Pertama-tama memanjatkan puji syukur kehadirat Allah SWT yang telah memberi kemampuan bagi para peserta delegasi untuk melakukan kunjungan Study banding dibidang hukum ke Pengadilan Administrasi Thailand di Kota Bangkok hingga pembuatan laporan hasil study banding ini. Selanjutnya mengucapkan terimakasih kepada Pimpinan Mahkamah Agung Rl yang telah memberi kesempatan dan anggaran bagi para peserta sehingga para peserta berkesempatan untuk mendapatkan pengalaman yang sangat berharga serta bermanfaat untuk mendukung pelaksanaan tugas peradilan. Study banding telah dilaksanakan pada Mahkamah Agung Peradilan Umum dan Pengadilan Administrasi Tingkat Pertama maupun Mahkamah Agung Peradilan Administrasi yang masing-masing berkedudukan di Kota Bangkok. Sasaran study banding terutama untuk mendapatkan bahan-bahan hukum guna memahami sistem peradilan di Thailan terutama Peradilan Administrasi. Metode mendapatkan bahan-bahan hukum dilakukan dengan cara wawancara kepada para pejabat Peradilan seperti Ketua Mahkamah Agung dan para hakim baik di tingkat pertama maupun para hakim agung. Selain itu bahanbahan hukum juga diperoleh dari dokumen-dokumen tertulis berupa buku dan peraturan perundangan Thailand yang berkaitan dengan Peradilan. Bahan-bahan hukum terse but telah dijadikan sebagai sumber hukum dalam pembuatan laporan ini. Disadari bahwa isi laporan Study banding ini adalah sangat terbatas terutama karena hanya terfokus pada jajaran Peradilan Administrasi. Sorotan utama pada peradilan Administrasi adalah mengenai kompetensi peradilan dan wewenang hakim dalam memeriksa perkara serta pelaksanaan putusan pengadilan administrasi. Hal ini dipandang sangat diperlukan dalam rangka pemberdayaan dan pengembangan Peradilan Administrasi di Indonesia terutama dalam menyongsong era undang-undang Administrasi Pemerintahan yang sedang dirancang oleh Pemerintah. Dengan menyadari keterbatasan hasil study banding ini, maka para delegasi yang telah menyusun laporan ini mengharapkan berbagai kritikan positif dari para pembaca yang budiman. Akhimya para delegasi berharap kiranya laporan ini dapat memberi manfaat untuk pengembangan hukum di Indonesia, khususnya yang berkaitan dengan pengembangan Peradilan Administrasi. Demikian laporan singkat ini disusun sebagai wujud tanggungjawab para delegasi yang telah menggunakan anggaran negara selama menjalankan tugas study banding. HASIL STUDY BANDING KE PERADILAN ADMINISTRASI THAILAND (THAILAND ADMINISTRATIVE COURT)
I.
Pembentukan dan Struktur Peradilan Administrasi di Thailand. 1. Sekilas sejarah Pembentukan Peradilan Administrasi Meskipun Peradilan Administrasi di Thailan baru dibentuk pada tahun 2001, akan tetapi keberadaannya telah ada sejak lama. Keberadaan Peradilan tersebut dapat ditelusuri sejak tahun 1874 sebagai berikut: a. Fase pertama dimulai sejak tanggal 14 Juni 1874 (BE. 2417), yaitu ketika Raja yang bernama CHULALONGKORN membentuk Undang-undang tentang Counsil of State yaitu selaku badan penasehat dibidang administrasi public dan perancangan undang-undang. Badan ini yang bertanggungjawab untuk memeriksa keberatan-keberatan masayarakat. Council of State ini mirip dengan organisasi yang dikenal dengan Conseil d'Etat di Perancis maupun di Negara lain yang menganut System Civil Law seperti Nederland, Belgia, Luxemburg, Itali, Mesir, Yunani, Tunisia dan Colombia. Tugas dan kewenangan Cuoncil of State yang didirikan tahun 1874 saat ini telah dijalankan oleh Peradilan Administrasi. b. Fase kedua yaitu mas a setelah peralihan regim Monarkhi Absolut menjadi Monarkhi Konstitusional pada tahun 1932. Masa ini diprakarsai oleh PROF. DR. PRiDI PHANOMYONG. Awalnya pemerintah mengembangkan kebijakannya untuk mendirikan suatu organisasi yang bertugas selaku penasehat bagi pemerintah dan mempunyai kekuasaan yang sama dengan Council of State dalam lingkungan bidang peradilan sipil. Badan ini delengkapi dengan Undang-undang tentang Council of State Tahun 1933 (BE 2476). Undang-undang ini telah mewajibkan pemisahan ketentuan untuk menentukan tipe kasus administrasi dengan prosedur administrasi yang belum ditangani. Kekurangan disini karena Council of State yang baru dibentuk hanya berfungsi selaku lembaga konsultasi hukum bagi eksekutif sehingga tidak dapat melakukan fungsi peradilan/judisial atau berbagai us aha penerapan hukum menyangkut tugas judisial. Namun kemudian pada tahun 1949 Undang-undang tentang Petisi Council (Petition Council Act) telah diberlakukan untuk menguji penyalahgunaan wewenang pejabat pemerintahan yang merugikan masyarakat. Akan tetapi undang-undang ini juga tidak sepenuhnya berhasil mengatasi persoalan meskipun telah diikuti dengan pembentukan lembaga Tribunal sebagai lembaga yang menangani prosedur administrasi. c. Fase ketiga pada tahun 1979 ketika PROF DR.AMORN CHANDARASOMBOON, sebagai Sekretaris Jenderal Counsil State memberi pandangan bahwa membangun peradilan administrasi tanpa mempersiapkan sistem administrasi peradilan dan personil yang siap pakai serta dengan dukungan peralatan hanyalah mengulangi kegagalan pada masa yang lalu. Sehingga reforrnasi hukum -pada Council of State akan tercapai dengan cara menggabungkan Law Drafting Council

