Considering the Law of 27 June 1937 on revision of the Law of 16 November 1919 on the regulation of air navigation, Article 5(1);

Article 1 This Decree defines the criteria and the procedure for obtaining an approval for the provision of groundhandling services at Brussels National airport.
Artikel 1. Dit besluit bepaalt de criteria en de procedure voor het verkrijgen van een erkenning voor grondafhandelingsdiensten op de luchthaven Brussel-Nationaal.
Definitions

Article 2 For the application of the present Decree, the following definitions shall apply:

1. AOC: the certificate issued to an air carrier to carry out specified commercial air transport activities (Air Operator Certificate);
1° AOC: bewijs afgegeven aan een luchtvaartexploitant om gespecificeerde commerciële luchtvervoersactiviteiten uit te voeren (« Air Operator Certificate »);
2. security: a combination of measures as well as human and material resources aiming to protect civil aviation against illegal acts;
2° beveiliging: een geheel van maatregelen evenals menselijke en materiële middelen bestemd om de burgerlijke luchtvaart te beveiligen tegen wederrechtelijke daden;
3. approval: permanent approval or provisional approval;
3° erkenning: definitieve erkenning of voorlopige erkenning;
4. linked company : a branch or any other business in which the company holds, directly or indirectly, a participation representing 20% or more of the voting rights or the capital;
4° gelieerde onderneming: een dochteronderneming of ieder andere onderneming waarin de onderneming rechtstreekse of onrechtstreekse participatie van 20% of meer van de stemrechten of van het kapitaal bestaat;

6.quality management system: the system intended for quality management of groundhandling activities, and more specifically the structure of the organisation, the responsibilities, the procedures, the processes and measures for implementation of a quality policy in the company foreseeing the management of quality in the act of handling;
6° kwaliteitsbeheerssysteem: systeem voor het beheer van de kwaliteit van grondafhandelingsactiviteiten, in het bijzonder de structuur van de organisatie, verantwoordelijkheden, procedures, processen en voorzieningen voor de implementatie van de kwaliteitspolitiek van de onderneming, dat voorziet in de beheersing van de kwaliteit tijdens het afhandelen;
7. Minister: the Minister with air naviation in their attributions.
7° Minister: de Minister die bevoegd is voor de luchtvaart;
8. parent company: a company which holds a controlling power over another company within the definition of the Companies Code of 7 May 1999;
8° moedervennootschap: een vennootschap die een controlebevoegdheid, zoals bedoeld in het Wetboek van Vennootschappen van 7 mei 1999, uitoefent over een andere vennootschap;
9. new company: a company which is so recent that they do not yet have audited annual accounts;

10. maintenance programme: a combination of maintenance, inspection and testing activities with the aim of preserving and guaranteeing the operation of stock;
10° onderhoudsprogramma: geheel van onderhouds-, inspectie- en keuringsactiviteiten dat als doel heeft de functionaliteit van het materieel te behouden en te garanderen;
11. company: a provider of ground handling services or a user who performs self-handling;
11° onderneming: een verlener van grondafhandelingsdiensten of een gebruiker die zelfafhandeling verricht;
12. regulation on the declaration of incidents: Regulation (EU) No 996/2010 of the European Parliament and of the Council of 20 October 2010 on the investigation and prevention of accidents and incidents in civil aviation and repealing Directive 94/56/EC and the RD of 22 April 2005;

organisation, the responsibilities, the procedures, the processes and measures for implementation of a safety policy in the company foreseeing the management of safety in the act of handling and a safe use of systems and support equipment;
grondafhandelingsactiviteiten, in het bijzonder de structuur van de organisatie, verantwoordelijkheden, procedures, processen en voorzieningen voor de implementatie van de veiligheidspolitiek van de onderneming, dat voorziet in de beheersing van de veiligheid tijdens het afhandelen en het veilig gebruik van ondersteunende systemen en apparaten;

Article 3 (1) The company submits an application to the Director General in a form that he/she has determined.
Article 3 §1. De onderneming dient een aanvraag in bij de Directeur-generaal in de door hem bepaalde vorm.
In the application, the company mentions the categories of groundhandling for which they would like to be approved, whether this is as a supplier of groundhandling services or as a user of selfhandling. The operations manual, written for the company, is an integral part of the request.
In de aanvraag vermeldt de onderneming voor welke categorieën grondafhandelingsdiensten zij erkend wil worden, hetzij als verlener van grondafhandelingsdiensten, hetzij als gebruiker die zelfafhandeling verricht. De exploitatiehandleiding, opgesteld voor de onderneming in kwestie, maakt integraal deel uit van de aanvraag.
(2) A company wishing to become active in one or several categories of groundhandling services submits an application for approval at least 4 months prior to the start of activities.
§2. Een onderneming die actief wenst te worden in één of meerdere categorieën grondafhandelingsdiensten, dient minstens 4 maanden voor de aanvang van deze activiteiten een aanvraag tot erkenning in.
(3) The Belgian Civil Aviation Authority carries out an evaluation of the request once all the documents required for application have been received.
§3. Het Directoraat-generaal Luchtvaart gaat over tot de beoordeling van de aanvraag na ontvangst van alle documenten die moeten worden ingediend ter staving van de aanvraag.

