LAPORAN HASIL PENGAMATAN PROSES PENGADAAN JASA KONSTRUKSI TAHAP PERTAMA BAGIAN I PENDAHULUAN Pemerintah Indonesia dengan Bank Dunia telah menandatangani Naskah Perjanjian Pinjaman (Loan Agreemnet) untuk Western Indonesia National Roads Improvement Project (WINRIP) IBRD Loan No. 8043-ID pada tanggal 14 Desember 2011. Loan efektif 12 Maret 2012 dan akan berakhir pada tanggal 31 Desember 2017, senilai USD250 juta. Porsi sharing Loan dan GOI adalah 70:30 untuk Civil Works, dimana Pemerintah Indonesia menyediakan Dana USD 100 juta, sehingga total nilai proyek adalah USD 350 juta. Pinjaman tersebut akan digunakan untuk mendukung penguatan berkelanjutan Sistem Jaringan Jalan Nasional di wilayah Indonesia Barat,yaitu untuk pekerjaan jalan dan jembatan. Tujuan utama proyek WINRIP adalah untuk meningkatkan status jaringan yang sebelumnya berfungsi sebagai jalan provinsi atau jalan non status agar sesuai dengan standar yang baru yaitu jalan nasional; memastikan bahwa jaringan jalan nasional tersebut menjadi lebih lancar dan berkeamanan; dan mampu mendukung peningkatan ekonomi daerah. Sesuai dengan Schedule 2 Section IC Naskah Perjanjian Pinjaman WINRIP,dan Bab 11 Project Management Manual (PMM) WINRIP, Pemerintah Indonesia dan Bank Dunia menyepakati pelaksanaan Anti-Corruption Action Plan (ACAP) atau Rencana Tindak Anti Korupsi (RTAK) dalam pelaksanaan proyek. Adapun tujuan RTAK adalah untuk; 1. Mengidentifikasi resiko bagi pemerintah dan langkah-langkah pencegahan sehingga mencapai standard sistem kendali yang lebih baik dari yang telah dilakukan pada program-program sebelumnya. 2. Mengatasi semua resiko dalam bentuk rencana tindak yang dikendalikan oleh Ditjen. Bina Marga. 3. Mencapai pelaksanaan RTAK WINRIP yang sejalan dengan Pedoman Bank Dunia tentang Pencegahan dan Upaya Memerangi Penipuan dan Tindak Korupsi pada program-program yang didanai oleh Bank Dunia. Pelaksanaan komponen RTAK WINRIP pada dasarnya adalah dalam rangka peningkatan transparansi dalam proses pelaksanaan proyek dengan menarik pelajaran dan pengalaman dari pelaksanaan RTAK pada proyek-proyek sebelumnya agar lebih kuat dan efektif, dengan melakukan langkah-langkah pencegahan dan meningkatkannya pada pelaksanaan rencana tindak-nya. Berdasarkan pelajaran dan pengalaman pada proyek sebelumnya, maka RTAK yang akan dilakukan meliputi lima area sebagaimana Western Indonesia National Roads Improvement Project (WINRIP) IBRD Loan No: 8043-ID

diformulasikan dalam Matrik Pemetaan Resiko Korupsi dan Rencana Tindak yaitu: a. b. c. d. e.
Meningkatkan Penyebarluasan Informasi dan Transparansi Meningkatkan Pemantauan yang dilakukan oleh Masyarakat Madani Meningkatkan Mekanisme Penanganan Pengaduan Pencegahan Kolusi serta Pemalsuan dan Resiko Penipuan, dan Penerapan Sanksi dan Tindakan Hukum
Sedangkan ruang linkup pelaksanaan RTAK atau ACAP meliputi komponen-komponen berikut: 1. Pelibatan Wakil Pengamat dari Masyarakat (WPM) / Community Representative Observers (CROs) dalam pemantauan atau pengamatan terhadap proses pelelangan / pengadaan jasa konstruksi. 2. Keterbukaan informasi kepada public / Public Disclosure. 3. Penanganan dan pengelolaan Pengaduan dari Masyarakat / Complaint Handling Mechanism System (CHS). 4. Pelibatan Pemantauan oleh Pihak Ketiga / Third Party Monitoring (TPM) dalam pemantauan proses konstruksi. WPM berperan sebagai kompone yang mewakili masyarakat madani dalam mengamati dan mencermati proses pelelangan / pengadaan jasa konstruksi untuk mencegah terjadinya praktek korupsi, kolusi, dan nepotisme, serta tindak pemalsuan dan resiko penipuan.

