Fishing boat skipper on cellphone before collision
A woman's death after a collision between an Auckland ferry and a charter fishing boat was due to the failure of both skippers to keep a proper lookout, the Transport Accident Investigation Commission has found. The finding came in a report released today into the January 4 collision that killed Gisborne woman Moira (known as Margaret) Newman, 74. She was a passenger on the Dr Hook fishing boat which was struck by the Fullers Quickcat ferry sailing from Waiheke Island to Auckland and died three weeks later. None of the 377 passengers or eight crew on the Quickcat was hurt. The commission found that the skipper of the Quickcat, Wayne Williams, did not have an additional lookout although visibility from the bridge was restricted by a cargo crane. Immediately before the collision, the owner and skipper of the Doctor Hook, Bruce Newbury, was on a cellphone and examining fishing gear, and failed to respond to warnings from his passengers, the report said. Williams has pleaded guilty to two charges under the Maritime Transport Act of operating a vehicle in a manner causing unnecessary danger or risk to other persons and operating a vehicle in a manner causing unnecessary risk to property, and will be sentenced in Auckland District Court on September 16.

The additional charges include failure to keep a proper lookout. The report found Williams did not see the Doctor Hook until it was too late but did put the engines into neutral and turned to port, which may have reduced the impact. Newbury did not initially respond when his passengers asked if he had seen the ferry until one shouted at him and grabbed his arm. He then tried to turn to port. The report found he may have been suffering from fatigue, having worked two 15-hour days immediately before the day of the accident. The commission said Fullers had ordered a new crane to improve visibility and made it standard procedure to have at least two crew on the bridge at all times.
Log barge adrift off Cape Flattery A log barge was adrift off Cape Flattery and in danger of running aground, Makah Indian Tribe officials said Friday. An oil spill adviser for the Makah Tribe, Chad Bowechop, said he was notified by the Coast Guard about 1 a.m. that the barge had separated from its tug. The barge carried no logs but has a crane on board with as much as 3,000 gallons of fuel and hydraulic fluid. Bowechop said the tug "Sea Commander" has been repaired at a Canadian port and is returning to the scene, and the Coast Guard said another tug was on its way from Bellingham. If the barge goes aground, it could threaten tribal property and the Olympic Coastal Marine Sanctuary.
Oil tanker rescues stranded refugees
A Danish oil tanker rescued 39 Somali refugees stranded in a boat off the coast of southern Yemen, the United Nations High Commissioner for Refugees said in a statement in Geneva on Friday. The refugees had spent several days on the open seas after the boat of the smugglers they had paid to take them from Somalia across the Gulf of Aden to Yemen broke down on Wednesday, UNHCR said. One person died during the trip, while a woman gave birth to a child, the refugee agency said.
"On Thursday afternoon, the 39 Somalis were given permission to dock in Djibouti," after the UN agency was contacted by the Danish tanker, UNHCR said.
Japan spots Chinese warships Japanese authorities said on Friday they had seen Chinese warships for the first time near a disputed gas field in the East China Sea, which Tokyo recently opened to exploration.

