Pemerintah Republik Indonesia dan Pemerintah Australia, untuk selanjutnya disebut dengan istilah "Para Pihak". •
Mempertimbangkan fungsi-fungsi Misi-misi Konsuler dan Diplomatik dalam melindungi dan mengan1ankan hnk-hak dan kepentingan-kepentingan Negara Pengirin1 serta \Varga-warga negaranya dalam batasan-batasan yang diijinkan oJeh hukum internasiunal~
•
Memperhatikan adanya kebutuhan untuk meningkatkan komunikasi yang lebih baik tentang perlindungan kekonsuleran sebagaimana diatur dalmn Konvensi Wina Tahun 1963 tentang Hubungan-hubungan Konsuler dan Konvensi Wina Tahun 196l tentang Hubungan-hubungan Diplomatik untuk mengatur komunik?.si din1aksud serta menjamin keterbukaannya;

Berkeinginan untuk memperkuat kerjasama bilateral dalam 1nengku1nunikasikan perlindungan yang efektifbagi kepcntingan \Varga kedua negara di masing-masing negara Pihak;
•
Berdasarkan pada !lltkum dan per:tturan yang berlaku di masing-masing negara;
Telah mencapai pengertian hersama sebagai berikut:
Bagian l Definisi Untuk tujuan--tujuan Pengaturan ini, maka istilah-istilah berikut akan memiliki pengertian sebagaimana dijelaskan di ba\vah ini:
1. aMisi Diplomatik" adalah perwakilan resmi dari ncgara pengirim di negara penerima yang melakukan fungsi-fungsi diplomatik berdasarkan pada Konvensi Wina Tahun 1961 tentang Hubungan-hubungan Diplon1atik;
2. ''Pos Konsuler" adalah setiap Konsulat JenderaL Konsulat, Wakil Konsulat atau, jika sesuai, Agen Konsuler; 3. "Wilayah Konsuler" adalah daerah yang ditentukan pada sebuah Pos Konsuler untuk melakukan fungsi-fungsi konsulec

"Fungsi-fungsi Konsuler'· adalah merujuk pada fungsi-fungsi konsuler sebagaimana tercantum dalam Pasal 5 Konvcnsi \"/ina Tahun 1963 tentang Hubung,m-h Ibungan Kousu]er serta dapat pula dijalankan okh misi dipl01natik sesuai dengan Pasal 3 (2) Konvensi Wina Tahun 1961 tentang Hubungan-hubungan Diplomatik; 1

Bagian 2 Fungsi-fungsi Konsuler 1. Fungsi-fungsi konsuler dilaksar.akan olch pos-pos konsuler. Hal-·hal ditTtaksud juga dapat dilaksanakan oleh misi-rnisi diplomatik sesuai dengan ketentuan Pasal 3 Konvensi Vlina Tahnn 1961 tnengenai Hubnngttn-h1.tbungan Diplomatik dan Pa~al 70 Konvensi Wina Tahun 1963 n1engen?i Hubungan-hubungan Konsuler.

Bagian 3 Pelaksanaan Fungsi-fungsi Konsuler di dalam dan di luar wila)'ah konsuler a tau atas nan1a Pihak Ketiga

1. Sesuai dengan undang-undang dan peraturan-peraturan 1\Jeg2ra penerima, pejabatpejahat konsuler tnetniliki hak untu~< melaksanakan ftmg·;i-tungsi konsuler di dalarn wilayah konsuler. 2. Seorang pejabat konsuler dapat, dalam keadaan J:husus, atas persetujuan Negara penerima, rne1rksanakan fungsi- fungsi eli Juar wilayah knnsulcmya. 3. Atas dasar notifikasi yang sesuai kepada Neggra peneritna, sebuah pos konsuler atau mist diplomatik Negara pengirim dapm, kecuali Negara penerima berkrberatan, melaksaea:

Bagian 4 Komunikasi dengan Otoritas yang Berwenang dari Negara Penerima Dalam melaksanakan fungsi-fungsinya, pejabat-pejabat konsuler dapat menghubungi: a. otoritas setempat yang berwenang di wilayah konsulemya: b. otoritas pusat yang berwenang dari Negara penerilna, jika, dan sampai sebatas hal tersebut diijinkan oleh undang-undang, peraturan-peraturan. dan kebiasaan dari Negara penerima atau oleh perjanjian -perjanjian inten1asional yang relevan dimana kedua negara menjadi pihak.
Bagian 5 Prinsip-prinsip Dasar Notifikasi Konsuler dalam hal Penangkapan, Penahanan dan Peradilan 1. Apabila seorang warga negara dari Negara pengirin1 ditangkap. ditahan, atau ditawan dalam wilayah konsuler Negara penerin1a, otoritas yang berwenang dari Negara penerima akan menginformasikan kepada yang bersangkutan, tanpa penundaan, mengenai hak-hak dan pilihan-pilihan hukum, termasuk hak untuk tnenghubungi pos konsuler ~tau n1isi diplon1atiknya~ scrta akan 1nen1fasilitasi komunikasi dengan pos konsuler atau misi diplornatik.nya. 2. Para Pihak akan n1enjamin, atas dasar resiprositas, bahwa warga negara dari Negara pengirim yang ditangkap, ditahan atau ditawan, akan diperlakukan dengan adil dan sctara se:;uai dengan undang-undang Negara penerima. 3. Negara pengirim berhak untuk tnendapatkan notifikasi bahwa seorang warga negaranya telah ditangkap, ditahan a~au ditawan, sesuai dengan undang-undang dan peraturan-peraturan yang herlaku di Negara penerin1a.
Bagian 6 Notifik::tsi dan Bantuan di dalam hal Penangkapan, Penahanan dan Peradilan 1. Otoritas yang berwenang dari Negara penerima akan memberitahukan pos konsuler atau misi rliplomatik dari Negara pengirim tanpa penundaan dan dalam waktu tiga hari kerja bahwa warga neghra rlari Negara pengirim telah ditangkap, ditahan, atau ditawan. 2. Informasi mengenai seorang warga negara yang telah ditangkap, ditahan atau ditawan di lokasi n1anapun di Negara penerima, akan disampaikan kepada pos konsuler atau misi diplomatik Negara pengirirn dengan persetujuan warga negara tersebut dan sesuai dengan Konvensi Wina tahun 1963 mengenai Hubungan-hubungan Konsuler serta undang-undang dan peraturan-peraturan Negara penerima yang relevan. Jika orang tersebut tidak memberikan persetujuannya, Negara penerima juga akan memheritahukan pos konsuler atau misi diplomatik secara tertulis mengenai hal ini,
sesuai dengan undang-undang dan peraturan-peraturan Negara penerima. -'· Komunikasi apapun yang ditujukan kepada pos konsuler atau misi diplomatik oleh warga negara dari N egara Pengirim yang ditangkap, ditahan atau ditawan akan difasilitasi dan diteruskan tanpa penundaan oleh otoritas yang berwenang dari Negara penerima pada pos konsuler atau misi diplomatik Negara pengirim. 4. Pejabat konsuler memiliki hak untuk berkunjung dan berkomunikasi dengan \Varga negaranya yang ditangkap. ditahan atau ditawan dan mengatur perwakilan hukum baginya atas dasar persetujuan yang bersangkutan. Otoritas yang berwenang dari Negara penerima akan dengan segera membuat pengaturan kunjungan dari pos konsuler atau misi diplomatik terhadap warga negara tersebut. Jika orang tersebut tidak memberikan izinnya, Negara penerima akan memberitahukan pos konsuler atau misi diplomatik secara tertulis mengenai hal ini, berdasarkan pada undang-undang dan peraturan-peraturan Negara penerima. 5. Seorang warga negara yang ditangkap, ditahan atau ditawan akan berhak untuk menerima dan mengirim surat -surat dan korespondensi lainnya se11a menerima barang-barang, obat-obatan, dan hal-hal lain untuk penggunac:.n pribadi dalam batasbatas yang ditentukan oleh undang-undang dan peraturan-peraturan yang berlaku dari N egara penerima 6.
Otoritas yang berwenang dari Negara penerima. atas dasar pern1intaan warga negara yang ditangkap atau ditahan, akan men1beritahukan pejabat konsuler Negara pengirim mengenai keadaan dan penyebab tuduhan-tuduhan terhadapnya, waktu, tanggal dan tempat yang ditetapkan untuk peradilan atau proses beracara lainnya. Seorang pejabat konsuler akan memiliki hak untuk menghadiri sidang atau proses beracara lainnya, apabila sidang tersebut terbuka untuk umum. Dalam hal persidangan bersifat tertutup. pejabat konsuler berhak untuk menghadiri sidang tersebut atas permintaan warga negara yang ditangkap atau ditahan, apabila peraturan persidangan memungkinkan.
Bagian 7 Informasi di dalam Kasus-kasus Kematian Jika informasi terkait kematian se01·ang warga negara dari Negara pengirim didapat oleh otoritas yang berwenang dari Negara penerima, otoritas tersebut memiliki kewajiban untuk menginformasikan tanpa penundaan kepada pos konsuler atau misi diplomatik terdekat dari Negara pengirin1 dan menyediakan, berdasarkan permintaan pos konsuler, sertifikat kematian atau salinan dokumen-dokun1en res1ni lainnya yang menyatakan kematian.
