MEMORANDUM SALING PENGERTIAN ANT ARA KEMENTERIAN PEMUDA DAN OLAHRAGA REPUBLIK INDONESIA DAN SEKRETARIAT NEGARA PEMUDA DAN OLAHRAGA REPUBLIK DEMOKRATIK TIMOR-LESTE TENT ANG KERJASAMA DI BIDANG PEMUDA DAN OLAHRAGA
Kementerian Pemuda dan Olahraga Republik Indonesia dan Sekretariat Negara Pemuda dan Olahraga Republik Demokratik Timor-Leste, selanjutnya disebut secara bersama-sama sebagai "Para Pihak" dan secara individu sebagai "Pihak";
BERKEINGINAN
untuk
lebih
lanjut
memperluas,
mempererat,
dan
meningkatkan persahabatan dan kerjasama antara Para Pihak;
MEMPERTIMBANGKAN secara khusus, perlunya menjalin dan membina hubungan baik pada bidang pemuda dan olahraga ;
SESUAI dengan peraturan perundang-undangan serta kebijakan-kebijakan yang berlaku di masing-masing negara;
TELAH MENYEPAKATI sebagai berikut:

PASAL 1 TUJUAN KERJASAMA
Memorandum Saling Pengertian (selanjutnya disebut sebagai "MSP") ini bertujuan untuk lebih lanjut mempererat hubungan persahabatan antara Para Pihak dan meningkatkan pembangunan sumber daya manusia pada di bidang pemuda dan olahraga antara Para Pihak atas dasar timbal balik, saling pengertian , dan saling meng untungkan .
PASAL 2 BIDAN G-BIDANG KERJASAMA
Para Pihak menyetujui untuk bekerjasama pada bidang-bidang sebagai berikut:
(1) Bidang Pemuda a. Pertukaran
kunjung an
oleh
pemuda ,
pejabat
pemerintah
yang
berwenang atas pembuatan kebijakan pemuda atau wakil organisasiorganisasi kepemudaan ; b. Pemberian undangan untuk menghadiri lokakarya, konferensi, atau seminar mengenai masalah-masalah kepemudaan yang dilaksanakan di masing-masing negara ; c. Pertukaran informasi tentang urusan pemuda sesuai dengan peraturan perundang-undangan
serta
kebijakan-kebijakan
di
masing-masing
negara; d. Mendorong partisipasi dalam kamp-kamp pemuda, festival pemuda, kepramukaan , dan acara-acara pemuda lainnya di kedua negara; e. Kerjasama pengembang an di bidang kepeloporan , kepemimpinan, kewirausahaan , kepramukaan, dan pembangunan pemuda; f. Kerjasama dalam penyediaan fasilitas kepemudaan ;
g. Mendorong pariwisata pemuda sebagai cara untuk meningkatkan pengertian bersama Para Pihak untuk mendukung perdamaian dan mempererat persahabatan; h. Mendorong kerjasama di bidang keterampilan hidup dan kewirausahaan antara kedua Pihak;
i. Mendorong
kerjasama
dalam
penyadaran ,
perlindungan ,
dan
pengendalian bahaya destruktif di antara pemuda; j. Mendorong nilai-nilai kemanusiaan dan spiritual antara pemuda.
(2) Bidang Olahraga
a. Pertukaran kunjungan oleh para pejabat senior; b. Pertukaran program dan kunjungan oleh pelatih , para ahli, spesialis, dan peneliti di bidang olahraga prestasi, olahraga masyarakat, ilmu olahraga, kedokteran olahraga dan hukum olahraga; c. Mendorong partisipasi dan pertukaran kegiatan olahraga termasuk pertandingan di perbatasan ; d. Mendorong kerjasam a antar organisasi olahraga yang terkait di kedua negara untuk memfasilitasi seminar, riset, lokakarya, dan konferensi; e. Pertukaran informasi, publikasi , data, dan bahan-bahan pengajaran tentang olahraga dan pendidikan jasmani sesuai dengan peraturan yang berlaku di kedua negara; f.
Kerjasama untuk meningkatkan prestasi olahraga di kedua negara, termasuk kamp pelatihan dan uji coba;
g. Mempromosikan dan membangun fasilitas olahraga , industri olahraga, dan olahraga tradisiona l; h. Menyelenggarakan kompetisi persahabatan dan pelatihan bersama untuk berbagai cabang olahraga, termasuk pertandingan perbatasan .
(3) Kegiatan-kegiatan kerjasama lain sebagaimana yang disepakati secara tertulis antara Para Pihak.
PASAL 3 HAK KEKA YAAN INTELEKTUAL
(1) Perlindungan hak kekayaan intelektual harus sesuai dengan peraturan
perundang-undangan dan aturan yang berlaku di masing-masing negara.

