Summary of the project Research on ‘Justice in Relation to Society’ is an expanding domain but is generally lacking a multidimensional approach in the social sciences. Building on the experience and results of a previous IAP project on “Justice & Society” (P6/01) which has covered major gaps in the knowledge about Belgium’s national justice history from a top-down and institutional perspective, the current project extends the scope to tackle the theme of the relationships between Justice and populations from an interdisciplinary, long-term perspective, covering the period from 1795 (end of the Ancien Régime in Belgium) up to the present. a) The Belgian experience is systematically examined in its international context, that of an increasingly globalised world. For the domain of justice, especially for the 20th-21st centuries, this necessitates an innovative approach to demonstrate how 'justice' is historically and geographically located in terms of the global/local context, and how the ‘local’ can be widened out to look at inter-, trans- and supranational aspects of justice. To Belgium, this is of particular relevance, since for several aspects and at different times in its history it has functioned as a “laboratory of Western Culture” (e.g. penal policies; experiences of wartime occupation; the Belgian colonies). b) A bottom-up perspective implies a focus on “populations”: both judicial actors and social groups and communities and individuals in their dealings with justice. From a social science perspective, this means that class, age, gender and ethnic or national differences are taken into account in all research projects. Objectives: The following scientific objectives are put forward: - Shift from more ‘justice-centred’ approaches to the study of interactions between judicial institutions, social groups and individuals. - Deepen diachronic knowledge, comparing past and present societies: identifying both long-term continuities and evolutions and moments of crisis and transformation. - International perspective: discuss issues of justice in a comparative and critical way, comparing national experiences, but also examining transnational transfers and the circulation of concepts, knowledge and practices within the framework of global processes. - Interdisciplinarity: the above objectives imply the involvement of various disciplines: history, legal studies, sociology, criminology, political science, management studies, archival science. Methodology and Project Structure: The project is structured around 5 integrated work packages: 4 thematic work packages, in which different national and international partners intervene to examine transnational key aspects of the relationships between Justice and Populations from various disciplinary angles and scales of analysis (macro, meso, micro, long term). The fifth WP is dedicated to the development of joint knowledge management strategies (sources, tools, methods, training, valorisation), aimed to support and promote the research of the entire network. Following a multidimensional and multidisciplinary approach, a variety of social science and historical methods are brought together, ranging from contextual legal history to social policy analysis, critical source analysis, discourse analysis, prosopography, case-studies and criminological field work, involving both quantitative and qualitative expertise of the partners. Work Package 1: Justice, the national State and international dynamics Composed of two distinct sub-Work Packages, this WP takes the judicial system as its point of departure to examine different levels of justice-society relationships. WP1a aims to move beyond the level of the nationState to consider the networks of international law, justice and policing, as well as colonial powers in their IAP – Phase VII

exchanges with the metropolis. WP1b looks inside the national justice system to the functioning and interaction of its institutions and actors, as shaped by their relationships to society, and to the professional and social networks of judicial personnel. Work Package 1a: Justice and international dynamics (BeJustInt): At the international level, Belgian jurists play(ed) an important role in configuring International Justice through exchanges on international law, colonial law, occupation law, law of armed conflicts, war crimes and human rights. There is also considerable Belgian involvement in the development of transnational jurisdictions of regulation and control (such as Interpol, Euro-Pol and Euro-Just) as well as in international policing practices. Work Package 1b: The State justice system: functioning, reform, actors (BeJustState): At the national level of the State justice system, both its structure and functioning are shaped by constant interaction between institutional actors at various levels of the ‘judicial chain’ (policing, prosecution, judgment, penal practice), which is, in turn, subject to change and reform as a result of varying public demands and attitudes towards justice. Examining the agency of collective judicial actors also necessitates further study of the intellectual, social and professional networks of justice: prosopography of justice personnel; processes of professionalisation and professional culture; (inter)national associations of magistrates, policemen, lawyers, jurists, etc. Work Package 2: Justice and the citizen (BeJustCitiz) The research conducted within WP2 approaches justice-society relationships from the viewpoint of the citizen, as both subject and client of legal and judicial systems. Following a ‘bottom-up’ perspective, citizens are not merely viewed as passive subjects