Bagian 8 Perlindungan bagi Warga Negara di bawah Umur dan dengan Kelainan Fisik
1. Pejabat konsuler berhak untuk menjaga, dalam batasan-batasan yang ditentukan oleh undang-undang dan peraturan-peraturan Negara penerima, kepentingan warga negara,
termasuk \Varga negara di bawah umur dan orang laitmya yang kurang berkemampuan penuh, dari Negara pengirin1 yang tidak tnemiliki kapasitas atau memiliki kapasitas terbatas untuk bertindak atas nama dirinya sendiri. 2. Otoritas yang berwenang dari Negara penerima akan menginformasikan pos konsuler atau misl diplomatik yang berwenang tanpa penundaan terhadap kasus apapun terkait penunjukkan wali atau pengampu yang bertindak atas kepentingan orang di bawah umur atau orang lainnnya yang metniliki kurang berkemampuan penuh yang merupakan warga negara dari Negara pengirin1. Pe1nberian informasi ini akan, bagaimanapun, tanpa n1engurangi pelaksanaan undang-undang dan peraturanperaturan Negara penerima n1engenai penunjukkan tersebut.
Bagian 9 Bantuan terhadap Kapal-kapal dari Negara Pengirim 1. Pejabat konsuler memiliki hak untuk memberikan bantuan terhadap kapal-kapal yang memiliki nasionalitas dari Negara pengirim yang berada di wilayah, laut wilayah, perairan kepulauan a tau perairan pedal am an dari N egara penerima, dan kepada kapten dan anggota anak buah kapalnya, serta: a.
menaiki kapal ketika akses bebas me11uju pantai telah d.iberikan kepada k8pal, menanyakan kapten dan setiap anak buah kapal serta menerima laporan-laporan mengcnai kapal, m.uatan dan pelayarannya;
b. tanpa tnengabaikan kewenangan otoritas dari Negara penerima, menyelidiki setiap kejadian yang terjadi selama pelayaran~ c.
memfasilitasi setiap penyelesaian sengketa-sengketa apapun antara kapten dan anak buah kapal sejauh mana hal ini diberi kewenangan oleh undang-undang dan peraturan-peraturan dari Negara penerima~
d. menerin1a kunjungan dari kapten atau anak buah kapal, dan, apabila diperlukan, membuat pengaturan-pcngaturan untuk perawatan kesehatan atan pemulangan mereka; e.
menerima, memeriksa, menyusun, menandatangani dan mengcsahkan dokumendokumen yang berhubun~an dengan kapal; dan
f.
menangani hal-hal lain yang berkaitan dengan kapal, yang diberikan tugas oleh otoritas yang bcrwenang dari Negara pengirim.
2. Kapten dan setiap anak buah kapal dapat menghubungi pejabat konsnler. Mereka dapat mendatangi pos konsuler atau misi diplomatik sesuai dengan undang-undang dan peraturan-peraturan dari Negara Pengirim. 3. Hak-hak yang mengacu pada sub-bagian 1 dan 2 dari Bagian ini akan dilaksanakan sesuai dengan undang-undang dan peraturan-peraturan dari Negara penerima.
Bagian 10 Notifikasi terkait Tindakan-Tindakan Wajib yang dilakukan terhadap Kapal dari Negara Pengirim 1. Ketika pengadilan atau otoritas lain yang berwenang dari Negara penerima bemiat
untuk menerapkan tindakan-tindakan wajib atau men1ulai penyelidikan resmi terkait kapal atau naik ke atas kapal yang memiliki nasionalitas dari Negara pengirim, otoritas tersebut akan memberikan notifikasi pos konsuler atau n1isi diplomatik terlebih dahulu guna memungkinkan bagi seorang pejabat konsuler untuk hadir pada saat tindakan-tindakan tersebut dilaksanakan. Apabila dalam keadaan yang mendesak tidak dimungkinkan untuk dilakukan pemberitahuan terlebih dahulu, otoritas yang berwenang di Negara penerima akan memberitahukan pos konsuler atau misi diplomatik segera setelah tindakan-tindakan tersebut dilakukan dan dengan segera menjelaskan semua rincian tindakan-tindakan yang telah dilakukan, atas permintaan dari Pejabat Konsuler. 2. Ketentuan mengenai pemberitahuan pada sub-bagian 1 dari 13agian ini akan berlaku terhadap tindakan-tindakan serupa yang dilakukan di pantai oleh otoritas yang berwenang dari Negara penerima terhadap kapten kapal atau anak buah kapal lainnya, berdasarkan undang-undang dan peraturan-peraturan yang berlaku di Negara penenma~
3. Ketentuan-ketentuan pada sub-bagian 1 dan 2 pada Bagian ini tidak akan berlaku terhadap suatu pemeriksaan rutin yang dilakukan oleh otoritas-otoritas yang berwenang dari Negara penerima terkait masalah cukai, administrasi pelabuhanpelabuhan, karantina atau pemeriksaan perbatasan, atau terkait upaya-upaya yang dilakukan oleh otoritas serupa dalam rangka menjamin keselamatan pelayaran di laut atau pencegahan pencemaran perairan~ 4. Kecuali atas permintaan atau dengan persetujuan kapten kapal yang memiliki nasionalitas dari Negara pengirim atau seorang pejabat Konsuler, otoritas-otoritas yang berwenang dari N egara penerima tidak akan mencampuri urusan di dalam kapal, ketika tidak terdapat pelanggaran terhadap ketenangan, keamanan dan ketertiban umum Negara penerima.
Bagian 1I Bantuan kepada Kapal Karam dari Negara Pengirim
1. Apabila suatu kapal yang

