SU MMARY This research aims to define the main reasons for success of the Dutch HFC emission reduction system, called the STEK regulation. Besides that recommendations are formulated to successfully implement similar regulations in other European countries. This STEK regulation was introduced in 1992 because of the Montreal protocol and started with the regulation of CFCs. Later on, HFCs, considered alternatives for CFCs, were also included in this regulation. HFCs, unlike CFCs have, no significant ozone depleting potential. However they do have a global warming potential. The contribution of HFCs to the total GHG emissions is projected to increase from 1% currently to 4-10% in the future. Total costs to reduce global warming can decrease if HFC emissions are reduced. The highest HFC emissions occur in the commercial refrigeration sector. The Dutch STEK system has succeeded in reducing the emissions from refrigerators from 30% to about 5% by introducing an administration and control system. The most important characteristics of this regulation are: • All organizations and personnel working with refrigerants should be certified. • All owners of an installation containing more than 3 kg refrigerant should only contract certified installers for installation, maintenance and repair. • All installations should be checked on a regular basis. • The use of HFCs should be administrated. In 2006 a similar regulation was in 2006 introduced throughout the EU. This European ‘F-gas regulation’ should be implemented in the individual member states in 2009, therefore 2008 seems a good moment to look back at the fifteen years experience in the Netherlands to investigate possible lessons for the EU regulation. To find the main reasons for success the actor system of the commercial refrigeration sector was researched, by means of web search and literature search. After mapping this system the most important actors were defined and interviewed. These interviews were used to investigate the main reasons for success and to find more information about the differences in opinions. The interview results show that the most important factor for success is thought to be the strong enforcement in the introductory years of STEK. Furthermore STEK lead to a higher environmental awareness in the sector, this resulted in an intrinsic motivation to comply with the STEK regulation. Another important reason is that the quality of the sector improved. The biggest disadvantage was found to be the relatively high administrative burden. This lead to extra costs that were, according to some actors, too high. The actors were asked to give their opinion on the success of different ways to reduce HFC emissions. The answers differed a lot. Especially on the expected cost-effectiveness big differences exist. Differences in expectations can influence the speed or direction of innovations. The work resulted in the following recommendations for further research to be able to really give an impression of the success of the EU regulation: • Identify the intention of the different member states on enforcement for this regulation • Define the opinion of the actors in other countries to identify the differences in opinion among the EU countries. To successfully introduce similar regulations in other countries the following aspects should be taken into account: • Strong enforcement during introduction. • The advantages (better environment, better installations) should be emphasized.

1. INTRO DU CTION Refrigeration has greatly improved our daily lives. Food stays fresh longer, medicines can be used for a longer time period and our work environment is more comfortable because of air-conditioning. These are only three examples of how refrigeration has changed our lives. Several decades ago a car with air-co was considered a luxury in the Netherlands; nowadays it is standard in new cars. Supermarkets sell more and more fresh and ready to eat products (Dutch Food Retail Association/ Centraal Bureau voor Levenmisddelenhandel [CBL], 2008). These and other changes increase the demand for cold (McCoullouch, 1994). This increased demand for cold could not only increase energy use, but also increases the risk of leakage of refrigerants into the environment. Hydrofluorocarbons (HFCs) are now the most commonly used refrigerants in new refrigeration and air-conditioning systems (Intergovernmental Panel on Climate Change [IPCC], 2005). HFCs have a big advantage over their predecessors, the Chlorofluorocarbons (CFCs): HFCs have no significant Ozone Depletion Potential (ODP)1. A disadvantage of both HFCs and CFCs is their relatively high Global Warming Potential (GWP)2(IPCC, 2005). Because of this GWP, HFCs are included in the basket of gases in the Kyoto protocol (United Nations [UN], 1997)3. The Kyoto protocol aims to reduce the global 1990 emission level of the six defined greenhouse gases with 5% in 2012 (UN, 1997). HFCs are mainly emitted due to leakages during use, maintenance and unsuccessful end of life recovery (IPCC 2005). HFC emissions currently contribute 1% of the total global GHG emissions (Reilly et al 1999). It is projected that without additional policy measures, this may rise to 4-10% in 2100 (Ko, Sze, Molnar & Prather, 1993). Although the contribution of HFC emissions to the total greenhouse gas emissions is relatively small, their reduction potential is thought to be important. It is generally agreed that measures to reduce HFC emissions can significantly reduce total emissions reduction costs (Chesnayea de la, Harveya, Kruger, & Laitner, 2001; Reilly, et al., 1999). It is therefore no surprise that the European Union wants to reduce the emissions of HFCs. Until 2005 three distinct policy measures were introduced in Europe on a national level to reach this goal: (1) Financial measures, e.g. taxes on HFCs to stimulate companies to use less HFCs, search for alternatives or recycle HFCs (Denmark). (2) A total ban (using phase out) on HFCs, HFCs cannot be used and companies are forced to use alternatives (Austria and Denmark). (3) Control on the use of HFCs, forced administration of use, and regulation on how to maintain an installation, also called containment measures (Sweden and the Netherlands) (Hekkenberg & Schoot Uiterkamp, 2007). To prevent market distortion because of different legislation in member states, the European Union (EU) introduced the F-gas regulation4 in 2006. This regulation makes it compulsory for each European country to design a structure to control the use of HFCs and other fluorinated gases, which is very similar to the existing containment strategy in the Netherlands. This strategy exists in the Netherlands since 1992, and is called the STEK-regulation5. The national legislation of the member states to comply with the EU policy is currently being developed by the member states and involved actors. The current situation thus offers a unique opportunity to use the fifteen years of learning experience and practice from the Dutch policy to improve the effectiveness of national policies in other EU countries. 1 Ozone Depletion Potential: ‘The amount of ozone destroyed by the emission of a gas over its entire lifetime relative to that due to emission of the same mass of CFC-11’. (WMO, 1991) 2 Global Warming Potential: ‘An index defined as the cumulative radiative forcing between the present and some chosen time horizon caused by a unit of gas emitted now, expressed relative to that for some reference gas’(IPCC, 2005). In this report, and in general this is CO2. Under the STEK regulation it is compulsory for an organization working with refrigerants to have a STEK-certificate. This can only be obtained if all employees working with refrigerants are certified to do so. It is obligatory for the owner of an installation to arrange regular checks and maintenance of the installation. Besides behavioural changes STEK lead to technical improvements of cooling installations. In some cases technical improvements simply occurred because the old method was forbidden, but other improvements might have occurred because of the changed attitude due to STEK. However it is hard to steer the direction of technical development. There are many examples of a technical solution being adopted much slower than expected. The adoption or refusal of a certain innovation is often due to many more factors than its potential for improvement. (Purvis, Hunt and Drake, 2001). The importance of actors (sometimes also called stakeholders) is often underestimated. The success of an innovation is highly dependent on the acceptance of the actors involved. A good example of this phenomenon is shown by Brezet (1994), in his study on the introduction of high efficiency heaters. The goal of the European and Dutch law is to improve the leak tightness of refrigerators6, so that their environmental impact will be smaller. This goal can partly be achieved by implementing technical directions for the construction of refrigerators. The installers, users and other actors involved in the system should also be motivated to work in this system. The estimated HFC emissions of the installed commercial refrigeration banked inventory (IPCC, 2005) in the Netherlands (about 5%) are much lower than the world average (30%) (Menkveld & Wijngaart van den, 2007). Critics claim that the reported emissions are rather unreliable and that the actual emissions could range anywhere from 3 to 13% (Anderson, 2005). This is still lower than the world average. In general the Dutch policy is therefore considered a success. However, four years after its implementation 40% of the companies were non-compliant to the STEK regulation. Nowadays non-compliance is reduced to 20% (personal communication with STEK). To facilitate and accelerate emission reductions in other countries, it is interesting to investigate how the Dutch commercial cooling sector was able to increase the compliance. Given that different preferences may lead to barriers in the implementation of these alternatives, investigating the influence of these preferences on the introduction of the Dutch legislation may provide valuable lessons for implementing similar legislation in other countries. 1.1.
Research aim and basic methodology description
This research aims to assess the key success factors of Dutch HFC-emission reduction policy from an actor perspective. This is done by investigating the main reasons for success of the Dutch STEK system. Besides that, also the existing pitfalls should be made clear. The description of the actor system and retrospective analysis of the different views of each actor are the main tools involved. In this research the unique opportunity in the Netherlands is used to do a retrospective research on the Dutch situation. The actor system of the Dutch commercial cooling sector is described. The most important actors are interviewed and with this knowledge recommendations can be formulated to successfully implement the European F-gas regulation. In the commercial cooling (CC) sector the following overall actor system can be described: designers, producers, retailers, buyers, mechanics, and recyclers. All of these actors have their own potential for change and may have their own opinions about which and how changes could best be introduced. 1.2.
Research questions
Given the aim and basic methodology, the following research questions can be formulated. How did the Dutch emission reduction system on F-gases become a success and what are potential lessons for other countries from the Dutch process? Sub questions; 6

This mainly retrospective study focuses on the actors involved in the Dutch STEK-regulation from 1992-2007. The STEK regulation was adopted in 1992. This gives a 15 year time span for following the changes in opinion of the different actors. The STEK regulation is investigated to point out the most important factors that lead to the success of this regulation. This knowledge can be used by other countries to successfully implement their F-gas regulation. STEK is a regulation concerning synthetic refrigerants CFCs, HCFCs and HFCs. The F-gas regulation regulates Fluorinated gases included in the Kyoto basket. HFCs are the largest group of F-gases. On a global scale the commercial cooling (CC) sector is the biggest contributor to HFC emissions in the refrigeration and air-conditioning sector. The annual leakage rate in the CC sector is estimated at 30% of the installed commercial refrigeration banked inventory (IPCC, 2005). Therefore the CCsector is chosen as the main focus sector of this research. The CC sector is in the IPCC report defined as: ‘the part of the cold chain comprising equipment used by retail outlets for preparing holding and displaying frozen and fresh food and beverages for customer purchase.’ In this study to this definition is added ‘the storage of food in cold stores before it is sold’. This definition of ‘commercial cooling’ is slightly broader than the definition used in the IPCC report. This is mainly because the cold store capacity in the Netherlands is both relatively and absolutely the largest in Europe (Wim van Bon, website NEKOVRI as seen on 15-12-2007). Moreover ammonia, the most common refrigerant in cold stores, is used less frequently in the Netherlands than in the rest of Europe. This is caused by the very stringent Dutch safety regulations for ammonia. This study is an actor study of the HFC cycle in the CC sector. The use of HFCs in other sectors is not taken into account, nor are actors involved in other refrigeration sectors. Two actors that may be considered part of the CC-HFC system are not included in the actor analysis: the HFC producer and the destruction of old refrigerators. They are expected not to be able to give their opinion of the impact STEK has, since they are not regulated under the STEK regime and have therefore no experience with STEK. 1.4.
Scope of the report
Chapter two presents the methodology of this research. In chapter three the legal/political history of regulation concerning F-gases is presented. In this chapter the different political events are discussed, starting at the Montreal protocol and ending with the current EU and Dutch legislation. This chapter is followed by a description of the actor system, in chapter four. The system is analyzed; the place, function and important relations of each actor is described. The results of the interviews with the different actors are described in chapter five. This description of the opinions of the different actors is discussed in chapter six. Chapter seven presents the conclusions and recommendations of this research.

2. METHODOLOGY Representatives of the different actors in the system were interviewed to answer the research question, ‘How did the Dutch emission reduction system on F-gases become a success and what are potential lessons for other countries from the Dutch process?’ To select which actor should be interviewed a list available from earlier research was used as a starting point. Using websites and information available about these actors the actor system was investigated. Experts from the field were consulted on which actors should be included in the system. During the interviews the actor system was part of the questionnaire to verify if all actors were included in the system. When possible, a branche organization of each actor was interviewed. The assumption is that the representative of a branche organization will be familiar with the ‘average’ opinion of the group he represents. To get an idea of the spread of opinions some individual actors are also included. Eleven different representatives were interviewed. The complete list of interviewed actors is presented in chapter 5. The interviews were held following a standardized questionnaire which was only sent in advance when the actor requested it. The written questionnaire was made following the approach described by Emans (1990). First the aim of the interview was defined with the research questions that should be answered using the questionnaire. After that the questionnaire was developed. Open and closed questions are carefully alternated. The STEK regulation has not been subject in a similar type of research before. Therefore it is hard to formulate an exhaustive enumeration. A closed set of answers would possibly say more about the expectations of the creator than of the respondent. Therefore most closed questions were preceded by an open question. This forces the respondent to formulate his own answer and this will result in a more realistic overview of the problem. A drawback of open questions is that it is hard to compare the different answers. That is why closed questions follow the open questions. This stimulates the respondent to choose the answer that fits best to the open answer he gave before. After that the interview was reviewed by an expert on interviewing to check its consistency. An expert from the cooling sector reviewed the interview to check it on factual flaws. The complete questionnaire is included in Appendix A; the original questionnaire is in Dutch. The interview consisted of three parts. The first part was used to check whether the described actor system is correct and to define the place of the interviewed actor in the system. In this part the actor system is evaluated and the actor has to explain his relations with the other actors. The second part of the interview goes into detail about the STEK regulation and is meant to study the factors for success. The actor had to answer questions on his opinion about STEK, the advantages and disadvantages of STEK and why the system is successful. Most questions were first formulated as an open question and followed by a closed question. A list with propositions was included in this section as well. These propositions can be split up in different sections. This gives more information about the opinion of the respondent in the STEK system. The third and final part of the interview went into more detail on the technological aspects. There were questions about the alternatives for HFCs. These questions are mainly included to find out how much knowledge the respondent has about alternatives. Other questions were about the factors that are important to choose for a certain technique or appliance. This includes questions about preconditions for new cooling appliances. Other questions deal with the sources for information that are used in the decision making process. This was done to find out how actors choose and how much they depend on other actors in the decision making process. For the relationship between the actors it is important to know how people make decisions. Finally there were questions about different ways to reduce emissions and about the expected success of the new EU-regulation. The actors were asked which of the possible alternatives is best and whether there would be problems implementing a STEK-like system in other European countries. The results of these questionnaires were used to find the most important factors that resulted in a success of the STEK regulation. This lead to the answer of the research question.

