PERSETUJUAN ANT ARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH KERAJAAN MAROKO TENT ANG KERJA SAMA EKONOMI, ILMU PENGETAHUAN DAN TEKNIK
Pemerintah Republik Indonesia dan Pemerintah Kerajaan Maroko, yang selanjutnya disebut
"Para Pihak": BERHASRAT untuk meningkatkan dan mempererat hubungan bilateral dan kerja sama untuk jangka waktu yang lama; MEYAKINI akan perlunya kerja sama yang efektif dan berkesinambungan untuk kepentingan kedua Negara; MENEGASKAN kepentingan kedua negara untuk memperkuat kerja sama bilateral antara kedua negara; DITUNTUN oleh keinginan untuk memperkuat hubungan persahabatan yang telah ada dan untuk memajukan perluasan kerja sama ekonomi, ilmu pengetahuan dan teknik antara kedua negara berdasarkan prinsip persamaan, saling menguntungkan dan menghormati kedaulatan mas ing-masing; MENYADARI perlunya suatu kerangka hukum yang tepat bagi hubungan Indonesia - Maroko yang sesuai dengan hukum dan peraturan perundang-undangan dari kedua negara; TELAH MENYETUJUI hal-hal sebagai berikut:
PASALI TUJUAN DAN RUANG LINGKUP KERJA SAMA 1. Para Pihak akan berusaha melakukan segala tindakan yang diper1ukan untuk mendorong, memajukan dan mengembangkan kerja sama ekonomi, ilmu pengetahuan, dan teknik antara kedua negara melalui kerangka kerja Persetujuan ini dan sesuai dengan hukum dan peraturan perundang-undangan kedua negara. 2. Kerja sama ekonomi sebagaimana dimaksud dalam Persetujuan ini akan mencakup dalam ruang lingkup pertanian, industri, energi, sumber daya alam, sumber daya manusia, transportasi , telekomunikasi, perikanan, konstruksi, dan bidang-bidang lain sebagaimana ditentukan oleh Para Pihak.

Konsultasi akan diselenggarakan secara prinsip sekurangnya sekali dalam satu tahun atau lebih apabila diperlukan, secara bergantian di Indonesia dan Maroko, pada tingkat Menteri Luar Negeri atau antara pejabat senior dari kedua kementerian luar negeri. Rincian mengenai tanggal , tempat, agenda dan tingkat dari wakil yang melakukan konsultasi akan disepakati melalui saluran diplomatik.
2.
Para Pihak akan menjamin kerahasiaan hasil konsultasi , dokumen-dokumen dan informasi yang dipertukarkan antara Para Pihak dan tidak akan menyampaikan atau menyerahkannya kepada pihak ketiga tanpa persetujuan sebelumnya dari Pihak lainnya.
3.
Apabila dipandang perfu , Para Pihak dapat membentuk, dengan kesepakatan bersama, kelompok kerja ad hoc yang terdiri dari para ahli untuk menangani isu-isu tertentu.
4.
Ketentuan Memorandum Saling Pengertian ini tidak akan melanggar perjanjianperjanjian dan persetujuan-persetujuan lain dimana kedua belah pihak menjadi pihak.
PASAL IV AMANDEMEN Memorandum Saling Pengertian ini dapat diamandemen atau direvisi dengan kesepakatan bersama para pihak. Amandemen atau revisi tersebut akan mulai berfaku pada tanggal yang disepakati oleh Para Pihak. PASAL V PENYELESAIAN PERSELISIHAN Setiap perselisihan atas penafsiran atau pelaksanaan dari Memorandum Saling Pengertian ini akan diselesaikan melalui konsultasi atau perundingan. PASALVI MULAI BERLAKU, MASA BERLAKU DAN PENGAKHIRAN Memorandum Saling Pengertian ini akan mulai ber1aku pada saat penandatanganan. Memorandum ini akan berlaku untuk jangka waktu 3 (tiga) tahun dan akan berlaku selanjutnya untuk jangka waktu yang sama, kecuali diakhiri oleh salah satu Pihak setelah memberikan pemberitahuan secara tertulis 3 (tiga) bulan sebelumnya.
SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah menandatangani Memorandum Saling Pengertian ini. DIBUAT di Rabat pada tanggal delapan bulan Juni tahun dua ribu delapan dalam rangkap dua, dalam bahasa Indonesia , bahasa Arab dan bahasa lnggris. Dalam hal terdapat perbedaan penafsiran, yang berlaku adalah naskah dalam bahasa lnggris.

REPUBLIK INDONESIA
AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE KINGDOM OF MOROCCO ON ECONOMIC, SCIENTIFIC, AND TECHNICAL COOPERATION
The Government of the Republic of Indonesia and the Government of the Kingdom of Morocco, hereinafter referred to as ··"the Parties"; DESIROUS of expanding and enhancing bilateral relations and cooperation on a lasting and long term basis; CONVINCED of the necessity of lasting and effective cooperation in the interests of both countries; CONFIRMING their interests in the strengthening of bilateral cooperation between the two countries; GUIDED by desire to strengthen the existing friendly relations and to promote the expansion of economic, scientific, and technical cooperation between the two countries based on the principles of equality, mutual benefits and full respect of sovereignty; AWARE of the necessity of giving the Indonesian - Moroccan relations an appropriate legal framework in accordance with the prevailing laws and regulations of each country; HAVE AGREED as follows:
ARTICLE I OBJECTIVES AND AREA OF COOPERATION 1. The Parties shall endeavour to take all necessary measures to encourage, to promote and to develop economic, scientific, and technical cooperation between the two countries within the framework of this Agreement and in conformity with their respective laws and regulations . 2. The economic cooperation referred to in the present Agreement shall cover the areas of agriculture, industry, trade, energy, natural resources, human resources, transportation, telecommunications, fisheries , and constructing spheres as well as other areas that may be determined by mutual agreement.
ARTICLE 11 TECHNICAL COOPERATION The Parties shall take all necessary measures to encourage technical cooperation between them through the exchange of scientific and technological data and of experts, technicians , and trainers in addition to the encouragement of all aspects of technical cooperation between the specialized institutions of both countries.
ARTICLE 111 IMPLEMENTATION OF COOPERATION The economic, scientific, and technical cooperation shall be conducted in accordance with the capabilities and requirement of the respective Parties as well as with the terms and conditions to be agreed upon between the Parties. The detailed provisions relating to the forms and methods as well as to the conditions of such cooperation in the agreed areas shall be laid down in separate specific arrangements.
ARTICLE IV COMPETENT AUTHORITIES The preparation, coordination and implementation of specific arrangements mentioned in Article I, II and Ill of this Agreement shall be granted upon and concluded by competent authorities of both Parties. Such specific arrangements shall specify the terms and conditions, rights and obligations of the Parties and other appropriate matters including, if it is deemed necessary, the financial arrangement of the programs or projects.
ARTICLE V RESPONSIBILITY OF THE PARTIES Subject to the laws and regulations of their respective countries, to their international obligations, and to their capabilities, the Parties shall offer the facilities necessary for the encouragement of economic, scientific, and technical cooperation.
ARTICLE VI ESTABLISHMENT OF JOINT COMMISSION 1.
The Parties shall establish a Joint Commission to examine the implementation of this Agreement, to discuss the issues that might arise from the application of this Agreement and to make all necessary recommendations for the achievement of its goals.
2.
The Joint Commission shall meet when considered appropriate by mutual agreement, alternately in Indonesia and in Morocco. This Joint Commission shall, whenever necessary, establish working groups and appoint experts and advisers to attend the meetings. If the meeting can not be held due to certain circumstances, documents shall be exchanged in lieu of such meeting.