dibawah undang-undang Council of State Act 1933 (BE. 2476) dengan Tribunal dibawah undang-undang tentang Petition Council Act 1949 (BE.2492). Ketentuan baru ini disebut dengan Council of State Act 1979 (BE.1979). Pada Council of State 1979 ini terbentuk dua badan yang disebut Law Drafting Council dan Petition Council. Law Drafting Council ini diberi missi judicial, sedangkan Petition Council adalah sebagai alat untuk menentukan prinsip hukum administrasi mana yang akan dikembangkan. Hal ini diharapkan sebagai suatu progres agar Petition Council memimpin pembentukan lembaga peradilan administrasi. Sehingga dapat dikatakan bahwa peradilan administrasi memperoleh wjudnya selama periode yang diilhami oleh Petition Council. Berbagai dukungan dari kalangan administrasi telah mendorong pengembangan Petition Council menjadi Peradilan administrasi yang juga hams diatur dalam konstitusi, yang akhirnya ditentukan pertama kalinya pada Charter tahun 1974. d. Fase keempat yaitu setelah rencana amandemen konstitusi yang kelima pada tahun 1995. Dalam konsep amandemen konstitusi ini telah dinyatakan bahwa peradilan administrasi menganut dual system peradilan. Pada akhirnya dalam Konstitusi tahun 1997 secara tegas telah ditentukan adanya peradilan administrasi. Inilah yang dipandang sebagai awal berdirinya peradilan administrasi yang berdiri sendiri terpisah dari peradilan lainnya. Selanjutnya pada tahun 1999 (B.E.2542) dibentuk Undang-undang Peradilan Administrasi dan Peradilan Prosedur Administrasi. Pada tanggal 9 Maret 2001 (BE 2544) diresmikanlah pendirian Supreme Admimnsitrative Court dan Central Administrative Court. 2. Landasan Hukum Pembentukan Peradilan Administrasi. Landasan Hukum Pembentukan Peradilan Administrasi di Thailand didasarkan pada; - Konstitusi Kerajaan Thailand (Constitution of The Kingdom of Thailand) B.E. 2540 (Tahun 1997) : Articel 276 - 280. - Konstitusi Kerajaan Thailand (Constitution of The Kingdom of Thailand) B.E. 2550 (Tahun 2007): Article 223 - 227. - Undang-undang Pembentukan Peradilan Administrasi dan Acara Peradilan Administrasi (Act on Establisment of Administrative Court and Administrative Procedure) B.E. 2542 (Tahun 1999) 3. Struktur Peradilan Berdasarkan di Thailand peradilannya sendiri. Ada

Konstitusi Kerajaan Thailand B.E. 2540 (Tahun 1997) peradilan menganut Multy Cuort System dimana masing-masing badan berpuncak pada Mahkamah Agung yang masing-masing berdiri empat Badan Peradilan yakni :

Judisial Court (Peradilan Umum) terdiri dari tiga tingkatan: ~ Supreme Court (Mahkamah Agung) sebagai peradilan Kasasi. ~ Court of Appeals (Pengadilan Tinggi) sebagai peradilan banding ~ Court of first Instance sebagai peradilan Tingkat pertama Perlu dicatat bahwa pada peradilan tingkat pertama terdapat beberapa kamarlbidang, seperti Civil Court, Criminal Court dan Juvenile and Family Court. Selain itu ada juga beberapa peradilan khusus yakni Labor Court, Tax Court, Intelectual Property and International Trade Court serta Bankruptcy Court. c. Administrative Court (Peradilan
Administrasi) terdiri dari dua tingkatan: (Mahkamah Agung Peradilan Administrasi) sebagai peradilan tingkat kasasi. I ~ Administrative Court of First Instance (sebagai tingkat pertama). Ada dua macam sebutan Peradilan tingkat pertama. Yang pertama yaitu Central Administrative Court yang hanya ada dan berkedudukan di Bangkok. Jenis yang kedua yakni Regional Administrative Court yang berkedudukan masing-masing di ibu kota provinsi selain Bangkok. Regional administrative Court ini ada di 7 provinsi yaitu masing-masing: Chiang Mai AC, Nakhon Ratchasima AC, Khon Kaen AC, Phitsanuluk AC, Rayong AC, Nakhon Si Thammarat AC dan Sangkhla AC.

Militery Court (Peradilan Militer) terdiri dari tiga tingkatan: ~ Supreme Militery Court (Mahkamah Agung Peradilan Militer) sebagai peradilan kasasi. ~ Central Militery Court (Pengadilan Tinggi Militer) sebagai peradilan banding ~ Militery Court of First Innstance sebagai peradilan tingkat pertama Militer. 1. Berdasarkan pasal 9 Undang-undang Peradilan Administrasi Thailand Tahun 1999 (Act on Establishment of Administrative Court and Administrative Court Procedure B.E.2542 (1999), dapat ditentukan kompetensinya yaitu memeriksa dan mengadili atau memerintahkanl menetapkan (order) menyangkut hal-hal sebagai berikut: a.