nasionalitas dari Negara pengirim, karam atau terdampar di \vilayah, laut wilayah. perairan kepulauan atau perairan pedalaman dari Negara penerima, otoritas yang berwenang dari Negara penerima akan merr1beritahu dengan segera pos konsuler atau misi diplomatik terdekat dengan tempat kejadian dengan atas tindakan-tindakan penyelamatan yang dilakukan terhadap orang-orang yang berada di atas kapal, kapal dan muatan dan barang-barang lainnya.
2. Pejabat konsuler berhak untuk melakukan tindakan-tindakan sejauh diperbolehkan oleh undang-undang dan peraturan-peraturan Negara penerima, untuk memberikan
banruan kepada setiap kapal karan1 yang men1iliki nasionalitas dari Negara pengirim dan terhadap anak buah kapal dan penumpangnya dan, dalam kaitan ini, men1inta bantuan dari otoritas-otoritas dari Negara penerima. 3. Apabila suatu kapal karam yang memiliki nasionalitas dari Negara pengirim atau barang-barang atau n1uatan yang ditemukan dekat pantai, atau yang dibawa masuk ke dalam pelahuhan Negara penenma dan tidak satupun kaptcn atau pemilik kapaL atau penvakilan dari perusahaan kapal atau perusahaan asuransi yang hadir atau berada dalam posisi yang tnemungkinkan untuk mengambil tindakan-tindakan untuk pemeliharaan atau pemusnahan, otoritas-otoritas yang berwenang dari Negata penerima akan memberitahu pos konsuler atau misi diplotnatik sesegcra mungkin. Pejabat konsuler dapat mengambil tindakan yang pantas atas nan1a pemilik kapal. 4. Kapal karatn yang memiliki nasionalitas Negara pengirim serta muatan dan barangbarangnya tidak akan dikenai kewajiban bea masuk atau bea-bea lainnya yang sejenis oleh Negara penerima dengan syarat pengiriman tersebut bukan dimaksudkan untuk dijual atau digunakan di Negara penerima.
Bagian 12 Pesawat Negara Pengirim Ketentuan-ketentuan pengaturan ini mengenai kapal yang memiliki nasionalitas dari Negara pengirim ini akan berlaku pula kepada pesawat yang didaftarkan di Negara pengirim dengan syarat bahwa penerapannya dimaksud tidak betientangan dengan ketentuan-ketentuan perjanjian-perjanjian bilateral yang berlaku mengikat di antara Negara pengirim dan Negara penerima atau perjanjian multilateral dimana kedua negara merupakan Pihak.
Bagian 13 Konsultasi-konsultasi Para Pihak sepakat bertemu untuk konsultasi setiap tahun atau sewaktu-waktu dibutuhkan untuk mengkaji hubungan kekonsuleran. Salah satu Pihak dapat juga meminta konsultasikonsultasi terkait berbagai masalah kekonsuleran sebagaimana dibutubkan dari waktu ke waktu.
Bagian 14 Amandemen Pengaturan ini dapat diamandemen secara tertulis setiap ~aat berdasarkan kesepakatan para Pihak. Amandemen tersebut akan mulai berlaku pada tanggal yang telah ditetapkan oleh para Pihak dan akan menjadi bagian yang tidak terpisahkan dari Pengaturan ini.