PELAKSANAAN RAPAT PENJELASAN AWAL / PRE-BID MEETING (Aanwijzing) Rapat Penpenjelasan Awal /Pre-Bid Meeting (aanwizjing dilaksanakan pada hari Kamis tgl. 21 Agustus 2014 dibuka pada jam 10 s.d jam 12.00 bertempat di Kantor Balai Besar Jalan Jl. Kota Medan Pembukaan rapat oleh Kepala Balai Besar Pelaksanaan Jalan Nasional Wilayah I. Rapat dihadiri unsur-unsur instansi terkait yaitu: 1. Dit. Panjang efektif 9.7 km, titik awal berada 9 mk dari simpang poriaha dan titik akhir proyek di Rampah (Simpang jalan Sibolga-Barus). Jenis pekerjaan meliputi peningkatan dan pelebaran badan jalan, drainase, pekerjaan jembatan . Kondisi existing berupa jalan tanah selebar6meter dan rencana peningkatannya.menjadi jalan nasional dengan lebar 6 meter ditambah bahu 1,5 meter,dengan penambahan 5 jembatan. Nilai Owner Estimate (HPS) sebesar 145.815.316.000. Durasi pelaksanaan 540 hari kalender Tata cara dan persyaratan mengikuti pelelangan. Jaminan Penawaran sebesar 3.600.000.000,Pemasukan Penawaran pada Tanggal 22 September 2014 (30 hari kalender) Hal-hal yang menggugurkan penawaran Format guarantee bank yang tidak boleh diubah kalimatnya Batas waktu pertanyaan terhadap dokumen adalah 2 minggu sebelum pemasukan Audit keuangan terakhir tahun 2013 harus diikutsertakan (CTC WINRIP) Hitungan financial resources untuk memenuhi kreteria (CTC WINRIP) Pemasukan penawaran sistem 2 amplop Surat sukungan bank harus dapat di realisasikan sebelum penandatanganan kontrak Rincian Mobilisasi dianggap tidak ada

BAGIAN IV PENUTUP 1.
KESIMPULAN Acara yang dihadiri oleh WPM pada Aanwijzing, memberikan kesan bahwa acara tersebut berjalan dengan baik dan lancer.Tidakterdapat protes dari peserta acara tersebut, serta tidak ada pertanyaan yang tidak bisa dijawab baikoleh POKJA, Satker,PMU WINRIP ataupun CTC WINRIP. .

Package 5: Sp. Rampa - Poriaha, South Sumatera 2. Package 11, Bantal- Mukolvluko,Bengkulu 3. Package 13, Sp. Rubs - Tj Kemuning, Bengkulu In reference to Aide Memoire June 2013, it was agreed that DGH may continue to follow pre-
qualification for the next round of only four packages (package 11, 13, 15 and 17). However, since package 5 has already been prepared and in order to avoid further delay, the Bank has no objection to DGH's proposal in using pre-qualification for package 5. Please be advised that the remaining contract packages shall follow post-qualification and that Pak Djoko agreed to it in the meeting of November 8, 2013. \ Based 011 the information provided, we have reviewed the draft PQ documents and have the following comments: Engineering Estimate and Technical Specifications 1. We noted that items of Section Day Works have not been included in the Engineering Estimate of package 11 (Bantal - Mukomuko) and package 13 (Sp.Rukis - Tj Kemuning. Please ensure that such items be included in the Engineering Estimate. 2. We noted that Section 7.16 and Section 8.7 were rmssmg from the proposed Technical Specifications, thus there are no specifications for Item 7.16(1) of package 5 (Sp Rampa - Poriaha), item 8.7(6)(a) of package 11 (Bantal Mukomuko); and also Items 8.7(5) and 8.7(6)(a) of package 13 (Sp .Rukis - Tj Kemuning). Please define these Sections and these items to be inserted in the Technical Specification.

We noted that item 7.2(1) (a), item 7.2(1)(b), item 7.2(2)(a), and item 7.2(2)(d) in BOQ package 5 (Sp Rampa - Poriaha) were conflicting with article 7.2.10.2(a) of the Technical Specifications, in which it is clearly stated that such prices and payments in the Items concrete precast (including the IGirder) shall be deemed full compensation and including erection, transportation, installment and others. Please revise and change these items; also please keep the consistency between BOQ and Technical Specification. 4.
We noted that the following items were not included in the Technical Specification: - 4 items in BOQ package 5 (Sp Rampa - Poriaha), including item 3.1(2), item 7.3(3), item 7.7(1)(b), and item 7.12(3). 3 items in both BOQ package 11 (Bantal- Mukomuko) and BOQ package 13 (Sp Rubs - Tj Kemuning), including item 2.4(4)(a), item 8.4(3)(a), and item 8.4(7)(a). Please define these items and insert them in the Teclmical Specification.