Penerbitan suatu keputusanlkebijakan (issuance of a rule) atau perintah (order) atau berkenaan dengan tindakan lainnya tanpa kewenangan atau melampaui batas kewenangan (Without or beyond the scope of power and duties), atau Tidak konsisten terhadap hukum (inconsistence with the law) atau bentuk (the form) atau proses (process) yang dipersyaratkan untuk itu, atau Tidak dipercaya (bad faith), atau Ada indikasi diskriminatif (indicating unfair discrimination), atau Melakukan ketidak pastian proses (Unnecessery process), atau Merugikan publik (excessive burden to the publik), atau sekelompok orang atau Melakukan ketidak pantasan dalam pembuatan suatu keputusan (undue exercise of discretion).
b. Sengketa yang berkaitan dengan tindakan yang dilakukan pejabat pemerintahan atau pegawai pemerintahan yang melalaikan tugasnya (neglecting official duties) yang seharusnya dilakukan sesuai yang ditentukan hukum yang berlaku, atau melakukan penundaan pelaksanaan tugasnya dengan tidak masuk akal (unreasonable delay) c.
Sengketa yang berkaitan dengan tindakan yang salah/melanggar hukum (wrongful) atau berkenaan dengan suatu tanggung jawab (liabilities) dari pejabat pemerintahan atau pegawai pemerintahan yang timbul akibat penggunaan kewenangan menurut hukum (under the law or from a law), perintah/keputusan administratif atau perintah lain, atau atas kelalaian pelaksanaan tugasnya yang menurut ketentuan seharusnya dilakukan, atau melakukan penundaan tugasnya tanpa suatu alasan yang masuk akal (unreasonable delay). d. Sengketa yang berkaitan dengan kontrak administrasi (administrative contract) e. Sengketa yang ditentukan oleh hukum untuk diajukan ke peradilan oleh instansi pemerintah atau pegawai pemerintah atas pemberian mandat kepada seseorang untuk melakukan atau tidak melakukan suatu tindakan tertentu. f Sengketa yang menu rut hukum yang berlaku ditentukan sebagai kewenangan peradilan administrasi.
Article 3 of Act on Establehment of Administrative Court and Administrative Court Procedure, B.E. 2542 (1999). Administrative Agency means a Ministry, Sub Ministry, Department, Government agency called by ather names and ascribed the status as a Department, provincial administration, State enterprise established by an Act or Royal decree or other State agency and shall include an agency entrusted to exercise the administrative power or carry out administrative acts. 3 Ibid. 2. Tidak termasuk kompetensi Peradilan Administrasi yaitu : a. Tindakan yang berkaitan dengan disiplin militer b. Tindakan yang dilakukan Komisi judisial sesuai dengan ketentuan tentang komisi judisial c, Sengketa menyangkut kompetensi peradilan anak dan peradilan keluarga (Juvenile and Family Court), peradilan perburuhan (Labor Court), peradilan pajak (Tax Court), peradilan hak inteklektual dan perdagangan Internasional (lntelectual Property and International Trade Court) , peradilan kepailitan (Bankruptcy Court) dan peradilan khusus lainnya. 3
Kompetensi Peradilan Administrasi sebagi tingkat pertama Pengadilan administrasi pada tingkat pertama berwenang untuk memeriksa dan mengadili semua sengketa yang termasuk kompetensi Peradilan administrasi, kecuali yang seharusnya menjadi kompetensi Supreme Administrative Court (Mahkamah Agung Peradilan Administrasi).
4. Kompetensi Supreme Administrative Court (Mahkamah Agung). Mahkamah Agung Peradilan Administrasi berwenang memeriksa dan mengadili: ~ Sengketa yang berkaitan dengan putusan komisi quasi peradilan (quasi judicial commissions" sebagaimana yang ditetapkan (prescribed) oleh Majelis Umum Hakim Mahkamah Agung Administrasi (General Assembly of the Judges of the Supreme Administrative Cour) ~ Sengketa yang berkaitan dengan legalitas Keputusan Raja (Royal Decree) atau keputusan-keputusan (By-Law issuedf dari Lembaga Kementerian (Council of Minister) atau persetujuan Lembaga Kementerian (approval of Council Minister) ~ Sengketa yang ditentukan oleh undang-undang menjadi kewenangan Supreme Administrative Court. ~ Sengketa kasasi yang dilakukan atas putusan atau perintahlpenetapan (order) Pengadilan Administrasi tingkat pertama. III.
Hakim Peradilan Administrasi. Persyaratan sebagai hakim Peradilan Administrasi maupun menyangkut hakhak dan kewajibannya secara rinci telah ditentukan dalam Undang-undang Peradilan Administrasi Thailand yang diatur dalam dalam Bab II mulai dari pasal 12 sd. Pasal 34. Mengamati pasal-pasal tersebut dapat dijelaskan sebagai berikut: 1. Penentuan jabatan Ketua, Wakil Ketua dan Ketua Majelis Jabatan hakim pada Supreme Court maupun pada Pengadilan Administrasi Tingkat pertama terdiri dari jabatan: President (Ketua), Vice of