3. OV ERV IEW OF THE RELEVA NT POLICIES CO NC ERN ING STEK This chapter describes the most important global, European and national regulations concerning synthetic refrigerants. Synthetic refrigerants are refrigerants industrially produced and do not occur naturally in the environment; CFCs and HFCs are such refrigerants. For the understanding of the STEK regulation it is important that the other laws involved are discussed as well. An overview of the regulations discussed in this chapter is shown in figure 3.1 3.1.
The Montreal Protocol
CFCs are used in cooling applications since the ‘30s. During the ’70s the ozone depleting potential of CFCs was discovered (Molina and Rowland 1974). In 1985 Farman, Gardiner and Shanklin discovered the hole in the ozone layer and the use of CFC became debated. In the same year the Vienna Convention for the protection of the ozone layer (1985) was held. A global approach was essential to successfully combat the effects of CFC-emissions. The Montreal Protocol was drawn up in 1987. The Montreal Protocol forces countries to reduce CFC-production and use. It is prohibited (in developed countries) to produce new CFCs. The use of HCFCs (an alternative for CFCs) is still allowed, but is being phased out at the moment. In 1988 the Council of the European Economic Community ratified the Vienna Convention and the Montreal Protocol (88/540/EEC). This regulation has been repealed and replaced a couple of times. It can now be found as 2037/2000/EC. This regulation is the legal base of the Dutch ‘Decision on ozone depleting substances7 (1994)’. This ‘Decision’ is the Dutch implementation of Montreal Protocol. It is replaced and is now called ‘Decision ozone depleting substances (Environmental Law 2003)’8. 3.2.
Kyoto Protocol
While the ozone problem was globally addressed, a new climate related problem was recognized: the enhanced greenhouse effect. In 1988 the IPCC, was founded with the goal to ‘assess the scientific, technical and socioeconomic information relevant for understanding the risk of human induced climate change.’(IPCC 2005). In 1992 the United Nations Framework Convention on Climate Change (UNFCCC) was held. The following objective resulted from that convention: “The ultimate objective of this Convention and any related legal instruments that the Conference of the Parties may adopt is to achieve, in accordance with the relevant provisions of the Convention, stabilization of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system. Such a level should be achieved within a time frame sufficient to allow ecosystems to adapt naturally to climate change, to ensure that food production is not threatened and to enable economic development to proceed in a sustainable manner.”(UNFCCC 1992) In 1994 the European Union approved the framework convention. In 1997 the Kyoto Protocol was formulated. The Kyoto Protocol states that in 2012 the greenhouse gas emissions (included in the Kyoto basket) should be 5% lower than the 1990 level. Each country has its own reduction target. In 2002 the European Union signed the Protocol. When Russia signed in 2004 the needed quorum of joining countries was reached, so in February 2005 the Kyoto Protocol came into force. Although the Kyoto Protocol was not yet into force, in 2003 the European Union and the Dutch government implemented regulations to reduce greenhouse gas emissions. In the Netherlands this, among others, lead to the ‘Decision on greenhouse gases 20039’. 3.3.
European F-gas regulation
On May 17 2006 the Regulation (EC) No 842/2006 of the European Parliament and of the Council on certain fluorinated greenhouse gases (F-gas regulation) came into force. The objective of this

regulation is to reduce the emissions of F-gases covered by the Kyoto protocol and therefore protect the environment. The conditions on how to handle F-gases are described in the F-gas regulation. The individual member states are obliged to implement regulations to ensure that the F-gas regulation is complied with. The most important rules in the F-gas regulation for the CC sector are the following: User -
Leakage of F-gases should be prevented with all technically feasible options as long as they do not entail disproportionate costs. Leakages should be detected and repaired as soon as possible. Certified personnel should check for leaks on a regular basis. Arrange proper F-gas recovery by certified personnel.
Refrigeration engineers/installers - European minimum requirements and conditions will be described for the certification of the companies and personnel. - Each Member State will establish their own training and certification requirements. - The GWP of F-gases used in installations should be included in the installation manual. Producer/distributor - Each producer, importer or exporter shall communicate the amount of F-gases that he has put on the market. - Each producer, importer or exporter shall communicate the amount of F-gases recovered, reclaimed or destroyed. On the 4th of July 2011 the effect and results of the F-gas regulation will be evaluated.
3.4.
STEK
STEK was introduced in the Netherlands in 1992 to reduce the emission of ozone depleting CFCs. STEK is designed as an implementation of the European Ozone regulation. However, the scope of STEK is broader than was strictly necessary for the European regulation. The attention in this EUregulation lies on reducing the production (and use) of CFCs (and HCFCs), not on the reduction of emissions. There was no legal necessity to include the ‘use phase’ in the CFC-reduction regulation. The government involved the sector very early on in the development process. The sector was asked to define a regulation that would decrease the emissions in the refrigeration sector. There was a good cooperation between the sector, experts and the government during the design of this regulation. This was a unique situation. When HFCs were introduced as an alternative for CFCs the government decided that HFCs should also be controlled under the same regulation. This has resulted in fifteen years of experience in the Netherlands with respect to emission reduction measures. STEK is an admission regulation that is based on the ‘decision on substances that deplete the ozone layer.’ This decision gives guidelines for ministerial regulations. The following items should be regulated: 1. Regulation to control of stationary equipment with more than three kilogram of refrigerant. 2. Regulation on examination and certification of individual installers. 3. Each individual person working with refrigerants should be certified. 4. Regulation can include rules on the certification of companies

The most important regulation for this is the ‘Regulation on leak-tight cooling installations 1997 (RLK)’10. In this regulation all safety measures and technical requirements are described. This regulation refers to STEK as the only certifying organization. STEK is the organization that has to control and examine the different installation companies. The rules of STEK (STEK 2007 and earlier versions) go into more detail about the exact rules companies have to comply with. In 2003 the European Pressure Equipment Directive (PED) was changed. The consequence was that cooling equipment had to comply with this regulation. In the earlier version of the PED this was not clear. Some countries included cooling installations and others did not. Since 2003 all countries had to include cooling applications in their ‘pressure equipment laws’. In the Netherlands this was based in the in 2003 revised ‘Decision commodities act pressure equipment’11. This included cooling applications and the construction of cooling applications. Before the PED was revised the construction of a cooling application and the connection of tubes involved was not controlled under the PED. In 2003 it was decided that the construction of a refrigerator should also comply with the safety regulations of pressure equipment. This resulted in more international, but in the eyes of some actors less strict rules. The PED does not allow individual member states to demand stricter rules in this field. This resulted in an alternation of the STEK rules. The goals of the PED and the RLK are different. The goal of the RLK is to reduce emissions as much as possible, while the goal of the PED is to have safe pressure equipment. A leaking installation can still be safe. In 2006 the RLK was changed due to the F-gas regulation. The RLK is now split into the ‘old’ RLK which only holds for ships and the new RLK called ‘Regulation on leak-tight cooling installations in the use phase 2006 (RLK 2006)12’. Until the new EU-based regulations are defined the STEKcertificate stays the only valid certificate to work with refrigerants. However, the future existence of STEK in its current form is uncertain. A summarized picture of the described regulations is presented in figure 3.1.

4. THE A CTOR SYSTEM This chapter describes the actor system of the refrigeration sector in the Netherlands. The following sub questions are addressed: o Who are the different actors in the CC-system? o How big is each group of actors? o What is the role of each group of actors in the CC- system? The full environmental impact of a given service or action, is usually comprised of the impact of multiple processes that are required for this service or action. In environmental life cycle assessments, such services or actions are therefore investigated from “cradle to grave”; all environmental impacts that arise from first extraction of raw materials, to the ultimate disposal of used goods into the environment are included in this methodology (Guinée, 2002). A similar approach can be followed regarding the different actors that are involved in providing a service. The effect on the environment of one step in the process is generally influenced by other steps in the process. In this chapter the processes that are involved in the lifecycle of CC-systems are described. For each step in this lifecycle the involved actors were identified. The overall system is shown in figure 4.1. Some steps in the system are only performed by one type of actor, while other steps can involve different kind of actors. For each step the actors involved and an approximation of their size in the Netherlands is made. The lifecycle of a cooling installation consists of two ‘streams’ 1. HFC stream 2. Apparatus stream First, the HFC-cycle is be described, followed by the cooling installation cycle. Finally a table (table 4.1) with the defined actors and their size in the Netherlands is presented to summarize the text. The numbers between brackets at each process corresponds with a number in figure 4.1. The actors that are included in this research are indicated in italics when first mentioned. After the description of the two streams the role of the involved political organizations in the system and the main actors they interact with are discussed. 4.1.
HFC Stream

about five refrigeration engineering companies that supply the major part of the market. The small supermarkets might work with small refrigeration installers. The refrigeration installer or engineer loads the HFC in the installation. The HFC now enters the use phase (3). Typically, two things can happen; the HFC can leak from the installation or it can be recovered (4).Recovery generally occurs when the installation is broken down or during maintenance. Recovery is done by refrigeration installers or engineers. The recovered HFC is transported to either the distributor or the producer. Depending on the quality, they will recycle or destroy (5) the HFC. 4.2.
Apparatus stream
In order to be able to build a cooling installation raw materials have to be extracted. Since these materials (steel, aluminium etc.) are not solely used for the construction of refrigerators and as this would broaden our research too much, the ‘apparatus stream’ starts at the design and production of refrigerant parts (6). There are a few companies that design parts in the Netherlands; most parts are imported. With these parts a refrigerator is designed (7). This is either done by the refrigeration consultant or by a refrigeration engineer. In the CC-sector there are mainly two types of users, supermarkets and cold-stores. A consultant is not frequently contracted in the supermarket sector. Most supermarkets want a standard installation, with proven functionality. The average lifetime of a supermarket refrigerator is 7-8 years. When a supermarket wants to construct a new kind of refrigeration a consultant is sometimes contracted. In the cold store sector consultants are a bit more common. The average lifetime of a cold store is 30-40 years. The installation has a much longer lifetime and the investment is usually bigger than in the supermarket sector. Innovations can therefore diffuse much faster in the supermarket sector than it can in the cold store sector because of the different lifetimes of the refrigerator. When the refrigerator is designed by a refrigeration consultant it will be installed (8) by either a refrigeration engineer, or installer. The product is designed and after that built on the spot. When the installation is built, it is filled with HFCs and put in use (9). The refrigerator is used by the user, in this research mostly supermarkets, or cold stores. During the use phase of the refrigerator the user is obliged to maintain (10) his installation by certified personnel. In practice he contracts a refrigeration installer of engineer. In most cases this is done by means of a maintenance contract by a refrigeration engineer (interview Fri-Jado). A new installation has a certain warranty period, in this period the maintenance is most often done by the company that built the installation. When the warranty period is over, supermarkets can change to a different maintenance contract. This happens sometimes, but it is unclear how often this happens. When the installation is disposed by the user it is either recycled or destroyed (11) by a refrigeration engineer or installer. The HFC is withdrawn from the installation and returned to the HFC distributor or producer. A summary of the actors involved in these two ‘streams’ is shown in table 4.1. 4.3.
Regulatory system
A schematic overview of the policy system is shown in figure 4.2. The STEK regulation was introduced because of the European ozone legislation and the Montreal protocol. When HFCs were developed, the Dutch government decided to include HFCs in the STEK regulation, there was at that time no European regulation in place that obliged to do this. The VROM ministry is the legislative body of the STEK-regulation; it does not directly enforce the regulation. Two organizations enforce the STEK-legislation (VROM-inspectorate and the Competent Authorities [CA]), both with a different emphasis and function. There is one executive body, STEK. The role of STEK consists of two main functions: (1) certification and control of companies and (2) definition of examination rules and the organisation of these exams. The RLK specifies that it is obligatory to use certified installers in the CC-sector. Certification can only be obtained through STEK. To be certified, one should be a member of STEK. When a company applies to become a member, STEK has to check if a company complies with the STEK rules and is eligible to become a member. The rules are partly laid down in the RLK and partly in the STEK-rules. If a company fails to comply with the STEK-rules STEK can as an ultimate measure terminate the STEK membership. It is not possible for STEK to take any further actions. The other function of STEK is to specify the ‘end terms’ for new installers to be able to get their certificate. STEK is also responsible for the final examination of installers. The two enforcement bodies can give penalties and would even be able to close organization if misconduct continues. The VROM-inspectorate and CA have their emphasis on control of the user. The CA checks all organizations in their region on permits that could apply for that organization. There is therefore no specific attention paid to STEK. The VROM-inspectorate is the main enforcing body for STEK. However, the VROM-inspectorate also has many other laws and regulations they should check for. Some of these regulations are emphasized each year. During the early years of the STEK regulation, STEK was given such emphasis. When compliance rates increased the emphasis was put on other regulations and STEK was more passively enforced. Hints indicating misbehave of companies are sent to the VROM-inspectorate and may lead to further enforcement actions.