meekly acquiescing in state-practised repression; rather, they are forces that react or turn to judicial institutions, in order to defend or serve their own interests. This WP focuses in particular on citizen involvement in the functioning and reform of legal and penal systems and on citizens’ experience and attitudes towards police and judicial practices and punishment. Three research axes are prioritized: 1) the experiences and attitudes of citizens as clients of justice, which is related to the issues of citizens’ trust or distrust in the judiciary, citizen involvement in the administration of justice, and public influence on judicial reform; 2) the (re)actions of citizens belonging to stigmatised target groups, the subject of specific police, judicial and social policies, including f.e. young offenders and ‘difficult’ detainees. Particular attention is paid to their daily interactions ‘on the ground’ with regulatory instances and the impact of judicial and police intervention on their careers of stigmatisation and confinement; 3) the experiences of ordinary citizens in their dealings with law and justice in particular contexts of crisis, conflict and reform, in times of revolution, colonisation or global conflicts. Work Package 3: Justice, Crisis and (At-)Risk Populations (BeJustCrisis) This WP examines experiences of global crisis and domination, which often induce specific transformations of judicial institutions and practices and, as times and contexts of exception and experiment, bring about fundamental shifts in justice-citizen relationships. The focus is on how contexts of crisis or domination affect and are experienced by specific populations subject to justice, and how these, in turn, develop their own mechanisms transforming dominant society. The research firstly addresses experiences of military domination, including the repression and resistance during periods of French, Dutch, German or Belgian domination/occupation; the role and status of military justice; and post-war retributive policies (amnesty, ‘incivism’). A second research axis focuses on contexts of colonial domination, examining both colonial law and justice and police systems in the Belgian ‘colonial empire’ (Congo, Ruanda Urundi), in the framework of European colonisation. Within both research axes, particular attention is paid to the question how, in contexts of crisis and/or domination, specific risk and atrisk populations are defined, policed and possibly confined: from ‘rebellious’ populations, political opponents and war collaborators, to gypsies, refugees and migrants in contemporary globalised society. Work Package 4: Long-term (self-)representations of justice (LongTermJust) This WP departs from the idea that “not only must Justice be done; it must also be seen to be done”. One of the most important relationships of justice to society and its citizens consists of the ways in which justice is represented and presents itself to the outside world. These (self-)representations are manifold and can be expressed through and shaped by various ‘media’, ranging from, for example, ‘sites of justice’ such as monuments, buildings and execution sites, and literary, visual and other expressions in popular culture, to expert discourses, judicial statistics and law reviews reflecting a ‘scientific’ professional culture of justice as well as technical information. Since this field is so vast and an integrated multidisciplinary approach is still in the making at the international level, it has been decided to combine two targeted in-depth research projects with smaller exploratory studies. The two main projects are concerned with judicial iconography, allowing Belgium to catch up with this highly developed international field of research, and the new domain of judicial archaeology, with a focus on the ‘built’ representations of justice such as court rooms, prison buildings, police quarters, etc. An IAP – Phase VII

important area for exploratory research concerns the role played by visual material and literature related to the judicial sphere in constructing collective representations of Society, more in particular in the representation of the colonial order, in the development of a ‘scientific culture of justice’ and in the symbolic representation of State power in the urban context. Work Package 5: Knowledge Management for a Social Science History of Justice: Sources, Tools, Training and Valorisation (DigitJustHis) This transversal WP is intended to support and promote the research of the entire network: it aims at 1) supporting strategies of collection, appraisal and digitisation of (un)published judicial sources, 2) developing methodological tools, research instruments and metadata, 3) making research in the field more productive and visible, both to the scientific community and the larger public, 4) organising common research training. The platform for these network-wide efforts is the existing IAP Portal “Just-His.be”, developed in IAP phase VI, which already contains several source and documentary collections and textual, prosopographical and statistical tools. Central points of attention involve in particular the inclusion of electronic publications; computer-based analysis; data archiving and retrieval; new digital source collections. Next to the specific expertise of archival science mobilised here, research will be oriented towards the internationally burgeoning field of the Digital Humanities, in which law and justice history plays a steering role. This is coupled with specific training for the IAP researchers on data management, computer-based analysis, data privacy and copyright issues, etc.