Presidents Wakil Ketua), Presidents of Chamber (Ketua Majelis), dan Judges (Para Hakim anggota). Penentuan Jabatan Ketua,Wakil Ketua dan Ketua Majelis dilakukan dengan prosedur yang sarna baik untuk Supreme Court maupun untuk tingkat pertama. Ketentuan mengenai Prosedur seleksi ditentukan oleh J.c.A.C dengan disetujui oleh Majelis lengkap Supreme Administrative Couurt. Cara seleksi untuk memilih jabatan-jabatan terse but dipilih dari antara seluruh Hakim. Setelah nama calon ditentukan, selanjutnya nama tersebut diajukan kepada Perdana Menteri. Perdana Menteri harus melakukan persetujuannya paling lama dalam jangka waktu 15 hari. Atas persetujuan Perdana Menteri tersebut nama calon diajukan kepada Raja untuk selanjutnya ditetapkan dalam jabatan tersebut. 2. Seleksi untuk diangkat jadi Hakim. Baik hakim Supreme maupun Hakim Tingkat pertama dipilih oleh Komisi Yudisial (Judicial Commission of Administrative Court =JCA.C) dengan disetujui Parlemen (House of Representative and Senate). Namun dengan adanya perubahan Konstitusi Kerajaan Thailand BE. 2550 (2007), dalam pasal 224 ditentukan bahwa pengangkatan Hakim pada semua tingkatan Peradilan Administrasi cukup dilakukan oleh J.C.A.C tanpa memerlukan persetujuan Parlemen. 3. Syarat menjadi Hakim pada Supreme Administrative Court Rekrut Hakim Peradilan Administrasi di Thailand pada dasamya bukanlah hakim karier, karena mereka selain yang berlatar belakang pemah sebagai hakim, mereka dapat juga direkrut dari otrang yang berlatar belang dan mempunyai keahlian hukum, ilmu politik, publik administrasi, ekonomi, ilmu so sial atau berasal dari pegawai pemerintah yang ditentukan oleh C.J.A.C. Syarat lain yang ditentukan adalah Warga negara Thailan, berusia serendah-rendahnya 45 Tahun, serta mempunyai latar belakang atau pengalaman salah satu atau lebih sebagai berikut: ~ Pemah menjadi Law Councilor, Petition Councilor atau Councilor of State. ~ Pemah menduduki jabatan hakim yang jabatannya tidak lebih rendah dari Ketua Majelis pada Pengadilan Administrasi Tingkat pertama. ~ Pemah menduduki jabatan yang tidak lebih rendah dari jabatan Judge of Supreme Court of Justice atau yang setara dengan itu atau sebagai hakim pada Supreme Military Court. ~ Pemah menduduki jabatan yang tidak lebih rendah dari jabatan Kepala Kejaksaan (Regional Chief Publik Prosecutor) atau jabatan lain yang setara dengan itu. ~ Pemah menduduki jabatan yang tidak lebih rendah dari jabatan Direktur Jenderal atau yang setara dengan itu pada lembaga pemerintahan yang ditentukan oleh J.C.A.C. ~ Seorang yang berpendidikan tinggi dan bergelar Professor yang pemah menduduki jabatan dosen pada perguruan tunggi dibidang hukum, ilmu politik, public administrasi, ekonomi, pengetahuan sosial yang relevan dengan urusan administrasi pemerintahan. ~ Pemah menjadi Pengacara (Lawyer) yang berpengalaman menangani kasusu-kasus administrasi yang lamanya tidak kurang dari dua puluh tahun dengan persyaratan yang ditentukan oleh C.lA.C.

Para calon tersebut selajutnya dipilih oleh C.J.A.C yang dibuat dalam suatu daftar nama-nama calon dan diajukan kepada Perdana Menteri (Prime Minister). Setelah daftar calon tersebut diterima selanjutnya paling lama dalam waktu 15 hari harus menentukan persetujuannya dan mengajukan kepada Raja untuk dipertimbangkan dan ditunjuk. 4. Syarat menjadi Hakim Pengadilan Administrasi Tingkat pertama: Rekrut Hakim administrasi pada tingkat pertama juga dilakukan oleh C.J.A.C. Persyaratan yang ditentukan undang-undang sebagai nberikut: a. b. c.

Warga Negara Thailand Berusia serendah-rendahnya 35 Tahun Mempunyai pengalaman dibidang hukum, ilmu politik, Publik administrasi, ekonomi pengetahuan sosial atau administrasi pemerintahan pada bidang yang ditentukan oleh C.J.A.C. Pemah berpengalaman pada salah satu atau lebih dari hal-hal sebagai berikut: • Sebagai petition commissioner atau sekretaris pada Law Councilor pada kantor Councilor State paling sedikit 3 tahun. • Berpengalaman paling sedikit 3 tahun pada kantor sengketa administrasi yang klasnya ditentuklan oleh J.C.A.C. • Berpengalaman paling sedikit 3 tahun sebagai hakim pengadilan perdata perdata atau hakim pada pengadilan pidana atau hakim pada pengadilan militer • Berpengalaman paling sedikit tiga tahun sebagai jaksa atau yang setara dengan itu pada Kejaksaan di tingkat Privinsi. • Berpengalaman paling sedikit 3 tahun sebagai pegawai pemerintah serendah-rendahnya pangkat tertentu yang ditentukan C.J.A.C • Pemah menjadi dosen dibidang hukum, ilmu politik, public administrasi, ekonomi, ilmu social yang berkaitan dengan administrasi bidang pemerintahan pada perguruan tinggi dan memperoleh posisi paling rendah sebagai Assosiate Professor paling sedikit tiga tahun, • Memperoleh ijajah Master dalam bidang Hukum Publik dan bekerja dalam bidang pemerintahan paling sedikit sepuluh tahun sejak memperoleh Master. Aatu berijajah Doktor dan pemah bekerja paling sedikit 6 tahun sejak mendapat ijajah doktor. • Pemah menjadi Pengacara paling sedikit 12 tahun dan berpengalaman menangani kasus-kasus administrasi sesuai dengan persyaratan yang ditentukan oleh C.J.A.C.
Selanjutnya prosedur seleksi dan pengusulannya sarna dengan prosedur seleksi dan pengajuan Hakim pada Supreme Addministrative Court.