5. RES ULTS PER ACTOR The results of the interviews are described in this chapter. The same protocol is followed in each interview. The interviews with STEK, VROM and VROM-inspectorate are slightly different because their role in the system is different and not all questions were relevant. The interviews are presented in Appendix B1 to B10. All respondents agreed with the publication of their answers as they are written down in the appendices. Table 5.1. The final question about STEK was about the introductory problems that occurred. Unfortunately not all respondents were able to answer this question. Despite our efforts to interview people that were involved since the beginning of STEK this was unfortunately not always possible. g. Methods to reduce HFC emission The questions about the effectiveness of different measures to reduce HFC emissions were closed. Five options were given: - Use of non-HFC refrigerants - Better leak-tight systems - Lower refrigerants charge per unit of cooling capacity - Reduced refrigerant capacity demand - Prevention of emission by means of controlling The respondent was asked to score these measures on effectiveness, desirability, cost-effectiveness and feasibility. The respondent was asked to rate each measure from 5-1 where 5 is most effective, desirable, feasible or cost-effective. The combination of those four factors shows the expected effect of each measure. This is shown graphically for each actor as shown in figure 5.1. h. Expected effect of the European F-gas regulation This question was closed. It turned out that this question was difficult to answer for most actors, because it is hard to ‘imagine’ the future. 5.1
HFC- Distributor (Linde gas)
a. Position in the system Linde gas is a distributor of, among many other gases, refrigerants. Linde gas does not fall under control of STEK, and is therefore not obliged to administrate their refrigerant distribution. b. Opinion about STEK Grade at introduction: n/a Grade now: 7 The person we interviewed has been working in the refrigeration field for 2,5 years so he could not give an opinion about the introduction of STEK. He grades the current functioning of STEK with grade 7. c. Advantages of STEK - It is an advantage for a distributor of refrigerants that is it possible to see who has a STEK-certificate, so who is a potential customer. - The volume of refrigerant used is known. - It is a regulation; everybody has to comply with the same, clear, rules. 22
d. Disadvantages of STEK - The amount of administration that is needed. - There are regional differences in the enforcement of the regulation. e. Reasons for success According to Linde gas, the facts that STEK is a regulation and that the initial enforcement was very strong are the most important factors for success. In figure 5.2 three different forms are identified low refrigerant charge scores intermediate on all options. The other measures are each others opposite. Alternatives for HFC vs. control and technical vs. demand for cold. This shows that according to Linde gas there is not one ultimate solution possible. h. Expected effect of the European F-gas regulation The regulation will probably cause higher administrative costs for Linde Gas. In the new F-gas regulation is more administration of the sold products needed. It will be very hard to control if the reported emissions are correct, moreover because there are few countries that have good baseline measurements. There will be an incentive to report low emissions, this might result in lower reported emissions than the reality. 5.2.
Producer of parts (Alfa Laval)
a. Position in the system Alfa Laval is a producer of parts for refrigerators. The parts Alfa Laval produces have to comply with the PED and RLK and therefore they have to have a STEK certificate. b. Opinion about STEK Grade at introduction: 4 Grade now: 7,5 The STEK regulation has no big impact on Alfa Laval at the moment. The RLK and STEK introduced specifications for refrigerant parts. The control on imported parts was too low and this lead to a big

disadvantages for Dutch producers of parts. For its functioning at introduction STEK therefore is graded a 4. This big disadvantage disappeared when the European PED replaced the RLK. The current grade for STEK’s functioning is 7,5. The current technical regulations are not very clear, especially in the border regions. c. Advantages of STEK - The quality of the sector improved - Lower leakage rate / high awareness in the sector - Better skilled refrigeration engineers and installers Disadvantages of STEK - Because of the lack of control on imported products the STEK regulation resulted in a competition disadvantage for Dutch producers of parts e. Reasons for success The most important reason for success is that it is a law and that there is enforcement. The three most important factors from the list are: 1. The branche organization supports the regulation. 2. The rules are clear 3. STEK positively influences the performance of the installation f. Introductory problems of STEK: The technical rules were unfair and this leaded to a disadvantage for Dutch companies. When this was reported, there was no adequate reaction. g. Methods to reduce HFC emission This question is only partly answered because we ran out of time. It will be most effective to aim for ‘a lower demand for cold’. To really define the effectiveness of a measure you should not only look at HFCs, but at the Total Equivalent Warming Impact (TEWI)13. h. Expected effect of the European F-gas regulation Also not answered due to lack of time 5.3.
Branche organization of the refrigeration sector (NVKL)
a. Position in the system The NVKL is the branche organization for the refrigeration and air-conditioning sector. It represents members in the whole range of the cooling sector. This includes all actors except the actor ‘user’ and ‘HFC producer/distributor’. Most members are refrigeration engineers and installers. b. Opinion about STEK Grade at introduction: 3 Grade now: 7,5 When STEK was introduced most refrigeration engineers and installers did not like it. People that had no experience in the field of refrigeration would have to control the quality of their work. Inspection in the sector was new. Therefore the functioning of STEK was graded a 3 during introduction. Later it became clear that STEK also had some important advantages. Installations improved, became more leak-tight and reliable. Besides that, STEK also protected the sector for unskilled (cheap) installers. To be allowed to work in the sector you need a diploma. Nowadays the NVKL is very positive about STEK and so is the majority of its members, its functioning is therefore now graded a 7,5. c. Advantages of STEK - The quality of installations and organizations improved. - The environmental awareness in the sector rose, more than it has in the rest of Europe. 13

Figure 5.3 shows that the technical and control options score very low. This is because it is already working very well. It would take a lot of effort to improve the already achieved results. Decreasing the demand for cold, or the needed refrigerant charge will be the best options. They score high on all aspects. h. Expected effect of the European F-gas regulation The refrigeration sector is different in several European countries e.g. England, Spain, Greece and Italy than in The Netherlands. In The Netherlands only specialists work in the refrigeration sector. In the other countries above this is not the case, every installer or electrician is allowed to work with refrigerants. This difference resulted in a lot less demanding EU-regulation than the Dutch one. The success of the regulation depends on the other EU countries. If everybody cooperates it can be a success.

Consultant (Adviesbureau Verhoef)
a. Position in the system Adviesbureau Verhoef is a consultancy firm for the refrigeration sector. Consultancy firms do not need a STEK-certificate because they do not work with refrigerants. However, it is important to design ‘STEK-friendly’ installations. b. Opinion about STEK Grade at introduction: n/a Grade now: 9 Compliance with the STEK rules became the standard. Less enforcement is needed because the installer and user both agree on the importance of a regular check. The functioning of the STEK regulation is therefore graded a 9. Figure 5.4 shows that the options are or, cost-effective and feasible but not effective and desirable (control and technical), or effective and desirable, but expensive and feasible (No HFC and low demand). Refrigeration engineer (Fri-Jado)
a. Position in the system Fri-Jado is one of the big refrigeration engineering companies that work in de commercial cooling sector. b. Opinion about STEK Grade at introduction: n/a Grade now: 7 It is difficult for the respondent to grade the introduction of STEK, since the respondent was not working at Fri-Jado yet at that moment. It is clear that the refrigeration sector improved by the introduction of STEK. Leakage is discovered and repaired sooner. The reported emissions of STEK are lower than the reality, but the respondent is sure that there is less leakage now than in 1993. The implementation of the PED made the rules clearer (and more international) and the STEK regulation gained strength with this introduction. It is therefore graded a 7 for its current functioning. c. Advantages of STEK - It is a law - There is a strong force to repair leakages - It is necessary to keep an administration d. Disadvantages of STEK A lot of parts for a cooling installation are imported. These parts do not always comply with the Dutch rules. It is impossible to check all those parts. The Netherlands are too small to have a regulation like this. It is hard to change the habits of big foreign companies. e. Reasons for success The most important reason for success is the strong cooperation between the government and the sector. This created a lot of support for the legislation. The three most important factors from the list; 1. STEK is created by the sector itself 2. Inspections occur regularly 3. The branche organization supports the regulation. f. When these problems were mentioned to the branche organization, STEK or the VROM-inspectorate, the problem was often clarified fast.

Figure 5.5 shows that the most effective, desirable and cost-effective options would be to reduce the amount of refrigerant and the amount of cold needed in supermarkets. Unfortunately this is not feasible because supermarkets have a certain ‘look’ or formula and this does not encourage them to search for refrigerant low solutions. Control is the most feasible option, but is already working very well; extra controls would result in high costs for only a small improvement. h. Expected effect of the European F-gas regulation It is positive that there is European legislation now. It is questionable if it will change a lot. Most cooling appliances are already very good, there is not much more possible with the proposed regulation. The expectancy of Fri-Jado is that the reported emissions will be lower than the actual emissions; it will be hard to really define the success of the regulation. 5.6.
User (CBL)
a. Position in the system The CBL is the branche organization for food retail. This are mainly supermarkets, but can also be smaller convenience stores. CBL represents all supermarkets in the Netherlands. A supermarket is the user actor. b. Opinion about STEK Grade at introduction: 9 Grade now: 9 The rules for STEK are very clear. It makes the choice for a refrigeration engineer or installer easier. Only certified refrigeration engineers or installers are contracted; this guarantees a certain quality level. The quality of the service increased. Before STEK existed the quality of the service was less constant. Therefore STEK is graded a 9, both currently and at introduction. c. Advantages of STEK - The quality of the refrigeration engineer and installer became higher and more constant. - The person who has the knowledge, has the responsibility (for the installation) d. Disadvantages of STEK There are none for supermarkets.

Figure 5.6 shows that almost all options score the same number for each factor. This means that most options are considered equal on the four factors. Alternatives for HFCs are considered a very good option, except that it is expected to be expensive. The control option is considered to be the best option. h. Expected effect of the European F-gas regulation The CBL expects the European legislation to be successful. The Dutch legislation was successful and that can be a good example for the other countries. 5.7.
User (NEKOVRI)
a. Position in the system NEKOVRI is the branche organization for cold stores. It represents the user actor. b. Opinion about STEK Grade at introduction: 4,5 Grade now: 8 When STEK was introduced there was scepticism. It was thought to be just a political action and that it would not have any practical value. The functioning of STEK therefore graded a 4,5. Later it became clear that STEK had some important advantages. The quality of installations and of refrigeration engineers and installers improved. Because of the forced inspections, the quality of an installation has become a common interest. STEK’s functioning is now graded an 8. STEK would be even better if it also included installations with natural refrigerants.

Introductory problems of STEK The only thing that could have been better was the knowledge of the civil servants and certifying organizations. They were not used to working in the refrigeration sector. This is probably an inevitable disadvantage and disappeared over time. g. Methods to reduce HFC emission This question is only partially answered so an emission reduction options graph could not be made. When a new cold store is build, using an alternative for HFCs is the best option. It is cost-effective, most effective, desirable and possible. When an installation already exists it is very expensive to change it into using non-HFCs. Other effective ways would be to decrease the amount of refrigerant needed and the amount of cold storage needed. h. Expected effect of the European F-gas regulation As long, and only as, there is strict control on the regulation it will work. 5.8.
Expert (Unilever)
a. Position in the system Unilever is a user of refrigerators, but in this system it is a supplier to the user. Unilever has some influence on supermarkets, but this is only marginal. Besides the fact that, René van Gerwen, our respondent is head of refrigeration at Unilever, he is also member of the STEK board and was working at TNO when STEK was developed. Although his opinion is asked from a Unilever perspective, he has a lot of extra knowledge which cannot be neglected. b. Opinion about STEK Grade at introduction: 9 Grade now:7,5 When STEK was introduced the enforcement by VROM (inspectorate) was very strong. This was very important. Therefore its functioning can be graded a 9. The last couple of years there have hardly been any controls. A good estimation about the emissions at this moment is therefore impossible. Since 2001, when the PED was introduced the rules got less strict. According to the expert STEK functions not as good as in the beginning and is graded a 7,5. c. Advantages of STEK - The rules were clear and uniform. Figure 5.8 shows that alternatives for HFCs and a lower cooling demand are the most effective and desired methods, but the least feasible. Decreasing the emissions by controls or technical advancements is expensive and not effective. This is because these measures are already working well and there is not much improvement possible. h. Expected effect of the European F-gas regulation There are big differences between the European countries with respect to their refrigeration rules. The effectiveness of the legislation depends on what the desired effect is. A leakage rate of 5% is not realistic, but a leakage rate of 10-20% is. 5.9.
Executive body (STEK)
a. Position in the system STEK is the organization that has to control its members. b. Opinion about STEK Grade at introduction: n/a Grade now: n/a Most people did not like STEK in the beginning. A lot of rules were introduced. As time past by people started to see the advantages of STEK. Installations worked better and users were more satisfied with the service of the installers. Expected effect of the European F-gas regulation It is quite normal in the Netherlands to involve the sector in the design of a regulation and to cooperate with the government. This is not in all countries the case. The success of the regulation depends on each EU member and how they implement the rules. 5.10.
Enforcing body (VROM-Inspectorate)
a. Position in the system VROM-inspectorate does not create legislation, but inspects whether the legislation is complied with. It is not possible for VROM-inspectorate to control everyone and therefore they pick a set of legislations each year to check on. The last couple of year this has not been the case for the STEKlegislation. b. Opinion about STEK Grade at introduction: n/a Grade now: n/a When STEK was introduced people did not like STEK. It gave them less freedom and it was seen as an administrative burden. Later on, after about 2-3 years more and more companies discovered the advantages. It was a protection of the sector, it was not possible anymore for just anybody to install refrigerators. This was a big advantage for those who were allowed to do so. c. Advantages of STEK - The emissions in the refrigeration sector decreased drastically. - The quality of the products and the employees improved - The sector is protected, so that only skilled personnel can work with refrigerants d. Disadvantages of STEK - Protectionism, this decreases the possibilities for a free-market economy - Some parts of the legislation are too detailed. This partly occurred because of the cooperation with the sector. The sector wanted to include a lot of technical details. - There was no standardised form to keep a logbook. This makes control more difficult. e. Reasons for success - The reason, protection of the ozone layer was for everyone the same. Legislative body (VROM)
The answers in this section are interpretations of the author of this report derived from a personal meeting with VROM and a written reaction on the list of questions. In figure 5.10 the opinion of VROM is represented. VROM was not able to make an estimation of the costs, so this part is not filled in. Decreasing the demand for cold will be effective and desirable, but not feasible. VROM has the opinion that there is not much extra improvement possible with control and technical measures. h. Expected effect of the European F-gas regulation All member states will have to incorporate the F-gas regulation in their National regulations. Countries do have a certain degree of freedom, the interpretation of each member state could determine the success of the regulation.

6. D ISC US SION In this chapter the seven points reported in chapter 5 are compared and discussed. This discussion leads to answers on the following sub questions of the main research question. o o
What is the opinion of each actor of STEK, now and fifteen years ago, at the introduction? What are, in the opinion of the actors, the reasons for the success of STEK?
o What different measures are available to reduce HFC-emissions? o What measures are seen as most preferred by the actors? o What measures are seen as most effective by the actors? In this discussion an attempt is made to describe the STEK-system. We interviewed eleven people from the full range of involved actors in the system. This should give a good idea about the working of the actor system and the different opinions that occur, but it is still only a very small sample size. The discussion should be read keeping that in mind. 6.1.
Opinion about STEK
In figure 6.1 is shown that the average grade for ‘STEK now’ is 7,8. All actors but one are more positive about STEK now than they were at the introduction of STEK. The average of the introduction of STEK is 5,1. In this average is the opinion of the ‘expert’ not included. This expert is not an actor in the system and is therefore not included in the calculation of the average. The actors ‘engineer’ and ‘user’ are mentioned twice. As these two actors are also considered as the most important actors no average of the two grades is taken. Unfortunately three of the eight respondents did not work long enough at their organization to be able to answer the ‘STEK-introduction’ question. We expect the average grade for ‘STEK at introduction’ would be lower if all respondents would have been able to give a grade. Most of the respondents had the feeling that the opinion about STEK in their company was less positive at introduction.

