THE NATION’S COMMITMENT IN OLD AGE INSURANCE FOR WORKERS Written by: Chazali H. Situmorang1 Abstract The existence of a nation is to fulfill multiple needs and wants, that requires the people to work together in order to fulfill their needs – as they could not fulfill it has individually. Thus, based on each persons‟ skill, each of them has their own tasks and work together to fulfill their needs. This unity is called society or nation. In a sovereign nation framework based on the 1945 Constitution, one of them is to provide social security for every citizens. Social security is also stated in the 1948 United Nations‟ Declaration of Human Rights, and further emphasised in International Labour Organisation‟s Convention No. 102/1952. Aligned with those regulations, the Indonesian Parliament (MPR-RI) in TAP No. X/MOR/2001 assign the President to create Nasional Social Security System (SJSN) to provide a integrated and comprehensive social security. In June 30th 2015, the Government issued Regulation No. 46/2015 about the Pension Plan – based on the Act No. 40/2004 about the National Social Security System. In the Regulation No. 46/2015, article 1 about the general requirement, section 1 that states “Old Age Insurance (JHT) is a lump-sum cash benefit that paid to the workers when retired, died, or permanently disabled”. Describing a nation‟s policy, in the form of regulations, is the necessity to measure the commitment of a nation in developing its people. Indonesia, as a part of the global world, has signed numerous world conventions and must be held accountable in improving the social welfare and protection for its citizens. In the implementation of JHT-SJSN, the findings are: (1) the nation‟s commitment has been relatively weak; (2) the regulations have been inconsistent; (3) the regulatons have multiple interpretations; and (4) the advocacy and socialisation have not been maximised. These findings are interconnected with each other. The first, second, and third findings are based on the same subject, which are Regulation No. 46, No. 60, and the Labour Minister Regulation No. 19/2015, that were cascaded from SJSN Act. The fourth finding is subject to the effort of BPJS Ketenagakerjaan. Because of the workers‟ resistance against the Regulation No. 46/2015, the Regulation No. 60/2015 and the Labour Minister Regulation No. 19/2015 were issued as a compromy – even though the content tend to diverge from the what is stated in SJSN Act. The policy recommendation for the Indonesian Government is to repeal the Labour Minister Regulation No. 19/2015 about the Procedures and Requirements of JHT Benefit Payment. 1

Regulations No. 60/2015 is also need to be revised, and directly referring to SJSN Act article 35, 36, 37, and 38. In that revision, it is also needed to regulate the mechanism of JHT claim payment under 10 years. BPJS Ketenagakerjaan must intensify the advocacy and socialisation of JHT philosophy and benefit for workers, so that they can age gracefully. BPJS Ketenagakerjaan Management has to create the necessary system and operational procedure. PENDAHULUAN Menurut Socrates, Negara dengan para pemimpin atau para penguasa yang dipilih secara seksama oleh rakyat, bertugas untuk menciptakan hukum. Pikiran ini menggambarkan pentingnya demokrasi dalam suatu negara. Pikiran Socrates ini dikembangkan lebih lanjut oleh Plato, muridnya yang banyak menulis buku tentang Negara. Menurut Plato, Negara sebenarnya bertujuan untuk mengetahui atau mencapai atau mengenal ide yang sesungguhnya. Negara muncul atau ada karena adanya macam-macam kebutuhan dan keinginan manusia, yang menyebabkan mereka harus bekerja sama, untuk memenuhinya. Masing-masing dari mereka tidak akan mampu memenuhi kebutuhannya sendirian. Maka sesuai dengan kecakapannya masing-masing, tiap-tiap orang mempunyai tugasnya sendiri dan bekerja sama untuk memenuhi kepentingan bersama. Kesatuan inilah yang kemudian disebut

masyarakat atau Negara2. Maka dari itu, Negara harus memenuhi 3 syarat untuk keberadaan suatu Negara, yaitu a) adanya wilayah tertentu; b) adanya rakyat; dan c) adanya pemerintah yang berdaulat. Indonesia, dilihat dari ketiga pilar syarat negara tersebut, sesungguhnya sangat kokoh dan luar biasa di antara negaranegara dunia. Dari sisi wilayah, Indonesia sangat strategis dengan lebih dari pulau 17.000, tanah yang luas, laut yang luas dan dalam, iklim tropis. Dari sisi rakyat, jumlahnya mencapai lebih dari 250 juta atau nomor empat dunia. Dari sisi pemerintahan, konstitusi Indonesia sangat berdaulat, dengan sistem demokrasi yang dikagumi dunia. Dalam kerangka Negara yang berdaulat dengan konstitusi UUD 1945 yang kuat, salah satu ketentuan kita miliki adalah penyelenggaraan jaminan sosial bagi 2

seluruh rakyat, yang diamanatkan dalam pasal 28H ayat (3) mengenai hak terhadap jaminan sosial dan mempertimbangkan pasal 34 ayat (2). Jaminan sosial juga dijamin dalam Deklarasi Perserikatan Bangsa-Bangsa tentang Hak Asasi Manusia tahun 1948 dan ditegaskan dalam Konvensi ILO nomor 102 tahun 1952 yang menganjurkan semua negara untuk memberikan perlindungan minimum kepada setiap tenaga kerja. Sejalan dengan ketentuan tersebut, Majelis Permusyawaratan Rakyat Republik Indonesia dalam TAP Nomor X/MPR/2001 menugaskan Presiden untuk membentuk Sistem Jaminan Sosial Nasional dalam rangka memberikan perlindungan sosial yang menyeluruh dan terpadu.3 Pengertian jaminan sosial begitu beragam dalam berbagai literatur, akan tetapi memiliki kesamaan esensi. Dalam pendekatan asuransi sosial, jaminan sosial dimaknai sebagai teknik atau metode penanganan resiko yang terkait dengan hubungan kerja berbasis pada hukum bilangan besar (law of large numbers). Dari sisi bantuan sosial, jaminan sosial berarti dukungan pendapatan bagi komunitas yang kurang beruntung untuk keperluan konsumsi. Maka dari itu jaminan sosial berarti sebagai (1) salah satu faktor ekonomi seperti konsumsi, tabungan dan 3

subsidi/konsesi untuk redistribusi resiko; (2) instrumen Negara untuk redistribusi resiko sosial ekonomi melalui tes kebutuhan (means test application), yaitu tes apa yang telah dimiliki peserta baik berupa rekening tabungan maupun kekayaan nyata; (3) program pengentasan kemiskinan yang ditindaklanjuti dengan pemberdayaan komunitas, dan (4) sistem perlindungan dasar untuk penanggulangan hilangnya sebagian pendapatan pekerja sebagai konsekuensi resiko hubungan kerja. Pemahaman jaminan sosial secara spesifik adalah sebagai sistem perlindungan dalam bentuk dukungan pendapatan (income support) bagi setiap orang yang memerlukannya melalui seperangkat uji kebutuhan (means test) oleh lembaga yang berwenang 4 (Purwoko, 2011). Lembaga-lembaga yang berwenang melakukan means test di beberapa Negara adalah institusi pajak di Inggris dan institusi Central Point di Australia. Aplikasi uji kebutuhan diperlukan untuk mewujudkan keadilan bahwa penerima manfaat jaminan sosial adalah memang benar-benar orang yang berhak dan membutuhkan dukungan pendapatan. UU SJSN menjelaskan bahwa pilar jaminan sosial terdiri dari bantuan sosial, tabungan wajib, dan asuransi sosial. Bantuan sosial adalah suatu sistem untuk mengurangi kemiskinan dengan 4

penggunaan dana dari pajak (yang dimasukan ke dalam APBN dan dikeluarkan sebagai PBI-Penerima Bantuan Iuran). Tabungan wajib (provident fund) adalah skema tabungan bagi peserta sendiri seperti JHT. Asuransi sosial adalah program wajib yang menggunakan dana yang berasal dari iuran peserta atau pihak lain dan atau didanai oleh pemerintah khusus bagi penduduk miskin. Model asuransi sosial ini dinilai paling baik dan efektif untuk membiayai jaminan sosial. Landasan utama SJSN adalah bahwa jaminan sosial merupakan program Negara yang bertujuan memberikan kepastian perlindungan dan kesejahteraan sosial bagi seluruh rakyat Indonesia. Dengan program SJSN diharapkan setiap penduduk dapat memenuhi kebutuhan dasar hidup secara layak apabila terjadi hal-hal yang dapat mengakibatkan hilang atau berkurangnya pendapatan seperti menderita sakit, mengalami kecelakaan, kehilangan pekerjaan, memasuki usia lanjut atau pension.5 Jaminan sosial merupakan komponen dari Perlindungan Sosial, disamping bantuan sosial. Di Indonesia sudah ada tata aturan tentang kewajiban pemerintah (sebagai penyelenggara Negara) untuk melaksanakan program perlindungan sosial. Tatanan kebijakan untuk penyelenggaraan program jaminan sosial diatur UU SJSN, dan UU 5

BPJS. Sementara program bantuan sosial lainnya seperti program raskin, PKH, perumahan rakyat, dan bantuan langsung tunai diselenggarakan langsung oleh pemerintah melalui Kementerian terkait. UU SJSN dan BPJS mengatur bahwa negara membentuk dua badan sebagai penyelenggara jaminan sosial yang bertanggung jawab langsung kepada Presiden yaitu BPJS Kesehatan dan BPJS Ketenagakerjaan. UU Nomor 24 tahun 2011 merupakan “akte kelahiran” yang mencantumkan kelahiran badan bernama BPJS Kesehatan dan BPJS Ketenagakerjaan dari dua „ibu‟ yang bernama PT Askes dan PT Jamsostek. Kedua „ibu‟ ini sudah ditetapkan akan berakhir keberadaannya sesudah melahirkan kedua badan tersebut pada tanggal 1 Januari 2014.6 Khusus untuk BPJS Ketenagakerjaan, UU BPJS telah mengatur bahwa per 1 Januari 2014, Program Jaminan Kesehatan diserahkan kepada BPJS Kesehatan. Maka BPJS Ketenagakerjaan menyelenggarakan JKK, JKM, dan JHT dengan tetap mengacu UU 3/1992 tentang Jaminan Sosial Tenaga Kerja sampai akhir Juni 2015. Sejak 1 Juli 2015 BPJS Ketenagakerjaan menyelenggarakan progam JKK, JKM, JHT dan JP sesuai dengan UU SJSN 6

dan UU BPJS. Sementara aturan pelaksaaan dalam bentuk PP keempat program tersebut sudah diterbitkan satu hari sebelum berlakunya (1 Juli 2015). Program Jaminan Hari Tua Pada tanggal 30 Juni 2015, pemerintah telah menerbitkan Peraturan Pemerintah Nomor 46 tahun 2015 Tentang Penyelenggaraan Program Jaminan Hari Tua sebagaimana diamanatkan dalam Pasal 37 ayat (5) dan Pasal 38 ayat (3) Undang-Undang nomor 40 Tahun 2004 Tentang Sistem Jaminan Sosial Nasional. Dalam PP Nomor 46/2015, pada Ketentuan Umum Pasal 1, ayat 1 menyatakan “Jaminan Hari Tua yang selanjutnya disingkat JHT adalah manfaat uang tunai yang dibayarkan sekaligus pada saat peserta memasuki usia pensiun, meninggal dunia atau mengalami cacat total tetap”. Ketentuan Umum tersebut dalam normanya diuraikan lebih lanjut pada Bab IV Manfaat dan Tata Cara Pembayaran, Bagian kesatu Manfaat Jaminan Hari Tua Pasal 22 yang secara utuh berbunyi “(1) Manfaat JHT adalah berupa uang tunai yang dibayarkan apabila Peserta berusia 56 tahun, meninggal dunia, atau mengalami cacat total tetap; (2) Besarnya manfaat JHT adalah sebesar nilai akumulasi seluruh iuran yang telah disetor ditambah hasil pengembangannya yang tercatat dalam rekening perorangan Peserta; (3) Manfaat JHT sebagaimana dimaksud

pada ayat (1) dibayar secara sekaligus; (4) Dalam rangka mempersiapkan diri memasuki masa pensiun, pembayaran manfaat JHT sebagaimana dimaksud pada ayat (3) dapat diberikan sebagian sampai batas tertentu apabila Peserta telah memiliki masa kepesertaan paling singkat 10 tahun; (5) Pengambilan manfaat JHT sampai batas tertentu sebagaimana dimaksud pada ayat (4) paling banyak 30% dari jumlah JHT yang peruntukannya untuk kepemilikan rumah atau paling banyak 10% untuk keperluan lain sesuai persiapan memasuki masa pensiun; (6) Pengambilan manfaat JHT sebagaimana dimaksud pada ayat (5) hanya dapat dilakukan untuk satu kali selama menjadi Peserta; (7) BPJS Ketenagakerjaan wajib memberikan informasi kepada Peserta mengenai besarnya saldo JHT beserta hasil pengembangannya satu kali dalam satu tahun. Berikutnya pada Bagian kedua Tata Pembayaran Jaminan Hari Tua, Pasal 26 berbunyi “(1) Manfaat JHT wajib dibayarkan kepada Peserta apabila: a. peserta mencapai usia pensiun; b. Peserta mengalami cacat total tetap; c. Peserta meninggal dunia atau; d. Peserta meniggalkan Indonesia untuk selama-lamanya; (2) Manfaat JHT bagi Peserta yang mencapai usia pensiun diberikan kepada Peserta pada saat memasuk usia pensiun; (3) Manfaat JHT bagi peserta yang dikenai pemutusan hubungan kerja atau

