Pertamina, KBRI Hanoi, K,Rl Ho Chi Minh City serta KADIN-Komite CLMV' sedangkan dari pihak Vietnam dipimpin oleh Menteri Perindustrian dan Perdagangan. bersahabat dan saling penuh pengertian dalam upaya untuk meningkatkan hubungan baik yang setama ini sudah terjalin serta meningkatkan kerjasama diberbagai sektor. peningkatan hubungan kerjasama bilateral kedua negara dalam bidang p€rdagangan, investasi, eneag dan sumber daya alam mineral, perikanan, pe/tanian, transportasi, pendidikan dan latihan, kesehatan, pariwisata dan kebudayaan, perbankan, industri, konstruksi serta Information Communication Technolosr (lCT).

Sebagaimana diketahui bahwa total perdagangan bilateral Indonesi+Vietnam pada tahun 2008 terc€tat sebesar US$ 2,4 milyat, naik sebesar 1,75% dibandingkan dengan tahun 2007 yang lercatat sebesar US$ 2,3 milyar. Laiu pertumbuhan perdagangan ratarata selama periode 2oo42oo8 positif 27€%. Meskipun nilai perdaEangan Indonesia Vietnam mengalami peningkatan yang cukup baik, namun dipandang masih terdapat petuang untuk dapat tebih meningfiatkan total volume perdagangan diantara keduanya. Untuk itu, kedua pihak sepekat untuk mengidentifikasi peluang-peluang yang dapat dikembangkan dalam meningkatkan hubungan perda€Angan antar kedua negara.

Penandatangan kontrak bisnis antara Caraka Group, dengan mitra dagangnya di Viet Nam dalam upaya menjajaki peluang kerjasama di bidangjasa kargo.
Dalam pertemuan komisi bers€ma, kedua Menteri Perdagjangan R.l. telah mengajukan ide pembentukan suatu mekanisme komunikasi melalui satu "window" dari maslngmasing pihak yang akan berfungsi untuk mengidentmkasi peluang peningkatan hubungan p€rdagangan dan ihvestasi sekali€ius sebagai focaf pornt menyelesaikan masalah-masalah perdagangan dan investasi yang timbul dalam hubungan bilateral kedua negara. Kedua Menteri kemudian sepakat untuk menunjuk masing.rnasing pejabat dari Oepartemen Petdagangan R.l. dan dari Departemen perindustrian dan Perdagangan Vietnam untuk membahas secara teknis mekanisme komunikasi tersebut. Dalam kunjungan ke Ho Chi Minh City Mentefi PedaganEan luga telah rnelakukan kunjungan kehormatan kepada Deputi Perdana Menteri Viet Nam dan Gubernur Ho Chi Minh City serta menjadi pembicara pada Asia Society Conference.

Bersamaan dengan pertemuan Komisi Bersama, Menteri perdagangan R.l juga telah mengadakan Business Forum Indonesia-Viet Nam pada tanggal 24 Aprit 2OO9 di Ho Chi Mlnh City. Buslness Forum dihadiri oleh 140 orang pengusaha Viet Nam dengan ,ine of business antara fain batubara, perikanan, food & bevera€es, agricutture, farming eguipments, farmasi, jasa logistik, property & ,.eal estate. Business Forum juga Lelah dihadiri oleh Menteri Perindustrian dan Perdagangan Vietnam-

Eusiness Forum dibuka oleh Dubes Indonesia untuk Viet Nam ditanjutkan dengan keynote speech oleh Menteri lndustri dan Perdagangan Viet Nam yang menekankan perfunya pengembangan hubungan dagang tndonesia-Met Nam (Enhancing lndonesiaViet Nam lrade) sebagai sesama negar:r anggota ASEAN. Pada kegiatan tersebut, Menteri Perdagangan R.l telah memberikan paparan dan p€njetasan mengenaj perkembangan perekonomian, perdagangan dan kebijakan investasi di fndonesia serta perkembangan hubungan perdagangan antara kedua negara. Selain itu, Menteri
Perdagangan R.l. juga telah memaparkan beberapa langkah kedepan untuk memperkuat hubungan bilateral kedua negara antara lain dengan mengajak pengusaha dan investor Metnam untuk melakukan bisnis dan investasinva dl lndonesia.

INTRODUCTION

Pursuant to the Agreed Minutes of the Fourth Meeting of the Indonesia - Viet Nam Joint Commission on Economic, Scientific and Technical Cooperation (JCESTC) held on 5s Rpril 2O07 in Jakarta, Indonesia, the Fiffh Meeting of the JCESTC was held in Ho Chi Minh City, Viet Nam on 25s April 2009. 1

The Indonesian. Delegation was headed by H.E. Mrs. Mari Elka Pangestii, Minister of Trade of the Republic of Indonesia. The Vietnamese Delegation was headed by H.E. Mr. Vu Huy Hoang, Minister of lndustry and Trade of the Sociaiist Republic of Vier Nam. The lists ofthe delegations appeared as Annexes 1 and 2, respectively.