The negative opinion was mostly fed by the fact that STEK was new, unknown and that the sector was not used to any control. The opinion of the respondents changed because it became clear that STEK had advantages and that its goal (to reduce emissions) was being achieved. The introduction of the RLK and the PED had influence on the opinion of STEK. It is remarkable that especially the introduction of the PED was for some actors (Engineer, producer of parts) an improvement, while according others (Expert, User) it was a detoriation of the STEK system. The PED caused changes in the technical demands for installations. This resulted in some eased prescriptions. Some actors regret this because it undermines the strict rules that were implemented by the RLK. On the other hand other actors argue that this regulation holds for the whole European Union and is therefore much stronger than the RLK. The RLK had a an important negative effect that imported goods did often not comply with the Dutch rules, but could still be imported and used because of insufficient control. Some respondents mentioned that their grade for STEK is decreasing at the moment. The European Fgas regulation rules are less strict. They are not officially implemented yet but the STEK rules are at the moment not strongly enforced, this leads to unclear situations. The grades for the STEK-regulation are high. This shows that the support for the regulation is high. It gives good hope for the success of the European F-gas regulation. 6.2.
Advantages of STEK
Each actor was asked to give the three most important advantages of STEK. These advantages can be divided into three main groups, and one rest group (other) see figure 6.2. The biggest group of advantages regards the quality improvement of the sector. This ranges from improvement of the skills of individual personnel to better management and administration of companies. The second advantage that is mentioned is the rise of environmental awareness. The introduction of STEK made installers aware of the possible consequences of the product they were working with. The third group of answers emphasizes the fact that this regulation has a legal base. Some actors see this fact as a big advantage. Without the legal base and enforcement of STEK it would not have resulted in such a success.

The most important reason that lead to the acceptance and appreciation of the STEK regulation is that it contributed to better working installations (included in the quality of improvement pie). This is an advantage for both the installer/engineer as the user of the installation. This improvement occurred because of the stricter rules for the construction and maintenance of an installation. Besides that companies were forced to have better skilled personnel. This suggests that the refrigeration sector was working suboptimally before the introduction of STEK. The actors hardly mention extra costs, but a better quality of the installation is reached. STEK proved to have a positive effect on both the installer as the user. The installer gained more stable returns as a maintenance contract gives more guaranteed returns than the ad hoc repair that was the standard. The user had on the first sight higher costs because of the compulsory maintenance, but it turned out that the quality and operational safety of the installation improved. This is a very valuable advantage of the regulation. Some actors mentioned the legal basis of STEK as a big advantage. They argue that STEK would not have been adopted if it was voluntary or a covenant. The low grades that almost all actors give for the first years of STEK, support this suggestion. 6.3.
Disadvantages of STEK
Respondents mention more advantages than disadvantages for STEK (see figure 6.3 and 6.2); some respondents mention no disadvantages at all. The most mentioned disadvantage was the extra administration. Another negative point concerning the administration is that most of the installing staff does not like to take care of the administration. They are “trained to install cooling installations, not to write about it”(personal communication with NVKL). Another problem that was mentioned several times was the (occasional) unequal enforcement of the STEK rules.

Two examples were mentioned. Imported products do not always comply with the Dutch rules and should not be allowed here. The control on these imported products is perceived to be too low. This can result in less leak tight installations and inequality on the market because the Dutch producers are obliged to comply with these rules. Another example is that enforcement in the border areas with Germany and Belgium is less strict and that there occur more irregularities. The foreign rules are different and in most cases less strict, so a company working in Germany has to comply with less strict rules. The VROM-inspectorate agrees that there was too little enforcement in the border regions recently. This is due to two reasons. Firstly the STEK regulation is not a main focus for this year. The VROM-inspectorate is not able to check all rules each year, every year they emphasize some points.

Because the STEK regulation is in general lived up to very well, strong enforcement will have less effect than enforcement in another sector. Secondly, due to the European rules not all Dutch rules will be relevant in the near future, these rules are not checked. It is very important for companies that everybody has to live up to the same rules. The motivation to comply with STEK decreases when the feeling rises that the enforcement is not equal. This can be a risk for the European regulation as each member state can decide on the exact rules that apply in their country. The enforcement of the regulation is also performed national, this could lead to demotivation if not all countries enforce the regulation on the same way. Because the administration of the use and production of HFCs is the only way to check the effect of the regulation a certain amount of registration is inevitable. Some actors do mention that the improved administration had advantages as well, however, the general opinion is that there are possibilities to keep the effect of the regulation intact, but decrease the administrative burden. The EU-legislation is thought to have succeeded in reducing this burden. 6.4.
Reasons for success
The three most frequently mentioned reasons for success by the actors are: 1. Legal implementation of STEK (5x) 2. Increased environmental awareness in the sector (4x) 3. Better working installations (3x) The most mentioned reason is that STEK is legally implemented. This obliged everyone to comply with the same rules. The second reason is the environmental awareness that was successfully raised and that that motivated the sector to comply with the rules. The third mentioned reason was that STEK resulted in better working installations. This is the first reason that was also included in the ten propositions that the respondents were asked to rate. These are listed in table 6.1. As shown here, STEK being created by the sector itself is the most important reason for success. After that three more reasons are rated high. The other five reasons are clearly less important, with the government not being directly involved as the least important reason. Table 6.1. The two most mentioned reasons for success in the open question were not part of the ten propositions in the closed question. The sector needed the force of the law to start with the new way of working. Most actors say that they do not want to go back to the situation before STEK. The second reason is more an intrinsic motivation. The obligatory STEK regulation raised the environmental awareness and gave employees an intrinsic motivation to comply with the rules. The proposition ‘STEK is created by the sector itself’ scores highest as shown in table 6.1, but was only once mentioned in the open questions. Since this is the first actor based research on STEK it was impossible to define in advance what factors were important for the success of STEK. It might have been a good idea to include the answers of the open question in the list of propositions, so that the list

would be more complete each time. A disadvantage of this method is that the results are very hard to compare because each actor would have had a different list. We are able to describe the relative importance of each proposition, but it is impossible to say how important each factor really was. A bigger sample size (more respondents) would probably have reduced this problem because it would have been easier to estimate the importance of the ‘new’ reasons (not included in the list of ten) in comparison with reasons that were included in the list of ten. 6.5.
Introductory problems of STEK
Two of the introductory problems mentioned were remarkable. The first is that Alfa Laval mentioned that STEK was very negative for their company because the introduction of STEK created a trade barrier for them. Their products had to comply with stricter rules and were therefore more expensive, while products from foreign countries were seldom checked. The other comes from VROMinspectorate, they mention that it was not a good thing to involve the sector very early in the process. This resulted in too detailed rules. This is remarkable because the rest of the respondents are very positive about the big influence of the sector on the development of the rules. The STEK-regulation is known for its resistance during introduction, but that there are only some problems mentioned. Even some actors that were not satisfied with the regulation at introduction were not able to mention problems during the introduction. This can either be explained because it was introduced very well, or because the introduction is fifteen years ago and people cannot always remember everything. 6.6.
Methods to reduce HFC emission
The opinion of each individual actor on the possibilities for HFC emissions can be found in Chapter 5. In figure 6.6. the average position of each measure is shown. Most measures end up around the score “3”. This means in most cases that some actors rated the measure very high and others very low. The control measure is feasible, but least effective. All actors have the opinion that the control measure is working very well at the moment and that it will not be easy to reach a higher reduction with this measure. This suggests that they may have rated control as a very effective measure if the question would have been: ‘in a new country, which of these measures is the most…’. Unfortunately this was not the question (only one user interpreted the question like this). The ‘effective’ option seems the only option were one can see a clear ‘ranking’. The ‘low refrigerant’ and ‘low demand for cold’ options are close. One user rated the option ‘low the demand for cold’ as the lowest on all aspects. The user mentioned that this was because the highest profit can be made on fresh products. So a decrease in the demand for cold would lead to less income for the supermarkets. The engineer/installer rated the control option lowest on all aspects. He mentioned that this option was already working optimal. But more control can also be a potential disadvantage for the installer/engineer. So this might be a reason for the low rating of the engineer/installer. The distributer of HFCs considered alternatives for HFCs as most effective en feasible, but the least desirable or cost-effective. The distributer argued however that alternatives would not lead to less profit for distributers. Which refrigerant is sold would not matter that much, as the margin on the products is similar. The respondents found it difficult to answer the question about costs. For most options the price is very uncertain. It is expected that alternatives will be expensive at introduction, but when more people use them they will become less expensive. Linde gas mentioned in the interview: ‘all new things are more expensive than the most common option’. Some actors have the expectation that technical improvements are possible and cost-effective, other actors expect that most technical improvements are already developed and used and that more emission reductions through technical improvements (on leak-tightness) will be expensive. What can be said about this ‘unclear’ result is that the expectations in the sector differ a lot. There is no agreement on the possibilities for improvement among the actors. This could delay the adoption of innovations, because each actor has different expectations of the effect of the innovation. There is no simple solution possible to reduce emissions even more. 6.7.
Expected effect of the European F-gas regulation
Almost all respondents mention that the enforcement and the place on the political agenda will determine the success of the regulation. The regulation will not have the desired effect if the member states will not strongly enforce the regulation. This will decrease the success in their own country, but will probably also decrease the success in other countries because companies will see the unequal enforcement as unfair. This is the most important factor for success. A possible obstacle in successfully implementing the regulation in the member states is the difference in structure of the cooling sector. Countries like, Greece, Spain, France and Italy have a different structure. In the Netherlands specialized refrigeration installers are operating. This is something that is unknown in some other countries. In those countries all installers are allowed to install and work with cooling appliances. Electricians and plumbers could also be the ones that install a cooling appliance. The last possible problem in the EU can be the different political structure, it is quite normal in the Netherlands to include the opinion and advice of actors in the design of the regulation. This is at the moment also done in the EU. It is expected to increase the acceptance of the regulation. This might not work in all countries because not all countries are used to this way of working.

7. CONC LUS ION The research question that we aimed to answer with this research is the following: How did the Dutch emission reduction system on F-gases become a success and what are potential lessons for other countries from the Dutch process? The Dutch emissions reduction system is mainly driven by the STEK regulation. As described in chapter three, this regulation has developed in a unique way. The sector has been involved very early in the process. They got a large amount of freedom to define the specifications of the regulation. The cooperation between the government and the sector was very good. The regulation was stricter than the European regulation demanded at that moment. This shows the ambition of the Dutch government at that time. Despite the intense cooperation between the government, the branche organisations and other experts (for example TNO), the regulation was not warmly welcomed by the individual installers. In chapter 6.1 and figure 6.1 it is shown that most actors were not very positive about STEK when it was introduced. Some actors did not expect that it would really improve anything and that it would mainly lead to more administration. This conclusion confirms earlier observations that the STEK regulation was not accepted from the beginning. Because of this resistance the strong enforcement of VROM and the VROM-inspectorate was very important to get the regulation adopted. Five of the eight (non policy) actors give the fact that STEK had a legal basis and that it was strongly enforced as the main reason for success. We did not expect the enforcement from the government to be so important. We expected that the involvement of the sector would have had a bigger influence on the motivation than the enforcement. This appeared not to be the case. At this moment there is a compliance of 80% (interview STEK) and less enforcement is needed. However, the NVKL is afraid that when there is no renewed attention on enforcement, the compliance rate will decrease. All actors agree that STEK has improved the refrigeration sector and that the current, more preventive type of practice is better than their ‘old’ more ad hoc way. The STEK regulation resulted in a protected market for the Dutch installers and engineers since it is (almost) impossible to work without a permit. The installers also experienced a more stable market, because they had to perform regular checks on installations. The advantages for the users were that it was easier for them to pick a good installer. An installer with a certificate had at least a basic amount of knowledge. Besides that the users discovered that their installations were working better due to the more regular checks. There were not much big problems mentioned during the introduction of STEK, but during several interviews occasions of unequal enforcement were mentioned and is was clear that this was seen as a strong demotivation for some actors. The most important drawback of the STEK regulation is the extra administrative burden. It is the general opinion that the administrative actions involved should be less. Some of the respondents are also involved in the EU-decision making process and mentioned that the needed administrative measures will be lower for most companies in the EU-regulation. However, some actors are worried that the EU-regulation will not be strict enough to really reduce emissions. They fear that the EU rules will also decrease the quality of installations in the Netherlands because not all regulations will stay valid. The actors agreed that the containment measure was successful and most actors argued that there would not be much improvement possible. The opinions about the other measures differed a lot. There was not one ‘second best’ option agreed on by the actors. This supports our hypothesis that there will be different opinions about the best policy option. 7.1.
Recommendations
Policy This research shows that enforcement of a new regulation is very important. There is no reason to assume that this will be different for the EU-regulation. The different member states should implement the EU-regulation in their own way. This could lead to compliance problems. This

research clearly shows that companies are very sensitive for differences in regulations or enforcement. When a regulation is enforced differently in different countries they might see that as unequal. Good communication between the member states will therefore be very important. Within each member states the enforcing and legislative bodies should pay attention to signals from the field. Especially in the beginning clear rules that apply for all EU countries are very important. The Dutch regulation has proved to provide improvements in the refrigeration sector where both the installer/engineer as the user benefit from. It might speed up the acceptation process when these benefits are clearly communicated in other member states. Although the enforcement turned out to be a crucial point of success the influence of the good cooperation between the sector and the government should not be underestimated. It surprised us that no actors complained about non-sensical, or unworkable up to rules. Although we did not literally ask this in our research, the cooperation between the government and the sector might be the reason for this. Future research This research shows the importance of strong enforcement to raise the compliance of emission reduction regulations. Besides that, some actors expressed their concerns on the effect of the regulation. Some actors expect that not all member states will have a high priority for this regulation. It would be interesting to investigate the intentions of different member states. The priority that is given to this regulation will be very important. It is expected that the countries were this regulation will be strongly enforced will reduce their emissions faster than countries that will not strongly enforce this regulation. It will also be interesting to investigate what the current opinion of installers in different member states is at this moment. Are installers in all countries as reluctant as the Dutch installers used to be? When installers already have a high environmental awareness and are positive about the regulation the need for enforcement might be lower. Another very important recommendation we want to give is about monitoring. There are only a few countries at the moment that have a good baseline measure of the current emissions. This will make it very hard to give a good estimation of the current emissions and also of the improvements. Even in the Netherlands the research that has been done on the current emissions is under much debate.

