LaboXX_Werk - Deelname Internationale Architectuur Biënnale Rotterdam. Overeenkomst - Goedkeuring
Motivering Aanleiding en context Op 12 juni 2015 (jaarnummer 5066) heeft het college het onderzoek Labo XX_Werk gegund aan drie studiebureaus. Deze bureaus onderzoeken hoe er meer plaatsen voor werk kunnen behouden en gecreërd worden in de 20ste-eeuwse gordel. Dit onderzoek wordt begin 2016 afgerond. Regelgeving: bevoegdheid Volgens artikel 57, §3, 1° van het Gemeentedecreet is het college van burgemeester en schepenen bevoegd voor de daden van beheer over de gemeentelijke inrichtingen en eigendommen, binnen de door de gemeenteraad vastgestelde algemene regels. Argumentatie De Internationale Architectuur Biënnale Rotterdam (IABR) is opgericht in 2001 in de overtuiging dat architectuur en met name de stedenbouw van groot publiek belang is. Zij richten zich daarom op de toekomst van de stad, waar over een aantal decennia bijna 80% van de wereldbevolking meer dan 90% van onze welvaart zal produceren. Deze tentoonstelling wordt tweejaarlijks georganiseerd. Het thema in 2016 is: The next economy. De tentoonstelling loopt van 22 april 2016 tot 10 juli 2016 in Rotterdam. Labo XX_Werk is, als onderzoek naar de verweving van werk en wonen in de twintigste-eeuwse gordel, geselecteerd om deel uit te maken van de tentoonstelling voor IABR. Om de resultaten van Labo XX_Werk te verspreiden biedt IABR een unieke kans. Om de deelname van Labo XX_Werk te formaliseren, wordt een overeenkomst voorgesteld. In deze overeenkomst wordt het inhoudelijke basismateriaal ter beschikking gesteld en de copyrights afgestaan voor de tentoonstelling, website en publicaties in het kader van IABR. en drukken van tentoonstellingspanelen. Eventuele extra elementen voor de tentoonstelling (maquette, filmpje…) moet door de stad worden voorzien. Het college keurt de overeenkomst 'IABR-2016-The Next Economy - Exhibition Agreement' met de Internationale Architectuur Biënnale Rotterdam (IABR) goed. Artikel 2
Dit besluit heeft in principe geen financiële gevolgen.

EXHIBITION AGREEMENT Rotterdam, 16-12-2015 Production code: IABR2016-TT-035 The following is an agreement between: The International Architecture Biennale Rotterdam, located at the Delftsestraat 5, mail address: IABR, P.O. Box 1019, 3000 BA Rotterdam, The Netherlands, and represented by George Brugmans, executive director, hereafter referred to as: the IABR and: The project, Labo XX -Werk by The City of Antwerp, located at Grote Markt 1, 2000, Antwerpen, België, and represented by Mister Bart De Wever, The Mayor, and Mister Roel Verhaert, The City Clerk as representatives of the College of Mayor and Aldermen, hereafter referred to as: the contracting party.
This is a contract regarding the presentation of Labo XX -Werk at the main exhibition of IABR– 2016–THE NEXT ECONOMY–. This agreement further defines the collaboration and is supplementary to all earlier agreements between the IABR and the party/parties representing Labo XX -Werk and does not affect or in any way invalidate these earlier agreements as pertaining to the exhibition, the use of material, copyrights and all other relevant issues.
Agreement 1. IABR Exhibition 1.01 The IABR develops, curates, designs, formats, and produces the exhibition IABR– 2016–THE NEXT ECONOMY–, taking place in the Fenixloods II, Veerlaan 21, Rotterdam from 22 April up until 10 July 2016, and in which the contracting party participates.
1.02
IABR makes the final material selection for the exhibition. IABR is responsible for and has the final decision about the overall lay-out and framework of the exhibition and the way in which Labo XX -Werk is presented within this lay-out and framework.