Samenvatting van het project: Onderzoeksdomein: Het onderzoek naar "Justitie in relatie tot de samenleving" is een groeiend domein. Vaak ontbreekt er echter een multidimensionale aanpak binnen de sociale wetenschappen. Bouwend op de ervaringen en resultaten van een vorig IUAP-project over "Justitie & Samenleving" (IUAP P6/01), dat belangrijke lacunes in de kennis van de Belgische nationale gerechtelijke geschiedenis aanpakte vanuit een top-down en institutioneel perspectief, breidt het huidige project de blik verder uit om het thema van de relaties tussen Justitie en bevolkingen te bestuderen vanuit een interdisciplinair lange-termijn perspectief, waarbij de periode van 1795 tot op heden wordt behandeld. a) De Belgische ervaring wordt daarbij systematisch onderzocht in haar internationale context, nl. die van een globaliserende wereld. Met betrekking tot justitie, in het bijzonder tijdens de 20ste en 21ste eeuw, vereist dit een vernieuwende benadering om aan te tonen waar men "justitie" historisch en geografisch kan plaatsen binnen de globale/lokale context, en hoe het "lokale" kan worden uitgebreid om de internationale, transnationale en supranationale aspecten van justitie onder de loep te nemen. Dit is met name relevant voor België aangezien het op diverse vlakken en op verschillende momenten in haar geschiedenis dienst heeft gedaan als een "laboratorium van de westerse cultuur" (bijv.: penitentiair beleid; ervaringen van bezetting tijdens de oorlogen; de Belgische koloniale gebieden). b) Een bottom-up perspectief houdt in dat het project zich toespitst op "bevolkingen": zowel juridische instellingen als sociale groepen, gemeenschappen en individuen in hun omgang met justitie. Vanuit een sociaal wetenschappelijk perspectief betekent dit dat klasse, leeftijd, geslacht en etnische of nationale verschillen worden in rekening gebracht in de onderzoeksprojecten. Doelstellingen: De volgende wetenschappelijke doelstellingen worden vooropgesteld: Omschakelen van een "justitie-centrische" benadering naar de studie van interacties tussen juridische instellingen, sociale groepen en individuen. De diachronische expertise uitdiepen: samenlevingen uit het verleden en het heden met elkaar vergelijken; continuïteit en evoluties identificeren op de langere termijn alsook momenten van crisis en verandering. Internationaal perspectief: juridische aspecten bestuderen op vergelijkende en kritische basis, nationale ervaringen vergelijken, maar ook transnationale overdrachten onderzoeken, evenals de verspreiding van concepten, kennis en praktijken binnen het kader van globale processen. Interdisciplinair: de bovenvermelde doelstellingen vereisen een deelname van uiteenlopende disciplines: geschiedenis, rechten, sociologie, criminologie, politieke wetenschappen, bestuurskunde, archiefwetenschappen. Methodologie en projectstructuur: Om deze doelstellingen te bereiken, wordt het project gestructureerd rond 5 geïntegreerde werkpakketten: 4 thematische werkpakketten, waaraan telkens verschillende nationale en internationale partners deelnemen en essentiële transnationale aspecten onderzoeken van de relaties tussen justitie en bevolkingen vanuit verschillende disciplinaire analytische invalshoeken en schalen (macro, meso, micro, lange termijn). Het vijfde WP is specifiek gewijd aan de ontwikkeling van gezamenlijke kennisbeheerstrategieën (bronnen, hulpmiddelen, methoden, training, valorisatie), gericht op het ondersteunen en promoten van het onderzoek van het volledige netwerk. In het kader van een multidimensionale en multidisciplinaire benadering worden uiteenlopende sociaal-wetenschappelijke en IAP – Phase VII

historische methoden samengebracht, gaande van de contextuele rechtsgeschiedenis tot sociale beleidsanalyses, bronnenkritiek, vertooganalyse, prosopografie, case- studies en etnografisch veldwerk, die allen zowel kwantitatieve als kwalitatieve expertise van de partners impliceren. Werkpakket 1: Justitie, de nationale Staat en de internationale dynamiek Samengesteld uit twee onderscheiden maar met elkaar samenhangende sub-WPs, neemt dit Werkpakket het gerechtelijk systeem als uitgangspunt om verschillende niveaus van de relaties tussen justitie en de samenleving te onderzoeken. WP1a heeft tot doel het niveau van natie-staat te overstijgen om de blik te richten op de netwerken van internationaal recht, rechtspraak en ordehandhaving, evenals op koloniale gebieden in hun uitwisselingen met de metropolis. WP1b kijkt binnen in het gerechtelijk systeem van de staat naar het functioneren van en de interactionele dynamiek