Article 4 (1) To evaluate the application, and subsequently every time it considers it necessary, the Belgian Civil Aviation Authority carries out audits, tests and inspections within the company. When setting the auditing programme, the Belgian Civil

(2) The audits, tests and inspections may be announced or may happen unexpectedly.
§2. Audits, controles en inspecties kunnen zowel aangekondigd als onaangekondigd plaatsvinden.
If the dates and scope of the audits, tests and inspections are announced at least 14 days in advance, the company will ensure that the persons or roles required are available during the audit, test or inspection.
Indien de data en de reikwijdte van audits, controles en inspecties minimaal 14 dagen op voorhand aangekondigd worden, zorgt de onderneming ervoor dat de vereiste personen of functies beschikbaar zijn tijdens de audit, controle of inspectie.
(3) Any findings or comments will be mentioned in the audit report.
§3. De eventuele vaststellingen en opmerkingen zullen in het auditrapport vermeld worden.
If the company does not agree with a finding or a comment, the company notifies the Director General of their reasoned objections within 10 working days of receipt of the audit report.
Indien de onderneming niet akkoord gaat met een vaststelling of opmerking, tekent de onderneming, binnen een termijn van 10 werkdagen na ontvangst van het auditrapport, gemotiveerd bezwaar aan bij de Directeur-generaal.
(4) The company prepares a corrective action plan, specifying a deadline for correction and for a response for every finding and comment, respectively. Within 15 working days of receipt of the audit report, the company submits a proposal for a corrective, up-to-date action plan to the Director General.
§4. De onderneming stelt een plan met correctieve acties op waarin voor elke vaststelling en opmerking een uiterlijke correctiedatum respectievelijk antwoorddatum bepaald wordt. Binnen de 15 werkdagen na ontvangst van het auditrapport bezorgt de onderneming een voorstel van bijgewerkt plan met correctieve acties aan de Directeurgeneraal.
The Director General may accept or reject this proposal. If the Director General rejects this proposal, the Director General may set, for one or several findings or remarks, a deadline for correction or response.
De Directeur-generaal kan dit voorstel aanvaarden of afwijzen. Als de Directeur-generaal dit voorstel afwijst, kan de Directeur-generaal voor één of meerdere vaststellingen of opmerkingen de uiterlijke correctie- of antwoorddata bepalen.

training provisions under Article 10;

(2) If the Belgian Civil Aviation Authority finds that the company does not meet one or several criteria under Article 5(1), the company includes these criteria in its corrective action plan.
§2. Indien het Directoraat-generaal Luchtvaart vaststelt dat de onderneming niet voldoet aan één of meerdere criteria vermeld in artikel 5, §1, neemt de onderneming deze op in haar plan met correctieve acties.

(3) If, in the evaluation of the request, it obviously seems that the company does not meet the criteria under Article 5(1), the Director General may issue the company with a provisional approval for one or several categories of groundhandling services, as long as the Director General has made sure that:

based on the accepted corrective action plan, a permanent approval, as defined in Article 5(1), may be issued to the company for the groundhandling services in question, before the end of validity period of the provisional approval; and

The issuing of a provisional approval does not compromise safety.

(4) The Director General makes a decision at the latest 4 months after the formal request, in accordance with Article 14 of the Royal Decree of 6 November 2010.
§4. De Directeur-generaal neemt ten laatste 4 maanden na de formele aanvraag ter zake een beslissing overeenkomstig artikel 14 van het koninklijk besluit van 6 november 2010.
(5) When an approval is issued, the Director General determines the categories of groundhandling services and the conditions.
§5. Bij het uitreiken van een erkenning vermeldt de Directeur-generaal de categorieën grondafhandelingsdiensten en de voorwaarden.
The approval is only valid for the categories of groundhandling services and under the conditions stated on the approval.
De erkenning is enkel geldig voor de categorieën grondafhandelingsdiensten en volgens de voorwaarden die op de erkenning zijn vermeld.
(6) The airport users who have obtained an approval for self-handling cannot provide groundhandling services for third parties.
§6. Luchthavengebruikers die een erkenning voor zelfafhandeling hebben gekregen, mogen op basis van deze erkenning geen afhandeling voor derde partijen verrichten.