5. Gaji dan tunjangan Hakim Besaran Gaji Hakim di Thailan ditentukan dengan pengaturan level penggajian. Posisi level Penggajian ini telah ditentukan dalam undang-undang Peradilan Administrasi, Seperti misalnya level gaji seorang Ketua Supreme Court berada lada level 4 yaitu gaji sebesar 69.220 Bath, tunjangan sebesar 50.000 Bath. Sedangkan Wakil Ketua, Ketua Majelis dan Hakim Anggota pada Supreme maupun Ketua Pengadilan Tingkat pertama pada Level 3 yaitu gaji sebesar 67.060 Bath, tunjangan sebesar 42.500 Bath. Selanjutnya Gaji Wakil Ketua, Ketua Majelis dan Hakim anggota pada Pengadilan tingkat pertama digaji berdasarkan level gaji antara level 2 hingga level 3. Gaji untuk hakim pada level 2 sebesar 63.920 Bath, sedangkan tunjangannya sebesar 41.500 Bath. Penentuan besaran gaji dan tunjangan hakim ini adalah berdasarkan Tabel Gaji Bagi Hakim Peradilan Administrasi yang 7 diberlakukan sejak tanggal I Oktober 2005. 6. Masa kerja dan Pensiun Hakim. Seseorang untuk dapat diangkat menjadi Hakim pad a Supreme Administrative Court haruslah memenuhi syarat usia serendah-rendahnya 45 tahun. Sedangkan pada Administrative Court of First Instance (Tingkat pertama) serendah-rendahnya usia 35 tahun. Usia pensiun bagi hakim Supreme maupun tingkat pertama adalah 65 tahun , akan tetapi bila kesehatannya memungkinkan dapat diperpanjang hingga 70 tahun. Ketentuan mengenai pemeriksaan kesehatan dan perpanjangan usia diatur oleh J.C.A.C dengan disetujui oleh Majelis Umum Supreme Administrative Court. Ada juga hal menarik, dimana pakaian seragam dan penggunaannya, serta penentuan hari kerja, jam kerja, hari libur kantor dan mengenai absensi hakim semuanya telah ditetapkan dalam peraturan yang dibuat oleh J.A.A.C. IV.
Komisi Judisial (Judicial Commission) Di Thailand, masing-masing badan peradilan mempunyai Komisi Judisial sendiri-sendiri. Komisi judisial untuk Peradilan Administrasi dinamakan Judicial Commision of Administrative Court (disingkat J.C.A.C). Komposisi Komisi Judisial terdiri dari 13 orang yaitu: a. Presiden Supreme Administrative Court otomatis sebagai Ketuanya. b. 6 orang dari Hakim Agung. c. 3 orang dari Hakim tingkat pertama d. 2 orang yang dipilih oleh Senat

Penentuan Hakim Agung dan Hakim tingkat pertama untuk menjadi anggota Komisi Judisial dilakukan melalui pemilihan yang dilakukan oleh sebuah panitia yang bersifat langsung bebas dan rahasia. Panitia ini terdiri dari Sekretaris Jenderal Supreme Administrative Court, tiga orang dari kalangan hakim administrasi serta tiga orang pimpinan Fakultas Hukum/Dekan (Dean) perguruan tinggi pemerintah yang ditentukan oleh Ketua Mahkamah Agung (President of Supreme AC). Penanggungjawab pelaksanaan pemelihan berada pada Ketua Mahkamah Agung Administrasi. Masa kerja Komisi Judisial adalah dua tahun, akan tetapi masih dapat dipilih kembali dan maksimum untuk dua periode. Bila ada anggota Komisi judicial yang berhenti sebelum masa periodenya berakhir , maka ia akan diganti dengan cara pemilihan yang sarna, kecualai masa tugasnya hanya tinggal 90 hari lagi. Tugas Komosi Judisial a. Mengadakan seleksi terhadap Calon Hakim Agung dan mengajukannya kepada Perdana Meneteri untuk mendapat persetujuan Senat dan penetapan Raja. b. Memilih diantara Hakim Agung untuk menjadi President Of Supreme Administrative Court (Ketua MA) dan mengajukan kepada Perdana Menteri untuk mendapat persetujuan Senat dan penetapan Raja. c. Memilih diantara Hakim Agung untuk diusulkan menjadi Wakil Ketua MA dan untuk menjadi Ketua Majelis MA serta mengajukan kepada Perdana Menteri untuk selanjutnya mendapat penetapan Raja. d. Mengadakan seleksi calon hakim untuk dipilih menjadi Hakim tingkat pertama dan mengajukan kepada Perdana Menteri untuk selanjutnya ditunjuk oleh Raja e. Memilih diantara Hakim tingkat I untuk diusulkan menjadi Ketua, Wakul Ketua dan Ketua Majelis serta mengajukan kepada Perdana Menteri untuk ditetapkan oleh Raja. f. Menetapkan Kode Etik Hakim g. Menbentuk Komite pemeriksa hakim yang dianggap melakukan pelanggaran etik hakim. (komite mana terdiri dari empat orang hakim dan seorang pegawai Civil Service). h. Mengusulkan pemberhentian Hakim yang berdarakan periksaan Komite Pemeriksa dipandang bahwa yang bersangkutan telah terbukti melalaikan tugasnya atau melanggar etik hakim, atau mengalami sakit yang permanen atau dihukum pidana dipenjara akibat kejahatan yang dilakukan dengan sengaja. 1. Memberi persetujuan permutasianjabatan hakim. J. Mengadakan seleksi atas hakim yang perlu perpanjangan USIa pensiunnya hingga 70 tahun. k. Membuat berbagai aturan berkenaan dengan hakim seperti pengaturan pakaian seragam, pengaturan jam kerja, pembuatan kode etik hakim, ketentuanketentuan menganai pegawai yang membantu persidangan (admistrative case official) dan berbagai hallainnya.

