Geachte mevrouw Schultz van Haegen, Op 18 maart jl. heeft er in Amsterdam een bespreking plaatsgevonden met Rens Vermeulen en Eise Mulder van het Ministerie Infrastructuur en Milieu enerzijds, en afgevaardigden van HISWA, Watersportverbond, Scouting Nederland, Federatie varend erfgoed Nederland, Stichting BASM, Ver. Waterhulpdiensten Nederland, Ver. de Motorsleepboot en belangenorganisatie Kleine Beroepsvaart Amsterdam (KBA) anderzijds. Op de agenda stond de CvO-plicht voor onderling slepende kleine schepen. Met de inwerkingtreding van de Binnenvaartwet in 2009 (BVW) is de oude definitie van Sleepboot aangepast. De aanpassing van de begripsbepaling voor Sleepboot heeft als gevolg dat voor de categorie kleine schepen met een ander klein schip op sleep, een Certificaat van Onderzoek (CvO) zou moeten zijn afgegeven. Denk daarbij aan kleine motorschepen, van oa. waterbouwers, vaarscholen, watersportverenigingen, bootverhuurders, ons varend erfgoed, de agrarische sector, scouting, jachthavens, scheepswerven, waterhulpdiensten, KNRM, toezichthouders en de pleziervaart. In de huidige wet- en regelgeving, maar ook in de bijbehorende toelichtingen daarop, ontbreekt de uitzondering die het toestaat dat een klein schip een ander klein schip sleept. De CvO-plicht geldt zowel voor de pleziervaart als voor bedrijfsmatige vaart. Voor de duidelijkheid: we hebben het hier over schepen kleiner dan 15 meter waarvoor geen vaarbewijs is vereist, ook niet tijdens het slepen. De vergadering concludeerde plenair dat er genoeg redenen zijn om de zogenaamde “weeffout” in de huidige wet- en regelgeving te repareren. Op verzoek van Rens Vermeulen zet ik, namens de KBA hieronder beknopt uiteen waarom wij vinden dat de wet zo spoedig mogelijk gerepareerd dient te worden. Wat u moet weten: - Onderzoek wijst uit dat het nooit de bedoeling van de wetgever is geweest om onderling slepende kleine schepen een CvO-plicht op te leggen; - de nationale wet- en regelgeving is op dit punt strenger dan de Europese Richtlijn 2006.87 voorschrijft. Dit kan een aanleiding zijn tot ingewikkelde en dure bezwaarprocedures; - de nationale wet en regelgeving is op dit punt niet in harmonie met het ROSR. Dit heeft bijvoorbeeld tot gevolg dat er geen CvO-plicht voor onderling kleine schepen is op de Waal, maar wel op de Weesterptrekvaart; - handhaving op het bezit van een CvO past vanwege het grote aantal schepen, niet in de doelstelling van de BVW: het terugdringen van inspanningen van de rechterlijke macht en overregulering;
- technische eisen die het CvO voorschrijft zijn niet uitvoerbaar op de pleziervaart en niet op een groot aantal bedrijfsmatige schepen; - een groot aantal schepen dat bedrijfsmatig vaart zal vanwege het niet uitvoerbaar zijn van de technische eisen, vervangen moeten worden, met enorme lastenverzwaring voor het bedrijfsleven tot gevolg; - lastenverzwaring (aanpassen of vervangen) zal leiden tot verhoging van tarieven voor de burger; - schepen die op dit moment een klein schip slepen (pleziervaart incluis!) zijn in overtreding zijn met de BVW, en daarom tijdens het slepen veelal niet verzekerd; - ILT heeft verscherpt toezicht aangekondigd, met nog meer boeteopleggingen, zienswijzen en bezwaarprocedures in het verschiet. Is er wel een aanleiding om deze categorie schepen tot een CvO te verplichten? - Sinds de invoering van de BVW in 2009 zijn er geen (sleep) incidenten bekend die de veiligheid van bemanning en/of schip in gevaar hebben gebracht; - sinds de invoering van de BVW in 2009 heeft Inspectie bij deze categorie schepen geen toezicht laten houden op het bezit van een CvO; - sinds de invoering van de BVW in 2009 heeft Inspectie voor deze categorie schepen geen technische voorschriften ontwikkeld; - sinds de invoering van de BVW in 2009 heeft Inspectie de CvO-plicht niet gecommuniceerd met de eigenaren van deze categorie schepen; - sinds de invoering van de BVW in 2009 hebben de verzekeringsmaatschappij, in navolging van de huidige wet- en regelgeving, geen aanleiding gezien om bij deze categorie schepen de technische eisen te (laten) aanscherpen; - sinds de invoering van de BVW in 2009 worden er voor bepaalde kleine schepen wel uitzonderingen gemaakt. De vrijstelling op de CvO-plicht wordt “gezien de specifieke kenmerken van de nationale vaarwegen vanuit nautisch oogpunt verdedigbaar geacht” aldus de toelichting op artikel 15 in de Nota; - sinds de invoering van de BVW in 2009 heeft men ervoor gekozen om voor het langszij vastgemaakt meevoeren van kleine schepen geen CvO-plicht eisen. De reden daarvoor is ook van toepassing op deze categorie