interview schema Introductie Goedendag. Mijn naam is Josje Fens ik ben student Energy & Environmental Sciences aan de Rijksuniversiteit Groningen. Ik heb u benaderd om mee te werken aan dit interview. Alvast hartelijk dank hiervoor. Ik zal nog even kort het doel van dit interview en de gang van zaken uitleggen. In Nederland is de STEK regelgeving nu zo’n 15 jaar van kracht. Binnen de EU is in 2006 een regelgeving ingevoerd die erg lijkt op de STEK regelgeving. De implementatie daarvan is echter nog bezig. Om een advies te kunnen geven over het succesvol invoeren van de nieuwe regelgeving kan de ervaring die er in Nederland met STEK is goed gebruikt worden. Om hier achter te komen richt ik mij op de verschillende actoren die bij koeling betrokken zijn. Ik wil dus graag van u weten hoe u de invoering en het gebruik van de STEK regelgeving heeft ervaren en welke zaken goed gingen of juist beter hadden gekund. De STEK-regelgeving heeft als doel de uitstoot HFK’s te beperken. Ik richt mij in dit onderzoek voornamelijk op de commerciële koeling, hieronder wordt de koeling in supermarkten en andere detailhandel verstaan, maar ook de koeling in koel- en vrieshuizen. Wereldwijd gezien is commerciële koeling namelijk een van de grootste bronnen van F-gas uitstoot. Vermindering van emissies in deze sector is dus erg interessant. Denkt u bij het beantwoorden van de vragen dan ook voornamelijk aan deze sector, werkzaamheden van uw bedrijf op een ander gebied kunnen in dit geval buiten beschouwing worden gelaten. In dit interview komen drie hoofdthema’s aan bod: Het actorsysteem Uw ervaring met de STEK regelgeving De mogelijkheden voor verbetering in het buitenland De meeste vragen zijn open vragen, ik wil u daarbij vragen kort en bondig op de vraag antwoord te geven en niet teveel uit te weiden, hoe interessant dit voor u en mij ook kan zijn. Ik heb opname apparatuur bij me en zal een korte samenvatting van de antwoorden opschrijven. Deze werk ik vervolgens uit en zal ik u toesturen zodat eventuele onjuistheden door u gemeld kunnen worden. Als u geen bezwaar heeft zal ik de naam van u en uw organisatie in mijn verslag melden. Is alles zo duidelijk? Dan wil ik nu graag met de eerste vraag beginnen: Voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? 2. Hoe lang werkt u al voor dit bedrijf? Ik wil beginnen met een aantal vragen over actoren. Met actoren bedoel ik bedrijven of instanties die betrokken zijn bij de koelingsketen. Ik kijk naar de volledige keten, dus vanaf de eerste productie van een koelvloeistof tot het afbreken of recyclen daarvan. Elke betrokkene heeft in dit systeem een andere functie. Sommige actoren werken erg specifiek, anderen werken juist op een veel breder scala. Ik heb een zogenaamde ‘cradle to grave’ lijn gemaakt en daar de betrokken actoren op ingevuld aan de hand van de plek die ze hebben in de keten. 3. Klopt deze lijn naar uw mening, zo nee, waarom niet? 4. Zou u uw bedrijf op de ‘actorlijn’ kunnen aangeven?

5. Welke actor heeft het meeste invloed op het systeem? Deze vraag is tweeledig: welke actor is het meest in de mogelijkheid om het beleid te veranderen? Welke actor heeft het meeste invloed op uw manier van werken? Geef aan op de balk Voor deelvraag 2 Ik wil nu wat dieper in gaan op de STEK regeling en de invoering daarvan. Deze stellingen geven niet mijn mening weer over de STEK-regeling, maar zijn bedoeld om een beter beeld te krijgen van de veranderingen die het systeem voor uw bedrijf heeft gehad. Wilt u per stelling aangeven in hoeverre u het hiermee eens bent: 0 = Helemaal oneens 5 = Helemaal mee eens ? = geen mening/nvt (antwoordblad) 11. Zonder STEK gebeurde onderhoud veel minder 12. Wat zijn volgens u de belangrijkste redenen voor dit succes? Dan heb ik nu nog een lijst met stellingen over het succes van STEK. Ik wil u nu vragen om deze stellingen op volgorde van belangrijk naar onbelangrijk te leggen. (geef papier). 33. STEK is een succes geworden doordat: - De brancheorganisatie de regelgeving steunt - STEK vanuit de branche zelf is opgezet - Controles met vaststaande regelmaat plaatsvinden - Controles van tevoren worden aangekondigd - Kosten relatief laag zijn - De regels duidelijk zijn - Er anders strengere regels waren opgelegd door de overheid - De overheid niet direct betrokken is bij de controles - Het bedrijfsrisico van verliezen van de vergunning groot is - STEK een positief effect heeft op de werking van de installaties 34. Men is echter druk bezig met het ontwikkelen van alternatieven voor het gebruik van HFK’s en er zijn ook al een aantal alternatieven voor handen. Ik wil nu graag uw mening weten over de bruikbaarheid van deze alternatieven. 38. Welke alternatieven voor HFK’s kent u? 39. Welke van deze alternatieven beschouwd u als volwassen 40. Met de keuze voor het STEK systeem is er gekozen voor de optie: voorkomen van lekkages d.m.v. controle. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s - Streven naar zo laag mogelijke lading van het systeem - Streven naar zo laag mogelijke koelvraag - Verhogen van de lekdichtheid van het systeem d.m.v. technische maatregelen - Voorkomen van lekkage door controle Al deze methodes hebben zo hun voor en nadelen. Dat houdt in de marketing, productinfo, contact met de brancheorganisaties. Koudemiddelen is een redelijk klein onderdeel van ons bedrijf. Van het vullen tot het recyclen, alles kan. 2. Hoe lang werkt u al voor dit bedrijf? Ik werk nu 5,5 jaar bij Linde en sinds 2 jaar in de koudemiddelen sector 3. klopt deze lijn naar uw mening, zo nee, waarom niet? Voor ons zit de lijn iets anders in elkaar, als HFK-producent (oa. Dupont) naar de distributeur, vervolgens vaak naar de installateur, heel soms direct naar de gebruiker. Wat vind u van de STEK-regeling? Stek raakt ons als bedrijf niet, we verplaatsen alleen koudemiddelen, we hebben daar geen erkenning voor nodig. Het voordeel van STEK verschaft ons wel informatie over volumes en gebruik van koudemiddelen. Het geeft veel inzicht in de markt. Stek communiceert duidelijk met zijn leden en naar buiten toe Vroeger hielden we de STEK-nummers van klanten bij, maar dat kostte een boel administratie en het was niet verplicht. Wel kijken we naar wie om de koudemiddelen vraagt. We leveren eigenlijk alleen aan installateurs, de installateurs verkopen de HFK’s duurder dan Linde doet, omdat er in de prijs van het koudemiddel ook andere kosten verwerkt zitten. Waarschijnlijk moet dat in de nieuwe regelgeving wel weer. Dat zou wel lastig voor ons kunnen worden. Kunt u een rapportcijfer geven (schaal 1-10)? 7 7. Het is de laatste tijd ook heel lastig om personeel te vinden, de werving van installateurs is erg lastig. Voor de gebruiker heeft het ook invloed gehad, maar wel veel minder? 35. Zijn er tijdens de invoering van STEK dingen misgegaan, m.a.w. had de invoering beter of effectiever gekund, zo ja welke?

nvt 36. Verwacht u dat HFK’s uitgefaseerd zullen gaan worden in de koelsector? Zo ja, op welke termijn? Ja, dat is logisch, dat gaat op termijn gebeuren. Voor automotive gaat het er al uit, automotive loopt meestal ook voor op de stationaire koeling. Ook de stationaire koeling zal uiteindelijk de automotive achterna gaan. De snelheid waarmee dit gebeurt hangt wel erg af van de welvaart. Op het moment dat het slechter gaat met de economie verlaagt ook de belangstelling voor dit onderwerp 37. Is het al dan niet gebruiken van HFK’s een onderwerp van discussie binnen uw bedrijf(stak)? Ja, we blijven koelvloeistoffen leveren, maar we willen natuurlijk wel weten waar de markt naartoe gaat. De marge op beide producten is ongeveer gelijk. Voor deelvraag 3 38. Welke alternatieven voor HFK’s kent u? CO2/CH4, Propaan/Butaan, Polypropyleen, Helium, Koeling met geluid en magneten 39. Ik denk dat er voornamelijk variaties op bekende technieken bekend worden. Er zijn bijvoorbeeld verschillen mogelijk in de zuiverheden van stoffen en daarmee ook hun functionaliteiten. 42. Waren de mogelijkheden voor alternatieven 15 jaar geleden anders dan nu ? Er zijn steeds meer verschillende manieren voor koeling. Vroeger had je alleen R22, wat een superproduct is. Nu heb je minimaal drie varianten om dezelfde koelvraag te kunnen bedienen. Het wordt hierdoor voor de branche steeds complexer. 43. Welke zaken wegen het zwaarst bij uw keuze voor een bepaalde techniek? nvt 44. Welke bronnen van informatie gebruikt u om tot uw keuze te komen? nvt 45. Ziet u uw bedrijf(stak) als milieubewust, waar uit zich dat in? Over het algemeen is ons bedrijf wel milieubewust. We hebben ook discussies over welke gassen we wel en welke niet kunnen gebruiken. Zo leveren we bijvoorbeeld geen gassen aan dierenwelzijn misdadigers. Daarnaast is er strenge regelgeving en houden we ons daaraan. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s - Streven naar zo laag mogelijke lading van het systeem - Streven naar zo laag mogelijke koelvraag - Verhogen van de lekdichtheid van het systeem d.m.v. technische maatregelen - Voorkomen van lekkage door controle Al deze methodes hebben zo hun voor en nadelen. Ik verwacht dat er een lagere uitstoot gerapporteerd zal worden, de vraag is hoe betrouwbaar het is. Voor de nieuwe EU landen zullen grote stappen gemaakt moeten worden. Probleem om te controleren of de regelgeving effectief is, is dat er nauwelijks nulmetingen zijn. Er zijn maar weinig landen waar goede nulmetingen bestaan.

Ik ben hoofd R&D, in deze functie houd ik mij bezig met de functionele specificaties van een apparaat. De verdeling standaard apparaten en custom made is ongeveer 50-50. 2. Hoe lang werkt u al voor dit bedrijf? Ik werk sinds 1999 voor Helpman en nu heet dat dus Alva Laval Tegenwoordig zijn wij niet meer technisch STEK-plichtig, dat wil zeggen, we worden nog wel qua logboeken gecontroleerd, maar de technische eisen zoals die in de RLK stonden zijn vervallen en vervangen door de PED en ISO auditeurs. Wij voldoen aan ISO 9001 en ISO 14001. 3. klopt deze lijn naar uw mening, zo nee, waarom niet? Eigenlijk zou er nog de producent van componenten bij moeten. Het kopje ontwerper wordt vaak ingevuld door de installateur of een adviesbureau. 4. Het STEK systeem wordt nu zo’n jaar of 15 gebruikt in Nederland. 6. Wat vind u van de STEK-regeling? Nu hebben we weinig last meer van de STEK-regelgeving omdat de technische eisen vervallen zijn. Dat was eerst wel anders. Sinds de technische regels zijn afgeschaft is er minder controle en minder duidelijkheid aan welke regels men moet voldoen, vooral in de grensregio’s is de onduidelijkheid groot. Toen de regeling geïntroduceerd werd werkte ik nog niet bij Helpman, maar voor ons was de STEK regelgeving in het begin wel nadelig. Er werden allerlei vrij zware technische eisen opgelegd die ons een concurrentienadeel gaven. Producten die uit het buitenland kwamen werden zelden goed gecontroleerd of deze ook aan de strenge eisen voldeden. Dit zorgde voor een concurrentienadeel omdat onze producten duurder waren door de strengere eisen. Voor de branche heeft het wel een voordeel gehad, het heeft voor kwaliteitsverhoging gezorgd, ook het imago van de branche ging vooruit. Kunt u een rapportcijfer geven (schaal 1-10) 4 voor ons persoonlijk 8. Waarom en wanneer is uw mening in de loop van de tijd veranderd? Een nieuwe regel zorgt altijd voor weerstand, maar uiteindelijk bleek het toch voor de branche een voordeel te zijn. Voor ons is STEK veel minder nadelig geworden toen de RLK vervallen is en de PED van kracht werd. Sindsdien hebben wij niet veel meer met STEK te maken. We zijn wel argwanend geworden om regels van de overheid in te voeren wanneer het gaat om commerciële eisen. 9. Wat zijn de drie belangrijkste voordelen van de STEK regeling? Eerst wat meer over de NVKL Belangenvereniging 650 bedrijven werkzaam in air-co, koelvries A leden 110 producenten/distributeurs B leden 500 installateurs + aanpalende branches, adviesbureas, opleidingsinstituten 85-90% van de markt Wet en regelgeving wat ik doe, meestal collectief belang, soms ook individueel belang. Nu 55-60 jaar bestaand. Ik ben directeur techniek, veiligheid en milieu. Ik hou mij voornamelijk bezig met de regelgeving omtrent koeling. Lobbywerk voornamelijk gericht op Den Haag, maar ook op het gebied van Europa. Daarnaast ben ik secretaris generaal van AREA, een Europese organisatie (wellicht tot 2008) 2. Hoe lang werkt u al voor dit bedrijf? Ik werk sinds 1996 voor de NVKL, daarvoor heb ik wel in de koelbranche gewerkt bij 9 jaar grasso products, maken industriele comressoren en Hoekloos/Linde schiedam, manager koudemiddelen. 3. klopt deze lijn naar uw mening, zo nee, waarom niet? 4. De NVKL is de belangenorganisatie voor alle facetten van deze lijn, behalve de gebruiker. Als veranderingen op de lijn is in NL geen sprake van een HFK-producent, maar wel van een distributeur. Daarnaast is de ontwerper actief bij de producent en bij de installateur. Ook de term producent is niet ideaal in Nederland zijn er maar twee bedrijven die onderdelen van koelinstallaties maken, voor de andere bedrijven is hier ook sprake van een distributeur. 5. Welke actor heeft het meeste invloed op het systeem? De producent en intallateur hebben het het meest voor het zeggen of er wel of niet iets veranderd in het systeem. De producent dreigt echter wel steeds meer macht te krijgen doordat installateurs het te druk hebben om altijd zelf de hele installatie te ontwerpen. Deze taak wordt meer en meer overgenomen door de producent. Dit heeft als gevaar dat niet altijd de voor de klant beste installatie wordt geplaatst. De producent ontwerpt een installatie met de onderdelen die hij (het liefst) verkoopt. Voor deelvraag 2 Ik wil nu wat dieper in gaan op de STEK regeling en de invoering daarvan. Het STEK systeem wordt nu zo’n jaar of 15 gebruikt in Nederland. 6. Wat vind u van de STEK-regeling? De STEK regeling is nu een hele goede regeling, installateurs willen niet meer zonder STEK. Omdat de lekpercentages nu zo laag zijn in een groot deel van de koelbranche zijn de controles door het VROM minder streng geworden, er valt niet meer zo veel te bereiken, samen met de onzekerheid over de toekomst van STEK zorgt dit ervoor dat er weer meer rommelaars op de markt komen en dat bedrijven de grenzen gaan opzoeken. Dit zou het succes van STEK weer kunnen verminderen. De middelen die er zijn worden ingezet op de gebieden waar het er het slechtst aan toe is, de scheepvaart waar lekpercentages 300 tot 600 % veel voorkomt 80-100% is gemiddeld!