Sekretaris Jenderal Peradilan Administrasi Sekretaris Jenderal pada peradilan administrasi di Thailand merupakan institusi yang indevenden yang bertugas dan bertanggungjawab untuk melakukan tugas-tugas kesekretariatan. Yang menjabat Sekretaris Jenderal haruslah berlatar belakang pendidikan nhukum. Sekretariat Jenderal bertugas selain menangani hal yang berkaitan dengan kesekretariatan juga: -

Melakukan kegiatan administyrasi kesekretariatan Melakukan kegiatan yang berkaitan dengan administrasi perkara, Melakukan eksekusi atas putusan pengadilan administrasi. Mengumpul dan mempelajari berbagai imformasi yang berkaitan dengan penagnan perkara Menganalis perkara yang masuk ke pengadilan guna memberi saran kepada pemerintah untuk perbaikan pemerintahan Mempublikasikan putusan atau penetapan pengadilan Mengadakan pelatihan hakim, kepada pegawai kesekretariatan. Bahkan dengan koordinasi sebelumnya pelatihan juga dapat dilakukan kepada pegawai lain diluar peradilan guna pengembangan prinsip-prinsip hukum publik dan huum adminstrasi Menunjuk pegawai (adminitrative case official) untuk membantu hakim raporteur (judge- raporteur) dalam persidangan perkara.
Contemtp of Court. Pengadilan Admistrasi berwenang untuk menetapkan ketentuan/persyaratan bagi pihak yang bersengketa atau siapapun yang hadir di pengadilan, yang oleh pengadilan menganggap perlu guna memelihara ketertiban, keterbukaan dan kelancaran persidangan sengketa-sengketa administrasi. Kewenangan pengadilan disini termasuk juga melarang para pihak yang bersengketa untuk bersikap sembrono (pursuing frivolous), memperlambat persidangan atau bersikap berlebihan (delatory or superfluous proceedings). Pelanggaran atas ketentuan yang ditetapkan pengadilan tersebut dianggap sebagai perbuatan yang merendahkan pengadilan (contemtp of court). Atas pelanggaran tersebur pengadilan berwenang untuk: - Memberi peringatan baik tertulis atau tidak tertulis (warming wiht or without written reproach). - Memerintahkan keluar dari ruang persidangan (expelling from the Court's precinct) - Menjatuhkan hukuman penjara (inflicting imprisonment) dengan waktu yang tidak lebih dari satu bulan atau denda (fine) tidak lebih dari lima puluh ribu bath. Penjatuhan hukuman pejara haruslah dilakukan oleh majelis hakim yang lain dari majelis yang menangani kasus yang bersangkutan." Akan tetapi bagi orang yang mengkritisi persidangan atau peradilan dengan etikat baik dan dengan alasan akademik (academic means) tidak dapat dihukum dan juga tidak dapat dinyatakan menista pengadilan atau hakim.
Ketentuan menganai pemberlakuan contempt of court ini diatur dalam Hukum Acara Perdata (Civil procedure code) akan tetapi berdasarkan Article 64 dari Act of AC and AC Procedure dinyatakan berlaku secara mutatis mutandis. 8

Pengajuan (hearing).
Gugatan
(Filling Administrative
Case) dan Pemeriksaan
Perkara
1. Pihak yang dapat mengajukan gugatan adalah : ~ setiap orang yang dirugikan atau ~ yang kerugiannya tidak dapat dihindari (any person who is aggrieved or injured or who may inevitably be aggrieved) akibat suatu tindakan atau pengabaian yang dilakukan oleh pejabat administrasi atau pegawai pemerintahan, atau ~ pihak yang mempunyai perselisihan berkaitan dengan kontrak administrasi atau persoalan-persoalan lainnya. 2. Gugatan dan surat-surat lain harus tertulis. Gugatan maupun dokumen-dokumen lain yang diajukan ke pengadilan haruslah tertulis dan dengan bahasa Tahiland. Apabila pengadilan mengijinkan dokumen tidak tertulis (made orally) maka hal itu harus diresume dalam berita acara (shall write down the statemen' in the memorandum of proceeding). Pengajuan gugatan dapat juga dikuasakan kepada orang lain dengan surat kuasa tertulis, dapat diantar langsung (by handing) ke pengadilan atau via post dengan surat tercatat (by registered post). 3. Syarat formal suatu gugatan haris berisi: a. Nama dan alamat penggugat b. Nama pejabat pemerintahan (name of the administrative agency) yang menerbitkan keputusan yang disengketakan c. Semua perbuatan yang relevan dijadikan sebagai fakta (all acts constituting the couse of action as well as necessary facts) d. Gambaran permintaan yang diharapkan penggugat (the relief sought by the planintiff). e. Gugatan harus ditandatangan oleh penggugat. Jika diberi kuasa kepada orang lain, haruslah dilengkapi dengan surat kuasa. Apabila persyaratan tersebut diatas tidak dipenuhi, maka Sekretaris jenderal dapat memberi nasihat agar hal itu diperbaiki 4. Kompetensi relatif pengadilan. Gugatan haruslah diajukan ke pengadilan yang wilayah hukumnya meliputi domisili penggugat atau ke pengadilan dimana akibat yang ditimbulkan perbutan pejabat itu terjadi (the cause of action has arisen). Dalam hal suatu pengadilan menganggap bahwa gugatan tersebut tidak termasuk dalam kompetensi relatifnya, maka gugatan terse but dapat diteruskan ke pengadilan yang dianggapnya kompeten. Akan tetapi bila pengadilan yang terakhir ini juga merasa tidak berwenang, persoalan ini langsung diajukan ke Mahklamah Agung untuk diputus. 5. Tenggang waktu Pengajuan gugatan Gugatan dapat diajukan dalam tenggang waktu 90 (sembilan puluh hari) sejak penggugat mengetahui atau seharusnya mengetahui akibat

