Perusahaan penanaman modal asing diperbolehkan oleh pejabat yang berwewenang di Viet Nam untuk menyewa tanah untuk melakukan proyek penanaman modal mereka. Jangka waktu penyewaan wajib sesuai dengan jangka waktu melakukan usaha dan wajib dipersyaratkan dalam ijin penenaman modal dan wajib diperpanjang apabilajangka waktu kegiatan perusahaan diperpanjang oleh pejabat yang berwewenang. Pemasok jasa asing diperbolehkan untuk memberikan sumbangan modal dalam bentuk pembelian saham perusahaan Viet Nam. Dalam hal ini jumlah keseluruhan kepemilikan yang dimiliki oleh penanam modal asing di dalam setiap perusahaan tidak boleh melebihi 30% dari modal perusahaan kecuali dipersyaratkan lain oleh

Satu tahun sesudah Viet Nam menjadi anggota WTO, pembatasan 30% kepemilikan asing untuk mengakuisisi perusahaan Viet nam wajib dihapus, kecuali untuk sumbangan modal dalam bentuk pembelian saham dari saham bersama bank komersial dan kecuali dalam sector yang tidak tercantum dalam jadwal ini. Untuk sector dan sub-sektor yang lain yang tercantum dalam jadwal ini, tingkat kepemilikan yang dimiliki oleh penanam modal asing dalam akuisisi perusahaan Viet nam wajib sesuai dengan batasan pada penyertaan modal asing yang ditetapkan, jika ada, termasuk batasan dalam bentuk jangka waktu tradisional, apabila ada.

Tetapi paling sedikit 3 orang manager, eksekutif dan spesialis yang bukan orang Vietnam harus diperbolehkan untuk setiap perusahaan. Manajer dan Eksekutif adalah mereka yang utamanya mengatur manajemen perusahaan asing yang telah membangun kehadiran komersialnya di Viet Nam, hanya menerima supervisi umum atau arahan dari direksi atau pemegang saham bisnis atau sejenisnya, termasuk mengarahkan pembangunan atau departemen atau sub-divisi pembangunan, pengawasan dan pengaturan kerja pengawas lain, profesional atau pegawai manajerial, mempunyai kekuasaan untuk merekrut atau memberhentikan atau tindakan personalia lainnya, yang tidak secara langsung melakukan tugas terkait dengan penyediaan jasa langsung dari pendirian tersebut. Spesialis adalah orang perorangan yang bekerja dalam sebuah perusahaan yang memiliki pengetahuan lanjut untuk keahlian dan dengan pengetahuan mengenai jasa organisasi, peralatan riset, teknik

Dalam mengakses pengetahuan tersebut, tidak hanya akan mempertimbangkan kehadiran komersial, tetapi juga apakah orang tersebut mempunyai keahlian atau kualifikasi yang tinggi berkenaan pengetahuan teknis spesifik. Spesialis dapat termasuk di dalamnya Asosiasi profesi berijin, tetapi hal ini tidak merupakan batasan definisi bahwa spesialis harus termasuk dalam asosiasi profesi berijin. (b) Personel lain Manajer, eksekutif dan spesialis, seperti disebutkan pada poin (a) di atas, yang tidak dapat digantikan posisinya oleh orang Viet Nam dan yang dipekerjakan di luar wilayah Viet Nam oleh perusahaan asing yang telah membangun kehadiran komersialnya di wilayah Viet Nam dengan maksud untuk berpartisipasi dengan aktifitas perusahaan asing tersebut di Viet Nam akan diijinkan untuk memasuki dan tinggal sesuai dengan masa kontrak kerja dimaksud atau untuk ijin pertamanya selama tiga tahun atau lebih pendek, dan dapat diperpanjang sesuai kontrak kerja antara personel tersebut dengan kehadiran komersial

(c) Orang per orangan penjual jasa yaitu orang peroangan yang tidak berada di wilayah negara VietNam dan tidak menerima pembayaran upah dari suatu sumber yang berlokasi di Viet Nam, dan yang terikat dengan aktifitas berkaitan dalam mewakili suatu penyedia jasa untuk tujuan negosiasi penjuaan jasa dari provider dimana: (i) penjualannya tidak dijual langsung ke khalayak umum; dan (ii) penjual jasa tersebut tidak terkait langsung dalam penyedian jasa. Ijin tinggal untuk orang perorangan yang demikian dibatasi hanya sampai 90 hari saja. (d) Orang - orang yang bertanggung jawab untuk mendirikan kehadiran komersial yaitu Manajer dan eksekutif (seperti yang disebutkan pada item (a) di atas) dalam sebuah badan hukum, dari suatu pihak yang bertanggung jawab atas pendirian kehadiran komersial perusahaan penyedia jasa di Viet Nam yang mana(i) orangorang tersebut tidak terikat dalam penjualan langsung atau penyediaan jasa; dan penyedia jasa tersebut mempunyai lokasi utama kegiatan bisnis diluar Viet

Ijin tinggal orang per orangan yang demikian dibatasi sampai dengan 90 hari. (e) Penyedia Jasa Kontrak Orang perorangan yang bekerja di perusahaan asing yang tidak mempunyai kehadiran komersial di Viet Nam diperbolehkan memasuki dan tinggal di Viet Nam selama 90 hari atau selama kontraknya, yang mana lebih pendek, harus mematuhi kondisi dan persyarata sebagai berikut: - Perusahaan asing tersebut telah mendapat kontrak jasa dari perusahaan Viet Nam yang operasional bisnisnya ada di Viet Nam. Otoritas Viet Nam yang berkompeten harus bisa membuat prosedur yang diperlukan untuk dapat memastikan kontrak tersebut dapat dipercaya orang-orang tersebut harus mempunyai: (a) gelar dari universitas atau dokumen kualifikasi teknis untuk menunjukkan tingkat pengetahuan yang sesuai; (b) kualifikasi professional yang mana dibutuhkan untuk menjalankan aktifitas sektor

Competitive safeguards

Prevention of anti-competitive practices in telecommunications Appropriate measures shall be maintained for the purpose of preventing suppliers who, alone or together, are a major supplier from engaging in or continuing anti-competitive practices.

all the licensing criteria and the period of time normally required to reach a decision concerning an application for a licence; and the terms and conditions of individual licenses.
The reasons for the denial of a licence will be made known to the applicant upon request. 5.
Independent regulators The regulatory body is separate from, and not accountable to, any supplier of basic telecommunications services. The decisions of and the procedures used by regulators shall be impartial with respect to all market participants.

Allocation and use of scarce resources

Any procedures for the allocation and use of scarce resources, including frequencies, numbers and rights of way, will be carried out in an objective, timely, transparent and nondiscriminatory manner. The current state of allocated frequency bands will be made publicly available, but detailed identification of frequencies allocated for specific government uses is not required.