Kunt u een rapportcijfer geven (schaal 1-10)? 7,5 7. Wat vond u van de regeling toen het 15 jaar geleden werd geintroduceerd? Niemand stond er op te wachten, het waren maar pottenkijkers die helemaal niks van koeltechniek afwisten die nu ineens moesten gaan bepalen hoe de installateurs hun werk moesten doen. Er was eigenlijk nooit controle van buitenaf geweest. Een lekpercentage van 30-40% was heel normaal Kunt u een rapportcijfer geven (schaal 1-10) 3 8. Waarom en wanneer is uw mening in de loop van de tijd veranderd? De STEK controles bleken een toegevoegde waarde te hebben, de installaties zijn er beter en lekdichter door geworden. Lekpercentages zijn nu onder de 3%. Ook de eigenaren zijn tevredener geworden over de controles, ze hebben nu ook door dat regelmatige controle zorgt voor een zelden uitvallend systeem en dat de installatie iedere keer weer goed wordt afgesteld. Bovendien gaf STEK de branche bescherming, rommelaars hadden geen kans en ook concurrentie uit het buitenland was makkelijker buiten de deur te houden. 2 jaar geleden zou STEK afgeschaft worden door de minister omdat het geen meerwaarde meer had. Dit is toen door het NVKL voorkomen, zodat deze nog kon blijven bestaan totdat duidelijk zou zijn wat de Europese regelgeving zou brengen. 6 jaar geleden ben ik samen met het STEK en VROM in Europa geweest om te vertellen over de Nederlandse regelgeving. De EU regels lijken erg op de Nederlandse lekdichtheidsvoorschrijften. Ik wil graag nog wat dieper op de STEK regeling in gaan 9. Wat zijn de drie belangrijkste voordelen van de STEK regeling? - De kwaliteit van de installaties en het management is hoger, er is meer controle op de uiteindelijke prestatie van een bepaald product. - De milieubewustheid van de branche is sterk omhoog gegaan, terwijl dit in europa (nog) niet het geval is. - Door de regelmatige controles blijven installaties betrouwbaarder, ze worden regelmatig weer ideaal afgesteld en kleine mankementen worden eerder ontdekt. Ook de gebruiker is tevreden 10. Wat zijn de drie belangrijkste nadelen van de STEK regeling? - het belangrijkste nadeel is de bureaucratie, bedrijven moeten veel meer bijhouden, terwijl ze liever gewoon aan het werk zouden gaan in plaats van het opschrijven van alles wat ze doen. Bij grote bedrijven heeft dit een volle FTE extra werk opgeleverd. Wat deze bureaucratie precies is, is moeilijk te zeggen, meestal blijven de klachten vrij vaag. Ja, de invoering is te snel geweest, hierdoor is er in de eerste jaren een boel door vallen en opstaan geleerd. Dit was niet nodig geweest als de NVKL meer tijd had gekregen goede formulieren ed. te ontwikkelen voor de administratie van STEK 36. Verwacht u dat HFK’s uitgefaseerd zullen gaan worden in de koelsector? Zo ja, op welke termijn? Ik hoop van niet, op dit moment is HFK soms gewoon de beste oplossing, als je het systeem integraal bekijkt. Er zijn landen (en milieugroeperingen) in Europa die de F-gassen helemaal willen verbieden, met de F-gassen verordening is dit voorlopig nog niet het geval. We hebben in NL aangetoond dat HFK;s in het systeem kunnen blijven. Maar ik maak me zorgen of dit op EU niveau ook gaat lukken. In 2011 moet het geëvalueerd worden en als de resultaten dan niet zo goed zijn als verwacht wordt wellicht de discussie over het verbieden van stoffen weer geopend. 37. Is het al dan niet gebruiken van HFK’s een onderwerp van discussie binnen uw bedrijf(stak)?

2 jaar geleden is de NVKL met een position paper gekomen over natuurlijke koudemiddelen. Deze zijn zeker een optie, maar je moet altijd naar de prestatie van het hele systeem kijken, dus niet alleen het koudemiddel, maar ook de prijs en het energieverbruik. Bij installateurs leeft het nog iets minder, het is ook een probleem van kennen/kunnen. Voordat je met natuurlijke koudemiddelen gaat werken zal je eerst weten hoe je er mee om moet gaan. De weg van trial and error is in dit geval eigenlijk altijd de verkeerde. Voor deelvraag 3 38. Welke alternatieven voor HFK’s kent u? Ammoniak, , CO2, Hybride, CO/ammoniak, Koolwaterstoffen, Geluidskoeling, Mechanische koeling, Bestralen met x-ray 39. Welke van deze alternatieven beschouwd u als volwassen Ammoniak wordt al veel gebruikt CO2 is vooral effectief bij diepvriezen, als het echt koud moet CO2/ammoniak is een goed alternatief als het minder koud moet Koolwaterstoffen, vooral nuttig in kleinere (stekkerklare) installaties. Het is namelijk brandbaar en explosief 40. Verwacht u dat er binnen nu en vijf jaar meer alternativen bruikbaar worden? 41. Welke? Vanuit de gebruiker is de vraag er nog niet zo sterk om naar nieuwe technieken te vragen, dus de installateur wordt niet zo geprikkeld om ook echt wat met de aangeboden kennis te gaan doen. De eindgebruiker krijgt moeilijk de informatie, daar gaat de NVKL nu aan werken, om ook de eindgebruiker geïnteresseerd te krijgen in de nieuwe technieken. 45. Ziet u uw bedrijf(stak) als milieubewust, waar uit zich dat in? Ja, nu zeker, 15jaar geleden nog niet, maar nu wel. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s - Streven naar zo laag mogelijke lading van het systeem - Streven naar zo laag mogelijke koelvraag - Verhogen van de lekdichtheid van het systeem d.m.v. technische maatregelen - Voorkomen van lekkage door controle Kunt u deze vijf methoden ordenen van meest naar minst 46. Denkt u dat er beperkingen zijn om de regel in te voeren in andere landen? 51. In welke landen wel/ niet en waarom? In Engeland, Spanje, Griekenland en Italie is de koelsector anders opgebouwd, daar hebben ze geen koeltechnisch installateurs, maar doen ook electriciens en loodgieters de koeltechnische installaties. Daardoor denken ze dat de F-gas eisen (die lager zullen worden dan de STEK-eisen) te moeilijk zijn voor. Maar deze competenties zijn natuurlijk wel minimaal om verantwoord met koudemiddelen te kunnen werken. 52. Zal de EU regelgeving, naar uw verwachting, effectief zijn? Waarom (niet)? Ik weet het niet. Het is een afgezwakt geheel van STEK, dat is jammer. Ik denk wel dat het kans van slagen heeft, maar dan moet iedereen wel meedoen, daar ben ik wel bang voor dat niet alle landen meedoen en dan zullen de resultaten ook niet goed zijn.

Adviesbureau verhoef werkt voornamelijk innovatief. Een adviesbureau wordt meestal alleen ingeschakeld als het bedrijf iets anders wil dan het gangbare. Veel supermarkten hebben dan ook geen adviesbureau in dienst omdat ze gewoon kopieren wat er al jaren gebeurt. Als adviesbureau heb je weinig te maken met STEK. We proberen wel de installatie zo te ontwerpen dat mensen zo min mogelijk ‘last’ hebben van STEK. Dus dat het een deugdelijke lekdichte installatie is. Ook houden ze zich bezig met energie monitoring bij supermarkten. Bij het management is wel een intentie om energie te besparen, maar bij de uitvoerende store managers is dat besef er veel minder. Er bestaat nu dus een tool waar energiegebruik per supermarkt gemeten kan worden, zo kunnen uitschieters (veroorzaakt door storingen, of slecht gesloten deuren bv.) snel ontdekt worden. 2. Hoe lang werkt u al voor dit bedrijf? Ik ben met adviesbureau verhoef gestart in 1979, daarvoor bij TNO gewerkt (PeterVerhoef). Hij had een gat in de markt ontdekt, bij groente en fruit veilingen. Het kan niet meer zo zijn. Op papier zullen de lekkages wel veel afnemen, maar in de praktijk verwacht ik er niet zo veel van.

B6 Interview with CBL Bedrijf: CBL Volgnummer: 02 interview schema voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? Het CBL is de belangenorganisatie van alle supermarkten in Nederland. Er werken 5 a 6 mensen die zich allen bezig houden met een ander onderdeel. Mijn taak is eigenlijk een allegaartje van alles wat niet onder de verantwoordelijkheid van de anderen valt. Onder andere Energie de MJA energiebesparing en dus ook STEK 2. Hoe lang werkt u al voor dit bedrijf? 11 jaar 3. klopt deze lijn naar uw mening, zo nee, waarom niet? Het enige wat niet vermeld is, is de eindgebruiker, de consument, maar die hoeft ook niet perse op de lijn, omdat het gebruikte koelmiddel eigenlijk niet leeft onder consumenten. 4. De STEK regeling werkt goed, de regels zijn duidelijk en het maakt de keuze voor een bepaalde koelmonteur makkelijker, je gaat alleen in zee met en monteur met diploma. Dit heeft de kwaliteit van het onderhoudt vergroot. Kunt u een rapportcijfer geven (schaal 1-10)? 9 7. Wat vond u van de regeling toen het 15 jaar geleden werd geïntroduceerd? De belangrijkste reden voor succes was denk ik wel dat het door de branche zelf is opgezet en dat de regels niet volledig zijn opgelegd. B7 Interview with NEKOVRI Bedrijf: Nekovri / van Soest bv Volgnummer: 06 interview schema voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? Ik was directeur eigenaar, samen met mijn broer tot 1990. Toen hebben we het bedrijf verkocht en ben ik nog 10 jaar in dienst gebleven als Algemeen Directeur Ook bij Nekovri ben ik zeer recent gestopt, maar ik zit nog wel in verschillende adviesorganen voor Nekovri 2. Hoe lang werkt u al voor dit bedrijf? Ik heb 40 jaar voor dit bedrijf gewerkt 3. klopt deze lijn naar uw mening, zo nee, waarom niet? Behalve dat de overheid niet in dit plaatje voorkomt, klopt het. Een goed voorbeeld is de regelgeving omtrent ammoniak. Dit was erg moeilijk om een vergunning te krijgen. Hierdoor zijn heel veel koelhuizen overgegaan op HCFK’s ipv. Ammoniak. 4. Zou u uw bedrijf op de ‘actorlijn’ kunnen aangeven? Ik zit aan de gebruikerskant 5. Welke actor heeft het meeste invloed op het systeem? De ontwerper heeft de meeste invloed op het systeem, hij bepaald de kwaliteit van de installatie. Keuzes die hier gemaakt worden zijn van invloed op de uiteindelijke prestaties van het systeem. De overheid zou hier in kunnen sturen om te zorgen voor wet/regelgeving. Voor deelvraag 2 Ik wil nu wat dieper in gaan op de STEK regeling en de invoering daarvan. Het STEK systeem wordt nu zo’n jaar of 15 gebruikt in Nederland. 6. Wat vind u van de STEK-regeling? Ik ben nu heel tevreden over STEK, de installaties worden beter, de installateurs werken beter. Door de controle is het voor iedereen van belang dat de installatie goed werkt. Wat mij betreft zou STEK wel uitgebreid kunnen worden, de natuurlijke koudemiddelen vallen nu buiten STEK, dat is jammer, want ook deze installaties moeten gewoon goed zijn. We hebben ook altijd gepleit om STEK niet af te schaffen. Kunt u een rapportcijfer geven (schaal 1-10)? 8 7. Wat vond u van de regeling toen het 15 jaar geleden werd geïntroduceerd? In het begin dacht ik dat het alleen een papieren tijger was en dat het dus alleen extra werk was en geld zou kosten. In het begin wisten de inspecteurs niet zoveel van de installaties af. Ik verwacht dat dit besluit binnen 10 jaar genomen is. Al is het afhankelijk van het politiekklimaat. De ROB-commissie is er ook niet voor niks. Wat jammer is, is dat de Energie investeringsaftrek verminderd is, hierdoor is het bijna onbetaalbaar om een installatie die nog niet aan vervanging toe is om te bouwen tot een Ammoniak/co2 installatie. De HCFK’s hebben eigenlijk betere prestaties dan HFK’s, maar HFK’s zijn het enige koelmiddel dat nog gebruikt mag worden binnenkort. Ik hoop dat de koelhuizen geholpen worden om de goede keuze te maken. Een koelhuis staat 30-40 jaar 37. Is het al dan niet gebruiken van HFK’s een onderwerp van discussie binnen uw bedrijf(stak)? Dat is al heel lang het geval ammoniak bestaat natuurlijk al heel lang.. Daarnaast doet Nekovri ook haar best om haar leden goed voor te lichten over de prestaties van verschillende installaties. Hiervoor zijn allerlei publicaties geweest zoals de (aanvulling)bouwwijzer. Voor deelvraag 3 38. Welke alternatieven voor HFK’s kent u? NH3/Co2 Propaan is te gevaarlijk op de schaal waarmee wij werken 39. Welke van deze alternatieven beschouwd u als volwassen NH3 is de oudste, door de regels van de overheid viel de keuze op HCFK’s Co2 Bij STEK zijn ong 1500 installateurs aangemeld, daarvan zijn er 400 die grote installaties kunnen bouwen, maar er zijn er maar 10 die met ammoniak/Co2 kunnen werken. Al zouden we met z’n allen over willen op ammoniak, de monteurs zijn er niet voor 40. Verwacht u dat er binnen nu en vijf jaar meer alternatieven bruikbaar worden? 41. Welke? De komende vijf jaar verwacht ik geen nieuwe koudemiddelen Ik verwacht wel dat de toepassing natuurlijke koudemiddelen groter wordt. Daarnaast doet Nekovri mee aan het Miniref project. Het doel van dit project is om een compleet nieuwe installatie te bouwen met 95% minder koudemiddelen. Dit zou wel een grote verbetering kunnen opleveren. Ook voor het gebruik van natuurlijke koudemiddelen zou dit een voordeel zijn doordat er veel minder natuurlijk koudemiddel nodig is. 42. Waren de mogelijkheden voor alternatieven 15 jaar geleden anders dan nu ? CO2 bestond toen eigenlijk nog niet, NH3/Co2 combi was nog niet mogelijk 43. Welke zaken wegen het zwaarst bij uw keuze voor een bepaalde techniek? Eigenlijk schakel ik altijd een adviseur in om tot mijn keuze te komen. Helaas doet niet iedereen dat en geeft de prijs soms toch de doorslag. 45. Ziet u uw bedrijf(stak) als milieubewust, waar uit zich dat in? Ja zeker, er zijn denk ik weinig branches die zoveel gedaan hebben, als deze. Energie is een grote kostenpost. We hebben veel aan voorlichting gedaan en doen dus mee met miniref. Daarmee hebben we de afgelopen jaren 20% energie kunnen besparen. Er zijn verschillende manieren om de uitstoot van HFK’s te beperken. Met de keuze voor het STEK systeem is er gekozen voor de optie: voorkomen van lekkages d.m.v. controle. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s