tindakan pejabat. Atau bilamana sipejabat tidak menjawab/memberi penjelasan atas permohonan tertulis yang diajukan penggugat, maka gugatan dapat diajukan setelah lewat 90 (sembi Ian puluh) hari sejak permohonannya diajukan. Akan tetapi apabila sengketa tersebut akibat perbuatan terguagat yang melanggar undang-undang atau karena kelalaiannya atau menunda melakukan pelayanan dengan tidak masuk akal atau yang berkenaan dengan kontrak administrasi, maka gugatan dapat diajukan dalam jangka waktu satu tahun Selanjutnya apabila sengketa tersebut menyangkut persoalan yang berkaitan dengan perlindungan kepentingan umum atau menyangkut status seseorang, gugatan dapat diajukan setiap waktu 6. Majelis Hakim, Hakim Rapporteur, Hakim Kommissioner. Pada Mahkamah Agung, majelis hakim yang mengangani perkara minimal lima orang hakim. Sementara pada peradilan administrasi tingkat pertama minimal tiga orang hakim. Hakim mempunyai kebebasan untuk mencari kebenaran materiel, dimana hakim dapat memeriksa bukti, saksi atau ahli menurut inisyatifnya sendiri meski tidak diajukan oleh pihak yang berperkara. Hakim Rapporteur, Apabila suatu perkara telah didistribusikan kepada majelis hakim, maka Ketua pengadilan/Ketua Mahkamah agung menunjuk hakim rapporteur (judge-rapporteur) yang bertugas untuk mengumpulkan fakta- fakta dan bukti maupun keterangan-keterangan para pihak. Hakim rapporteur ini juga dibantu oleh pegawai administrasi (administrative case official). Hakim rapporteur haruslah mengadakan pemeriksaan kepada para pihak, bukti-bukti dan berkas- berkas perkara guna mendapatkan fakta dan hukum yang relevan. Bahkan dapat memerintahkan para pihak untuk menyerahkan bukti-bukti yang dipandang perlu diserahkan dalam limit waktu tertentu. Apabila hakim rapporteur memandang bahwa persoalan menyangkut fakta dan hukum sudah cukup, maka ia akan menyampaikan/rnerepresentasikan pendapatnya kepada majelis yang menagani perkara yang bersangkutan. Hakim Commissioner. Hakim Komisioner adalah hakim selain Majelis hakim yang menagani suatu perkara yang dapat mengikuti jalannya persidangan. Berbeda dengan Hakim Rapporteur yang hanya bertugas dalam tahap pemeriksaan awal sebelum persidangan perkara. Hakim Kommissioner ini menerima kesimpulan mengenai fakta dan hukum yang dihimpun oleh hakim rapporteur. Hal itu sudah diterima sebelum hari persidangan. Hakim Komisioner ini juga memberi opini kepada Majelis hakim, mereka berhak untuk mengikuti persidangan dan menghadiri musyawarah majelis hakim. Akan tetapi mereka tidak mempunyai hak suara dal;am p[ uitusan musyawarah. Singkatnya bahwa hakim komisioner hanyalah sebagai pembanding mengenai fakta dan hukum. Penunjukan Hakim Komisioner ini dilakukan oleh ketua, yang ditunjuk dari antara hakim-hakim akan tetapi selain/diluar hakim majelis yang menangani kasus yang bersangkutan. Adakalanya hakim komisioner pada Mahkamah .,

Agung ditunjuk oleh Ketua Makhklamah Agung dari kalangan Hakim tingkat pertama. 7. Peringatan dan sanksi kepada tergugat yang tidak taat pada persidangan. Dalam pemeriksaan yang dilakukan oleh hakim rapporteur, dan dalam hal tergugatlpejabat tidak mengindahkan perintah hakim rapporteur atau tidak memenuhinya dalam waktu yang telah ditentukan, maka pengadilan dapat mengambil tindakan: - melaporkan hal itu kepada atasannya atau kepada Perdana Menteri guna dijadikan sebagai koreksi, atau - memberi paksaan atau menetapkan tindakan displiner, atau - tanpa pemeriksaan pengadilan menjatuhkan hukuman penjara dengan alas an contempt of court. VIII.
Putusan Perkara dan eksekusi 1. Pemutusan perkara haruslah dilakukan dengan suara terbanyak. Apabila ada hakim yang berpendapat berbeda, maka ia akan membuat dissenting opinion secara tertulis. Suatu perkara dapat juga diputus oleh Majelis lengkap (General assembly) apabila menurut Ketua Mahkamah Agung hal itu diperlukan. Majelis lengkap tidak boleh kurang dari separoh jumlah hakim selain ketua Mahkamah Agung sendiri. 2. Isi Putusan Suatu putusan paling sedikit haruslah memuat hal-hal sebagai berikut: a. nama penggugat b. pejabat yang digugat c. akibat perbuatan (tergugat) d. fakta hukum e. alasan yang melandasi putusan f. pertimbangan hukum g. keputusan pejabat bila ada, dan hal yang harus dilakukan pejabat (yang digugat) Hari dan tang gal pengucapan putusan harus diberitahu kepada para pihak yang berperkara. Apabila para pihak tidak hadir pada pengucapan putusan, maka kepadanya harus diberikan salinannya. Penyerahan itu dianggap sebagai hari pengucapan putusan. Putusan tersebut juga harus dipublikasikan oleh Sekretaris Jenderal kepada publik, termasuk yang dipublikasikan juga opinoi hakim komisioner pada perkara yang bersangkutan. Putusan Hakim Agung mengikatldapat dilaksanakan sejak hari yang secara khusus detetapkan pada putusannya. Akan tetapi pelaksanaan Putusan Hakim tingkat pertama ditunda hingga habis tenggang kasisi (appiel) yang ditentukan. Masa pengajuan kasasi ditentukan 30 hari. Putusan pengadilan juga mengikat kepada pihak ketiga dengan ketentuan sebagai berikut: Putusan mengenai perintah/pengusiran seseorang dari suatu temp at dapat dilakukan tanpa mereka membuktikan titel khusus untuk itu. Jika seseorang telah memberi suatu jaminan di pengadilan untuk sesuatu tindakan yang ditentukan dalam putusan, maka jaminan itu harus