DAILY COLLECTION OF MARITIME PRESS CLIPPINGS 2005 – 207 A fleet of five ships, including a 7,940-tonne Sovremenny-class destroyer, had been spotted midmorning by a Japanese P-3C patrol plane near the Chunxiao gas field, said the Defence Agency’ s maritime staff office. The gas field lies just on China’ s side of what Japan claims to be the median line between their exclusive economic zones. China does not recognize the line. In November, Japan spotted a Chinese nuclear submarine intruding into what it considers its waters near the gas fields. Relations between the nations have seriously deteriorated this year over both the gas field and memories of Japan’ s bloody wartime occupation of China. Beijing has been incensed at visits to a Tokyo war shrine by Prime Minister Junichiro Koizumi, who is predicted to win a general election Sunday, which he has kept focused on domestic economic reforms.
Spill fine for Brostrom Swedish tanker owner Brostrom has been ordered to pay £31,344 ($57,500) by a UK court for a negligent spill of bunker oil. Fuel leaked from the 14,300-dwt products carrier Bro Traveller (built 1988) during a routine internal bunker transfer soon after the vessel left Grangemouth bound for Rotterdam in March 2004. The spill was caused by a breakdown in procedures following maintenance of a transfer pump. A system that automatically shutdown the bunker transfer system had been deactivated. District judge Fred Rutherford ruled that the incident was caused by error and negligence stating that Brostrom had failed to have proper procedures in place to ensure that an incident of this type did not happen. Brostrom was fined £20,000 and ordered to pay costs of £11,344 at Hull magistrates court. The Bro Traveller was involved in a collision in off the UK with the 28,000-dwt Greek controlled bulker Island Gem (built 1984) in March of this year.
Terugkeer kotter 'ongehoord'
Door : Eric Molenaar De 23 meter lange kotter Varnebank, waarvan de Raad van State eind juli aangaf dat hij illegaal in de Oosterhaven lag, is daar vertrokken maar weer teruggekeerd. Dat de gemeente dit heeft toegestaan is volgens de rechtskundig adviseur van buurtbewoners die strijden tegen het 'kolossale' schip 'ongehoord' en 'een sterk staaltje bestuurlijke ongehoorzaamheid'. Volgens rechtskundig adviseur W. van Bentem heeft de gemeente bewust 'het schip nog even gauw toegelaten'. Hij zegt dit in zijn 23-jarige rechtspraktijk nog nooit te hebben meegemaakt. Hij heeft gisteren bij het college een klacht ingediend tegen burgemeester en wethouders zelf en andere betrokkenen. Ook heeft hij op grond van de wet openbaarheid van bestuur alle documenten opgevraagd die betrekking hebben op de relatie tussen de gemeente Enkhuizen en botenhandelaar Floor Kersten. ,,Ik kan en wil niets insinueren, maar de gemeente wringt zich in allerlei bochten om te zorgen dat die boot daar mag blijven liggen. Waarom? Toch niet voor die paar honderd euro die de verhuur van dat stukje Oosterhaven de gemeente oplevert?'' Kersten huurt al sinds begin jaren negentig 200 vierkante meter bedrijfswater in de Oosterhaven van de gemeente. Hij handelt in schepen, die hij daar opknapt en weer verkoopt. Omwonenden R. Lub en G. van Dokkum waren altijd al tegen dit gebruik, maar de maat was vol toen de Varnebank hier een paar jaar geleden kwam te liggen. Dit grote schip ontneemt hen het uitzicht op de haven. In een van de juridische procedures die werden gestart bepaalde de afdeling bestuursrechtspraak van de Raad van State, eind vorige maand, dat het afmeren van de schepen op deze plek niet in overeenstemming is met het geldende

Volgens Van Bentem kan het college nu niet anders dan het besluit nemen het schip te verwijderen. Hij was dan ook verheugd vorige week te horen dat het schip was vertrokken. ,,Ik belde direct de gemeente met het verzoek het schip niet meer toe te laten tot de lopende procedures zijn afgehandeld. Maar ik begreep dat de verantwoordelijk wethouder daar niet aan wil beginnen. Dus heb ik een verzoek voor een voorlopige voorziening naar de bestuursrechtbank in Alkmaar gestuurd waarin ik een verbod vroeg om het schip weer tot de haven toe te laten. Dat zou woensdag 24 augustus worden behandeld maar het is door de rechtbank een week uitgesteld omdat meneer Kersten er anders niet bij kon zijn. En inmiddels ligt het schip weer in de haven, dus loop ik achter de feiten aan.'' Wat Van Bentem betreft handelt Enkhuizen bewust tegen de wet. De gemeente had schriftelijk vergunning moeten verlenen voor het binnenvaren en afmeren van het schip en had die moeten weigeren als het afmeren in strijd is met het bestemmingsplan. Dat het schip 'mondeling is toegelaten' is onderwerp van een aparte zaak bij de bestuursrechter in Alkmaar. Volgens Van Bentem is het veel lastiger het schip weg te krijgen nu het er weer ligt. ,,De voorzieningenrechter kan niet zomaar zeggen dat de gemeente het schip moet wegslepen.'' Bij de gemeente kon gisteren niemand reageren.
Owner denies UK accusations
Turkish shipowner Bilgili Denizcilik is vehemently rejecting claims by UK port-state authorities that crewmen on its 6,000-dwt general cargoship Berkan B (built 1984) were unpaid and underfed. Speaking from Istanbul, Captain Hakan Bilgili denounces claims circulated yesterday by the Maritime & Coastguard Authority (MCA) as nonsense. The MCA said it had detained the vessel at Ipswich for a number of safety-related violations after receiving reports that the crew had not been paid wages for three months and was subsisting on bread and olives. “The technical problem may be different but when it comes to crew and unpaid salary, it is all bullshit,” said Hakan. “In every Turkish vessel, the first thing we spend money on is crew provisions, even before technical [expenses].” Offering to fax invoices, he said: “We spent $6,000 at Damietta on provisions including 150 kilos of meat and 50 kilos of chicken. Upon arrival [in the UK] we advised the shipchandler to bring about £2,500 [$4,600] worth of provisions on board.” He adds that the crew would have to be “eating like cannibals”to have consumed that much meat in 14 days and that it is only logical that a vessel would have been out of fresh vegetables by the end of that period.