(7) Providing that the approval has not been withdrawn, a permanent approval is valid for a period of 7 years from the date the approval was issued or, where applicable, from the date of issuing of the provisional approval which precedes the permanent approval.
§7. Behalve als ze ingetrokken wordt, is een definitieve erkenning geldig voor een periode van 7 jaar te rekenen vanaf de datum van uitreiking van de erkenning of, indien van toepassing, vanaf de datum van uitreiking van de voorlopige erkenning die de definitieve erkenning voorafgaat.
Providing that the approval has not been withdrawn, a provisional approval is valid for the period indicated on the provisional approval, with a maximum of one year, renewable for a period of maximum one year. A provisional approval comes to the end on the date that a permanent approval is issued.
Behalve als ze ingetrokken wordt, is een voorlopige erkenning geldig voor een periode vermeld op de voorlopige erkenning met een maximum van één jaar, hernieuwbaar met een periode van maximaal één jaar. Een voorlopige erkenning vervalt ambtshalve op de datum waarop een definitieve erkenning wordt uitgereikt.

Article 6 (1) The company requesting an approval demonstrates that:

1° over a period of 24 months from the date of expected approval on the basis of realistic hypotheses, it may at any time meet its current and potential obligations; and
2° zij gedurende een periode van 24 maanden vanaf de verwachte erkenningsdatum te allen tijde haar op realistische veronderstellingen gebaseerde, bestaande en potentiële verplichtingen kan nakomen; en
2.
3° zij gedurende een periode van 3 maanden vanaf de verwachte erkenningsdatum haar vaste en variabele kosten kan dekken die voortvloeien uit de activiteiten volgens haar bedrijfsplan en die op realistische veronderstellingen zijn gebaseerd, zonder dat rekening wordt gehouden met de inkomsten uit haar activiteiten.

(2) The approval is refused for a company that:

procedure of the same kind existing in the legislation of the country where the company is established;

has made a declaration of bankruptcy, started a liquidation procedure or legal winding-up arrangement or has an ongoing procedure of the same kind existing in the legislation of the country where the company is established;
2° aangifte heeft gedaan van haar faillissement, een procedure van vereffening of een gerechtelijk akkoord aanhangig heeft of een gelijkaardige procedure lopende heeft overeenkomstig de wetgeving in het land van de maatschappelijke zetel van de onderneming;
3.
is not registered in the professional register as required in the legislation of the country of establishment;
3° niet geregistreerd is in het beroepsregister, zoals door de wetgeving in het land van de maatschappelijke zetel van de onderneming wordt vereist;
4.
who has, in bad faith, given inaccurate information.

(3) If the company no longer meets the conditions in (2), it immediately informs the Belgian Civil Aviation Authority.
§3. Wanneer de onderneming niet meer voldoet aan de voorwaarden bedoeld in §2, stelt de onderneming het Directoraat-generaal Luchtvaart hiervan onmiddellijk op de hoogte.
(4) The company reports to the Belgian Civil Aviation Authority on its financial situation using the following means:
§4. De onderneming brengt verslag uit aan het Directoraat-generaal Luchtvaart over haar financiële situatie overeenkomstig de volgende modaliteiten:
1.
every company, with the exception of a new company, produces its audited annual accounts from the previous five financial years or the accounts already available if the company is less than five years old, at the same time as the request;
1° elke onderneming, behalve een nieuwe onderneming, verstrekt bij de aanvraag haar geauditeerde jaarrekeningen van de vijf voorgaande boekjaren of van de beschikbare boekjaren wanneer de onderneming jonger is dan vijf jaar;

the company encloses with its request a signed financial analysis in accordance with the template specified by the Director General. This

template is made available, electronically, by the Belgian Civil Aviation Authority. The company also provides the Belgian Civil Aviation Authority with the complete financial analysis electronically. The signatory of the financial analysis is responsible for the exactness of the data and the completed information in the financial analysis and is authorised to this effect within the company;

every company encloses a business plan for at least three years from the date of expected approval with their request. This business plan also includes details of the financial links between the company and any other commercial activities in which the company is directly involved or via linked companies;
3° elke onderneming dient bij de aanvraag een bedrijfsplan in voor ten minste de drie jaren volgend op de verwachte erkenningsdatum. Het bedrijfsplan bevat ook nadere gegevens betreffende de financiële banden tussen de onderneming en eventuele andere commerciële activiteiten waarbij de onderneming rechtstreeks of via gelieerde ondernemingen betrokken is;
4.
the company provides all pertinent information, including the following details in particular:

In the course of the period of validity of the provisional approval, the company shall make sufficient efforts to improve its financial situation. (6) The company includes with its request a certificate from the direct tax authority and the VAT authority - dating 6 months maximum - in which it shows that they are not in arrears or that a debt settlement plan is being duly respected. Article 20 (1) If the company calls upon one or several sub-contractors, the company keeps a register of these sub-contractors. This register is made available to the Belgian Civil Aviation Authority.

(2) The company that calls upon one or several subcontractors ensures that their performance in selfhandling meets the criteria in the present Decree.

Revoke and suspension of approval

Article 21 (1) The Director General may revoke or suspend an approval if the company, for reasons attributed to them:

1.
clearly no longer fulfils the criteria in Article 5(1) of the present Decree; or
1° duidelijk niet langer voldoet aan de criteria vermeld in artikel 5, §1 van dit besluit; of
2.
has, in bad faith, communicated inaccurate information thus preventing an exact idea of the facts to be obtained; or
2° ter kwader trouw verkeerde informatie heeft verstrekt waardoor een juiste voorstelling van de feiten onmogelijk wordt gemaakt; of
3.
has not started the activities mentioned in the approval within 12 months of the issuing of the approval; or
3° de activiteiten, vermeld in de erkenning, niet heeft opgestart binnen een periode van 12 maanden na het verkrijgen van een erkenning; of
4.
has ceased activities for more than 12 months.
4° haar activiteiten gedurende meer dan 12 maanden heeft gestaakt.
(2) The Director General communicates their intention to revoke or suspend an approval and the reasons for this in a letter sent by recorded delivery to the company. A copy of this letter is sent to the airport operator. Within 15 working days following the date the letter was received, the company may notify the Director General of its reasoned objections.
§2. De Directeur-generaal deelt het voornemen tot intrekking of schorsing van een erkenning en de redenen daartoe per aangetekende brief met ontvangstbewijs mee aan de onderneming. Een kopie van deze brief wordt naar de luchthavenuitbater gestuurd. Binnen een termijn van 15 werkdagen na de datum van ontvangst van deze brief, kan de onderneming gemotiveerd bezwaar aantekenen bij de Directeurgeneraal.
The Director General makes a decision concerning the revoke or suspension within working 20 days from the expiry of the period of 15 working days recorded in the previous paragraph. The company is informed of this decision in a letter sent by recorded delivery. The Director General outlines the conditions for the revoke or suspension, including but not exclusively, the period from which the revoke or suspension will be effective. A copy of this decision is sent to the airport operator.
De Directeur-generaal neemt een beslissing betreffende de intrekking of schorsing binnen een termijn van 20 werkdagen, die ingaat na verloop van de termijn van 15 werkdagen vermeld in het vorige lid. De onderneming wordt per aangetekende brief met ontvangstbewijs op de hoogte gesteld van deze beslissing. (3) By way of derogation to the provisions in paragraph 2, the Director General can suspend the approval with immediate effect if safety concerns require it. The company is informed of this decision and the reasons in a letter delivered by recorded delivery. A copy of this decision is sent to the airport operator.
§3. In afwijking van de bepalingen in paragraaf 2, kan de Directeur-generaal de erkenning met onmiddellijke ingang schorsen indien dit omwille van de veiligheid vereist is. Amendment of the approval
Wijziging van de erkenning
Article 22 (1) The company ensures that the data on the approval is correct at all times. If one or more details on the approval have ceased to be correct, the holder of the approval requests without notice an amendment to the approval from the Director General.
Art. 22. §1. De onderneming waakt erover dat de gegevens op haar erkenning te allen tijde juist zijn. Als één of meerdere gegevens vermeld op de erkenning niet langer juist zijn, vraagt de houder van de erkenning onverwijld een wijziging van de erkenning aan bij de Directeur-generaal.
The company immediately informs the Director General of:

substantial changes in the volume of its activities;

any insolvency procedures taken against the company.

(2) The Director General may modify the approval if the provisions in the present Decree are met.

For these requests, the Director General, by way of derogation of Article 5(4), makes a decision no later than 6 months after the request under paragraph 1.

Entry into force

Article 24
The present Decree enters into force on the first day of the month following the expiry of a ten day period starting the day after its publication in the Belgian Official Journal.