dilaksanakan dan putusan itu tidak perlu lagi dilakukan kepada . . . sipenjamm. Putusan menganai status hukum atau kapasitas seseorang dapat diterapkan kepada pihak ketiga kecuali bila pihak ketiga tersebut menunjukkan suatu titel hukum yang lebih baik/tinggi Putusan yang diambil berkaitan dengan hak atas kekayaan dapat diterapkan oleh para pihak kepada pihak ketiga kecuali pihak ketiga mempunyai titel hukum yang lebih baik/tinggi 3. Eksekusi putusan pengadilan. Dalam melaksanakan putusan pengadilan, pengadilan berwenang sebagai berikut: Dalam hal keputusan pejabat melanggar hukum, pengadilan dapat memerintahkan pencabutan keputusan atau penundaan sebagian atau seluruhnya Dalam hal pejabat melakukan suatu kelalaian atau menunda pelayanan dengan tidak masuk akal, maka pengadilan dapat memerintahkan pimpinan pejabat administrasi yang bersangkutan untuk melakukan suatu kewajiban yang ditentukan pengadilan. Dalam hal keputusan pejabat diterbitkan dengan melanggar hukum atau menyalahi kewajibannya atau yang berkaitan dengan kontrak administrasi, maka pengadilan dapat memerintahkan pembayaran sejumlah uang atau penyerahan barang atau melakukan atau tidak melakukan suatu perbuatan dengan atau tanpa memberi jangka waktu atau keadaan/kondisi tertentu. Berkaitan dengan suatu permohonan mengenai hak dan kewajiban seseorang, maka pengadilan dapat memerintahkan pemulihan hak dan kewajiban. Memerintahkan seseorang untuk melakukan atau tidak melakukan sesuatu yang ditentukan hukum. Putusan mengenai pembatalan keputusan pejabat. hams diumurnkan dalam lembaran negara (Gaverment Gazette). Apabila putusan pengadilan menyangkut kewajiban untuk membayar sejumlah uang atau penyerahan barang, maka pengadilan dapat melakukan eksekusi terhadap harta kekayaan yang bersangkutan. Apabila putusan pengadilan menyangkut suatu perintah untuk melakukan atau tidak melakukan suatu perbutan, maka pengadilan dapat melakukan eksekusi dengan menggunakan Hukum Acara Perdata secara mutatis mutandis. 4. Perlawanan pihak ketiga. Apabila terdapat pertentangan putusan pengadilan yang berbeda tingkatan mengenai suatu persoalan yang sarna dan putusan yang telah berkekuatan tetap, maka putusan Mahkamah agung terse but harus dimenangkan/diutamakan. Selanjutnya apabila pertentangan putusan tersebut terjadi atas putusan sesama pengadilan tingkat pertama, maka para pihak atau pihak ketiga yang berkepentingan dapat mengajukan keberatan ke Mahkamah Agung yang memohon agar ditetapkan putusan mana yang hams digunakan. Putusan Mahkamah Agung dalam hal in merupakan putusan akhir dan mengikat.

IX.
Peninjauan kembali. Terhadap suatu putusan pengadilan, para pihak atau pihak ketiga yang berkepentingan terhadap putusan tersebut dapat mengajukan permohonan ke pengadilan untuk memohon pemeriksaan dan pemutusan ulang perkara yang bersangkutan dengan syarat-syarat sebagai berikut: - Pengadilan administrasi telah keliru mengenai fakta, untuk itu diharuskan adanya bukti baru. - Pihak yang bersengketa atau pihak ketiga tidak hadir atau kehadirannya ditolak dengan alasan yang tidak mas uk akal sehingga tidak berkesempatan untuk membela kepentingannya - Telah terjadi ketidak pantasan proses pemeriksaan perkara sehingga berakibat putusan tidak adil - Telah terdapat pertentangan fakta dan hukum satu dengan yang lain - Bahwa pihak pemohon atau pihak ketiga terse but sarna sekali tidak mengetahui adanya pemeriksaan perkara yang bersangkutan - Permohonan dapat diajukan setelah 90 (sebilan pulu hari) sejak putusan perkara yang bersangkutan, akan tetapi tidak boleh melebihi jangka waktu lima tahun sejak putusan terse but.