The Ministerial Meeting was co-chaired by the Heads of Delegation and preceded by the Senior Official Meeting on 23'd and 24'\ April 2009. The Meeting discussed a number of bilateral issues with a view to further enhancing the existing ties of friendship and mutually beneficial cooperation in various areas between the fwo countries. The Meeting was held in cordial atnosphere, friendship and mutual understanding.

In his opening remarks, the Minister of Industry and Trade of the Socialist Republic of Viet Nam extended a warm welcome to the Minister of Trade of the Republic of Indonesia and rnembers of the Indonesian Delegation. The Minister briefed the Meeting on the latest economic and trade relations between the two countries at bilateral and regional level. The Minister reviewed with satisfaction the progress and achievements in bilateral relations between Indonesia and Viet Nam and

their cooperation in multilateral frameworks, particularly ASEAN and APEC:

The Minister of Trade of the Republic of Indonesi4 in her
opening remarks, overviewed the Indonesian economic performance and bilateral trade relations between the two countries. She expressed the hope that this Fifth Meeting would lead to further enhancement of their bilateral economic and trade relations for the mutual benefits of both countries. To this end, the Minister informed the Meeting that she had brought an Indonesian business delegation to intensiff economic and trade relations befween the two countries.

Both sides underlined the important role of the JCESTC in initiating specific measures to promote economic, scientific and technical cooperation between the two countries. The texts of the opening remarks appeared as Annexes 3 and 4, respectively.

Both sides recognized the importance of the Joint Declaration on the Framework for Friendly and Comprehensive Cooperation in the 21st century between the Republic oflndonesia and the Socialist Republic of Viet Nam signed in June 2003. Based on the Joint Declaration and with the aim of further enhancing comprehensively all aspects of cooperation between the two counties, the Vietnamese side highly appreciates if the Indonesian side finalizes and exchanges views on the Action Plan 2008 201 1 as soon as possible.
II.
ADOPTION OF THE AGENDA OF TIIE FIFTII MEETING OF JCESTC

DISCUSSION ON BILATERAL COOPERATIONS
The highlights of the discussion on bilateral cooperation were follows:

The Meeting noted that the two way trade volume between the two countries has been increasing remarkably and there was great potential available for the bilateral trade to grow further,

The Vietnamese side acknowledged the Indonesian Government's in granting tariff preferences under the AISP scheme to Vietnarnese products in the last years. The Indonesian side informed the Meeting that the AISP scheme had been provided to some Vietnamese products since 2003 and the latest list would be expired in May, 2009. In this regard, the Indonesian side requested the Vietnamese side to provide a new list of AISP for further consideration in granting tariff preferences. The Vietnamese side took note of this request and would hand over the requested product list as soon as possible.

Both side shared the same view that food security is not only national- but also regional and global issue of primary concern which requires close cooperation between the two countries and any individual country in the region. The Memorandum of Understanding on Rice Trade signed in Jakarta on 5'n April 2007 between the two countries served as an important undertaking to contribute into the assr.rance of food security in the two cormtries in case of emergency needs. In such
spirit, boft sides had concluded the renewed Memorandum of Understanding on Rice Trade, signed by the two Ministers on 25s April 2009.

Both sides agreed to continue encouraging and
supporting enterprises and industry associations of the two countries in promoting the bitateral hade activities.

Both sides acknowledged the business meeting which was held at the sideline of the Fifth Meeting of ICESTC. Both Ministers welcomed and witnessed the signing of Memoranda of Understanding between the private sectors ofthe two countries.

Both sides shared the view on the importance of promoting the exchange of information, experiences and expertise in the field of consumer protection.

The Indonesian side proposed the Vietnamese side to facilitate the of Indonesian companies to Vietnamese anthracite supply. Investment
In order to further promote
investment cooperation, both sides agreed to enhance the information exchange on investrnent environment
of each"country, to study the foreign investment policy of each country to find out an encouraging mechanism for investment between the tuo countries, to exchange missions to explore new investment opportunities in t}le two countries, and to assist in training foreigrr investment management staffs.

Both sides highly appreciated the effective cooperation among Indonesia, Viet Nam, and Malaysia through tlree oil and gas companies: Pertamina (Indonesia), Petrovietnam (Viet Nam) and Petronas (Maiaysia) in the existing projects in Viet Nam, lndonesia, and Malaysia. Both sides expressed their aspiration of developing this tdpartite cooperation as a model for cooperation among ASEAN members.

The Indonesian side took note of the Viebnamese side's proposal to facilitate bilateral cooperation befween Petrovietnam and Pertamina to enable Petrovietnarn buying gas from the Natuna D Alpha field and carrying out other exploration and production projects in Indonesia.

The Indonesian side took note of the Vietlramese side's proposal to facilitate the access of Vietnamese companies to Indonesian counterparts to seek for possibilities of cooperation on coal exploration and exploitation in lndonesia.

Both sides acknowledged cooperation in education and training in the field of petroleum and proposed to extend such cooperation in the fields of electricity, coal mining (including underground) and renewable energy.

