Zadavatel s ohledem na upřesnění zadávacích podmínek prodlužuje lhůtu pro podání žádosti o účast do 24. 6. 2013 do 12:00. Ostatní ustanovení zadávacích podmínek se nemění. / The tenderer thus extends the time limit for proving the principal delivery provided by the tenderer up to “6 years” and reduces the value of the principal delivery to “min. 75 mil. V případě, že náš partner bude zahraniční (ne česká) firma, musí mít „osoby autorizované pro činnost ve výstavbě“ registrované u příslušných českých úřadů nebo je dostačující registrace autorizovaných osob v zemi registrace firmy (např. Polsko)? A jak je to s prokázáním daňových nedoplatků, nedoplatků sociálního pojištění apod.? Je 9

English translation provided by the Contracting entity: We are thinking about joint request to participate for tendering procedures we are interested in. In case that our partner will be a foreign (not Czech) company, is it for the foreign tenderer necessary to have their authorized engineers and technicians active in the construction registered with the relevant authorities in the Czech republic, or is sufficient the registration in the state of registered office of the foreign tenderer (for example Poland). And how about confirmation of tax arrears and social security arrears. Are the confirmations of authorities from the state of registered office of foreign tenderer sufficient? Dodatečné informace zadavatele / Answer from the Contracting entity: Zadavatel uvádí, že výše uvedené skutečnosti jsou uvedeny v zadávacích podmínkách (kvalifikační dokumentaci). Má-li být předmět veřejné zakázky plněn několika dodavateli společně a za tímto účelem dodavatelé podávají společnou žádost o účast (resp. hodlají podávat společnou nabídku v následující fázi zadávacího řízení), musí splnění základních kvalifikačních předpokladů a profesního kvalifikačního předpokladu podle § 54 písm. a) ZVZ (tj. předložení výpisu z obchodního rejstříku či obdobné evidence) prokázat všichni tito dodavatelé v plném rozsahu. Splnění ostatních kvalifikačních předpokladů dle § 50 odst. 1 písm. b) ZVZ (oprávnění k podnikání a osvědčení dle zákona č. 360/1992 Sb.) a § 50 odst. 1 písm. d) ZVZ (osvědčení o řádném plnění a čestné prohlášení o dodávce) musí prokázat alespoň jeden dodavatel nebo souhrnně všichni dodavatelé. Není tedy nezbytně nutné, aby doklady pro osoby autorizované pro činnost ve výstavbě předkládali všichni členové sdružení, tyto doklady se prokazují za všechny uchazeče dohromady. Zadavatel však trvá na osvědčení vystaveném Českou komorou autorizovaných inženýrů a techniků činných ve výstavbě, případně oznámení o svém úmyslu vykonávat povolání jako hostující osoby, pokud bude tuto část kvalifikace prokazovat zahraniční člen sdružení. Prokázání neexistence daňových nedoplatků a nedoplatků sociálního pojištění musí pak být pro zahraničního dodavatele prokázáno jak ve vztahu k zemi jeho sídla, tak ve vztahu k České republice, více v bodě 3.1 kvalifikační dokumentace. / The contracting entity states, that all relevant information according these questions are in the tender documentation (qualification documentation). If the subject-matter of the public contract is to be performed jointly by several tenderers and they submit a joint request to participate to that effect (a joint tender in the successive stage of the award procedure), each tenderer shall be obligated to demonstrate the fulfilment of the basic qualifications prerequisites and the professional qualifications prerequisite pursuant to § 54 lit. a) PCA (i.e. submission of the extract from the Commercial Register or similar register) to the full extent. The fulfilment of remaining qualifications pursuant to § 50 par. 1 lit. b) PCA (licence to pursue business activities and certificates according to the Act. Dodatečné informace zadavatele / Answer from the Contracting entity: Zadavatel v zadávacích podmínkách stanovil, že v případě, že část veřejné zakázky bude plněna formou subdodávky, požaduje zadavatel v souladu s § 44 odst. 6 zákona v nabídce uvést identifikační údaje subdodavatele, jaká konkrétní část plnění veřejné zakázky bude zadána subdodavateli a procentuální vyjádření podílu subdodavatele na plnění veřejné zakázky ve vztahu k objemu nákladů celého plnění veřejné zakázky. Žádost číslo 43 / Request no. 43 (obdržena / received on 26. 9. 2013): V Zadávací dokumentaci v bodu 4.1 je specifikována bankovní záruka, která se má předložit před uzavřením smlouvy, ve výši 15% z celkové ceny díla bez DPH. Toto upravuje APPENDIX 10, kde je v bodu 6 upravena i délka bankovních záruk. Tyto okolnosti jsou vzhledem ke krytí investora pochopitelné. Nerozumíme ale poznámce v dodatečných informacích, kde se píše, že bankovní příslib na tyto záruky musí být platný do konce zadávací lhůty, která podle bodu 6 Výzvy pro podání nabídek činí 180 dnů od podání nabídky. V případě, že se nabídky otevírají 10 minut po konci lhůty pro podání, považujeme platnost 180 dnů za bezpředmětnou. Tato lhůta pouze zvyšuje 30