B8 Interview with Unilever Bedrijf: Unilever Volgnummer: 03 interview schema voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? Lead engeneer refrigeration wereldwijd verantwoordelijk voor de koeltechniek binnen unilever. Veilig betrouwbaar, kosteneffectief en milieubesparend koeling bedrijven. Niet specifiek voor Nederland.De transportkoeling is voor 100% uitbesteed in Europa, Europa is 1/3 van de totale verkoopmarkt van Unilever. Met merken is het zo dat ze ook verantwoordelijk worden gehouden voor misstanden van derden die de producten verhandelen. Hierdoor probeert Unilever voornamelijk te werken met betrouwbare derden. Bij bedrijven die geen merkproducten maken ligt deze verantwoordelijkheid anders. Verkoop aan de consument gebeurt ook door derden (retail). Cosumptie ijs direct aan de consument (impuls verkoop via kiosken etc) is een uitzondering, de verkoopmeubelen van dit ijs (2.2 miljoen wereldwijd) blijven eigendom van Unilever en daar kunnen ze dus ook bepalen welke koelvloeistoffen er gebruikt worden. 2. Hoe lang werkt u al voor dit bedrijf? 8 jaar. Daarvoor heb ik bij TNO gewerkt en daarvoor bij een aantal koelbedrijven. 3. klopt deze lijn naar uw mening, zo nee, waarom niet? Opzet is werkbaar. Er is nu alleen een mix van activiteiten en bedrijfskolommen. Ik geef de voorkeur aan activiteiten. Misschien is het ook inzichtelijker als je het als twee stromen behandelt 1. 5. Welke actor heeft het meeste invloed op het systeem? Geldstromen gaan van de gebruiker naar de rest van het systeem. Vaak is het wie betaalt, bepaalt. Degene die betaalt heeft alleen niet altijd de kennis en prioriteit om echt te bepalen. Zolang de gebruiker niet iets anders wil, zullen eventuele andere dingen ook niet zo snel de markt gaan overnemen. Market pull Traditionele sector Supplier push Innovatieve sector In de koeltecniek was dit voor 1990 heel duidelijk traditioneel, het was een ambacht. Door de regelgeving is er meer noodzaak geweest voor veranderingen, waardoor innovatie meer gebeurt binnen de sector. Maar een innovatieve sector is het nog lang niet. Goedkoop is belangrijker, dan innovatie Heeft unilever ook invloed op de supermarkt? Invloed op de supermarkt is heel lastig. Supermarkten hebben ook huismerken, die willen ze ook graag verkopen, maar A-merken leveren vaak meer winst op Wallmart Carrefour en Lidl beginnen nu aan te geven dat ze ook meer aandacht voor het milieu willen geven. Ahold loopt wat dat betreft niet voorop. Ahold heeft nu ongeveer alles mbt koeling outsourced. Ze nemen het initiatief om dit samen met toeleveranciers te doen.Unilever vult in veel gevallen 1/3 van de supermarkt. Er gaan binnenkort de eerste gesprekken plaatsvinden. Ruwweg 50% van energiegebruik wordt veroorzaakt door koeling. Voor deelvraag 2 Ik wil nu wat dieper in gaan op de STEK regeling en de invoering daarvan. Het STEK systeem wordt nu zo’n jaar of 15 gebruikt in Nederland. 6. Wat vind u van de STEK-regeling?

In 1989 werd er actie ondernomen voor het ozonprobleem. De overheid was erg ambitieus en wilde voorlopen op Europa.Toen is er een driedelig plan opgezet. 1. Technische eisen oa. Het niet mogen gebruiken van flair verbindingen 2. organisatorisch/procedures (gedeeltelijk-STEK) 3. Vakbekwaamheid (STEK) Dit alles is vastgelegd in de RLK. Later kwam er de PED, die liet niet toe dat er strengere eisen worden gesteld aan technische eisen dan de Europese. Maar veilige druk is iets anders dan lekdichtheid. Dit heeft dus ervoor gezorgd dat de techinische eisen achteruit zijn gegaan (bijv. wel weer flare verbindingen toegestaan). STEK controleert alleen om erkenning te controleren. Niet om te kijken hoe het er met de emissiecijfers voor staat. De echte controle moet door VROM-inspectie gebeuren. Kunt u een rapportcijfer geven (schaal 1-10)? 7,5 voor compleet pakket 9 voor vakbekwaamheid 7. Wat vond u van de regeling toen het 15 jaar geleden werd geintroduceerd? In het begin werd het heel streng nageleefd en was er duidelijke enforcement vanuit het VROM. Tegenwoordig doet VROM eigenlijk niets meer aan controle. Ik heb nu geen idee naar de feitelijke resultaten qua emissies. Sinds 2001 zijn er geen goede cijfers meer geweest over emissiecijfers. Ik weet dus niet wat het effect is geweest van de verlaging van de technische eisen. De landen rondom ons komen allemaal rond de 10-20% ondanks dat ze dezelfde technieken en apparaten gebruiken. In duitsland hebben ze ook een certificeringssysteem voor personeel (Meisterbetrieb), maar ook 10% lekkage (schatting). Ze hebben daar geen verplicht preventieve controles, al ligt de duitse cultuur wel zo dat preventief onderhoud meer wordt uitgevoerd. Kunt u een rapportcijfer geven (schaal 1-10) 9 8. Waarom en wanneer is uw mening in de loop van de tijd veranderd? Zie boven Ik wil graag nog wat dieper op de STEK regeling in gaan 9. Wat zijn de drie belangrijkste voordelen van de STEK regeling? - Heldere uniforme regelgeving die geen vrijblijvendheid toeliet (level playing field) - Wettelijk verplicht kader en strenge enforcement - Sector eigen regeling. De sector mocht de inhoudelijke eisen stellen en de uitvoering zelf organiseren. - Van correctief onderhoud naar preventief onderhoud 10. Wat zijn de drie belangrijkste nadelen van de STEK regeling? In het begin was het beeld dat het er alleen maar veel duurder door zou worden. In de praktijk bleek het betrouwbaarder en dus goedkoper. Over het algemeen heeft men de mening dat STEK de emissies van HFK’s heeft verminderd en dat het systeem een succes is. 32. Wat zijn volgens u de belangrijkste redenen voor dit succes? De combinatie van de ozongassen en de opvolgers zijn uitiendelijk samen in de RLK terechtgekomen. Dat was heel lastig omdat de HFK’s geen ozoneffect hadden en dus eigenlijk niet thuishoorden in een regeling voor ozongassen. Gelukkig is dit uiteindelijk toch gelukt. Anders was STEK heel snel ter ziele gegaan omdat de focus van CFK’s snel verschoof naar HFK’s. Belangrijkst was dat de verantwoordelijkheid voor de inhoud bij de sector lag, maar dat de uiteindelijke controle en enforcement wel bij VROM lag en dat ze dat in de beginjaren ook streng gedaan hebben. Ik wil u nu vragen om deze stellingen op volgorde van belangrijk naar onbelangrijk te leggen. 33. STEK is een succes geworden doordat: 3 - De brancheorganisatie de regelgeving steunt 2 - STEK vanuit de branche zelf is opgezet 7 - Controles met vaststaande regelmaat plaatsvinden 8 - Controles vantevoren worden aangekondigd 4 - Kosten relatief laag zijn 1 - De regels duidelijk zijn 5 - Er anders strengere regels waren opgelegd door de overheid 10- De overheid niet direct betrokken is bij de controles 9 - Het bedrijfsrisico van verliezen van de vergunning groot is 6 - STEK een positief effect heeft op de werking van de installaties 34. Voor welke actor is de invoering van het STEK-systeem het ingrijpendst geweest? De installateur. Voornamelijk de echte kleine installatiebedrijven (1-4 medewerkers). 35. Zijn er tijdens de invoering van STEK dingen misgegaan, m.a.w. had de invoering beter of effectiever gekunt, zo ja welke? Waar wellicht meer aandacht voor had kunnen zijn, is de kleine installatiebedrijven. Ik weet eigenlijk niet of dit echt tot veel schrijnende gevallen heeft geleid, maar er had wel meer aandacht voor kunnen zijn. Opzet is niks misgegaan, maar wat erg misgegaan is, is dat het uiteindelijk bij VROM van de agenda ging. Hierdoor zijn de ambtenaren die in eerste instantie erbij betrokken waren weggegaan en is het dossier minder duidelijk voortgezet. Uiteindelijk was niet meer duidelijk wie er verantwoordelijk was voor de regeling en handhaving. industrie?, klimaat/broeikasgassen?. Uiteindelijk is tijdens het eerste kabinet balkenende tijdens de deregulering opgeschreven dat STEK opgeheven moest worden. Ze dachten dat STEK ook binnen het bedrijfsleven niet meer gewenst was. STEK moest koste wat kost van de agenda. Gelukkig is dat nooit gebeurd en is de

tendens nu weer dat STEK moet blijven zodat dit kan doorvloeien naar de Europese regelgeving. Een wet moet wel blijven worden onderhouden. 36. Verwacht u dat HFK’s uitgefaseerd zullen gaan worden in de koelsector? Zo ja, op welke termijn? Nederland zal de HFK’s nooit zelf afschaffen. Nederland blijft liever in lijn met de EUregelgeving. Als de F-gas verordening een politiek succes wordt zal het nog wel een tijd duren voordat deze wordt afgeschaft. 37. Is het al dan niet gebruiken van HFK’s een onderwerp van discussie binnen uw bedrijf(stak)? Hoe is de deal met Greenpeace tot stand gekomen? Dat is begonnen bij de olympische spelen in 2000 in Sydney. Australie had een goed milieuprogramma en Greenpeace had een campagne green olympics dirty sponsors gemaakt. Deze lag klaar om gelanceerd te worden. Coca-cola, unilever en mcDonalds waren deze sponsors. Onder druk van deze dreigende campagne is toen een convenant gesloten dat de bedrijven een plan zouden maken om HFK’s op termijn uit te faseren. Voor deelvraag 3 38. Welke alternatieven voor HFK’s kent u? Ammonia, Co2, Koolwaterstoffen, Water, ‘Fluid H’, Absorptiekoeling, Sirling, Aircycle, Thermoakoestisch, Magnetocalorisch, Thermo-electrisch 39. Welke van deze alternatieven beschouwt u als volwassen Ammoniak, is volwassen vnl in grote installaties CO2 is voor bepaalde toepassingen bruikbaar. Koolwaterstoffen zijn volwassen op kleine installaties. 40. Verwacht u dat er binnen nu en vijf jaar meer alternatieven bruikbaar worden? 41. Welke? Alle alternatieven zullen stapje voor stapje dichterbij een toepassing komen. Ik verwacht niet dat er ooit een (1) alternatief voor alle toepassingen komt. Het blijft een complex scala aan verschillende alternatieven, afhankelijk van het soort toepassing. 42. Waren de mogelijkheden voor alternatieven 15 jaar geleden anders dan nu ? De HFK’s waren het alternatief. Er was nog niks bekend over de nadelige effecten van deze oplossing. Er is door de Chemische industrie nog nooit zoveel geld in onderzoek gestoken als om een alternatief voor CFK’s te vinden, met tot nu toe alleen koudemiddelen op basis van HFK’s. 43. Welke zaken wegen het zwaarst bij uw keuze voor een bepaalde techniek? Orden op volgorde van belangrijk naar onbelangrijk Aankoopkosten = Installatiekosten 1 Energieverbruik 4 Onderhoudskosten 4 Bedrijfszekerheid 3 Eisen van moederbedrijf 6 (heel soms is dit 1) Veiligheid 2 Milieuvriendelijkheid 5 … 44. Welke bronnen van informatie gebruikt u om tot uw keuze te komen? Noem de 3 belangrijkste Aanbieders en adviseurs 45. Ziet u uw bedrijf(stak) als milieubewust, waar uit zich dat in? Voor grote bedrijven staat de licence to operate hoog op de agenda. In die zin wordt er wel over nagedacht. Een bedrijf wil echter natuurlijk voornamelijk winst maken, dus in hoeverre deze licence to operate werkelijk milieubewustheid inhoudt is de vraag. Als de consument/publieke opinie milieubewustheid van een groot bedrijf gaat meewegen bij aankoopbeslissingen en brand image, dan wordt dit wel belangrijk Er zijn verschillende manieren om de uitstoot van HFK’s te beperken. Met de keuze voor het STEK systeem is er gekozen voor de optie: voorkomen van lekkages d.m.v. controle. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s

Denkt u dat er beperkingen zijn om de regel in te voeren in andere landen? 51. In welke landen wel/ niet en waarom? In veel landen zijn er nog helemaal geen regels: griekenland, spanje, portugal en frankrijk. Polen heeft de STEK regelgeving geadopteerd! 52. Zal de EU regelgeving, naar uw verwachting, effectief zijn? Waarom (niet)? De regeling zal zeker effect hebben, maar wat is het gewenste effect? Stel je zou zeggen lekkage van 5% in 2011 (gemiddeld over hele EU) dan is het niet haalbaar. Lekkage tussen 10-20% wel.