(2) Bila
pengaturan , program , atau proyek khusus dapat menghasilkan
kekayaan intelektual, maka Para Pihak harus menyertakan pengaturan terpisah sesuai dengan peraturan perundang-undangan mereka masingmasing.
PASAL4 KETE NTUAN KEUANGAN
Seluruh kegiatan kerjasama menurut MSP ini harus tergantung pada ketersediaan dana di masing-masing Pihak dan dana tersebut harus dianalisa dan disepakati bersama oleh Para Pihak.
PASAL 5 PELAKSANAAN
(1) Para Pihak harus sepakat untuk melaksanakan Memorandum Saling Pengertian ini melalui pembuatan pengaturan khusus dalam bentuk rencana kerja, program eksekutif, atau bentuk pengaturan lain yang disepakati bersama.
(2) Pengaturan tersebut harus ir:erinci, antara lain program dan kegiatan yang diusulkan, urusan keuangan, tanggung jawab Para Pihak yang
terliba~ ,
pertukaran informasi dan kerahasiaan , perlakuan kekayaan intelektual dan persoalan lain yang disepakati bersama.
PASAL 6 KERAHASIAAN
(1 ) Para Pihak harus berusaha rnenghormati kerahasiaan dan perahasiaan
dokumen, informasi dan data lain yang diperoleh atau diberikan oleh Pihak lain untuk pelaksanaan MSP ini;
(2) Jika salah satu Pihak ingin memberitahukan dokumen dan informasi
rahasia kepada pihak ketiga , maka Pihak tersebut harus mendapatkan izin tertulis dari Pihak lain;
(3) Para Pihak sepakat bahwa ketentuan-ketentuan pasal ini harus tetap
mengikat antara Para Pihak meskipun MSP ini berakhir.
PASAL 7 PENYELESAIAN PERSELISIHAN
Setiap perselisihan atau perbedaan yang timbul akibat penafsiran atau pelaksanaan MSP ini harus diselesaikan secara damai melalui konsultasi dan/atau negosiasi lewat jalur diplomatik antara Para Pihak.

PASAL 8 PEMBATASAN KEGIATAN PERSONIL
Masing-masing Pihak harus menjamin bahwa personilnya yang terlibat dalam kegiatan-kegiatan yang berkaitan dengan MSP ini harus menghormati kebebasan politik, kedaulatan , dan keutuhan wilayah negara tuan rumah dimana kegiatan-kegiatan tersebut berlangsung . Masing-masing Pihak juga harus sepakat untuk tidak mencampuri urusan dalam negeri negara tuan rumah dan menghindari segala kegiatan yang bertentangan dengan maksud dan tujuan Memorandum Saling Pengertian ini.
PASAL 9 AMAN DEM EN
MSP ini dapat ditinjau ulang atau diamandemen kapan saja atas persetujuan bersama secara tertulis oleh Para Pihak. Amandemen tersebut akan dimulai pada tanggal sebagaimana ditetapkan oleh Para Pihak dan merupakan bagian yang tak dapat dipisahkan dari MSP ini.
PASAL10 MULAI BERLAKU , JANGKA WAKTU , PENANGGUHAN DAN PENGAKHIRAN
(1) MSP ini harus mulai berlaku pad a tanggal penandatanganannya.
(2) MSP ini harus tetap berlaku untuk masa 5 (lima) tahun dan dapat
diperpanjang untuk masa 5 (lima) tahun berikutnya atas persetujuan bersama secara tertulis oleh Para Pihak.
(3) Salah
satu pihak dapat mengakhiri MSP ini kapan saja, dengan
memberikan pemberitahuan tertulis kepada Pihak lain akan niatnya untuk
mengakhiri MSP ini sekurang-kurangnya 6 (enam) bulan sebelum tanggal pengakhiran dimaksud .
(4) Pengakhiran MSP ini tidak harus mempengaruhi keabsahan dan jangka
waktu setiap pengaturan, program dan kegiatan yang dibuat menurut MSP ini hingga selesainya pengaturan , program dan/atau kegiatan tersebut, kecuali Para Pihak menyepakati hal-hal lain.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah menandatangani ! Memorandum Saling Pengertian ini.
DIBUAT dalam rangkap dua di .Dili pada .tanggal 26 Januari tahun 2016 dalam Bahasa Indonesia, Portugis, dan lnggris, semua naskah memiliki kekuatan hukum yang sama. Jika ada perselisihan atau perbedaan penafsiran , maka naskah berbahasa lnggris yang berlaku .