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON CONSULAR NOTIFICATION AND ASSISTANCE

The Government of Australia and the Government of the Republic of l~donesia. hereinafter referred to as ''the Parties". •
Considering the functions of Consular and Diplomatic l\1issions in protecting and securing the rights and interests of the Sending State and those of its nationals within the limits permitted by international law:
•
Taking into account of the need to promote better communication regarding the consular protection as set out in the 1963 Vienna L~ onvention on Consular Relations and 1961 Vienna Convention on Diplomatic Relations in order to arrange for such communication and ensure its transparency:
•
Desiring to strengthen bilateral cooperation in the communication of the effective protection of interests of both nationals in the Parties' countries;
•
Pursuant to the prevailing laws and regulations of the respective countries:
Have reached a common understanding as follows:
Section 1 Defini tions
For the purposes of the present Arrangemen t~ the follow!ng expressions will have the meanings hereunder assigned to them: I. "Diplomatic Mission" means official representatives of the sending state in the receiving state who conduct diplomatic function~ pursuant to the 1961 Vienna Convention on Diplomatic Relations; 2. "Consular Post" means any Corsulate-Ceneral, Constdate, Vice-Conc;;ulate or, where appropriate, Consular Agency; 3. "Consular District" means the area assigned to a consul:;,r rost for the exercise of consular functions;
4. "Consular Functions'' refers to those consular functions listed in Article 5 of the 1963 Vienna Convention on Consular Relations and may be performed by diplomatic missions in accordance with Article 3(2) of the 1961 Vienna Convention on Diplomatic Relations; 5. "Head of Consular Post" means the person charged with the duty of acting in that capacity; 6. "Consular Officer " means any person, including the head of a consular post, entrusted in that capacity with the exercise of consu iar functions~
Section 2 Consular Functions
I. Consular functions are exercised by consular posts. They are also exercised by diplomatic missions in accordance with Article 3 of the 1961 Vienna Convention on Diplomatic Relations and Article 70 of the 1963 Vienna Convention on Consular Relations. 2. Nothing in this Arrangement will be construed as preventing the performance of consular functions by a diplomatic mission. 3. The names and ranks of the members of the consular and diplomatic staff charged with the exercise of consular functions of the mission will be notified to the Ministry of Foreign Affairs of the receiving State, including upon changes to personnel.
Section 3 Exercise of Consular Functions within and Outside the Consular District or On Behalf of a Third Party
1. In accordance with the laws and regulations of the receiving State, consular officers are entitled to exercise within the consular district the consular functions. 2. A consular officer may, in special circumstances, with the consent of the receiving State, exercise his or her functions outside his or her consular district. 3. Upon appropriate notification to the receiving State, a consular post or diplomatic mission ofthe sending State may, unless the receiving State objects, exercise consular functions in the receiving State on behalf of a third State.
Section 4 Communication with the Authorities of the Receiving State
I. In the exercise of their functions. consular ofticers may address: a. the competent local authorities of their consular district; b. the competent central authorities of the receiving Stat~. if, and to the e~:tent that, this is allowed by the laws, regulations and usages of the receiving State or by relevant international agreements to which both states are parties.
Section 5 Consular Notification Basic Principles in respect of Arrest, Detention and Trial 1. If a national of the sending State is arrested, detained or apprehended within the consular
district of the receiving State, the competent authorities of the receiving State will inform him/her without delay of his/her legal rights and options, including the right to contact his/her consular post or diplomatic mission~ and will facilitate communication with his/her consular post or diplomatic mission~ 2. The Parties will ensure, upon a reciprocal basis, that the arrested, detained, or apprehended national of the sending State will receive fair and equal treatment under the laws ofthe receiving State. 3. The sending State is entitled to be notitled that a nati0nnl of the sending State has been arrested. detained or apprehended, subject to the laws and regulations of the receiving State. Section 6 Notification and Assistance in respect of Arre::;t. Detention and Trial