B9 Interview with STEK Bedrijf: STEK Volgnummer: 07 interview schema Voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? Ik hou mij voornamelijk bezig met de certificerende instanties. Dus de erkenningkant. Minder aan de kant van de opleiding. 2. Hoe lang werkt u al voor dit bedrijf? Sinds 2000 Huidige stand van zaken: Eerst technische voorwaarden in RLK Toen de PED kwam, vervielen de installatietechnische bepalingen in de RLK en wij controleren niet op de PED. Verder moet een bedrijf in de stationaire sector nog steeds STEK-erkent zijn en aan de voorwaarden voldoen. De automotive branche hoeft sinds 4 juli als bedrijf niet meer erkent te zijn, de monteurs moeten nog wel een diploma hebben. In Brussel is de commissie bezig bezig met de F-gas verordening, dit gaat wat langzamer dan verwacht, maar men denkt nog wel op tijd klaar te zijn (4 juli 2008, moet het af zijn). Er is dus nog geen helderheid over de toekomst van STEK, dat is jammer. 3. Klopt dit schema naar uw mening, zo nee, waarom niet? STEK controleert alleen de installateur, niet de verkoper en de distributeur. Verder controleert VROM inspectie natuurlijk iedereen. 5. Welke actor heeft het meeste invloed op het systeem? Deze vraag is tweeledig: welke actor is het meest in de mogelijkheid om het beleid te veranderen? Welke actor heeft het meeste invloed op uw manier van werken? Afhankelijk van het belang zal de belangenorganisatie proberen te lobbyen. Ook STEK probeert de belangen van de branche om de emissiedoelstellingen te halen zo goed mogelijk te behartigen. Voor deelvraag 2 Ik wil nu wat dieper in gaan op de STEK regeling en de invoering daarvan. Het STEK systeem wordt nu zo’n jaar of 15 gebruikt in Nederland. Is er een reductiedoel gesteld toen de regelgeving ingevoerd werd? Nee, niet echt er moest een zorgvuldig en degelijk plan komen vanuit de branche, anders kwam er wetgeving. Later is er vanuit VROM in de RLK wel een beleidsstreven geformuleerd waar 1% emissie als beleidsdoel is gesteld. Houden mensen zich aan de regeling? 80% van de controles is positief. 20% dus niet, dit zijn vaak fouten in werkbonnen, werkvoorschriften en koudemiddelenregistratie. Veel van deze dingen zijn administratief van aard en kunnen makkelijk opgelost worden. 10 jaar geleden was 60/65% van de mensen in een keer door de controle gekomen. 6. Wat is het beeld dat u nu heeft van de acceptatie van de STEK regelgeving? Nu is men positief over STEK 7. Hoe was dat tijdens introductie? Vernieuwing zorgt per definitie voor weerstand. Ze werden geconfronteerd met eisen die er eerst niet waren, ze moesten een opleiding/investering/administratie. 8. Als dit anders is: Waarom en wanneer is dit veranderd? Als het hetzelfde is: Waarom is het niet veranderd? Toen de regeling ging werken bleek het toch ook veel op te leveren. Vaste controles=inkomsten. Betere installatie. Minder claims bij de producent, koelingen gingen minder vaak stuk. Ik wil graag nog wat dieper op de STEK regeling in gaan

9. Wat zijn de drie belangrijkste voordelen van de STEK regeling? - Emissiereductie - Betere installatie - De hele keten is beter geworden, minder claims voor producent,, installateur meer werk, gebruiker betrouwbaardere installatie 10. Wat zijn de drie belangrijkste nadelen van de STEK regeling? - Eerste investering - Enige administratieve druk 10b. Hoe belangrijk is de enforcement vanuit VROM voor de effectiviteit van STEK? Die heel belangrijk, STEK mag alleen bedrijven controleren die erkent zijn of erkenning aanvragen. VROM-inspectie mag iedereen controleren en heeft meer bevoegdheden. We werken goed met VROM-inspectie samen, zegt een bedrijf zijn erkenning op, dan geven we dat door en kan VROM-inspectie controleren of dat wel terecht was. 10c Zijn daar veranderingen opgetreden de laatste jaren? In het begin was de enforcement streng. Nu is er minimaal 1x per jaar een gesprek tussen VROM-inspectie, STEK en de certificerende instanties om het controlebeleid door te spreken zodat het zoveel mogelijk geharmoniseerd wordt en het beleid voor de branche duidelijk is. VROM-inspectie stelt elk jaar een aantal speerpunten vast en de laatste jaren was stationaire koeling geen speerpunt omdat men zich over het algemeen goed aan de regels houdt. 10d. Er is een tijdje onzekerheid geweest over het voortzetten van de STEK regelgeving, wat voor gevolgen heeft dat (gehad)? Vooral in de grensstreken zijn er wel erkende bedrijven die last hebben van de onzekerheid en de verminderde inspectie door VROM-inspectie. Buitenlandse bedrijven of niet erkende bedrijven kunnen dan voor lagere prijzen de producten aanbieden. Dat is vervelend. Er volgen nu een aantal stellingen over het STEK-systeem. 0 = Helemaal oneens 5 = Helemaal mee eens ? = geen mening/nvt (antwoordblad) 11. Zonder STEK gebeurde onderhoud veel minder 5 12. Sinds de invoering van STEK zijn koelsystemen betrouwbaarder 5 geworden. 13. HFK’s zouden helemaal verboden moeten worden 14. Sinds STEK is ingevoerd zijn de kosten voor onderhoud lager geworden 15. STEK is er een voorbeeld van dat bedrijven niet vertrouwd worden 1 door de overheid. 16. Dan heb ik nu nog een lijst met stellingen over het succes van STEK. Ik wil u nu vragen om deze stellingen op volgorde van belangrijk naar onbelangrijk te leggen. (geef papier). 33. STEK is een succes geworden doordat: 1- De brancheorganisatie de regelgeving steunt 1- STEK vanuit de branche zelf is opgezet 4- Controles met vaststaande regelmaat plaatsvinden 7- Controles van tevoren worden aangekondigd 6- Kosten relatief laag zijn 5- De regels duidelijk zijn -- Er anders strengere regels waren opgelegd door de overheid -- De overheid niet direct betrokken is bij de controles 3- Het bedrijfsrisico van verliezen van de vergunning groot is 2- STEK een positief effect heeft op de werking van de installaties - Anders, in de loop der jaren is er een structuur ontstaan waarbij we met zijn allen aan een beter systeem gewerkt hebben, de communicatie onderling is erg goed 34. Voor welke actor is de invoering van het STEK-systeem het ingrijpendst geweest? De installateur 35. Zijn er tijdens de invoering van STEK dingen misgegaan, m.a.w. had de invoering beter of effectiever gekund, zo ja welke? Het zal de gebruikelijke opstartproblemen hebben gehad. 36. Verwacht u dat HFK’s uitgefaseerd zullen gaan worden in de koelsector? Zo ja, op welke termijn? Op termijn wel, mits er goede alternatieven zijn. Er zijn verschillende manieren om de uitstoot van HFK’s te beperken. Met de keuze voor het STEK systeem is er gekozen voor de optie: voorkomen van lekkages d.m.v. controle. We hebben het tot nu toe voornamelijk over de Nederlandse situatie gehad. De regeling gaat nu ook in Europa, in een iets andere vorm, ingevoerd worden. 46. Denkt u dat er beperkingen zijn om de regel in te voeren in andere landen? 47. In welke landen wel/ niet en waarom? In Nederland werkt het ‘meepraten’ de branche er in betrekken heel goed, in andere landen is dat minder bekend. 48. Zal de EU regelgeving, naar uw verwachting, effectief zijn? Waarom (niet)? B10 Interview with the VROM-inspectorate Volgnummer: 10 interview schema voor deelvraag 1 Voor deelvraag 1 1. Wat is uw functie binnen uw bedrijf? Adjunct inspecteur. Regio Limburg en Noord-Brabant. Twee soorten toezicht 1ste lijns en 2de lijns toezicht. Tweede lijns toezicht is toezicht op instanties en andere overheden. De eerste lijns toezicht richt zich op bedrijven. Daar richt Nico Peeters zich op. VROM-inspectie houdt toezicht op algemene regels die voor iedereen gelden. CFK-regelgeving is daar er een van. Er moeten bedrijven bezocht worden, maar dit gebeurt vaak te weinig, doordat er toch sprake is van behoorlijke bureaucratie. 2. Hoe lang werkt u al voor dit bedrijf? heb niet gevraagd sinds wanneer, maar in iedergeval sinds het begin van STEK 3. Het klopt wel wat VROM-inspectie doet verticaal toezicht. STEK doet horizontaal toezicht, de markt houdt zichzelf in de gaten. Beide vormen van toezicht zijn noodzakelijk. Bij STEK gaat de controle voornamelijk vanuit de installateur, deze moet goed zijn. Bij VROM-inspectie wordt vanuit de gebruiker gekeken, heeft die de zaakjes goed voor elkaar. Op deze manier kunnen misstappen beter ontdekt worden. Het toezicht van STEK is wel heel anders dan dat van VROM-inspectie, STEK heeft er namelijk belang bij om mensen lid te houden van STEK. Ze hebben ook minder mogelijkheden om te ‘straffen’. Bij de supermarkten wordt vaak met contracten gewerkt omdat de installateur meer moet bieden dan alleen het bouwen van een koeling. Ieder 6-7jaar moet er een nieuwe look komen in de winkel en ook de koelinstallatie hoort daarbij. De installateur moet dus ook mee willen

vernieuwen. Ik heb het beeld dat supermarktketens het beter voor elkaar hebben dan de individuele kruidenier. Voor deelvraag 2 3. Was er een kwantitatief doel gesteld bij de invoering van de STEK-regelgeving, waarom wel/niet. Ja, er is een beleidsdoel gesteld. Toen de regeling werd ingevoerd warem de lekverliezen +30%. Er was eerst een deeldoelstelling van 1-5% lekkage na … jaar. Uiteindelijk moesten de lekverliezen teruggedrongen kunnen worden naar 0,1-1%. De installateur had er bijna belang bij om de lekverliezen in leven te houden, dat zorgde voor gegarandeerd onderhoud. Bovendien was er weinig ‘awareness’ van de schadelijke gevolgen van Freon gebruik. 4. Wat is het beeld dat u nu heeft van de acceptatie van de STEK regelgeving? Tot voor enige jaren was ik zeer actief betrokken bij de handhaving van de "CFK-regelgeving" en was er bij installateurs én gebruikers uiteindelijk sprake van een goede tot zeer goede acceptatie van de regelgeving. De acceptatie op dit moment kan ik niet echt peilen omdat er op dit moment te weinig aandacht is vanuit de VROM-inspectie voor deze regeling. 5. Hoe was dat tijdens introductie, wat waren de grootste bezwaren? Tijdens de introductie van de STEK-regelgeving vonden de supermarkten en installateurs hun vrijheid ingeperkt en ook vonden ze dat er teveel administratie was. 6. Als dit anders is: Waarom en wanneer is dit veranderd? In 2-3 jaar veranderde weerstand in waardering voor de regelgeving. Voor de installateurs ontstond nieuw werk. Ze moesten controleren en in logboeken geschreven. Dus de installateurs die netjes volgens de regels werkten en een diploma hadden kregen meer inkomsten. De Nadruk kwam op preventie te liggen. Er was minder uitval en meer werk. De kosten kwamen meer naar voren te liggen, maar de bedrijfszerkeheid nam toe. Het werkte ook als marktbescherming. Je moest een diploma hebben en zonder diploma had je niks te zoeken op de markt. Mensen gingen ook tips geven aan de VROM-inspectie als er bedrijven waren die zich niet aan de regels hielden. De relatie tussen VROM-inspectie en de koeltechniek wereld was goed. 7. Wat zijn de drie belangrijkste voordelen van de STEK regeling? - Terugdringen van emissies - Kwaliteitsslag voor de sector - Protectionisme van de markt 8. Wat zijn de drie belangrijkste nadelen van de STEK regeling? - Protectionisme STEK als monopoly (geen/minder vrije marktwerking) - Onderdelen waren te gedetailleerd, veel administratie. Dit kwam ten dele doordat de branche mocht meedenken en er dus ook allerlei technische specificaties in kwamen - Geen standaardisatie van het logboek, dit zou eigenlijk wel moeten. 9. Hoe belangrijk is de enforcement vanuit VROM(inspectie) voor de effectiviteit van STEK? Heel belangrijk STEK heeft er belang bij om bedrijven binnen de boot te houden. Ze hadden ook niet veel mogelijkheden om te ‘bestraffen’. VROM-inspectie had betere mogelijkheden tot sancties. 9b. Wordt de regeling over het algemeen goed nageleefd? 3-4 jaar terug was er behoorlijk naleefgedrag 10. Zijn daar veranderingen opgetreden de laatste jaren? Wellicht dat het de laatste jaren minder is geworden 10b. Kunt u een inschatting geven van het lekpercentage in de commerciele koelsector 3-5% 11. Er is binnen de sector onzekerheid over het voortzetten van de STEK regelgeving, heeft dat invloed (gehad) op de naleving van de regelgeving? Er heerst wel de mening dat er bedrijven zijn die het minder nauw nemen met de regelgeving. Er zijn ook mensen die hun lidmaatschap hebben opgezegd. VROM-inspectie zal hier ook niet op gaan keuren, een natuurlijk persoon moet een diploma hebben zo staat in de nieuwe F-gas verordening. Het zou dus flauw zijn een wet te gaan controleren waarvan iedereen al weet dat deze afgeschaft gaat worden. Er volgen nu een aantal stellingen over het STEK-systeeem.

Over het algemeen heeft men de mening dat STEK de emissies van HFK’s heeft verminderd en dat het systeem een succes is. 29. Wat zijn volgens u de belangrijkste redenen voor dit succes? - Voor iedereen was er hetzelfde doel: lekkage verminderen. Dit doel was voor iedereen belangrijk, je kon er niet tegen zijn om het gat in de ozonlaag te beschermen. - Preventie werkt, dat is ook voor iedereen winst - Iedereen moest aan dezelfde regels voldoen. De regels waren voor iedereen hetzelfde Daarnaast was het een unieke regelgeving, het was voor het eerst dat zo’n soort regelgeving zo wereldwijd aandacht kreeg. De basis lag in Montreal, EU, NL Industrie vroegtijdig betrokken geraakt Dan heb ik nu nog een lijst met stellingen over het succes van STEK. Ik wil u nu vragen om deze stellingen op volgorde van belangrijk naar onbelangrijk te leggen. 30. Er zijn nog andere manieren om de uitstoot van HFK’s te beperken: - Gebruik van alternatieven voor HFK’s - Streven naar zo laag mogelijke lading van het systeem - Streven naar zo laag mogelijke koelvraag - Verhogen van de lekdichtheid van het systeem d.m.v. technische maatregelen - Voorkomen van lekkage door controle Al deze methodes hebben zo hun voor en nadelen.