berhenti bekerja sebelum usia pensiun, dibayarkan pada saat Peserta mencapai usia 56 tahun; (4) Dalam hal Peserta mengalami cacat total tetap, hak atas manfaat JHT diberikan kepada Peserta; (5) Dalam hal Peserta meninggal dunia sebelum mencapai usia pensiun, hak atas manfaat JHT diberikan kepada ahli waris sebagaimana dimaksud dalam pasal 23 ayat (2); (6) Dalam hal Peserta tenaga kerja asing atau warga Negara Indonesia meninggalkan Indonesia untuk selama-lamanya, manfaat JHT diberikan kepada Peserta yang bersangkutan. Jika kita lihat amanat sebenarnya dari UU SJSN dalam kaitannya dengan Program JHT, pada Pasal 35, 36, 37, dan 38. Terkait dengan manfaat JHT di PP 46/2015 (Ketentuan Umum dan Pasal 22) sudah mengacu pada UU SJSN, kecuali ayat (5) Pasal 22 PP 46/2015, tidak ada diperintahkan/diamanatkan dalam UU SJSN. Dalam perjalanannya, PP 46/2015 ditolak oleh para Pekerja melalui berbagai organisasi Buruh. Mereka melakukan demonstrasi secara besarbesaran. Para buruh yang merasa hak JHT nya dipermainkan, mengancam akan merusak Kantor BPJS Ketenagakerjaan. Agus Pambagio, pengamat kebijakan publik dalam media online Detikcom (6 Juli 2015), berkomentar “Publik, buruh dan perusahaan swasta bingung ketika terjadi perubahan kebijakan berkait Jurnal Institut BPJS Ketenagakerjaan Tahun 2016 Volume 1
dengan pencairan JHT secara tiba-tiba karena selama ini tidak pernah ada penjelasan, baik dari pengelola JHT (BPJS Ketenagakerjaan) maupun Kementerian Tenaga Kerja. Akibatnya terjadi penolakan publik dan yang menjadi sasaran adalah Presiden, sebagai penanda tangan PP”. Gelombang demonstrasi yang semakin besar dianggap mengganggu Istana sehingga sekitar 42 hari kemudian, Presiden Jokowi melakukan perubahan atas PP 46/2015, dengan keluarnya PP 60/2015, Tentang Perubahan Atas Peraturan Pemerintah Nomor 46 Tahun 2015 Tentang Penyelenggaraan Program Jaminan Hari Tua, pada tanggal 12 Agustus 2015. Fokus perubahan pada PP 60/2015, adalah pada Pasal 26, dengan mengalami perubahan dan berbunyi “(1) Manfaat JHT wajib dibayarkan kepada Peserta apabila: a. peserta mencapai usia pensiun; b. Peserta mengalami cacat total tetap; c. Peserta meninggal dunia atau; d. Peserta meniggalkan Indonesia untuk selama-lamanya; (2) Manfaat JHT bagi Peserta yang mencapai usia pensiun sebagaimana dimaksud pada ayat (1) huruf a diberikan kepada Peserta; (3) Manfaat JHT bagi peserta yang mengalami cacat total tetap sebagaimana dimaksud pada ayat (1) huruf b diberikan kepada Peserta sesuai dengan ketentuan peraturan perundang-undangan; (4) Manfaat JHT bagi Peserta yang meninggal dunia sebagaimana dimaksud pada ayat (1) c 6
sebelum mencapai usia pension diberikan kepada ahli waris sebagaimana dimaksud dalam Pasal 23 ayat (2); (5) Ketentuan lebih lanjut mengeai tata cara dan persyaratan pembayaran manfaat JHT sebagaimana dimaksud pada ayat (1) diatur dengan Peraturan Menteri. Pada PP Nomor 60/2015 tersebut, ayat (3) dan ayat (6) Pasal 26 PP 46/2015 dihilangkan. Dalam jangka waktu tidak terlalu lama (7 hari), terbitlah Peraturan Menteri Tenaga Kerja Republik Indonesia Nomor 19 Tahun 2015 Tentang Tata Cara dan Persyaratan Pembayaran Manfaat Jaminan Hari Tua, tanggal 19 Agustus 2015. Pertimbangan dasarnya merujuk pada PP 60 Tahun 2015, khususnya pada Pasal 26 ayat (5), Permenaker ini ditengarai dapat menenangkan para Pekerja, karena pasal-pasalnya dibuat multitafsir, dan mengaburkan hakekat usia pensiun, sebagai masa berakhirnya seseorang bekerja karena usia pensiun. Rancunya pemahaman tentang Pemutusan Hubungan Kerja (PHK), yang merupakan domain dari UndangUndang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dicampuradukan dengan UU SJSN. Dalam UU 13/2003, jelas bahwa PHK berkaitan dengan hak mendapatkan pesangon Peserta, sedangkan UU SJSN dan UU BPJS mensyaratkan JHT untuk usia pensiun, cacat total tetap selama bekerja, dan meninggal dunia selama bekerja.

Memang lahirnya PP 60/2015 dan Permenaker Nomor 19/2015, dapat meredakan amarah Pekerja, dan pekerja yang mengalami PHK bersama-sama mengambil JHT, walaupun masa kerja mereka dibawah 10 tahun bahkan kebanyakan dibawah 5 tahun. Dana JHT di rekening BPJS Ketenakerjaan di berbagai cabang dengan cepat berpindah ke kantong Peserta. Direktur Perluasan Kepesertaan BPJS Ketenagakerjaan E. Ilyas Lubis dalam Dialog Nasional bersama Serikat Pekerja Seluruh Indonesia (SPSI) di Jakarta 31 Maret 2016 menyatakan “Meningkatnya pencairan dana JHT itu terjadi setelah terbitnya Permanaker No. 19/2015 dan meningkatnya jumlah pemutusan hubungan kerja”. TEMPO.CO, menyebutkan BPJS Ketenagakerjaan mencairkan dana Jaminan Hari Tua rata-rata Rp. 50 miliar hingga Rp. 55 miliar setiap hari pada periode Januari – Maret 2016 sebagai akibat berubahnya filosofi dari bekal di hari tua menjadi jaring pengaman sosial saat ini. METHODOLOGI Kajian tentang Komitmen Negara Dalam Memberikan Jaminan Hari Tua bagi Pekerja, dilakukan dengan pendekatan Deskriptif, dengan memotret kebijakankebijakan Negara dalam bentuk Hukum Negara yang dilaksanakan oleh pemerintah sebagai Penyelenggara Negara. Kerangka berpikir Regulasi Tersistem, menitikberatkan pada cara kebijakan Negara mewujudkan Komitmen Negara terhadap masyarakatnya dilakukan dan berlangsung secara berkesinambungan. Kebijakan Negara adalah suatu kebijakan publik yang direalisasikan dalam keputusan atau ketetapan pemerintah (sebagai penyelenggara Negara) untuk melakukan tindakan yang dianggap membawa dampak baik bagi kehidupan warga Negara. 7 Menurut Bridgman and Davis 8 , kebijakan publik pada umumnya mengandung pengertian mengenai “whatever government choose to do or not to do”
apa saja yang dipilih oleh pemerintah untuk dilakukan atau tidak dilakukan. Kebijakan Negara dalam bentuk perundang-undangan sebagai suatu produk hukum beserta aturan turunannya menjadi suatu keniscayaan untuk mengetahui sejauh mana komitmen Negara dalam membangun masyarakatnya. Kerangka berpikir tersistem ditujukan pada produk UU, Peraturan Pemerintah, Peraturan Menteri yang terkait dengan penyelenggaraan Program Jaminan Hari Tua. HASIL ANALISIS

Dari berbagai fakta regulasi yang telah dikeluarkan pemerintah sebagai penyelenggara Negara yang berkaitan

dengan penyelenggaraan Program JHT diperoleh gambaran sebagai berikut: 1. Lemahnya komitmen Negara; Penyelenggara Negara adalah pemerintah, dan UU SJSN sudah mengamanatkan untuk segera membuat Undang-Undang BPJS, Peraturan Pemerintah dan Peraturan Presiden sebagai aturan pelaksanaannya. Undang-Undang BPJS baru dapat dibentuk (2011) 9 atau setelah tujuh tahun. PP dan Perpres terkait BPJS Kesehatan diselesaikan 2 hari menjelang diluncurkannya BPJS Kesehatan dan BPJS Ketenagakerjaan 1 Januari 2014. Dan PP terkait Program JKK, JKM, JHT dan JP diselesaikan 30 Juni 2015, satu hari menjelang dimulainya keempat program tersebut yang sesuai dengan UU BPJS. Secara faktual, rentang waktu 9 – 10 tahun untuk menyusun regulasi yang diamanatkan UU SJSN merupakan indikasi kuat bahwa komitmen Negara yang dimanifestasikan oleh pemerintah sebagai penyelenggara Negara masih lemah (late and injury time). 2. Inkonsistensi Regulasi: substansi PP 46/2015, melampaui amanat UU SJSN, pada Pasal 22 ayat (5), dana JHT dapat diambil setelah 10 tahun 9

sebanyak 30% untuk pemilikan rumah. Padahal tidak ada norma dalam pasal-pasal terkait JHT di UU SJSN yang menyebutkan bahwa dana JHT dapat digunakan untuk pemilikan rumah. Perumahan untuk rakyat sudah diatur tersendiri dalam Undang-Undang Tentang Perumahan. Kewajiban BPJS Ketenagakerjaan adalah memberikan uang JHT secara tunai. Namun inkonsistensi terlihat pada PP 60/2015, diikuti Permenaker nomor 19/2015 sebagai turunannya. Inkonsistensi dengan UU SJSN mencakup antara lain tidak ada norma dalam UU SJSN yang menyebutkan atau mendelegasikan wewenang kepada Menteri Tenaga Kerja untuk menerbitkan Peraturan Menteri Tenaga Kerja yang mengatur Tata Cara dan persyaratan pembayaran manfaat JHT. Isi Permenaker Nomor 19/2015, menjungkirbalikkan hierarkhi regulasi, dan melampaui wewenangnya. Permenaker tersebut meniadakan syarat usia pensiun untuk mendapatkan JHT, dan syarat 10 tahun dalam membayar iuran sebelum dapat mengambil pinjaman JHT, dan menjadikan „PHK‟ atau „diberhentikan oleh pemberi kerja‟ tanpa memperhatikan syarat masa kerja 10 tahun, peserta bahkan boleh mengambil JHT hanya setelah 5 tahun. Fungsi JHT sudah berubah dari Jaminan Hari Tua menjadi jaringan pengaman sosial. Dengan

inkonsistensi regulasi Program JHT, Menaker dapat dikategorikan “melampui wewenangnya” atas substansi Permenaker yang diterbitkannya. 3. Multitafsir Regulasi: peraturan yang dibuat seharusnya tidak menimbulkan multitafsir, supaya para penyelenggara tidak kebingungan dalam melaksanakan peraturan tersebut. Permenaker 19/2015, pasalpasalnya multitafsir. Substansinya mencampuradukkan UU SJSN dengan UU 13/2003 tentang Ketenagakerjaan. UU SJSN tidak ditujukan untuk mengatur tentang Pemutusan Hubungan Kerja, tetapi memberikan jaminan untuk mendapatkan jaminan sosial bagi Pekerja. Pasal 156 UU 13/2003, ayat (1) berbunyi” Dalam hal terjadi pemutusan hubungan kerja, pengusaha diwajibkan membayar uang pesangon dan/atau uang penghargaan masa kerja dan uang penggantian hak seharusnya diterima”. Upaya mengalihkan tanggung jawab PHK dikaitkan dengan JHT sangat merugikan Pekerja, karena pengusaha mengganggap bahwa dengan meloloskan JHT bagi yang di PHK ke BPJS Ketenagakerjaan, maka Pekerja tidak mendapatkan hak pesangon. Urusan administrasi pesangon pun lebih rumit, tidak selancar mendapatkan JHT dari BPJS Ketenagakerjaan.

4. Advokasi dan sosialisasi belum maksimal: BPJS Ketenagakerjaan, semasa transisi program dari UU 3/92, ke UU SJSN, periode Januari 2014 sampai Juni 2015, belum melakukan advokasi dan sosialisasi secara maksimal kepada stakeholder (pengusaha dan pekerja), terkait dengan perubahan fundamental program JHT dalam UU 3/92 dari UU SJSN, khususnya terkait jangka waktu pengambilan JHT dari 5 tahun menjadi 10 tahun dan hanya dapat diambil pada saat usia pensiun. Kewajiban sosialisasi oleh BPJS Ketenagakerjaan sudah diatur dalam Penjelasan Pasal 61 (UU BPJS huruf b berbunyi: “Penyiapan operasional BPJS Ketenagakerjaan untuk program jaminan kecelakaan kerja, jaminan hari tua, jaminan pensiun, dan jaminan kematian mencakup antara lain: a. menyusun sistem dan prosedur operasional yang diperlukan untuk beroperasinya BPJS Ketenagakerjaan, dan b. melakukan sosialisasi kepada seluruh pemangku kepentingan jaminan kecelakaan kerja, jaminan hari tua, jaminan pensiun dan jaminan kematian”. PEMBAHASAN Realitas sosial baru memerlukan perspektif baru. Masyarakat Indonesia yang semakin maju ditandai dengan kapasitas individu untuk mengkritisi kebijakan dan kekuasaan. Pada saat yang sama, kemampuan pranata sosial 10
yang membentuk abad kedua puluh secara signifikan untuk memahami situasi ternyata melemah dalam beberapa dasawarsa terakhir. Adolp Lowe menyatakannya secara cerdas sebagai (1971: 563), kita sedang menyaksikan perubahan dari dunia tempat realitas sosial muncul otomatis ke dunia tempat realitas sosial direkayasa. Realitas sosial baru ini memunculkan masyarakat maju sebagai 10 masyarakat berpengetahuan. Indonesia sebagai negara yang menuju ke negara maju seiring dengan perkembangan politik, ekonomi dan budaya dunia. Amandemen UU Dasar 1945 dengan program jaminan sosial sebagai hak dasar bagi masyarakat Indonesia merupakan salah satu contoh penyesuaian dengan perubahan dunia tersebut. Kewajiban Negara untuk menyelenggarakan program jaminan sosial telah menjadi keputusan politik Negara. Masyarakat Indonesia yang maju dan berpengetahuan sadar akan hak-haknya, walaupun masih perlu dilakukan advokasi dan sosialisasi atas kewajibannya sebagai warga masyarakat/warga Negara.. Indonesia telah menandatangani berbagai konvensi internasional seiring usaha untuk meningkatkan kesejahteraan dan perlindungan sosial bagi rakyatnya. Sebagai masyarakat berpengetahuan, keterbukaan, kejujuran, komitmen, integritas dan etos
kerja harus menjadi tolok ukur bersama dalam kinerja untuk mencapai sasaran program. Peresmian BPJS merupakan tonggak sejarah baru bagi bangsa dan Negara Indonesia dalam memenuhi hak-hak konstitusional warga negaranya dan mewujudkan kesejahteraan rakyat. 11 Kondisi ideal yang dicita-citakan Negara ini telah tertuang dalam UU SJSN dan UU BPJS, walaupun diakui masih ditemukan kelemahan di beberapa substansi antar lain tentang posisi PT. Taspen dan PT. Asabri yang harus menyerahkan programnya kepada BPJS Ketenagakerjaan pada tahun 2029. UU BPJS mengamanatkan pada kedua BUMN tersebut untuk menyusun “Roadmap” penyerahan program dimaksud. Berbagai kalangan berpendapat, tidak mudah bagi kedua BUMN tersebut untuk menyusun Roadmap menuju “liang kubur” nya sendiri. Pemerintah telah menyusun aturan pelaksanaan berupa PP maupun Perpres terkait implementasi BPJS Kesehatan dan Ketenagakerjaan. Dalam program JHT, tiga produk hukum telah diterbitkan yaitu PP 46/2015, yang kemudian diubah dengan PP 60/2015, dan Permenaker 19/2015. Meskipun kita ketahui tidak ada satu pasalpun dalam UU SJSN dan UU BPJS yang