1.03
All costs directly pertaining to the set-up, installation (including graphic design, printing and panelling), audio-visual hardware and dismantling of the exhibition itself are covered by the IABR up to a given maximum and based on specifications to be agreed between the two parties.
1.04
The IABR provides the contracting party in due course with formats, requirements and guidelines to which the elements and data of the contracting party’s contribution should comply.
1.05
Insurance of the exhibition material(s) against theft and damage during the exhibition period is provided by the IABR.
1.06
The IABR will use Labo XX -Werk as title of the project, and Stad Antwerpen as the main credit for the exhibition and the catalog unless otherwise notified before 1 November 2015, by making the necessary adjustment in this contract as it will be signed and returned to IABR.
Catalog The IABR edits, designs, develops and produces the catalog of IABR–2016–THE NEXT ECONOMY–, in which the contracting party’s project is duly represented.

The IABR provides the contracting party with formats, requirements and guidelines to which the contracting party’s contribution to the catalog should comply.
Promotion Whenever relevant and/or appropriate the contracting party will be included in the promotional activities of IABR–2016–THE NEXT ECONOMY–, at the discretion of the IABR.
1.09
2. CONTRACTING PARTY Exhibition 2.01 The contracting party is responsible for the development, production, sending/shipping and delivery of all exhibition materials to and from Rotterdam, the Netherlands, including the financing and transport insurance thereof, within the timeframe provided by the IABR. 2.02 The contracting party agrees to provide all exhibition materials according to the formats, requirements and guidelines as specified by the IABR. 2.03 The material presented at the exhibition that is produced by IABR on the basis of digitally submitted material by the contracting party, becomes the property of the IABR, unless other agreements are entered into before the material is submitted for the exhibition. In the latter case, the contracting party will be responsible for the collection and/or sending/shipping of the material after the exhibition and within the timeframe provided by the IABR. 2.04 If films are submitted for the exhibition, the spoken language should be English or the film should have English subtitles, and in the format requested by the IABR.

2.05 The material that is submitted in physical form by the contracting party, such as, but not limited to models, artifacts and mock-ups, remains the property of the contracting party. For these materials, separate loan agreements will be made. 2.06 In the case of complex presentations, for example composite scale models, large, digital or interactive installations, teams may be asked to assist the set-up in order to ensure appropriate installation and placement. This also applies to disassembly after the exhibition. Travel costs related to such assistance will not be covered by the IABR. 2.07 There is limited AV and computer equipment available for individual projects. The contractor may be asked to provide this equipment or else compensate the exhibition organizers for the cost of obtaining the necessary equipment. 2.08 All additional and material-specific data, captions and all relevant credits will be communicated to the IABR within the timeframe and according to the guidelines as provided by the IABR.
Catalog 2.03 The contracting party will provide - credits, articles, photographs, pertinent illustrations and/or all other relevant material for the IABR catalog according to the guidelines of and before the deadlines given by the IABR, and all material will be free of all copyrights and/or royalty claims.
3. MISCELLANEOUS All travel, accommodation and other costs related to the contracted party’s participation in all activities organized by the IABR, including its presence at the exhibition and/or the opening and closure event thereof, are at the expense of the contracting party with the exclusion of specific invitations as defined in 3.02;

Reimbursements for costs pertaining to contributions to IABR–2016–THE NEXT ECONOMY– not directly related to the presentation of the project itself, and otherwise than specified in this agreement, are to be negotiated separately between the two parties.
3.03
A sheet with the planning time line of the exhibition and the catalog is attached to this contract.
3.04
The contracting party will provide all articles, texts, materials, photographs, drawings, and all other illustrations and material free of copyrights and/or royalty claims. These may be used for presentations, exhibitions, the catalogue, and any other media associated with the IABR, such as - but not limited to - films, internet, television, posters, advertising, etc.
3.05
The IABR has the right to publish these texts or parts of these, and/or publicly present the work where and whenever it deems appropriate but only within the context of IABR–2016– THE NEXT ECONOMY–.
3.06
The IABR will not be responsible for any claim by third parties. It will provide written acknowledgment of sources wherever possible.

3.07
Whenever relevant or possible the contractor will publicly present itself as participant in the main exhibition of IABR–2016–THE NEXT ECONOMY–.
3.08
If the entire exhibition or part of it travels elsewhere after the exhibition in Rotterdam, then additional agreements between IABR and the contracting party will be entered into in a timely fashion.
3.09
The IABR reserves the right to ultimately opt out of materials and projects previously selected for the exhibition, based on the quality of the materials produced and delivered. This Agreement will enter into force once signed in full by both parties, and will end 1 September 2016. By signing and returning this document, the contracting party accepts all terms and conditions mentioned herein. All documents have been made up under Dutch law.