competent authorities of the receiving State will without delay and within three working days inform the consular post or diplomatic mission of the ~ending State that a national of the sending State has been C!rrested. detained, or apprehended.
2. Information concerning a national who has been arrested, detained or apprehended in any !or-ation in the receiving State, will be provided to the consular post or diplomatic mission of the sending State where the national has consented and in accordance with the 1963 Vienna Convention on Consular Relations and relevant laws and regulations of the receiving State. If that particular person has not extended his or her consent, the receiving state will also inform in writing the consular post or diplomatic miss;on of this matter, subject to the laws and regulations ofthe receiving State. 1. Any communication addressed to the consular post or diplomatic mission by the arrested. detained or apprehended national of the sending State will be facilitated and forwarded by the competent authorities of the receiving State to the consular post or diplomatic mi~sion ~)fthe sending State without delay.
4. A consular officer will have the right to visit and communicate with his or her arrested, det::1ined or apprehended national and to arrange for his or her legal representation, subject to his or her consent. The competent authorities of the receiving State will make prompt arrangements for the visit to the said national by such consular post or diplomatic mission. If that pa11icular person has not extended his or her consent, the receiving state will to inform in writing the consular post or diplomatic mission of this matter, subject to the laws and regulations of the receiving State. 5. An arrested, detained or apprehended national will be entitled to receive and to send letters and other correspondence and to receive goods, medicines and other articles for personal use within the limits impos< d by the appli~able laws and regulations of the receiving State. 6.

c0mptter.t authoritie-s of the receiving State, upon the request of the arrestee or detainee, will inform a consular officer of the sending State of the nature and cause of the accusations against him/her. the time. date and place set for trial or other proceedings. A consular officer will be entitled to attend such trial or such other proceedings, provided the
trial is held in open court. In the case of closed court proceedings, a consular officer may attend the trial at the request of the arrestee or detainee, if the court rules permit this. 1-~

Section 7 Information in Cases of Death 1:
If the relevant information of the death of a national of the sending State is available to the competent authorities of the receiving State, such authorities will have the duty to inform without delay the nearby consular pest or diplomatic mission of the sending State and provide, upon the request of the consular post, a death certificate or a copy of other documents certifying the death.

Section 8 Protection of Minors and Disabled Nationals I. A consular officer will be entitled to safeguard, within the limits imposed by the Jaws and
regulations of the receiving State, the interests of a national, including a minor or other person lacking full capacity, of ~he sending State who has no capacity or limited capacity to act on his/her own behalf. 2. The competent authorities of the receiving State will inform the competent consular post or diplomatic mission without delay of any case where the appointment of a guardian or trustee appears to he in the interests of am in or or other person lacking full capacity who is a national of the sending State. The giving of this information will, however, be without prejudice to the operation of the laws and regulations of the receiving State concerning such appointments.
Section 9 Assistance to Vessels of the Sending State II!