Keel laying ceremony Logistic Support Vessel Royal Netherlands Navy
On the 25th of August 2005 the keel laying ceremony of the new Logistic Support Vessel for the Royal Netherlands Navy took place at Damen Shipyards Galati, Romania.
The ceremony was performed by Vice-Admiral R.A.A. Klaver, Commander-in-Chief Royal Netherlands Navy (RNUN). This keel laying ceremony marks the start of the construction of the new vessel which will replace the current vessel named HM “Pelikaan”. The 56 meter long vessel will be based in the Caribbean and will be deployed for transport of equipment and personnel mainly in the Netherlands Antilles. Delivery of this new vessel is scheduled for May 2006.

ASRY breaks repair record ARAB Shipbuilding and Repair Yard (ASRY) completed repair work on 111 vessels in the first eight months of 2005, showing a 23% increase over the same period last year. "The repair work, with a total of 6.05Mdwt, is perhaps the largest ever by any shipyard and far exceeds our own record of 90 vessels repaired during the same period in 2004," ASRY chief executive Mohammed Al Khateeb told daily newspaper Bahrain Tribune. The dock occupancy rates remained 94% plus and the vessels repaired in the period ranged between 120m and 140m in length. Of the total repaired, half came from outside the Arab and the Middle East countries. In July ASRY launched a $15M expansion project for three additional 140m long berths; the project is scheduled for completion by 2007.
Principeovereenkomst Iv-Groep en Damen Shipyards
De Iv-Groep en Damen Shipyards hebben een principeovereenkomst bereikt voor een samenwerking op het gebied van engineering. Damen Shipyards zal daartoe een belang nemen in Iv-Nevesbu. EU okays late yard subsidies
The European Commission (EC) has given retroactive approval to Portuguese operating subsidies granted to Viana do Castelo shipyard. The Portuguese state kicked in some 9% of the operating cost for building the 14,000-dwt productschemical tankers Kiisla (built 2004) and Suula (built 2005). The ice-classed pair, built to Fortum specifications, was originally set for delivery in October and November of 2003 but delayed beyond the limits allowed by European subsidy rules.

DAILY COLLECTION OF MARITIME PRESS CLIPPINGS 2005 – 207 But according to European Union (EU) rules abolishing state operating aid to shipbuilding, the last ships qualifying for such subsidies had to be built under contracts signed before the rules were passed in December 2000 and executed before the end of 2003. Now, however, the decision okays delivery dates of 29 October 2004 and 5 February 2005 for the two products tankers built by Estaleiros Navais de Viana do Castelo. The EC exception or “derogation”from the subsidies ban is based on “the technical complexity of the construction of these two ships”. Unexpected disruptions in a yard’ s working programme as well as technical complexity can justify such extensions for up to three years.