0 Ministerio da Juventude e Desporte da Republica da Indonesia e a Secretaria de Estado da Juventude e do Desporte da Republica Democratica de Timor-Leste e, doravante designadas conjuntamente coma as "Partes" e individualmente coma a "Parte";
DESEJANDO expandir, ainda mais , fortalecer e promover a amizade e cooperai;ao entre as Partes;
CONSIDERANDO, em especial, a necessidade de desenvolver e fomentar relai;oes estreitas nas areas da juventude e do desporto;
EM CONFORMIDADE com as leis e os regulamentos em vigor, bem coma as polfticas de seus respetivos Paises;
ACORDAM o seguinte:
ARTIGO 1 OBJECTIVOS DA COOPERACAO
Este Memorando de Entendimento (doravante designado por MdE) tern por
objetivo fortalecer ainda mais os

de amizade entre as Partes e promover
o desenvolvimento dos recursos humanos no domrnio da juventude e do desporto entre as partes com base na reciprocidade e na compreensao e beneficio mutuos.

ARTIGO 2

AREASDECOOPERACAO
As Partes acordam em cooperar nas seguintes areas: (1) Area da Juventude a.
lntercambio de visitas de jovens, funcionarios do governo responsaveis pela politica da juventude ou representantes de organiza96es da juventude;
b. Convites para a participa9ao em workshops, conferencias ou seminarios sobre questoes da juventude real izados em cada Pais; c. lntercambio de informa9oes em materia da juventude de acordo com as leis e os regulamentos em vigor, bem como com as politicas dos respetivos Paises ; d.
lncentivar a participa9ao em acampamentos de jovens, festivais de juventude, escotismo, e outros eventos de jovens em ambos os Parses;
e. Coopera9ao para o desenvolvimento nas areas da lideran9a, empreendedorismo, escutismo e desenvolvimento da juventude; f.
Coopera9ao no fornecimento de instala96es para a juventude;
g.
lncentivar o turismo para jovens como ferramenta para aumentar o entendimento comum entre ambas as Partes e para apoiar a Paz e refor9ar a amizad e;
h. Cooperar e incentivar a forma9ao basica para o desenvolvimento diario e o empreendedorismo entre ambas as Partes;
i.
lncentivar a coopera9ao para a promo9ao da toma de consciencia, protec;ao e controle dos perigos destrutivos para os jovens;
j.
Encorajar os valores humanos e espirituais entre os jovens.
(2) Materia do Desporto a. lntercambio e visitas de diretivos e outros tecnicos; b.
Programas de intercambio e visitas de treinadores , peritos, especialistas, bem como pesquisas na area de desportes competitivos, desporto para todos, ciencias do desporto, medicina desportiva e direito 11
desportivo;

incluindo os jogos de fronteira ; d. lncentivar a cooperac;ao entre as organizac;oes desportivas relevantes