“memerintahkan” Program JHT diatur dengan Permenaker. Hasil Analisis yang diuraikan diatas menunjukkan ada 4 masalah besar dalam implementasi program JHT SJSN, yaitu pertama, Lemahnya komitmen Negara; kedua, Inkonsistensi Regulasi; ketiga, Multitafsir regulasi; dan keempat, advokasi dan sosialisasi yang belum maksimal. Keempat kelemahan ini saling berkaitan satu sama lain. Kelemahan pertama, kedua dan ketiga bersumber dari subjek yang sama yaitu PP 46, PP 60, dan Permenaker 19/2015, dengan merujuk pada UU SJSN. Masalah sosialisasi dan advokasi yang belum maksimal oleh BPJS Ketenagakerjaan ditengarai sebagai pemicu marahnya Pekerja pada peluncuran PP 46/2015 yang sebenarnya telah mengacu UU SJSN. Pemerintah yang lebih mengutamakan kepentingan politik kekuasaan daripada politik konstitusi kemudian melakukan perubahan dan terbitlah PP 60/2015 dan Permenaker 19/2015, yang jauh menyimpang dari amanat UU SJSN. Presiden sebagai Kepala Negara dan Kepala Pemerintahan disamping memiliki atribusi kewenangan juga diberi delegasi kewenangan untuk membuat peraturan pelaksanaan UndangUndang. Kewenangan tersebut harus dilaksanakan dengan sebaik-baiknya. Untuk itu, Presiden ditopang oleh kelembagaan pemerintahan dan birokrasi dengan berbagai fasilitas Jurnal Institut BPJS Ketenagakerjaan Tahun 2016 Volume 1
pendukungnya. Tidak ada alasan untuk tidak memenuhi kewajiban yang diembannya sesuai dengan ketentuan Undang-Undang.12 Sistem Jaminan Sosial lahir dalam peraturan perundang-undangan untuk menjamin terpenuhinya hak asasi setiap orang atas jaminan sosial dan terpenuhinya tugas Negara untuk mengembangkan sistem jaminan sosial bagi seluruh rakyat. Presiden bertugas melaksanakan perundang-undangan secara memadai dan operasional agar sistem jaminan sosial nasional terselenggara secara efektif. Sumpah Presiden untuk menjalankan undangundang ini harus dipenuhi.13 Implementasi program JHT sesuai dengan SJSN diatur dalam Permenaker 19/2015, khususnya terkait Tata Cara dan Syarat Pembayaran Manfaat Jaminan Hari Tua. Kerancuan regulasi tersebut sangat rumit dan membingungkan. Lihat pasal 3, ayat (2) dan (3), bagaimana dengan „halusnya‟ mengaitkan usia pensiun dengan pengunduran diri Peserta, dan Peserta terkena pemtusan hubungan kerja. Jelas ayat (2) dan (3) tersebut tidak ada dalam pasal-pasal JHT di UU SJSN. Demikian juga lihat Pasal 5 dan Pasal 6 tentang syarat usia pensiun menjadi kabur, dan batas 10 tahun sudah tidak ada bahkan kurang dari 5 tahun, 12

sehingga dapat ditafsirkan JHT dapat ambil. Kondisi multitafsir akan menimbulkan kebingungan bagi penyelenggara BPJS Ketenagakerjaan di lapangan. Permenaker ini patut diduga sebagai usaha pemerintah dalam hal ini Kementerian Tenaga Kerja untuk menenangkan Pekerja, dan dipihak lain memberi kelonggaran pengusaha untuk tidak membayar pesangon, karena pekerja sudah mendapat JHT, dengan alasan bahwa pengusaha telah membayarkan 3,7% dari 5,7% iuran JHT pekerjanya. Dalam situasi ini, BPJS Ketenagakerjaan seharusnya tidak menerima begitu saja kebijakan Menaker tersebut. BPJS Ketenagakerjaan sesuai dengan wewenang dan tanggungjawabnya dalam Undang-Undang SJSN dan Undang-Undang BPJS, perlu melakukan komunikasi intens dengan Menaker bahwa kebijakan Menteri tersebut menyebabkan penghindaran pengusaha membayar pesangon yang bertentangan UU 13/2003 pasal 156 dan merugikan bagi pekerja dalam jangka panjang. Menteri Tenaga Kerja seharusnya mempertimbangkan bahwa BPJS Ketenagakerjaan mengelola dana JHT yang akumulasinya Rp. 180 Triliun akan cepat berkurang jika diambil oleh Pekerja yang belum memenuhi syarat (menurut UU). Sementara itu pemerintah membutuhkan dana untuk menggerakan pembangunan,

bandingkan dengan target Tax Amnesty yang hanya Rp. 165 Triliun. Pekerja dengan masa kerja pendek tentu hanya mendapat uang tidak seberapa dibandingkan uang pesangon. BPJS Ketenagakerjaan perlu memberikan penyadaran bagi pekerja bahwa uang JHT disimpan, dikembangkan dan dijamin oleh Negara agar nantinya diberikan saat Pekerja memasuki usia pensiun. Ketika pekerja secara fisik sudah tidak kuat bekerja sedangkan kebutuhan hidup tidak pernah berhenti, uang JHT yang didapat akan bermakna untuk modal usaha di usia pensiun tersebut. Sementara itu kebutuhan hidup akibat PHK, UndangUndang mewajibkan pengusaha bertanggungjawab untuk memberikan pesangon dan/atau uang penghargaan masa kerja dan uang penggantian hak yang seharusnya diterima. KESIMPULAN Kesimpulan yang dapat ditarik dari hasil analisis dan pembahasan yang diuraikan diatas adalah sebagai berikut: Pemerintah dalam hal ini Menteri Tenaga Kerja disarankan untuk mencabut Peraturan Menteri Tenaga Kerja Nomor 19 tahun 2015 Tentang Tata Cara Dan Persyaratan Pembayaran Manfaat Jaminan Hari Tua, karena bertentangan dengan peraturan perundang-undangan diatasnya.

1. PP 60 Tahun 2015 perlu direvisi, dan merujuk pada Pasal 35, 36, 37 dan 38 UU SJSN. Revisi menyangkut mekanisme masa transisi untuk pembayaran klaim JHT yang masa pembayaran iurannya dibawah 10 tahun. 2. BPJS Ketenagakerjaan harus melakukan advokasi dan sosialisasi secara massif tentang filosofi dan manfaat JHT bagi Pekerja, agar kehidupan hari tua mereka lebih terjamin. 3. PENUTUP Kapal besar bernama BPJS Ketenagakerjaan telah berlayar mengarungi samudera Indonesia nan luas dengan topan, badai dan gelombang besar yang menghadang, namun kita tak surut, dengan kekuatan dan kecerdasan, kita menuju Jaminan Sosial nasional yang paripurna.

THE NATION’S COMMITMENT IN OLD AGE INSURANCE FOR WORKERS Written by: Chazali H. Situmorang1 Abstract The existence of a nation is to fulfill multiple needs and wants, that requires the people to work together in order to fulfill their needs – as they could not fulfill it has individually. Thus, based on each persons’ skill, each of them has their own tasks and work together to fulfill their needs. This unity is called society or nation. In a sovereign nation framework based on the 1945 Constitution, one of them is to provide social security for every citizens. Social security is also stated in the 1948 United Nations’ Declaration of Human Rights, and further emphasised in International Labour Organisation’s Convention No. 102/1952. Aligned with those regulations, the Indonesian Parliament (MPR-RI) in TAP No. X/MOR/2001 assign the President to create Nasional Social Security System (SJSN) to provide a integrated and comprehensive social security. In June 30th 2015, the Government issued Regulation No. 46/2015 about the Pension Plan – based on the Act No. 40/2004 about the National Social Security System. In the Regulation No. 46/2015, article 1 about the general requirement, section 1 that states “Old Age Insurance (JHT) is a lump-sum cash benefit that paid to the workers when retired, died, or permanently disabled”. Describing a nation’s policy, in the form of regulations, is the necessity to measure the commitment of a nation in developing its people. Indonesia, as a part of the global world, has signed numerous world conventions and must be held accountable in improving the social welfare and protection for its citizens. In the implementation of JHTSJSN, the findings are: (1) the nation’s commitment has been relatively weak; (2) the regulations have been inconsistent; (3) the regulatons have multiple interpretations; and (4) the advocacy and socialisation have not been maximised. These findings are interconnected with each other. The first, second, and third findings are based on the same subject, which are Regulation No. 46, No. 60, and the Labour Minister Regulation No. 19/2015, that were cascaded from SJSN Act. The fourth finding is subject to the effort of BPJS Ketenagakerjaan. Because of the workers’ resistance against the Regulation No. 46/2015, the Regulation No. 60/2015 and the Labour Minister Regulation No. 19/2015 were issued as a compromy – even though the content tend to diverge from the what is stated in SJSN Act. The policy recommendation for the Indonesian Government is to repeal the Labour Minister Regulation No. 19/2015 about the Procedures and Requirements of JHT Benefit Payment. Regulations No. 60/2015 is also need to be revised, and directly referring to 1

SJSN Act article 35, 36, 37, and 38. In that revision, it is also needed to regulate the mechanism of JHT claim payment under 10 years. BPJS Ketenagakerjaan must intensify the advocacy and socialisation of JHT philosophy and benefit for workers, so that they can age gracefully. BPJS Ketenagakerjaan Management has to create the necessary system and operational procedure. INTRODUCTION According to Socrates, the State which has leaders or rulers carefully chosen by the people, has a duty to create laws. This thought illustrates the importance of democracy in a country. Socrates’s idea was further developed by Plato, his disciple who has written many books about States. According to Plato, the State actually aims to find or reach or get to know the real idea. Countries appear or exist due to a variety of human needs and desires, in which they must work together to meet them. Each of them will not be able to meet their needs alone. Then, in accordance with each person’s respective capacity, s/he has her/his own duties and must work together to meet common interests. Unity is then referred to as the society or State 2 . Therefore, the State must meet three requirements to exist, namely a) specific territories; b) people; and c) sovereign government. 2

Indonesia, observed from such three pillars of the state requirements, is actually very sturdy and remarkable among countries in the world. In terms of territories, Indonesia is very strategic with more than 17,000 islands, vast land, and vast and deep sea, as well as tropical climate. Regarding the people, the population reaches more than 250 million, i.e. the world’s number four. In terms of the government, Indonesia’s constitution has sovereignty, and Indonesia has the democratic system which is admired by the world. Within the framework of a sovereign State with a strong 1945 constitution, one of the provisions we have is the implementation of social security for all citizens, as mandated in Article 28H paragraph (3) on the right to social security and considering article 34 paragraph (2). The social security is also guaranteed in the United Nations Declaration of 1948 on Human Rights and confirmed in the ILO Convention number 102 of 1952 which urge all countries to provide minimum

protection to all workers. In line with these provisions, the People’s Consultative Assembly of the Republic of Indonesia in its Decree Number X/MPR/2001 assigns the President to establish a National Social Security System in order to provide a comprehensive social protection and integration.3 The social security definition is highly diverse in various literatures, but it has the same essence. In the approach to social insurance, social security is defined as a technique or method of handling risks associated with working relationship based on the law of large numbers. In terms of social assistance, social security means income support for the less fortunate for consumption purposes. Thus, the social security means (1) one of the economic factors such as consumption, savings and subsidy/concession for the redistribution of risk; (2) an instrument of State for economic social redistribution via the means test application, i.e. tests on what having been owned by the participants in the form of savings accounts and real assets; (3) poverty alleviation programs which are followed-up by the community empowerment, and (4) a basic protection system for the partial loss of worker’s income as a consequence of employment relationship risks.
A specific understanding on the social security is a protection system in the form of income support for every person who needs it through a set of means test by the competent authorities (Purwoko, 2011) 4 . The institutions authorized to conduct a means test in some countries are the UK's tax agency and Central Point institution in Australia. The means test applications are required for the need of justice that the social security beneficiaries are truly the persons who have the right and need of income support. The Social Security Law explains that the social security pillars consist of social assistance, compulsory savings, and social insurance. Social assistance is a system for reducing poverty with the use of funds from taxes (which is included in the state budget and issued as PBI-Contribution Recipient). The compulsory savings (provident fund) is a savings scheme for the participants themselves, such as JHT. The social insurance is a mandatory program which uses funds from the participants', or other party’s contributions or is funded by the government, especially for the poor citizens. This social insurance model is considered as the most good and effective method to finance social security. The SJSN main foundation is that the social security is a state program which aims to provide the protection

guarantee and social welfare for all Indonesian citizens. With the Social Security program, it is expected that each resident may meet the basic needs of decent living when certain events happen that cause a loss or reduction in income, such as illness, accident, loss of a job, entering old age or pension5. The social security is a component of the Social Protection, in addition to the social assistance. In Indonesia, there are rules and regulations about the obligation of the government (as the State caretaker) to implement the social protection programs. The policies order for the implementation of social security programs is regulated by the Social Security Law, and Law on BPJS (National Social Security Agency). Meanwhile, other social assistance programs, such as the raskin (Rice for the Low-Income Group) program, PKH, public housing, and cash transfers, are directly organized by the government through the relevant Ministry. The Laws on Social Security and BPJS stipulate that the state should establish two institutions as the social security providers, which are directly responsible to the President, namely BPJS Kesehatan and BPJS Ketenagakerjaan. Law No. 24 of 2011 is a "birth certificate" that included the birth of agencies named BPJS Kesehatan and BPJS Ketenagakerjaan. These two agencies were born from two "mothers", i.e. PT. Askes and PT. 5