tussen de juridische instellingen en actoren, en naar de socio-professionele netwerken van het juridisch personeel. Werkpakket 1a: Justitie en internationale dynamieken (BeJustInt): Op internationaal niveau spe(e)l(d)en Belgische juristen een belangrijke rol in de configuratie van het internationale recht en jurisprudentie door middel van uitwisselingen van internationale wetgeving, koloniale wetgeving, bezettingswetgeving, wetgeving in verband met gewapende conflicten, oorlogsmisdaden en mensenrechten. Anderzijds is er een aanzienlijke Belgische vertegenwoordiging in de ontwikkeling van transnationale rechtsgebieden van regelgeving en controle (zoals Interpol, Euro-Pol en Euro-Just), evenals in de uitoefening van internationale ordehandhaving. Werkpakket 1b: Het nationale gerechtelijke systeem: werking, hervormingen, actoren (BeJustState): Op het niveau van het nationale gerechtelijke systeem zelf worden de structuur en werking van juridische systemen gevormd door complexe interacties tussen institutionele actoren en organen op verschillende niveaus van de ‘gerechtelijke keten’ (politie, vervolging, berechting, strafuitvoering), die op hun beurt onderhevig zijn aan verandering en hervorming als gevolg van wijzigende verwachtingen en houdingen van burgers ten aanzien van justitie. Onderzoek naar het handelen en interageren van collectieve gerechtelijke actoren vereist daarnaast ook bijkomende studie van de intellectuele, sociale en professionele netwerken van justitie; een prosopografie van het juridisch personeel; processen van professionalisering en professionele cultuur; (inter)nationale verenigingen van magistraten, politieagenten, advocaten, juristen, enz. Werkpakket 2: Justitie en de burger (BeJustCitiz) Het onderzoek dat wordt uitgevoerd in het kader van WP2 benadert de relaties tussen justitie en maatschappij vanuit het oogpunt van de burger, als subject (soms ‘doelwit’) en klant van wettelijke en juridische systemen. Uitgaande van een "bottom-up" perspectief worden burgers niet enkel beschouwd als getrouwe onderhorigen die zich passief onderwerpen aan de repressie van de staat; zij moeten eerder worden beschouwd als krachten die zich wenden tot, en actief gebruik maken van, de politie en de rechtbanken om hun eigen doelen te realiseren en hun eigen belangen te behartigen. Dit WP spitst zich in het bijzonder toe op de betrokkenheid van de burger bij de werking van de gerechtelijke en penitentiaire systemen en hun hervormingen, en op de ervaringen van burgers met en hun attitudes ten opzichte van de politie, justitie en de gevangenissen. Verschillende onderzoeksprojecten draaien rond drie centrale punten: 1) de ervaring en de houding van burgers als klanten van justitie, waarbij de vraag over het vertrouwen / wantrouwen van de burgers in de juridische instellingen wordt gesteld. De vraag over de impact van de burger op hervormingen van het wettelijk systeem wordt gesteld in een hedendaagse context: het Gerechtelijk wetboek van 1967 en het post-Dutroux tijdperk; 2) de acties/reacties van de burgers die deel uitmaken van gestigmatiseerde doelgroepen en derhalve het onderwerp vormen van een specifieke ordehandhaving en gerechtelijke en sociale reactie, inclusief, bijv., jonge overtreders en "geïnterneerden" met gedragsproblemen. Bijzondere aandacht gaat uit naar hun alledaagse interacties in de praktijk met regelgevende instanties en de impact van juridische en politionele interventies op hun individuele trajecten van stigmatisering en opsluiting; 3) de ervaringen van de gewone burgers in hun omgang met de arm der wet en justitie in niet-standaard of uitzonderlijke contexten zoals een crisis, conflicten en hervormingen, in het bijzonder in perioden van revolutie, kolonialisme of globale conflicten. Werkpakket 3: Justitie, crisis en risico(volle) bevolkingen (BeJustCrisis) Dit WP onderzoekt ervaringen met een globale crisis en overheersing die specifieke veranderingen teweeg brengen binnen de juridische instellingen en praktijken en die, in tijden en contexten van uitzonderingen en/of experimenten, fundamentele verschuivingen veroorzaken in de relatie tussen justitie en de burger. De focus ligt hier meer bepaald op de wijze waarop deze veranderingen een impact hebben op, en ervaren worden door, de betrokken overheerste bevolkingen, en ook de wijze waarop deze reageren door eigen strategieën te ontwikkelen, en aldus de dominante orde veranderen. Het onderzoek richt zich in de eerste plaats op de ervaringen van militaire overheersing, inclusief de IAP – Phase VII