náklady na podání nabídek a to v řádech statisíců korun (pro některé firmy může být tato podmínka i limitující). Žádáme proto o upravení tohoto bodu tak, aby platnost bankovního příslibu mohla být pouze v řádu dnů od podání nabídky, nikoli v řádu měsíců English translation provided by the Contracting entity: In the tender conditions in the article 4.1 there is requested the bank guarantee, which has to be submitted by the tenderer before signing the contract, in the amount of 15% of the total tender price (without VAT). This conditions are set it the APPENDIX 10, where in the article 6 there is also stated the duration of the bank guarantees. These conditions are understandable due to the coverage of the contracting entity. However we do not understand the additional information, where it was stated, that the mandatory promise of the bank guarantee for the performance of the work has to be valid until the end of the award period, which is according to the article 6 of the invitation of the submission of the offers 180 days from the submission of the offers. In case, that the offers will be opened within 10 minutes after the end of the deadline for the submission of the offers, we consider the validity of 180 days as groundless. This period only extend the cost for the submission of the offer by hundred thousand Czech crowns (this condition can be also limiting to some companies). Therefore we ask you to adjust this condition and reduce the validity of the mandatory promise of the bank guarantee for the performance of the work to the daily bases (not monthly bases). Dodatečné informace zadavatele / Answer from the Contracting entity: Zadavatel uvádí, že není možné stanovit platnost závazného bankovního příslibu v řádech dnů tak, jak uvádí zájemce. Smyslem tohoto požadavku je zajistit, že v případě, kdy bude nabídka daného zájemce vybrána jako nejvýhodnější, vystaví banka vybraného uchazeče požadovanou bankovní záruku. Již z logiky tohoto požadavku tedy vyplývá, že k naplnění tohoto závazku nedojde v řádu dnů po otevření obálek, ale až po výběru nejvhodnější nabídky. Proto je tedy nezbytné, aby byla zajištěna platnost závazného bankovního příslibu do konce zadávací lhůty. / The contracting entity states, that is not possible to require the validity of the mandatory promise of the bank guarantee on the daily bases, as the tenderer mentions. The purpose of the this requirement is to secure, that in case that offer of the tenderer is chosen as the most suitable one, the bank of the selected tenderer will issue the requested guarantee. From the logic of this requirement it is apparent, that the fulfillment of this obligation will be needed not after few days after the opening of the envelopes, but after the decision on the most suitable offer. Therefore it is necessary to secure the validity of the mandatory promise of the bank guarantee until the end of the award period.

Žádost číslo 44 / Request no. 44 (obdržena / received on 26. 9. 2013): V příloze ANNEX No.12 Zadávací dokumentace je uveden podrobný popis Sub-kritérií pro hodnocení nabídky. V oddíle "Spotřeba elektrické energie" je uvedena mezní hodnota 0,32 MWh, která v případě překročení vede k vyloučení nabídky. Je tato hodnota myšlena pro oba výklopníky najednou, nebo je to hodnota pro výklopník V2 a stejná pro výklopník V3 (tedy 0,64 MWh pro oba dva)? English translation provided by the Contracting entity: The ANNEX No.12 of the tender documentation contains the detail description of the sub criterion for the evaluation of the offer. In the section “Power consumption” there is set the limit amount of 0,32 MWh, whose exceeding leads to rejection of the offer. Is this value for both tipplers together or is it value only for tippler V2 and for the tipplers V3 is the same value (it means 0,64 MWh for both together)? Dodatečné informace zadavatele / Answer from the Contracting entity: Hodnota 0,32 MWh platí pro jeden výklopník, přepočteno z roční celkové spotřeby při 70% využití. Maximální spotřebu na oba výklopníky projekt stanovuje na 0,87 MWh. Tento limit je nyní stanoven s ohledem na větší přehlednost jako hraniční pro kritérium spotřeby. Zadavatel poskytuje upravenou přílohu č. 12 (TD_WT_AN_12_EN_CZ_verze DI XVII.pdf) jako přílohu těchto dodatečných informací. / The limit value of 0,32 MWh is valid for one tippler, recalculated from total year consumption with 70% of working time. Maximal consumption for both tipplers is set to 0,87 MWh in the project. With the aim of higher clarity, this value is now the limit for consumption criterion. Contracting entity provides adjusted Annex nr. 12 (TD_WT_AN_12_EN_CZ_verze DI XVII.pdf) as the part of this additional information.