Jamsostek. Both 'mothers' have been stipulated to be wound-up following the birth of two agencies on 1 January 20146. Especially for BPJS Ketenagakerjaan, BPJS Law has arranged that per 1 January 2014, the Health Security Program is handed over to BPJS Kesehatan. BPJS Ketenagakerjaan manages JKK, JKM, and JHT by referring to Law 3/1992 on Employment Social Security until the end of June 2015. Since 1 July 2015, BPJS Ketenagakerjaan manages the JKK, JKM, JHT and JP programs in accordance with that Social Security Law and BPJS Law. Meanwhile, the implementing rules for such four programs have been issued in the form of a PP (Government Regulation), one day before the enactment (1 July 2015). Provident Fund Program On 30 June 2015, the government has issued the Government Regulation Number 46 of 2015 on the Implementation of the Provident Fund Program as mandated in Article 37 paragraph (5) and Article 38 paragraph (3) of Law Number 40 of 2004 on National Social Security System. In PP No. 46/2015, the General Provisions Article 1, paragraph 1 states 6

that "the Provident Fund, hereinafter abbreviated as JHT, is a cash benefit paid at once when the participant retires, passes away or suffers from permanent total disability". Such General Provisions are in nature described further in Chapter IV – Benefits and Payment Procedures, Section One – Provident Fund Benefits, Article 22, which is read in whole as "(1) The JHT Benefit is cash to be paid if the participant is 56 years old, died, or suffers from a permanent total disability; (2) The amount of JHT is equal to the accumulated value of all contributions already paid plus investment returns recorded in the Participants’ personal accounts; (3) The JHT Benefit as referred to in paragraph (1) shall be paid in a lump sum; (4) In order to prepare for retirement, the JHT benefit payments as referred to in paragraph (3) may be given in part to a certain extent if the Participants have had a minimum membership period of 10 years; (5) The JHT benefit withdrawal to a certain extent as referred to in paragraph (4) shall be maximum 30% of total JHT, in which the allocation is aimed for home ownership or at the most 10% for other purposes in order to prepare for the retirement; (6) The JHT benefit withdrawal as referred to in paragraph (5) may only be done for one time during the active membership; (7) BPJS Ketenagakerjaan shall inform the Participants on total JHT balance and its investment returns in one year.
Furthermore, the Section Two – Provident Fund Payment Procedures, Article 26 states that "(1) The JHT Benefits shall be paid to the Participants if: a. participant reaches the retirement age; b. Participants suffer from a permanent total disability; c. Participant died or; d. Participants leave Indonesia forever; (2) The JHT Benefit for Participants who reach the retirement age is given to them when they enter their retirement age; (3) The JHT Benefit for participants subject to the employment termination or retiring before the age of retirement, will be paid to Participants when they reach 56 years old; (4) In the event the Participants suffer from a total permanent disability, the right to JHT shall be given to the Participants; (5) If a Participant dies before s/he reaches the retirement age, the right to JHT shall be given to the inheritors as referred to in Article 23 paragraph (2); (6) In the event that the foreign workers or Indonesian citizens leave Indonesia forever, JHT shall be given to the relevant Participant. If we look at the actual mandate of the Social Security Law in relation to the JHT program, it is stated in Article 35, 36, 37, and 38. Related to the JHT Benefit in PP 46/2015 (General Provisions and Article 22), it is already referred to the Social Security Law. Except for paragraph (5) Article 22 of PP 46/2015, it is not ordered/mandated in the Social Security Law. In a way, PP 46/2015 was rejected by the Workers through various labor

unions. They held a massive demonstration. The workers, who felt their JHT rights were mocked, threatened to damage the BPJS Ketenagakerjaan’s Office. Agus Pambagio, a public policy analyst in the online media, Detikcom (6 July 2015) comments that "The public, workers and private companies are confused when the policies change in terms of the sudden JHT withdrawal. So far, there has never been an explanation, either from the JHT management (BPJS Ketenagakerjaan) and the Ministry of Labor. The result is a public rejection and the target is the President, as a signatory in the PP".
benefits for Participants suffering from permanent total disability as referred to in paragraph (1) letter b shall be paid to Participants according to laws and regulations; (4) The Provident Fund benefits for Participants passed away (prior to the retirement age) as referred to in paragraph (1) letter c shall be paid to heirs as referred to in Article 23 paragraph (2); (5) Further provisions on the procedures and terms of the Provident Fund benefits payment as referred to in paragraph (1) shall be governed in a Regulation of the Minister. The growing demonstration wave was considered to disturb the Palace. Therefore, about 42 days later, President Jokowi made an amendment to PP 46/2015 by issuing PP 60/2015 on Amendment to Government Regulation No. 46 of 2015 on Implementation of the Provident Fund Benefit Program, on 12 August 2015.
Within a relatively short period (7 days), the Regulation of the Minister of Manpower of the Republic of Indonesia Number 19 of 2015 on Payment Procedures and Requirements for the Provident Fund Benefits, dated 19 August 2015 was issued. The underlying consideration refers to PP 60 of 2015, in particular to Article 26, paragraph (5). It is considered that this Regulation of the Minister of Manpower may soothe the worker, because articles are made ambiguous, and they obscure the nature of the retirement age as the expiry of a person working due to a retirement age. The ambiguous understanding of the Employment Termination (PHK), which is the domain of Law Number 13 of 2003 on Manpower is mixed up with the law. In Law Number 13/2003, it is clear that the layoffs are associated with a right to severance pay for the Participants, while the Social Security

TEMPO.CO says that BPJS Ketenagakerjaan disbursed the Provident Fund in an average of IDR50 billion to IDR55 billion per day within the period of January - March 2016 due to the change in the philosophy of the provision in the old days into the current social safety net.
Law and BPJS Law require the Provident Fund (JHT) for retirement, occupational permanent total disability, and occupational death. Indeed, the birth of PP 60/2015 and the Regulation of the Minister of Manpower No. 19/2015 could appease the Workers’ anger, and workers who were laid off together withdrew the JHT, although their working term was under 10 years and even mostly was under 5 years. The JHT funds in the BPJS Ketenagakerjaan’s accounts at various branches were quickly transferred to the Participants. The Director of Membership Expansion of BPJS Ketenagakerjaan E. Ilyas Lubis in the National Dialogue together with Serikat Pekerja Seluruh Indonesia (Indonesian Workers’ Union), held in Jakarta on 31 March 2016 states that "The increase of the JHT fund disbursement happened after the issue of the Regulation of the Minister of Manpower

The Theoretical Framework on Systematic Regulations focuses on how to realize the State’s Commitment to its citizens so it may be managed and takes place on an ongoing basis. State Policies are a public policy which is materialized in a decree or government regulation (as the caretaker of the State) in order to take actions, which are considered to bring good impacts to the lives of citizens 7 . According to Bridgman and Davis 8 , the public policy generally implies that "whatever government choose to do or not to do".
is the government, and the Social Security Law has been mandated to immediately draft a Law on BPJS, Government Regulations and Presidential Regulations as the implementing regulations. The Law on BPJS is only drafted in (2011)9 or after seven years. Relevant PP and Presidential Regulations to BPJS were completed two days prior to the launch of BPJS Kesehatan and BPJS Ketenagakerjaan on 1 January 2014. Then, a PP related to the JKK, JKM and JP Program were completed on 30 June 2015, i.e. one day before the start of such four programs in accordance with the Law on BPJS. In fact, a span of 9-10 years to prepare regulations mandated by the Social Security Law is a strong indication that the State's commitment manifested by the government as the caretaker of the State is still weak (late and injury time).
State Policies in the form of a law as a legal product and its derivative regulations becomes a necessity to decide the extent of the State's commitment in building societies. The systematic theoretical framework is aimed at Laws, Government Regulations, Regulations of a Minister, which are related to the implementation of the Providen Fund Program. ANALYSIS RESULTS Out of various regulatory facts which have been issued by the government as the caretaker of the State related to the JHT program performance, several following descriptions are obtains: 1. JHT in the Social Security Law which state that the JHT funds can be used for home ownership. Public housing is already regulated separately in the Law on Housing. BPJS Ketenagakerjaan’s obligation is to provide money in cash for the Provident Fund (JHT). However, the inconsistencies can be observed in PP 60/2015, which is followed by the Regulation of the Minister of Manpower Number 19/2015 as the derivative regulation. The inconsistency with the Social Security Law includes, among others, there is no norm in the Social Security Law which states or assigns the Minister of Manpower to issue a Decree governing the Payment Procedures and Terms of JHT. The content of the Regulation of the Minister of Manpower Number 19/2015 flips up the regulatory hierarchy, and goes beyond his authorization. Such Regulation of the Minister of Manpower negates the requirements of a retirement age to obtain the JHT, and a 10-year contribution term prior to the eligibility to withdraw the JHT loan, and “layoff” or “terminated by the employer” without considering a 10year working term. Participants are allowed to withdraw their JHT after only 5 years. The JHT’s function has changed from the Old Age Security to be a social safety net. Under such inconsistent JHT Program regulations, the Minister of Manpower may be categorized as

"exceeding its authority" related to the substance of the Regulation of the Minister of Manpower issued. 3. Ambiguous Interpretations of the Regulations: the regulations made shall not lead to multiple interpretations. Thus, the administrators are not confused in implementing the regulations. The Regulation of the Minister of Manpower Number 19/2015 shall have ambiguous articles. The substance confuses the Social Security Law and Law Number 13/2003 on Manpower. The Social Security Law is not intended to regulate an Employment Termination. Instead, it provides Workers a guarantee to get the social security. Article 156 of Law 13/2003, paragraph (1) reads "In the event of an employment termination, employers are required to pay the severance pay and/or gratuity and right compensation should be accepted ". Efforts to transfer the employment termination responsibility associated with the JHT are very detrimental to Workers, because the employers assume that a JHT is transferred to BPJS Ketenagakerjaan for the terminated workers and it means the Workers will not get any severance pays. The severance pay administration will become more complicated. It will not as easy as withdrawing the JHT from BPJS Ketenagakerjaan.

4. The advocacy and outreach has not been maximized: BPJS Ketenagakerjaan, during the program transition from Law 3/92 to the Social Security Law for the period of January 2014 to June 2015, has not performed any maximum advocacy and outreach to stakeholders (employers and workers), related to the fundamental changes of the JHT program in Law 3/92 from the Social Security Law, especially related to the JHT withdrawal period from 5 years to be 10 years. Furthermore, the JHT may only be disbursed when the Workers reach their retirement. The outreach obligations of BPJS Ketenagakerjaan are set out in the elaboration of Article 61 of BPJS Law letter b, which reads: "The operational preparation of BPJS Ketenagakerjaan for the occupational accident, provident fund, pension, and death benefit programs shall include, among others: a. arrange a system and operational procedure necessary for the operation of BPJS Ketenagakerjaan, and b. to hold socialization for all stakeholders of the occupational accident, provident fund, pension and death benefits." DISCUSSION The new social realities require new perspectives. More advanced Indonesian people are characterized by an individual's capacity to scrutinize the

policies and power. At the same time, the ability of social institutions which significantly made up the twentieth century to understand the situation turns out to be weaker in recent decades. Adolp Lowe smartly expresses it as (1971: 563), “we are witnessing a change of the world where the social reality appears automatically into a world where the social reality is engineered. This new social reality raises a developed society as a knowledgeable society10. Indonesia, as a country which is walking to be a developed country, runs in line with the development of the world’s politics, economic and culture. The Amendment of the 1945 Constitution with a social security program as a fundamental right for the Indonesian people is one adjustment example to a changing world. The State’s obligation to organize a social security program has become the State's political decisions. The advanced ad knowledgeable Indonesian people are aware of their rights, even though the advocacy and socialization on their obligations as citizens are necessary. Indonesia has signed various international conventions in line with efforts to improve the welfare and social protection for its citizens. As a knowledgeable society, the openness, honesty, commitment, integrity and work ethic should become collective performance benchmarks to reach the program targets. 10

The BPJS inauguration is a new milestone for the nation and State of Indonesia in fulfilling its citizens’ constitutional rights and materializing the welfare of its people 11 . The ideal conditions aspired by this State has been stated in the Social Security Law and BPJS Law, although it is admitted that some weaknesses are still found in some substances, among others, the position of PT. TASPEN and PT. Asabri which must submit their program in 2029 to BPJS Ketenagakerjaan. BPJS Law mandates both BUMNs (StateOwned Enterprise) to compile a "Roadmap" of such program delivery. Various people argue that it is not easy for both BUMNs to draw up a Roadmap toward their own "grave". The government has drawn up implementing regulations of PP and Presidential Regulation related to the implementation of BPJS Kesehatan and Ketenagakerjaan. In the JHT program, three law products have been issued, namely PP 46/2015, as amended by PP 60/2015 and the Regulation of the Minister of Manpower 19/2015. Even though we know that there is no single article in the Social Security Law and BPJS Law, which "orders" the JHT program to be regulated under a Regulation of the Minister of Manpower. The analysis results indicate there are 4 major problems in the JHT SJSN program implementation, i.e.
first, the weak State's commitment; second, the inconsistent regulations; third, the ambiguous regulations; and fourth, minimal advocacy and socialization. These four weaknesses are related to one another. The first, second and third weaknesses come from the same subject, namely PP 46, PP 60, and Permenaker 19/2015, with reference to the Social Security Law. The minimal advocacy and socialization by BPJS Ketenagakerjaan is considered as a trigger of the Workers’ angers at the launch of PP 46/2015, which had actually been referring to the Social Security Law. The Government’s prioritizing the interests of power politics than constitutional politics made an amendment and PP 60/2015 and the Regulation of the Minister of Manpower 19/2015 were issued, which are much deviated from the mandate of the Social Security Law. The President as the Head of State and Head of Government has not only the authority attributions but also the delegation authority to make regulations implementing the Law. The authorization must be carried out with the best initiative. Therefore, the President is supported by government institutions and bureaucracy with various facilities. There is no excuse for not fulfilling their obligations in accordance with the laws and regulations12.

The Social Security System was born in laws and regulations to guarantee the fulfillment of every person’s rights to the social security and State's duty to develop a social security system for all citizens. The President has a duty to sufficiently implement laws and regulations and operation. Thus, the national social security system may be managed effectively. The oath of the President to carry out this law must be met13. The JHT program implementation in accordance with the National Social Security System is regulated in the Regulation of the Minister of Manpower 19/2015, in particular related to the Payment Procedures and Terms of the Provident Fund Benefits. The ambiguity of these regulations is very complicated and confusing. See article 3, paragraph (2) and (3), how the article links “in a delicate way” between the retirement age and resignation of the Participants, and also the terminated Participants. It is obvious that paragraph (2) and (3) do not exist in the articles of JHT in the Social Security Law. Likewise, see Article 5 and Article 6 on the retirement age requirement, which becomes blurred, and the 10-year limit is not stated and there is even a less than 5 year-period. Therefore, it can be interpreted that the JHT can be withdrawn. The multiple interpretations will cause confusion for the BPJS Ketenagakerjaan’s field administrators. This Regulation of the Minister of Manpower is suspected as

the government's efforts, in this case the Ministry of Manpower, to soothe the Workers, and on the other hand, it gives a leeway to the employers for avoiding the severance pay, as the Workers have obtained that JHT. The employers may argue that they have paid 3.7% to 5.7% of the Workers’ JHT contribution. In this situation, BPJS Ketenagakerjaan should not take the Minister of Manpower’s policy for granted. BPJS Ketenagakerjaan, in accordance with its powers and responsibilities under the Social Security Law and BPJS Law, should intensely communicate with the Minister of Manpower that such policy of the Minister of Manpower causes the employers’ avoidance in paying the severance. This fact contradicts with article 156 of Law 13/2003 and is disadvantageous for the Workers in the long run. The Minister of Manpower should take into consideration that BPJS Ketenagakerjaan manages the JHT fund, in which the accumulated amount may reach IDR180 Trillion, and it will be quickly reduced if it is disbursed by the ineligible Workers (according to Law). Meanwhile, the government needs funds to fund the development, if it is compared with the Tax Amnesty target, which is only IDR165 Trillion. A short working-term Workers will certainly only get money which is nothing compared to the severance pay. BPJS Ketenagakerjaan needs to provide awareness for the Workers that the JHT money is saved, developed and guaranteed by the State, which will

be paid later when the worker retires. When a Worker becomes physically unfit to work while the necessities of life never stop, the JHT money obtained will be meaningful for a working capital in the retirement age. Meanwhile, in terms of the life necessities due to a layoff, the Law requires the employers to be responsible in providing the severance pay and/or gratuity and rights compensation. CONCLUSION The conclusion which can be drawn from the analysis and discussion above is as follows: The Government, in this case the Minister of Manpower, is advised to revoke the Regulation of the Minister of Manpower No. 19 of 2015 on Payment Procedures and Terms of the Provident Fund Benefits, as it is contradictory with the more superior laws and regulations. 1. PP 60 of 2015 should be revised by referring to Article 35, 36, 37 and 38 of the Social Security