repressie en weerstand tijdens de Franse, Nederlandse, Duitse of Belgische overheersing/bezetting; de plaats van militaire justitie; en naoorlogse repressie (amnestie, "incivisme"). Een tweede onderzoeksas spitst zich toe op de context van de koloniale overheersing, waarbij zowel de koloniale wetgeving als justitie en politiesystemen in het Belgische "koloniale rijk" (Kongo, Rwanda Urundi) worden onderzocht in het kader van het Europese kolonialisme. In beide onderzoeksassen gaat bijzondere aandacht uit naar de studie van de wijze waarop, in een context van crisis en/of overheersing, specifieke risico- en risicolopende bevolkingen worden gedefinieerd, aan politionele controle onderworpen en mogelijk worden geïnterneerd. Het gaat hierbij van "rebelse" bevolkingen, politieke tegenstanders en oorlogscollaborateurs, tot zigeuners, vluchtelingen en migranten in de hedendaagse geglobaliseerde maatschappij. Werkpakket 4: Lange termijn (zelf)representaties van justitie (LongTermJust) Dit WP gaat uit van het idee dat “justitie niet alleen moet worden uitgevoerd; ze moet ook uitgevoerd zien worden”. Een van de belangrijkste relaties van justitie met de maatschappij en haar burgers bestaat in de wijze waarop justitie wordt verbeeld en zichzelf verbeeldt naar de buitenwereld toe. Deze (zelf)verbeelding of -representaties kunnen vervat zitten in, en gevormd worden door, uiteenlopende ‘dragers’, gaande van, bijvoorbeeld, "plaatsen van justitie" zoals monumenten, gebouwen en sites van terechtstelling tot literaire, visuele en andere uitingen in de populaire cultuur. De (zelf)verbeelding van justitie zit eveneens vervat in de ‘deskundige vertogen’ die men aantreft bij experts, in gerechtelijke statistieken en vaktijdschriften en bij beleidshervormingen, en die allen (tot doel hebben om) een ‘wetenschappelijke’ beroepscultuur van justitie weerspiegelen. Aangezien dit veld zo omvangrijk is en een geïntegreerde multidisciplinaire benadering nog steeds in zijn beginfase staat op internationaal niveau, werd de beslissing genomen om drie gerichte en diepgaande onderzoeksprojecten te combineren met kleinere verkennende studies, waar alle partners aan deelnemen door aandacht te besteden aan representaties van justitie binnen hun respectievelijke sub-projecten in andere WPs. In de gerichte onderzoeksprojecten komt de gerechtelijke iconografie aan bod om België de kans te geven haar achterstand in te halen in dit sterk ontwikkeld internationaal onderzoeksveld, evenals het eerder nieuwe domein van de rechts- en justitiearcheologie, met focus op de ‘gebouwde’ representaties van justitie zoals rechtszalen, gevangenissen, politiekantoren, etc. Een derde project onderzoekt de rol van visueel materiaal (van populaire schilderijen tot foto's en film) en literatuur (van romans tot professionele wettelijke herzieningen) in de constructie van collectieve representaties van de samenleving, meer in het bijzonder in de verbeelding van de koloniale orde, en in de ontwikkeling van een "wetenschappelijke cultuur van justitie". Werkpakket 5: Kennisbeheer voor een sociaal-wetenschappelijke geschiedenis van justitie: bronnen, hulpmiddelen, training en valorisatie (DigitJustHis) Dit transversale WP heeft als doel het onderzoek van het volledige netwerk te ondersteunen en te promoten: het streeft naar 1) de ondersteuning van strategieën voor de verzameling, evaluatie en digitalisering van (niet) gepubliceerde gerechtelijke bronnen, 2) het ontwikkelen van methodologische hulpmiddelen, onderzoeksinstrumenten en metagegevens, 3) het productiever en zichtbaarder maken van onderzoek, zowel voor de wetenschappelijke gemeenschap als het grotere publiek, 4) de organisatie van een gemeenschappelijke onderzoeksopleiding. Het platform voor deze netwerk-brede inspanningen is de bestaande IUAP-portaalsite "Just-His.be", ontwikkeld tijdens IUAP fase VI, die reeds talrijke bronnen en een grote hoeveelheid documentatie bevat alsook tekstuele, prosopografische en statistische hulpmiddelen. Centrale aandachtspunten zijn meer in het bijzonder de integratie van elektronische publicaties; computeranalyse; gegevensarchivering en -ophaling; nieuwe digitale bronverzamelingen. Behalve de specifieke expertise op het gebied van de archiefwetenschap die hier wordt ingezet, richt het onderzoek zich op het internationaal ontluikende veld van de Digital Humanities, waarin de criminaliteit- en justitiegeschiedenis een sturende rol speelt. Dit wordt gecombineerd met een gerichte opleiding voor de IUAP-onderzoekers op het gebied van gegevensbeheer, computeranalyse, privacy- en auteursrechtelijke kwesties, etc...