ARTIGO 3 DIREITOS DE PROPRIEDADE INTELECTUAL
(1) A prote9ao dos direitos de propriedade intelectual deve estar em conformidade com as leis e regu lamentos de cada um dos respetivos Paises.
(2) No caso de acordos especificos, programas ou projetos dos quais possam resultar direitos de propriedade intelectual, as Partes deverao incluir um acordo separado que cumpra com as respetivas leis e regulamentos aplicaveis.
ARTIGO 4 ENCARGOS FINANCEIROS
Todas as atividades de coopera9ao no ambito deste Memorando de Entendimento estarao sujeitas
a
disponibilidade de fundos pelas Partes,
estando sujeitas a analise e mutuo acordo das Partes.
ARTIGO 5 IMPLEMENTACAO
(1) As Partes concordam em implementar este Memorando de Entendimento, atraves do desenvolvimento de Acordos especificos de lmplementa9ao, que poderao revestir a forma dos pianos de aQao, programas executivos , ou qualquer outra forma mutuamente acordada.
(2) Estos Acordos especificos de implementa9ao deverao incluir, inter alia, a proposta de programa , atividades a serem implementadas e questoes financeiras,
responsabilidades das Partes, intercambio de informa96es,
clausulas de confidencialidade e tratamento dos direitos de propriedade intelectual, bem como outras questoes acordadas pelas Partes.
ARTIG06 CONFIDENCIALIDADE
(1} As Partes comprometem-se a guardar a confidencialidade e sigilo de documentos, informacoes e outros dados recebidos pela outra Parte no ambito das atividades de implementa9ao deste Memorando de Entendimento; (2} Se uma das Partes tivesse a inten9ao de partilhar documentos e/ou i !
informa9oes confidenciais a uma terceira Parte, devera previamente ter o consentimento por escrito da outra Parte; (3) As Partes acordam que o disposto no presente artigo continuara a ser obrigat6rio entre as Partes ap6s a cessa9ao da vigencia deste Memorando de Entend imento.
ARTIGO 7 RESOLUCAO DE CONTROVERSIAS
Qualquer
controversia
ou
diferen9a
resultante
da
interpreta9ao
ou
implementa9ao do presente Memorando de Entendimento sera resolvida amigavelmente atraves de consultas e I ou negocia9oes, por via diplomatica, entre as partes.
ARTIGO 8 LIMITACAO DE A TIVIDADES DE PESSOAL
Cada Parte devera assegurar que o pessoal envolvido nas atividades relacionadas com o presente Memorando de Entendimento respeitara a independencia polltica, soberania e integridade territorial do Pais de acolhimento em que essas atividades ocorrem . Cada Parte devera tambem comprometer-se a nao interferir nos assuntos internos do Pais de acolhimento
e a evitar qualquer atividade incompativel com os fins e objetivos do presente Memorando de Entendimento.
ARTIGO 9 ALTERACOES
Este Memoranda de Entendimento podera ser revisto ou alterado a qualquer momenta por consentimento mutuo, por escrito, entre as Partes. Tais altera96es terao inicio na data em que for determinada pelas partes e constituira parte integrante do presente Memoranda de Entendimento.
ARTIGO 10 ENTRADA EM VIGOR , DURACAO, SUSPENSAO E CESSACAO DE EFEITOS
( 1) 0 presente Memoranda de Entendimento entrara em vigor na data da sua assinatura.
(2) Este Memoranda de Entendimento permanecera em vigor por um periodo de 5 (cinco) anos, podendo ser prorrogado por um novo periodo de 5 (cinco) anos, por mutuo consentimento escrito das Partes.
(3) Qualquer das Partes podera denunciar o presente Memoranda de Entendimento a qualquer momenta, mediante notifica9ao por escrito
a outra
Parte da sua inten9ao de denunciar o presente Memoranda de Entendimento, pelo menos 6 (seis) meses antes da data prevista do termino.
(4) A denuncia do presente Memoranda de Entendimento nao prejudica a validade e a dura9ao de qualquer acordo, programa e atividades feitas no ambito do presente Memoranda de Entendimento ate a conclusao do acordo, programa e I ou atividade, salvo se as Partes acordarem em contrario.

MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF YOUTH AND SPORTS OF THE REPUBLIC OF INDONESIA AND THE SECRETARIAT OF STATE FOR YOUTH AND SPORTS OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE ON YOUTH AND SPORTS COOPERATION
The Ministry of Youth and Sports of the Republic of Indonesia and the Secretariat of State for Youth and Sports of the Democratic Republic of TimorLeste, hereinafter referred to collectively as the "Parties" and individually as a "Party";
DESIRING to further expand , strengthen , and promote the friendship and cooperation between the Parties;
CONSIDERING in particular, the need to develop and foster close relations on youth and sports matters;
PURSUANT to the prevailing laws and regulations as well as policies of their respective countries ;
HAVE AGREED as follows :
ARTICLE 1 AIMS OF COOPERATION
This Memorandum of Understanding (hereinafter referred to as "MoU") aims to further strengthen the ties of friendship between the Parties and to promote human resources development in the field of youth and sports between the Parties on the basis of reciprocity, mutual understanding and benefit.
ARTICLE 2 FIELDS OF COOPERATION
The Parties agree to cooperate in the following areas: (1) Youth matters a. Exchange of visits by youth, government officials in charge of youth policy making or representatives of youth organizations; b. Extension of invitations to workshop , conferences, or seminars on youth issues held in each country; c. Exchange of information on youth matters pursuant to the prevailing laws and regulations as well as policies of the respective countries; d. Encouraging the participation in youth camps, youth festival , scouting , and other youth events in both countries; e. Cooperation of development in the areas of pioneering , leadership, entrepreneurship, scouting, and youth development; f. Cooperation in providing youth facil ities; g. Encouraging youth tourism as a tool to increase common understanding on both Parties supporting peace and strengthening friendship ; h. Encouraging cooperation on life skills and entrepreneurship between both Parties;
i. Encouraging cooperation in awareness, protection , and control of destructive danger among youth ; j . Encouraging human and spiritual values among youth .
(2) Sports matters
a. Exchange of visits of senior officials; b. Exchange programs and visits by coaches, experts, specialists, and researches in the field of competitive sports, sports for all, sports sciences, sports medicines, and sports law; c. Encouraging the participation and exchange of sporting events including border games; d. Encouraging cooperation between the relevant sports organizations of the two countries to facilitate seminars, researches, workshops, and conferences; e. Exchange of information, publication , data, and teaching materials on sports and physical education in accordance with the laws in force in both countries; f. Cooperation to improve 'sports achievement of the two countries, including training camp and try out; g. Promoting and developing sports facilities,
sports industry, and
traditional sports; h. Organizing friendly competition and joint training of various sports, including border games.
(3)
Such other cooperative activities as may be agreed upon in writing between the Parties.
ARTICLE 3 INTELLECTUAL PROPERTY RIGHTS
(1)
The protection of intellectual property rights shall be in accordance with the prevailing laws and regulations of their respective countries.
(2)
In case specific arrangement, programs or projects may result in intellectual property, the Parties shall include any separate arrangement in accordance with their respective laws and regulations.

ARTICLE 8 LIMITATION OF ACTIVITIES OF PERSONNEL I
'
Each Party shall assure that its personnel involved in the activities related to this MoU will respect the political independence, sovereignty, and territorial integrity of the host country in which such activities take place. Each Party also shall agree not to interfere in the internal affairs of the host country and to avoid any activity inconsistent with the purposes and objectives of this MoU.
ARTICLE 9 AMENDMENTS 1¥ I

This MoU may be reviewed or amended at any time by mutual written consent

of the Parties. Such amendments will commence on such date as may be determined by the Parties and will constitute an integral part of this MoU .

ARTICLE 10 ENTRY INTO FORCE, DURATION, SUSPENSION AND TERMINATION l
(1)
This MoU shall enter into force on the date of its signing.
(2)
This MoU shall remain in force for a period of 5 (five) years and may be extended for another period of 5 (five) years by mutual written consent of the Parties.

Either Party may terminate this MoU at any time, by giving written

notification to the other Party of its intention to terminate this MoU at least 6 (six) months prior to the intended date of termination. The termination of the present MoU shall not affect the validity and

duration of any arrangement, program and activity made under the present MoU until the completion of such arrangements, program and/or , activities, unless the Parties agree otherwise.