Law. The revision is related to the transitional period mechanism for the JHT claim payment in which the contribution payment period should be under 10 years. 2. BPJS Ketenagakerjaan have to hold a massive advocacy and socialization on the philosophy and benefits of the JHT for the Workers, so their old-age life will be more secure. 3. The Management of BPJS Ketenagakerjaan constructs an operation system and procedure, which is required for the operation and management of BPJS Ketenagakerjaan. COVER The big ship called BPJS Ketenagakerjaan has sailed across the Indonesian ocean, which is vast and full of hurricanes, storms and huge waves. PENGARUH PERKEMBANGAN MAKRO EKONOMI INDONESIA TERHADAP PERTUMBUHAN KEPESERTAAN BPJS KETENAGAKERJAAN Oleh: Ratih Yasnuarni Gultom1
Abstract The aim of this study is to determine the economic indicators that affecting the growth of participants of BPJS ketenagakerjaan which was also known as PT Jamsostek (Persero). The study emphasized the effect of economic indicators such as Gross Domestic Product (GDP) percapita, the average of minimum wages of provinces in Indonesia, the rate of labor participation, the institution transformation from PT Jamsostek (Persero) to BPJS Ketenagakerjaan towards the participants growth of BPJS Ketenagakerjaan. Using multiple regression with ordinary least square (OLS) method, it was found that Gross Domestic Product (GDP) percapita and the average of minimum wages of provinces in Indonesia did not significantly affect the participants growth of BPJS Ketenagakerjaan on 1%, 5% or 10% confidence level. However, The rate of labor participation and the institution transformation of BPJS Ketenagakerjaan significantly affected the participants growth of BPJS ketenagakerjaan on 1% confidence level. The change on the level of labor participation has positive effect to the participants growth; this was caused by the rise on the labor supply which adding the number of labor that was the target market of BPJS Ketenagakerjaan. Similarly, the institution transformation from PT Jamsostek (Persero) to BPJS Ketenagakerjaan significantly affect the participants growth, this probably due to awareness of workers about BPJS Ketenagakerjaan as obligatory participants as it is ruled by law on UU No. 40 of 2004 and UU No. 24 of 2011.

1 Pendahuluan Jaminan sosial menurut UU No. 24 tahun 2011 adalah salah satu bentuk perlindungan sosial untuk menjamin seluruh rakyat agar dapat memenuhi kebutuhan dasar hidupnya yang layak. Hal ini sejalan dengan tujuan negara Indonesia yang tercantum dalam pembukaan Undang Undang Dasar 1945 yang menyatakan bahwa negara Indonesia dibentuk untuk melindungi segenap bangsa, memajukan kesejahteraan umum dan mencerdaskan kehidupan bangsa. Dalam UU No. 24 tahun 2011 tentang Badan Penyelenggara Jaminan Sosial dinyatakan bahwa sistem jaminan sosial nasional merupakan program negara yang bertujuan memberikan kepastian perlindungan dan kesejahteraan sosial bagi seluruh rakyat; untuk mewujudkan tujuan sistem jaminan sosial nasional perlu dibentuk badan penyelenggara yang berbentuk badan hukum berdasarkan prinsip kegotongroyongan, nirlaba, keterbukaan, kehati-hatian, akuntabilitas, profitabilitas, kepesertaan bersifat wajib, dana amanat, dan hasil pengelolaan dana jaminan sosial seluruhnya untuk pengembangan program dan untuk sebesar-besar kepentingan peserta. BPJS Ketenagakerjaan sebagai salah satu badan penyelenggara jaminan sosial seperti yang diamanatkan dalam UU No. 24 tahun 2011 tentang Badan Penyelenggara Jaminan Sosial dibentuk untuk menyelenggarakan program jaminan kecelakaan kerja, jaminan hari tua, jaminan pensiun dan jaminan kematian. Peserta BPJS Ketenagakerjaan adalah

setiap orang termasuk orang asing yang bekerja paling sedikit 6 (enam) bulan di Indonesia, yang telah membayar iuran. Sedang, pekerja adalah setiap orang yang bekerja dengan menerima gaji, upah, atau imbalan dalam bentuk lain. Selain itu pada pasal 62 UU No. 24 tahun 2011 juga PT Jaminan Sosial Tenaga Kerja atau disingkat PT Jamsostek (Persero) yang dibentuk dengan Peraturan Pemerintah Nomor 36 Tahun 1995 tentang Penetapan Badan Penyelenggara Program Jaminan Sosial Tenaga Kerja (Lembaran Negara Republik Indonesia Tahun 1995 Nomor 59), berdasarkan Undang-Undang Nomor 3 Tahun 1992 tentang Jaminan Sosial Tenaga Kerja (Lembaran Negara Republik Indonesia Tahun 1992 Nomor 14, Tambahan Lembaran Negara Republik Indonesia Nomor 3468) tetap melaksanakan kegiatan operasional penyelenggaraan: 1. Program jaminan pemeliharaan kesehatan termasuk penambahan peserta baru sampai dengan beroperasinya BPJS Kesehatan. 2. Program jaminan kecelakaan kerja, jaminan kematian, dan jaminan hari tua bagi pesertanya, termasuk penambahan peserta baru sampai dengan berubah menjadi BPJS Ketenagakerjaan. BPJS Ketenagakerjaan menyelenggarakan program jaminan kecelakaan kerja, program jaminan hari tua, program jaminan kematian dan jaminan pensiun paling lambat 1 Juli 2015. Prinsip kepesertaan pada BPJS Ketenagakerjaan bersifat wajib.

Kepesertaan wajib dimaksudkan agar seluruh rakyat menjadi peserta sehingga dapat terlindungi. Meskipun demikian penerapannya tetap disesuaikan dengan kemampuan ekonomi rakyat dan Pemerintah serta kelayakan penyelenggaraan program. Tahapan pertama dimulai dari pekerja di sektor formal. Sementara pekerja sektor informal dapat menjadi peserta secara suka rela, sehingga dapat mencakup petani, nelayan, dan mereka yang bekerja secara mandiri. Pada akhirnya Sistem Jaminan Sosial Nasional dapat mencakup seluruh rakyat. Dengan semakin besarnya jumlah angkatan kerja di Indonesia, kepesertaan BPJS diharapkan tumbuh lebih besar sehingga pertumbuhan ekonomi Indonesia semakin meningkat. Tulisan ini ingin meneliti tentang indikator makro ekonomi seperti pertumbuhan produk domestik bruto (PDB), pertumbuhan rata-rata upah minimum propinsi di Indonesia, perubahan tingkat partisipasi angkatan kerja (TPAK) serta transformasi PT Jamsostek (Persero) menjadi BPJS Ketenagakerjaan dan pengaruh indikator tersebut terhadap pertumbuhan kepesertaan BPJS Ketenagakerjaan.

2 Kerangka Teori 2.1 Kepesertaan BPJS Ketenagakerjaan. Menurut UU No. 24 tahun 2011 mengenai badan penyelenggara Jaminan Sosial, peserta adalah setiap orang, termasuk orang asing yang bekerja paling sedikit 6 (enam) bulan di Indonesia, yang telah membayar iuran. Menurut Peraturan Presiden Republik Indonesia No. 109 Tahun 2013 tentang penahapan kepesertaan program jaminan sosial, Pasal 3 dinyatakan bahwa Peserta program jaminan sosial terdiri atas peserta penerima upah dan peserta bukan penerima upah. Pada pasal 4 Perpres tersebut juga menjelaskan peserta penerima upah adalah pekerja yang bekerja pada pemberi kerja penyelenggara negara dan pekerja yang bekerja pada pemberi kerja selain penyelenggara negara. Pada pasal 7 Perpres No. 109 tahun 2013 menjelaskan Peserta bukan penerima upah adalah : a) pemberi kerja b) pekerja di luar hubungan kerja atau pekerja mandiri c) pekerja yang tidak termasuk huruf b) yang bukan menerima gaji atau upah. Pertumbuhan kepesertaan PT Jamsostek (Persero) cukup rendah. dari tahun 1997 hingga 2013 berada di sekitar -1% hingga 1% tetapi setelah berubah badan hukum menjadi BPJS Ketenagakerjaan pada tahun 2014 terjadi penambahan tenaga kerja aktif yang cukup signifikan.

Besarnya jumlah peserta aktif BPJS Ketenagakerjaan cenderung meningkat dari tahun ke tahun. Selama tahun 2009-2014 kepesertaan BPJS Ketenagakerjaan tumbuh sebesar 13,27% (CAGR) dari sebesar 8,29 juta orang pada tahun 2009 menjadi 16,10 juta jiwa pada tahun 2014. Komposisi kepesertaan BPJS Ketenagakerjaan didominasi oleh tenaga kerja penerima

upah yang mencapai 97,61% pada tahun 2009. Namun, proporsi tenaga kerja bukan penerima upah semakin meningkat persentasenya yang ditahun 2014 sudah mencapai 4,11%. Angelini dan Hirose (2004) menyatakan beberapa faktor yang mengahalangi perlindungan jaminan sosial di sektor informal yang disebut

juga sebagai peserta bukan penerima upah di Indonesia antara lain: a) Pendapatan yang rendah dan tidak tetap pada sektor informal adalah rintangan utama. Kebanyakan pekerja sektor informal di Indonesia menerima upah yang tidak tetap sehingga sulit untuk menghitung upah bulanan menjadi sulit dan kurang reliable. b) Jenis dan manfaat jaminan sosial tidak sejalan dengan kebutuhan utama dan keterbatasan sumber daya dari tenaga kerja pada sektor informal. c) Kurangnya kepedulian atas konsep jaminan sosial dan kurang nya kepercayaan atas institusi pemerintah yang lazim ditemukan di tenaga kerja sektor informal membawa efek negatif terhadap keinginan membayar iuran. d) Kesuksesan dari perluasan perlindungan bergantung pada peningkatan kapasitas administrasi berkelanjutan, yang mungkin mengungkapkan masalah registrasi, compliance, pengumpulan iuran dan pencatatan. Perhitungan pertumbuhan kepesertaan BPJS Ketenagakerjaan dilakukan dengan menghitung pertumbuhan kepesertaan tahun t dari tahun t-1 dengan rumus:

Dimana: P BPJSTK adalah pertumbuhan kepesertaan BPJS ketenagakerjaan, P BPJS TK t adalah Jumlah kepesertaan BPJS TK tahun t dan P BPJS TK t-1 adalah Jumlah kepesertaan BPJS TK tahun t-1. Besarnya pertumbuhan kepesertaan BPJS Ketenagakerjaan dinyatakan dalam persen. Data kepesertaan PT Jamsostek (Persero)/BPJS Ketenagakerjaan yang digunakan dalam tulisan ini adalah data kepesertaan aktif yang di peroleh dari laporan tahunan PT Jamsostek (Persero)/BPJS Ketenagakerjaan dari tahun 1997 hingga 2015. 2.2 Produk Domestik Bruto (PDB) Leamer (2009) mendefinisikan Produk Domestik Bruto (PDB) sebagai nilai dari barang dan jasa yang diproduksi dalam suatu area geografis tertentu (biasanya dalam suatu negara). PDB biasanya digunakan sebagai standar ukuran dan tingkat kesehatan suatu negara. Produk domestik bruto Indonesia pada tahun 2015 menurut data World Bank adalah sebesar USD 1.144.331 juta atau berada pada peringkat 16 didunia. Pengukuran perekonomian menggunakan PDB memiliki beberapa isu, misalnya PDB hanya memperhitungkan hasil dibandingkan dengan proses, PDB tidak memperhatikan keadilan yang wajar, selain itu PDB juga tidak memperhitungkan hibah dan semua pemberian yang tidak melibatkan transaksi jual beli. Menurut Costanza, Et al (2009), metodologi PDB awalnya

dikembangkan di Amerika Serikat dan Inggris pada sekitar tahun 1930 dan 1940-an dimana dunia sedang dihebohkan dengan perang dunia dan depresi besar besaran. Penggunaan PDB secara global sebagai pengukuran pertumbuhan ekonomi lebih jauh diperkuat dengan konferensi Bretton Woods. Salah satu faktor kunci pecahnya perang dunia II adalah ketidakstabilan ekonomi di sejumlah negara yang disebabkan oleh nilai tukar yang tidak stabil dan praktek diskriminasi perdagangan internasional yang menghambat perdagangan internasional. Konferensi Bretton Woods yang dihadiri 44 negara yang tersebut menghasilkan keputusan mendirikan International Monetary Fund (IMF) dan International Bank for Reconstruction and Developement (IBRD) yang saat ini menjadi bagian World Bank. PDB digunakan IMF dan World Bank sebagai alat utama untuk mengukur perkembangan ekonomi dalam 60 tahun terakhir. Sejak tahun 1990, United Nations Development Program (UNDP) telah menggunakan Human Development Index (HDI) dalam laporan pembangunan manusianya. Tujuan dari indeks ini adalah untuk memperhitungkan manajemen pertumbuhan ekonomi dan pembangunan manusia dalam meningkatkan kesejahteraan masyarakat di negara-negara di dunia.

Dalam indeks ini digunakan proksi seperti umur yang panjang diukur menggunakan angka harapan hidup, pengetahuan diukur menggunakan angka melek huruf dan tingkat pendidikan serta akses terhadap standar hidup yang layak yang menggunakan PDB yang yang disesuaikan mencerminkan daya beli masyarakat (Costanza, et al 2009). PDB perkapita adalah besarnya PDB suatu negara dibagikan dengan jumlah penduduk negara tersebut. Perhitungan pertumbuhan PDB perkapita Indonesia dilakukan dengan menghitung pertumbuhan PDB perkapita tahun t dibandingkan dengan tahun t-1 dengan rumus:
Dimana PDB adalah pertumbuhan produk domestik bruto perkapita Indonesia, PDBt adalah besarnya produk domestik bruto Indonesia tahun t dan PDB t -1 adalah besarnya produk domestik bruto Indonesia tahun t-1. Besarnya pertumbuhan PDB perkapita Indonesia dinyatakan dalam persen. Data yang digunakan dalam tulisan ini adalah data Produk Domestik Bruto (PDB) perkapita Indonesia dalam USD dari World Bank yang diperoleh dari Bloomberg dari tahun 1997 hingga 2015.