Résumé du projet : Domaine de recherche La recherche qui concerne « la justice et ses relations avec la société » est un domaine en expansion mais qui manque généralement d'une approche multidimensionnelle dans le champ des sciences sociales. Construit à partir de l'expérience et des résultats d'un précédent projet PAI sur le thème « Justice & Société » (PAI P6/01) qui a permis de combler des lacunes majeures en histoire de la justice en Belgique et qui adoptait une perspective nationale et institutionnelle dite « top-down », le projet actuel veut aborder le thème des relations entre Justice et Populations en étendant le périmètre de recherche et en s'inscrivant dans une perspective interdisciplinaire et de longue durée, puisqu'elle couvre une période allant de 1795 à aujourd'hui. a) L'expérience belge est systématiquement examinée dans 'son' contexte international, qui est celui d'un monde globalisant. Dans le domaine de la justice, et spécialement pour les 20e-21e siècles, cela nécessite une approche innovante pour démontrer comment la justice est historiquement et géographiquement située dans un contexte à la fois global et local, et comment le 'local' peut s'élargir et révéler des aspects intertrans- et supra-nationaux de la justice. Ce point de vue est particulièrement pertinent pour la Belgique puisque ce pays a, pour certains aspects et certaines périodes, fonctionné comme un « laboratoire de la culture occidentale » (p.e. politiques pénales; expériences d'occupation en temps de guerre; colonies belges). b) Une perspective bottom-up implique de s'attarder sur les « populations », c'est-à-dire sur les acteurs judiciaires, les groupes sociaux, les communautés et les individus dans leurs échanges avec la justice. Si l'on adopte une méthodologie relevant des sciences sociales, cela signifie que les différences de classe, d'âge, de genre, ethniques et nationales sont prises en compte dans tous les projets de recherche. Objectifs Les objectifs scientifiques suivants sont proposés : Déplacer une approche centrée sur la justice vers l'étude des interactions entre les institutions judiciaires, les groupes sociaux et les individus. Approfondir l'expertise diachronique, en comparant les sociétés présentes et passées : identifier à la fois les continuités et les évolutions sur le long terme, les moments de crises et de transformation. Adopter une perspective internationale : analyser les questions judiciaires en adoptant une perspective comparative et critique, comparer les expériences nationales mais aussi examiner les transferts transnationaux et la circulation des concepts, du savoir et des pratiques au sein d'une structure faite de processus globaux. Adopter une perspective interdisciplinaire : les objectifs cités plus haut impliquent d'avoir recours à des disciplines diverses (histoire, sciences juridiques, sociologie, criminologie, sciences politiques, sciences archivistiques). Méthodologie et structure du projet Pour atteindre ces objectifs, le projet est structuré autour de cinq Work Packages (groupes de travail) : quatre WP thématiques, au sein desquels les partenaires nationaux et internationaux interviennent pour examiner les aspects clés transnationaux des relations entre Justice et Populations à partir de différents angles disciplinaires et échelles d'analyse (macro, meso, micro, longue durée). Le cinquième WP est consacré au développement de stratégies conjointes de gestion de la connaissance (sources, outils, méthodes, formation, valorisation). Suivant une approche multidimensionnelle et multidisciplinaire, diverses méthodes émanant des sciences sociales et de l'histoire seront rassemblées, passant d'une histoire du droit IAP – Phase VII

contextuelle à une analyse des politiques sociales, à l'analyse critique des sources, au discours analytique, à la proposopographie, aux études de cas et au champ de la recherche criminologique, en impliquant par exemple à la fois les expertises qualitatives et quantitatives des partenaires. Work Package 1: Justice, l’Etat national et les dynamiques internationales Ce WP, composé de deux sous WP distincts, prend le système judiciaire comme cadre de réflexion afin d’analyser les différents niveaux de relation qui existent entre la justice et la société. Le WP1a a pour objectif de dépasser le cadre strictement national de l’Etat pour considérer les réseaux de droit international, de la justice et du maintien de l’ordre, ainsi que les pouvoirs coloniaux dans leurs échanges avec la métropole. WP1b prend pour cadre le système judiciaire national