We found some inconsistencies all the documents such as point 3.3 of AER under "General Construction Experience", in the first and the end paragraph of this subject, it appears that it does not consistent with the narrative description of four applicants as written. Moreover, under point applicant No.3 (PT Brantas Abipraya) and applicant No.14 (PT Yasa Patria Perkasa), it still refers to PT Nandya Karya. As to applicant No.7, from the narrative it is not clear why this applicant did not meet the required experience.
2. Finally, an inconsistency is also found in section 4 Conclusions and Recommendations of AER in the last paragraph. Please revise all as appropriate to ensure consistency. 3. We note thatrequest for clarification letters were sent by PIU to only 7 (out of the total 14) applicants on the Key Activities. Please confirm that other than the missing qualification information which was requested from the 7 applicants through request for clarification letters, the remaining qualification information provided by all 14 applicants in their applications was found by PIU to be sufficient for making the determination of the applicants' qualifications against the specified qualification criteria. If not, please send a written request to seek clarification from the applicants inrelation to the produetien :rate of key activities. 4. It is indicated in the AER that one applicant (PT Lince Romali Raya) does not meet the requirement of general experience and two applicants (PT Conbloc Infratecno and PT Jaya Konstruksi Manggala Pratama) do not meet the requirement of key activities. It seems that the :firm carried out the past contract experience as lead partner of 55% portion of IV. For the cash flow requirement, it is stated in the- footnote of Section III PUll1t J.l(b) ofilie Prequalification document that the applicant must demonstrate the availability of the required liquid assets in the form of a statement showing the amount in the applicant's bank account and/or through line of credit supported by letter from the applicant's commercial bank confirming availability of those funds for this contract if awarded to the bidder. However, in the table of AER, it appears that PlU incorrectly calculated the total amount of the applicant's available liquid assets by also including the amount equal to the difference between current assets and current liabilities based on the latest period of the applicant's audited financial statements. This is inconsistent with the requirements specified in the pre-qualification document. Please revise the AER accordingly by determining the available liquid asset of each applicant based on the documented amount in the applicant's bank account and/or line of credit, as specified in the qualification criteria of the pre-qualification document, In case after having correctly calculated the available liquid asset of each applicant, if the applicant does not meet the requirement of cash flow (in the form of liquid asset and/or credit line) and if the applicant meets all other qualification criteria, then in order to avoid restricted competition at the subsequent bidding stage and also given that the cash flow requirement in any case has to be verified 'as being met at the later stage of bidding, 'the B.an1~will be willing to. consider if PIU would like to still conditionally pre-qualify all such applicants subject to the applicant meeting the required minimum amount of liquid assets at the later time of bidding

It seems that the firm carried out the past contract experience as lead partner of 55% portion of JV. Please confirm that the total amount of 10,338.02 ton/month for asphalt and 9,011.25 m3/month is the total production rate done by PT Jaya Konstruksi.
4. PT Lince Romauli Raya did not submitted completely data for general experience and this applicant had failed in MCTO requirement so we assumed the clarification was not need anymore for general experience. PT Jaya Konstruksi Manggala Pratama submitted the complete data. The committee evaluated the biggest experience of key specific activities that had submitted to us (calculation of production rate and supporting pages of data included in the report). Same case for PT Conbloc infratecno based on completely data received, the committee evaluated the highest production rate of the applicant related to Aggregate and Asphalt works.
5. For the cash flow requirement, it is stated in the footnote of Section III point 3.1(b) of the Pre- qualification document that the applicant must demonstrate the availability of the required liquid assets in the form of a statement showing the amount in the applicant's bank account and/or through line of credit supported by letter from the applicant's commercial bank confirming availability of those funds for this contract if awarded to the bidder. For cash flow requirements in section III point 3.1 (b) we have to fix in accordance with the requested World Bank, where in the evaluation sheet have included data support the bank and current account of each applicant. The committee had corrected the evaluation regard to this criteria, some applicant did not submitted the data and some others based on evidences includes in document did not fulfill the requirements, as suggested by the Bank to avoid restricted competition, the committee made consideration to qualified in applicant who did not fulfill the requirement for cash flow but meet the requirement in other criteria. For all applicants the financial resources must be updated and meet the requirement for this criteria at the bidding stage.
6. Please also confirm that in addition to the advertisement in UNDB online, this procurement process was also published in local newspaper and/or in PIU's website.
