MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL COUNTER TERRORISM AGENCY OF THE REPUBLIC OF INDONESIA AND THE NATIONAL SECURITY COMMITTEE OF THE REPUBLIC OF KAZAKHSTAN ON COUNTER-TERRORISM COOPERATION
The National Counter Terrorism Agency of the Republic of Indonesia and the Nationa ~
Security Committee of the Republic of Kazakhstan (hereinafter
referred to as "Parties");
Considering the friendly relations and cooperation between the states of the Parties;
Realizing the need to achieve greater cooperation to address threat posed by terrorism in all its forms on the territory of states of the Parties;
Recog nizing the need to strengthen international cooperation at all levels in countering terrorism in a comprehensive manner;
Desiring to enhance coordination of the exchange of knowledge and experiences, in accordance with the international commitments of both states and within the limits established by the legislation of states of the Parties;

Guided by the principles of mutual respect for sovereignty, territorial integrity, equality, reciprocity and mutual benefit;
Pursuant to the prevailing laws and regulations of states of the Parties;
Have reached the following understanding:
Article 1 Objective
This Memorandum of Understanding shall provide a framework for cooperation between the Parties in preventing, suppressing, countering and combating international terrorism in all its forms.
Article 2 Forms of Cooperation
Both parties interact jointly to implement this Memorandum of Understanding, in accordance to its respective domestic laws and regulations, in any or all of following activities:
1) sharing of information on legislation, national policies and strategies that related to counter terrorism;
2) exchange of views, experience, lesson learned and best practices in countering terrorism;
3) promoting cooperation between the both states' law enforcement agencies and other institutions related to the effort to counter and combat terrorism;

4) strengthening capacity building and capabilities through networking and programs of training and education; exchange of visits of high officials, analysts and field operators; seminars, conferences, as appropriate;
5) other forms of cooperation that may be agreed by the Parties.
Article 3 Funding
1. The implementation of this Memorandum of Understanding will be subject to the availability of funding and officials of each Party.
2. Unless otherwise agreed in writing, each Party in accordance with the laws and regulation of its state will bear the cost and expenses for its participation in activities under this Memorandum of Understanding.
Article 4 Settlement of Disputes
Any dispute ans1ng out of the interpretation or implementation of this Memorandum of Understanding shall be settled through consultations or negotiations between the Parties through diplomatic channels.
Article 5 Confidentiality
1. The Parties shall ensure the confidentiality of the confidential information provided by one Party.

2. Documents, objects and information received by the Parties under this Memorandum may not be assigned to a third party without the written consent of the providing Party. 3. The transfer between Parties of information containing
information
constituting state secrets shall be in accordance with their national laws and regulations and international agreements on the protection of classified information, which the Republic of Indonesia and the Republic of Kazakhstan are parties to them.
Article 6 Amendment
This Memorandum of Understanding may be amended and revised, as deemed necessary, by mutual written consent of the two Parties. Such amendment or revision will come into effect on such a date as may be determined by the Parties.
Article 7 Duration and Termination
1. This Memorandum of Understanding shall come into force on the date of its signature.
2. This Memorandum of Understanding shall remain in effect for three (3) years. Upon the expiration thereof shall be automatically renewed for further period of three (3) years. 3. Either Party may at any time terminate this Memorandum of Understanding by giving three months advance written notice to the other Party.

Signed in Astana on this second day of September 2013 in two original copies, each ir. Indonesian, Kazakh, Russian and English language, all texts being equally authentic. In case of any divergence of interpretation, the Parties will refer to the English text.