afin d’analyser le fonctionnement et les interactions entre les institutions et les acteurs du système judiciaire, qui sont façonnés par leurs relations avec la société, ainsi que pour analyser les réseaux socioprofessionnels du personnel judiciaire. Work Package 1a: Justice et dynamiques internationales (BeJustInt): A un niveau supranational, les juristes belges jouent/ont joués un rôle important dans la configuration de la Justice Internationale, notamment par leurs échanges au sujet du droit international, du droit colonial, du droit de l’occupation, du droit des conflits armés, des crimes de guerre et des droits de l’Homme. L’engagement belge dans le développement de juridictions transnationales de régulation et de contrôle (telles qu’Interpol, Euro-Pol et Euro-Just), mais aussi dans les pratiques internationales de maintien de l’ordre, est également considérable. Work Package 1b: Le système judiciaire national : le fonctionnement, les réformes, les acteurs (BeJustState): Au niveau national, les structures et le fonctionnement du système judiciaire sont façonnés par les constantes interactions des acteurs institutionnels aux divers niveaux de la « chaîne judiciaire » (police, poursuites, jugement, pratique pénale) les uns avec les autres. Cette « chaîne judiciaire » est à son tour sujette aux changements et aux réformes selon les variations des demandes de l’opinion public et des attitudes de ce public envers la justice. Le fait d’examiner le service des acteurs collectifs de la justice nécessite également de procéder à une étude plus poussée des réseaux intellectuels et socioprofessionnels de la justice : prosopographie du personnel de justice ; processus de professionnalisation et culture professionnelle ; associations (inter)nationales de magistrats, policiers, avocats, juristes, etc. Work Package 2: Justice et le citoyen (BeJustCitiz) La recherche entreprise au sein du WP2 étudie les relations justice-société à partir du point du vue du citoyen, en tant que sujet et client des systèmes législatif et judiciaire. Suivant une perspective dite « bottomup », les citoyens ne sont plus vus comme des sujets passifs qui acquiescent humblement aux pratiques de répression étatique ; à l'inverse, ils sont forcés de se tourner vers la police et les tribunaux et d'en faire usage pour servir leurs propres fins. Ce WP se centrera en particulier sur l'implication des citoyens dans le fonctionnement des systèmes législatif et pénal et dans leur réforme, et sur l'expérience et les attitudes des citoyens face à la police, au monde judiciaire et aux prisons. Différents projets de recherche s'organisent autour de trois aires de convergence: 1) les expériences et attitudes des citoyens comme « clients » de la justice, en prenant en compte les dimensions de confiance-méfiance du citoyen dans l'institution judiciaire. La question de l'impact du citoyen sur les réformes du système législatif est posée dans un contexte essentiellement contemporain : le code judiciaire de 1967 et l'ère post-Dutroux; 2) les actions/réactions des citoyens qui sont stigmatisés en tant que groupes-cibles et qui font l'objet d'un contrôle et de politiques judiciaires et sociales particulières, incluant p.e. les jeunes délinquants et les 'détenus' qui ont des problèmes de comportement. Une attention particulière sera portée aux interactions quotidiennes « sur le terrain » avec les instances de régulation et sur l'impact de l'intervention judiciaire et policière sur les trajectoires individuelles de stigmatisation et de confinement; 3) les expériences des citoyens ordinaires et leurs échanges avec le droit et la justice dans des contextes non-ordinaires ou de crise, de conflit et de réforme, en particulier pendant les périodes de révolution, de colonisation ou de conflits globaux. Work Package 3: Justice, crises et populations à risque/risquées (BeJustCrisis) Ce WP examine les expériences globales de crises et de domination qui génèrent des transformations spécifiques des institutions et pratiques judiciaires et qui, dans des périodes ou des contextes d'exception ou d'expérimentation, donnent lieu à des changements fondamentaux dans les relations entre justice et citoyen. L'objectif est de comprendre comment ces transformations affectent et sont vécues par les populations dominées impliquées, et comment ces populations développent, à leur tour, leurs propres modes de fonctionnement jusqu'à transformer la société dominante. Cette recherche s'intéressera tout d'abord aux expériences de domination militaire, incluant la répression et la résistance pendant les périodes de domination ou d'occupation françaises, néerlandaises, allemandes ou belges; la place de la justice militaire; les régulations rétributives d'après-guerre (amnestie, incivisme). Un deuxième axe de recherche se centrera sur les expériences coloniales, en examinant à la fois la législation (socio-économique) coloniale et les systèmes judiciaires et policiers dans 'l'empire colonial' belge (Congo, IAP – Phase VII