Pertumbuhan PDB Indonesia relatif stabil dari tahun 1997 hingga 2015. Namun pada tahun 1998 terjadi krisis ekonomi yang menyebabkan PDB perkapita Indonesia turun dari USD 1.064 perkapita di tahun 1997 menjadi USD 464 ditahun 1998. 2.3 Upah Minimum Berdasarkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan penetapan upah minimum bertujuan untuk meningkatkan taraf hidup pekerja sesuai dengan kebutuhan hidup minimalnya, oleh karena itu penetapan upah minimum didasarkan atas Kebutuhan Hidup Layak (KHL). Menurut Simanjuntak dalam (Sulistiawati, 2012), Kebijakan upah minimum merupakan sistem pengupahan yang telah diterapkan di beberapa negara. Kebijakan ini dapat dilihat dari dua sisi yaitu bahwa upah

minimum merupakan alat proteksi bagi pekerja untuk mempertahankan agar nilai upah yang diterima tidak menurun dalam memenuhi kebutuhan hidup sehari-hari serta sebagai alat proteksi bagi perusahaan untuk mempertahankan produktivitas. Dalam Pasal 1 Ayat 1 dari Peraturan Menteri Tenaga Kerja No. 1/1999, upah minimum didefinisikan sebagai upah bulanan terendah yang terdiri dari upah pokok termasuk tunjangan tetap. Waisgrais dalam (Sulistiawati, 2012) juga menjelaskan bahwa upah minimum memberikan efek positif mengurangi kesenjangan upah di pasar tenaga kerja. Sementara Askenazy dalam (Sulistiawati, 2012) menyatakan upah minimum meningkatkan perekonomian menjadi lebih kompetitif. Pengertian upah menurut Undang-Undang Tenaga Kerja No.13 Tahun 2000, Bab I, pasal 1, Ayat 30):

"Upah adalah hak pekerja/buruh yang diterima dan dinyatakan dalam bentuk uang sebagai imbalan dari pengusaha/pemberi kerja kepada pekerja/buruh yang ditetapkan dan dibayarkan menurut suatu perjanjian kerja, kesepakatan, atau peraturan perundang-undangan termasuk tunjangan bagi pekerja/buruh dan keluarganya atas suatu pekerjaan dan/atau jasa yang telah atau akan dilakukan”. Dilihat dari sisi perusahaan; upah adalah biaya yang selanjutnya akan dibebankan kepada konsumen melalui harga. Upah minimum propinsi (UMP) biasanya digunakan sebagai acuan untuk menetapkan upah pekerja di sektor formal, oleh karena itu kenaikan UMP yang lebih tinggi daripada produktivitas pekerja akan merugikan perusahaan karena dapat menaikkan biaya produksi. Biaya produksi yang tinggi mengakibatkan harga output menjadi tidak bersaing, maka pada gilirannya perusahaan akan mengurangi output. Penurunan output selanjutnya akan menurunkan penggunaan faktor produksi tenaga kerja, khususnya tenaga kerja yang berpendidikan rendah. (Sulistiawati, 2012). Sulistiawati (2012) menemukan dalam penelitiannya bahwa kenaikan upah akan berpotensi menurunkan penyerapan tenaga kerja, terutama tenaga kerja yang produktivitasnya rendah. Freeman (2009) menyatakan bahwa upah minimum di banyak negara tumpah ke sektor informal dan memperuncing distribusi upah. Lebih

lanjut, Freeman (2009) menemukan bahwa upah minimum meningkatkan upah tenaga kerja berpenghasilan rendah di sektor formal sehingga meruncingkan distribusi pendapatan dan mengubah upah untuk kelompok tenaga kerja berpenghasilan rendah. Studi dari Harrison dan Scorce dalam (Freeman, 2009) di Indonesia menemukan bahwa upah minimum mempunyai efek yang berlawanan secara moderat terhadap jumlah tenaga kerja, tetapi terdapat beberapa variasi dibandingkan beberapa negara. Penetapan upah minimum propinsi di Indonesia diusulkan oleh Dewan Pengupahan Daerah (DPD) yang terdiri dari birokrat, akademisi, buruh dan pengusaha kepada Gubernur agar di sahkan berdasarkan kebutuhan hidup pekerja lajang. Upah minimum yang digunakan dalam tulisan ini adalah rata-rata upah minimum propinsi di Indonesia. Pertumbuhan rata-rata upah minimum propinsi dalam tulisan ini dihitung menggunakan rumus:
Dimana UMP adalah pertumbuhan rata-rata upah minimum propinsi di Indonesia, UMPt adalah besarnya ratarata upah minimum propinsi di Indonesia pada tahun t dan UMP t -1 adalah besarnya rata-rata upah minimum propinsi di Indonesia tahun t1. Besarnya pertumbuhan rata-rata UMP Indonesia dinyatakan dalam persen. Data upah minimum propinsi (UMP) yang digunakan dalam tulisan ini merupakan rata-rata UMP dari 33 37
propinsi di Indonesia yang di peroleh dari web BPS dari tahun 1997 hingga 2015. Rata-rata pertumbuhan UMP di Indonesia dari tahun 1997 hingga 2015
adalah sebesar 14,36% dengan pertumbuhan tertinggi terjadi pada tahun 2001 sebesar 29,40%.

2.4 Tingkat Partisipasi Angkatan Kerja ILO mendefinisikan tingkat partisipasi angkatan kerja sebagai pengukuran proporsi dari populasi angkatan kerja yang aktif di pasar tenaga kerja baik bekerja atau mencari pekerjaan; tingkat partisipasi angkatan kerja mengindikasikan supply tenaga kerja yang tersedia untuk terlibat dalam produksi barang dan jasa secara relatif terhadap populasi pada usia kerja. De Mesa, et al (2004) mencatat bahwa di negara Chile perlindungan sistem pensiun terikat secara dekat dengan keterbatasan dan restriksi pada pasar tenaga kerja. Pasar tenaga kerja yang terus berkembang dipengaruhi

oleh perubahan ekonomi dan kebijakan pemerintah. Perubahan pasar tenaga kerja mempengaruhi ketidakpastian pada tenaga kerja terutama tenaga kerja mandiri dan berpendapatan rendah untuk berpartisipasi dalam jaminan sosial. Freeman (2009) menemukan bahwa terjadi penurunan sektor informal pada tahun 1980-an hingga 2000-an bahkan ketika sektor informal meningkat persentasenya dalam tenaga kerja global, bahkan di negara berkembang dengan pertumbuhan ekonomi yang cepat. Pertumbuhan ekonomi yang cepat gagal memperkecil persentase tenaga kerja informal, kemungkinan alasannya adalah

pertumbuhan produktifitas di sektor formal cukup besar sehingga ekspansi masif dari output tidak meningkatkan jumlah tenaga kerja. Tingkat partisipasi angkatan kerja (TPAK) yang digunakan dalam tulisan ini adalah tingkat partisipasi angkatan kerja di Indonesia dari tahun 1997 hingga 2015. Perubahan TPAK dalam tulisan ini dihitung menggunakan rumus:
Dimana TPAK adalah selisih tingkat partisipasi angkatan kerja di Indonesia dibandingkan dengan periode yang sama di tahun sebelumnya. TPAKt adalah besarnya tingkat partisipasi angkatan kerja di Indonesia pada tahun t dan TPAK t -1 adalah besarnya tingkat partisipasi angkatan kerja aktif pada tahun t-1. Perubahan TPAK di Indonesia cukup fluktuatif dari tahun 1997 hingga 2015, dimana posisi terendah terjadi pada tahun 2001, 2005 dan 2013 saat perekonomian Indonesia mengalami resesi.

2.5 Transformasi PT Jamsostek (Persero) Menjadi BPJS Ketenagakerjaan. Keinginan pemerintah memberikan jaminan sosial yang menyeluruh sistem jaminan sosial nasional (SJSN) dikembangkan bagi seluruh rakyat Indonesia. Setiap orang berhak atas jaminan sosial untuk dapat memenuhi kebutuhan dasar hidup yang 39
layak dan meningkatkan martabatnya menuju terwujudnya masyarakat Indonesia yang sejahtera, adil, dan makmur. Hal ini menjadi dasar yang melatarbelakangi disahkannya Undang Undang No. 40 tahun 2004 tentang Sistem Jaminan Sosial Nasional. Berdasarkan Undang Undang No. 24 tahun 2011 tentang Badan Penyelenggara Jaminan Sosial, pada bab 2 pasal 5 dinyatakan bahwa BPJS yang dibentuk dibedakan menjadi BPJS Kesehatan dan BPJS Ketenagakerjaan. Berdasarkan pasal Bab 18 ketentuan penutup UU No. 24 tahun 2011 pada pasal 1 dinyatakan bahwa PT Jamsostek (Persero) berubah menjadi BPJS Ketenagakerjaan pada tanggal 1 Januari 2014. Pada pasal 62 ayat 2 pada poin (a) dinyatakan PT Jamsostek (Persero) dinyatakan bubar tanpa likuidasi dan semua aset dan liabilitas serta hak dan kewajiban hukum PT Jamsostek (Persero) menjadi aset dan liabilitas serta hak dan kewajiban hukum BPJS Ketenagakerjaan. Tulisan ini menggunakan dummy variable transformasi PT Jamsostek (Persero) menjadi BPJS Ketenagakerjaan dalam model penelitian ini. Tulisan ini memberikan nilai 0 (nol) pada saat institusi masih dalam bentuk PT Jamsostek (Persero) pada tahun 1997 hingga 2013 dan nilai 1 (satu) saat PT Jamsostek (Persero) berubah menjadi BPJS Ketenagakerjaan di tahun 2014 hingga 2015. 3 Metode Penelitian Data yang digunakan dalam tulisan ini menggunakan data makro

ekonomi Indonesia dari tahun 19972015. Data yang digunakan adalah Produk Domestik Bruto (PDB) perkapita, rata-rata Upah Minimum propinsi (UMP), Tingkat partisipasi angkatan kerja (TPAK) di Indonesia serta jumlah peserta aktif BPJS Ketenagakerjaan sejak masih berbentuk PT Jamsostek (Persero) dari tahun 1997 hingga 2015. Model penelitian yang digunakan dalam tulisan ini adalah multiple regression dengan persamaan sebagai berikut:

Tulisan ini menggunakan Data Jumlah kepesertaan aktif yang diperoleh dari laporan tahunan (annual report) PT. Jamsostek (Persero) yang berubah badan hukum menjadi BPJS Ketenagakerjaan. rata upah minimum propinsi dan tingkat partisipasi angkatan kerja di Indonesia diperoleh dari web Badan Pusat Statistik (BPS) dan Bloomberg. Data yang digunakan merupakan data time
series dari tahun 1997 hingga 2015. Data yang digunakan dalam tulisan ini diolah menggunakan software eviews versi 8 dengan menggunakan metode Ordinary Least Square (OLS).

Besarnya R2 dari model ini adalah sebesar 0, 546954 yang artinya bahwa variabel pertumbuhan PDB perkapita, pertumbuhan rata rata UMP, perubahan tingkat partisipasi angkatan kerja (TPAK) dan perubahan institusi dari PT. Jamsostek (Persero) menjadi BPJS Ketenagakerjaan hanya mampu Jurnal Institut BPJS Ketenagakerjaan Tahun 2016 Volume 1
menjelaskan variabilitas pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 54,69% dan sisanya dijelaskan oleh faktor lain yang tidak dijelaskan dalam tulisan ini.

partisipasi angkatan kerja di Indonesia, akan menyebabkan kenaikan pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 8,0016%, ceteris paribus. β4 = 0, 213581 artinya bahwa setelah terjadi institusi PT Jamsostek (Persero) berubah menjadi BPJS Ketenagakerjaan, pertumbuhan kepesertaan lebih besar sebesar 0,2135% dibandingkan dengan saat masih menjadi PT. Jamsostek (Persero), ceteris paribus.

Covariance adalah probabilitas variabel-variabel yang digunakan dalam tulisan ini untuk bergerak bersama-sama baik dengan arah yang sama ataupun berlawanan. Secara umum covariance ketiga variabel yang digunakan dalam tulisan ini yaitu pertumbuhan PDB perkapita, Jurnal Institut BPJS Ketenagakerjaan Tahun 2016 Volume 1
pertumbuhan UMP dan perubahan TPAK dari tahun 1997 hingga 2015 cukup kecil sehingga kemungkinan untuk ketiga variabel ini untuk bergerak bersama cukup kecil. Covariance antara pertumbuhan PDB perkapita dan pertumbuhan UMP Indonesia adalah sebesar 0, 000316 yang artinya 42
bahwa kemungkinan antara pertumbuhan PDB perkapita dan pertumbuhan UMP adalah sebesar 0,03%. Correlation adalah besarnya korelasi antara satu variabel dengan variabel lainnya. Besarnya korelasi antara pertumbuhan PDB perkapita dan pertumbuhan UMP adalah sebesar -0, 193009, artinya bahwa antara pertumbuhan PDB perkapita dan pertumbuhan rata- rata UMP memiliki hubungan yang negatif sehingga kemungkinan untuk setiap kenaikan perubahan rata rata UMP akan menyebabkan penurunan pertumbuhan PDB perkapita. Besarnya kemungkinan untuk hal ini terjadi adalah sebesar 19,30%. 5 Pembahasan Kenaikan 1% dari pertumbuhan Produk Domestik Bruto (PDB) per kapita Indonesia akan menyebabkan kenaikan pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 0,0344%, ceteris paribus, besarnya t statistik untuk pertumbuhan PDB perkapita adalah sebesar 0, 5652 dengan P test sebesar 0,5815. Pertumbuhan PDB perkapita tidak berpengaruh signifikan pada pertumbuhan kepesertaan BPJS Ketenagakerjaan karena nilai P test adalah sebesar 0,5815 sehingga pertumbuhan PDB perkapita hanya signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan di level kepercayaan 58,15%. PDB perkapita merupakan salah satu indikator kesejahteraan suatu negara. Semakin baik kesejahteraan suatu negara maka semakin tinggi kesadaran

masyarakat akan jaminan sosial, namun hal ini belum tercermin di Indonesia karena pertumbuhan PDB perkapita tidak signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan. Kenaikan 1% dari pertumbuhan rata-rata upah minimum propinsi (UMP) di Indonesia akan menyebabkan kenaikan pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 0,1147%, ceteris paribus, besarnya t statistics untuk pertumbuhan rata-rata UMP adalah sebesar 0,4426 dengan besar P test sebesar 0,6653. Pertumbuhan rata-rata UMP tidak berpengaruh signifikan pada pertumbuhan kepesertaan BPJS Ketenagakerjaan karena nilai P test adalah sebesar 0,6653 sehingga pertumbuhan rata-rata UMP hanya signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan di level kepercayaan 66,53%. Meski upah minimum propinsi (UMP) merupakan cost yang harus dibayar pengusaha di sektor formal, namun disisi lain semakin tinggi UMP akan menjadi lebih menarik bagi tenaga kerja untuk bekerja di sektor formal. Lebih dari 90% peserta BPJS ketenagakerjaan merupakan pekerja penerima upah yang bekerja di sektor formal yang dipengaruhi oleh UMP. Namun, pertumbuhan UMP tidak signifikan mempengaruhi pertumbuhan kepesertaan BPJS ketenagakerjaan. Kenaikan 1% dari perubahan tingkat partisipasi angkatan kerja (TPAK) akan menyebabkan kenaikan pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 8,0016%, ceteris paribus. Besarnya t statistics