3.
The Joint Commission shall perform, among other things , the following functions: a. Examine and approve specific projects; b. Supervise the execution of this Agreement; c. Regulate the forms of cooperation referred to in Article Ill of this Agreement; d. Review the progress of the cooperation between the two countries and make
recommendations to the Government of both countries concerning activities and projects that could be undertaken; 4.
The Joint Commission shall determine its own rules or procedures at its first meeting. ARTICLE VII PROTECTION OF INTELLECTUAL PROPERTY RIGHTS
1.
The Parties agree that any intellectual property arising under the implementation of this Agreement will be jointly owned, and a. Each Party shall be allowed to use such intellectual property for the purpose of maintaining, adapting, and improving the relevant property. b. Each Party shall be liable for any claim made by any third party on the ownership and legality of the use of the intellectual property rights which is brought in by the aforementioned Party for the implementation of the cooperation activities under this Agreement.
2.
If either Party wishes to disclose confidential data and/or information resulted from the cooperation activities under this agreement to any third party, the disclosing Party must obtain prior consent from the other Party before any disclosure can be made.
3.
In the event the intellectual property is used by the Party and/or institution on behalf of the Government for commercial purposes, the other Party shall be entitled to obtain equitable portion of royalty.
4.
Whenever either Party requires the cooperation of another Party outside the Republic of Indonesia and the Kingdom of Morocco for any commercial undertaking resulted from intellectual property covered by this Agreement, this Party will give first preference of the cooperation to the other Party under this agreement, which will be waived, if the other Party is unable to participate in mutually beneficiary manner.
ARTICLE VIII FINANCIAL MATTER
Additional financial support from international bodies and/or other countries may, upon mutual consent, be utilized by either Party to finance the activities carried out within the framework of the present Agreement.
ARTICLE IX TECHNICAL AND INFORMATION ARRANGEMENTS
Technical documents and information which are conveyed in accordance with the terms of the present Agreement shall be treated confidentially by both Parties and shall not be given to natural or juridical persons of third countries or other entities, without the consent of both Parties.
ARTICLEX FACILITATION OF DUTIES Either Party shall in accordance with its existing laws and regulations grant the citizens of the other Party, pursuant to the provisions of this Agreement, necessary facilities and assistance in the fulfillment of their duties.
ARTICLE XI CLAIM BY THIRD PARTIES The host government shall be responsible for claims which may be brought by third Parties against experts, advisers, technicians or other persons perfonning official services in respect of claims or liabilities arising from criminal acts, gross negligence or willful misconduct of the said individuals.
ARTICLE XII AMENDMENT Either Party may request in writing a revision or amendment of all or parts of the present Agreement. Any revision or amendments which have been agreed upon by the Parties shall come into effect on such date as will be determined by the Parties.
ARTICLE XIII SETTLEMENT OF DIFFERENCES Any difference between the Parties arising out of the interpretation or application of the present Agreement shall be settled amicably through consultations or negotiations.
ARTICLE XIV ENTRY INTO FORCE, DURATION, AND TERMINATION 1. This Agreement shall enter into force on the date of receipt of the last notification by which the Parties inform each other, through diplomatic channels, that their respective constitutional requirements for giving effect to this Agreement have been fulfilled. 2. This Agreement shall remain in force for a period of 5 (five) years and shall automatically be renewed for every successive period of 5 (five) years unless either Party tenninates it by giving written notification 6 (six) months prior to its expiration. 3. The tennination of the present Agreement shall not affect the validity and duration of any arrangement and/or contract made under the present Agreement until the completion of such arrangement and/or contract.
IN WITNESS WHEREOF, the undersigned, have signed the present Agreement. DONE in duplicate at Rabat on this eighth day of June two thousand and eight in the Indonesian, Arabic, and English languages, all texts being equally authentic. In case of any divergence of interpretation of the present Agreement, the English text shall prevail.