schepen; - in de Toelichting van de Minister om artikel 7.7. van BVR te wijzigen, lezen we dat onderzoek heeft uitgewezen dat de groep bedrijfsmatige schepen (< 20 meter) die schepen slepen of duwen (< 20 meter) geen gevaar oplevert voor de veiligheid van de scheepvaart - bedrijfsmatige schepen in deze categorie zijn veelal beter ingericht om te slepen dan een gemiddelde pleziervaartuig waarmee gesleept wordt. Conclusie: - Er is in het verleden geen aanleiding geweest voor de Europese Unie, noch de Nationale wetgever, Inspectie en verzekeraars om voor onderling slepende schepen een CvO-plicht in te stellen, c.q. te (laten) handhaven, niet bij de pleziervaart en niet bij bedrijfsmatige vaart; - het is vanuit nautisch oogpunt verdedigbaar om voor deze categorie schepen (pleziervaart én bedrijfsmatige vaart) dezelfde uitzondering te maken zoals die destijds al gemaakt is voor schepen in de sociaal culturele sector; - onderling slepende kleine schepen leveren geen gevaar op voor de veiligheid van scheepvaart: niet bij de pleziervaart en niet bij bedrijfsmatige vaart. Bedrijfsmatige vaart versus niet bedrijfsmatige vaart. De KBA is een belangenorganisatie voor nautische bedrijven die bedrijfsmatig varen in Amsterdam en omstreken. De bedrijven zijn actief op- rondom het Noordzeekanaal, IJ, Markermeer en het Amsterdam Rijnkanaal (Zone 3 en 4). Vanaf eind 2015 worden wij door met name Waternet Amsterdam regelmatig geconfronteerd met toezicht op CvO. De bedrijven varen, c.q. slepen met hun schepen weliswaar bedrijfsmatig, maar in tegenstelling tot de reguliere sleepdiensten die voornamelijk grote schepen slepen, is slepen niet ons beroep. De schepen van de KBA zijn zonder uitzondering allemaal kleine schepen. Alleen de drie schepen met CvO, slepen schepen boven de 20 meter: oa. dekschuiten en woonboten. Met de andere 34 schepen worden uitsluitend kleine schepen gesleept, voornamelijk pleziervaart. Vanuit nautisch oogpunt verschillen we hierin niet met de “onderling slepende pleziervaart”. Behalve dan dat al onze schepen geschikt zijn om mee te slepen en al onze schippers ruime ervaring hebben met slepen.
Het is daarom slecht verdedigbaar om bij het voorschrijven van een certificaat van onderzoek onderscheid te maken tussen de exploitatie van een schip, bedrijfsmatig of niet bedrijfsmatig, maar het is ook: - rechtsongelijk. In de Nota van Toelichting op het Binnenvaartbesluit (§3.1 pag. 21 en 32) motiveert de Minister dat “uit het oogpunt van rechtsgelijkheid, het niet goed verdedigbaar is als de wijze van exploitatie tot verschillen leidt ten aanzien van de certificaatplicht bij schepen van gelijke afmetingen”; - en overregulerend. Voor de toezichthouders betekent dit dat ze op het water pleziervaart van bedrijfsmatige vaart moeten zien te onderscheiden. De praktijk van voor 2009 heeft ons al geleerd dat dit zeer lastig is; Oplossing. Wij zijn van mening dat bij het voorschrijven van het CvO de lengte (lengte criterium) en niet het gebruik (exploitatie criterium) van het vaartuig bepalend dient te zijn Er zijn genoeg redenen voor harmonisatie van de Europese en nationale wet- en regelgeving. Veiligheid van de scheepvaart moet daar het belangrijkste uitgangspunt zijn. En gebleken is dat het voor de veiligheid niet uit maakt of een klein schip bedrijfsmatig, of niet bedrijfsmatig wordt gesleept. Een oplossing zou kunnen zijn dat de begripsbepaling voor sleepboot en duwboot in het BVB alsvolgt wordt aangepast: “schip dat is bestemd of wordt gebruikt voor het slepen/duwen van schepen met een Certificaat van onderzoek en niet is bestemd voor het zelfstandig vervoeren van goederen” Dit betekent dat de sleepboot wel gekeurd moet zijn voor het slepen van schepen boven de 20 meter en bedrijfsmatige schepen onder de 20 meter. Maar niet voor het slepen van de overige groep schepen: hoofdzakelijk zijnde pleziervaart. Natuurlijk wisselen wij graag met u en de overige betrokkene van gedachte om samen tot een complete oplossing te komen. Wij zien uw uitnodiging voor een vervolg gesprek met belangstelling tegemoet.

4. Verhuurbedrijven. Bedrijven: Canal Boats, Boaty, Mokum Boats, Vaarschool Nautiek, Canal Motorboats Vloot: 7 (kleine) schepen zonder CvO, 1 (klein) schip met CvO; Werkzaamheden: het slepen van eigen (fluister)boten en waterfietsen;
5. Waterhulpdiensten. Bedrijven: Zeeg, HoosJeBootje, M. Roskam, de Klusjesboot, Sleepdienst Zaanbrug, T. van den Bragt, Royal Ship, WSB Vanmeelis & Zn.; Vloot: 10 (kleine) schepen zonder CvO; Werkzaamheden: het verlenen van sleephulp aan particuliere pleziervaart en jachtservice bedrijven;