untuk perubahan TPAK adalah sebesar 2,6968 dengan besar P test sebesar 0,0183. Perubahan TPAK berpengaruh signifikan pada pertumbuhan kepesertaan BPJS ketenagakerjaan karena nilai P test adalah sebesar 0,0183 sehingga perubahan TPAK secara signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan di hingga level kepercayaan 1,83%. Besarnya persentase TPAK secara signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan, karena besarnya TPAK dihitung berdasarkan tenaga kerja sektor formal yang merupakan sebagian besar dari peserta BPJS TK, sehingga semakin besar perubahan TPAK semakin tinggi pertumbuhan kepesertaan BPJS Ketenagakerjaan. Dengan adanya transformasi PT Jamsostek (Persero) menjadi BPJS ketenagakerjaan, pertumbuhan kepesertaan BPJS Ketenagakerjaan lebih besar sebesar 0,2135% dibandingkan dengan saat masih menjadi PT Jamsostek (Persero) ceteris paribus. Besarnya t statistics untuk Dummy BPJS Ketenagakerjaan adalah sebesar 4,4880 dengan besar P test sebesar 0,0006. Perubahan institusi menjadi BPJS Ketenagakerjaan berpengaruh signifikan pada pertumbuhan kepesertaan BPJS ketenagakerjaan karena nilai P test adalah sebesar 0,0005 sehingga perubahan institusi menjadi BPJS ketenagakerjaan secara signifikan mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan di hingga level kepercayaan 0,06%. Transformasi institusi ini berpengaruh

signifikan terhadap pertumbuhan kepesertaan BPJS Ketenagakerjaan. Dengan adanya UU No. 40 tahun 2004 dan UU No. 24 tahun 2011 telah membantu meningkatkan kesadaran masyarakat akan jaminan sosial karena untuk tenaga kerja, pada dasarnya kepesertaan BPJS Ketenagakerjaan adalah wajib berdasarkan undangundang. 6 Kesimpulan dan Batasan 6.1 Kesimpulan Tulisan ini bertujuan untuk meneliti perkembangan makro ekonomi yang berpengaruh terhadap peningkatan kepesertaan BPJS Ketenagakerjaan. Dalam model penelitian ini digunakan indikator makro ekonomi yang digunakan adalah Produk domestik Bruto (PDB) perkapita, Rata-rata Upah Minimum Propinsi (UMP) dari 33 propinsi di Indonesia dan Tingkat Partisipasi angkatan Kerja (TPAK) sebagai variabel independen. Sementara pertumbuhan kepesertaan aktif PT Jamsostek (Persero)/BPJS Ketenagakerjaan digunakan sebagai variable dependen. Data time series yang di gunakan adalah data tahunan dari tahun 1997 hingga 2015. Selain itu juga digunakan variabel dummy yang membedakan institusi PT Jamsostek (Persero) berubah menjadi BPJS Ketenagakerjaan. Dengan menggunakan model multiple regression dengan metode ordinary least square (OLS) di peroleh informasi bahwa seluruh variabel independen yang digunakan dalam model ini memiliki pengaruh positif terhadap pertumbuhan kepesertaan

BPJS Ketenagakerjaan. Pertumbuhan PDB perkapita dan pertumbuhan ratarata upah minimum propinsi tidak berpengaruh signifikan terhadap pertumbuhan kepesertaan BPJS Ketenagakerjaan baik di level kepercayaan 1%, 5% ataupun di level 10%. Sementara, Perubahan tingkat partisipasi angkatan kerja (TPAK) dan dummy perubahan institusi BPJS Ketenagakerjaan berpengaruh signifikan terhadap pertumbuhan kepesertaan BPJS Ketenagakerjaan masing masing di level 1,83% dan 0,06%. Perubahan TPAK berdampak positif terhadap peningkatan kepeserrtaan BPJS Ketenagakerjaan, sehingga semakin tinggi jumlah penawaran tenaga kerja maka akan menambah jumlah kepesertaan BPJS Ketenagakerjaan karena peserta BPJS Ketenagakerjaan adalah tenagakerja baik sektor formal maupun informal. Transformasi institusi PT Jamsostek (Persero) menjadi BPJS Ketenagakerjaan juga berdampak positif terhadap pertumbuhan kepesertaan dimana dengan perubahan badan hukum tersebut BPJS Ketenagakerjaan dan BPJS Kesehatan sesuai dengan UU No. 24 tahun 2011 lebih dikenal dimasyarakat sehingga menjadi moment untuk

6.2 Batasan Aspek dalam tulisan ini terbatas pada data agregat dan makro ekonomi tanpa memperhatikan pada aspek mikro dari institusi dan individu yang terlibat dalam meningkatkan kepesertaan pada BPJS Ketengakerjaan. Data times series yang di gunakan adalah sepanjang 18 tahun atau observasi, waktu observasi yang lebih panjang akan lebih baik sehingga datanya menjadi lebih robust terutama masa setelah institusi berubah menjadi BPJS Ketenagakerjaan yang dalam model ini masih 2 tahun. R2 dalam model yang digunakan dalam tulisan ini adalah sebesar 0,5469 yang hanya mampu menjelaskan variabilitas dari pertumbuhan kepesertaan BPJS Ketenagakerjaan sebesar 54,69%, sedang 45,31% lainnya dijelaskan oleh variabel lainnya yang tidak termasuk dalam model ini sehingga dapat dikembangkan model lainnya dengan menambahkan variabel independen lain di masa mendatang untuk mengetahui faktor yang mempengaruhi pertumbuhan kepesertaan BPJS Ketenagakerjaan.

Abstract
The aim of this study is to determine the economic indicators that affecting the growth of participants of BPJS ketenagakerjaan which was also known as PT Jamsostek (Persero). The study emphasized the effect of economic indicators such as Gross Domestic Product (GDP) percapita, the average of minimum wages of provinces in Indonesia, the rate of labor participation, the institution transformation from PT Jamsostek (Persero) to BPJS Ketenagakerjaan towards the participants growth of BPJS Ketenagakerjaan. Using multiple regression with ordinary least square (OLS) method, it was found that Gross Domestic Product (GDP) percapita and the average of minimum wages of provinces in Indonesia did not significantly affect the participants growth of BPJS Ketenagakerjaan on 1%, 5% or 10% confidence level. However, The rate of labor participation and the institution transformation of BPJS Ketenagakerjaan significantly affected the participants growth of BPJS ketenagakerjaan on 1% confidence level. The change on the level of labor participation has positive effect to the participants growth; this was caused by the rise on the labor supply which adding the number of labor that was the target market of BPJS Ketenagakerjaan. Similarly, the institution transformation from PT Jamsostek (Persero) to BPJS Ketenagakerjaan significantly affect the participants growth, this probably due to awareness of workers about BPJS Ketenagakerjaan as obligatory participants as it is ruled by law on UU No. 40 of 2004 and UU No. 24 of 2011. 1 Introduction The social security according to Law No. 24 of 2011 is one of the social protections to ensure that all people can meet their basic needs for a decent life. This complies with the Indonesia’s objectives as listed in the preamble of the 1945 Constitution. They state that Indonesia was established to protect the people, promote the general welfare and educate the nation. The Law No. 24 of 2011 on Social Security Agency states that the national social security system is a state program which aims to provide social protection and welfare security for all citizens. Furthermore, in order to materialize the national social security system’s goals, it is necessary to establish a managing entity, which is a legal entity, under the principles of mutual cooperation, non-profit, transparency, prudence, accountability, profitability, mandatory membership, and trust fund. All social security management funds are aimed for the program development and greatest interest of the participants. BPJS Ketenagakerjaan as one of the social security agencies as mandated by the Law No. 24 of 2011 on Social Security Agency was established to manage the programs of occupational accident, provident fund, pension and death benefits. BPJS Ketenagakerjaan Participants are every person, including foreigners who have worked for at least 6 (six) months in Indonesia and paid contributions. Meanwhile, a worker is
every person who works for a salary, wage, or other remunerations. In addition to article 62 of Law No. 24 of 2011, PT. Jaminan Sosial Tenaga Kerja or abbreviated as PT. Jamsostek (Persero) established by the Government Regulation No. 36 of 1995 on Establishment of an Employment Social Security Agency (State Gazette of the Republic of Indonesia of 1995 Number 59), based on Law No. 3 of 1992 on Employment Social Security (State Gazette of the Republic of Indonesia of 1992 Number 14, Supplement to State Gazette of the Republic of Indonesia Number 3468) continues to run operational activities of the organization: 1. Healthcare benefit program, including new participants additions until the operation of BPJS; 2. Occupational accident, death, and provident fund benefits for its participants, including the addition of new participants until it is altered into BPJS Ketenagakerjaan. BPJS Ketenagakerjaan organizes occupational accident, death, provident fund, and pension benefits no later than 1 July 2015. The participation in BPJS Ketenagakerjaan is mandatory. Such compulsory membership is aimed to make all citizens as participants. Therefore, they can be protected. Nonetheless, the application is adjusted to the citizens

and Government’s economic capacity and program feasibility. The initial phase is started from formal sector workers. Meanwhile, the informal sector workers can be a voluntary participant, including farmers, fishermen, and those who work independently. In the end, the National Social Security System can cover the entire population. With a growing number of manpower in Indonesia, the BPJS membership is expected to grow larger, so the Indonesia's economic growth will be increasing. This paper intends to examine the macro-economic indicators, such as gross domestic product (GDP) growth, the average growth of the regional minimum wage in Indonesia, changes in labor participation rate (TPAK) and the transformation of PT. Jamsostek (Persero) into BPJS Ketenagakerjaan and the effect of these indicators on the BPJS Ketenagakerjaan membership growth. 2 Theoretical Framework 2.1 BPJS Ketenagakerjaan Membership According to Law No. 24 of 2011 on social security agency, participants are every person, including foreigners
who have worked for at least 6 (six) months in Indonesia and paid contributions. According to Article 3 of the Regulation of the President of the Republic of Indonesia No. 109 of 2013 on social security program membership stages, it is stated that the social security program Participants consist of wage earning participants and non-wage earning participants. Article 4 of such Presidential regulation also explains that wage earning participants are workers who work at public and nonpublic employers. Article 7 of the Presidential Decree No. 109 of 2013 explains that non-wage earning Participants are: a) employers b) workers without any employment binds or selfemployed workers c) workers who are not included in letter b) and do not receive any salary or wage. The membership growth of PT. Jamsostek (Persero) is quite low. From 1997 to 2013, it is around 1% to 1%. However, after it changes its legal status into BPJS Ketenagakerjaan in 2014, there is a significant additional active workers number.

The number of BPJS Ketenagakerjaan active participants tends to increase from year to year. During 2009-2014, the BPJS Ketenagakerjaan
membership grew by 13.27% (CAGR) from 8.29 million participants in 2009 to 16.10 million participants in 2014. The composition of the BPJS

Ketenagakerjaan membership is dominated by wage-earning workers at 97.61% in 2009. However, the nonwage earning workers proportion percentage keeps increasing, in which it has reached 4.11% in 2014. Angelini and Hirose (2004) suggest several factors which hinder the social security protection in the informal sector, which also known as a nonwage earning participant in Indonesia, among others: a) Low and non-fixed income in the informal sector is a major hurdle. Most informal workers in Indonesia receive non-fixed wages. Thus, it will be difficult and less reliable to calculate the monthly wage. b) The social security types and benefits are not in line with the primary needs and resource constraints of the informal workers. c) Lack of awareness on the social security concept and lack of trust from the government institutions, which are prevalent in the informal workers, have a negative effect on the willingness to pay dues. d) The success of the protection expansion depends on the continuous administrative capacity, which may reveal problems with the registration, compliance, contributions, collection and record keeping. The BPJS Ketenagakerjaan membership growth is calculated the
membership growth for year t from year t-1 under the following formula:
Where: P BPJSTK is the BPJS Ketenagakerjaan membership growth, P BPJS TK t is the BPJS TK TK Membership for year t and P BPJS TK t-1 is the BPJS TK Membership for year t-1. The number of BPJS Ketenagakerjaan membership growth is expressed in the percentage. The PT. Jamsostek (Persero)/BPJS Ketenagakerjaan membership data used in this paper is the active membership data obtained from the annual report of PT. Jamsostek (Persero)/BPJS Ketenagakerjaan from 1997 to 2015. 2.2 Gross Domestic Product (GDP) Leamer (2009) defines the Gross Domestic Product (GDP) as the value of goods and services produced in a particular geographic area (usually a country). GDP is usually used as a standard measure and the reliability of a country. According to data from the World Bank, Indonesia's gross domestic product in 2015 is USD1,144,331 million, which ranks the 16th in the world. The economic measurement using GDP has some issues, for example, GDP takes into account only the results compared with the process and GDP does not pay attention to the reasonable justice. In addition, GDP also does not take

into account grants and all rewards which do not involve a buying or selling transaction. According to Costanza, Et al. (2009), the GDP methodology was originally developed in the United States and England in about 1930 and 1940 when the world was shocked by the world wars and great depression. The global use of GDP as a measure of economic growth is further strengthened by the Bretton Woods conference. One key factor of the World War II is the economic instability in some countries due to unstable exchange rates and international trade discriminatory practice, which hindered the international trade. The Bretton Woods conference which was attended by 44 countries resulted in decision to establish the International Monetary Fund (IMF) and International Bank for Reconstruction and Development (IBRD), which are currently a part of the World Bank. GDP is used by IMF and World Bank as the main tool for measuring the economic development in the last 60 years. Since 1990, the United Nations Development Program (UNDP) has been using the Human Development Index (HDI) in the human development report. The purpose of this index is to account for the management of economic growth and
human development in improving the welfare of society in the world’s countries. This index uses a proxy, such as a long life is measured using the life expectancy, knowledge is measured using the literacy figure and education levels and access to adequate living standard use the adjusted GDP to reflect the public purchasing power (Costanza, et al 2009). GDP per capita is the amount of GDP of a country divided by the population of the country. The calculation of the Indonesian GDP per capita growth is calculated using the GDP per capita growth in year t compared to year t-1 with the following formula:
Where GDP is the Indonesian gross domestic product per capita growth, PDBt is the amount of Indonesian gross domestic product in year t and GDP t-1 is the amount of Indonesian gross domestic product in year t1. The amount of Indonesian GDP growth per capita is expressed in percentage. The data used in this paper is the Indonesian Gross Domestic Product (GDP) per capita in USD from the World Bank obtained from Bloomberg from 1997 to 2015.