Fisheries'
Both sides acknowledged the importance of fisheries cooperation between Viet Nam and Indonesia and would encourage the promotion of fisheries cooperation between the two countries.

The Indonesian side took note of the proposal of the Vieb:amese side on promoting fishing ventures between enterprises of the nvo countries.

The Vietnamese side requested the lndonesian side to respond to the counter-draft of the Memorandum of Understanding on Marine Affairs and Fisheries Cooperation with the aim of an early conclusion of this Memorandum of Understanding. The Vietnamese side would send a delegation to Indonesia for further discussion on this issue in the year of 2009.

Bbth sides agreed that other bilateral fisheries and marine issues including but not limited to fisheries management should be discussed in appropriate fora to enhance the cooperation on fisheries'

The Indonesian side informed the Meeting of the regulations of the Republic of lndonesia regarding Capture Fishery Business. The Indonesian side hoped that the Vietnamese side could convey the mentioned regulations to the Vietnamese business sectors. E.
Agriculture

Both sides recognized that Indonesia and Viet Nam are two big markets for agriculnral commodities however the cooperation is still limited and needs to be expanded.

To promote the cooperation in this fiel{ both sides agreed to conclude the Memorandum of Understanding on Agricultual Commodities. Both sides aiso agreed to promote cooperation on exchange of information on Production, Post Harvest TreaEnents including Post Hawest Preservation or its Marketing relevant to the agricultural products such as coffee, pepper, tea and rubber by establishing a joint committee for each relevant commodity if necessary.

The Indonesian side suggested to conduct joint research on hybrid in production agricultural research institutes of the two countries.

Transportation
Both sides recognized the effectiveness 6f the implenientation of the Aleement on Maritime Merchant Shipping, the Agreement on Air Transportation signed on 25 October 1991, the Letter of Undertaking on Mutual Recognition of Certificate of Competency in accordance with

Education and Training
T.he Vietnamese side welcomed the scholarship exchange progr:rms between the two governments and requested the Indonesian side to continue providing undergraduate, master-degree and doctordegree scholarships for \tetnamese students and researchers, as well as to send Indonesian students and researchers to shrdy for undergraduate, master and doctor degrees in Viet Nam.

The Indonesian side informed the VieDramese side on the offer granted by the Deparrment of Foreign Affairs of the Republic of . Indonesia to the Vietnamese diplomats for participating in the Promotion of Indonesia Language Program foi Foreign Diplomats on October - November 2009 and the Short Diplomatic Course for Cambodian, Laotian, Myanmarese and Vietnamese (CLMV) Diplomats on October- November 2009.

The Viehamese side proposed that both sides should initiate negotiations on an agreement on mutual recognition of equ.ivalent credentials for undergraduate education to facilitate the exchange of sfudents between educational institutions of the two countries.

Both sides agreed to further enhance their exchange of experience on Good Manufacturing Practice for medicine, vaccine especially medicine fiom herbs.

Both sides agreed to exchange experience on traditional medicine including management, production, planting and nourishing.

Tourism and Culture
Both sides agreed to further enhance. the exchange of missions to leam exlrerience in tourist developmen! particularly in planning tourist destination island and world-class tourist destination.
45. The Vienramese side suggested that both sides should study the possibility of setting up joint promotion programs at the intemational tourist fairs and on international media.
46, The lndonesian side suggested that both sides should promote cooperation in historical religious or pilgrimage tourism, based on Borobudur Declaration signed in 2006 by six members of ASEAN countries including Viet Nam.

Banking
Both sides appreciated bilateral cooperation between their. central banks regarding banking business and exchange of information based on the Memorandum of Understanding signed in 2000 and, within the scope of their respective legislative framework, would endeavor to their best efforts to enhancing cooperation aimed at developing collaborition of financial and banking activities.

In exploring the implementation of the cooperation, both sides are expected to make an initial observation of the existing SMEs development of each side.

Both sides agreed to promote exohange missions to facilitae
strategic cooperation between enterprises of the two countries in providing construction services in accordance with the laws and regulations of the respective country.

fnformation Communication Technology
Both sides took note of the existing cooperation between the two countrie3 in the intemational and regional organizations.

Both sides agreed to promote the bilateral cooperation in the fields of information and communication technology through the following activities: exchanging information and experience in state administration, developing cooperation on human resources, encouraging and facilitating contacts between ICT enterprises ofthe two countries to explore business opportunitios in trading, producing and supplying services and equipments.

Both sides agreed to hold the Sixth Meeting of the JCESTC in Indonesia at the date and venue to be mutually agreed upon through diplomatic channels.
V.
ACKNOWLEDGMENT
Both sides expressed their satisfaction over the results of the Fifth Meeting of JCESTC between the Republic of Indonesia and the Socialist Republic of Viet Nam, which was held in cordial atmosphere, friendship and mutual understanding.
The lndonesian delegation expressed their appreciation to the Vietramese delegation for the warm welcome and hospiuliq' accorded to them during their stay in Ho Chi Minh Citl and for the excellent arrangement made for the Meeting.