Costa leads US back to Libya CARNIVAL Corp subsidiary Costa Crociere has unveiled plans to significantly increase the number of calls at ports in the North African country of Libya. Some 36 calls have been booked for 2006, compared with just 11 this year. Six ships will call at Tripoli, notably both the two current flagships Costa Magica and Costa Fortuna, together with the Costa Marina, Costa Classica, Costa Romantica and Costa Europa. Calls will also be made at Benghazi. About 50,000 passengers will visit Libya, four times the number estimated for 2005. Costa chairman and chief executive Pier Luigi Foschi will make an official visit to Libya next week on the Costa Allegra, during which he will meet the country's tourism minister Ammar Al Taief. The news comes two weeks after Libyan leader Moammar Gadhafi held talks with US Senate Foreign Relations Committee chairman Richard Lugar seeking to normalise relations with the US after decades of estrangement. Tripoli recently took the decision to abandon weapons of mass destruction, and Lugar revealed Gadhafi had invited President Bush and Secretary of State Condoleeza Rice to visit Libya.
Kollakis aid for Katrina The Greek government has chartered in the first cruiseship from Majestic International Cruises for aid stricken survivors of hurrican Katrina in New Orleans. Majestic International Cruises controlled by the Kollakis family in Greece has chartered out the 14,000-gt cruiseship Ocean Monarch (built 1955) to the Greece’ s Ministry of Foreign Affairs. The Hellenic republic has pledged at least two ships for the victims of Katrina. The cruise ship can accommodate just over 500 passengers according to company executive, Constantine Zalocostas. Tradewinds understands the charter rate is minimal and close to the operating costs of the cruise ship. Zalocostas says the charter party is subject to US Coast Guard (USCG) approval. The process he says normally can take up to three months for the USCG to stamp a seal of approval that would let ship to enter US coastal waters. The Greek Government however is currently working towards attaining a special dispensation from the USCG so that the relief is provided sooner. The ship end its current employment arrangements on 25 September after which it can sail down to New Orleans. The same vessel had been used for relief effort for Tsunami victims in Sri Lanka
Havila takes ship-sale profit Per Saevik’ s offshore vessel company Havila Shipping has booked a useful profit by selling a platform supply ship. The 2,100-gt Havila Fortune has gone for NOK 90m ($14.35m) to a Fearnley Finans limited partnership. Havila will gain NOK 36m from the deal and retain management of the vessel. It will also have 30% of the partnership. The vessel was acquired in March and will be delivered by the end of September, generating operating profit of NOK 20m in that time, Havila said. Havila listed in May in Oslo. Saevik and three of his children control 55% of the company. It owns a 16vessel fleet, after the sale, including four OSVs and an anchor-handling tug acquired from US-based Seacor earlier this year with the help of an NOK 260m private placement.

De KLM Airbus A330-200 De 'Dam - Amsterdam' (PH-AOA) heet hij: de jongste telg uit de KLM-vloot. Sinds 25 augustus jl. is KLM de eerste Airbus A330200 rijker. Wat betekent dit? Een ruimere cabine en een verbetering van service en comfort. Zowel in Business- als Economy Class is de A 330-200 uitgerust met het audio/video-ondemand systeem. Met dit systeem kunt u tijdens de vlucht uw favoriete film kiezen uit een zeer gevarieerd aanbod. Op het moment dat u het prettig vindt kunt u de film starten, stoppen of op pauze zetten. Daarnaast biedt het systeem audioprogramma’ s, spelletjes, flight tracking en bestemmings- en luchthaveninformatie. Last but not least is de Airbus A330-200 stiller en milieuvriendelijker. De ‘ Dam’wordt sinds 1 september vijf keer per week ingezet op de dagelijkse vluchten naar Washington. Vanaf 1 oktober vliegt de A330 dagelijks op deze route. Later dit jaar volgen nog twee toestellen, die worden ingezet naar New York (Newark) en Accra, Ghana. KLM zal acht A330-toestellen in haar vloot opnemen die op termijn de Boeing 767-300ER vervangen.
Second pilot helicopter crashes
ONE person died and another is missing after a helicopter from Le Havre Pilot station crashed early this morning, a few miles off Antifer, the Le Havre oil offshore port. At this stage, it is unclear why the newly built Dauphin helicopter fell into the sea, as the weather was calm in the area even though there were some fog patches. The aircraft had taken off a few minutes earlier and was heading for the Greek VLCC Arion to pick up the pilot assisting the ship out of Antifer. The marine pilot, who was in contact with the helicopter, said he suddenly lost contact with it. Two navy helicopters, a French coastguard patrol boat, a dredger and the P&O ferry Pride of Le Havre immediately attended the scene to try and locate the wreck and find possible survivors. Floating debris has been spotted, together with the body of one of the helicopter's crew. Le Havre pilots bought the helicopter in April. It is a modern aircraft with multiple safety devices supposed to prevent incidents. Pilots in Le Havre have been using helicopters since the late 1970s, particularly to serve VLCCs and large container vessels. An investigation into the cause of the accident has been started. The incident is believed not to have affected navigation, but all traffic in the area has been asked to watch the sea surface in the continuing search for the missing person. There are no consequences for pilotage resources as pilot boats are also in use at the port. The accident happened less than a week after another helicopter picking up a pilot crashed off Richards Bay, South Africa. That aircraft, described as a recently-serviced Augusta 119, broke up and sank, taking the life of a winchman on board, after it was said to have come into contact with the ship.