The Indonesian GDP growth is relatively stable from 1997 to 2015. However, in 1998, there was an economic crisis which cause the Indonesian GDP per capita fell from USD1,064 per capita in 1997 to USD464 in 1998. 2.3 Minimum Wage Based on Law No. 13 of 2003 on Manpower, the minimum wage stipulation aims to improve the workers’ living standards in accordance with the minimum necessities of life. Therefore, the minimum wage is based on the Proper Living Needs (KHL). According Simanjuntak in (Sulistiawati, 2012), the minimum wage policy is a wage system which has been implemented in several countries. This policy can be seen from two sides, namely that the
minimum wage is a protection tool for workers to maintain the value of their wages in meeting the everyday life needs as well as protection tool for companies to maintain productivity. In Article 1 Paragraph 1 of the Regulation of the Minister of Manpower No. 1/1999, the minimum wage is defined as the lowest monthly wage, which consists of basic salary including fixed allowances. Waisgrais in (Sulistiawati, 2012) also explains that the minimum wage has a positive effect in reducing the wage gap in the labor market. Meanwhile, Askenazy in (Sulistiawati, 2012) states that the minimum wage make the economy more competitive. Definition of wages according to the Law No. 13 of 2000 on Manpower, Chapter I, Article 1, Section 30): "Wages are the rights of workers/laborers, which are

received and expressed in an amount of money for a return from a business/employer to workers/laborers. It is decided and paid under an employment agreement, contract, or laws and regulations, including allowances for workers/laborers and their families on a job and/or service which has been or will be done". From the side of the company; wages are costs which would then be passed on to consumers through price. The regional minimum wage (UMP) is usually used as a reference to set the wages of formal workers. Thus, a higher increase in minimum wage than the productivity of workers will hurt the company because it can raise production costs. High production costs lead to the price output which becomes uncompetitive. Then, in turn, the company will reduce output. The decline in output will also lower the worker productive factor use, especially for low-educated workers (Sulistiawati, 2012). Sulistiawati (2012) finds in her research that the wage increase will potentially reduce employment, especially workers whose productivity is low. Freeman (2009) states that the minimum wage in many countries dominates the informal sector and exacerbates the wage distribution. Furthermore, Freeman (2009) finds that the minimum wage increases the wages of low-income
formal workers, so it sharpens the income distribution and changes the low-income workers’ wages. The study by Harrison and Scorce in (Freeman, 2009) in Indonesia finds that the minimum wage has the moderately opposite effect against the number of workers. However, there are some variations compared to some countries. The regional minimum wage in Indonesia is proposed by the Regional Wage Council (DPD), which is composed of bureaucrats, academics, workers and employers to the Governor to be legalized by the life necessities of single workers. The minimum wage used in this paper is the average of regional minimum wages in Indonesia. The average growth of the regional minimum wage in this paper is calculated by the formula:
Where the UMP is the average growth of the regional minimum wage in Indonesia, UMPt is the average regional minimum wage in Indonesia in year t and UMP t-1is the average regional minimum wage in Indonesia in year t-1. The Indonesian regional minimum wage average growth is expressed in percentage. The regional minimum wage (UMP) data used in this paper is the average minimum wage of 33 provinces in Indonesia which was obtained from the BPS’s website from 1997 to 2015.

2.4 Manpower Participation Rate The ILO defines the manpower participation rate as a proportional measure of the active manpower population in the labor market, in which they are either working or looking for work. The manpower participation rate indicates the supply of workers available to engage in the production of goods and services relative to working-age population. De Mesa, et al (2004) notes that Chile’s pension protection system is tied closely to limitations and restrictions of the labor market. The labor market continues to grow and is affected by changes in the economy and government policy. Changes in the labor market affect the manpower
uncertainty, especially independent and low-income workers, to participate in the social security. Freeman (2009) finds that an informal sector declined in the 1980s to the 2000s even though the global informal sector percentage increased. Such decline took place even in developing countries with rapid economic growth. The rapid economic growth failed to reduce the percentage of informal workers. The possible reason is the formal sector productivity growth is large enough. Thus, the output massive expansion does not increase the workforce. The manpower participation rate (TPAK) used in this paper is the manpower participation rate in

Indonesia from 1997 to 2015. The TPAK change in this paper is calculated using the formula:

same period. TPAKt is the Indonesian manpower participation rate in year t and TPAK t-1 is the active manpower participation rate in year t-1. The Indonesian TPAK difference is expressed in percentage.

The Indonesian TPAK change is quite volatile from 1997 to 2015, where the lowest point occurred in 2001, 2005 and 2013 when Indonesia fell into an economic recession. 2.5
Transformation of PT. Jamsostek (Persero) to BPJS Ketenagakerjaan The government wants to provide a social security comprehensive via the national social security system
(SJSN), which is developed for all Indonesians. Every person is entitled to social security to meet the basic life needs and enhance the dignity towards the prosperous, just, and affluent Indonesia. This causes the enactment of Law No. 40 of 2004 on National Social Security System. Based on Law No. 24 of 2011 on Social Security Agency in chapter 2 Article 5, it states that the established

BPJS is divided into BPJS Kesehatan and BPJS Ketenagakerjaan. Based on the Chapter 18 – closing provisions of Law No. 24 of 2011 in Article 1, it is stated that PT. Jamsostek (Persero) is altered into BPJS Ketenagakerjaan on 1 January 2014. Article 62 paragraph 2 point (a) declares that PT. Jamsostek (Persero) is dissolved without liquidation and all assets, liabilities, rights and legal obligations of PT. Jamsostek (Persero) are transferred to become the assets, liabilities, rights and legal obligations of BPJS Ketenagakerjaan. This paper uses a dummy variable of the transformation of PT. Jamsostek (Persero) to BPJS Ketenagakerjaan in this research model. This paper gives a value of 0 (zero) when the institution is still PT. Jamsostek (Persero) in 1997 and 2013 and a value of 1 (one) when PT. Jamsostek (Persero) is altered into BPJS Ketenagakerjaan in 2014 - 2015. 3 Research Method The data used in this paper uses Indonesian macroeconomic data from 1997 to 2015. The data used is the Gross Domestic Product (GDP) per capita, average minimum regional wage (UMP), manpower participation rate (TPAK) in Indonesia and the number of BPJS Ketenagakerjaan active participants since it is still PT. Jamsostek (Persero) from 1997 to 2015.

The R2 value of this model is 0.546954 which means that the GDP per capita growth, UMP average growth, changes in the manpower participation rate (TPAK), and an institutional change from PT. Jamsostek (Persero) to BPJS Ketenagakerjaan variables only explain the BPJS Ketenagakerjaan membership growth variability of 54.69% and the rest is explained by
other factors which are not described in this article. β1 = 0.034409 means every 1% increase in the Indonesian Domestic Product growth will lead to an increase in the BPJS Ketenagakerjaan membership growth of 0.0344%, ceteris paribus. β2 = 0.114759 means every 1% increase in the Indonesian average

Covariance is the variables probability used in this paper to move together either in the same or opposite direction. In general, the covariance of three variables used in this paper is the growth of GDP per capita, UMP growth and TPAK change from 1997 to 2015 and it is small enough. Therefore, the possibility for these three variables to move along is quite small. The covariance between the GDP per capita growth and Indonesian UMP growth is 0.000316, which means the possibility of the
GDP per capita and UMP growth is 0.03%. Correlation is the correlation between one variable and another variable. The correlation between the GDP per capita and UMP growth is -0.193009, which means the GDP per capita growth and UMP average growth has a negative relationship. Thus, the possible increase in the average UMP change will cause a decline in the GDP per capita growth. The possibility

percentage for this event happening is 19.30%. 5 Discussion The 1% increase of the Indonesian Gross Domestic Product (GDP) per capita will lead to an increase in the BPJS Ketenagakerjaan membership, i.e. 0.0344%, ceteris paribus. Meanwhile, the t statistics for the GDP per capita growth is equal to 0.5652 with P test of 0.5815. The GDP per capita growth does not have any significant effects on the BPJS Ketenagakerjaan membership growth, as the test P value is 0.5815. Therefore, the GDP per capita growth only significantly affects the BPJS Ketenagakerjaan membership growth at 58.15% confidence level. GDP per capita is one indicator of a country's welfare. The better the welfare of a country, the higher public awareness on social security is. However, this is not yet reflected in Indonesia due to the GDP per capita growth does not significantly affect the BPJS Ketenagakerjaan membership growth. A 1% increase from the average growth of the Indonesian regional minimum wage (UMP) will lead to an increase in the BPJS Ketenagakerjaan membership growth, i.e. 0.1147%, ceteris paribus. The t statistics for the UMP average growth is 0.4426 in which the P test is 0.6653. The UMP average growth does not have any significant effects on the BPJS Ketenagakerjaan membership growth, the P test value is at 0.6653. Therefore, the UMP
average growth only significantly affects the BPJS Ketenagakerjaan membership growth at 66.53% confidence level. Even though the regional minimum wage (UMP) is a cost to be paid by formal sector employers, on the other hand a higher UMP will become more attractive for workers to work in the formal sector. More than 90% of BPJS Ketenagakerjaan participants are wage earning workers, who work in the formal sector and are affected by the UMP. However, the UMP growth does not significantly affect the BPJS Ketenagakerjaan membership growth. A 1% increase from the manpower participation rate (TPAK) change will lead to an increase in the BPJS Ketenagakerjaan membership growth, i.e. 8.0016%, ceteris paribus. The t statistics for TPAK changes are 2.6968 in which the P test is 0.0183. The TPAK change has a significant effect on the BPJS Ketenagakerjaan membership growth, as the P test value is 0.0183. Therefore, the TPAK change significantly affects the BPJS Ketenagakerjaan membership growth up to 1.83% confidence level. The TPAK percentage significantly affects the BPJS Ketenagakerjaan membership growth, because the TPAK is calculated based on the formal sector workers, who are mostly the BPJS TK participants. Therefore, the more significant TPAK change, the higher the BPJS Ketenagakerjaan membership growth is.

With the transformation of PT. Jamsostek (Persero) to BPJS Ketenagakerjaan, the BPJS Ketenagakerjaan membership growth is bigger, i.e. 0.2135% compared with the figure, when it is still PT. Jamsostek (Persero) ceteris paribus. The t statistics for Dummy BPJS Ketenagakerjaan is 4.4880 and P test is 0.0006. An institutional change to become BPJS Ketenagakerjaan significantly affects the BPJS Ketenagakerjaan membership growth as the P test value is 0.0005. Therefore, the institutional change to become BPJS Ketenagakerjaan significantly affects the BPJS Ketenagakerjaan membership growth up to 0.06% confidence level. This institutional transformation has a significant effect on the BPJS Ketenagakerjaan membership growth. Law No. 40 of 2004 and Law No. 24 of 2011 have assisted in increasing the public awareness on the employment social security, specifically BPJS Ketenagakerjaan participation is mandatory by law. 6 Conclusions and Limitations 6.1 Conclusions This paper aims to examine the macro-economic development which affects the increase of BPJS Ketenagakerjaan membership. This research model uses macroeconomic indicators, namely gross domestic product (GDP) per capita, average regional minimum wage (UMP) of 33 provinces in Indonesia and Manpower
Participation Rate (TPAK) as independent variables. Meanwhile, the active membership growth of PT. Jamsostek (Persero)/BPJS Ketenagakerjaan is used as the dependent variable. Time series data used are annual data from 1997 to 2015. It also uses a dummy variable which differentiates PT. Jamsostek (Persero) from BPJS Ketenagakerjaan. By using a multiple regression model and ordinary least squares (OLS) method, information is obtained that all independent variables used in this model have a positive influence on the BPJS Ketenagakerjaan membership growth. The GDP per capita growth and the regional minimum wage average growth has no significant effect on the BPJS Ketenagakerjaan membership growth, i.e. the confidence level is 1%, 5% or 10%, respectively. Meanwhile, the manpower participation rate (TPAK) change and dummy institutional change of BPJS Ketenagakerjaan significantly affect the BPJS Ketenagakerjaan membership growth, respectively at the level of 1.83% and 0.06%. The TPAK change positively affects impact the BPJS Ketenagakerjaan membership growth. Therefore, a higher workers figure will increase the BPJS Ketenagakerjaan membership as BPJS Ketenagakerjaan participants are both formal and informal sectors workers.

The institutional transformation of PT. Jamsostek (Persero) into BPJS Ketenagakerjaan also has a positive impact on the membership growth, in which the change in the legal entity, namely BPJS Ketenagakerjaan and BPJS Kesehatan under Law No. 24 of 2011, is better known in the community. Therefore, it is a moment to build public awareness in the social security. 6.2 Limitations Aspects of this paper are limited to aggregate and macroeconomic data regardless of the micro aspects of institutions and individuals involved in increasing the BPJS Ketenagakerjaan membership. The time series data used was all 18-year data or
observation. A longer observation time will be better as data becomes more robust, specifically the period after the institution is transformed into BPJS Ketenagakerjaan. In this model, the transformation is still 2 years. R2 in the model used in this paper is 0.5469, which is only able to explain the variability BPJS Ketenagakerjaan membership growth up to 54.69%, while 45.31% is explained by other variables not included in this model. Such other variables can be developed into other models by adding another independent variable in the future to determine the factors which influence the BPJS Ketenagakerjaan membership growth.

KETENTUAN PENULISAN Ketentuan Umum 1. Artikel yang dipublikasikan Jurnal Institut BPJS Ketenagakerjaan berupa hasil penelitian dan non penelitian (ilmiah/populer) baik dari internal maupun eksternal BPJS Ketenagakerjaan yang memiliki relevansi jaminan sosial, ketenagakerjaan, pengembangan sumber daya manusia, ekonomi, keuangan dan kebijakan publik. 2. Naskah yang dikirim merupakan karya asli, belum pernah dan atau akan diterbitkan di media publikasi lainnya. 3. Artikel diketik dalam bahasa Indonesia dan atau bahasa Inggris dengan ukuran kertas A4 menggunakan tipe huruf Arial, ukuran font 12, spasi 1,5.dengan jumlah minimal 15 halaman dan maksimal 25 halaman dalam bentuk hardcopy atau softcopy. 4. Redaksi berhak menyunting setiap naskah yang masuk. Ketentuan Penulisan Naskah Urutan naskah mengikuti format sebagai berikut: 1. Judul; Judul tidak melebihi 12 kata dalam bahasa Indonesia dan dalam bahasa Inggris tidak melebihi 10 kata. 2. Data Penulis; ditulis lengkap tanpa gelar, dicantumkan nama . 3. Abstrak; dibuat dalam bahasa Indonesia dan Inggris, terdiri paling banyak 400 kata berisi tujuan, metode dan hasil penelitian. 4. Kata Kunci; memuat konsep yang terkandung dalam artikel, ditulis dalam bahasa Indonesia dan bahasa Inggris terdiri dari 4 – 6 kata ditulis di bawah abstrak. 5. Pendahuluan; berisi latar belakang, perumusan masalah, kerangka teoritis, dan tujuan penelitian yang dibuat secara ringkas 6. Metodologi; memuat secara rinci dan jelas mengenai lokasi dan waktu penelitian, sumber data, serta bagaimana metode analisis datanya. 7. Pembahasan; Bagian ini memuat data, analisis data dan interpretasi terhadap hasil. 8. Simpulan; ditulis dalam bentuk essay yang memuat hasil dari penelitian. 9. Daftar Pustaka; menuliskan seluruh pustaka yang digunakan dalam penulisan. Pengiriman Naskah Naskah dapat dikirim melalui email