Ruanda-Urundi), dans le contexte de la colonisation européenne. Au sein de ces deux axes, nous tenterons particulièrement de comprendre comment sont définies, contrôlées et éventuellement confinées, dans des contextes de crises et/ou de domination, les populations « risquées » ou « à risque » : populations 'rebelles', opposants politiques, collaborateurs de guerre, tziganes, réfugiés, migrants dans des sociétés contemporaines globalisées. Work Package 4: les (auto)représentations de la justice sur la longue durée (LongTermJust) Ce WP part de l'idée que « la justice ne doit pas seulement être accomplie, on doit aussi voir qu'elle s'accomplit ». L'une des relations les plus importantes entre la justice, la société et ses citoyens se trouve dans la manière dont la justice est représentée et se représente elle-même au monde et à la société. Ces (auto)représentations sont nombreuses et peuvent s'exprimer à travers différentes 'plates-formes', depuis les « lieux de justice » tels que monuments, bâtiments et lieux d'exécution, jusqu'aux « expressions » visuelles et autres de la culture populaire, en passant par les discours d'experts, les statistiques judiciaires et revues juridiques qui révèlent une 'culture scientifique' professionnelle de la justice aussi bien qu'une information technique. Comme ce champ est très vaste et qu'une approche multidisciplinaire intégrée est toujours en train de se constituer au niveau international, il a été décidé de combiner trois projets de recherche approfondis et ciblés constitués de plus petites études exploratoires, auxquels tous les partenaires participeront, en étant attentifs au questions des représentations au sein de leurs projets respectifs qui relèvent des différents WP. Le projet original de ce WP concerne d'une part l'iconographie judiciaire, ce qui permettra à la Belgique de rejoindre un champ de recherche fortement développé au niveau international, et d'autre part ce nouveau domaine qu'est l'archéologie judiciaire, avec un focus sur les représentations 'construites' de la justice telles que salles d'audiences, constructions pénitentiaires, quartiers policiers, etc. Un troisième aspect de l'étude concerne le rôle joué par le matériel visuel (des peintres populaires aux photographes et films) et la littérature (des nouvelles aux revues de droit professionnel) en reconstituant les représentations collectives de la Société et plus particulièrement les représentations de l'ordre colonial, et le développement d'une « culture scientifique de la justice ». Work Package 5: Gestion des connaissances en sciences sociales et en histoire de la justice : sources, outils, formation et valorisation (DigitJustHis) Ce WP transversal est mené pour soutenir et promouvoir la recherche de l'ensemble du réseau : il tend à 1) soutenir les stratégies de collection, d'évaluation et de digitalisation de sources judiciaires (non)publiées; 2) développer des outils méthodologiques, des instruments de recherche et des métadonnées; 3) faire de la recherche dans des champs plus productifs et plus visibles, à la fois pour la communauté scientifique et le large public; 4) organiser une formation à la recherche commune. La plate-forme qui accueillera ces contributions de l'ensemble du réseau sera le portail PAI existant 'Just-His.be', développé dans la phase VI du PAI, qui contient déjà une série de collections de sources et de documentation et des outils d'analyse textuelle, prosopographique et statistique. Les principaux points d'attention seront: l'intégration de publications électroniques; l'analyse linguistique; l'archivage et l'extraction de données; les nouvelles collections de sources digitales. A côté de cette expertise spécifique des sciences archivistiques, la recherche sera orientée vers ce champ en plein essor, au niveau international, que sont les Digital Humanities, où l'histoire du droit et de la justice joue un rôle majeur. Ces projets seront couplés à une formation ciblée pour les chercheurs du PAI en gestion de données, en analyse linguistique, sur des questions de vie privée et de droits d'auteur, etc.