1. A consular officer will be entitled to render assistance to vessels having the nationality of the sending State which are in the territory, territorial sea, archipelagic or internal waters of the receiving State, and to their master and crew members, and also: a. to board a vessel when free access to shore has been granted to the vessel, question the m<1ster and any member of the crew and receive reports on the vessel, its cargo and voyage;

b. without prejudice to the powers of the authorities of the receiving State, to investigate any incident which occurred during the voyage; 1':

c. to facilitate the settlement of disputes of any kind between master and crew insofar as this may be authorized by the laws and regulations ofthe sending State;
ct. to receive visits from the master or any member of the crew, and, when necessary, make arrangements for his or her medical treatment or return home;

to handle other matters relating to a vessel. which are entrusted by the competent authorities of the sending State.
2. The master and any member of the crew may contact a consular officer. They may go to
the consular post or diplomatic mission in accordance with the laws and regulations ofthe recetving State. 3. The rights referred to in sub-section 1 and 2 of this Section will be exercised in conformity with the laws and regulations ofth~ receiving State.
Section 10 Notification in case of Compulsory Actions against a Vessel of the Sending State 1. In case the courts or other competent authotities of the receiving State intend to take compulsory actions or start an official investigation with regard to a vessel or aboard a vessel having the nationality of the sending State, those authorities will notify the consular post or diplomatic mission in advance so as to enable a consular officer to be present when actions are taken. If the urgency of the matter prevents prior notification, the competent auth0rities of the receiving State will notify the consular post or diplomatic mission immediately after the actions have b,een taken and promptly provide his or her with full particulars of the said actions. upon the request of a consular officer. 2. The notification provisions of sub-section I of this Section will apply to simil,.r actions taken on shore by the competertt authorities of the receiving State against the master of a vessel or any member of the crew. subject to the laws and regulations of the receiving State; 3. The provisions of the sub-sections I and 2 of this Section will not apply to any routine inspection carried out by the competent authorities of the receiving State in relation to customs, administration of ports, quarantine or border check, nor to measures taken by such authorities to ensure navigation safety on sea or the prevention of pollution of waters; 4. Except upon request or with the consent of the master of a vessel having the nationality of the sending State or of a consular officer, the competent authorities of the receiving State will not interfere in the internal affairs of the vessel, when the peace, security and puhlic crder of the receiving State are not violated.
Section 11 Assistance to Wrecked Vessels of the Sending State I. If a vessel having the nationality of the sending State, is wrecked or runs aground in the territory. territorial sea, archipelagic or internal waters of the receiving State, the competent authorities of the receiving State will inform without delay the consular post or diplomatic mission nearest to the scene of the occurrence of the measures taken for rescuing the persons aboard, the vessel and its cargo and other properties. 2. A consular officer will be entitled to take measures to the extent permitted hy the laws and regulations of the receiving State, to render assistance to any wrecked vessel having the nationality of the sending State and its crew and passenger and to request assistance from the authorities of the receiving State in this connection.

3. If a wrecked vessel having the nationality of the sending State or its articles or cargo is found near the coast of, or is brought into a port of the receiving State and neither the master nor the owner ofthe vessel. nor any agent of the vessel's company or its insurance company is present or is in a position to take measures for their preservation or disposal, the competent authorities of the receiving State will inform the consular post or diplomatic mission as promptly as possible. A consular officer may take appropriate measures on behalf of the owner of the vessel. 4. A wrecked vessel having the nationality of the sending State and its cargo and articles will not be subjected to customs duties or other similar charges by the receiving State provided they are not delivered for sale or for use in the receiving State.
Section 12 Aircraft of the Sending State The provisions of this Arrangement concerning vessels having the nationality of the sending State will apply to aircraft registered in the sending State provided that such application does not contravene the provisions of bilateral agreements in force between the sending State and the receiving State or multilateral agreement to which both States are Parties.
Section 13 Consultations The Parties agree to meet for consultations annually or as needed to review the consular relationship. Either Party may also seek consultations on any consular matter as required from time to time.
Section 14 Amendment This Arrangement may be amended in writing at any time by mutual consent of the Parties. Such an amendment will come into effect on such a date as may be determined by the Parties and will form an integral part ofthis Arrangement.
Section 15 Settlement of Differences

Any difference arising out of the interpretation and implementation of this Arrangement will be settled amicably by consultation or negotiation between the Parties.
Section 16 Duration and Termination This Arrangement will enter into effect on the date of signing, and will remain in effect until the termination by either Party on six-month notice in writing to the other Party through diplomatic channels.
