety norms related to pollution of the environment will be adhered to and also pleaded that the inspection was not possible unless and until the ship was permitted to arrive in Gujarat. Sanjay Parikh, counsel for the petitioner NGO Research Foundation for Science, however, opposed the entry of the ship on the grounds that the hazardous waste in the ship was yet to be decontaminated. The court, however, rejected the contention of the petitioner and accepted the suggestion made by an expert committee appointed by the Supreme Court and directed that all safety norms be strictly implemented. DAILY COLLECTION OF MARITIME PRESS CLIPPINGS 2006 – 113 The court, however, did not permit the dismantling of the ship till further orders. It may be noted here that the ship had started from Malaysia and came to reach its present destination via Dubai. Neighbouring Bangladesh has already refused entry to the ship. At present it is anchored 120 km away from Indian territorial water. Earlier the French government had to recall its ship containing similar toxic hazardous substance after the Supreme Court refused entry to the ship. Counsel for Central Pollution Control Board, Vijay Pajwani, pleaded that hazardous waste rules pertaining to import of such toxic waste must be strictly complied with.

Bijzondere opening expositie ONDERZEEBOTEN !

IRISL to Launch Feeder Service Islamic Republic of Iran Shipping Line (IRISL) is about to launch its own feeder service in the Baltic Sea region. A spokesman for the company's Hamburg branch said the service would start by the middle of next week. It will be served by the 269 TEU vessel "Paaschburg". The 1980-built ship, owned by German tramp owner Seavoss, has been chartered in by IRISL for 9 months. The line did not want to send its bigger ships to Sweden for the new contracts and decided to open a feeder line instead.
Cianbro to Convert Tankers into Supply Ships Cianbro Corp. has been awarded a contract to convert two 370-foot sulfur tankers into multipurpose supply vessels for the offshore oil industry. Cianbro said its agreement with Hornbeck Offshore Services of Covington, La., will provide more than 300 jobs on the Portland waterfront and at Bath Iron Works, the primary subcontractor on the project. Cianbro said it is scheduled to receive the first ship later this month, with work on both vessels expected to continue through next year. Terms of the deal are not being divulged. When completed, it is believed that the two U.S.-flagged vessels will be the largest offshore supply ships in the world, according to the Pittsfield-based construction company's announcement, which did not include the dollar value of the contract. Work on the project will take place at Cianbro's Ricker's Wharf marine facility, the Portland Ocean Terminal, BIW's fabrication facility in Brunswick and its main shipyard in Bath. Todd Hornbeck, chairman, president and CEO of Hornbeck Offshore Services, said the HOS 370s will be unlike any vessels now working in the Gulf of Mexico. He said they are designed to have multiple Coast Guard certifications and will be able to support offshore construction, subsea well intervention, pipe hauling and floating hotel services, among other capabilities.

N. Korea flag barred on 9 ships A Syrian shipping company operates a North Korean-flagged freighter that is owned by one of nine Delaware-based companies, a practice barred last month by U.S. government sanctions that prohibit U.S. firms from flying the North Korean flags on ships. The nine ships that are owned or operated by companies incorporated in Delaware are listed in the authoritative industry reference Fairplay World Shipping Encyclopedia, including the cargo ship United that is owned by a company known as United Maritime Co. and operated by Phoenicia Maritime, whose headquarters are in Tartous, Syria. Industry sources also said that North Korean-flagged vessels are owned or operated by companies in Belize, Greece, Iraq, Lebanon, Liberia, the Marshall Islands, Panama, Pakistan, Romania, St. Vincent and the Grenadines, Singapore, Syria, Turkey, Ukraine, the United Arab Emirates and Yemen. The Treasury Department's Office of Foreign Assets Control last month ordered all U.S.-incorporated shipping companies to stop using North Korean flag registry for their ships after intelligence reports indicated that Pyongyang was making money from selling its flag at higher-than-normal prices, and that some of the ships are engaged in illegal activities. Administration officials said the sanctions reversed Clinton-administration rules that loosened Korean War-era economic sanctions on North Korea as part of efforts to induce the communist regime to halt long-range missile tests. Weeks after the sanctions went into effect on May 8, U.S. intelligence officials said there are signs that North Korea is preparing a test launch of its long-range Taepo-Dong 2 missile, which was first flight-tested in August 1998. The shipping sanctions are part of "defensive measures" aimed at punishing North Korea for illegal activities that include counterfeiting U.S. currency, specifically a high-quality fake $100 bill known as a supernote, as well as drug trafficking and human smuggling, the officials said. In addition to the Syrian-owned United, the eight ships that are owned or operated by Delaware-based companies covered by the new sanctions are: • The cargo ship Tolstoy, formerly a Ukrainian-flag freighter that now is owned by the Delaware-based Pegasus Shipping; and the refrigerated cargo ship Lady Haya, formerly the Spanish-flagged ship that is owned by the U.S. company BCK International Shipping Ltd. • The North Korean-flagged cargo ships Johaynna, owned by Faissal Shipping Inc.; the Haj Sayed, owned by the Trabeh Lines Co.; Ahmad N, owned by Reem Shipping and managed by Phoenicia; the Alalaa 1, owned by Sharm Shipping; and the Boushkin, owned by Perseus Shipping, are all listed as being U.S.-owned or -operated and having headquarters in Delaware City, Del. • The cargo ship Farouk-M, owned by FYMT Shipping, which is based in Alexandria, Egypt, and has an incorporated subsidiary in Delaware and also purchased a North Korean flag registry. A Treasury Department official said none of the ships should be flying the North Korean flag as of May 8, but it is not known whether the ships have changed their registries. Administration officials say North Korea was charging two or three times the market rates for ships to fly its flags.

Italia Marittima and Zim to Launch a New Service
Italia Marittima SpA (ITS) and Zim will launch a new weekly transatlantic service early August 2006. Designated the North Europe – US East Coast (NEC) service, it will link the North European ports of Antwerp, Hamburg and Liverpool with New York, Norfolk and Savannah. The new service will deploy four ships, each with a loading capacity of approximately 1,800 TEU. ITS will provide two ships, while Zim will contribute the other two ships. The first westbound voyage ix expected to depart Antwerp early August and will commence a port rotation of: Antwerp – Hamburg – Liverpool – New York – Norfolk – Savannah. According to ITS, the NEC service will complement its slot allocation on the NUE service, an Evergreen-operated pendulum service linking North Europe, North America and Asia via the Panama Canal. While the NUE service covers Antwerp, Bremerhaven, Thamesport, Rotterdam and Le Havre in Europe and New York, Norfolk and Charleston in the US, the NEC service offers German and Benelux ports (Hamburg and Antwerp) as well as Liverpool, a UK port with a long tradition of serving the North Atlantic trade and a strong catchment area in Northern England and the Midlands. In the US, shippers will now have twice weekly calls in New York and Norfolk and the option of Savannah as well as Charleston in the South Atlantic
Stena - Prospective Buyer of Scandlines Also Stena Line has entered the bidding for the Danish/German Scandlines, which is equally owned by the Danish Ministry of Transport and Energy and the German railway company Deutsche Bahn AG. Last Friday Stena officially declared its interest to buy the company. "It feels natural for us with a merger as we already own the Swedish part of Scandlines. If we in the end acquire the remaining parts of Scandlines we see great possibilities to develop the activities in the common company. It is a well managed and profitable company with very competence employees," says Stena Line's managing director Gunnar Blomdahl. Among the other bidders is the German shipping company Seereederei, financed by Alliance Capital Partners and LD Equity. Also the Australian Macquarie Bank is said to have shown interest for Scandlines.
