Souběžný dovoz léčivých přípravků • Souběžné obchodování s produkty je v rámci vnitřního trhu zákonnou formou obchodu. • Obchodování je „souběžné“ v tom smyslu, že zahrnuje produkty, které jsou v zásadě podobné produktům uváděným na trh prostřednictvím distribučních sítí výrobců nebo původních dodavatelů, ale probíhá mimo (často vedle) těchto sítí. • K souběžnému obchodu dochází v důsledku odchylek cen farmaceutických přípravků • Souběžný obchod v zásadě vytváří zdravou soutěž a vede ke snižování cen pro spotřebitele a je přímým důsledkem vývoje vnitřního trhu, který zaručuje volný pohyb zboží.

FMD: Mandatory Safety Features In principle, all prescription medicines will carry safety features, unless included on a ‘white list’ of products seen as at low risk of falsification OTC medicines are excluded from the directive unless included on a ‘black list’ of products seen as at high risk By implication, we can assume that virtually all PD products will carry mandatory safety features Two types: Unique identifier & tamper evidence device Wholesalers, PD and pharmacists use UI for authentication that medicine is genuine. Mandatory verification. Precise technical details of safety features not defined in the Directive, but are to be determined later by so-called ‘delegated acts’ yet to be developed by the Commission
Delegated Act favors stakeholder model In January 2014, the Commission released initial ideas for cornerstones of the coding system: The Commission will propose the following cost-effective options: 1.The composition, format and carrier of the unique identifier will be fully harmonised across the EU. The unique identifier will be placed in a 2D barcode and contain the manufacturer code, a serialisation number, a national reimbursement number (if present), the batch number and the expiry date. 2.Medicine authenticity will be guaranteed by an end-to-end verification system supplemented by risk-based verifications by wholesale distributors. Medicines will be systematically verified before being dispensed to patients. Medicines at higher risk of falsification (returns or medicines not being distributed directly by manufacturers) will be additionally checked at wholesaler level. 3.The repository containing the unique identifiers will be set up and managed by stakeholders. National competent authorities will be able to access and supervise the database.

Repackaging after the FMD Prior to repackaging, the re-packager must verify that the product to be repackaged is authentic and has not been tampered with Re-packagers, as holders of manufacturing authorisations, can can partly - or fully - remove, or cover up mandatory safety features, as long as they replace them with ‘equivalent’ safety features, and without opening the immediate packaging Safety features applied by PD must be ‘equivalent’ to those applied by originators ‘Equivalent’ = equally efficient in identifying, authenticating and preventing tampering with medicinal products Must also comply with technical specifications yet to be established in a delegated act Replacement of safety features must be carried out under GMP conditions, and subject to inspection by competent authorities Labelling changes on packs require variation to license: time to market