NOTA KESEPAHAMAN ANTARA BADAN NASIONAL PENANGGULANGAN TERORISME REPUBLIK INDONESIA DAN KOMITE KEAMANAN NASIONAL REPUBLIK KAZAKHSTAN TENT ANG KERJA SAMA PENANGGULANGAN TERORISME
Badan Nasional Penanggulangan Terorisme Republik Indonesia dan Komite Keamanan Nasional Republik Kazakhstan selanjutnya disebut sebagai "Para Pihak";
Mempertimbangkan hubungan yang bersahabat dan kerjasama antara kedua
Negara;
Menyadari kebutuhan untuk mencapai kerjasama yang lebih erat dalam
mengatasi terorisme dalam segala bentuknya di wilayah kedua Pihak;
Mengakui kebutuhan untuk memperkuat kerja sama internasional di semua
tingkat dalam memerangi terorisme secara komprehensif;
Berkeinginan untuk meningkatkan koordinasi dalam bertukar pengetahuan dan pengalaman, sesuai dengan komitmen internasional dan dalam batasan yang diatur dalam peraturan perundangan masing-masing Pihak;
Dipandu oleh prinsip-prinsip saling menghargai kedaulatan, integritas wilayah, persamaan, resiprositas dan saling menguntungkan;
Sesuai dengan hukum dan peraturan perundang-undangan yang berlaku di negara masing-masing;
Mencapai kesepahaman sebagai berikut:
Pasal 1 Tujuan
Nata Kesepahaman ini akan memberikan kerangka kerja bagi kerja sama kedua Pihak dalam mencegah, menanggulangi dan memberantas terorisme internasional dalam segala bentuknya .
Pasal2 Bentu k Kerja Sama
Kedua Pihak secara bersama melaksanakan Nota Kesepahaman ini, sesuai dengan hukum dan peraturan perundangan nasional masing-masing, dalam salah satu atau semua kegiatan berikut:
1. berbagi informasi tentang peraturan perundangan, kebijakan dan strategi nasional yang terkait dengan penanggulangan terorisme;
2. bertukar pandangan, pengalaman, pelajaran yang dapat diambil serta praktik yang baik dalam upaya penanggulangan terorisme;

3. meningkatkan kerja sama antara institusi penegak hukum serta institusi lain kedua negara yang terkait dengan upaya penanggulangan dan memerangi terorisme;
4. memperkuat pengembangan kapasitas dan kemampuan melalui jaringan dan program pelatihan dan pendidikan, saling kunjung antar pejabat tinggi, para analis dan para petugas pelaksana di lapangan, penyelenggaraan seminar, konferensi, bilamana dirasa perlu;
5. bentuk kerja sama lainnya yang dapat disetujui oleh Para Pihak
Pasal3 Pendanaan
1. Pelaksanaan Nota Kesepahaman ini akan tergantung pada ketersediaan dana dan pejabat dari masing-masing Pihak;
2. Kecuali ada kesepakatan lain yang secara tertulis, sesuai dengan hukum dan peraturan perundangan dari masing-masing Pihak, setiap Pihak akan menanggung biaya yang dikeluarkan dalam rangka keikutsertaan pada setiap kegiatan yang dilakukan dalam kerangka Nota Kesepahaman ini.
Pasal4 Penyelesaian Perselisihan
Setiap perselisihan yang timbul dari interpretasi atau pelaksanaan Nota Kesepahaman ini akan diselesaikan secara damai melalui konsultasi atau negosiasi antara kedua belah Pihak melalui saluran diplomatik.

Pasal5 Kerahasiaan
1. Para Pihak akan menjamin kerahasiaan informasi rahasia yang diberikan oleh salah satu Pihak lainnya.
2. Dokumen, barang dan informasi yang diterima oleh salah satu Pihak dalam rangka Nota Kesepahaman ini tidak dapat diberikan kepada pihak ketiga tanpa ijin tertulis dari Pihak pemberi.
3. Pemindahtanganan informasi antar para Pihak atas informasi yang isinya dianggap rahasia negara dilakukan sesuai dengan hukum dan peraturan perundangan nasional dan perjanjian internasional tentang informasi rahasia dimana Republik Indonesia dan Republik Kazakhstan menjadi pihak.
Pasal6 Amandemen
Nota Kesepahaman ini dapat diamandemen atau direvisi, jika diperlukan, melalui persetujuan tertulis oleh kedua Pihak. Amandemen atau revisi tersebut akan mulai berlaku pada tanggal sebagaimana dapat ditentukan oleh para pihak.
Pasal7 Jangka Waktu dan Pengakhiran

2. Nota Kesepahamam ini akan tetap berlaku selama tiga (3) tahun dan pada saat berakhir akan diperbaharui secara otomatis untuk tiga (3) tahun berikutnya;
3. Salah satu Pihak dapat setiap saat menghentikan Nota Kesepahaman ini dengan memberikan pemberitahuan terlebih dahulu tiga (3) bulan sebelumnya secara tertulis kepada Pihak lainnya. Ditandatangani di Astana pada tanggal 2 September 2013 dalam dua
rangkap, masing-masing dalam bahasa Indonesia, Kazakh, Rusia dan lnggris, semua naskah tersebut bersifat otentik. Dalam hal terdapat perbedaan penafsiran, Para Pihak akan mengacu pada teks bahasa lnggris.
